United Nations Treaty Notes (Declarations, Reservations and Notifications)

1.) St Vincent and the Grenadines has a Declaration under Chapter 4: 11 b. Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict. Declaration: “In accordance with Article 3, paragraph 2, of the Optional Protocol to the Convention on the Rights of the Child on Involvement of Children in Armed Conflicts, 2000, the Government of Saint Vincent and the Grenadines declares that the minimum age required for voluntary recruitment into the Police Force is nineteen (19) years in accordance with the Police Act, Chapter 280 section 6(1) of the Law of Saint Vincent and the Grenadines.”

2.) St. Vincent and the Grenadines has a Reservation under Chapter 5: 3. Convention relating to the Status of

Stateless Persons. Reservation:

3.) St. Vincent and the Grenadines has a Reservation under Chapter 5: 5. Protocol relating to the Status of Refugees.

Reservation:

"In accordance with the provisions of Article VII paragraph 1 of the aforesaid Protocol, however, the

Government of Saint Vincent and the Grenadines makes a reservation with respect to Articles IV of the Protocol

that, for the submission of any dispute in terms of that article to the jurisdiction of the International Court of

Justice, the express consent of all the parties to the dispute is required in each case."

4.) St. Vincent and the Grenadines has a Declaration under chapter 10: 6. Agreement establishing the Caribbean

Development Bank.

The instrument of ratification contains a declaration made in accordance with the first provision of the second

part of paragraph 3 of article 63 of the Agreement to the effect that the privilege conferred by article 53 shall be

restricted in its territory to treatment not less favourable than the Government concerned accords to international

financial institutions of which it is a member.

6.) St. Vincent and the Grenadines has a Reservation under chapter 16: 1 Convention on the Political Rights of Women.

Reservation:

“The Government of St. Vincent and the Grenadines reserves from the application of article III of this Convention

all matters relating to the recruitment to, and conditions of service in, the armed forces of St. Vincent and the

Grenadines.”

7.) St. Vincent and the Grenadines has a Declaration under chapter 18: 7. Convention on the Prevention and

Punishment of Crimes against Internationally Protected Persons, including Diplomatic Agents. Declaration:

“Saint Vincent and the Grenadines avails itself of the provisions of article 13, paragraph 2 of the aforesaid

Convention and declares that it does not consider itself bound by the provisions of paragraph 1 of that article

under which any dispute between two or more States Parties concerning the interpretation or application of this

Convention shall, at the request of one of them, be submitted to arbitration or referred to the International Court

of Justice, and states that in each individual case, the consent of all Parties to such a dispute is necessary for the

submission of the dispute to arbitration or to the International Court of Justice.”

and the Grenadines declares that in the application of this Convention to Saint Vincent and the Grenadines the

following treaties shall be deemed not to be included in the Annex referred to in its Article 2 paragraph 1(a):

1. Convention on the Physical Protection of Nuclear Material, adopted at Vienna on 3 March 1980.

2. International Convention for the Suppression of Terrorist Bombings, adopted by the General Assembly of

the United Nations on 15 December 1997.

Further, in accordance with Article 24 paragraph 2 of the said Convention, the Government of Saint Vincent

and the Grenadines declares that it does not consider itself bound by paragraph 1 of Article 24. The Government

of Saint Vincent and the Grenadines considers that any dispute may be referred to the International Court of

Justice only with the consent of all the parties to the dispute."

9.) St. Vincent and the Grenadines has a notification under chapter 18: 12. United Nations Convention against

Transnational Organized Crime. “Pursuant to articles 5(3), 16(5), 18(13), 18 (14) and 31(6), the Government of

Saint Vincent and the Grenadines would like to notify the Secretary-General of the following:

Article 5 of the above mentioned Convention deals with criminalization of participation in an organized group.

Section (3) asked to provide the requisite legislation that deals with serious crimes being committed by organized

criminal group. The definition for “serious crime” as identified by the convention means any conduct constituting

an offence punishable by a maximum deprivation of liberty of at least four years or a more serious penalty. An

“organized criminal group” is defined by the Convention as a structured group of three or more persons, existing

for a period of time or acting in concert with the aim of committing one or more serious crimes or offences

established in accordance with the Convention, in order to obtain, directly or indirectly, a financial or other

material benefits. A “structured group” means a group that is not randomly formed for immediate commission

of an offence and that does not need to have formally defined roles for its members, continuity of its membership

or a developed structure.

There are several offences under the Criminal Code Cap. 124 of the Laws of Saint Vincent and the Grenadines.

Revised Edition 1990 which deals with Offences that are punishable by four years or more. Some of these are

Bribery (Police Act), Theft on indictment (section 215 Cap 124), Drug trafficking (Drug (Prevention) and Misuse

Act), Extortion (85-93), Sexual exploitation of children (199-207), Prostitution (123-140), Blackmail (232), Forgery

and Counterfeiting (239-260), Obtaining property by deception (223), Obtaining services by deception (225),

Treason (Section 41), Piracy (Section 50), Murder (Section 159), Genocide (Section 158), Abduction, Kidnapping

and similar crimes (Section 199-204), Money Laundering (Proceeds of crime and Money Laundering (Prevention)

Act No. 39 of 2001) and Terrorism (United Nations (Anti-Terrorism Measures) Act No. 34 of 2002).

The Criminal Code does not deal with the element of the definition which speaks to these crimes being

committed by an organized or structured group.

Article 16 (5) of the above mentioned Convention highlights the legal basis for extradition by state parties

under this Convention. International Law permits that state parties to a convention takes the Convention as the

legal basis for extradition between the state parties. The Fugitive Offenders Act Cap. 126 of the Laws of Saint

Vincent and the Grenadines, Revised Edition 1990, makes new provision for the return from Saint Vincent and the

Grenadines or persons found therein who are accused of, or have been convicted of offences in other countries

and whose return is requested by such other countries and for matters related thereto.

Article 18(13) seeks notification on the Central Authority designed for the purpose of Mutual Legal Assistance.

The Central Authority is the Attorney General’s Chambers, Ministry of Legal Affairs, Methodist Building, Corner

Granby & Sharpe Streets, Kingstown, Saint Vincent and the Grenadines

Article 18 (14) seeks notification as to the language that is acceptable by the State party. English Language.

Article 31 (6) requires the name and address of the authority or authorities that can assist, state parties in

developing measures to prevent transnational organized crime.

1, the consent of all parties to the dispute is required in each case.”

“In accordance with Article 287, of the 1982 United Nations Convention on the Law of the Sea of 10 December

for the Law of the Sea established in accordance with Annex VI, as the means of settlement of disputes

concerning the arrest or detention of its vessels.”
