Attached for the Council's review and approval are the minutes for the Town Council meetings held on Monday, September 12, and Monday, September 26, 2016. Please call Jennie Berry with any grammatical/ spelling changes prior to the meeting. Discussion at Monday evening's meeting should be limited only to substantive changes.
LEGAL AUTHORITY: RSA 91-A:2 (II) specifies what must be contained in minutes of public meetings: "Minutes of all such meetings, including names of members, persons appearing before the bodies or agencies, and a brief description of the subject matter discussed and final decisions, shall be promptly recorded and open to public inspection not more than 5 business days after the public meeting, except as provided in RSA 91-A:6, and shall be treated as permanent records of any body or agency, or any subordinate body thereof, without exception."

SHALL THE TOWN COUNCIL APPOINT JOAN LAWSON, 21 SURREY LANE, AS A REGULAR MEMBER TO THE ZONING BOARD OF ADJUSTMENT?
Attached for the Council's information and consideration is an application for board appointment submitted by Joan Lawson, 21 Surrey Lane, requesting appointment as a regular member to the Zoning Board of Adjustment. There is currently one regular member vacancy, created by the resignation of Henry Smith in September 2016, with a term expiration of April 30, 2019. There are also two alternate member vacancies with term expirations of April 30, 2018 and 2019.
Ms. Lawson has met with ZBA Chair Sean Starkey and has attended at least one meeting of board. Attached is correspondence from Mr. Starkey endorsing Ms. Lawson's appointment
LEGAL AUTHORITY: Section 11.5 "Vacancies in Elected or Appointed Office" states that, "Unless otherwise specified in this Charter, in the event of a vacancy in an elected or appointed office, board, commission or committee of the town, the Town Council shall fill that vacancy by appointment, such appointment to continue until the next town election for elected positions or the remainder of a person's term if an appointed position."

Attached for the Council's information and consideration is an application for board appointment submitted by Micah Warnock, 45 Woodman Road, requesting appointment to the Zoning Board of Adjustment. There is currently one regular member vacancy, created by the resignation of Henry Smith in September 2016, with a term expiration of April 30, 2019. There are also two alternate member vacancies with term expirations of April 30, 2018 and 2019.
Mr. Warnock has met with ZBA Chair Sean Starkey and. Attached is correspondence from Mr. Starkey endorsing Mr. Warnock's appointment. As noted in Mr. Starkey's correspondence, Mr. Warnock has not been able to attend a ZBA meeting because the board has not had a meeting since August 2016 and may not meet again in November 2016. Mr. Warnock has been advised to watch the most recent ZBA meeting online to get a sense of the board's work and purpose.

Mr. Warnock demonstrates the dedication and background to be a valuable member to the board. SHALL THE TOWN COUNCIL MOVE ALTERNATE MEMBER ROBERT BROWN TO FILL THE UNEXPIRED REGULAR MEMBER TERM OF STEPHEN ROBERTS ON THE PLANNING BOARD, WITH SAID TERM TO EXPIRE APRIL 30, 2019?
On October 10, 2016, Stephen Roberts gave notification of his resignation as a regular member on the Planning Board (attached).
Attached for the Council's information and review is an application and request from Robert Brown to be moved from his current alternate member position on the Planning Board to fill the regular member vacancy of Stephen Roberts.
The Planning Board concurs with Mr. Brown's request (attached) and recommends that the Council move him to fill the unexpired regular member vacancy of Stephen Roberts, with said term to expire April 30, 2019.

The Town's expenditures as of September 30, 2016 show a total expenditure of $10,246,044 or 72.7% of the total approved budget amount of $14,101,467. To compare, the amount expended as of September 30, 2015 was 74.7%.
The Business Office is reviewing the departmental budgets on a monthly basis and will meet with an individual Department Head as necessary to discuss any overages. At this point in time there are no areas of concern to be reported.

Nine-month Budget Status
In reviewing the status of the police operational budget for the first¾ of 2016 where many lines should reflect approximately 75% expenditure, I noted the following and wanted to update you on the current operating budget's expenditures as we strive to meet our goals.
At this juncture the overall police budget is at 71% expended, which is outstanding and reflective of our efforts to balance all accounts. However there will be emerging challenges with a number of extremely busy weekends approaching including Halloween that will negatively impact the overtime line. Unfortunately the overtime line is already over-budget due to a number of challenges that occurred this summer with the lack of personnel due to military deployments (two officers), paternity leave, as well as two vacancies due to resignations. While noteworthy efforts were made during the summer months to keep overtime to a minimum, there were still significant vacancies in patrol shift schedules that required overtime expenditures. Our new hires of Kevin Abbott and Kathryn Callahan are at lower step pay grades which have assisted in reducing the impact upon the entire budget by demonstrating 67% expenditure in the full-time wage account. As expected at this point in the budget year there are a number of lines over expended. I have provided a brief overview associated with the overage in each line:

Overtime as noted is largely due to unexpected resignations of Jen Misek and Nick Glowacki as well as military and paternity leave, all of which occurred simultaneously leaving 25% of the agency unavailable for work. Training exceeded due to the opportunity to have an officer attend a rarely occurring class. This account will stabilize. Medical Testing is over budget due to the need to conduct two hiring processes. There will be no further expenditures from this account. The Ad/Legal account is over the budgeted due to the unexpected resignations of Officers Jen Misek and Nick Glowacki.

Work-study wages are off-set by funds added to the Community Policing line to pay for an intern to manage the survey distributed this summer. Contracted Services exceeded expectations due to Cinco de Mayo as well as the need to compensate Strafford County prisoner transportation services. School Resource exceeded due to the increase in costs for Freshman Orientation
