Dear Secretary Chu:

I am writing to urge your support for a renewable fuels and power project that is under development in my districtand will soon apply for a loan guarantee from the Department of Energy (DOE) under Section 1705, which was

created by Congress in the American Recovery and Reinvestment Act (ARRA) to help fund the development ofadvanced renewable energy project.

The Rentech Rialto Renewable Energy Center in Rialto, CA, will be a break- facility that will produce fuels andpower that will have a near-zero carbon footprint. It is not only in alignment with the environmental goals of theState of California, but also very much within the spirit and letter of the objectives laid out by Congress and the

Administration in the Act. I am pleased that Rentech, a Los Angeles-based alternative energy company, has

selected Rialto as the site for this first-of-a-kind plant. I understand that the project will bring approximately 250new jobs during construction and create approximately 70 full-time positions at the site once the facility is fullyoperational. Equally important, it will produce renewable fuels and power that help to reduce our dependenceupon foreign oil while improving air quality in Southern California and cutting green house gas emissions.

As I stated above, Rentech will be seeking funding for this project through the DOE's Section 1705 loanguarantee program. This project meets the guidelines established in the ARRA for energy security, environmentalbenefit and jobs creation and will do so within the timeframe required by the law. It is my understanding that the

proposed project is one of the few under development in the State that can contribute to achieving goals set inthree of Governor S~hwar;a;~egger's Executive Orders 'oi1renewable'energyand environmental improvements:

I) Executive Order S-06-06: Rentech's Rialto facility will provide enough renewable electricity from greenbiomass for approximatel~nd will help meet the Order's goal to increase biomass powerutilization in California; ..........

2) Executive Orders S-21-09 and S-14-08: The electricity generated from the Rialto facility will be steady"baseload" power and help meet the Orders' goal of33 percent of the state's electricity coming from renewable

sources by 2020;

3) Executive Order S-01-07: The low-carbon footprint of Rentech's unique renewable fuel, RenDiesel"', willhelp the transportation sector meet the Order's largets, as established in the Low Carbon Fuel Standard, to reducethe carbon intensity of transportation fuels by 2020.

The Elijah Cummings Youth Program in Israel (ECYP) is a leadershipdevelopment program designed to build relationships between Baltimore'sdiverse communities. We try to foster positive bonds between ethnic groups andtrain our youth to become successful future leaders. At our organization, weinvest in two important programs, one of which sends students to Israel for afour-week trip. We also offer the Jerold C. Hoftberger Leadership EnhancementProgram, which is a two year program in which we teach students theimportance of cooperation, diversity, and civic engagement.

We are writing as Hispanic Members of Congress to encourage a timely and favorable reviewwithin the applicable laws, rules and regulations of Comcast and General Electric's (GE)proposed NBC Universal (NBCU) joint venture. While a thorough review is called for, webelieve that the benefits that this transaction canies are easily sufhcient to allay any concernsthat might be created by what is essentially a vertical combination of NBCU's content withComcast's multiple distribution platforms. Consumers will benefit from the sustained innovationand investment that NBCU will gain from Comcast, jobs in the industry will be preserved andultimately created, and new programming opportunities will rise out of the new company's needto continue growing.

Comcast and NBCU have made substantial commitments to the Hispanic community, which willset the standard for responsible corporate citizenship and serve as a model for other information,communications, and technology companies in the United States. When the companiesannounced their intention to form a joint venture, they also announced a series of importantcommitments to diverse communities, especially the growing Hispanic community. Recognizingthat the new entity's programming will speak to more Hispanic viewers than ever before and thata significant amount of Hispanic households continue to rely on over-the-air broadcasting,Comcast and NBCU committed that the new NBCU will strengthen Telemundo and will launcha new multicast channel on Telemundo's digital broadcast spectrum. The new NBCU also willsignificantly increase Telemundo and mun2 programming choices available On Demand andonline.

Comcast and NBCU have recently expanded these initial commitments with the announcementthat Comcast will add independently-owned and operated cable networks with substantial Latinoownership interests, will expand the caniage of existing Latino-owned channels, and willestablish an external Hispanic Advisory Council, as well as diversity councils representing othercommunities, to advise on their groundbreaking diversity initiatives. These steps will providesolid metrics that can be monitored and tracked as the joint venture moves forward. It is ourunderstanding that Comcast, NBCU and a group of prominent organizations in the Hispaniccommunity have reached an agreement that confirms and provides for ongoing review of thesecommitments. We look forward to playing a role in this oversight of the Comcast/NBCUcommitments and the performance of the media industry in general.

Clyburn Announces MOX Fuel Facility Funding for Savannah River SiteMay 23, 2007

(Washington, DC) – House Majority Whip and Sixth District Congressman James E. Clyburn today announced a new MOX fuel facility at the Savannah River Site has cleared its first hurdle to secure federal funding. Today the Energy and Water Subcommittee of the House Appropriations Committee passed its FY ’08 Energy and Water Appropriations Bill and included $168 million for the facility that will turn weapons-grade plutonium into nuclear reactor fuel. “I am pleased to have worked closely with John Spratt to secure the funding to move this project forward,” Congressman Clyburn said. “The MOX program at SRS was a priority of mine while serving on the Appropriations Committee, and I am pleased they responded to my insistence that the funding remain in this year’s appropriations bill.” The funding had been in jeopardy. The two South Carolina Congressmen, who both carry significant clout in Congress, fought hard to keep funding for the MOX facility. Congressman Clyburn received special permission to participate in a subcommittee hearing with Energy Secretary Bodman earlier this year so that he could seek a commitment from him on the MOX fuel project. The bill must clear the full House Appropriations Committee before being considered by both the House and Senate. # # #

SEN. HATCH: Well, thank you, Mr. Chairman.

Let me start with you, Mr. Leibowitz -- Chairman Leibowitz. You mentioned in your testimony that you were actively pursuing two cases which assert -- which you assert are pay-for-delay cases. Court papers recently filed by Watson Pharmaceuticals CEO Paul Bisaro -- is his name, I believe -- alleged that the FTC threatened to initiate an investigation of Watson if the company did not waive its exclusivity rights to a generic version of Provigil so that a foreign competitor could enter the market. Now, the court brief includes the following allegations, quote, "that the FTC obtained confidential information from the FDA and shared that information with Watson and Apotex"; next paragraph, quote, "that the FTC obtained confidential information from Watson and apparently shared it with Watson's competitor Apotex"; and then one more: quote, "that Markus Meier, assistant director of the FTC Bureau of Competitions Health Care Division, asserted that FTC's 'front office,'" in quotes, "would open an investigation of Watson if Watson did not relinquish its potential exclusivity rights," unquote.

Now, Chairman Leibowitz, what concerns me is that the FTC apparently did not deny any of these allegations. Were you aware of Mr. Meier's actions in this matter, and can you look into these allegations and provide me with more information about what happened?

MR. LEIBOWITZ: We would be happy to do that. And the reason we haven't responded to this yet is because that was a filing by a company, Watson, and -- in the AndroGel case. And it's a filing in response to our insistence that we -- that the CEO be subpoenaed. So it's one thing for a company to -- it's one thing for a company to disagree with our case. You have a right to say this isn't a pay-for- delay or a reverse-payment case, and that's fine. It's another thing, as I understand it, not to even be deposed.

So we're going to respond in court papers. We are going to take a look at this. I'm going to get back to you. I don't believe -- Markus Meier is a very, very good and experienced litigator. He runs our health care practice. And I don't believe that he would ever breach confidentiality, but we're going to take a look at that because I think that's important.

MR. LEIBOWITZ: We will.
