Nika, the six-year-old pregnant carthorse, died on the scene. The owner of a Golf Chico, Phillip Smit (36), was driving past the Bothasig police sta- tion when he suddenly saw a “flash of brown” from the left and then he was show- ered in a “white explosion of powdered glass”. His car lifted onto two wheels and then it fell back to earth with a sickening thud. Just a few seconds earlier, 18-year-old Jade Nahoff and two other carthorse occu- pants stopped in Swellengrebbel Road to ap- parently give some water to Nika. Bolted A homeowner let them use her garden hose to fill a bucket with water, but the hose frightened Nika and she bolted down the road towards Steenhoven Street. According to Cart Horse Protection Asso- ciation (CHPA) inspector Diana Truter, an- other carthorse owner saw this incident and rushed to the corner of the road to warn the oncoming car that something is amiss, but to no avail – the speeding Nika ran right into the side of Smit’s Golf. Now his uninsured vehicle, which was his only means of transport, has been written off. Nahoff also lost his hope of having a little colt or foal, as well as his beloved Nika. Both he and Smit are devastated and an- gry that it all had to come to this. Truter, who was on the scene just minutes after it happened at 14:00 on Saturday, elabo- rates: “Jade has been working at CHPA dur- ing his holidays for years. Last year he won Most Improved Carthorse Owner at our an- nual awards. He has to care for his parents, sister and other friends of the family and carthorsing is his only income. He also goes to school and he is determined to succeed.” Adoption The CHPA regulates the carthorse indus- try in the Cape Flats and surrounds. Truter has also, in her private capacity, been helping to pay Nahoff’s school fees. Truter continues: “Jade also owns a horse named Silver, but he was about to put this one up for adoption, because Silver was get- ting to the age where he tired quickly.” V To page 2.     Ward councillor James Vos has big plans

    for Bothasig and surrounds.

    He has identified several weaknesses and

    strengths for the suburb and has also re-

    vealed what he plans to focus on during

    2013.

    As far as he is concerned there is a lack

    of community pride, which is strange con-

    sidering all the drawcards.

    We have recently renovated shopping

    centres, parks and open spaces, the Fynbos

    Nature Reserve, a healthcare facility, a li-

    brary, many schools, a sport complex and

    a community hall, elaborates Vos.

    Another weakness, according to him, is

    that there is a tendency of insufficient up-

    keep of private properties.

    Vos has a plan to rectify this, but at the

    moment he doesnt want to elaborate, since

    it is in the early planning phase.

    Other weaknesses include that there are

    several undeveloped open spaces and dis-

    concerting negative perceptions of resi-

    dents in Bothasig.

    Yet, there is an abundance of municipal

    amenities and infrastructure, a large quan-

    tity of businesses and commercial nodes,

    numerous safety and security providers,

    plenty of educational bodies, a suitable

    community activation and valuable leader-

    ship, lots of religious bodies and churches

    and many undeveloped open spaces for fu-

    ture development opportunities.

    Vos also released a list of priorities for his

    ward, which includes Bothasig and Edge-

    mead.

    Says Vos: We should work towards bet-

    ter-quality management of nature conser-

    vation areas owned by the City of Cape

    Town and Eskom and the implementation

    of service level agreements. Then we must

    develop an Informal Trading Plan to regu-

    late and control informal trading.

    Other priorities for this year are the need

    to facilitate improved public transport sys-

    tems; improved levels ofmunicipal services

    with focus on parks and open spaces, roads

    and stormwater systems; improvedmunici-

    pal law enforcement and traffic operations;

    improving sporting facilities and library

    centres; expedite and enable development

    of open spaces for commercial enterprise;

    and to promotemethods to advance road ac-

    cess and public transport systems adjacent

    to the N7 corridor and the Montague Gar-

    dens industrial node.

    When the CHPA heard Nika was pregnant

    they suggested to Nahoff that he halted the

    adoption process until Nika gave birth.

    When she got a phone call informing her

    of the accident inBothasig she immediately

    rushed to the scene.

    When she got there, there were many

    more carthorse owners and tempers were

    seething.

    Smit explains: Once I parked what was

    left ofmy car on the sidewalk Iwas obvious-

    ly very angry! When I looked at the horse

    I felt sorry, but thats probably a R2 000

    horse...Mycar isworthR60 000. Iwas stand-

    ing therewhen three young children ran to-

    wards me. One of them was wielding a

    knife!

    According to Smit a policewoman

    strolled with no care in the world from

    the police station and saw the boys threaten

    himwithaknife, but later shedenied seeing

    anything.

    In just five minutes chaos consumed the

    scene, adds Smit.

    He adds that he has never approved of the

    carthorses on the roads.

    I understand that people are trying to

    make money with their carthorses, but

    there should be stricter regulations. Why

    are they allowed to be on the roads at all

    times? Also, why do some drivers look so

    young? Are they allowed to drive these

    carts? he asks, before adding that Bothasig

    has been a target for thieves who use cart-

    horses.

    Truter denies claims by Smit that Na-

    hoffs carthorse wasnt licensed. She also

    explains that there are rigorous procedures

    to prepare carthorse owners for the roads.

    Themost important part of thewhole sor-

    ry affair which transpired in Bothasig on

    Saturday is revealed by Truter when she

    concludes: Wehavea rule thatwhenacart-

    horse driver stops and leaves the cart for

    whatever reason, one person must at all

    times stand in front of the horse to prevent

    something like this from happening. They

    must always follow the correct procedure.

    Their bags are packed, scooters customised

    and all that is left is to get in the saddle and

    head for the land of the elusive leprechaun.

    On Saturday morning Chris Venter from

    Tygerhof and three friends began their

    journey of more than 35 000 km from Cape

    Town to Ireland.

    TygerBurger reported on their planned

    expedition in June last year (To Ireland on

    a scooter, for the kids, and a pint, 6 June).

    Their effort to promote and create aware-

    ness about the Red Cross Childrens Hospi-

    tal in this way, has been given a big boost,

    due to that article, said Chris.

    Paul Braun from Abbey Tours, who or-

    ganises package tours for Irish tourists in

    South Africa and for South Africans tour-

    ing to Ireland, read the article and set us up

    with sponsored accommodation at all the

    Protea Hotels as well as accommodation in

    Ireland. That means we will have to spend

    a lot less on accommodation and wont be

    camping as much as well, a grateful Chris

    said.

    The media exposure their trip has re-

    ceived thus far means they are already

    reaching some 100 000 followers.

    Chriss support for the Red Cross Chil-

    drensHospital is a grateful gesture. It is his

    way of thanking the hospital for the lifesav-

    ing operation they performed on his baby

    daughter in 1994.

    People can still assist uswithR50 for fuel

    or buy us a cooldrink or a burger if they

    come across us along the road. But all cash

    and big contributions should go to the hos-

    pitaital.

    A passionate Chris says the hospital is

    suffering from donor fatigue.

    If you read a newsletter or an email or

    any other correspondence from them, it

    reads exactly the same. It is boring and peo-

    ple dont take notice. What we do is give

    thema story of interest, a platform to create

    awareness from and hopefully raise funds

    in the process, he said, explaining the real

    cause behind their trip.

    Half of the trip costing about R1 million

    to organise was covered by sponsors.

    But each of us still had to pitch in about

    R100 000 of our own money.

    The 150cc scooters they are travelling on,

    have been customised with back racks.

    The first back racks couldnt handle the

    weight so I spent the last couple of days,

    welding and fitting, said Hein Gerber, the

    groups mechanic.

    There wasnt room for both of the boxes

    of spares they had to take along, so Hein

    built these spares into the cavities under

    their seats. The other boxes contain travel

    documents, medical supplies, photography

    equipment and their kitchen.

    Riding a scooter took some getting used

    to for the only foreigner in the group Dave

    Manor.

    A former business partner of Chris, Dave

    is not new to Africa, having spent much

    time here in the early 2000s. Although an

    avid motorcyclist he is not accustomed to

    riding a scooter.

    Mymain ride is a 1700 cc Yamaha Cruis-

    er, its classicAmericana, bigger andbetter,

    you know, jokes the man from Florida,

    USA.

    So Im gonna lose 500 pounds and 1600 cc

    but I love these scooters. Im thinking about

    downsizing to a smaller bike so that I can

    zip around as well, he said.

    A buyer and seller, Dave jumped at the

    chance to join his longtime friend on this

    trip. I am taking a year off, closed up shop,

    boarded up the house and here I am.

    The tripwill be documented by the fourth

    rider in the party, Ian Chamberlain.

    We will be shooting on GoPro cameras

    and a high definition video camera.We esti-

    mate thatwewill be shooting about 16 terra-

    bytes of footage, Ian said.

    A 33-year-old Nigerian national was ar-

    rested for possession and dealing in

    drugs lastweekWednesday by the flying

    squad.

    Bothasig Police spokesperson, Const

    Noloyiso Rwexana, elaborates: At

    about 08:30, members of the flying squad

    acted on information and arrested the

    suspect. He has been arrested before for

    a similar offence, so two cases are cur-

    rently being heard in Bellville andMait-

    land.

    Some 74 four small packets containing

    cocaine, one containing rock and one

    filled with dagga were found in his pos-

    session, along with R8 460 in cash.

    Nailed for dealing in drugs

    In all 74 small packets of cocaine, one with rock and one filled with dagga and cash

    were confiscated from a 33-year-old suspect last week.

    Schoolgirls in the Bothasig area are

    warned to be on their guard after an

    incident in Adam Tas Road recently.

    Says spokesperson for the local police,

    Const Noloyiso Rwexana: There is

    apparently a short, coloured man who

    follows young school girls, lifts their

    skirts and touches their private parts.

    Girls must be alert while walking from

    school!

    No criminal case was opened by the

    complainant who reported this incident.

    Twosuspectsmanaged to flee a robbery scene

    with R100 000 in cash on Tuesday 22 January.

    Police are urgently looking for the eyewit-

    ness who aided the investigation.

    According to Goodwood Police spokesper-

    son, Const Nokwanda Harmans, the incident

    happened on the corner of Hofmeyer and De

    Wet streets.

    Two suspects robbed a woman of R100 000

    and jumped into a vehicle. An unknown com-

    munity member who witnessed the robbery

    wrote the suspects vehicle registration

    number down. That person must please con-

    tact W/O Johannes Swart on 021 597 1760 or

    076 314 4993 as soon as possible, she adds.

    . Goodwood Crime Prevention Unit mem-

    bers arrested a man for possessing and deal-

    ing in drugs last week Thursday.

    Russians host Red Nose Day

    The Russian Network hosted a Red

    Nose Day at Goodwood Sports Ground

    last week Sunday in aid of children in

    need and abused children in the prov

    ince.

    This day for families was fun for young

    and old, since there were bullriding

    competitions, jumping castles and even

    ponies to ride on. Suffice to say that

    the kids were kept busy the whole day

    while the adults explored the delicious

    food stalls and explored the arts and

    crafts, clothing and tattoo stalls.

    Valuation roll

    released by

    city for 2012

    The City of Cape Town has produced the

    General Valuation Roll 2012 (GV 2012) in

    terms of theMunicipal Property RatesAct,

    that governs the valuation of properties.

    TheGV 2012was signed off by themunic-

    ipal valuer on 31 January 2013 and handed

    to the city manager.

    According to a city spokesperson, there

    are 815 676 properties on the GV 2012 roll

    with a total value of R913 billion.

    This is an approximate increase of about

    13 % over the total value of the General

    Valuation in 2009.

    The number of properties has increased

    by 39 925 since 2009.

    It has a valuation date of 1 July 2012,

    meaning that the properties are valued at

    the market rate on that date.

    Property rates based on the GV 2012 val-

    uations will be billed from 1 July 2013.

    Publishing the GV 2012 valuation roll in-

    cludes, publication of notices in the pro-

    vincial gazette, notices in local newspa-

    pers and posting notices to property own-

    ers.

    The valuation roll will also be posted on

    the cityswebsite: theGV2012will be avail-

    able from 21 February 2013 at www.cape-

    town.gov.za/propertyvaluationsad.

    The GV 2012 will be made available for

    inspection at 17 public inspection venues

    across the city. City officials will be availa-

    ble at these venues to assistmembers of the

    public who wish to inspect the valuation

    roll or submit an objection.

    Legislationallowsanyperson to lodgean

    objection against the valuation of any

    property on the valuation roll if they be-

    lieve that the valuation is incorrect.

    An objection must be submitted on the

    prescribed objection form. The website

    (www.capetown.gov.za/propertyvalua-

    tions) contains instructions for download-

    ing the prescribed objection form.

    An objection must be well motivated.

    Valuations on the GV 2012 were derived

    from sales that occurred around the valua-

    tion date (1 July 2012) and it is, therefore,

    best for an objector to motivate his or her

    objection by using information about sales

    which occurred around that date.

    Information about property sales have

    been made available on the citys website

    and it will also be available at the public

    inspection venues.

    OF 1985): AMENDMENT OF GENERAL STRUCTURE PLAN IN

    GENERAL STRUCTURE PLAN TO AUTHORISE MUNICIPALITIES TO GRANT OR REFUSE REZONING

    APPLICATIONS

    The Minister of Local Government, Environmental Affairs and Development Planning intends to, in terms

    of section 4(7) of the Land Use Planning Ordinance, 1985 (Ordinance 15 of 1985), read together with

    sections 5(2) and 42(1) of the same Ordinance, amend the General Structure Plan for the Western Cape

    Province, to authorise municipalities to grant or refuse rezoning applications in terms of sections 14(4),

    16(1) or 18 and to determine, in terms of section 16(2)(a), an extended period after which a rezoning shall

    lapse, subject thereto that the said authorisation shall not be applicable in the following cases, namely:

    (a) Any rezoning where, because of the nature and scale of land use to which it relates, has or will have a

    substantial effect on the order or co-ordinated and harmonious development of a region or the Province

    or on the general welfare of the inhabitants of the region or the Province, or

    (b) any rezoning where a state institution is not in favour thereof.

    Jean-Marc Johannes is all

    pended in the air with a

    twisted body and the next he

    was on his backside with a

    The pain would send most

    limping off, but Jean-Marc

    walked the limp off and then

    he pulled the move off per-

    fectly!

    This 22-year-old skate-

    boarder from the southern

    suburbs is one of the best in

    the country. In fact, if skate-

    boarding was a company he

    would be on the board, be-

    cause thats where he be-

    longs.

    Jean-Marc is not a bailer. He is a class skateboarder

    who has strutted his stuff on the international scene

    and he will also be competing at the UltimateX event

    at the V&A Waterfront on 16 February.

    He certainly knows what hes doing, so he has plenty

    of advice for beginners.

    When you start skateboarding there will come a

    time when youll think that this is not for you. I started

    10 years ago. Youll start doing basic tricks such as the

    olly, kick flips and pop-shove. I started havingmore fun

    with it and I started understanding the basics and final-

    ly I thought up my own tricks, he says.

    Gnarly (is that word still cool?) combinations of

    tricks will include names such as olly, laser flip, hard

    flip, kick flip, front-side flip and darkside grind.

    One of Jean-Marcs greatest memories in his career

    happened inAmsterdamwhen skaters fromall over the

    world had to perform three of their best tricks for a

    place on the 10-man podium.

    The first was a flip-grab combo, then someone else

    landed something way better and I thought Id have to

    step it up a bit.

    Then I landed a double backside flip, but then some-

    one landed something that was like a combination of

    four tricks. The guywent up, did a flip trick to amanual

    trick and then he went down a rail! That was amazing!

    My last one was a double-big spin flip down a set of

    stairs.

    I didnt expect anything, then they called my name

    and I got a podium place! I thought they were joking!

    looflike salaris- of loonverhoging, ook die

    spyker in jou, jou medewerknemers en/of

    jou onderneming se doodskiste is.

    Palm trees and the south-easter

    do not go together.

    The trees may look attractive

    during the winter months, but

    the strong winds of summer

    tear the leaves to shreds and

    the torn parts turn brown. The

    general appearance is very

    shabby.

    The poor trees look like

    people with torn, old clothes!

    They look untidy year-round.

    They do not improve the

    appearance of the areas where

    they are planted.

    Date palms must have

    their sagging branches sawn

    off every year. While the

    branches hang at the height of

    humans they are very danger-

    ous, as the thorns at the end

    of each leaf are impossible to

    remove from the skin and only

    come out once there is sepsis.

    They must be an absolute

    nightmare in an eye! Tips of

    cut branches lying on the

    ground can also pierce the legs

    of the unwary.

    What manager or group of

    managers in the Cape Town

    council have decided to plant

    palms in their hundreds

    instead of real trees? When the

    lovely indigenous trees were

    removed along the R27 for the

    construction of the bus lanes

    we were told that they would

    be replaced. The low plantings

    are pretty but are not trees,

    and the palms being planted in

    numbers are ghastly.

    I have been told that flying

    cockroaches breed in them.

    Some types of palm make a

    terrible noise when the wind

    blows, making the wind seem

    much worse.

    Transplanted palms have

    weak root systems and must

    fall eventually.

    The question of where the

    large palms come from also

    arises. Are they being removed

    from areas where they are

    useful? They grow densely on

    the dunes along the east coast

    of the country, forming a

    windbreak and preventing the

    beach sand from blowing

    CapeTown is not a

    tropical island

    On 22 January, I was home

    recovering from a back opera-

    tion when I heard the sound of

    chainsaws outside in the

    garden.

    Four men with four chain-

    saws cutting down a tree that

    took a very long time to grow.

    I went outside to request the

    workers to stop and show me

    the paperwork and who in-

    structed them to cut down the

    tree. No paperwork, no identifi-

    cation and refusal to speak

    English.

    I immediately called the

    police who did respond but did

    nothing to stop this carnage.

    The police went to the munici-

    pal council and came back with

    the name of the official who

    had appointed these tree

    trimming contractors.

    A request to the municipal

    council for trimming of this

    specific tree the correct way

    was placed in August 2012. The

    municipality responded that

    they had a backlog in trimming

    trees and appointed unscrupu-

    lous contractors who are doing

    their own thing with no regard

    to people or trees.

    All the useable branches were

    neatly sawed and packed on the

    contractors vehicle (probably

    for reselling) and the branches

    that had leaves on were left on

    the pavement.

    Humans have abused earth

    for so long that the few of us

    who do care about nature just

    get ignored.

    Western Cape government? The

    working in every aspect...

    focus on this gross crime that

    has been committed towards all

    DRAFT WESTERN CAPE LAND USE PLANNING BILL, 2013

    The Western Cape Government, Department of Environmental Affairs and Development Planning in

    collaboration with the municipalities, were, over the past couple of years, involved with the drafting of

    integrated Planning legislation for the Western Cape. The publication of the Draft Western Cape Land Use

    Planning Bill was approved by Cabinet on 28 November 2012.

    The draft bill was advertised in the Provincial Gazette Extraordinary No 7080/2013 for comment on 18

    January 2013. It is available on the departmental web page: www.westerncape.gov.za/eadp.

    Note that the draft bill is currently only available in English and Afrikaans, however, a copy in isiXhosa

    Sjokoladeblare vertoon ook

    baie mooi. Kooksjokolade

    werk die beste vir hierdie

    doel.

    Kies stewige blaartjies in

    die tuin roosblare werk

    goed. Was hulle en druk

    droog. Smelt die sjokolade en

    verf n dun lagie op die

    agterkant van elke blaartjie.

    Plaas in yskas en verkil.

    Verf dan nog een of twee

    lagies sjokolade oor, laat hard

    word tussen elke laag en trek

    dan die blaartjies versigtig af.

    Pienk, wit en ligpers

    skuimpies lyk ook baie mooi

    op die tert. Plaas dit op en

    rondom die tert net voor

    opdiening.

    Hierdie heerlike tert word

    somtyds met kaaskoek

    verwar, veral as ek n bolaag

    van ingelegte kersies opsit.

    Jy verdik net n blikkie

    kersies met n bietjie mielie-

    blom (Maizena), wat met

    water gemeng is.

    Laat dan eers die tert stol,

    skep dan die afgekoelde

    kersiemengsel oor en laat

    weer stol. Room kan ook

    hierby bedien word.

    Dit lyk pragtig op die tafel

    by n doopgeleentheid van n

    babadogtertjie.

    Jy het nodig:

    V koppie kookwater

    V 250 g Cremora-koffieverro-

    mer

    V 1 blik kondensmelk

    V koppie vars uitgedruk-

    te suurlemoensap

    V 500 g jogurt (Swartwoud-

    kersiegeur)

    V 1 pakkie rooi jellie, bv.

    framboosgeur

    V 1 pakkie beskuitjies,

    fyngemaak, bv. Marie-,

    tennis- of semelbeskuitjies

    V 5 eetlepels gesmelte botter

    of margarien

    V Flake-sjokoladestafie vir

    versiering

    So maak mens:

    Meng die fyngemaakte

    beskuitjies met die gesmelte

    botter of margarien en druk

    vas op die boom van n

    geskikte bak.

    Meng die Cremora-poeier

    goed met die halwe koppie

    kookwater en plaas in yskas

    en verkil. Klits dan tot styf

    en romerig. Meng dan die

    kondensmelk en suurlemoen-

    sap by en klits goed.

    Maak intussen die jellie

    aan volgens die instruksies

    op die pakkie en laat afkoel,

    maar moenie dat dit stol nie.

    Meng die jogurt en jellie by

    die kondensmelkmengsel en

    gooi oor die beskuitjiekors in

    die bak.

    Versier met die Flake-sjoko-

    lade. Plaas in die yskas om

    verder te stol.

    LAND USE PLANNING ORDINANCE, 1985 (ORDINANCE 15 0F

    1985) AMENDMENT OF ZONING SCHEME REGULATIONS IN

    TERMS OF SECTION 7(2), SECTION 8 AND SECTION 9(2)

    The Minister of Local Government, Environmental Affairs and Development Planning intends to amend in

    terms of section 9(2) of the Land Use Planning Ordinance, 1985, (Ordinance 15 of 1985) (LUPO), the zoning

    scheme regulations approved in terms of Provincial Notices 1047 and 1048 of 5 December 1988 as amended

    by Provincial Notice 177 of 2009, regarding the powers of municipalities in terms of the Ordinance to grant

    or refuse applications for departures and subdivisions, including instances where restrictive title conditions

    are involved, as follows:

    1 DEPARTURES

    1.1 Regulation 2.1 of the Scheme Regulations made in terms of section 7(2) of the Ordinance and

    published in Provincial Notice 1047 of 5 December 1988 to supplement the Scheme Regulations

    relating to the zoning schemes set out in the Schedule thereto as amended by P.N. 177/2009 of

    29 May 2009, shall be amended to read as follows:

    A Municipal Council may in terms of subsections (1)(b) and (5) of section 15 of the Ordinance

    respectively grant or refuse an application for a departure, or determine an extended period after

    which such departure shall lapse: provided that, where the Council authorises the utilization of

    land on a temporary basis as contemplated by section 15(1)(a)(ii), such concession shall be granted

    for a maximum period of five years, with the exception of a departure for a mining activity, in which

    case the concession may be granted for such number of years as is related to the expected lifetime

    of the mine concerned.

    1.2 Regulation 5.1.1 of the Scheme Regulations made in terms of section 8 of the Ordinance, published

    in Provincial Notice 1048 of 5 December 1988 as amended by P.N. 177/2009, shall be amended to read

    as follows:

    A Municipal Council may in terms of section 15(1)(b) section 15 of the Ordinance respectively grant

    or refuse an application for a departure, or in terms of section 15(5) determine an extended period

    after which such departure shall lapse: provided that, where the Council authorises the utilization of

    land on a temporary basis as contemplated by section 15(1)(a)(ii), such concession shall be granted

    for a maximum period of five years, with the exception of a departure for a mining activity, in which

    case the concession may be granted for such number of years as is related to the expected lifetime

    of the mine concerned.

    2 SUBDIVISIONS

    2.1 Regulation 3.1 of the Scheme Regulations made in terms of section 7(2) of the Ordinance and

    published in Provincial Notice 1047 of 5 December 1988 to supplement the Scheme Regulations

    relating to the zoning schemes set out in the Schedule thereto as amended by P.N. 177/2009, shall be

    amended to read as follows:

    A Municipal Council may grant or refuse an application for the subdivision of land in terms of section

    25(1) of the Ordinance within, and subject to the conditions applicable to a sub divisional area, as well

    as an application for the subdivision of land involving no change in zoning.

    2.2 Regulation 5.2.1 of the Scheme Regulations made in terms of section 8 of the Ordinance, published

    in Provincial Notice 1048 of 5 December 1988 as amended by P.N. 177/2009, shall be amended to read

    as follows:

    A Municipal Council may grant or refuse an application for the subdivision of land in terms of section

    25(1) of the Ordinance within, and subject to the conditions applicable to a sub divisional area, as well

    as an application for the subdivision of land involving no change in zoning.

    3 REMOVAL OF RESTRICTIONS

    3.1 Regulation 4 of the Scheme Regulations made in terms of section 7(2) of the Ordinance and

    published in Provincial Notice 1047 of 5 December 1988 to supplement the Scheme Regulations

    relating to the zoning schemes set out in the Schedule thereto as amended by P.N. 177/2009, shall be

    amended to read as follows:

    Notwithstanding regulations 2 and 3, all conditions restricting subdivision, the number of buildings

    that may be erected or the utilisation of land or any other restrictive conditions which may have a

    bearing on the rezoning, subdivision or departure applied for and registered against the land unit

    shall, where applicable, first be removed prior to an application being granted.

    3.2 Regulation 5.3 of the Scheme Regulations made in terms of section 8 of the Ordinance, published

    in Provincial Notice 1048 of December 1988 as amended by P.N. 177/2009, shall be amended to read

    as follows:

    Notwithstanding regulations 5.1 and 5.2 of these regulations, all conditions restricting subdivision,

    the number of buildings that may be erected or the utilisation of land or any other restrictive

    conditions which may have a bearing on the rezoning, subdivision or departure applied for and

    registered against the land unit shall, where applicable, first be removed prior to an application being

    granted.
