SummaryThese Guidelines outline Disability Employment Services Providers’ (herein referred to as ‘DES Providers’) responsibilities and required actions when transferring or receiving transferred Participants in Disability Employment Services.

A Participant may change DES Providers in their local Employment Service Area (ESA) if the Participant: moves to a new location—relocation or DES Provider, requests a transfer by the Department, if at any time the Participant and DES Provider are

unable to achieve or maintain a reasonable and constructive service relationship—relationship failure requests to change DES Provider and both DES Providers agree to the change—by agreement or requests the Department to change DES Provider where the Participant can demonstrate they would receive

better services that could enhance their employment prospects from another DES Provider — better services for the Participant with another DES Provider; or

requires a change of DES Provider as a result of an Ongoing Support Assessment recommendation—Assessment.

Permanent Address of job seekerSubject to Attachment A, a DES Provider may only transfer a job seeker whose Permanent Address is located in an ESA specified in the receiving DES Provider’s Schedule.

A Participant’s local ESA is the ESA where a Participants permanent home address is located in.

In all cases, the receiving Provider must immediately facilitate and cooperate with the transfer to ensure services continue to be provided to the Participant without delay.

Transfer due to relocation:

When Participants notify Centrelink of a change of address Centrelink will record the new address and notify the Department via the Department’s IT System.

The Department will determine if the Participant requires a transfer due to relocating.

For Participants in Employment Assistance

If a Participant remains in the same ESA and their new location is within a reasonable distance of their current DES Provider Site, they will not be transferred and the DES Provider must continue to provide services to the Participant at no additional cost to the Department.

End of Process

If a Participant remains in the same ESA and their new location is within a reasonable distance of another Site of the current DES Provider that is contracted to deliver the same Programme Services the Participant was receiving at the time of the relocation, the DES Provider can transfer the Participant to that Site and continue to provide services without interruption.

End of Process

If a Participant remains in their current ESA but not within a reasonable distance of a Site of their current DES Provider, the Participant and DES Provider should discuss options for transfer to another DES Provider. See ‘Transfer by agreement’

If the Participant moves to a new ESA, and the original DES Provider does not have a Site in the new ESA, the Department will automatically allocated to a new DES Provider in the new ESA. Proceed to Step 2.

If the Participant moves to a new ESA and the original DES Provider is contracted to deliver the same Programme Services the Participant was receiving at the time of relocation, the Department will transfer the Participant to a new Site in the new ESA within the same organisation. Proceed to Step 4

For Participants in the Post Placement Support (PPS) or Ongoing Support (OS) phase

The Department’s IT system will check for participation in OS or PPS and no transfer will occur for these Participants. The DES Provider must continue to provide services to the Participant at no additional cost to the Department.

End of Process

If it is not possible to continue to provide services to the Participant, a transfer may be appropriate. See ‘Transfer by Agreement’ or ‘Transfer due to Better Services for the Participant with another DES Provider’.

2. The Department

Participant requires a new DES Provider or a new Site

The Participant will be be transferred by the Department (or the Department to a new DES Provider. The original DES Provider will receive a noticeboard message. Proceed to Step 3.

with their original DES Provider

If the Participant has transferred to a new DES Provider or Site, the new DES Provider or Site will receive a noticeboard message. Proceed to Step 4.

3. Participant

The Participant receives notification of transfer and given a choice of DES Provider.

Clause 81.4

After the DES Provider receives notification that the Participant has been transferred to them, the Participant will receive the details of their new DES Provider via their personal page and SMS and/or email if those are identified as being a preferred method of contact.

The Participant will also be given the option to choose a different DES Provider to the one they have been allocated. If the Participant takes up this option, they must contact the National Customer Service Line (NCSL) within five business days of being transferred.

4. DES Provider

The new DES Provider, or original DES Provider’s new Site, arranges an initial Contact appointment and starts delivering services to the Participant

The new DES Provider, or the new Site, must immediately facilitate and cooperate with the transfer so as to enable services to continue to be provided to the Participant. This includes contacting the Participant to arrange a suitable initial Contact appointment.

Note 1: Standard compliance rules apply for Activity Tested Participants who do not attend. See Disability Employment Services Participant Compliance Guidelines.

Note 2: There may be instances where the Department’s IT System automatically allocates a Participant who has relocated under the Connecting People with Jobs initiative to a DES Provider that has not been involved in the negotiation of the Participant’s Connecting People with Jobs Agreement. If this occurs, the receiving DES Provider must agree to transfer the Participant to the appropriate DES Provider so that the negotiated relocation assistance can be provided.

At the initial Contact appointment with the transferred Participant, the new DES Provider or the new Site must:

explain the Programme Services that the DES Provider will provide; and

review and update the Participant’s Job Plan and

commence delivering Programme Services in accordance with his or her Job Plan.

Where the Participant has relocated under the Connecting People with Jobs initiative, the previous and the new DES Provider should discuss their roles and responsibilities, including support to be provided to the Participant and expenses to be covered under the initiative, including any wage subsidies. If an agreement cannot be reached, the the Department contract manger should be notified. The Department will not pay the same expenses to both Providers. Refer to the Connecting People with Jobs Advice.

Note: While an Initial Interview session type will be used in the Providers Electronic Diary for the Participant transferring in, the DES Provider does not have to deliver all of the required information and services of the Initial Interview as per the Disability Employment Services Deed.

details and history of events. Some information that relates to previous DES Providers, such as Skills Assessment or Participation Reports will show as completed but the detail will not be accessible to the new DES Provider.

If a DES Provider is unable to achieve or maintain a reasonable and constructive service relationship with a Participant the DES Provider is able to apply to National Customer Service Line (NCSL) staff for a Participant transfer located within the Participants ESA. The DES Provider should fill out the transfer form and forward this to the Departments NCSL staff for review and determination along with evidence to support the request, so that the Departments NCSL staff can review the request and make a determination.

Note: It is expected that DES Providers must take every action possible to resolve the difference with the Participant prior to requesting a transfer.See detail in Step 2 for points on what the Department will consider when making a determination.

If the Department approves the transfer, proceed to Step 3

If the Department determines not to approve the transfer, proceed to Step 4

2. Participant

Participant applies to the Department NCSL for a transfer

The Participant may apply for a transfer if they feel they are unable to achieve or maintain a reasonable and constructive service relationship with their DES Provider, or they believe they will receive better services that could enhance their employment prospects from another DES Provider located within the Participants ESA. If applicable, the NCSL staff will complete the relationship failure form on the Participant’s behalf.

The NCSL wil undertake the same process to determine if the transfer is appropriate.

When a request is received the Department may take into account any relevant matter including, but not limited to:

the DES Provider and the Participant can no longer work together to service the Participant’s needs; or

the services outlined in the Participant’s Job Plan and the Service Guarantee are not offered by the DES Provider. For example, a Participant may receive more appropriate services from a Specialist Service Provider; or

the Participant, general public or any staff member of a DES Provider is likely to be harmed as a result of a continuing relationship (harm may include violence or harassment) or there is a lack of sensitivity to the cultural needs of groups such as Indigenous Participants and Participants from culturally and linguistically diverse backgrounds; or

the reasons provided by the Participant as to why he or she would receive better services that could enhance their employment prospects from the other DES Provider.

The evidence for this decision could include:evidence of counselling, conflict resolution or mediation

services;Participation Report/s;entries on the Participant’s file;ongoing entries made by NCSL staff in the Department’s IT

System; or

Participant Incident Report/s (as relevant).

If the Department approves the transfer, proceed to Step 3

If the Department determines not to approve the transfer, proceed to Step 4

3. The Department

The Department approves the transfer

The request will be investigated and a decision made based on the information provided. Once the decision is made, the Department will contact the DES Provider and the Participant to advise the outcome.

The NCSL may contact the DES Provider or the Participant, for more details regarding the request to transfer as part of their investigation into the relationship failure.

If the Department approves the transfer, the NCSL staff will arrange for the transfer of the Participant and book the Participant into an initial Contact appointment with the new DES Providerof their choice?

NCSL staff will inform the Participant of the available DES Providers (including Specialist Services Providers) in the area and provide information such as Performance Ratings and locations. Participants who do not select a DES Provider will be randomly allocated to a DES Provider within their ESA.

The original DES Provider will receive a noticeboard message that the Participant has transferred from their caseload.

The new Provider will receive a noticeboard message.

Proceed to Step 5

4. The Department

The Department determines not to approve the transfer

If the Department determines not to approve the application to transfer, the Department will notify the requesting party of the result of the determination. The Participant will not be transferred and the original DES Provider must continue to deliver Programme Services to the Participant.

Where a DES Provider or a Participant is not satisfied with the result of the determination, they may request that the decision be reviewed.

If a Participant or a DES Provider requests an internal review they must notify the NCSL in their State to request a review within 14 business days of the original decision. Reviews are preferably requested in writing and are to be processed within five business days from receipt of a review request where possible.

If the determination is changed the process will continue from Step 3.

5. DES Provider

DES Provider delivers services to the transferred Participant

The new DES Provider must immediately facilitate and cooperate with the transfer so as to enable services to continue to be provided to the Participant. This includes contacting the Participant to arrange a suitable initial Contact appointment. See the Employment Pathways Plan Guidelines for more details.

At the initial Contact appointment with the transferred Participant, the new DES Provider must:

explain the Programme Services that the DES Provider will provide; and

review and update the Participant’s Job Plan andcommence delivering Programme Services in accordance with

his or her Job Plan.

Note: While an initial Interview session type will be used in the Providers Electronic Diary for the Participant transferring in, the DES Provider does not have to deliver all of the required information and services of the Initial Interview as per the Disability Employment Services Deed.

The new DES Provider will have access to Participant records, personal details and history of events. Some information that relates to previous DES Providers, such as Skills Assessment or Participation Reports will show as completed but the detail will not be accessible to the new DES Provider.

Service Fees are pro-rated, calculated by the Department and based on the period of time from the date of the initial Contact with the Participant by the receiving DES Provider to the end of the 13 week period in which the transfer occurred. The Department will not recover Service Fees from the Original DES Provider when Participants transfer.

Note: Service Fees are not pro-rated for Participants who transfer between Sites of the same DES Provider.

A Participant may discuss transferring to a different DES Provider with their current DES Provider. The current DES Provider should inform the Participant of their transfer options and discuss whether a transfer by agreement would be appropriate.

The current DES Provider or the Participant may approach a new DES Provider regarding a transfer by agreement.

When the original DES Provider, the new DES Provider, the Department and the Participant agree, a Participant is eligible for transfer by agreement.

The reason for the transfer may include transport or financial difficultites or that the new DES Provider would be more appropriate to the Participant’s needs, for example, a Specialist Service Provider.

When considering a transfer request, the current DES Provider should assess the Participant’s assistance requirements and level of engagement and make a decision on whether the transfer may be beneficial.

If the Participant is seeking to relocate for employment through Relocation Assistance to Take Up a Job, the two DES Providers should discuss their roles and responsibilities, including support to be provided to the Participant and expenses to be covered under the initiative, including any wage subsidies. If an agreement cannot be reached, the the Department contract manger should be notified. The Department will not pay the same expenses to both Providers – Refer to the Relocation Assistance to Take Up a Job Guideline.

If all parties agree to the transfer, proceed to Step 3

If all parties do not agree to the transfer, proceed to Step 2

2. Participant

All parties don’t agree to transfer

If all parties do not agree to a transfer the Participant will not be transferred and the DES Provider must continue to deliver Programme Services to the Participant.

If the decision is made to reject a transfer request, the original DES Provider should inform the Participant of the reason. However, if the Participant feels that they can demonstrate to the Department that they will receive better services that could enhance their employment prospects from another DES Provider in the Participants local ESA, they may contact the CSL to request a transfer due to relationship failure or better servicing—

Participant complete and sign the transfer form

A request for a transfer by agreement can be lodged electronically via the Australian JobSearch website

The DES Participant commences the process by lodging a request on the Australian JobSearch website. The DES Participant's request will first be sent to the proposed DES Provider for agreement

If the proposed DES Provider agrees, the transfer request will be sent to the DES Participant's current Provider.

If both DES Providers agree, the DES Participant will be automatically transferred.The current and proposed DES Providers must action the request for a transfer by agreement within three business days of receiving the request otherwise the request will be automatically declined.

Note: If either the current or the proposed Employment Provider declines the request, the transfer will not be actioned and the reason will be entered into the online form. The form will then be sent to the DES Participant.

Lodgement through the Employment Services System (ESSweb)A transfer by agreement request can also be lodged in the Department's IT Systems using the Transfer by Agreement Form, which is available on the Provider Portal and the Department's public website:

When all parties agree and sign the Transfer by Agreement Form, the current Employment Provider must enter the details into the Department's IT Systems to action the transfer. The current Employment Provider must retain a copy of the signed form

Where either the current or the proposed Employment Provider declines the transfer request, they should be informed of the outcome of the request.

Note: Participants with a current Level 3 Incident Report and Pre-release Prisoners cannot have their transfer completed through the Australian JobSearch website.The DES Provider of a Participant with a current Level 3 Incident Report (including Pre-release Prisoners) must contact the Department's Employment Systems Help Desk on 1300 305 520 to facilitate a transfer where agreement has been reached by all parties.

4. DES Provider

The Ongoing Support Assessment recommendation results in a Disability Management Service Participant’s transfer to Employment Service Support

Disability Employment Services Deed Clause References:

When an Ongoing Support Assessment (OSA) recommends that a Disability Management Service (DES-DMS) Participant requires the Employment Support Service (DES-ESS) of Moderate or High Ongoing Support the Participant must transfer to the DES-ESS Provider.

See Ongoing Support Guidelines.

If the original DES Provider is contracted to deliver the DES-ESS at the Site the Participant is registered, the DES Provider must transfer the Participant to the DES-ESS Provider and commence delivering the DES-ESS to the Participant without interruption.

End of Process

If the original DES Provider is contracted to deliver DES-ESS within the ESA at a Site within a reasonable distance of the current Site, the DES Provider must transfer the Participant to DES-ESS at the new site. The new Site must immediately facilitate and cooperate with the transfer so as to enable services to continue to be provided to the Participant.

End of Process

If the original DES Provider is not contracted to deliver DES-ESS in the ESA, the DES Provider must facilitate a transfer of the Participant to another DES-ESS Provider in the Participant’s local ESA.

Proceed to Step 2.

2. the Department’s IT System

Participant transfers to new DES Provider

The original DES Provider facilitates a teleconference with National Customer Service Line (NCSL) staff and the Participant to discuss the Ongoing Support Assessment recommendation and ascertain the Participant’s choice of Provider. Participants who do not choose a DES-ESS Provider will be randomly allocated to a DES Provider within their ESA.

Participants who are randomly allocated a new DES Provider will be notified of their new DES Provider and offered the opportunity to select a different DES Provider and the process via the Participant’s personal page and by SMS and/or email if those are identified as being a preferred method of contact.

Participants who have not already Commenced with the DES Provider they were allocated can contact the NCSL within five business days if he or she wishes to transfer to a different DES Provider.

The NCSL staff will arrange for the transfer of the Participant and book the Participant into an initial Contact appointment with the new DES Provider.

The original DES Provider will receive a noticeboard message that the Participant has transferred from their caseload.

The new DES Provider will see the transfer has been completed when the Participant appears on their caseload and they receive a noticeboard message.

services to the transferred Participant

Participant. This includes contacting the Participant to arrange a suitable initial Contact appointment. See the Job Plan Guidelines for more details.

At the initial Contact appointment with the transferred Participant, the new DES Provider must:

explain the Programme Services that the DES Provider will provide; and

review and update the Participant’s Job Plan andcommence delivering Programme Services in accordance with his or

her Job Plan.

Note: While an initial Interview session type will be used in the Providers Electronic Diary for the Participant transferring in, the DES Provider does not have to deliver all of the required information and services of the Initial Interview as per the Disability Employment Services Deed.

The new DES Provider will have access to Participant’s records, personal details and history of events. Some information that relates to previous DES Providers, such as Skills Assessment or Participation Reports will show as completed but the detail will not be accessible to the new DES Provider.

A Participant requires a Transfer due to:

RelocationParticipant relocates and advises Centrelink of new address and the Department’s IT System is notified.

Participants in Employment Assistance If Participant remains in their current ESA, is within a reasonable distance of their current DES Provider, the Participant will not be transferred and the DES Provider must continue to provide services at no additional cost to the Department. If the distance is not reasonable, the Participant and Provider should discuss a transfer to another Site or DES Provider (see: Transfer by Agreement).

Participants in Post Placement Support or Ongoing SupportNo transfer occurs and the Provider must continue to provide services at no additional costs to the Department. If it is not possible to continue to provide services, a transfer may be appropriate (see ‘Transfer by Agreement’ or ‘Transfer due to Better Services for the Participant with another DES Provider’.

AgreementAll parties (the original Provider, the new Provider and the Participant) agree to a transfer.

Relationship FailureTransfer applied for by a Participant or DES Provider to CSL staff. Transfer form forwarded by DES Provider or completed by CSL staff on behalf of Participant. The Department will investigate the request.

AssessmentRequires a change of DES Provider or a transfer to a new Site of the original DES Provider due to an Ongoing Support Assessment recommendation.If applicable, the DES Provider facilitates a teleconference with CSL Staff and the Participant to discuss the recommendation and transfer.

All parties agree/Transfer is approvedNote: Noticeboard messages will reflect the transfer.

Relocation: new DES Provider or original DES Provider’s new Site arranges a suitable time for an initial Appointment with the Participant.

Failure of Relationship: CSL transfers the Participant and books the Participant into an initial Appointment with the new DES Provider.

Agreement: the transfer form is signed by all parties and the signed form is retained by the original DES Provider on the Participant’s file. The original DES Provider transfers the Participant using the transfer screen in the Department’s IT System, unless an incident report is recorded, in which case CSL staff should be contacted to manually process the transfer. The new DES Provider arranges an initial Appointment with the Participant.

Assessment: Participant transfers to new DES Provider or a new Site of the original DES Provider. Old and new Provider will be notified via a noticeboard message that the Participant has transferred.

All Parties do not agree/Transfer is not approvedRelocation: The Participant will be notified via their Personal Page, SMS or email, of their new DES Provider and given the option to change DES Providers within five business days by calling the CSL. The CSL will then transfer the Participant and book them into an appointment with their chosen DES Provider.

Failure of relationship: The original DES Provider must continue to deliver Programme Services to the Participant. The Department will notify the appropriate parties that the transfer was not approved.

If the application was under relationship failure, the Participant may subsequently submit an application under the ‘better services for the Participant with another DES Provider’ provision.

Agreement: If the Participant feels that they can demonstrate to the Department that they will receive better services that could enhance their employment prospects from another DES Provider they should contact the CSL to request a transfer. (See: transfer due to a relationship failure or better services for the Participant with another DES Provider.)

Participant transferredThe new DES Provider or original DES Provider’s new Site, delivers services to the transferred Participant. The DES Provider must: explain the Programme Services that will be provided; review and update the Participant’s Job Plan and deliver the Programme Services to the Participant for the remaining Period of Service. Assessment: DES Provider transfers the Participant to a new Site and commences delivering the ESS.

Note: While an Initial Interview session type will be used for the Participant transferring in, the DES Provider does not have to deliver all of the required information and services of the Initial Interview as per the Deed.

ATTACHMENT B

Transferring a job seeker whose Permanent Address is located outside an ESA specified in the Schedule.

Specialist Providers Specialist Providers can receive transfers where a job seekers Permanent Address is located outside an ESA specified in their Schedule, but only where the relevant job seeker has the disability, or other characteristic, that the relevant specialist Provider specialises in; and where the above requirements are met, the specialist Provider must deliver Programme Services to the job seeker in accordance with the Disability Employment Services Deed. That is, the specialist Provider must:

only deliver Programme Services from a Site within the Provider’s contracted ESA, unless otherwise approved by the Department in accordance with the Disability Employment Services Deed; and

is not permitted to establish a physical presence (either temporary or permanent) in an ESA that is not specified in their Schedule. This includes the operation of a mobile servicing facility to visit or otherwise service a job seeker whose Permanent Address is located outside an ESA specified in a specialist Provider’s Schedule.

Where exceptional circumstances exist, such that it is not possible for a job seeker to visit the specialist Provider (for example the job seeker is incapacitated) at a Site in the specialist Provider’s ESA, the specialist Provider may seek approval from their contract manager to deliver services to that job seeker at a location other than at the specialist Provider’s Site for a specified period. The relevant contract manager may grant such approval in writing at its absolute discretion.

Generalist Providers Generalist Providers cannot accept transfers from job seekers whose Permanent Address is located outside an ESA specified in their Schedule. However, where a job seeker wishes to choose a generalist Provider in another ESA, this may be considered in exceptional circumstances. Generalist Providers must seek approval from their contract manager on a case by case basis. The relevant contract manager may grant such approval in writing at its absolute discretion.

Reversing an automatic Centrelink Transfer of a job seekerCentrelink may automatically transfer Participants to a Provider in the ESA in which they permanently reside if the Participant submits a change of circumstances with a change of address.

This may result in Participants being inappropriately transferred when they have been Directly Registered by a provider in an ESA that shares a common boundary with the ESA that they permanently reside in. In this instance, the local Contract Manager will have to reverse the automatic Transfer made by Centrelink.

The Provider must Contact their local Contract Manager to request the reversal of the Transfer to enable the Participant’s Programme of Service to resume with the Provider.
