MEETING PROTOCOL AND STANDARDS OF CONDUCT

Public Participation

Public comment is encouraged and will be listed as an agenda item at every regular Board meeting.

Each individual wishing to be heard during the public comment period will be given up to three (3) minutes to make a comment.

The public comment period will not be used to make political endorsements or for political campaign purposes.

Questions from the Board will be for clarification purposes only. Public comment will not be used as a time for problem solving or reacting to comments made but, rather, for listening to the comments of citizens without taking any formal action.

The Board may direct the Town Administrator to provide information requested by a speaker during the public comment period.

Speakers are not allowed to make belligerent, accusatory, impertinent, slanderous, threatening, abusive, or disparaging comments.

The Mayor may elect to defer public comment on a specific issue that appears on the regular agenda until that specific item is addressed.

The Mayor may call for order when sidebar conversations occur in the audience. Those conversations are distracting from the Board addressing the topics at hand.

Members of the public who do not follow proper conduct after a warning in a public meeting may be barred from further participation at that meeting or removed from the Board Chambers pursuant to the Elizabeth Municipal Code and Colorado Revised Statutes.

April 14, 2020

CALL TO ORDER

The Regular Meeting of the Board of Trustees of the Town of Elizabeth was called to order on

Tuesday, April 14, 2020, at 7:07 pm by Mayor Megan Vasquez.

ROLL CALL

Present by virtual meeting were: Mayor Megan Vasquez, Mayor Pro Tem Angela Ternus,

Trustees Steve Gaither, Loren Einspahr, Tammy Payne, Ron Weaver, and Jason Weiss. Mayor

Vasquez stated there was a quorum to conduct business.

Also present were Town Administrator Matt Cohrs, Assistant Town Administrator Grace

Erickson, Town Clerk Michelle Oeser, Police Chief Stephen Hasler, Public Works Director Mike

DeVol, and Town Attorney Corey Hoffmann.

Motion by Mayor Vasquez, seconded by Trustee Gaither to approve the consent agenda with

the change from regular meeting to special meeting.

The roll call vote of those Trustees present was 6 in favor and 1 opposed. Trustees Weiss

opposed approval. Motion carried.

Town Administrator –

The Town is partnering with Elizabeth and Rattlesnake Fire Protection Districts to

distribute colored paper to the public to place in their windows for notification purposes

New Board laptops have been purchased

Mayor Pro Tem Ternus stated concerns she has regarding communication about the

paving project to citizens that are going to be affected by the project

Trustee Weiss stated he has concerns with the purchase of laptops at this time

Town Administrator Cohrs responded to both concerns

Mayor Vasquez asked for an update on the County Road 13 realignment project

Town Administrator Cohrs gave an update on the realignment project

Assistant Town Administrator –

Dairy Queen and Countryside Village are moving forward

Lula properties will be starting construction soon

Governor Polis will announce how the stay at home order may be lifted prior to April 26,

2020 deadline

There are 16 confirmed COVID-19 cases in Elbert County

Trustee Weiss stated he sees an overreach by the Town Administration and Police

Department

Trustee Gaither stated he would like to see the money usually pledged to the Stampede

to be dispersed to the fire department, police department, and food bank

Discussion followed on how to distribute the money to best help the community

STUDENT LIAISON REPORT

Students have been doing distance learning for three weeks

Some students do not have laptops or Wi-Fi, which has caused them difficulties

Kids being at home is causing issues with no social interaction

Student Liaison Colton Arciniaga asked that people think about what the students

may be going through. He stated now is the time to come together and work

together

Mayor Pro Tem Ternus asked how distance learning is affecting grades

Trustee Weiss congratulated Colton on his accomplishments

Mayor Vasquez asked if Colton knew if he had received the Boettcher Foundation

Scholarship

Student Liaison Arciniaga said he did receive the scholarship

Management Team April 28, 2020 Management Team - Monitoring Report Administration/Town Administrator – Matt Cohrs Work on the town trail continues. Concrete pouring has started on the north side of the trail at Evans Park going south to Running Creek. High water levels slowed down work on the undercrossing portion of the trail where a footbridge goes over Running Creek then the trail goes under SH 86 (Kiowa), but with the good weather last week this portion is nearing completion. Grading along the floodplain going south is also underway. As part of the street paving project, staff has been working with the design team at Core Engineering on the layout for the mail kiosks at CR 136 and Pine Ridge. This includes parking with the mail kiosks adjacent for ease of access by residents, as well as allowing Public Works to plow the lot and areas in front of the mail kiosks to ensure access in the Winter. For the homes on the north side of SH 86, the layout for the mail kiosks where Elbert Street dead ends into a cul de sac is also being completed. Community/ Economic Development – Grace Erickson The Public Hearings on Legacy Village Subdivision Sketch and Preliminary Plans have been cancelled. An application for the sketch and preliminary plans is still active. Public hearings would potentially be rescheduled in the future per the notice requirements outlined in Chapter 16 of the municipal code. DOLA is looking into providing a virtual Planning Commission training that would be availible live as a webinar but also recorded and posted. They are still working out the kinks, but this virtual training would replace the training that was intended to be live in April. I will keep everyone posted and will forward the training information as soon as it becomes available. Town Clerk – Michelle Oeser Election have been completed, results have been filed with both the Elbert County Clerk and Recorder and with the Department of Local Affairs (DOLA). Result have been published on the town website and in the Ranchland News. Staff has done a good job of keeping up with their daily workload, communicating and adjusting to working from home and at the office. Court will be held on May 7, 2020. A plan is being designed by the prosecutor, judge, court staff and the police department to have court run smoothly and securely. The docket is small with cases having been moved to June, so it is a good time to implement new processes. In February four special event permit applications were submitted to the town. Special event applications go to the Board of Trustees as a public hearing. All four of these applications were originally scheduled to be heard on the March 24, 2020. These items were never placed on the agenda due to the COVID pandemic and the Board moving to virtual meetings. Three of these hearings will be reposted and heard at the May 26, 2020 Regular Board of Trustees meeting, the fourth application will be heard at the August 11, 2020 Regular Board of Trustees meeting. The Elizabeth Police Department responded to a disturbance at Big R Stores. The situation was resolved

Following a report of a suicidal subject, a young male was transported to Parker Adventist Hospital on a

A local businessman reported a possible theft of a package from his place of business, after a failed

SUBJECT: Public Works Monitoring Report

The Town of Elizabeth Public Works continues to be operating full time with full staff while practicing social distancing

from each other and the public to remain safe and healthy.

1. Public Works has CLOSED Larmer and Bandt Park playgrounds during the COVID-19 pandemic. (Open

space is still usable).

2. Public Works completed the removal of the Larmer Park (W. Elm St. and S. Tabor St.) existing playground

equipment due to safety issues and being out-dated. The dirt work has been completed and will be receiving

a concrete border to surround the New playground equipment and the rubberized safety material that is

replacing the old existing wood mulch. Larmer Park will receive 4 new colorful picnic benches and trash bins

with lids. The color scheme includes bright blue, yellow, tan, green and red. Larmer Park is a park that is

considered infant through age 5 (toddlers). Public Works will be removing 1 very large Elm/Cottonwood tree

that was damaged during a lightning storm years ago and deemed unsafe and unhealthy. The removal of

this tree will allow for a more uniform storm drainage flow whereas it created a fully shaded semi wet area.

Public Works anticipates the Park completed the end of May 2020 depending on weather and other duties.

3. Public Works is working with JVA Engineering for upgrading Gold Creek Lift Station Pump sizing for

Ritoro/Gold Creek Filings 2 and 3 build out.

4. Public Works continues to work with JVA Engineering and HRS Water Engineering for the drilling of the

New Arapahoe and Denver acquifer wells within the Ritoro/Gold Creek filing 2 property.

5. Public Works continues to work with JVA Engineering to build and equip the New Well house for the water

treatment facility, tank distribution, and Supervisory Control and Data Acquisition (SCADA) communications

systems.

6. County Rd. 13 Realignment Project is on schedule and moving forward with all the Utilities (Century Link,

Black Hills Energy, IREA, ComCast, and Future Fiber Optic lines) relocations and the New Sanitary Sewer

line installation on the West side of the shell station. The New Sanitary Sewer service line has been installed

and passed pressure, lamp and deflection inspection per the Town of Elizabeth Water and Sewer

Standards. The New 12-inch Water Line tie-in is scheduled for Friday night May 1st that will allow the

addition of 3 New Water Main Valves, extend Main line out of Hwy 86 and NOT disrupt businesses in the

area. This will allow the repaving and the reopening of Elizabeth St. on schedule May 30. Public Works and

CORE Engineering are completing daily inspections of installations.

7. Public Works has completed the Water Storage Tank cleaning, inspection and disinfection during the month

of April per CDPHE Tank Rules 100 Compliance schedule. Inspection reports will be relayed at a later date.

8. Public Works has tentatively placed Town Clean Up Day on hold during the COVID-19 pandemic. This will

be revisited as things settle down.

9. Public Works has placed the Paint Round Up scheduled event on hold during the COVID-19 pandemic. The

tentative new date is for September or October 2020.

10. Public Works will NOT be conducting the High School Student Volunteer Clean-Up as students are out of

school during COVID-19.

11. Public Works will begin the grading and watering for dust suppression on County Rd. 13 South of County

Rd. 136 for the summer season. Public Works believes this will be required less over the next two months

due to no school and less commuter traffic.

12. Street Sweeping will be conducted once the COVID-19 pandemic subsides as to not create excess dust for

the public and staff.

13. The CDOT Hwy 86 Cross Walk/Street light signage has been completed at Hwy 86/Main St. and Hwy 86

and Elbert St. Hwy 86 and Banner St. is 75% complete. These cross-walk areas have street lighting and

cross walk push button activated flashing lights that will help ensure the safety of pedestrians crossing Hwy

86.

SUMMARY

The Elizabeth Municipal Code provides for the appointment of officers of the town by the Board of Trustees. The Code calls for the appointment of officers of the town at the first meeting of a new Board. There are six positions that are currently filled and up for reappointment by the Board of Trustees. SUMMARY

Resolution 20R15 would extend the declaration of Local Disaster Emergency until May 12, 2020. The Town of Elizabeth previously issued an order declaring a Local Disaster Emergency in and for the Town of Elizabeth on March 17, 2020 in response to the COVID-19 pandemic. It was extended at the Board of Trustee meetings on March 24th, March 31st, and April 14th and needs to be extended again. This declaration follows the weekly declarations released by Elbert County starting on March 16th through April 20th, 2020. The declaration allows the Town to be furnished aid and assistance through the state and federal governments. STAFF RECOMMENDATION Staff recommends approval of Resolution 20R15, a Resolution Consenting to and Extending the Order Declaring a Local Disaster Emergency in and for the Town of Elizabeth, Colorado until May 12, 2020. RESOLUTION 20R-15

A RESOLUTION CONSENTING TO AND EXTENDING THE ORDER

DELCARNG A LOCAL DISASTER EMERGENCY IN AND FOR THE

TOWN OF ELIZABETH, COLORADO

WHEREAS, the Colorado Disaster Emergency Act, C.R.S. § 24-33.5-701, et seq. (the

"Act"), provides procedures for statewide and local prevention of, preparation for, response to, and

recovery from disasters and emergencies;

WHEREAS, pursuant to the Act, an "emergency" is an unexpected event that places life or

property in danger and requires an immediate response through the use of state and community

resources and procedures, and an "emergency epidemic" is cases of an illness or condition,

communicable or noncommunicable, caused by bioterrorism, pandemic influenza, or novel and

highly fatal infectious agents or biological toxins;

WHEREAS, pursuant to C.R.S. § 24-33.5-709, a local disaster emergency may be declared

"only by the principal executive officer of a political subdivision," here, the Mayor;

WHEREAS, on March 17, 2020, the Mayor did issue an order declaring a local disaster;

WHEREAS, pursuant to C.R.S. § 24-33.5-709(1), on March 31st, 2020, the declaration of

a local emergency was continued or renewed for a periods of 14 days until April 28, 2020 by the

Elizabeth Board of Trustees;

WHEREAS, pursuant to C.R.S. § 24-33.5-709(1), the declaration of a local emergency

shall not be continued or renewed for a period in excess of 7 days except by or with the consent of

Board of Trustees;

WHEREAS, pursuant to C.R.S. § 24-33.5-709(1), any order declaring, continuing, or

terminating a local disaster emergency shall be given prompt and general publicity and shall be

filed promptly with the Town Clerk, the County Clerk and with the state office of emergency

management; and

WHEREAS, immediately after it was issued, the attached order was given prompt and

general publicity, was filed with the Town Clerk and the Elbert County Clerk and Recorder, and

it was submitted to the Colorado Office of Emergency Management.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE

TOWN OF ELIZABETH, COLORADO AS FOLLOWS:

Section 1. The Board of Trustees hereby consents to and supports the Order Declaring

a Local Disaster Emergency in and for the Town of Elizabeth, Colorado.

Section 2. The Board of Trustees hereby extends the Order Declaring a Local Disaster

Emergency in and for the Town of Elizabeth, Colorado until May 12, 2020, unless sooner

Section 3. This Resolution shall be given prompt and general publicity, filed with the

Town Clerk and the Elbert County Clerk and Recorder, and it shall be submitted to the Colorado

Office of Emergency Management

Call to Order: Christine Ware called the meeting to order at 8:30 a.m. Roll Call: Ms. Ware, Mike Hussey, Tim Miller, Tedd Lipka Agenda Changes: None Minutes: Mr. Hussey moved to approve the regular meeting minutes of December 12, 2019. Mr. Lipka seconded; all in favor. New business Discussion with The Elizabeth Brewing Company on 2020 Elizabeth Farmers Market

Emily Briggs from The Elizabeth Brewing Company was in attendance to discuss the 2020 Farmers Market with the Main Street Board. First market would start the week after the Stampede; last market would take place September 11th. Discussed the need for additional lighting, handicap porta potties, and shade, and electric hookups. Discussed produce vendors and artisans.

Discussion and possible action on establishment of posting place of regular meetings as Bulletin Board located at 151 South Banner Street

Establishing a regular posting place is required the first meeting of each year. Mr. Hussey motioned to establish a posting place of regular meetings as Bulletin Board located at 151 South Banner Street. Mr. Miller seconded; all in favor.

Staff Reports January 14th is the next quarterly report to the Board of Trustees. Christine Ware has stated she will be present to address the Board. On January 14th, Staff will place on the agenda for the Board of Trustees attendance to Dallas conference for two Main Street Board members. Staff is working with Lively Events to schedule a time to discuss the 2020 Wine in the Pines, Hops Fest, and the Mayor’s Tree Lighting events. Staff anticipates a discussion on the February agenda. Staff has a quarterly report due to DOLA on January 15th which addresses 4th quarter activity. Following the compilation of data for that report, Staff will start preparing the 2019 Annual Report for the Elizabeth Main Street Program. Ornament sales update We’ve sold 60 of the 100 ornaments ordered to the following businesses: The Carriage Shoppes, Mountain Man, Prickly Pear, and My Country House Boutique. Hard copies of the Old Town Plan were provided to the Board. Board Reports Adjourn: Ms. Ware adjourned the meeting at 9:44 a.m.
