French Creek Trail UpdateBoy Scout Mark Less, from Troop 158 in Kimberton, completed the last section of the French Creek Trail in December as a step to

earning his Eagle Scout badge. His project included clearing and blazing the section of the trail from Township Line Road and into the wooded area behind the Villas at French Creek. He constructed a walking bridge over a stream and three benches that overlook the French Creek.

With the completion of this section, the French Creek Trail is now 2 miles long from Township Line Road to Hares Hill Road. The new trailhead on Township Line Road serves as an additional parking area for trail users.

What Exactly Is A Right-of-Way?

A “right-of-way” provides for “the right to pass over property owned by another party” and is the basis for creating and maintaining roads in our communities. The right-of-way typically encompasses both the paved areas of a road for use by vehicles, called the “cartway,” plus strips of land along each side where shoulders, curbs, gutters, sidewalks or drainage swales exist. These strips of land that abut the paved road are called the “ultimate” right-of-way. The right-of-way between private property and the paved road is the owner’s to use for access to the driveway and placement of a mailbox. Care and maintenance of any plantings, sidewalks, driveway aprons and curbs in this area is the homeowner’s responsibility, but is also regulated by the township to keep it available for use by utilities or other public projects, including road widening.

Although many older neighborhoods are lined with trees between the curb and sidewalks; planting trees, installing large shrubs and fencing within the right-of-way is discouraged by the Township. These things would obstruct workers who may have to maintain utility lines, lay underground piping or even widen the road. If you have plantings within the right-of-way, prune tree branches so that they are at least 9 feet above sidewalks. Branches that overhang the streets should be at least 11 feet above them. Shrubbery must be trimmed back beyond the street and/or sidewalk. Vegetation should not obstruct the line of sight for motorists, safety signs, traffic signals or pedestrians.

Section 2326 of the Second Class Township Code prohibits obstructions and nuisances on public roadways, which includes portable recreation apparatus. These objects are a public safety issue and a liability. The owner of the object may be sued for any resulting injuries or damages. So, if you have a portable basketball hoop, hockey net, soccer goal or any other contraption in the street or along the sidewalk, it must be removed. These items should be located within your yard or driveway, and not within the right-of-way.

Kimberton Zoning Ordinance Amendments

East Pikeland Township’s Planning Commission is working with interested citizens to facilitate development and redevelopment

of historic Kimberton Village and the immediately surrounding area. This purpose is consistent with and reinforced by the 2013 Plan for Open Space and Economic Development: A

Supplement to the East Pikeland Township Comprehensive Plan, with goals including the recognition of Kimberton Village

as the Township’s defining historical settlement, and policies to promote lively and synergistic development that respects its integrity.

The public is invited to Planning Commission workshops where discussion will focus on Kimberton, including the following topics:

• The extent of the Village and adjacent zoning districts • Use, bulk, and density standards appropriate to each specific Kimberton

area district• Design and streetscape standards • Criteria and incentives for Historic Rehabilitation projects• Compatibility with the Historic Resource Protection Standards of the zoning

ordinance• Facilitation of pedestrian and bicycle accessibility, including integration with

the Township and regional trail systemZoning workshops are held at the East Pikeland Township Municipal Building,

1158 Rapps Dam Road, on the second Monday of each month, immediately following the Planning Commission’s regular business meeting at 7:00 pm.

This project is funded in part by a grant from Chester County’s Vision Partnership Program (VPP). In order to comply with the VPP contract provisions, the ordinance must be adopted by July 31, 2017. Thus, the latest tentative dates for actions in the adoption sequence are as follows:

5-8-17 – Planning Commission mtg. – Public comment and authorization to submit for Chester County review6-12-17 – Planning Commission mtg. – Discuss comments from County review – Recommend adoption by the Board of Supervisors7-11-17 – Board of Supervisors Public Adoption Hearing

Snow Emergency Routes

The Public Works Department works hard to clear the snow and ice off of the roads and asks residents not to park on the roadway whenever possible. However, if a road has been designated as a Snow Emergency Route, the No Parking regulation is mandatory. If a road has the Snow Emergency Routes posting, it means that after two or more inches of snow has fallen, or a snow emergency has been declared, no vehicles should be parked on the paved roadway of the roads designated below:

Police Department PromotionsAt their January meeting, the Board of Supervisors promoted three police officers. Part-time officers Matthew Paris and

Robert Wilson were promoted to full-time positions. Officer Joe Heyman, a 20-year veteran of the department, was promoted to Sergeant.

Officer Paris attended Villanova University where he majored in Sociology/Criminal Justice. He began his law enforcement career with West Chester University Police Department, then worked with Villanova University Public Safety Department. He has been a part-time officer with East Pikeland since September 2015.

Officer Wilson has only been with the East Pikeland Police Department as a part-time officer for six months, but came with experience in surrounding municipalities and with the Chester County Sheriff’s Department. He is a 2011 graduate of the Montgomery County Police Academy. Officer Wilson will serve as the township’s weapons specialist.

Sergeant Heyman is well-known in the township, as both a resident and long-time officer of the Department. He will assist Sergeant Susette Wilson who is serving as the “Officer in Charge” of the Police Department while the township conducts a search for a new police chief.

Good luck wishes to Officer Ben Martin, who has resigned from East Pikeland to take a position with the Chester County Detectives Department.

Building PermitsBuilding and zoning permits are required for all construction

and most renovation projects. If the project is structural or involves plumbing, electrical or mechanical work, you must obtain a permit. A permit is not needed to re-shingle your roof, or to replace siding, windows and doors. Decks lower than 30” inches from the ground, sheds under 500 sf., gazebos and pergolas require a Zoning Permit only. A detached garage, pole barn or other accessory structure over 500 sf. requires a Building Permit and must be setback a minimum distance equal to the height of the structure, but not less than 15’ from the property line. Accessory structures cannot be located in the front yard.

• Exterior modifications to a Historic resource, or a property located within a designated Historic District requires prior review by the Historical Commission and/or HARB before a permit can be issued.

Dog LawsChapter 2-102 of the EPT Code of Ordinances prohibits dogs

running at large in the community. A dog must be accompanied by and under the control of the owner at all times while on a street, sidewalk, public land, or private property of persons other than the owner. Be courteous and pick up your dog’s waste! Also be considerate of your neighbors when leaving your dog outside. Barking dogs are a nuisance and could result in a citation (Chapter 2-202) if not controlled. All dogs must be licensed through Chester County. Be advised that if your animal is picked up by or taken to the Brandywine Valley SPCA, you will incur fees from them and also be required to reimburse the township for fees that the SPCA may charge us. Just a reminder that dogs are not allowed in Kimberton Park; they are however welcome on the township trails.

Stray cats can be dangerous and a health risk! We do not encourage taking stray cats to the SPCA because the township is charged a fee for each cat that is dropped off at their facility. If you do encounter a stray and are concerned about its well-being, contact a local feline animal rescue organization.

Keeping of AnimalsSection 1818 of the Zoning Ordinance is titled Keeping of

Animals. In summary, if your property is 1-acre or more, you may be allowed one horse, cow, pig, three sheep or goats, ten fowl or rabbits per acre. The provisions vary for properties over 10-acres and those located within the AP-Agricultural Preservation zoning district. Before acquiring any animals, other than domestic pets, you should contact the township office to confirm minimum lot size requirement, the number and type of animals permitted, and shelter and fencing requirements.
