Nguyen Dynasty's Official Document is a type of the administrative documentsof the Vietnamese Feudal Royal Dynasties under the reign of the Nguyen Kings. Thesedocuments feature the King' red royal remarks of various types. According to NationalArchive Center I, State Records Management and Archives Department of Viet Nam, of theMinistry of Internal Affairs, the Official Documents of the Nguyen Dynasty are categorizedinto 734 volumes with thousands of unit of documents. These Official Documents areoriginal, but due to the poor state of preservation during the war, a great number of theseOfficial Documents have been lost and damaged. Researchers, however, have managed tocollect a number of Official Documents concerning the Hoang Sa (Paracel) and Truong Sa(Spratly) Archipelagos.

The Nguyen Dynasty's Official Documents are valuable in terms of both formalityand substance. With regard to the formality, these documents are original with the directorder from the Kings, which makes it highly legally valuable. With regard to its substance,these Official Documents provide valuable information concerning the administrationof the country in different aspebts, including the exercise of sovereignty which is ofparticular interest. Various events.and administrative activities were recorded in differenthistorical documents by History Record Team based on these Official Documents, whichaccordingly affirms the authenticity and legal value of these events and activities.

The establishment and exercise of sovereignty over the Hoang Sa (Paracel) andTruong Sa (Spratly) Archipelagos by the Nguyen Dynasty have also been expressed anddemonstrated through these Official Documents. Although a number of the documentshave been lost, the collected ones are more than enough to show the broad picture of theexercise of sovereignty over the two archipelagos by the Nguyen Dynasty. More importantly,the majority of the documents concerning the the Hoang Sa (Paracel) and Truong Sa(Spratly) Archipelagos feature the royal remarks by the King, which are convincing.andclear evidences of the Kings'highest concerns for these two archipelagos.

Accordingly, it is clear that the Kings of the Nguyen Dynasty consistently followedthe policy of the Nguyen Lords concerning the two archipelagos, and implemented in amore comprehensive and systematic manner the management of the Hoang Sa (Paracel)and Truong Sa (Spratly) Archipelagos. In particular, Nguyen Dynasty established differentadministrative units on the islands, conducted the surveys, the plantation ofthe sovereigntymarkers, mapping.search and rescue and guarantee of the maritime safety..., oS well asissued a clear reward and punishment policy to encourage the soldiers of the Hoang Saand Bac Hai brigades deployed to the two archipelagos.

2.1. The Nguyen Dynasty continuously appointed its oficers to conduct the survey, plan-tation of the markers and mapping on the Hoang Sa (Paracel) and Truong Sa (Spratty)Archipelagos

After King Gia Long had taken over the reign, he conducted various political,economic' cultural and social activities to build up and maintain the dynasty, and expressedhis special interest for the maritime boundary. One ofthe boundarymanagement activitiesof King Gia Long was to deploy one military unit together with the Hoang Sa brigade toconduct the survey on the Hoang Sa (Paracel) Archipelago. According to The kuthfulAccounts of Dai Nam Present Dynasties (Dai Nam Thuc luc Chinh Bien), in the year of AtHoi, the 14th year of Gia Long's Reign (1815), the King appointed Pham Quang Anh to theHoang Sa (Paracel) Archipelago to explore the sea route,l and in March of the l5th year

9f Gia Long's Reign (1816), the King continued to deploy a navy unit and the Hoang Sabridgade to the Hoang sa (Paracel) Archipelago to explore the sea route.2

King Gia Long passed away in 1819 and his grandson took over the reign in 1820named as Minh Menh. King Minh Menh followed his ancestors'policy to maintain theregime. As for the administrative machine, King Minh Menh established the Cabine-t toassist the King in administering the country, including the exercise of the sovereignty overthe the Hoang Sa (Paracel) and Truong Sa (Spratly) Archipelagos. Based on the OfficialDocuments' the bodies in charge of the management of the exercise of sovereignty over theHoang Sa (Paracel) and Truong Sa (Spratly) Archipelagos included the Cabinet, Ministryof Public Works, Ministry of Finance, Ministry of National Defense, Ministry of /ustice,Ministry of Internal Affairs, and Provincial Administration of Quang Ngai, Binh Dinh . . .The Ministry of National Defense was in charge of the military deployrnent3 and patrol ofthe maritime areas.a The Ministry of Public Works was in charge of the survey, tuildingand management of the Hoang Sa (Paracel) and Truong sa (Spratly) Archipelagos.

Undertaking the King's order, many survey teams came to the Hoang Sa Archipelago.The works of these teams varied from sea route exploration and mapping to the plantationof the wooden markers in the Hoang Sa (Paracel) Archipelago. fh" Offi.iul Documentdated 12nd February of the l7th year of Minh Menh's reign (1836) by the Ministry of publicWorks showed that the Chief of the Navy appointed to plant the sovereignty marker inthe Hoang Sa (Paracel) Archipelago was Pham Huu Nhat. There were two iines in thisdocument:f rstly, eachwooden marker was 5 "thuoc" long, 5 "tac" broad and I "tac" thick;secondly, the wooden markers had to be planted in every place the vessel sailed to. Thesea1e the royal remarks by King Minh Menh. These royal remarks evidenced the King'sdetermination to exercise the sovereignty over the Hoang Sa (Paracel) Archipelago. th.plantation of the markers was not merely the responsibility of the Naiy. Accordiig to adocument by the Cham ethnic in Phu Quy Island, the people prepared 3 vessles with the

Each Survey Team coming back from the Hoang Sa (Paracel) Archipelago submittedits reports. The Official Document dated 21't |une of the 19'h year of Minh Menht reign(1838) revealed the results of the Hoang Sa Survey Team in 1838: The team conductedsurvey over 25 islands (including 12 islands previously surveyed by other teams and 13new islands).

During the reign of Thieu Tri (1841- 1847), two documents concerning the exerciseof the sovereignty over the the Hoang Sa (Paracel) and Truong Sa (Spratly) Archipelagoswere found. It was said from these two official documents that the bodies in charge of themanagement of the exercise of sovereignty over the Hoang Sa (Paracel) and Truong Sa(Spratly) Archipelagos operated in accordance with the state regulations. However, sincethere were many historical changes during the Thieu Tri's reign, the survey of the HoangSa and Truong Sa Archipelagos were temporarily suspended.

2.2. The Nguyen Dynasty's Policy concerning the search and rescue

Since the dynasty defined the maritime zones around the Hoang Sa (Paracel) andTruong Sa (Spratly) Archipelagos to be part of Viet Namb territory, the dynasty carriedout search and rescue for merchant ships in distress in these areas and provided aid andassistance for the victims. The Report dated 27'h lrtne of the 1l'h year of Minh Menh's reign(1830) by Nguyen Van Ngu, Head of Da Nang Port Authority provided that receiving thenews that a French merchant ship was in distress in the Hoang Sa archipelago, a patrolship carrying fresh water was sent to rescue the French ship. The Report by the Ministryof Finance dated 22"d December of the 22"dyear of Tu Duc's reign (1869) provided that 540people of Phuc Kien province in a merchant ship were in danger. An officer of Da NangPort Authority rescued and provided aid for the victims. The search and rescue by the PortAuthority demonstrated the Nguyen Dynasty's willingness and responsibility to managethe maritime zones.

2.3. The Nguyen Dynasty's Policy concerning the oficers carrying out their missions onthe Hoang Sa (Paracel) and Truong Sa (Spratly) Archipelagos

The Nguyen Dynasty defined the survey of the Hoang Sa (Paracel) and Truong Sa(Spratly) Archipelagos as an extremely difficult and highly important job. Being awareof such importance, the Nguyen Dynasty usually offered encouraging policy for officerscarrying out such mission. Based on the official documents, these policies were as follows:

Firstly, the State decided to offer tax exemption forihe crew members carrying outfishery management mission in maritime zones, especially the management of exercisingsovereignty such as exploration and survey of the Hoang Sa (Paracel) and Truong Sa(Spratly) Archipelagos. The request for tax exemption for the crew on the vessels carryingout public missions in the Hoang Sa archipelago was stated clearly in the Documentdated 19'h luly of the 79'h year of Minh Menh's reign (1838) reported by the Head of QuangNgai Province. The report clearly stated the size and origin of the vessles, number andhometown of the crew members. The report was approved by the King.

Secondly, the State also offered some favourable policies concerning the forms ofreward and punishment for officers carrying out missions in the Hoang Sa (Paracel)archipelogo. The forms of reward and punishment were clearly recorded in the OfficialDocuments, especially during the Minh Menh's reign.

According to the collected Official Documents, the highest form of reward for theofficers carrying out public missions in the Hoang Sa (Paracel) and Tkuong Sa (Spratly)Archipelagos was death penalty exemption. This case was applied for the officer TruongViet Soai, for example. He was the Manager of the Gun Powder Warehouse and committedthe crime of letting the Gun Powder Warehouse on fire, and was sentenced to death. TheReport dated 13th July of the 18th year of Minh Menh\ reign (1837) noted that Officer TruongViet Soai committed a serious crime and was many times appointed to carry out missionsin the Hoang Sa (Paracel) Archipelago. The King ordered him to be remoted and to waitfor further assignment.

Besides, the King offered clear forms of reward and punishment in case the navyofficers failed to fulill their missions in the Hoang Sa (Paracel) and Truong Sa (Spratly)Archipelagos. According to the Official Documents, as the Dynasty was fully aware of theexceeding difficulty of the management of exercising the sovereignty over the Hoang Sa(Paracel) and Truong Sa (Spratly) Archipelagos, the Report to offer sentence exemptionfor such officers was usually approved by the King.

The Nguyen Dynasty's Offcial Documents were a valuable source of informationconcerning the exercise of the Viet Namt sovereignty over the Hoang Sa (Paracel) andTruong Sa (Spratly) Archipelagos. A l'heureactuelle, selon les statistiques de 1993 du Centre national des archives 1, Ddpartement desdocuments et des archives de l'Etat relevant du Ministdre de I'Int6rieur, les Chau ban dela dynastie des Nguyen sont classds en734 recueilsl avec des milliers d'extraits. Ce sonttous des textes originaux mais au cours des guerres, en raison du manque de moyens deconservation, un nombre important d'entre eux ont disparu ou 6t6 abim6s de diftrentsdegrds (coll6s, moisis ou pourris). Cependant, les chercheurs ont pu collecter beaucoupde Chau ban dont le contenu concerne les deux archipels de Hoang Sa (Paracels) et deTruong Sa (Spratleys).

La valeur des Chau ban de la dynastie des Nguyen se montre tant sur le fond quesur la forme. Sur la forme, il s'agit des actes administratifs originaux, dont un grandnombre portent I'avis du roi et qui ont ainsi une valeur juridique confirm6e. Sur le fond,les Chau banfounissent des informations relatives I la gestion du pays sur tous les aspects,dont l'exercice de la souverainet6 qui fait lbbjet d'une attention particulidre. Bien des6v6nements, actes de gestion administrative relates dans les ouvrages historiques r6dig6spar le Quoc su quan (Bureau des annales) ont etd rapport6s et d6taill6s par les Chau ban, cequi confirme I'authenticit6 ainsi que la valeur juridique de ces faits.

lbtablissement et l'exercice de la souverainet6 par la dynastie des Nguyen sur lesdeux archipels de Hoang Sa (Paracels) et de Truong Sa (Spratleys) ont 6td pr6sent6s etjustifi6s de manidre d6taill6e dans les Chau ban de ladite dynastie qui sont conserv6sjusqu'aujourd'hui. En d6pit de la disparition d'un grand nombre de Chau ban, ceuxd6couverts jusqu'ici suffisent ir dresser I'apergu g6n6ral de l'exercice de la souverainet6 dela Cour de Hue sur ces deux archipels. En particulier, la plupart des Chau ban relatlfs auxarchipels de Hoang Sa (Paracels) et de Truong Sa (Spratleys) portent l'avis du roi, ce qui enfait des preuves vivantes et claires justifiant l'int6r€t port6 par I'autorit6 sup6rieure de l€tatfeodal sur ces deux archipels.

Le contenu de ces Chau ban nous ont permis de constater que les rois de la dynastiedes Nguyen ont poursuivi la politique des seigneurs Nguyen sur ces deux archipels, enmettant en Guvre de manidre plus exhaustive et systdmatique des activit6s dbdministrationsur les deux archipels de Hoang Sa (Paracels) et de Truong Sa (Spratleys), e savoir :instituer une unit6 administrative sur ces archipels, effectuer des explorations, planter desbornes de souveiiinet6, faires des relev6s cartographiques, venir au secours des bateaux en

pdril, assurer la s6curit6 maritime..., tout en menant des politiques de gratification et desanction 6quitables afin de motiver les soldats des Compagnies de Hoang Sa et de Bac Haiqui y sont envoy6s.

2.7 La dynastie des Nguyen envoyait successivement des missions aux archipels de HoangSa (Paracels) et de Truong Sa (Spratleys) pour y planter des bornes et faire des relevdscartographiques.

Nous savons que l'empereur Gia Long, une fois au pouvoir, a effectud beaucoupdbctivit6s en matidre politique, 6conomique et socio-culturelle en vue de construire etfortifier son royaume, en mettant I'accent sur les frontidres en mer. Lune des activit6sde gestion des frontidres maritimes d6ploy6es par l'empereur Gia Long constitue l'envoides troupes marines, une section de I'arm6e et de la Compagnie de Hoang Sa pour unemission d'exploration de lbrchipel de Hoang Sa (Paracels). Selon le DaiNam thucluc chinhbien (Relation v6ritable du Dai Nam,), en fevrier de I'annde At Hoi, 14d-'ann6e du rdgneGia Long (1815), I'empereur a ordonn6 i Pham Quang Anh de se rendre ir lhrchipel deHoang Sa (Paracels) effectuer des activitds d'inspection des routes maritimes2 ; en mars,printemps de la 15d-" ann6e du regne Gia Long ( 1816), il a de nouveau a ordonn6 auxforces navales et i la Compagnie de Hoang Sa de se rendre en bateau d lbrchipel de HoangSa (Paracels) effectuer des activit6s d'inspection des routes maritimes3.

lbmpereur Gia Long est d6c6d6 en 1819, son petit-fils Nguyen Phuc Dam a acc6dd autr6ne en 1820 en prenant le pseudonyme de Minh Menh. Lbmpereur Minh Menh continuala politique de renforcement de la dynastib de ses ancdtres. Sur le plan administratif, il ainstitu6 un Cabinet qui lui assiste dans la gestion du pays, dont I'exercice de la souverainetdsur les deux archipels de Hoang Sa (Paracels) et de Truong Sa (Spratleys). Selon les Chauban,Ies ministdres et administrations ir qui 6taient confi6l'exercice de la souverainet6 surles deux archipels de Hoang Sa (Paracels) et de Truong Sa (Spratleys) 6taient le Cabinet,le Ministdre des Travaux publics, le Ministdre des Finances, le Ministdre de la Guerre,le Ministdre de la fustice, le Ministdre de l'Int6rieur et les mandarins sup6rieurs desprovinces de Quang Ngai, de Binh Dinh... Le Ministdre de la Guerre 6tait en charge de lamobilisation des forces arm6esa et de la surveillance des frontidres maritimess. Celui destravaux publics est responsable des explorations, des constructions et de lhdministrationdes archipels de Hoang Sa (Paracels) et de Truong Sa (Spratleys).

de Minh Menh (183a) conserv6$ar la famille des Dang d I'ile de Ly Son, a at6 remis au Commissionnationale des frontidres du Ministdre des Affaires 6trangdres.

5Le Chau ban en date du 22 dlcembre de la22cne ann6e du rdgne Tu Duc (1869) comporte I'avis du roi :ce fait a 6t6 rapportl par le Ministdre de la Guere. Cela montre que ce Ministdre 6tait toujours en chargede la pr6servation des frontidres maritimes du pays, m6me sous l'invasion des Frangais.

Sur ordonnance de I'empereur, de nombreuses missions d'exploration se sont renduesir I'archipel de Hoang Sa (Paracels). Leurs objectifs n€taient pas les m€mes. Certainesmissions menaient des activit6s d'inspection des routes maritimes, d'autres faisaientdes relevds cartographiques ou emmenaient des bornes en bois d planter ir I'archipel deHoang Sa (faracels). Le rapport en date du12 f6vrier de la 17d-" ann6e du rdgne MinhMenh (1836) du Ministdre des Travaux publics a relat6 que le commandant marin PhamHuu Nhat a dt6 envoyd i l'archipel de Hoang Sa (Paracels) pour planter une borne desouverainet6. II contient deux lignes d€criture. Premidrement, chaque borne mesure de 5thuoc de longueur, 5 tac de largeur et I tac d€paisseur, deuxidmement, chaquebateau doitplanter une borne d chacune de ses destinations. Ce sont des 6critures de I'empereur MinhMenh. Cela montrre la d6termination de ce dernier dans l'exercice de la souverainetdsur l'archipel de Hoang Sa (Paracels). La plantation des bornes ir Hoang Sa n'est pas unemission propre i lbrm6e. Selon un document des Champas install6s sur f ile de Phu Quy,les habitants locaux ont pr6par6 trois bateaux pour accompagner les hommes de corv6e etpdcheurs aux archipels de Truong'Sa (Spratleys) et de Hoang Sa (Paracels) et leur aider irplanter des bornes sur ordonnance de l'empereur6.

Chaque mission d'exploration de I'archipel de Hoang Sa (Paracels) devait pr6senterun rapport de son retour. Un rapport en date dl2Ijuin de la 19d-" ann6e du rdgne MinhMenh (1838) a abord6les r6sultats acquis par le groupe d'expddition lhrchipel de Hoang Sa(Paracels) en 1938 : le groupe d'exp6dition a visit6 25 iles (dont 12 iles avaient 6t6 explordespar les groupes prdcddents et 13 iles sur lesquelles ces derniers n'avaient jamais mis lespieds).

Sous le rdgne Thieu Tri (1841-1847), ont 6t6 ddcouverts deux documents relatifsaux activit6s d'exercice de la souverainet6 sur les archipels de Hoang Sa (Paracels) et deTruong Sa (Spratleys). A lire ces Chau ban, on peut constater que les autorit6s en chargede l'exercice de la souverainet6 sur les archipels de Hoang Sa (Paracels) et de TruongSa (Spratleys) observent toujours les instructions de l'Etat. Cependant, ir cette 6poque,en raison des perturbations historiques, I'exploration des deux archipels de Hoang Sa(Paracels) et de Truong Sa (Spratleys) a 6t6 suspendue.

2.2. Politiques de la dynastie des Nguyen relatives aux activitds de de sauvetage en mer

Assur6e que les parages des deux archipels de Hoang Sa (Paracels) et de TruongSa (Spratleys) reldvent de la souverainetd du Vietnam, la Cour des Nguyen menait unepolitique de sauvetage et de traitement favorable au profit des bateaux de commerce6trangers naufrag6s. Dans son rapport en date du 27 juin de la I 1c-' ann6e du rdgne MinhMenh (1830) de Nguyen Van Ngu, Chef de la brigade de garde frontidre au port maritimede Danang, ce dernier a rapportd que, ayant appris le naufrage d'un bateau de commercefrangais i Hoang Sa, il a imm6diatement envoy6 un bateau de patrouille portant de I'eaudouce i sa recherche. Dans un autre rapport du Ministdre des Finances en date du 22d6cembre dela22E^" annde du rdgne Tu Duc (1869), a 6tE relate le fait qu'un bateau decommerce ayant il bord 540 habitants de la province de Phuc Kien a coul6 d Hoang Sa. LeChef de la brigade frontidre au port maritime de Danang les a sauv6s et pratiqu6la politiquede soutien ir leur profit. Ces activit6s de sauvetage ont fait preuve de la responsabilitd de laCour des NSufen; l€gard de la gestion des frontidres maritimes.

2.3. La politique des Empereus des Nguyen d lUgard des soldats partant aux Hoang Sa etTruong Sa pour le compte de la Cour de Hue

Pourla Cour des Nguyen,les missions de reconnaissance et de lev6 des deux archipelsde Hoang Sa et de Truong Sa 6taitent difficiles et importantes. Elle a men6, compte tenude cette importance, de6 politiques visant d encourager les gens partant en mission. Sur labase des actes de la Cour de Hue, on peut les identifier comme suit:

Tout dhbord, toute jonque partant en mission au large pour I'Etat (administration,p6che et surtout la reconnaissance et levd des iles de Hoang Sa et de Truong Sa) dtaitexempte d'imp6t et taxes. Dans un acte dat6 le 19 fuillet 1838 (19c ann6e de Minh Menh,le mandarin de Bo chinh de la province de Quang Ngai a fait inventaire des jonquesmobilis6es pour les missions aux archipels de Hoang Sa et de Truong Sa, qui b6n6ficiaientde I'exemption des imp6ts: ce rapport a bien mentionnd la taille, la cat6gorie des jonquesainsi que le nombre et le pays natal de l€quipage. Ce rapport a 6t6 approuv6 par le roi.

Ensuite, la Cour de Hue a pris des mesures encourageant les soldats envoy6s auxarchipels eux-mdmes en leur accordant des r6compenses ainsi que leur imposant despeines. Les actes ont relat6 bien ces mesures, surtout celles de la dynastie de Ming Menh.

Selon les actes de la Cour des Nguyen, la meilleure r6compense pour les soldatspartant en mission aux Hoang Sa et Truong sa 6tait la grAce pour les comdamn6s d mort.La grdce a 6t6 accord6e ir Truong Viet Soai, le surveillant du stock de poudre i canon. Il a6t6 comdamn6 I mort pour avoir laiss6le stock enflam6. Selon un rapport dat6le 13 juillet1837 (18d-" ann6e du rdgne Minh Menh), Truong Viet Soai a 6td envoy6 en mission auxHoang Sa plusieurs fois comme une substitution de sa peine.

Pour ceux qui n'accomplissaient pas leux tAches, ils feraient lbbjet des punitions.Pourtant, vu les missions p6nibles au large, le roi leur faisait souvent Ia grice.

Les Chau ban des Nguyen constituent une source originale nous fournissant desinformationspr6cieuses concernantl'exercice de la souwainetd duVietnam surles archipelsde Hoang Sa et de Truong Sa. Il s'agit des actes officiels de la Cour des Nguyen justifiantl'6tablissement et I'exercice continu et pacifique de sa souverainet6 sur ces deux espaces viales activitds de l'Etat sur ordonnances et instructions directes du Roi. Le Comitd Nationaldes Frontidres a I'honneur de pr6senter aux lecteurs, chercheurs vietnamiens et 6trangersune partie des recueils des actes de la dynastie des Nguyen prouvant la souverainetd duVietnam sur les archipels de Hoang Sa et de Truong Sa.

At the Hour of Tiger (3 - 5am) on the 20'h this month, D'Ochilie, a French ship-own-er and Chief Officer Idoir, together with group of Envoy led by Mr. Le Quang Quynlis, setsail to the Philippines, this matter has been reported. At the Hour of the Tiger on the 27'h,Chief Officer Idoir and eleven crew members sailed on a small boat into the port and re-ported, At the Hour of the Ox (1-3am) on the 21't, our ship passing the West of the Paracelarchipelago, was stranded and submerged more than eight thuoc in the water. The crewdecided to share the two silver-coin trunks, some tools and food, then sailed on two small-er boats to the shore. However, the boat of Mr. D'Ochilie had not reached the port at thetime. I immediately sent patrol boats carrying fresh water to go searching for the missing

boat. I respectfully report to your Majesty that at the Hour of the Horse (1lam - lpm), wemet with D'Ochilie, the envoy and other 15 crew members and accompanied them to theport safe and sound. Envoy Le Quang Quynh and his companions said they were all tiredand exhausted and asked for several days offand would report to Your Majesty later whenthey were fully recovered".

Comme je vous lhvait rapport6, le 20 ce moi-ci, i l'heure du tigre (entre 3 et 5 h dumatin),le capitaine du bateau commercial frangais-dAuxilly,le sous-capitaine Edouard etles envoy6s du roi, dirigds par M. Le Quang Quynh ont leve l'ancre pour un voyage d'af-faires d Luzon. Soudain, le 27, it I'heure du tigre (entre 3 et 5h du matin), le sous-capitaineEdouard et 1l autres membres de son 6quipage ont d6barqu6 ir notre port maritime surune petite barque. Ces derniers ont rapport6 quh la deuxidme veille de la nuit (entre 19het 21h) du 2I ce moi-ci, en traversant les eaux i I'Ouest de Hoang Sa, leur bateau s'y estdchoud et a 6te submerg6 de plus que 8 thuoc3 dans l'eau. A I'issue de leur discussion, lesmembres d€quipage ont d6cid6 de ramener deux coffres dbrgent appartenant aux fondsde I'Etat, quelques 6quipements n6cessaires et de la nouriture et de se r6partir en deuxgroupe, s'embarquer sur deux petites barques en espdrant que le vent les ramdne ir la terreferme. Etant donn6 que la barque au bord de laquelle se trouvent dAuxilly,les envoy6s duroi et de lhrgent n'6tait pas encore arriv6e, j'ai envoy6 un bateau de patrouille dot6 de I'eaudouce aller les chercher.

En voilir la nouvelle: A I'heure du cheval (entre 1lh et 13h), dAuxilly, les envoy6sdu roi et les membres d€quipage... qui font 15 personnes en total ont 6t6 retrouv6s etramen6s i la porte maritime sains et saufs. Les envoy6s du roi, y compris M. Le QuangQuynh, ont dit qu'ils sont i bout du souffle. IIs demandent donc la permission de se re-poser quelques jours avant de paraitre ir la capitale pour mission dds qu'ils se retrouventen forme. - Prince Vinh Tuong submits a petition, asking for a name to be given. Having considered

the fine names of the Emperor's descents, the Cabinet would like to request permission

granted for the word Hong.

- The report from the Ministry of Defense provides that Detachment 3 of Binh Thuan is

divided into two units, but the Ministry still submitted a request for the appointment of

Phan Van Binh as the Corporal of Detachment 3. Now that an error has been detected, we

would like to request for the penalty to be given to officer Lai...

- The document of the Ministry of Defence provides: Previously, based on the list made

by Pham Van Senh, an officer sent to Paracels on a surveying mission, the Ministry

submitted a request for a reward of "10 mai" coins to him, and 'bne mai" coin to each of

19 listed sailors of that detachment. Now the officer finds one extra sailor who was put

wrongly in the list, but dare not apply for rewards. The Ministry has sent a letter to the

Department in charge to grant the rewards according to the actual number; as for the

officer of the Ministry, who did not check to find the error, the Ministry has attached a

paper, requesting for penalty.

We would like to respectfully request the order: Phan Van Senh made a wrong list,

and the Ministry did not check to make it clear, therefore some rewards were granted in

excess; that is illegal. However, taking into consideration that the money in excess has not

been granted yet and is small in value, we thus request for an exemption from punishment;

other issues of this report remain unchanged./.

- Encore un rapport du ministdre de la D6fense : la Division 3 de la province de BinhThuin a 6t6 divisee en deux, mais ledit ministdre a demand6 quand mdme de nommerPhan Van Binh au poste de chef de la Division 3 de cette province. Pour cette faute, le Cab-inet du roi demande de sanctionner celui qui prend en charge des affaires dbrganisationdudit ministdre.

According to the order from the Ministry of Defense received last month, it is pro-vided that: in accordance with order ffrom the King] the Ministry has requested the prov-ince to prepare in advance 3 vessels, which are carefully maintained and ready at the ports,the King's Envoy and a marine officer would proceed to make arrangements for the sur-veying mission to Paracel Archipelago. Please follow the order.

Respectfully following the order, the provincial authority has held a worshippingceremony then prepared for 3 speedy and light vessels and other logistic things, whichare carefully maintained. Officer Vu Van Hung, who was sent last year and sorne morelaborers are asked to be the sailors with 8 sailors for each vessel, amount to 24 in total. Thevessels would set sail in the last week of March, when the weather is favorable for shipping.

Now all the arrangements have been done and the envoy has brought all the vesselsto the port. Because the reasons for choosing Vu Van Hung are convincing, the port au-thority decide to issue the certificate for the sailors and appoint Dang Van Xuyen as themaster, who would sail on a vessels accompanying the Envoy, Officers and Vu Van Hungto Paracels.

This mission is highly important, therefore the crew has to invest utmost efiorts toeffectively fulfill the mission. If any mistakes or misconducts found, the crew would beseverely punished.

All the crew is hereby listed. Master D*g Van Xiem from An Hai ward, Binh Sondistrict and Duong Van Dinh from Hoa Diem village who have been granted certificate asabove accordingly implement this order.

Suivant cette circulaire, les autorit6s provinciales ont organisd une c6remonie deculte, mobilis6 ensuite trois bateaux de guerre bien restaur6s, remplis de vivres et 6qui-pements ndcessaires pour venir i la citadelle. Elles ont d6sign6 Vu Van Hung, d6jd a[6 nHodng Sa lbnn6e dernidre, et choisi en outre 24 autres p€cheurs locaux exp6riment6s quisont r6partis ir ces trois bateaux. Cette d6l6gation ira au large vers mi-mars, lorsque la merest calme.

Maintenant, tout est pr6t. Lenvoy6 du roi est ddji venu en bateau. En trouvant rai-sonnables les demandes de Vu Van Hung, les autoritds de la province ont d6livr6le permisde conduire aux p€cheurs exp6rimentes qui sont Dang Van Xi6m et son 6quipe. Ministry of Public Works submitted a report about the summer grain harvest dam-

age and requested for a tax exemption for the two provinces Hai Duong and Thai Nguyen.

Following the order, we have confirmed the damage and in accordance with the law, we

respectfully request an order to grant such exemption.

- With respect to the three investigation documents by Gia Dinh, Quang Nam, we re-

spectfully request an order to give these documents to ... 3 to further investigate and

report accordingly.

- The other day, Eunuch Nguyen An conveyed the questions to the Cabinet about the

delayed return of the soldiers and sailors, who were sent to Paracels. Also, whether Cor-

poral Pham Van Nguyen and anyone else committed embezzlement must be revealed. If

there is any embezzlement committed, the case must come before the Ministry of |usticefor further punishment. If there is not any embezzlement, Pham Van Nguyen should be

immediately released without being sentenced to 80 lashes, and reinstated to his previous

post. The oficers who did not carry out the mapping properly have been sentenced to 80

lashes, but all have been released. The pilots have been rewarded with small "3 mai" coins

each, and Soldiers have been rewarded with one quan each. The laborers taking part in

this mission, if they have not been granted tax exemption, have been rewarded with one

quan each.

The Cabinet, in following the order to review the case, would like to rePort that: In

the past, following the order of your Majesty, the Ministry.of Public Works and the Min-

istry of fustice already investigated the soldiers and sailors, who were on the mission to

Paracels. Being asked, the two Ministries replied that investigation had been made, but no

embezzlement was detected. The Cabinet then sent official Do Ba Hong with the Ministry

of |ustice to question them again, but they declared the same thing and fully pledged that

none of them had committed embezzlement. The Cabinet would like to fully report the

result of the investigation as stated and to ask for an order as follows:

Corporal Pham Van Nguyen who was sent to Paracels on a mission and delayed his

return trip was asqigned to the Ministry of Defense for punishment. But after the investi-

gation, no trace ofmisappropriation has been found. Furthermore, during this mission, he

performed well and deserved reward. Corporal Pham Van Nguyen, who showed his com-

placency, and moved around in a very inappropriate manner after his return, was removed

from his post; detained and shackled. He is now sent to the Ministry for considering hisoffence and to be sentenced to 80 lashes, but he is granted a favor to be exempt from theIash and to be reinstated in the former post. The officials Tran Van Van, Nguyen Van Tien,and Nguyen Van Hoang who failed to fulfill their responsibility to properly conoucr map-ping were also sentenced to 80 lashes, but they are requested to be released. pilots Vu VanHung and Pham Van Senh are granted small'phi long" coins as rewards. The soldiers andsailors taking part in this mission are rewarded one quan each and sent back to their units.The laborers sent on the mission by provinces, except for the two who are already givenmoney, are rewarded one quan each as token of favor.

- Le ministdre des Finances a remis un rapport d6crivant les d6gits de la rizicole d€t6

et demandant d'une rdduction d'imp6t pour les deux provinces de Hai Duong et Thai

Ngry.tr. En trouvant que cette demande se conforme ir la loi, nous demandons au Roi

d'accepter cette demande.

- Concernant les trois rapports d'inspection de Gia Dinh, Quang Nam, nous demandons

au Roi de confier aux organes concern6s de les examiner et rapporter aprds.

- Encore, auparavant,l'eunuque royal Nguyen An nous a interpell6 sur le fait que les sol-

dats du g6nie envoy6s ir Hoirng Sa qui sont rentr6 tard. Il faut v6rifier si le chef du groupe

et ses complices ont des signes d'escroquerie. Si oui, il faut les confier au ministdre de la

|ustice pour les juger. Si non, il faut pardonner Pham Van Nguyen et exempter les 80 coups

de bAton, et le r6int6grer son ancien poste. Le mandarin charg6 de la surveillance de la

du groupe d'exp6dition de Hohng Sa. Ils ont conclut que ces derniers nont pas de sig-

ne d'escroquerie. Notre employ6 D6 Ba H6ng en coordination avec les repr6sentants du

ministdre de la |ustice interrogent plusieurs fois les personnes concerndes, qui restent tou-jours fiddles avec ses anciennes d6clarations et s'engagent de ne pas escroquer. En se basant

sur les rapports et les d6cisions communes, nous d6claror-rs que :

Comme le voyage ir Hoirng Sa a ddpass6le d6lai pr6vu, Pham Van Nguyen, chef du

groupe d'exp6dition a et6 confi6 au ministdre pour sanctionner. Mais aprds des sdances

d'interrogation, aucun signe d'escroquerie ria 6t6, trouv6. En revanche, sa mission au large

a 6t6 bien accomplie, il faut le r6compenser. Le gestionnaire Pham Van Nguyen qui, ir son

retour s'est montr6 son esprit d'autosatisfaction a 6t6 rdvoqu6 et mis en prison. Mainte-

nant, nous accordons une grAce et restaurons son ancien poste au lieu de le confier au

Allsoldiers and laborers (on two vessels from Quang Ngai and two other vessels from BinhDinh) who were sent on duty have been sent back to their previous units and posts. OurMinistry has considered the work done last year: the corporal and pilots who were sentto Paracels on a surveying mission returned home without bringing maps have beenpunished; the soldiers and sailors have been rewarded with one month salary bonus, andthe laborers.have been rewarded with two "quari'each.

We, Ha Duy Phien and Ly Van Phuc, under instructions by His Majesty the King.

In the past, Royal Marine, Royal Guard and soldiers from two provinces of Binh

Dinh and Quang Ngai were sent to the Paracels on a surveying mission. Now they have re-

turned, except for the Royal Marine Pham Van Bien, Pilots Vu Van Hung, Pham Van Senh

and Master Lu Duc Truc who delayed their return and accordingly sentenced to the lash

by your Majesty, other people who have been hard-working at sea, deserve the bonus of

one-month salary per soldier and two quanper laborer. The laborers sent by the provincial

authority may now return to their homeland and make a living of their own.

Royal Guard Truong Viet Soai, who was the Manager of the Gun Powder Warehouse

and committed the crime of letting the Gun Powder Warehouse on fire, and was sentenced

to "suspended beheading", was sent on duty to Paracels and was sent to join the laborers

to build Gia Dinh citadel. This year he was again sent on a surveying duty to Paracels.

Although he carried survey on 11 features, he failed to properly conduct the mapping.

Aupravant, un officier de marine et un surveillant de la citadelle, accompagnds desoldats, partisans et hommes de corv6e originaires de deux provinces Binh Dinh et QuangNgai ont 6t6 envoy6s pour une mission d'exploration ir Hoang Sa. Le groupe en est rentr6.

Quatre personnes y compris lbfficier de marine Pham Van Bi6n qui est envoye parla cap-itale,les guides Vu Van Hung, Pham Van SOnh et le conducteur de bateau Luu Duc Truc,sont responsables du ddpassement de d6lai et ont 6t6 r6primand6s et punis ir coups debAtons. Quand aux autres membres du groupe,l.u la difficultd et la dtrret6 de leur missionau large, ils seront r6compens6s. Chaque soldat ou partisan recevra une somme 6gale ir sonsalaire mensuel. Chaque homme de corv6e recevra une somme de 2 quan. Les soldats etles hommes de corv6e envoy6s par les provinces seront renvoyds ir leur ancien 6tablisse-ment respectif.

Quand au surveillant de la citadelle Truong Viet Soai, il a commis une violationde la discipline militaire pendant qu'il sbccupait de la production de la poudre i canonet en a 6t6 condamnd ir mort mais Sa Majest6lui a fait grdce,l'a envoye en mission ir Ho-ang Sa et aux travaux forc6s pour construire la citadelle Gia Dinh l'ann6e pass6e, commesubstitution ir sa peine. Cette annde il a 6t6 envoyd de nouveau en mission ir Hoang Sa.Sa missiori d'6tablir des cartes g6ographiques n'a pas 6t6 bien accomplie, mais il a quandmdme effectu6 des explorations sur 11 iles et bandes de sable, dbilleurs il a fait des efiortsen effectuant des travaux forc6s i plusieur reprises. Pour ces raisons, il sera pardonnd etremis comme soldat ir I'escadron de surveillants de la citadelle, en attendant d'une nouvellemission pour continuer ir r6parer sa faute. Pour l'ex6cution.

In following the order to send people to Paracels, our Ministry asked for an order toset sail during the last week of March for surveying and measuring the entire area there,and would return in the last week of |une. Followin-g the King's order, our Ministry made:9pi": of the King's order and sent them to the twJ provinces of Binh Dinh and euangNgai for the implementation and recruitment of royaiguards, royal marines and imperialwarships to be sent there in advance. We now r...i* the document from euang Ngaiprovince reporting in detail that the imperial warships arrived on the 2l.t of March. Sail-ors from Binh Dinh province also arrived on the 3'd of March. Notre Ministdre a aussis6lectionn6 des soldats, surveillants de la citadelle, officiers de marine et marins et les aexp6di6s. A pr6sent, nous avons reQu une lettre de la province Quang Ngai rapportantlhrriv6e le 2l mars des personnes envoy6es de la capitale. Les personnes et le bateauoriginaires de la province Binh Dinh sont dgalement arriv6es le 3 avril. Le guide PhamVan Senh,lui, est arriv6le 9 avril. Cependant, comme I'envoy6 du Roi nous l'a rapport6,levent de I'Est souflait sans cesse depuis le l0 jusqu'au 26 avril, ce qui a rendu le d6part desbateaux presque impossible. Cai tinhr l'a t6moign6 et il tient i demander la permission deretarder le ddpart des bateaux jusqu? ce que le vent du Sud se ldve. A ce moment-li, lesbateaux partiront imm6diatement et leur d6part sera signald sans retard.

Ayantjexamin6 la question, notre Ministdre trouve que la date de la missiond'exploration ir Hoang Sa a 6t6 bien d6termin6e, c'est ir dire les bateaux devraient partir finmars. A cause du vent et de la marrde qui sont d6favorables, le d6part des bateaux a 6t6retard6 jusqu? fin avril. Il s'agit alors d'un d6passement de d6lai. We now receive Do Mau Thuong and Imperial Guard Le Trong Ba, who are our

Ministry's officers, and returned from a mission to Paracels. Our Ministry have been in-

formed by these two officers that this time, the surveying team reached 25 islands in 3

groups of island The team revisited 12 islands and landed on other 13 islands for the very

first time). According to the pilot Vu Van Hung, the entire region of Paracels comprises

four groups, and this time, the team conducted the survey in 3 groups, the remaining

group in the South is rather far away, and strong Southern wind blew so powerfully' so it

was unfavorable to go there; it would be late to wait for favorable wind, therefore, ships

should be sent there next year. Considering four maps brought back (three of them depict-

ed individual group and the fourth one depicted all three areas as a whole) together with

a yet edited logbook, our Ministry would like to request for a thorough examination and

modification to the maps before submission.

According to the report by these two officers, they had collected one bronze-covered

cannon, red corals, some sea birds and turtles. Now they had brought them all back home.

Nous avons regu des fonctionnaires de notre ministdre qui s'appelent Do MauThuong et Le Trong Ba [envoy6s en mission publique ]r Hoang Sa]. Ils sont de retourde leur mission [i Hoang Sa]. Ils nous ont rapport6 que cette fois-ci, le grouped'expddition avait visit6 25 iles qui appartiennent ir trois groupes d'iles (le groupeavait revu 13 iles et explor6 12 iles pour la premiere fois). D'aprds le guide Vu VanHung, Hoang Sa comprend 4 groupes d'iles en totale dont ir pr6sent, 3 groupesd'iles ont 6t6 explor6s. Mais il reste un quatridme groupe au Sud, assez loin desgroupes explor6s, tandis que le vent du Sud souflait trds fort, ce qui 6tait d6favorablepour le voyage li-bas. Il a propos6 alors d'y envoyer des bateaux I'ann6e prochaine.Nous avons examin6 les quatre cartes que le groupe d'exp6dition avait apport6s,dont 3 dessignent les groupes d'iles s6par6ment, une dessigne le tout, et un journalde bord qui n'est pas encore bien corrig6 ou retouch6. Notre Ministdre propose iVotre Majest6 de nous laisser r6examiner toutes ces choses-ld et demander ir cesgens de les perfectionner afin de vous les pr6senter.

Les hommes mentionn6s ci-dessus ont en plus rapport6 qu'au cours de leurvoyage, ils oirt trouv6 et apport6 un canon cuivr6, du corail rouge, des oiseaux demer et des tortues de mer.

Quang Ngai's provincial Head of Treasury Dang Duc Thiem, who has been recog-nized for merits seven times, would like to respectfully submit this report and to requestfor the tax exemption for hired vessels which perform public services.

In fanuary this year, we received an order to send people on a duty to Paracels inorder to undertake the work of the Ministry of Public Works, which provided, inter alia,the schedule to send surveying team to Paracels and to return to the Capital via Thuan Anestuary was the last week of March and the last week of fune respectively. The Ministry ofPublic Works also sent an order for our province to provide them with two vessels and thecrew in advance in order to prepare for the mission.

In obeying the King's order, this time, I hired and arranged two local vessels and twovessels from the province of Binh Dinh, which were at our port at the time, to accompanythe Envoy to Paracels to carry out the mission.

Now the team has returned, and I would like to request for a tax exemption to begranted for the above vessels this year. Tax is a very important issue, which is why I wouldlike to submit this request for approval.

The total sum all the vessels have to pay for the year together with names, age andaddresses of the ship-owners are provided overleaf. I would like to respectfully submit thisreport.

Name: An aka Tran Van Duc, born in the year of the Rat, 59 years old. A big vessel(Registered Number 89),2 truong 7 thuoc long; 6 thuoc 7 tac wide, and2 thuoc I tac high.The tax is 15 quan.

La mission est terminle. Ie demande donc respectueusement ir Votre Majest6d'accorder une exemption d'imp6t auxbateaux que nous avons lou6s qui d6passe le nombredemand6.
