YYÖÖNNEETT‹‹MM KKUURRUULLUU // MANAGEMENT BOARD


1994 y›l›nda 544 say›l› KHK ile kurulmufl genç vedinamik bir kurum olan Türk Patent Enstitüsü(TPE), bilindi¤i gibi, ülkemizde patent, faydal›model, marka, co¤rafi iflaret ve endüstriyel tasar›mgibi s›nai mülkiyet haklar›n›n korunmas›ndansorumlu ve yetkili tek kurum olup çal›flmalar›na,yepyeni bir vizyon ve yeni projeler ile h›zla devametmektedir. Yak›nda TBMM’ne sunulacak olan veAvrupa Birli¤i Komisyonunun olumlu görüfl verdi¤iEntegre Devre Topografyalar› yasa tasar›s›n›nkanunlaflmas›yla birlikte, TPE’nin sorumlu olaca¤›s›nai mülkiyet haklar› daha da geniflleyecektir.

Türkiye’de sözkonusu haklar ile ilgili ilk yasalaroldukça eski olup, 19. yüzy›l›n ikinci yar›s›na,Osmanl› ‹mparatorlu¤u dönemine dayanmaktad›r.Nitekim ilk patent kanunu 1879, ilk markalar yasas›ise 1871 y›l›nda oluflturulmufltur. Bununla beraber,ülkemizde s›nai mülkiyet alan›nda modern biryaklafl›m› simgeleyen TPE’nin kuruluflu vesözkonusu yasalar›n modernlefltirilme çabalar›,toplu olarak ancak 1994 y›l›nda bafllat›labilmifltir.1994 y›l›nda kurulan TPE ve ard›ndan s›naimülkiyet haklar› ile ilgili olarak Gümrük Birli¤imevzuat›na uyum çerçevesinde gündeme gelen

The Turkish Patent Institute, a young and dynamicinstitution that has been established in 1994 inaccordance with the Decree Law No: 544, and theonly such establishment responsible andauthorized with the protection of industrialproperty rights, such as patents, utility models,trademarks, geographical indications andindustrial designs, continues to function with abrand new vision and new projects. As soon as theproposal for Law on Topographies of IntegratedCircuits, which has been affirmed by the EuropeanCommunity Commission and shall be presented toThe Grand National Assembly of Turkey, is put intoforce, the area of industrial property rights that theTPI shall be responsible of shall expand.

The first laws concerning the fore mentioned rightsin Turkey date back to the second half of the 19thcentury, i.e. the period of the Ottoman Empire.Thus, the first patent and trademark laws have beenestablished in 1879 and 1871 respectively. Due allthis, the establishment of the TPI, which representsa modern perspective to the industrial propertyrights, has only been started in 1994. The studiespertaining to the "establishment of new

"yeni yasalar›n oluflturulma" ve "uyumlaflt›r›lma"çal›flmalar›, günümüzde de devam etmektedir.Bunun nedeni s›nai mülkiyet sisteminin genelyap›s›ndan kaynaklanmakta; ilgili haklar konusun-da dünyada meydana gelen h›zl› geliflmeler, ülkemevzuatlar›n›n da sürekli bir flekilde gözden geçir-ilmesini gerekli k›lmaktad›r.

Öte yandan, 1999 y›l›nda gerçeklefltirilen HelsinkiZirvesinden beri Avrupa Birli¤ine aday ülke konu-munda olan ülkemiz; patent konusunda benzeri birbirli¤e girmifl durumdad›r. Nitekim TPE, 2000 y›l›Kas›m ay› itibariyle Avrupa PatentOrganizasyonuna kabul edilerek, böylesine teknikve ekspertiz gerektiren bir konuda, dünyan›n say›l›ülkeleri ile ayn› ligde mücadele etme ve teknikiflbirli¤i yapma imkan›n› elde etmifltir. Türkiye,merkezi Münih’te bulunan Avrupa Patent Ofisi’ninart›k 20. üyesidir.

Enstitümüzün yurtd›fl› iliflkileri yaln›zca AvrupaPatent Organizasyonu ile s›n›rl› de¤ildir. DünyaTicaret Örgütü (WTO), Dünya Fikri MülkiyetTeflkilat› (WIPO) ve Topluluk Marka Ofisi (OH‹M)de, Enstitünün sürekli iletiflim içerisinde oldu¤u,önemli yükümlülüklerinin bulundu¤u uluslararas›sekreteryalar aras›ndad›r. Yükümlülüklerdenbahsederken, 1995 tarihli Gümrük Birli¤indendolay› Türkiye’nin gerçeklefltirmekle yükümlüoldu¤u mevzuat uyumu, TPE’nin en önemli görev-leri aras›ndad›r.

Bu çal›flmalar, ilgili mevzuat bazal›narak yap›lan her türlü tescil ve dokümantas-yonun yan›s›ra, e¤itim, bilgilendirme vebilinçlendirme faaliyetlerini de kapsamaktad›r.Yaklafl›k 20 farkl› yasa ve yönetmelikten meydanagelen s›nai mülkiyet mevzuat›n›n tam olarakbenimsenmesi, iyilefltirilmesi, revizyonu, AvrupaBirli¤i ile uyumlaflt›r›lmas›, do¤ru yorumunun


legislation" and "harmonization" that have beenintroduced after the establishment of TPI in 1994and the harmonization under the legislation ofCustoms Union, still continue today. The generalstructure of industrial property system generatesthe reason for this; the rapid developments aboutthe said rights obligate an overall review of thecountries’ legislations continuously.

On the other hand, our country, which has been acandidate for the European Union since theHelsinki Convention, has joined a similar union onpatents. Hence, having admission into theEuropean Patent Organization by the November of2000, TPI has obtained an opportunity to competeand cooperate in the same league, which in factgoverns a subject requiring high level of techniqueand expertise. Now, Turkey is the 20th member ofthe European Patent Office that is centered inMunich.

The international affairs of our Institute are notlimited with only the European PatentOrganization. World Trade Organization (WTO),World Intellectual Property Organization (WIPO)and Office for Harmonization in the Internal Market(OHIM) are among the secretariats with which theInstitute continuously communicates and to whichit has liabilities. Speaking of liabilities, theharmonization of legislations that Turkey isresponsible of under the Customs Union, dated1995, is among the high priority duties of the TPI.

It is no doubt that another area of duty of theInstitute, which is as important as the internationalaffairs, is the nation wide tasks. These studiescomprise, including education, information andincreasing the consciousness, any kind ofregistration and documentation under the relatedlegislations. Several issues which constitute theprinciple duties of the Institute are; the adoption,

temini, toplumun ilgili kesimlerinin bil-gilendirilmesi ve bilinçlendirilmesi gibi meseleler,Enstitünün temel görevlerinden baz›lar›d›r. Tüm buçal›flmalar; bulufllar›n özendirilmesi, bulufl vemarka sahiplerinin haklar›n›n gerekti¤i gibi korun-mas›, sözkonusu kiflilere belirli bir süre için üre-timde tekel hakk› verilmesi ve dolay›s›yla sanayiderekabetin düzenlenmesi ve korunmas› yönündeönemli ifllevlere sahiptir.

Bu arada üzerinde önemle durulmas› gereken birhusus da TPE’nin, ülkemiz s›nai mülkiyet sisteminioluflturan dört adet temel yap›tafl›ndan yaln›zca birtanesi oldu¤udur. Bilindi¤i üzere, modern bir s›naimülkiyet sitemini oluflturan ögeler 1) ihtisasmahkemeleri, 2) ilgili mevzuat altyap›s›, 3) yasaldayana¤a sahip bir vekillik sistemi, ve 4) patentofisi veya kurumu’dur. Dolay›s›yla, ülkemizde etkinve rekabet gücü yüksek bir s›nai mülkiyet sistemi-nin oluflturulabilmesi ve sanayi ile ticari hayatönündeki engellerin azalt›labilmesi için sistemintüm halkalar›n›n, eksiksiz olarak tamamlanmas›gerekmektedir. Bu çerçevede mevcut hedef, ihtisasmahkemelerinin say›s›n›n ivedilikle ço¤alt›lmas›,ilgili hakimlerimizin yetifltirilmesine öncelikverilmesi ve vekillik sisteminin bir an önce yasaldayana¤a kavuflturulmas›d›r.

Enstitüye yap›lan y›ll›k baflvuru say›s› 31.12.2000tarihi itibariyle 35 bini aflm›flt›r. Sözkonusubaflvurular içerinde patent baflvurular›n›n say›s›3,500 kadar olup, Enstitünün esas ifl yükünü farkl›bir alan, "markalar" ile ilgili ifllemler oluflturmak-tad›r. Marka baflvurular›n›n toplam tescilbaflvurusu içerisindeki pay› % 82’dir ve baflvurusay›s›n›n yüksek oluflu, ticari hayat›n aktifli¤inin debir göstergesi olarak kabul edilebilir.

TPE olarak en öncelikli hedefimiz, Enstitü ifllem-lerinde herkes taraf›ndan kabul edilecek asgarifleffafl›¤›n sa¤lanmas›, kararlarda mükemmeliyetin

enhancement, revision, harmonization with theEuropean Union, provisioning the correctinterpretation, informing and providingconsciousness to the involved sections of thepublic of the legislation that is composed of 20different laws and regulations. All these studies areindispensable for encouraging inventions, properprotection of the rights of inventors and trademarkholders, providing such people with exclusiverights in production for a certain period of time andthus, maintaining and protecting the competitionin industry.

An important issue worth pointing out is that TPI isbut one of the four basic foundations shaping theframework of industrial property system. It isknown that the elements forming a modernindustrial property system are: 1) specializedcourts, 2) infrastructure of the related legislation,3) a representative system built on a legal basis,and 4) central industrial property office orinstitution. Therefore, for the establishment of aneffective and highly competent industrial propertysystem and the reduction of the obstacles standingbefore the industrial and trade life in our country,all the links of the system need to be in placewithout absence. The present goal under thisscope is then; increasing the number of specializedcourts rapidly, giving priorities to the training ofour judges related to these and providing therepresentative system with a legal basis.

The number of applications to the Institute hasexceeded 35,000, by the date of 31.12.2000.Whereas the number of patent applications amongthe total sums up to 3,500, the major workload ofthe Institute is focused on a different area;administrations concerning "trademarks". Thepercentage of trademark applications among thetotal registration applications is 82% and the highvalue may be evaluated as an indicator of the tradelife activity.

Ayr›ca, yak›n gelecekte, herhangi bir baflvurusahibi, evinden veya bürosundan sadece birkaçtufla basarak Enstitümüz web sitesinde tutulacakdosya kay›tlar›na ulaflacak, arzu etti¤i markaaraflt›rmas›n› yapabilecek; patent veya tasar›mbaflvurusu ile ilgili son durumu ö¤renebilecek veböylece ifllemlerini süratli, emniyetli ve insanunsuruna asgari ölçüde dayanan bir sistemçerçevesinde gerçeklefltirmifl olacakt›r. Böyle birgeliflme, ayn› zamanda, Türk s›nai mülkiyetsisteminde de çok önemli bir geliflmeye iflaretedecektir.

Yeni çal›flma döneminin hedefleri aras›nda 2önemli yasa tasar›s›ndan baflka ; mevzuat -yenilefltirme çal›flmalar›, bürokrasi ve ifllemsürelerinin azalt›lmas›na yönelik "yenidenyap›land›rma" çal›flmalar›, kurumsallaflman›ntamamlanmas›, backlog’un tamamiyle eritilmesi vetan›t›m kampanyalar›na a¤›rl›k verilmesi gibihedefler de bulunmaktad›r.

Buradan, Enstitümüzün kuruldu¤u günden bu yanaeme¤i geçen Baflkan, yönetici, uzman veçal›flanlar›na bir kez daha teflekkürlerimizisunarken, haz›rlam›fl oldu¤umuz bu rapor ile,TPE’yi ve Türk s›nai mülkiyet sistemini dahayak›ndan tan›yaca¤›n›z› umuyoruz.

Our preceding goal as TPI is; acquiring in theadministrative work a minimum level oftransparency acceptable by all, keeping thenumber of objections at a lower level by targetingperfect decisions and achieving a monotonousinterpretation of the related legislation byundertaking necessary education and coordinationstudies with our patent and trademarkrepresentatives. Therefore, the protection of theindustrial property rights shall be implemented inthe most transparent and equal way.

Besides, in the near future, any applicant, in hishouse or office, will reach the file records that areto be held in the web site of the Institute by typinga few keys, make a trademark search as he desires;learn the latest condition of a patent or designapplication and thus, he shall complete hisadministrative work with a system that is fast,reliable and dependant on human factor at the leastlevel. Such a development, at the same time, shallpoint out an important enhancement in the Turkishindustrial property system.

Included among the objectives of the new workseason other than 2 important law proposals are;studies on legislation revision, "reconstruction"studies to reduce administrative work durations,completing the institutional framework,diminishing the backlog completely andconcentrating on presentational activities.

Hereby acknowledging the efforts of and thankfulto all Chairmen, directors, examiners and workers,we hope that this report we prepared shall help youknow the TPI and the Turkish industrial propertysystem closer.

Bilgi toplumunun oluflum sürecinde en önemli üre-tim faktörünün bilgi oldu¤u gerçe¤inden hareketle,21. yüzy›lda etkili ve baflar›l› bir toplum olman›nanahtar› dünyadaki h›zl› de¤iflime uyum sa¤layabilenve bireylerini bu yeni ortam›n gerektirdi¤i niteliklerledonatabilen, bilgiye eriflebilen, bilgiyi üretebilen vekullanabilen ülkelerden biri haline gelmektir.

Tüm dünyada teknoloji alan›nda kaydedilen köklüilerlemeler sadece basit iflgücünü de¤il bir ölçüyekadar beyin gücünü de ikame edebilme imkan›sa¤lam›fl, bilgiye dayal› üretim büyük ivme kazan-m›fl, buna ba¤l› olarak teknolojik yenilikler veverimlilik art›fllar› sürekli hale gelmifltir.

Bu nedenle d›fl ticaret, rekabet, ve fikri haklar gibialanlarda geliflen yeni norm ve standartlar konu ileilgili ulusal ve uluslararas› kurulufllar›n etkinli¤ininartmas›na yol açm›flt›r.

Ülkemizin 1995 y›l›nda Dünya Ticaret Örgütü Ku-rulufl Anlaflmas› ve eki Ticaretle Ba¤lant›l› FikriMülkiyet Haklar› Anlaflmas›’na taraf olmas› ve ABile Gümrük Birli¤i uygulamas›na geçilmesi ayn›dönemde Avrupa Toplulu¤unda da s›nai haklar ala-n›ndaki geliflmelerin Topluluk mevzuat›na yans›t›l-mas› ve üye ülkelerde uyumlaflt›r›lmas› gibi gelifl-meler Türkiye’nin hem ulusal sanayii ve ticaretihem de uluslararas› ticaret ve rekabette etkin olma-s›n›n gereklili¤ini zorunlu k›lm›flt›r.

Bu nedenle, ülke içinde s›nai mülkiyet haklar›n›nuluslararas› standartlarda ve etkin bir biçimdekorunmas› için gerekli altyap› oluflturulmufl vefikri haklar bütününün s›nai mülkiyet haklar› bölü-mü ile ilgili olarak:

Based upon the fact that information is the mostimportant factor of production during the build upof an information based society, the key tomaintain an effective and successful society is tobecome one of the countries that reaches / produ-ces and uses information and manages to adapt tothe rapid change in the world and provide her citi-zens with the skills necessitated by this new envi-ronment.

The fundamental advances in technology throug-hout the world has provided for not only the estab-lishment of simple labor but also the brain power,and the information based production gained a hu-ge momentum that results in the continuity of tech-nological innovations and yield increase.

Therefore, the new standards and norms in branc-hes, such as foreign trade, competition and intel-lectual property, have resulted in the increase ofthe effectiveness of the related national and inter-national institutions.

Developments such as the participation of our co-untry to the Agreement Establishing The WorldTrade Organization and its annex; Agreement onTrade Related Aspects of Intellectual PropertyRights and the establishment of Customs Unionwith EU in 1995, and also the implementations ofdevelopments in the intellectual property field intothe Community legislation and harmonization ofthe member states, have necessitated Turkey to be-come effective in both national industry and tradeand also in international trade and competition.

Consequently, for the effective protection of intel-lectual property rights according to the internati-onal standards, the necessary infrastructure hasbeen established and concerning the industrialrights that exists in the whole of the intellectualproperty rights:

• S›nai Mülkiyet Haklar›n›n etkin bir biçimdekorunmas›na yönelik olarak yürürlükte bulunanKararnameler ile bunlar›n uygulama fleklini göste-rir yönetmeliklerin, uygulama alan›nda karfl›lafl›lanbaz› aksakl›klar ve geçen zamana ba¤l› geliflmelerdikkate al›narak güncellefltirilmesi ve Avrupa Birli-¤i mevzuat›na tam uyumlu hale getirilmesi çal›fl-malar› sürdürülmüfltür.

• Topluluk Marka ve Tasar›m Ofisi (OHIM) ile Ens-titümüz aras›nda hukuki, idari ve teknik faaliyetlerbak›m›ndan paralellik sa¤lanmas›n› hedefleyenMutabakat Zapt› (Memorandum of Understanding)01.12.2000 tarihinde imzalanm›flt›r.

To provide a modern, effective and strong intellec-tual property protection in Turkey, legislation com-patible with the European Community (EU) legisla-tion and Agreement on Trade Related Aspects ofIntellectual Property (TRIP’s) Annex to AgreementEstablishing the World Trade Organization. Theactivities related to intellectual property that hasbeen carried out until the end of year 2000 are asfollows:

• The studies on updating the Decree Laws andthe implementing Regulations that are necessaryfor an effective industrial property protection, focu-sing on several defects and the developments in ti-me and also harmonization of the said legislationswith EU legislation has continued.

• The Memorandum of Understanding has beensigned in 01.12. 2000 between the Office for Har-monization in the Internal Market (OHIM) and ourInstitute, which aims parallel proceedings with res-pect to legal, administrative and technical activities.

APPLICATIONS

Within the year 2000, 35092 applications have be-en made to Turkish Patent Institute, concerning in-dustrial property rights. When a comparison is ma-de with the 28975 applications made in the year1999, a 21% increase is observed. Marka baflvuru istatistikleri gözönüne al›nd›¤›nda2000 y›l›ndaki bu art›fl›n, Türkiye’nin 01.01.1999tarihinde Madrid Protokolü’ne taraf olmas› ileyabanc› baflvuru sahiplerinin Uluslararas› TescilSistemi’ni tercih etmeleriyle aç›klanmaktad›r.

By the Patents Department, 3444 patent and 460utility model applications have been processed inthe year 2000. In the year 1999, the number of pa-tent and utility model applications are respectively,3028 and 317. The observed approximate increaseof 14% shows that the concept of invention whichconstitutes an indicator of technological develop-ment, is still at the point of initiation. Consideringthe utility models, a 45% increase is observed withrespect to year 1999. Since these numbers are atlow percentages for a country like Turkey, it is un-derstood that the establishment of wider policiesaiming to increase the number of patent and utilitymodel applications become necessary.

By the Trademark Department, 28627 trademarkapplications have been processed in the year 2000.The number of applications in the year 1999 is23692, which shows a 21% increase. An increasein the number of trademark applications, which isknown to be an important factor in determining thedevelopment levels of countries, depends on bothestablishing a general public awareness and theconstitution of the still growing infrastructure ofour Institute.

Considering the statistics of trademark applicati-ons, the increase in the year 2000 can be explainedby the participation of Turkey to Madrid Protocol in01/01/1999, since the foreign applicants prefer theInternational Registration System.

Industrial Designs are being processed accordingto the Decree Law No: 554 Pertaining to the Pro-tection of Industrial Designs, dated 27 June 1995,that has been published in the Official Journal No:22326. Being a relatively new implementation rela-ted to the other industrial property rights in our co-untry,1937 industrial design applications have be-en processed in the year 1999. The number in theyear 2000 being 2552, an increase of 32% has be-

en observed. Within these numbers, 85% belongto national applicants. This case shows that theTurkish industry has an interest on protecting thedesigns by registration. Since the Hague Agre-ement concerning the international registration ofindustrial designs has not come into force in ourcountry, even though studies in contribution to ithas been completed in our Institute, the number ofinternational applications are at a low level of 15%.

Another study, which is important for our country,carried out in the year 2000 is the registration ofGeographical Indications. Such registrations areprocessed by publication in two gazettes havingthe most circulation and also in the OfficialJournal, for the objection of third parties. In the ye-ar 2000, 9 geographical indication applicationshave been made. The low level of applications inour country, which has a high potential, is due tothe absence of public awareness and the lack ofinterest of persons on the subject.

2000 y›l›nda yürütülen çal›flmalardan ülkemiz içinönem arz eden konulardan biri de, Co¤rafi ‹flarettescilleridir. Bu tesciller Resmi Gazetede, yurt ça-p›nda da¤›t›m› olan en yüksek tirajl› günlük gazete-lerden ikisinde ve bir yerel gazetede ilan edilerekgerçeklefltirilmektedir. 2000 y›l› içerisinde 9 adetCo¤rafi ‹flaret tescil baflvurusu yap›lm›flt›r.

171 adet faydal› model belgesi verilmifl, toplam

17987 marka ve 1 adet co¤rafi iflaret tescil edilmifl

ve toplam 1834 adet endüstriyel tasar›m ifllemi

belge verilerek koruma alt›na al›nm›flt›r. Toplam

21110 adet tescil ifllemi gerçeklefltirilmifltir.

2000 y›l›nda ise 1114 patent, 150 faydal› model

belgesi verilmifl, 15771 marka, 2 co¤rafi iflaret ve

2172 adet endüstriyel tasar›m ifllemi tescile

ba¤lanm›flt›r. 2000 y›l›nda toplam 19209 adet

tescil ifllemi gerçeklefltirilmifltir. 1999 ve 2000

y›llar› aras›nda bir de¤erlendirme yap›ld›¤›nda

genel tescil say›s›nda %10’luk bir azalma

görülmektedir.

S›nai Mülkiyet ifllemleri ile ilgili olarak 2000

y›l›nda TPE’ne yap›lan baflvurularda bir önceki y›la

göre kaydedilen %21 oran›ndaki ifllem art›fl

hacmine ra¤men personel say›s›n›n artt›r›lamamas›

nedeniyle tescil ifllemlerinde düflüfl kaydedilmifltir.

Enstitü’nün önemli hedeflerinden biri S›nai

Mülkiyet Haklar› konusunda toplumu

bilinçlendirmektir.

Bu say›lar›n art›r›lmas›na yönelik kamuoyunun bil-

gilendirilmesi ve bilinçlendirilmesi çal›flmalar›na

etkin bir flekilde devam edilmektedir.

REGISTRATIONS

In the field of Intellectual Property Rights in 1999,1117 patent and 171 utility model certificates weregranted and 17987 trademarks, 1 geographicalindication and 1834 industrial designs were regis-tered by TPI. Total registration number is 21110.However in the year of 2000, 1114 patent and 150utility model certificate models were granted.15771 trademarks, 2 geographical indication and2172 industrial designs were registered. Total reg-istration number is 19201 in 2000. It is observedthat there is a10 % decrease withrespect to theprevious year. 21 % increase has been remarkedin the total applications and 10 % decrease in reg-istrations. The reason of this slight breakdown inregistrations is directly related to the lack of per-sonnel employment. One of the most importantgoals that Institute has is the achievement of pubicawarness and informing the society in the field ofindustrial property rights (IPR).

Ay-r›ca, Avrupa Patent Ofisi'nce düzenlenen e¤itimprogramlar›na toplam 18 kiflinin kat›l›m› gerçeklefl-tirilmifltir. Avrupa Toplulu¤u ile 6 Mart 1995tarihinde imzalanan 1/95 say›l› Ortakl›k KonseyiKarar›'n›n 8 no'lu eki çerçevesinde Enstitümüzgörev alan›na giren konulardaki yükümlülükler deyürütülmektedir. Buna göre:

1) Marka Kanunlar›n›n Harmonizasyonu Antlaflma-s›na Türkiye'nin kat›l›m›n›n sa¤lanmas› hususundaEnstitümüz nezdinde çal›flmalar sürdürülmektedir.

2) Endüstriyel Tasar›mlar›n Uluslararas› Tesciline‹liflkin LAHEY Anlaflmas› Cenevre Metni 16 Hazi-ran - 6 Temmuz 1999 tarihlerinde WlPO taraf›ndandüzenlenen ülkemizin de temsil edildi¤i Diploma-tik Konferans’ta kabul edilmifltir.

Dünya Ticaret Örgütü Anlaflmas› eki Ticaretle Ba¤-lant›l› Fikri Mülkiyet Haklar› Anlaflmas›’nda(TRIP’s), s›nai mülkiyet alan›nda öngörülen yü-kümlülüklerin yerine getirilmesi amac›yla TRIP’skonsey toplant›lar› 2000 y›l› içerisinde de takipedilmifltir. Ekim 1999 tarihinde yap›lan TRIP’sKonsey toplant›s›nda tespit edilen flekil ve flartlarçerçevesinde, Ocak 2000 tarihinde TRIP’s sekreter-yas›na mevzuat bildirimimiz yap›lm›flt›r. TRIP’s An-laflmas›n›n 65. maddesi gere¤ince Türkiye’nin deiçinde yer ald›¤› geliflme yolundaki ülkelere TRIP’sAnlaflmas›na uyum için tan›nan 5 y›ll›k geçifl süre-si 2000 y›l›nda dolmufl bulunmaktad›r. Bu itibarlaülkemizin s›nai mülkiyet alan›ndaki mevzuat›n›nTRIP’s’e uyumlu olup olmad›¤› 27 Kas›m-1 Aral›k2000 tarihleri aras›nda TRIP’s Konseyinde incelen-mifl ve TRIP’s mevzuat›na uyumumuz baflar›l› bu-lunmufltur.TRIP’s Konseyinde "Co¤rafi ‹flaretlere" iliflkin çok

programs held by European Patent Office has beenachieved.

The obligations, which were in the framework ofnumber 8 Annex of Partnership Council Decisionsnumbered 1/95 signed with European Union in 6March 1995, within the responsibility of the Insti-tute, is being carried out. According to this:

1) Studies for Turkey’s participation in the Trade-mark Law Treaty are in progress within theInstitute.

2) The Hague Agreement on International Registra-tion of Industrial Designs, the Geneva Act is accep-ted at the Diplomatic Conference, in which our co-untry is represented, held by WIPO in between 16June – 6 July 2000.

TRIP’s council meetings also have been pursued inthe year 2000 for the purpose of carrying out thecommitments prescribed by the Treaty Establis-hing World Trade Organization and Annexed Agre-ement on Trade Related Intellectual PropertyRights. The legislation declaration has been madeto TRIP’s Secretariat in January, within the frame-work of the shape and conditions those determinedin the TRIP’s Council meeting held in October2000. The 5 year transition period, which was gi-ven according to the Article 65 of TRIP’s, for adap-tation of developing countries to TRIP’s, one ofthem being Turkey, has been expired by 2000. Inessence to this, the issue of our legislation on in-dustrial property area, whether harmonious toTRIP’s or not, has been examined between 27 No-vember – 1 December 2000 and our achievementto harmonising to the TRIP’s legislation isconcluded.

Our insistent behaviour, at TRIP’s Council, aboutthe opinion that the enlargement must be shaped

As known the candidate status of Turkey for Euro-pean Union is concluded at European Council Me-eting that was held in Helsinki in between 11-12December 2000. Since the acceptance of our can-didate status, the issues related to European Unionhave had greater importance.

TPI, in its responsibility, carried out nearly wholepart of the studies on harmonisation with the EUlegislation, within the framework of Customs Uni-on. However the examination of changes and deve-lopments to EU Legislation made after CustomsUnion is being continued.

After acceptance of the candidate status, the con-tacts between EU and TPI has been made to Officefor Harmonisation of Internal Market (OHIM), andaccordingly, participation has been achieved to theSymposiums held in Slovenia and Spain. Also

Preliminary search services for TrademarkApplications.

It marks applications it is of great importance toconduct preliminary surveys before application tothe Trademark Department of the Turkish PatentInstitute as to either prior registration or applica-tion is made for the identical or similar type goodsand services with that trademark becoming sub-ject to current application. In order to meet thisrequirement TPI renders preliminary search ser-vices to the applicants, prior to their applications.In this regards, 7404 preliminary search activitiesare carried out for trademark applications, in2000.

Preliminary Search Services for Patents

The role of Patent system in motivating RD studiesand production of technologies, is also a motivat-ing element to transfer technologies from othercountries, parallel to encouraging new inventions.If the patented products or methods are protectedunder patents in the other countries; new productsand methods will be put in action and transferredto the industry, either by the patent owner directlyor via license agreements. Information and Documentation Centers

TPI, apart from its other informatory services, hasstarted to set up "TPI Information andDocumentation Centers" in industrially intensiveprovinces where the major part of applications aremade, to fulfill its obligations and responsibilitiesmore efficiently, with a view to contributing to thenational industry and economy, satisfying theneeds of academicians, university students andtraders, for information and documentation, con-cerning national and international applications onlegislation, previous studies, preliminary searchactivities on international and national data basesand status of existing technology, related to theindustrial property rights. Such a unit is initiallyestablished in Istanbul in the Y›ld›z TechnicalUniversity campus, jointly by TPI, Y›ld›z TechnicalUniversity and SMIDO. It is followed by "TPIInformation and Documentation Center" in Izmir,Aegean University in EBILTEM building, togetherwith the University. Similar centers are planned tobe established in several other economically activeprovinces.

ver, 65adet PC, 30 adet Deskjet yaz›c› ve 13 adet la-

zer yaz›c› Enstitü bünyesinde kullan›ma al›nm›flt›r.

Teknolojideki yeni geliflmelerden yararlanarak

hizmetleri daha h›zl› ve daha verimli yürütmek üze-

re donan›m ve yaz›l›m gelifltirme çal›flmalar›

sürdürülmektedir.

Hardware / Software

In addition to the existing hardware and softwarethe "Industrial Design" software has started operat-ing Oracle data base. The online connection of theheadquarter building on Necatibey Street with thesub-office on ‹zmir Caddesi is established with afiber optic cable. 23 PCs, 8 laser printers, 5 dot-matrix printers, 2 printer-scanner-fax-photocopierare purchased in 2000.

Furthermore, the upgrading of RAMs of 70 PCs,purchase of Microsoft office 2000 for 175 users,purchase of antivirus software for 180 users and itsapplication to the existing system, purchase of fire-wall system is realized and the server, 65 PCs, 30Deskjet printers and 13 laser printers which areprocured through the GT2 project are put inoperation within the Institute.

The studies on developing hardware and softwarethrough benefiting from the technological develop-ments are being continued.

27.06.1994 tarihinde 544 say›l› KHK ile kurulanTürk Patent Enstitüsü’nde gerçeklefltirilen ifllemler-de de¤iflik davalar›n türlerine ve mahkemelerdeTPE aleyhine toplam 523 adet dava aç›lm›flt›r. Da-valar›n türlerine ve mahkemelerine göre da¤›l›mla-r› ile sonuçlar›n›n istatistiki veriler ile Enstitüaleyhine aç›lan davalarda verilen kararlara ait veri-ler afla¤›da sunulmufltur.Halen derdest olan dava-lar›n 313’ü yerel mahkemelerde görülmekte, 47 da-va ise Yarg›tay’da temyiz tashihi karar aflamas›ndabulunmaktad›r.

LEGAL ADVISORY SERVICES

For the services and procedures carried out in TPIsince its establishment on 27.06.1994 by theDecree Law No:544, a total of 523 trials are raisedagainst TPI in various courts. The distribution oftrials on the basis of types of cases and courts theyare filed, together with the statistical data on theresults, are given below. 313 of the trials are beingheld in local courts, and 47 are at the stage ofdecision of Supreme Court.

The heavy workload and an incruse in that,causesa shortage of personnel in TPI.Unless the guanti-ty and the guality of the personnel is raised , theInstitute will have difficulties in its studies with thecurrent workload.

Türk Patent Enstitüsü’nün 2000 y›l›nda mevcutpersonel durumu afla¤›da gösterilmifltir. Enstitü personel ihtiyac›na binaen 11 adet patentuzman yard›mc›s› ile 2 adet marka uzman yard›m-c›s› kadrosuna aç›ktan atama yap›labilmesi içinBaflbakanl›¤›n izniyle 08.04.2000-09.05.2000 ta-rihlerinde yap›lan yaz›l› ve sözlü s›nav sonucundabaflar›l› olan 12 aday›n atamas›n› gerçeklefltirmifl-tir. Aral›k 2000 tarihi itibariyle 43 adedi sözleflme-siz 107 adedi de sözleflmeli olmak üzere toplam150 adet kadrolu personel vard›r.

Türk Patent Enstitüsü’nün personel istihdam›konusundaki eksikliklerine ve yaflad›¤› sorunlarara¤men hizmetlerini verimli yürütebilmesini teminetmek üzere altyap› gelifltirme çal›flmalar› dasürdürülmektedir.

With respect to the personnel needs of the Institute,among 11 Jr.Patent Examiners and 2 TrademarkExaminers, 12 have been accomodated and pro-moted after a written and oral examinat›on in08.04.2000 - 09.05.2000,by the clearance fromthe Prime Ministry.

Infrastructure development studies are in progressin order to carry out its services and fulfill itsresponsibilities, despite shortages and problemsfaced in terms of number of personnel. The infra-structure development studies can be evaluatedunder two headings:
