INTRODUCTION

This booklet contains an unofficial copy of theMemorial University Traffic Regulations whichgovern parking on all Memorial University propertyincluding the main campus in St. John’s andGrenfell Campus in Corner Brook. TheseRegulations have been approved by the Board ofRegents pursuant to the Memorial University Act,RSNL 1990 c. M-7, as amended, and registeredunder the Statutes and Subordinate Legislation Act,RSNL 1990 c. S-27, as amended.

Short title1. These regulations may be cited as theMemorial University Traffic Regulations.

Definitions2. In these regulations

(a) "Act" means the Memorial UniversityAct;

(b) "board" means the Board of Regents;(c) "campus" includes all land owned, occu-

pied or leased by the university and anybuildings erected on it;

(d) "Campus Enforcement and Patrol" meansthe security force of the university;

(e) "car pool" means where 2 or more per-sons register separate vehicles to com-prise a car pool;

(f) "crosswalk" means(i) a part of a roadway at an intersection or

elsewhere distinctly indicated for pedes-trian crossing by signs or by lines orother markings on the surface, or

(ii) the part of a roadway at an intersectionthat is included within the connection ofthe lateral lines of the sidewalks on theopposite sites of a highway, measuredfrom the curbs or, in the absence ofcurbs, from the edges of the roadway;

g) "drop off points" means areas on cam-pus designated for the drop off and pickup of passengers;

(h) "employee" means a person on the pay-roll of the university or a personemployed by the Eastern RegionalIntegrated Health Authority and workingat the Health Sciences Centre;

i) "fee" means a fee prescribed by theboard;

(j) "hospital" means the Eastern RegionalIntegrated Health Authority;

(k) " Memorial University of Newfoundland "means the corporate body establishedand continued under the Act;

(l) "minister" means the minister appointedunder the Executive Council Act toadminister the Act;

(m) "motor cycle" means a motor cycle withinthe meaning of the Highway Traffic Act;

(n) "motor vehicle" means a motor vehiclewithin the meaning of the HighwayTraffic Act and includes a motor cycle;

(o) "no parking area" means(i) a part of the university land where

signs are erected under the Act orunder these regulations to indicatethat no parking is permitted,

(ii) a part of the university land that isnot covered by a hard surface, or

(iii) a part of the university land that is asidewalk, walkway or otherwise notintended for use by a motor vehicle;

(p) "park or parking" means to permit avehicle whether occupied or not toremain in a stationary position, exceptwhen halting temporarily for the purposeof, and while actually engaged in, theloading and unloading of goods andpassengers;

(q) "parking areas" means that portion ofuniversity land designated for the park-ing of motor vehicles;

(r) "parking meter" means a device whichindicates on it the length of time duringwhich a vehicle may be parked andwhich has as a part of it a receptacle forreceiving and storing coins, a slot orplace in which the coins may be deposit-ed, a timing mechanism to indicate thepassage of the interval of time duringwhich the parking is permissible andwhich also displays a signal when theinterval of time has elapsed;

(s) "parking meter space" means any areaor portion of any highway, street or park-ing are marked out under these regula-tions for the accommodation of a vehicleand adjacent to which a parking meterhas been installed;

(t) "permit" means a permit issued underthe Act or these regulations;

(u) "permit only area" means a part of thecampus where signs erected under sub-section 35(7) of the Act indicate thatparking is not permitted except underpermit;

(v) "person" includes a partnership, corpo-ration or association;

(w) "roadway" means that portion of univer-sity land designated for the use ofmotorized vehicles, excluding parkingareas;

(x) "service personnel" means personsemployed by companies, firms, govern-ment departments, individuals or agen-cies providing services full-time orpart-time on campus;

(y) "signs" means a marking or device dis-played or erected by the university to

regulate the movement of pedestrianand vehicular traffic and the parking ofvehicles on campus;

(z) "student" means a student registered ineither day or evening courses for creditor non-credit;

(aa) "summons" means an issued summonswhich relates to an alleged traffic orparking offence;

(bb) "traffic control device" means a parkingmeter, mechanical gate or other deviceused for the control of traffic or parking;

(cc) "traffic officer" means a member ofCampus Enforcement and Patrol or apolice officer;

(dd) "university" means the MemorialUniversity of Newfoundland;

(ee) "university land" means all land ownedor occupied or leased by the universityand any buildings erected on it;

(ff) "vehicle" means a vehicle as defined bythe Highway Traffic Act , and includes amotor cycle; and

(gg) "visitor" means a person not defined asa student, employee or service person-nel.

Application3. (1) All persons using university land are

subject to these regulations.(2) Unless otherwise specified, these regu-

lations are in effect 24 hours a day, 7days a week.

Revisions and conflict4. (1) Any revision to these regulations shall

be published in the MUN Gazette andthe Muse and may be posted on the uni-versity notice boards.

(2) In the case of a conflict between mapdesignations and on-site signs regardingparking instructions, the on-site signageshall be assumed to be the more recentand shall take precedence.

Passenger drop-off/pick up points5. Locations for the drop-off and pick-up of pas-sengers have been established on campus and aremarked with signs.

Parking in designated areas only6. (1) Parking on campus is permitted in des-

ignated parking areas only unless per-mission to park elsewhere is given by aCampus Enforcement and Patrol officeror police officer.

(2) Parking in designated areas shall be inaccordance with signs and instructionsnoted regarding restricted times.

(3) Parking is not permitted on campusroadways, loading zones, fire zones,traffic lanes within parking lots, drop-offpoints or where otherwise indicated bysigns.

(4) Notwithstanding subsection (3), parkingmay be permitted on campus roadwayswhere metered parking is provided.

(5) A person shall not park a vehicle in amanner that violates or contravenessubsection (1), (2) or (3).

Parking meter spaces7. (1) The Director of Facilities Management is

authorized to designate and mark out bysuitable lines or marking separate park-ing meter spaces, adapted for the park-ing and accommodation of a vehicle, onthe roadways or other university proper-ty and to cause to be installed adjacentto each parking meter space a parkingmeter.

(2) Each parking meter shall have markedon the face plate of the meter the maxi-mum period of time during which a vehi-cle may be parked in the parking meterspace adjacent to which that parkingmeter is installed.

User pay parking8. (1) User pay parking is available in desig-

nated areas at the times and for therates posted.

(2) A vehicle shall not be parked in a desig-nated user pay area until the designatedfee has been paid.

(3) All vehicles parked in designated userpay areas shall be parked in a mannercomplying with these regulations andshall be removed before 7:00 daily.

(4) A person shall not park a vehicle in amanner contrary to this section.

Issuing permits9. The issuance of parking permits shall beunder the direction and control of the Director ofFacilities Management and administered byCampus Enforcement and Patrol.

Permit areas10. The Director of Facilities Management isauthorized to designate areas on university land asparking areas and to mark out and designate by suit-able lines, marking or signs within those areas, des-ignated parking spaces adapted for the parking andaccommodation of a vehicle, whether on the road-ways or other university land and to designate theparking permits applicable for each designated area.

Obtaining a parking permit11. (1) Students, employees, service personnel

and other persons having a direct asso-ciation with the university or hospital,and wishing to park a vehicle in a desig-nated area on campus shall obtain aparking permit.

(2) Application forms for parking permitsreferred to in subsection (1) are avail-able at the Campus Enforcement andPatrol Office.

Process of application12. (1) Applications may be processed by mail.

(2) The application form shall be completedand signed by the applicant, and shallinclude the applicable fee and proof ofownership of the vehicle.

(3) University employees requesting theirparking fee to be deducted from theirsalaries must complete and sign theapplicable portion of the application form.

Affirmation by applicant13. (1) By signing the application form, the

applicant acknowledges that he or shehas read, understands, and agrees toabide by these regulations.

(2) Applications may not be processed if theapplicant has outstanding tickets andthe applicant has previously shown dis-regard for these regulations.

Special consideration14. (1) In special circumstances, an application

made by an individual for a parking per-mit for a vehicle not registered to him orher may be considered.

(2) Written permission from the registeredowner of the vehicle must be providedbefore consideration will be given torequests made under subsection (1).

Designated areas15. (1) Parking in designated areas shall be

allocated as space permits.(2) The fees for each designated area will

be prescribed by the board.(3) Priority shall be given to full-time faculty

and staff and to persons with disabilitieswho were registered for the parking areain the previous year.

(4) Priority for the current year's permitissue shall not be applicable after May31.

(5) Full-time students living in university res-idences may apply for a parking permit,on a semester basis, for area 8, 10A, 11,12, 14, 22 or 24.

(6) Full-time students living in residences atGrenfell Campus may apply for areas P-4, P-2.2, P-6 and P-7.

(7) Permits will be granted on a first-comebasis.

(8) Full-time and part-time day students notresiding on campus, and who haveacquired a minimum of 48 credit hours,may apply for a permit, on a semesterbasis, for area 16A or 36, or in thoseother areas in which the manager ofCampus Enforcement and Patrol hasdetermined that space is available, andthose permits will be issued as space isavailable on the basis of a computerizedrandom draw.

(9) Part-time evening students may applyfor a permit for area 15, 16A or 36, whichif available will be valid for parking after3:00 pm on weekdays and all day onSaturday and Sunday.

(10) Students living in university residencewhile attending summer semester orintersession may apply for a permit forarea 8, 10A, 11, 12, or 14 and those per-mits will be granted on a first-comebasis.

(11) Students not residing on campus whileattending summer semester or interses-sion, and who have a acquired a mini-mum of 48 credit hours, may apply for apermit for area 16A or 36, or in thoseother areas in which the manager ofCampus Enforcement and Patrol hasdetermined that space is available, andthose permits will be issued as space isavailable on the basis of a computerizedrandom draw.

(12) In the event that an applicant does notreceive the preferred parking area indi-cated on the application form, a writtenrequest may be sent to the assistantmanager of Campus Enforcement and

Patrol, indicating a continued interest inthe preferred area as space becomesavailable.

Decals16. (1) Permits in the form of decals issued for

vehicles other than motorcycles, carpool vehicles or multiple vehicles shallbe affixed on the inside of the front wind-shield and located in the top centrebehind the rearview mirror so as not tointerfere with the drivers vision, asapproved by the minister.

(2) Decals when affixed must be clearly vis-ible through the front windshield fromoutside the vehicle.

(3) Motorcycle decals shall be affixed on thefront or rear fender so as to be clearlyvisible.

(4) Where a location referred to in subsec-tion (1) or (3) is not considered satisfac-tory, applicants may contact CampusEnforcement and Patrol for adviceregarding satisfactory placement of thedecal.

(5) All previous university decals shall beremoved from the windshield.

Special or temporary permit17. (1) Temporary or special permits may be

issued by Campus Enforcement andPatrol to meet specific needs of stu-dents, employees or other persons hav-ing a direct association with theuniversity(a) when the registered vehicle is out of

service;

(b) when the registered owner sufferstemporary health or disability prob-lems; or

(c) for guests of the university.(2) Special or temporary permits shall be in

the form of cards and must be placed onthe dashboard of the vehicle so as to beclearly visible through the front wind-shield from outside the vehicle when it ison campus.

Registration of multiple vehicles18. (1) A person may be permitted to register

two vehicles for the same parking area.(2) The area fee for registration in subsec-

tion (1) shall apply for the first vehicleand an administration fee as prescribedby the board shall be charged for thesecond vehicle.

(3) Where registration is permitted undersubsection (1), only one vehicle shall beparked on the designated parking areaat a time.

(4) Multiple vehicle permits shall be laminat-ed by Campus Enforcement and shallbe hung from the rearview mirror of thevehicle so as to be clearly visiblethrough the front windshield from out-side the vehicle when it is on campus.

(5) Upon being satisfied of a breach of thissection Campus Enforcement and Patrolmay rescind the permit issued for bothvehicles either in addition to or in substi-tution of any other penalty.

Second permits19. (1) As space permits, a second permit may

be issued where 2 persons using onevehicle on campus request permissionto park in different parking areas.

(2) Where the areas requested have differ-ent fee schedules, the higher fee shallapply and an additional administrativefee as prescribed by the board shall becharged for the second permit.

(3) Both permits shall be laminated byCampus Enforcement and Patrol andshall be hung from the rearview mirror ofthe vehicle so as to be clearly visiblethrough the front windshield from out-side the vehicle when it is on campus.

Car pools20. (1) Two or more employees, or three or

more students, may apply for a singlepermit at the appropriate fee for use in acar pool.

(2) An application shall be completed foreach vehicle in the car pool.

Car pool permits21. Car pool permits shall be laminated byCampus Enforcement and Patrol and shall be hungfrom the rearview mirror of the vehicle so as to beclearly visible through the front windshield from out-side the vehicle when it is on campus.

Replacement permits22. (1) Replacement permits may be issued as

circumstances require upon sale of vehi-cles or replacement of windshields or inother circumstances as considered

appropriate by Campus Enforcementand Patrol.

(2) Recognizable portions of the valid permitpreviously issued shall be returned toCampus Enforcement and Patrol.

(3) An administrative fee as approved bythe board shall be charged for permitsissued under subsection (1).

Persons with disabilities23. (1) Persons physically disabled or having

some other health disability who requirespecial consideration regarding parkingmay make requests in writing to theassistant manager of CampusEnforcement and Patrol:(a) when submitting their application

form; or(b) regarding particular parking prob-

lems.(2) Every reasonable effort will be made to

accommodate requests made undersubsection (1).

(3) Medical verification of disability may berequired for an application under sub-section (1) by the assistant manager ofCampus Enforcement and Patrol.

Special occasions24. (1) Persons organizing conferences, semi-

nars, or inviting guest lecturers may con-tact the assistant manager of CampusEnforcement and Patrol concerningdesired parking arrangements.

(2) Where circumstances warrant specialtemporary permits may be issued for

those designated areas, the durationand upon the conditions as determinedappropriate by the assistant manager ofCampus Enforcement and Patrol.

(3) An administrative fee as approved bythe board shall be charged for permitsissued under subsection (2).

(4) A person shall not park a vehicle in vio-lation or contravention of any of the con-ditions of a special temporary permit.

Departmental permits25. (1) Departments, including those depart-

ments located off campus which haverequirements for personnel to visit otherdepartments or sections on campus ondepartmental business, may apply for aspecial departmental permit.

(2) Applications giving full details of specialrequirements shall be submitted in writ-ing by the dean, director, or departmenthead to the assistant manager ofCampus Enforcement and Patrol.

(3) A departmental parking permit shall onlybe used by members of a department incarrying out their duties to the universityor the hospital and is intended to providetemporary parking in a parking areaother than that allocated to the individ-ual.

(4) Departmental permits shall only be usedby currently registered permit holders invehicles registered with the university.

(5) The dean, director, or department headmaking an application under subsection(2) shall ensure that a departmental per-mit is not misused.

(6) The misuse of a departmental permitreferred to in subsection (4) may resultin the rescission of the permit.

Retired faculty and staff26. (1) Faculty and staff retired from the employ

of the university or the hospital mayapply for a parking permit.

(2) Permits issued under subsection (1)shall be free of charge.

(3) Notwithstanding subsections (1) and (2),permits to retired faculty and staff shallbe issued on a space available basis.

Prohibition27. (1) A person shall not deface, copy or dupli-

cate a permit issued under these regula-tions.

(2) A person shall not provide false or mis-leading information in the process ofobtaining a parking permit.

(3) A person shall not leave a vehicle con-tinuously parked on university land formore than 3 consecutive days withoutprior approval from the CampusEnforcement and Patrol.

Payment of fees28. (1) All fees referred to in these regulations

shall be as prescribed by the board.(2) Fees may be paid at a Campus

Enforcement and Patrol Office.(3) Fees may be paid by cash, cheque,

money order, or electronic debit whenavailable.

(4) Employees sending fees through themail may send their cheque or money

order payable to Memorial University ofNewfoundland.

(5) University employees may have theirparking fee paid through salary deduc-tion by completing and signing theapplicable portion of the applicationform.

(6) Applicants shall include their employeenumber on the application form.

(7) Applications for payroll deduction shallnot be accepted after September 30 inthe current parking year.

Prorated permits29. (1) Permits issued for the current parking

year shall be valid from May 1 to April 30.(2) Permits issued after June 30 in the cur-

rent parking year shall be proratedmonthly.

Cancellation of permits30. (1) A permit holder wishing to cancel a park-

ing permit shall do so by returning rec-ognizable portions of the decal or permitto Campus Enforcement and Patrol.

(2) Individuals requesting a refund shallcomplete a request for refund form.

(3) Where the original payment was in theform of cash or cheque, a 30 day pro-cessing period shall apply.

(4) Where the original payment was a pay-roll deduction(a) a lump sum deduction shall be

processed against the applicant'spayroll to close out an outstandingbalance; or

(b) where there is no outstanding bal-ance, the request for refund shall beprocessed and a cheque available30 days from the final payroll deduc-tion.

(5) It is the responsibility of the employee toinitiate the refund process.

(6) A prorated refund shall be made, ifapplicable.

(7) An administrative fee shall be deductedfrom a refund, and a minimum refundshall apply after that administrative feehas been deducted.

(8) Refunds shall be calculated by CampusEnforcement and Patrol and paid bycheque from the Comptroller's Office.

Cancellation of gate control cards31. (1) A permit holder who is issued a gate

control card with a permit and who wish-es to cancel his or her permit may berequired to return the control card and allrecognizable portions of the decal orpermit.

(2) Where the control card is submitted toCampus Enforcement and Patrol, therefund shall be calculated in accordancewith these regulations.

Alternative designated areas32. (1) The issuance of a permit for a designat-

ed area does not guarantee that parkingspace will be available at all times in thatarea.

(2) Where the assigned area on 1, 1A, 2, 3,4, 5, 6, 7, 7A, 8, 9, 10, 10A, 11, 12, 14,15, 15A, 15B, 16, 16A, 17, 18, 19, 20,

21, 22, 23, 24, 25, 26, 27, 28, 31, 36, 51,52, 56, 56A, 60 or 62 is fully occupied,alternative parking for valid permit hold-ers is Area 16A.

After hours parking33. Parking areas 9, 16A are available, under nor-mal circumstances, to a vehicle with a valid univer-sity parking permit after 3 p.m.

Alternate parking for permit holders34. (1) A vehicle displaying a valid university

parking permit may, as space permits,park in another parking area at the fol-lowing times:(a) between Monday 5 p.m. and

Tuesday 7 a.m.;(b) between Tuesday 5 p.m. and

Wednesday 7 a.m. ;(c) between Wednesday 5 p.m. and

Thursday 7 a.m. ;(d) between Thursday 5 p.m. and

Friday 9 a.m. ;(e) between Friday 4 p.m. and Monday

7 a.m. ; and(f) during statutory holidays and other

times when the university buildingsare closed.

(2) Subsection (1) does not apply to ParkingAreas 1, 1A, 2, 8, 9B (East), 9H, 10,10A, 11, 12, 13, 14, 24, 25, and 56A oncampus and parking areas with controlgates or parking meters.

Closure of parking areas35. (1) Parking areas may be closed when nec-

essary for maintenance, cleaning, snowclearing, safety or other purposes.

(2) A person shall not park in a parking areathat has been closed.

Trailer36. (1) Trailers shall not be parked on campus

unless explicit permission is given byCampus Enforcement and Patrol.

(2) A person shall not park a trailer in a man-ner that violates or contravenes this sec-tion.

Parking prohibitions37. (1) A person shall not park a vehicle in des-

ignated parking areas for which a permitis required without a valid permit for thatarea.

(2) A person shall not park a vehicle in adesignated parking area for which thatperson has a valid permit without prop-erly displaying the permit as specified inthese regulations.

(3) A person other than the holder of a per-mit shall not park a motor vehicle in anarea for which a permit is required.

(4) A person shall not park a vehicle in sucha way as to occupy more than one park-ing space within a designated parkingarea.

(5) A person shall not enter a designatedparking area which is controlled by agate control device or for which paymentis required other than through the desig-nated entry way.

Interference with other vehicles38. A person shall not park a motor vehicle uponuniversity land in a manner as to interfere with theparking of other motor vehicles or other motor vehi-cles attempting to enter upon or leave a portion ofuniversity land.

Parking prohibited39. (1) Where a sign which has the words "NO

PARKING" or a symbol for "NO PARK-ING" inscribed on it is erected on a road-way and the part of the roadway towhich the sign is applicable is clearlyindicated by painted lines or words ormarkers on the roadway or by additionalwords inscribed on the signs describingthe area to which the prohibition of thesign is applicable by name or otherdescription or by reference to anothersign erected on or near the same road-way, the driver of a vehicle shall not parkthe vehicle in the area to which the signapplies, or between the hours or duringthe time specified on the sign.

(2) Where a sign which has the words "NOPARKING EXCEPT UNDER PERMIT"or a symbol for "NO PARKING EXCEPTUNDER PERMIT" inscribed on it iserected on a roadway and the part of theroadway to which the sign is applicableis indicated by painted lines or words ormarkers on the highway or by additionalwords or symbols inscribed on the signdescribing the area to which the prohibi-tion of the sign is applicable by name orother description or by reference toanother sign erected on or near thesame roadway, a person other than theperson to whom the permit was issued

shall not park a vehicle in the area towhich the sign applies.

(3) A person shall not park a vehicle in amanner that violates or contravenes thissection.

Prohibited parking40. (1) A person shall not park any vehicle in

any parking meter space at any timeunless the driver or operator of that vehi-cle, immediately after parking the vehi-cle in the parking meter space, depositsin the parking meter adjacent to thatparking meter space a coin or coins asindicated on the parking meter for eachsixty minutes of time or part of it duringwhich the vehicle is to be parked in theparking meter space.

(2) Upon compliance with these require-ments, the person shall be entitled touse the parking meter space for parkingpurposes for the interval of time indicat-ed by the timing mechanism of the park-ing meters.

(3) A person shall not allow a vehicle toremain parked in any parking meterspace for a period longer than that forwhich payment has been made by thedriver or operator in the form of coinsdeposited in the parking meter adjacentto that parking space but the driver oroperator may park a vehicle in a parkingspace for the unexpired time remainingon the parking meter from this previoususe without depositing a coin in themeter.

(4) A person shall not permit a vehicle toremain in a parking space while the sig-

nal "Expired" or "Violation" is in view onthe parking meter.

(5) A person shall not permit a vehicle topark or cause or permit to be parked inany parking meter space any motorvehicle forming part of the stock-in-tradeof any company or person who is a deal-er in motor vehicles.

(6) A person shall not park a vehicle at ametered parking space other than in thedirection of the normal traffic flow.

(7) A person shall not allow a vehicle toremain parked in any parking meterspace for any period longer than themaximum period of time indicated by themarking on the face plate of the parkingmeter adjacent to the parking meterspace.

(8) A person shall not park any vehicle insuch a manner that it is not wholly withinthe area designated or marked underthese regulations as a parking meterspace and, if a vehicle of a length so asto prevent it from being parked within oneparking meter space and occupies part ofthe adjoining parking meter space, thenthe person parking that vehicle shallmake the necessary deposit of coins asrequired by these regulations in the park-ing meter for each of the adjoining park-ing meter spaces occupied in whole or inpart by the vehicle as if that person hadparked two vehicles in the adjoining park-ing meter spaces.

General prohibition41. (1) Except where otherwise provided or

where necessary to avoid conflict with

traffic or to comply with the law or thedirections of a traffic officer or traffic-control device, a person shall not stop,stand or park a vehicle on a roadway oruniversity land so that the vehicle or apart of it is(a) in violation of the direction provided

by any sign erected and applicableto the area in which the vehicle isparked;

(b) on a campus roadway;(c) in a no parking area;(d) double parked;(e) in an area that is not clearly defined

as a parking space;(f) occupying more than one marked

parking space;(g) on a sidewalk, walkway, landscaped

area or in any area not designatedor intended to be used for parking;

(h) in front of a public or private drive-way;

(i) in front of an authorized loadingdoor designated as that by theDirector of Facilities Management;

(j) within an intersection or within 6metres of an intersection;

(k) within one metre from the point onthe curb or edge of the roadwayimmediately opposite a fire hydrant;

(l) within 3 metres of a fire exit;(m) within a hospital emergency area;(n) within a designated fire lane;(o) within a designated loading zone;

(p) within a crosswalk;(q) within 6 metres of the approach of a

crosswalk;(r) within 10 metres upon the approach

to a flashing beacon, stop sign ortraffic-control signal located at theside of a roadway;

(s) within a designated bus stop or dropoff area;

(t) within 6 metres of a designated busstop or drop off area;

(u) alongside or opposite a street exca-vation or obstruction when stopping,standing or parking obstructs traffic;

(v) on the roadway side of a vehiclestopped or parked at the edge orcurb of a roadway;

(w) in a manner contrary to the direc-tions of a posted sign;

(x) obstructs or impedes the movementof other vehicles or pedestrians; or

(y) in a place in contravention of a traf-fic-control device that gives noticethat stopping, standing or parking isthere prohibited or restricted.

(2) Except where otherwise provided orwhere necessary to avoid conflict withtraffic or to comply with the law or thedirections of a traffic officer or traffic-control device, a person shall not stop,stand or park a vehicle on a highway sothat the vehicle or a part of it is in a placeof contravention of a traffic-controldevice that gives notice that stopping,standing, or parking is there prohibitedand restricted.

(3) Except where otherwise permitted, a dri-ver shall not stop, stand or park a vehi-cle on a highway other than on the rightside of the highway parallel to that sideand, where there is a curb, with thewheels within 30 centimetres of thecurb.

Parking approval-Facilities Management42. (1) Except in accordance with the Act or these

regulations the driver of a vehicle shall notpark the vehicle upon university landunless permission has been obtained fromthe Director of Facilities Management,either orally or in writing and either withoutor subject to conditions.

(2) A driver who receives permission undersubsection (1) shall park the vehicle inaccordance with the conditions to whichthe permission is subject or, where thereare no conditions, as otherwise directedby the Director of Facilities Management.

Disabled parking43. (1) For the purposes of this section:

(a) "disabled parking space" means aparking space set aside for disabledpersons to park a motor vehicle andso designated by the parking prohib-ited except disabled sign;

(b) "parking prohibited except disabledsign" means the sign used to desig-nate that parking is prohibited at alltimes, disabled drivers excepted, onall days, in the directions indicatedby the arrows and the sign shall con-form to the specifications of the RB-71 sign in the 4th edition of the

Manual of Uniform Traffic ControlDevices for Canada;

(c) "international wheelchair logo"means the sign or symbol with awhite wheelchair on a blue back-ground; and

(d) "permit" means the permit bearingthe international wheelchair logowhich has been issued by theProvince of Newfoundland andLabrador .

(2) A person, other than the holder of a validpermit or a person accompanying a per-mit holder, shall not park a motor vehiclein a disabled parking space.

(3) Every person who holds a permit andparks in a disabled parking space shalldisplay that permit in the driver's side,lower portion of that vehicle's windshieldwhile parked in that space.

(4) For the purpose of this section, a motorvehicle displaying a valid special licenseplate or valid parking permit with theinternational wheelchair logo and issuedunder the laws of a province other thanthe Province of Newfoundland andLabrador or a state of the United States,shall be recognized as valid and allow-ing the special parking privileges provid-ed in these regulations.

Visitor's parking44. A person who is not a visitor shall not park amotor vehicle in a parking space designated for vis-itor’s parking.

Enforcement45. (1) Any person who violates or contravenes

any provision of these regulations isguilty of an offence and is liable to thefine set out in the schedule, or whereno fine is set out, to the penalty providedin the Act.

(2) A vehicle parked in violation of theseregulations or the Act may be towed andimpounded at the direction of a CampusEnforcement and Patrol officer where:(a) the parking offence continues for 48

hours;(b) the vehicle is interfering with the

parking of other motor vehicles;(c) the vehicle is interfering with other

motor vehicles attempting to enterupon or leave a portion of universityland;

(d) the vehicle is obstructing the flow oftraffic on a roadway or parking area;

(e) the vehicle is parked in a fire lane orloading zone; or

(f) the vehicle is parked in a mannerthat creates a hazard to pedestriansor other vehicles.

Possession of vehicle without consent46. (1) The owner of a vehicle shall incur the

penalties provided for a violation ofthese regulations with respect to a vehi-cle owned by him or her unless at thetime of the violation the owner establish-es that some person, other than theowner, was in possession of the vehiclewithout the consent of the owner.

(2) Nothing in this regulation shall relieve thedriver or operator referred to in subsec-tion (1) from incurring the penalties pro-vided for a violation of these regulations.

Rescinding permits47. A parking permit may be rescinded the

Director of Facilities Management for(a) obvious disregard of these regulations;(b) defacing a permit;(c) copying or duplicating a permit;(d) misuse of a permit;(e) supplying false information; or(f) damaging or tampering with a traffic con-

trol device or sign.

Rescinded permits48. Persons whose university vehicle parking per-mits have been rescinded shall not be eligible for arefund.

Towing fee49. A towing fee as prescribed by the board shallbe charged by the university and shall be payableduring normal business hours at the CampusEnforcement and Patrol Office on the St. John'scampus or at the Bursar’s Office at the GrenfellCampus, Corner Brook.

Impounding fee50. An impounding fee per day or any part of aday as prescribed by the board may be charged foran impounded vehicle and shall be payable duringnormal business hours at the Campus Enforcementand Patrol Office on the St. John's campus or at theBursar's Office at the Grenfell Campus, CornerBrook.

Release of seized vehicles51. Vehicles towed or impounded shall bereleased to the registered owner on the payment ofthe applicable towing and impounding fees.

Repeal52. The Traffic Control and Parking Regulations,Consolidated Newfoundland and LabradorRegulation 1123/96, is repealed.
