Why Train?
The Provision and Use of Work Equipment Regulations (PUWER) 1998 states: “That every employer shall ensure that all persons who use work equipment have received adequate training for purposes of health and safety, including training in the methods which may be adopted when using the work equipment, any risks which such use may entail and precautions to be taken.” This quote is fundamental to understanding the importance of quality training for employees within an organisation. Accident Case Studies
Company fined £75,000 as a result of a worker being crushed to death by forklift truck
Two companies have been fined a total of £67,500 after a worker was crushed by a forklift truck.
34‐year‐old Shane Neal was killed whilst carrying out work on the Building Research Establishment (BRE) site in May 2003. The accident occurred in a hanger at a former RAF base in Cardington, Bedfordshire. Luton Crown Court heard how Mr Neal was manoeuvring the truck in order to dismantle a fire test rig, when the vehicle overturned. A HSE investigation into the accident found that Mr Neal was not adequately trained to drive the vehicle. Mr Neal’s employer was Welwood Roofing Services Ltd of Corby.
The company, which is now in administration, was charged with a breach of section 3(1) of the Health and Safety at Work Act 1974, and was fined £50,000 with costs of £25,000 after pleading guilty to this charge.
A second company, BRE in Watford, was fined £17,500 with £12,000 costs after pleading guilty to a breach of Regulation 9(1) of the Provision and Use of Work Equipment Regulations 1998.
In light of the incident, the HSE has warned employers to ensure that their employees are properly trained in using workplace equipment, with HSE Inspector Alison Ashworth saying: "I hope this tragic accident makes it clear to employers that they need to take positive action to manage risks, particularly where the work involves using forklift trucks. Mr Neal's death could have been avoided had the companies involved carried out checks to confirm whether or not he knew of the dangers of forklift trucks and how to drive them safely.
"HSE will not hesitate to take action against those who fall short of the law in such a way."

The importance of professional, competent training is a compulsory requirement within today’s workplace. Statistics below from www.hse.gov.uk and relevant case studies display not only that work related injuries and deaths are still an ever present threat but also that as a result of neglecting the training needs of employees the risk of such incident occurring increases.
Health & Safety Executive – Key Annual Figures 2007/8
2.1 million people were suffering from an illness they believed was caused or made worse by their current or past work.
229 workers were killed at work, a rate of 0.8 per 100,000 workers. 136 771 other injuries to employees were reported under RIDDOR, a rate of 517.9 per 100 000 employees.
299 000 reportable injuries occurred, according to the Labour Force Survey, a rate of 1000 per 100 000 workers.
34 million days were lost overall (1.4 days per worker), 28 million due to work‐related ill health and 6 million due to workplace injury.

Foreman fined for dumper truck death
Paul Nolan, site foreman, and employee of A&A Building services has been found guilty of breaching the Health and Safety at Work Act 1974 (HSWA) after a worker was killed by a nine‐tonne dumper truck. However, it seems Nolan was lucky to avoid far more serious charges after the Crown Prosecution Service (CPS) pursued a manslaughter charge against him.
Legal proceedings were brought after Alexander Hayden was killed when a dumper truck that he was driving overran the edge of an embankment. In trying to jump clear Hayden sustained extensive injuries. He was crushed by the toppled truck and was pronounced dead at the scene, in Stoke‐on‐Trent on 31 August 2005.
The court heard that Hayden had only been driving the nine‐tonne truck for two months, during which time he had been involved in two other accidents and had not received the required training. Stafford Crown Court found Nolan not guilty of the CPS manslaughter charge but guilty of a charge under the HSWA. He was fined £5,000 to be paid within 28 days or face three months’ imprisonment.
Setting the fine the Judge addressed Nolan saying that:
"You were responsible for the day‐to‐day running of the site and showed a complete disregard for the safety of the workers working under you; you thought you knew best… but you didn't. You were failed by your employers but you failed Alex Hayden."
Darren Barrie Atkins, a Director of A&A Building Services Ltd, was also found guilty of breaching HSWA, by failing to ensure the safety of his employees. He was fined £15,000, to be paid within three months or face nine months’ imprisonment.
To Atkins the Judge said:
"You were the director responsible for health and safety but you did next to nothing about health and safety, ignored clear warning bells, fell very short of what was expected and there was a high degree of neglect."
The company had already pleaded guilty, at an earlier hearing, to the health and safety breaches; therefore A&A Building Services Ltd was fined £55,000.

NPORS was formed in 1992.
NPORS has accredited over 1000 instructors and training providers who operate on national and international projects.

Current Standings / Objectives
NPORS have currently registered over 160,000 operators who have been employed across all UK industry sectors.
The Health and Safety Executive recognise NPORS as competent to accredit and monitor organisations to train instructors and/or to train, test and certificate operators.
NPORS has been an Accredited Body recognised by HSE since 1999 for Rider‐operated Lift Trucks: Operator Training – Approved Code of Practice (L117).
NPORS sit on the HSE Accrediting Bodies Forum along with the other accrediting bodies, RTITB, AITT, ITSSAR, Lantra and Construction Skills (CITB).
The main objective of NPORS is to allow NPORS Accredited Training Providers a flexible approach to meet the needs of the employer to help and assist in providing an adequately trained workforce within the UK.

1st Call Training has the facility to offer a range of forklift truck training. These are explained below together with course duration and any applicable accreditation:
Basic training is available to novices or operators with some experience but no previous formal training or testing. The training programme will run between 3‐5 days depending on previous experience
Refresher training is available to operators with some past experience of training and testing but requiring a course to update their skills. The training programme for refresher training normally runs for 1 day
Conversion training is available to operators with experience of training and testing on a particular forklift but requiring a course to convert their skills to another category of forklift. The training programme for conversion training is nominally 1‐2 days depending on experience

Section|G – National Vocational Qualifications [NVQ]
[CPCS] Delegate Process – Obtaining Blue Competent Operator Card
1st Call Training can also offer a range of NVQ [or similarly SVQ] qualifications. Some of these are necessary through the CPCS [Construction Plant Competence Scheme] scheme, enabling a Red Trained Operator Card holder to progress to a Blue Competent Operator Card [Please see introduction]. However there is N/SVQ’s available to delegates that are a qualification in their own right. Below details of each S/NVQ available are explored together with the relevant accrediting body.
Who’s it for: Any operator who has been trained and tested to CPCS standards and thus gained their red trained operator card will have to complete a Level 2 Specialised Plant & Machinery Operations NVQ in their selected piece of lifting or plant equipment. Only after this has been successfully completed through continuous assessment will the candidate be awarded their blue competent operator card. Course Aims: As a result of undergoing this course the delegate will have the opportunity to upgrade his current red trained operator CPCS card to a blue competent operator CPCS card. Course Content: Each Candidate will be offered an Induction where the following will be completed:
Registration Application for funding (if applicable) Skills match in order to validate experience and identify any additional training needs IAG ‐ Information and Guidance for any Key Skills that the candidate may require In addition the candidate will be allocated his/her assessor who will identify the units that will be required to complete the NVQ and the subsequent CPCS Competent Operators Blue Card
On completion of the Induction the candidate will receive their Registration number for their NVQ through CAA.
There are three mandatory units and one or more additional units depending upon what plant or machinery equipment the candidate operates. Below the process to complete the portfolio of competence is explained:
The assessor will visit the candidate (normally) in the work place for a minimum of three visits During this period the Assessor will use a range of assessment methods to gain sufficient evidence to help complete the portfolio of competence [Wherever possible the assessor will advise the candidate when the next visit will take place so that the candidate can address any action points]
The assessor will be contactable by the delegate The Internal Verifier [IV] who may also identify further information for the portfolio will examine the portfolio twice in the process
On completion the training provider will submit the portfolio to the accrediting body for External Verification and Certification.
At this point the Certification and the Portfolio will be given to the candidate and application made on their behalf for the CPCS Competent Operators Blue Card
