Peggy Crosby and Bev Beaton appeared before Council on behalf of the Princeton Park Legacy Group and provided a brief update on the progress being made at the park with the future installation of benches and trees.
Jason Vernooy of the Wm. Kipp Funeral Home appeared before Council and commented on the changes that have occurred as well as changes which are proposed related to the operation of the Township cemeteries.

REPORT HIGHLIGHTS
The application for zone change proposes to rezone the subject property from ‘GeneralAgricultural Zone (A2)’ to ‘Special Temporary General Agricultural Zone (A2-Sp-T) topermit the placement of a trailer on the property for a temporary time period of threeyears.

Environmental Protection Overlays 1 & 2 (EP1&2) PROPOSAL: The Application for Zone Change proposes to rezone the subject lands from ‘General Agricultural Zone (A2)’ to ‘Special Temporary General Agricultural Zone (A2-24-T) to permit the placement of a trailer on the property for a temporary time period of three years. The trailer is proposed to be located on north side of the property (as shown on Plate 3). As indicated by the applicant, the trailer is to be used for hunting purposes and will only be occupied a few days of the year. The subject property comprises approximately 25.7 ha (62.6 ac) and is currently vacant. Surrounding uses include conservation lands to the north, woodlands to the west and Highway 401 to the southeast. Plate 1, Existing Zoning & Location Map, shows the location of the subject property and existing zoning in the immediate vicinity. Plate 2, Aerial Map (2015) with Existing Zoning, provides an aerial view of the subject property and surrounding area and identifies the proposed location of the trailer. Application Review
PROVINCIAL POLICY STATEMENT: The Provincial Policy Statement (PPS) provides policy direction on matters of provincial interest related to land use planning and development. Under Section 3 of the Planning Act, where a municipality is exercising its authority affecting a planning matter, such decisions “shall be consistent with” all policy statements issued under the Act. Section 2.1 of the PPS directs planning authorities to protect natural features and areas for the long term. Section 2.1.5 also states that development and site alteration shall not be permitted in significant wetlands, significant woodlands, significant valleylands or significant areas of natural and scientific interest. Furthermore, Section 2.1.8 does not permit development or site alteration on lands adjacent to the aforementioned features, unless it has been demonstrated that there will be no negative impacts on the natural features or their ecological functions. Section 3.1 further directs that development shall generally be directed to areas outside of hazardous lands adjacent to river, stream and small inland lake systems which are impacted by flooding hazards and/or erosion hazards. Furthermore, development and site alteration shall not be permitted within areas that would be rendered inaccessible to people and vehicles during times of flooding hazards or erosion hazards, unless it has been demonstrated that the site has safe access and egress appropriate for the nature of the development and the natural hazard, or a floodway regardless of whether the area of inundation contains high points of land not subject to flooding. Section 2.3 of the PPS directs that prime agricultural areas shall be protected for long term agricultural use. In prime agricultural areas, permitted uses and activities include agricultural uses, agriculture-related uses and on-farm diversified uses. All types, sizes and intensities of agricultural uses and normal farm practices shall be promoted and protected in accordance with provincial standards. OFFICIAL PLAN: The subject lands are primarily designated ‘Environmental Protection (EP)’ and ‘Open Space (OS)’, with the exception of a small portion of land on the south side of the property that is designated ‘Agricultural Reserve’, according to the Township of Blandford-Blenheim Land Use Plan. The ‘EP’ designation is reflective of the Locally Significant Natural Heritage Feature (woodlot), Provincially Significant Wetlands (PSW), Significant Valleylands and Life Science Area of Natural and Scientific Interest (Life Science ANSI), while the ‘OS’ designation is reflective of the identified floodplain associated with Black Creek. The majority of the lands are also identified as ‘Erosion Hazard Lands’ and ‘Unstable Soil’. According to Section 3.2.4.2, where lands designated ‘EP’ are affected by two or more natural heritage features, the most restrictive policies will apply. In this case, the policies respecting the PSW will apply.

As per Section 3.2.4.2.1, no development or site alteration, with the exception of silvicultural practices, may be permitted within a PSW. However, development or site alterations may be permitted within 120 m (394 ft) of a PSW, provided an Environmental Impact Study (EIS) is prepared in accordance with Section 3.2.6. Development and site alteration within 50 m (164 ft) of a Significant Woodland, Significant Valleylands or Life Science ANSI also requires the preparation of an EIS. While an EIS is typically required for the above noted circumstances, Section 3.2.6 indicates that this Study may be waived where a Conservation Authority has no concerns with a proposal. It should be noted that the Ministry of Natural Resources and Forestry (MNRF) is responsible for determining the boundaries of significant wetlands and wetland complexes. ‘Open Space’ areas are also intended to maintain and enhance important ecological functions. Areas within the ‘OS’ area include Conservation Authority lands and areas within regulatory flood plains. A large portion of the property has also been identified as ‘Erosion Hazard Land’ and ‘Unstable Soil’. Very limited development is permitted within ‘Open Space Areas’, including, but not limited to, passive recreational uses and structures that are accessory or ancillary to the Open Space use. Staff note that the proposed trailer will be located outside of the Open Space area. While the lands are primarily designated ‘Environmental Protection’, development or site alteration on lands adjacent to such areas shall be consistent with the permitted uses of the underlying land use designation, being the ‘Agricultural Reserve’. Within the ‘Agricultural Reserve’ lands are to be developed for a wide variety of agricultural land uses, including general farming, animal or poultry operations, regulated livestock farms, cash crop farms and specialty crop farms, together with farm buildings and structures necessary to the farming operation, and accessory residential uses required for the farm. Residential uses on the farm unit will be accessory to farming operations and shall only be permitted as part of the farm. Additional dwelling units may be permitted on the farm unit in the form of temporary dwellings (mobile homes or modular dwellings) or permanent detached dwellings (bunkhouses or converted dwellings) through a minor variance granted by the Committee of Adjustment. Notwithstanding the above, Section 10.3.9 (Temporary Use) of the Official Plan permits the development of uses that do not conform to the Official Plan land use designations or Zoning By-law for specific temporary periods, up to a maximum of three (3) years. Such uses may be permitted upon individual application and careful consideration by Township Council of the need and appropriateness of a temporary use by-law and to ensure that the objectives and policy direction of the Official Plan are not adversely affected by such uses. In doing so, the following matters shall be taken into consideration by Township Council:
compatibility of the use with surrounding land uses;
the requirement for temporary buildings or structures;
any temporary connections to municipal services and utilities;
the potential impact of the use on transportation facilities and services in the immediate area;
road access requirements; and,
parking requirements that can be provided on the site.

Township Council may extend the temporary use beyond the initial three (3) year time period, as set out in the Planning Act, provided such extensions do not exceed a three (3) year time period and do not jeopardize the long term development intentions of the subject lands as specified in the Official Plan. TOWNSHIP OF BLANDFORD-BLENHEIM ZONING BY-LAW: The subject lands are currently zoned ‘General Agricultural Zone (A2)’ according to the Township of Blandford-Blenheim Zoning By-law, which permits a wide range of agricultural uses, including farm buildings and accessory dwellings. The majority of the lands also contain ‘Environmental Protection 1 & 2 Overlays (EP1&2)’, which are reflective of the Provincially Significant Wetlands, Significant Woodlands, Significant Valleylands and Life Science ANSI on the property. It should be noted that according to Section 5.6.2 (Existing Lots in an ‘A2’ Zone), a building or structure may be erected on an existing ‘A2’ lot of at least 16 ha (39.5 ac) provided that all other requirements of the Zoning By-law are complied with. A ‘dwelling’ is also defined as a building occupied or capable of being occupied as the home or residence of one or more persons, but shall not include a trailer, a mobile home, a motor home or recreational vehicle. This definition implements the farm residential use polices of the Official Plan and clearly establishes that a trailer cannot be used as a principle dwelling on a property.
Notwithstanding the underlying zoning, uses permitted within ‘EP1&2’ overlays are limited to those uses existing at the date of the passing of the Zoning By-law, limited farm activities on existing cleared areas (excluding buildings and structures), public uses and conservation projects. According to Section 5.22.5, all other zone provisions of the underlying zone also apply to lands containing ‘EP1&2’ overlays. In this case, the applicant proposes a temporary zoning to permit a trailer on the property for a period of three years. As no existing dwellings are located on the property, the proposed trailer will be considered the principle dwelling on the property, which is not permitted by the Zoning By-law. Staff also note that the trailer will be located in an area containing ‘EP2’ overlay, which is also not permitted. AGENCY COMMENTS:
The application was circulated to those agencies that were considered to have an interest in the proposal. The following comments were received. The Grand River Conservation Authority (GRCA) is not in a position to support the application at this time. Prior to providing recommendation for approval, the applicant needs to clearly demonstrate that the proposed trailer is not located within the floodplain and/or wetlands areas in accordance with Provincial, County and GRCA policies. An Environmental Impact Statement (EIS) is required to support the development proposal, and to receive a permit from the GRCA to place the trailer on the property. In this regard, it is recommended that the application be deferred to provide the applicant with additional time to provide the appropriate supporting information to the GRCA.

The Township Chief Building Official provided the following comments:
A building permit may be required for the proposed trailer.
The owner is required to pay Township Development Charges.
Approval is required from the GRCA prior to placement of the trailer on the property. The Township Drainage Superintendent, Township Director of Public Works, County Public Works Department, County Public Health & Emergency Services Department and Ontario Provincial Police indicated that they have no concerns with the proposal. PUBLIC CONSULTATION: Notice of complete application and notice of public meeting regarding this application were circulated to surrounding property owners on November 18, 2016 and December 1, 2016. At the time this report was written, no comments or concerns had been received from the public.
Planning Analysis The applicant proposes a temporary zoning to permit a trailer on the subject property for a period of three years. The PPS directs that natural features, including Provincially Significant Wetlands, Significant Woodlands, Life Science ANSI’s and Significant Valleylands, shall be protected. Furthermore, development shall generally not be permitted in areas impacted by flooding hazards and/or erosion hazards. In this case, the trailer is proposed to be located within an area currently identified as a Provincially Significant Wetland, Significant Woodland and Life Science ANSI. The trailer will also be located adjacent to Significant Valleylands, Erosion Hazard Lands and a Floodway. As the applicant has not demonstrated that the proposed development will have no negative impacts on the natural features or their ecological functions, to the satisfaction of the County and GRCA, Planning staff are not satisfied that the proposal is consistent with the natural heritage policies of the PPS. As previously mentioned, the majority of the subject lands are designated ‘Environmental Protection (EP)’, which generally permits no new development or site alternation, while a small portion of land on the south side of the property is designated ‘Agricultural Reserve’, which permits a variety of agricultural land uses. In this case, the proposed trailer will be located within the ‘EP’ designation, which requires the submission of an EIS to determine if the proposed development will have any negative impacts on the above noted natural heritage features. In this case, it was communicated to the applicant by both Planning staff and the GRCA that that an EIS was required in support of the application. As a full scope EIS was not submitted nor reviewed by the GRCA, it cannot be determined if the proposed development will have any impact on the significant natural heritage features on the property. For Council’s information, correspondence was provided by the applicant from the Ministry of Natural Resources and Forestry (MNRF) with regard to the boundary of the PSW on the subject property. As indicated by the MNRF, the boundary of the wetland does not extend to the area that is proposed to be occupied by the trailer, and as such, will be revised accordingly. Notwithstanding this revision, given that the trailer will be located within the required setbacks of

each natural heritage feature (120 m), an EIS is still required to evaluate the impact of the proposed development. Given the above, the GRCA is requesting that the application be deferred to provide the applicant with an opportunity to clearly demonstrate that the proposed trailer is not located within the floodplain and/or wetlands areas in accordance with Provincial, County and GRCA policies. As an EIS was not submitted, the Conservation Authority is not able to determine if the proposed trailer will have a negative impact on all of the environmental features on the property and is not able to confirm if the proposal is consistent with the Natural Heritage policies of the PPS. While the MNRF has re-evaluated the wetland boundary, the proposal remains within area adjacent to the wetland and other natural heritage features on the property and the GRCA requires additional information to evaluate the potential impacts of the proposal. It should be noted that the subject property is within the GRCA Regulation Limit, and a permit from the GRCA is required prior to the issuance of a building permit. Further, while the majority of the property is designated ‘Environmental Protection’, the policies of the ‘Agricultural Reserve’ designation also apply. In this regard, residential uses may only be permitted as part of the farm, and additional dwelling units may be permitted in the form of temporary dwellings, such as mobile homes or modular dwellings. In this case, the applicant proposes to place a temporary dwelling unit on the property, where an existing permanent accessory dwelling does not exist. As such, the temporary dwelling will be considered the principle residential use, which does not conform to the farm residential policies of the Official Plan. The property is also zoned ‘A2’ which permits an accessory farm dwelling and additional dwellings through minor variance. As previously noted, a permanent accessory farm dwelling is required to be established prior to a temporary dwelling in the ‘A2’ zone. According to the Zoning By-law, a dwelling does not include a trailer, as proposed. As such, the trailer is not a permitted use on the property. It is also noted that due to the ‘EP’ designation, the majority of the lands also contain ‘EP1&2’ zoning overlays. These overlays ensure environmental features are protected in accordance with the policies of the Official Plan. In this case, the proposed trailer will be located within an ‘EP2’ overlay, which is not permitted. As the development proposal does not conform to the Official Plan land use designations or comply with the permitted uses of the Zoning By-law, the applicant is requesting a temporary zoning to allow the trailer on the property for a period of three years. With respect to the specific review criteria regarding temporary uses, while no permanent private services will be installed to accommodate the proposed trailer, road access is available, and it is not anticipated that the proposed trailer will have further impacts on neighbouring uses, Planning staff are of the opinion that the proposal does not maintain the policy direction of the Official Plan, respecting agricultural residential uses. In addition, given that an EIS was not submitted and reviewed to ensure the trailer will have no adverse impacts on the noted natural heritage features, the proposal cannot be determined to be consistent with the natural heritage policies of either the PPS or Official Plan.

Planning staff also note that permitting a trailer as the principle dwelling on the property may set undesirable precedent for the Township, which could have impacts on current and future properties within the municipality. In light of the foregoing, Planning staff are not supportive of the application as the proposal is not consistent with the natural heritage policies of the PPS and Official Plan or the policies of the Official Plan respecting farm residential uses, and does not maintain the intent and purpose of the Township Zoning By-law. Should Council be favourable of the proposal, Planning staff note that the application should be deferred to ensure the applicant satisfies the requirements of the GRCA with regard to the environmental features identified on the property. A permit will be required from the Authority should the application be approved.
RECOMMENDATION
It is recommended that the Council of the Township of Blandford-Blenheim not approve the zone change application submitted by Lawrence Beckett, whereby the lands described as Part Lots 13 & 14, Concession 8 (Blenheim), Township Blandford-Blenheim are to be rezoned from ‘General Agricultural Zone (A2)’ to ‘Special Temporary General Agricultural Zone (A2-Sp-T)’ to permit the placement of a mobile home trailer on the property for a temporary time period of three years.

Background:
In prior years Council has been provided a time-line for consideration and finalization of the Capital and Operating Budgets. The purpose of this report is to provide Council a time-line for consideration of projected 2017 revenues and expenditures.
Analysis/Discussion:
For the upcoming 2017 budget deliberations, staff are proposing the following timeline.
Staff are proposing to have one regular Council meeting on February 1, 2017 and then utilize the second Council meeting in February as an extended budget meeting. A similar format was used last year, and it is felt that it provided better focus on inter-departmental projects and allowed Council to address budgeted revenue/expenditures as a whole. Directors will highlight significant operating changes and current capital spending.
This time-line provides public the ability to have input to the proposed budgets weeks in advance of Council passing the Tax Rate By-Law for 2017.

That Council authorize the Mayor and Clerk to sign a severance agreement with Loretta Siminoski in accordance with County of Oxford Land Division Committee decision dated May 5, 2016 (file B16-1-1 and A16-02-1).
Background:
An application was made to the County of Oxford Land Division Committee for consent to sever a lot off a property located at 20 Oxford Street West in Drumbo. Since there was no proposed zone change for the existing or severed property there was no need for the application to come to Township Council.
The Land Division Committee considered the application on May 5, 2016 at which time it was granted with a number of conditions. One of the conditions was that, if required, the Owner enter into a severance agreement with the Township of Blandford-Blenheim.
Analysis/Discussion:
Applications to create new lots through severance are considered by the Oxford County Land Division Committee. For many years the Township has requested that the County place a condition on approval that owners who create new lots enter into severance agreements with the Township.
The attached agreement has been drafted to cover the conditions of the Township. It has been reviewed and signed by the property owner.

AGREEMENT
THIS SEVERANCE AGREEMENT dated the _____ day of ___________, 2016. BETWEEN: Loretta Siminoski 20 Oxford Street West PO Box 50 Drumbo, ON N0J 1G0 and hereinafter called the “Owner” of the First Part - AND - THE CORPORATION OF THE TOWNSHIP OF BLANDFORD-BLENHEIM hereinafter called the “Township” of the Second Part WHEREAS the Owner has made an application to the County of Oxford Land Division Committee (File Number A16-02-1 and B16-11-1) for consent to sever certain lands described as Lot 1, Block “C”, Registered Plan 104, in the Township of Blandford-Blenheim, in the County of Oxford, which application was granted subject to certain conditions, outlined in those decisions. AND WHEREAS the Council of The Corporation of The Township of Blandford-Blenheim is of the opinion that such change and approval is not proper and in the public interest unless the Owner agrees to perform the covenants herein set forth; NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of other good and valuable consideration and the sum of Two Dollars ($2.00) of lawful money of Canada, now paid by each of the parties hereto to each of the other parties hereto, (the receipt whereof is acknowledged), the Owner and Township hereby covenant, promise and agree with each other as follows:
1. The Owner agrees that no building permit shall be issued until water and wastewater services, to
the satisfaction of the County of Oxford, are provided to the subject property and payment of these services has been collected by the County of Oxford Public Works Department. Payment of these services includes, but is not limited to, extension of the services and connection charges.
2. The Owner agrees to pay the sum of $300 to the Township which sum shall be deposited in the Township’s Reserve Account for Street Lighting. This sum shall be payable prior to the stamping of the deed.
3. The Owner agrees to pay the sum of $500 to the Township which sum shall be deposited in the Township’s Reserve Account for Sidewalk Extensions, Improvements and Maintenance. This sum shall be payable prior to the stamping of the deed.
4. The Owner agrees to pay the sum of $1,500 to the Township which sum shall be deposited in the Township’s Reserve Account for Parks and Recreation. This sum shall be payable prior to the stamping of the deed.
5. To ensure that the Owner, lot purchaser or their successors constructs acceptable lot grading, boulevard and driveway work, the Township will require a security of $2,500 per lot, cash or certified cheque, prior to issuance of a building permit. This deposit shall be returned, as also specified below, to the lot owner at the time the required work is satisfactorily completed, without interest and less the costs of the Township Engineer's involvement with site plans, site reviews and any foundation certification works, and upon the Township Engineer's certification of lot grading and driveway construction and shall only be returned if any damages to existing services such as the Roads are attended to and if all other matters required by this agreement are attended to.
6. The Owner agrees to notify the lot purchaser of their obligation to construct and pay the appropriate fee for any private drain connection, back water valve, and sump pump as required. All foundation drainage to be pumped over foundation wall and discharge by gravity to PDC.
7. The Owner agrees to notify the lot purchaser of their obligations of construction re the New Building Lot in accordance with the approved plan. The Owner agrees to provide free of charge to any lot purchaser a copy of this agreement as registered, a copy of the approved plan, a notice that this agreement is registered against the lot acquired, and a written notice that the lot purchaser is required to comply with all applicable sections of this agreement.
8. All development charges as applicable at the time of building permit application must be paid prior to the issuance of a building permit.
9. The Owner agrees that the Township may, at its sole discretion, require that this agreement be registered or deposited in the appropriate Registry or Land Titles Office. The cost for this will be the responsibility of the Owner.
10. This agreement shall enure to the benefit of and be binding upon the parties hereto, their
respective heirs, executors, administrators, successors and assigns. IN WITNESS WHEREOF THE PARTY OF THE FIRST PART has hereunto affixed their hand and seal, the Party of the Second Part has hereunto affixed its corporate seal attested to by the hands of its proper officers thereunto lawfully authorized.

THE CORPORATION OF THE

BY-LAW NUMBER 1997-2016
Being a by-law to establish the Corporation of the Township of Blandford-Blenheim Fees and Charges.
WHEREAS, Section 391(1) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that a municipality may pass by-laws imposing fees or charges for services or activities provided, for costs payable by it for services or activities provided or done by or on behalf of the municipality for the use of its property including property under its control;
AND WHEREAS, the Planning Act, R.S.O. 1990, c.P.13, as amended, and the Building Code Act, S.O. 1992, c.23, as amended, and various other statutes provided municipalities with authority to impose various fees and charges;
AND WHEREAS, notice was given of Council’s intent to consider changes to the Township of Blandford-Blenheim Fees and Charges By-Law on the Township’s website in accordance with Township of Blandford-Blenheim Notice By-Law 1668-2011.
NOW THEREFORE the Council of the Corporation of the Township of Blandford-Blenheim hereby enacts as follows:
1. That all fees and charges by-laws previously established by Council of theTownship of Blandford-Blenheim are hereby repealed.
2. That the fees and charges as set out in Schedules “A” through “J” attachedhereto and forming part of this By-law are hereby established and adoptedby the Council of the Township of Blandford-Blenheim.
3. That no request by any person for any information, service, activity or useof County property described in Schedules “A” through “J” will beprocessed or provided by any Township Official, unless and until theperson requesting the information, service, activity or use of the Townshipproperty has paid the applicable fee or charge in the prescribed amount asset out in Schedules “A” through “J” to the Township or paymentarrangements have been made with a Township Official;
4. That unless otherwise prescribed, the fees and charges established by thisBy-Law shall be payable to The Township of Blandford-Blenheim by cash,money order, certified cheque, cheque or debit card when due.
5. That fees and charges that have been imposed in accordance with this By-Law that remain unpaid after the date on which they are due shall besubject to prescribed interest and penalty charges of one and one quarterpercent per month (1.25%), non compounded or fifteen percent (15%) perannum.

6. That in the event another by-law of the Township of Blandford-Blenheim establishes a fee or charge that is not referenced by this By-Law and that is not inconsistent with this By-Law, the fee or charge established by that other by-law shall be deemed to be included in Schedules “A” through “J” attached hereto;
7. That any provision of any by-law that is inconsistent with this By-Law be
hereby repealed; 8. That the effective date of this By-Law shall be January 1, 2017.

THE CORPORATION OF THE
TOWNSHIP OF BLANDFORD-BLENHEIM
BY-LAW NUMBER 1998-2016
Being a By-law to confirm the proceedings of Council.
WHEREAS by Section 5 of the Municipal Act 2001, S.O. 2001, c.25, the powers of a municipal corporation are to be exercised by its Council.
AND WHEREAS by Section 11 of the Municipal Act 2001, S.O. 2001, c.25, the powers of every Council are to be exercised by by-law;
AND WHEREAS it is deemed expedient that the proceedings of the Council of the Corporation of the Township of Blandford-Blenheim at this meeting be confirmed and adopted by by-law;
NOW THEREFORE the Council of the Corporation of the Township of Blandford-Blenheim hereby enacts as follows:
1. That the actions of the Council of the Corporation of the Township of Blandford-Blenheim in respect of each recommendation contained in the reports of theCommittees and each motion and resolution passed and other action taken by theCouncil of the Corporation of the Township of Blandford-Blenheim, at this meetingheld on December 21, 2016 is hereby adopted and confirmed as if all suchproceedings were expressly embodied in this by-law.
2. That the Mayor and proper officials of the Corporation of the Township ofBlandford-Blenheim are hereby authorized and directed to do all things necessaryto give effect to the actions of the Council referred to in the proceeding sectionhereof.
3. That the Mayor and the CAO / Clerk be authorized and directed to execute alldocuments in that behalf and to affix thereto the seal of the Corporation of theTownship of Blandford-Blenheim.
