The 90-day amendment takes effect immediately at all Thoroughbred and harness tracks in the state. It may be renewed if the board proposes a new rule. Previously, the owner making the claim assumed all risk once the gates opened at the start of a race. The 21 deaths that occurred--primarily in claiming races--during the inner track meet (Nov. 30, 2011 to Mar. 18, 2012) prompted the action by the board at a special meeting. Meanwhile, a panel of racing experts appointed by the board in March is examining the flurry of fatal injuries. Racing and Wagering Board Chairman John Sabini said that the sharp increase in purses in New York in 2012 from revenue from the Resorts World Casino New York at Aqueduct has changed the claiming race business at the track. Sabini said that the higher purses and have led to larger fields and more claims, possibly creating an environment in which horsemen are more willing to enter at-risk horses who could suffer injuries that produce life-threatening situations for both equine and human participants. AThe time to talk is over,@ Sabini said. AI believe that this emergency measure is the first step. It=s not the last step. Far from it. There needs to be more done. This is something that we have talked about for a long and it=s time that we need to give it a try and see if we can make things better.@ In a letter to the board, New York Thoroughbred Horsemen=s Association president Richard Violette Jr. said his organization supported the concept, but noted that Athe devil is in the details.@ Violette asked that it be tabled until the panel makes its report because it forces the examining veterinarian to make decisions on whether to euthanize a horse without being able to use diagnostic tools like x-rays and ultrasounds. While providing another positive bulletin on the unbeaten Juddmonte star, the Warren Place trainer is looking at concluding the colt=s career at Ascot=s Champions Day. AThe Breeders= Cup is not ruled out completely, but I=d think it would be a second thought at the moment,@ he said. AIt=s a very long way to go until the Breeders= Cup. There is Ascot, and the horse should hopefully stand in Europe. He=s a grass horse and there=s a very good chance he=ll be retired at the end of the year. Why go over to America in November on unknown territory? Everything might not suit, but time will tell and it might come back into the equation.@ Frankel is set to have a racecourse gallop during Newbury=s Greenham S. meeting later this month ahead of his comeback in the G1 Lockinge S. there May 19. AHe has wintered well, and I've got to put work into him now because he gets too fresh,@ Cecil added. AI hope he'll start off in the Lockinge at Newbury, but there is a long time until then, and I've asked permission to give him a racecourse gallop at Newbury and for him to stay the night. After that, he'll tell me what to do and everything is open. AWhile we should consider that, what is bestfor horse has to remain first and foremost.@ The American Association of Equine Practitionersproposed in 2009 that rules be changed to allow claimsto be voided due to deaths in races or after a horse iseuthanized on the track. California adopted the rule in2011. Sabini said he looks forward to the panel=s report, butthat the board had to deal with a pressing problem. AThe goal and the practice here will not be to euthanizethe horse if there are questions, but rather todisincentivize putting a horse at risk into a claimingrace,@ he said. AThat=s what we seek to do here, topreserve the horse population and to preserve the ridingpopulation who risk life and limb being on what mightbe a compromised horse put into a claiming race.@

J “TDN Rising Star” J Top Offer (GB) (Dansili{GB}) is being aimed at the G3 Greenham S. atNewbury, trainer Roger Charlton announced yesterday.Off since his impressive winning debut at that venue inAugust, Khalid Abdullah=s homebred will bid tounderline his 2000 Guineas credentials in that seven-furlong prep Apr. 21. AHe looks well and is a very good-moving horse, so I=m not particularly concerned aboutthe current firm ground, but the training is starting toget a bit restrictive with the drought conditions,@Charlton said. AHis preparations have gone well, but it=sworth bearing in mind that, although he is a good-looking, impressive horse, he has won a maiden raceand there has to be massive improvement. It wasunfortunate he got injured last year and was unable tocontest a conditions race, as if he had won one he=dhave ended up in a group race and he=d know more andI=d know more. At the moment we=re still in the dark, soit would be a mistake to ramp a horse up mentally andwork-wise just to get him to the Greenham fitter thananything else. He=ll come when he=s ready, and if he=sready for the Greenham he=ll run there, and if not we=llfind something else. But it=s so far, so good. Hewouldn=t go straight to the Guineas--he=d need to run ina trial and come out of the trial well. It=s a long season,and I try not to screw things up by forcing things ifthey=re not quite ready.@

Cityscape Options Open... Trainer Roger Charlton is weighing the potentialtargets for Saturday=s impressive G1 Dubai Duty Freehero Cityscape (GB) (Selkirk). Following the 4 1/4-length success of Khalid Abdullah=s 6-year-old atMeydan, connections are looking at the internationalcalendar. AI was very bullish about him before the race,as he has been training really well and lookedmagnificent and has developed into a seasonedtraveller,@ Charlton commented. AHe eats well and takeseverything well, but it=s difficult to expect to win a $2 million race against lots of previous Group 1winners. To break the track record and win like thatwas really nice. He deserves to win a Group 1 race andhe=s got better as he=s got older--he=s a very toughhorse. I believe the sectional times in that race werephenomenal, so the fact that he was able to quickenoff a fast pace and then idle in front makes it an evenmore commendable performance.

He continued, AHe relaxes very well in his races, and10 furlongs is now definitely worth trying, and youwouldn=t shirk a mile if it was suitable. It=s a case ofwhat we do and where we go, but the important thingis that, although he=s a very good mover, I=d never runhim at an undulating track. We will stick to leveltracks--a lot of the man-made tracks like Meydan andHong Kong are wonderful galloping tracks, and it=s thesame with Woodbine. There is a big race in Singaporethat could come into the melting pot, but also perhapsthe G1 Prix d=Ispahan over nine furlongs at Longchampwill be considered.@

A.P. Indy has 28 foals of racing age out of DeputyMinister mares and as many as seven of them (25%)are stakes winners. The most famous of the seven isundoubtedly Rags To Riches, the Kentucky Oaks winnerwho just got the better of Curlin in the Belmont S. Others are Telling (twice winner of the GI SwordDancer Invitational S. over a mile and a half) andSerenading (GII Falls City H. over a mile and an eighth).Inevitably A.P. Indy=s sons have been given everychance with Deputy Minister mares, and so far we=veseen Bernardini sire the GI Cigar Mile winner To Honorand Serve, while Mineshaft and Old Trieste have bothsired Grade II winners. His grandsons Tapit and SkyMesa also have graded winners out of Deputy Ministermares. Telling is relevant here, as this smart turf horse has asecond dam by Secretariat, and is therefore inbred 3x3to the 1973 Triple Crown winner. Take Charge Indy isout of a mare by Dehere, a champion 2-year-old siredby Deputy Minister from a Secretariat mare. The FloridaDerby winner is therefore inbred 3x4 to Secretariat andhas three lines of Bold Ruler. Other good A.P. Indy coltswith Secretariat inbreeding include Majestic Warrior(3x4), Master Command (3x3) and Jump Start (3x4). Remarkably, A.P. Indy=s five foals of racing age out ofdaughters of Dehere feature three stakes winners(60%). In addition to Take Charge Indy, they includeFriesan Fire, the 2009 Louisiana Derby winner whosecareer rather fell apart following his Kentucky Derbyflop, and Vaulcluse, an unbeaten minor stakes winner.A.P. Indy=s son Pulpit numbers the Grade II winnerOratory among his two foals out of Dehere mares, sothis A.P. Indy/Dehere cross appears to be worthy offurther exploration. Perhaps I should point out that the dams of FriesanFire and Take Charge Indy weren=t just any olddaughters of Dehere. Friesan Fire=s dam Bollinger was aGroup 1 winner over just short of a mile in Australia,whereas Take Charge Indy is out of Take Charge Lady.This popular filly over-achieved to such an extent thatthis $175,000 yearling sold for no less than $4.2million as a 5-year-old, in foal to Seeking the Gold. In a three-year career, she won half of her 22 startsand was second in another seven. Starting with anExperimental Free Handicap rating of 115 after winningthree of her five juvenile starts, the 3-year-old TakeCharge Lady achieved a figure of 116 on the 2002International Classifications, followed by 115 in 2003.Clearly she was a model of consistency and her effortsbrought in nearly $2.5 million. She twice won the GI Spinster S. over a mile and an eighth, so a mile anda quarter shouldn=t be a problem for her son by aBelmont S. winner.

Unfortunately, we never discovered the full extent ofDehere=s stamina. What we knew for sure was that hewas a very talented and precocious juvenile. On balance I would say that there is probably a littlemore speed than stamina in Take Charge Indy=s femaleline. His second dam Felicita is an unraced daughter ofthe champion sprinter Rubiano, who was a Grade Iwinner at up to a mile. Felicita=s Lear Fan filly Eventailwas a stakes winner over a mile and an eighth, a tripwhich was also within the compass of Felicita=sstakes-winning son Commendation. Eventail is now thedam of Straight Story, a Grade II-winning son of Giant=sCauseway who has run well at up to 1 3/8 miles. Felicita=s dam, Grand Bonheur, produced two quitespeedy performers in England to sons of NorthernDancer. Her Nureyev colt Zarbyev won at up to a milebefore being returned to the U.S. and her NorthernBaby colt Northern Tryst was third in the Middle Park S.Grand Bonheur did her winning at six furlongs and shealso ranks as the second dam of the Breeders= Cup TurfSprint winner Chamberlain Bridge. No wonder Take Charge Indy has plenty of speed athis disposal, but I am hopeful the Florida Derby winnerwill be able to carry his speed a bit further.

Court Dismisses Everest Claims: The United States District Court for the EasternDistrict of Kentucky dismissed claims made by JeffreyNielsen=s Everest Stables against Pope McLean Sr.=sCrestwood Farm. In rendering her decision last Friday,District Judge Karen Caldwell ruled there was nosignificant evidence to support Nielsen=s claims thatCrestwood had mismanaged the stallion Petionville andhorses sold by Crestwood on behalf of Everest. Thecourt also ruled that Crestwood is entitled to disputedfunds from proceeds of the sale of horses. Everestclaimed Crestwood did not earn its commission on thesale of a yearling filly by Storm Cat out of IslandFashion at the 2009 Keeneland September sale.Crestwood charged Everest with breach of contractafter Nielsen had a third party bid on the filly on hisbehalf, in spite of an agreement to sell all the horseswithout reserve.
