TRUE STORY: TOP LAWYERS ARE BEST IN CLASS
The Franchise Times Legal Eagles of 2014 are good sports, for which we are thankful. They revealed
the fictional legal character they’d most like to play on TV, and you might be surprised by some of their an-swers. (Denny Crane is a natural, the old-school lawyer on Boston Legal played by William Shatner. But Dex-ter? The serial killer of serial killers? That one gave us pause.)
These attorneys also are stellar at their craft (or per-haps we should call it art), and as evidence we pres-ent the trove of nominations that flooded in to recom-mend them. We’ve provided excerpts for just a few of the most-nominated lawyers, to give a glimpse of the praise they generate from colleagues and clients.
These attorneys are thoughtful, too, answering our question about the philosophy that guides their fran-chise law practice, with answers both practical and profound. “Different is good,” is one pithy quote. “Ev-ery dollar spent with us is an investment, and it should show a measurable return” is another. Read more about their views on page 47.
Above all, the Franchise Times Legal Eagles of 2014 are superior attorneys, selected from nominations by their clients and peers. This is one true tale we’re proud to present, as we salute their achievements for the 11th year running. Nominations for next year’s class open in December.

There are really three kinds of franchise lawyers. The first simply is looking for a buck. The second
is cut and dried and has a formulaic way of doing things. The last is the Alan Greenfield type, who is more
interested in having you as a permanent client.

In their DreamsWith which TV legal character do you most identify?John Baer, Greensfelder, Hemker & Gale
It would have to be Denny Crane (William Shatner) on Boston Legal. Although Denny Crane appeared to be somewhat of a doofus, he always had his clients’ best interests at heart and managed to get them the results they needed. Plus he liked an occasional drink or two with his partner on the patio or balcony of his firm’s office.
Jason Murray, Murray Law
Jonathan Rollins on L.A. Law, played by Blair Underwood. Rollins was a young hotshot black attorney with a stellar resume and an extraor-dinary background. One urban legend reports that Underwood’s character on L.A. Law was based, at least in part, on President Barack Obama in his early days when he served as the first black president of the Harvard Law Review.
Karen Abrams, Paris Ackerman & Schmierer
Judge Judy, because she’s smart, tough, to the point, and no-nonsense. She gets it done!
Peter Singler, Singler & Dillon
Dexter. OK, not “legal” per se, but law enforcement. Slightly unortho-dox, but he gets the job done. After dealing with lawyers throughout the
day, I really do not want go home and watch lawyer shows. My wife is a Law & Order fan though, so I at least know who Jack McCoy is.
Lee Plave, Plave Koch
Judge Harry Stone, in Night Court. He took his work seriously, but not himself.
Kate Nilan, Gray Plant Mooty
I’d like to think I’m more the Shirley
Schmidt (Candice Bergen) type in Boston Legal.
Charles Miller, Bartko Zankel Bunzel Miller
Gregory Peck in To Kill a Mockingbird. I like Sam and Peck because they are
both straight shooters and exude a respect for the law with high ethical standards.
Mike Drumm, Drumm Law
L ione l Hut z , t h e Simpsons. Mr. Hutz was a marketing guru—from his use of business cards that turned to a sponge when
placed in water, his “cases won in 30 minutes or your pizza is free” promo-tion or naming his law firm “I Can’t Believe It’s a Law Firm!”
Marisa Faunce, Plave Koch
Alicia Florrick in the Good Wife (minus the lying, cheating, scoun-drel of a husband). Alicia is intelligent, independent and tenacious. She fiercely defends her clients’ interests while staying cool under pressure. She also has an amazing wardrobe and a never-ending supply of shoes. Thankfully, my husband is a rock star and he knows full well that I will not “stand by my man” if he cheats on me.
Jeff Haff, Dady & Gardner
Perry Mason. He was my idea of what a law-yer should be. He always fought for the little guy against tough odds.
Eric Goldberg, Stark & Stark
Jack McCoy (Sam Waterston) in Law & Order, as he is relentless in
his pursuit of justice and what is right.
Nicole Zellweger, Stinson Leonard Street
Olivia Pope (Kerry Washington) in Scandal, minus her judgment lapse every time the President is nearby. I’m obviously not advocating tapping an opposing party’s phone or hacking into a computer system (although all of that looks like great fun on televi-sion), but I like to think of myself as a “fixer” operating within the bounds of the law.

Mike Drumm is different - in a good way. The clients of Drumm Law repeatedly comment that Mike offers them a business perspective when giving them legal advice. He is not your typical franchise attorney. His practice is relationship-driven; he strives to not only to provide legal solutions, but legal solutions that mesh with his clients’ business needs. He is a partner with business, and as their “outside general counsel,” he strives to see the big picture of their business so that he can offer practical and effective solutions for their day-to-day legal needs.
Mike founded Drumm Law so that he could provide the service that his clients need, not the service that a big law firm thinks they need. Drumm Law is based upon the principles of maintaining low overhead and leveraging technology to provide affordable legal services to its clients.

Peter Lagarias puts his heart and soul into representing
franchisees.
It’s easy for lawyers to sound like they know about franchising, but too often it’s just a lot of talk. At Sotos, we deliver results. This is why lawyers at other firms rate so many of ours as “Legal Eagles” – tops in the field.
And we help with much more than just basic agreements. As the industry’s go-to firm, we also work with companies on all of the legal matters a franchise business faces: Real estate and leasing, banking and finance, day-to-day business issues, intellectual property and trademarks, employment, taxes, resolving disputes. We even guide franchise holders as they address knotty succession and estate planning concerns.
We give more than sound advice; we provide practical help. It’s why we’ve done more than just talk about franchising since the 1980s.
While many franchise lawyers talk a good game ...
… We’re busy delivering results.

Words to Live ByWhat’s your philosophy or “motto” when working with franchise clients?Kirk Reilly, Gray Plant Mooty
Don’t tell clients what they want to hear—tell them what they need to hear. Franchisors pay me for profes-sional legal advice—not a pep talk.
Benjamin Levin, Hyland Levin
See the other side’s view-point and figure out a way to get what you want where the other side doesn’t feel screwed.
Richard Rosen, Richard L. Rosen
When you treat the other side fairly, your chances of achieving a workable solution to the issues at hand increase exponentially.
Robert Salkowski, Zarco, Einhorn, Salkowski & Brito
Be responsive. Many of my clients have never been involved in a legal dispute and are scared because of both the real and perceived risks.
Bethany Appleby, Wiggin and Dana
Let’s solve the problem and then, whenever possi-ble, make improvements so the system does not experience the same problem again.
Deborah Coldwell, Haynes and Boone
Find out what the client’s real goal is and then figure out a smart way to get there.
Kate Nilan, Gray Plant Mooty
You can’t grow if your ducks aren’t in order.
Mike Drumm, Drumm Law
Different is good.
Constantine Fournaris, Wiggin and Dana
First do no harm! Stated differently, resist organi-zational biases to change successful things and to make simple things more complicated than they need to be.
David Kaufmann, Kaufmann Gildin & Robbins
You say jump, we say how high and when.
John Gotaskie Jr., Fox Rothschild
Disclose, disclose, dis-close. I have yet to meet a
regulator who says, “You disclosed too much.”
Karen Abrams, Paris Ackerman & Schmierer
Treat every client and every lease as if it is my own personal deal and I am signing my own name on the dot-ted line. I am myself a retail tenant on two franchised retail leases, so I really
“get it.”
Elizabeth Sigety, Fox Rotschild
In short, understand your client’s business and goals. It’s not just inter-preting regulation, but adding value to your client’s business.
Warren Lee Lewis, Akerman
A franchisor cl ient should do what is necessary to maintain or strengthen its franchisor-franchisee relationships. A franchisor client should be firm, but fair, in dealing with fran-chisees.
Peter Singler, Singler & Dillon
Every dollar spent with us is an investment, and it should show a mea-surable return.
Alexander Tuneski, Kilpatrick Townsend & Stockton
To provide superior counsel, you must invest the time to really get to know your clients, the idiosyncrasies of their system, and the challenges and opportunities facing their business.
