EYN O T E A D D

RESS

This session will highlight trends in the global ultra high net worth population, with a specific focus on the Caribbean and Bermuda. We will assess global trends in wealth creation and compare these findings with the situation in the Caribbean and Bermuda:

• There are now 211,275 UHNW globally, 6% growth from last year - why do we see such growth in this population?

• The world’s UHNW individuals hold 25% of their wealth in cash and cash equivalents - how do UHNW individuals decide on optimal asset allocation?

• 6% of the world’s UHNW population is expatriated and the Caribbean and Bermuda are increasingly important destinations for these individuals - what explains these movements and who does it attract?

• In the next five years, we expect to see the population of UHNW individuals grow by almost 30% - what does this imply for Bermuda and what other trends are relevant?

Protecting Trustees: Personal Liability for Trustees & Directors

In the modern era of professional and sophisticated trust administration, the level of remuneration paid to trustees can sit uneasily with the level of protection from liability afforded to trustees by, e.g., widely drawn exoneration clauses and Beddoes orders. This panel discussion will take a fresh look at the risk of personal liability for trustees and ask whether the cards are unfairly stacked against the interests of beneficiaries. Amongst the themes that will be touched upon are:

• Exoneration Clauses, their permissible scope and limitations

• Limitation of liability in third party contracting • The rise of the Private Trust Company • The Beddoes Order as an aspect of 21st Century

trust administration

21st Century Structuring Options Are global transparency and reporting initiatives

gradually discouraging the formation of certain trust structures or are new opportunities for wealth preservation being created? This session will consider these issues and will also look at the following:

• Opportunities and challenges with current and future structuring options

• How to balance a settlor’s need for control and avoiding risks of challenge. When is too much control detrimental to a structure?

• When is a corporate versus trust structure desirable?

• Alternatives to trust structures, are there any left?

11.50 The Good, The Bad and The Ugly: Changes Coming to a Theatre near

You from the United States We are living in an era of unprecedented change – tax,

legal, political, economic, cultural and scientific -- much of it being generated by the United States. This program will make observations on how difficult it has become to do estate planning and wealth preservation for high net worth clients when the rules change constantly. It will cover:

• Tax changes around the world (as they impact one another)

• Enforcement changes leading to FATCA • Changes in access to information • Changes in the nature of families • Changes in the frequency of intrafamily litigation

The session will then review what changes are likely in transition, which will return to “normal,” and which changes are here to stay - and how best to advise in the meantime.

12.30 Estate and Succession Planning in a Brussels IV World

Brussels IV aims to enhance free movement of persons in relation to cross-border estates, allow EU citizens to organise their succession in advance and guarantee the rights of heirs, legatees and other family members, and of creditors of the estate. The impact of the new regulations will be widespread, and beyond the EU states signed up. This session will highlight potential solutions to the new legislation:

• Exclusions • Choice of national law • Renvoi • Nationals of non-Brussels IV states who are

habitually resident in a Brussels IV state • Nationals of Brussels IV states habitually resident in

non-Brussels IV states • Matrimonial property regimes: forced heirship &

firewall legislation
