other material will be handled in accordance with the enclosed instructions.

It is imperative that the fiveday timetable be adhered to, strictly.

HOUSE SELECT COMMITTEE ON ASSASSINATIONS

U. S. HOUSE OF REPRESENTATIVES (HSCA)

PURPOSE: To advise of procedures to be followed in reviewing the Final

Report, Staff Reports, or other materials furnished to the U. S. Departm

ent

of Justice (USDJ) and FBI by the HSCA.

BACKGROUND: The HSCA has been inquiring into the assassinations of

President John F. Kennedy and the Reverend Martin Luther King, Jr.

The Memorandum of Understanding between the HSCA and the USDJ,

signed by the Attorney General on 10/5/77, specifies that the USDJ and

its components (FBI) will have only five days (calendar) to provide

written objections to information which the HSCA intends to disclose.

The formal submission of materials, such as the Committee's

Final Report and Staff Reports, will constitute its notice to us that

the HSCA intends to disclose such information. The five days will begi

n

to toll upon receipt of these materials. According to the Memorandum o

f

Understanding, " . . . If within five days from receipt of such notice

the Chairman does not receive written notice from the Attorney General

or his designee objecting to the proposed disclosure and stating the

reasons for it, the Committee may disclose the information . . . "

Permissible objections, according to the Memorandum of Under-

standing, are limited to the following categories of information.

1. That which tends to identify or compromise:

a. Sensitive ongoing foreign intelligence operations

and sources and other sources or methods of comparable

sensitivity.

b. " . . . FBI sources who are or were informants or

potential informants as defined in the FBI Manual

of Instructions."

c. "Sources" defined as " . . . persons who have provided

or continue to provide information to the FBI

and as to whose identity the FBI has undertaken

an obligation of confidentiality."

2. That which " . reveals matters in current litigation

or in which criminal prosecution is pending . . . "

3. That which " . is classified information designated

for protection from unauthorized disclosure by the Attorney

General or an other properly designated official that

identifies peculiarly sensitive foreign intelligence

sources . . . "

When the Committee Chairman has been provided written objections

and reasons therefor within the prescribed five days (calendar), he or

his representative will then meet with the Attorney General or his

representative " . . . to attempt to resolve any differences over the

information to be disclosed . . . " " . . . Any differences left

unresolved by negotiation may become the subject of litigation . . . "

The Bureau has been engaged in an- informal review of the

Committee's material since December, 1978. It is hoped that all major

problems have been resolved through that informal review. (See Attachment

2.)

ACTION: Each addressee will receive a complete copy of all materials

furnished to the Bureau. Attachment 1 reflects the Committee's breakdown

of material previously made available to Bureau representatives for

informal review. Attachment 1 also designates primary Divisional

responsibility for particular sections as they are known at this time.

Day 3 - By close of business (or sooner), each Division wi

hand carry the original and 15 copies of final

(smooth) drafts of letterhead memoranda suitable

for dissemination setting forth permissible objections

(see above) with all reasons therefor to Special Agent

(SA) George J. Foster, Room 8988. By routing slip,

each Division will identify the writer and telephone

extension number to be called regarding each objection.

Advise SA,Foster by routing slip if no objections are

to be tendered. See note below.

Day 4 - Representatives of Legal Liaison and Congressional

Affairs Unit, Legal Counsel Division, and the

Congressional Inquiry Unit, Records Management Division,

will coordinate with FBI Legal Counsel and with the

Deputy Assistant Attorney General Robert L. Keuch,

USDJ, concerning submission of specific objections.

Divisions will accomplish any rewrites as necessary.

Day 5 - Submit final response to USDJ.

It must be emphasized that only those objections permitted

under the Memorandum of Understanding need be addressed within the five-

day limit.

Factual errors should also be handled within the five-day

limit by telephonically furnishing documented corrections to SA Drew J.

Clark, extension 3685. Arrangements have been made with the remaining

Committee Staff to handle these corrections informally. Any misspellings

or incorrect grammatical constructions involved in statements about the

FBI or its personnel should be brought to SA Clark's attention. Every

effort will be made to have such minor errors corrected by the Committee.

NOTE: A separate letterhead memorandum will be written for each separate

objection. Each letterhead memorandum will be captioned "House Select

Committee on Assassinations; U. S. House of Representatives; Bufile

62-117290." For the sake of uniformity, each letterhead memorandum may

begin with the following or similar language: A review of the HSCA

Final Report, Section JFK-C-3, "Cuban Exiles" conducted in accordance

with the Memorandum of Understanding, discloses the following on page

213. (Repeat Committee language, state objection, supply complete

reasons for same, and suggest alternative language. Insure objection is

permitted under the Memorandum of Understanding.) (See pages 1 and •

2.)


U. S. House of Representatives (HSCA)

It will be necessary for each addressee to assign sufficient

Agent manpower, with thebest expertise immediately available, to review

all the material and to -thoroughly scrutinize those sections for which

primary responsibility has been. assigned to the addressees.

The Projects Unit, Document Classification and Review Section,

Records Management Division, will be responsible for reviewing, within

the established time limit, for classification purposes, all material

furnished to the Bureau. Any problems relating to classified matters

should be coordinated with SA William A. Harwood, Unit Chief, Projects

Unit, extension 3565% SA Harwood's Unit will prepare any letterhead

memoranda or internal comments required.

The Records Management Division will arrange for all required

reproduction facilities in order to provide timely distribution of

complete copies to all addressees. Because of the time constraints

imposed by the Memorandum of Understanding, this reproduction must take

precedence over routine matters.

Addressees. will insure that reviewers are particularly alert

to identify any statements or conclusions of the HSCA which warrant

internal comment or rebuttal that may not be construed as permissible

objections under the Memorandum of Understanding. Such internal comments

should be handled expeditiously but without regard to the five-day

timetable imposed by the Memorandum of Understanding. These comments

should be brought to the attention of the Associate Director, the Deputy

Associate Director, and the Public Affairs Office in light of the

potential media and other attention that may be generated by publication

of the HSCA's report. Primary Divisional responsibility for generating

internal comments will be id accordance with Attachment 1 and other

responsibilities assigned herein.

Addressees should immediately appoint coordinators for the

Division's total effort. These coordinators should identify themselves

to SA Foster, extension 3685, in order to facilitate receipt of material

and subsequent processing.

The page count of material to be furnished is not known at

this time, but it may approach 2,500.

A review of the HSCA Final Report was conducted in accordance with the Memorandum of Understanding. Particular attention was given by the Laboratory to the scientific matters. The Laboratory interposes no objections to the material as it is presented. A review of the House Select Committee on Assassinations' report has been completed by the Criminal Investigative Division (CID) in accordance with the instructions contained in memorandum dated 4/10/79. The one item concerning the identity of sources has been taken up with SA John T. Aldhizer and con-sideration is being given to the preparation of an appropriate LHM concerning this item. No other items concerning permissible objections were noted, although the Division is not in agreement with all statements and conclusions reached by the House Committee.

REFERENCE: By Memorandum from Mr. Adams and Mr. McDermott to Mr. Cochran and other Assistant Directors, dated 4/10/79, captioned as above, the Technical Services Division was instructed to review the HSCA Final Report, Staff Reports, and other material; raise any permissible objections according to the Memorandum of Understanding between the HSCA and the

U.S. Department of Jugtice (USDJ); and advise SA Foster by routing slip if no permissible objections are being tendered.

PURPOSE: To advise SA Foster that no permissible objections are being tendered by Technical Services Division.

DETAILS: The TSD has reviewed the pertinent sections of the "Report of the House Select Committee on Assassina-tions; U.S. House of Representatives." At this time, TSD has no permissible basis for objection to the report of the ESCA under the rules established by the Memorandum of Understanding between the HSCA and the USDJ. This material was reviewed

by SA's Steven A. Killion and James B. Reames.

For the information of SA Foster or SA Clark, a review of the Appendix to Hearings Before the HSCA, Volume VIII, "Acoustics, Polygraph, Handwriting and Fingerprint Reports" states on page 32 "Thus, the probability is 95 percent or more that the impulses and echoes have the same source - a gunshot, or a sound at least as sound as a gunshot, from the grassy knoll." Enclosed are the original and one copy of a memorandum responding

in full to a May 31, 1979, inquiry of Mr. G. Robert Blakey, former Chief Counsel and Staff Director, RUA.

On May 31, 1079, Mr. Blakey telephoned Special Agent-Drew J. Clark from Ithaca, New York, where Mr. Blakey has returned to professorial

duties at the Cornell Law School.

Mr. Blakey advised that a recent article appearing in "Gallery"

magazine has caused him to focus on a question which he believes presents a

mutual problem for the HSCA and the Bureau. .

Mt. Blakey explained that when the HSCA's consultant in activation analysis had occasion to measure and weigh the fatal bullet and bullet fragments recovered after the assassination of President John F. Kennedy, which are now in the custody of the National Archives and Records

Service (NAM), the consultant found no particles comparable in number, size

or weight to those originally analyzed by the FBI Laboratory in 1963

and 1964.

This responds in full to a Nay 31, 1979, inquiry received from G. Robert Blakey, former Chief Counsel and Staff Director, MCA.

Mr. Blakey advised that a recent magazine article has caused him to focus on a question which involves the bullet and bullet fragments recovered after the assassination of President John P. Kennedy. Ne explained that when the HSCA's consultant in neutron activation analysis (NAA) had occasion to measure and weigh the bullet and bullet fragments now in the custody of the National Archives and Records Service (KARS), the consultant found no particles comparable in number, size, or -weight to those originally analyzed by the FBI Laboratory in 1963 and 1964.

FBI inquiry and research indicates the following:

A representative of the FBI Laboratory contacted a former Special Agent who was involved with the ex citation of metal fragments by KRA. This person advised that it was his recollection that the metal fragments which were made radioactive

e disposed of as "radioactive trash° at the Oak Ridge National Laboratory (ORNL). Re stated that this was the appropriate . method of dealing with these radioactive samples.

NARS may not have preserved the-exact number or mass of evidence

delivered to it by the FBI Laboratory.

Past research in Bureau files indicates that the fatal

ballistic evidence was subjected to both spectographic and neutron

activation analysis by the FBI. Laboratory. It seems logical that

some mass was consumed or otherwise depleted as a result of these

examinations and this may be documented through a review of the

original examiner notes.

The July, 1979, issue of "Gallery" magazine has been

obtained and a copy of the pertinent portion of the 32-page article

(page 20), entitled "Special Gallery Report--The JFK Assassination,"

is attached. Separately, a complete copy of the article with a

recording disk will be delivered to the Technical Services Divi-

sion and copies of the 32-page article will be delivered to the

Criminal Investigative Division and Laboratory Division for

information and any further action deemed appropriate.

It is felt that it would be in the best interests of the

Bureau to set the record straight and explain how much evidence

was originally obtained (number, size and weight), how the evidence

may have been altered through examination, and exactly how much

was transferred to NARS.

RECOMMENDATIONS: 1. That the Laboratory Division prepare a letter-

head memorandum (LHM) predicated on Blakey's

concern and setting forth a detailed history of the Laboratory's

receipt of the fatal ballistic evidence, its examinations of same,

and eventual transfer of same to NARS, to include an explanation

that specifically addresses how and why the number or mass of

evidence may have been altered while in the custody of the FBI.

I etc. And yet when we read tt majority report. you will fit that they do not hesitate to con-jecture and speculate and ar-rive at some conclusions and hypotheses that have no basis in fact whatsoever, when it suits their purpose. When it does not suit their purpose. they simply say. "We cannot engage in this kind of scientific speculation because we simply don't know that it is accurate.-

I would like you to know—as I stated when I gave my testimony —that on numerous occasions with the entire panel as individuals and as a group. I pleaded. cajoled. provoked. challenged. in every possible way. all of them to come for-ward with one bullet from any of their vast array of cases that would even begin to simulate the near pristine appearance of CE 399 [the "magic bullet-1. What they like to say —al-though not too often when I'm around—is. "Well, we don't know that a bullet could not do this." And they will even sometimes say that they have seen bullets like CE 399. It should be clearly, emphatically noted for the record that no such "magic bullet" had ever been produced. I think it was pointed out that the nine of us on the panel had collectively done over 100.000 autopsies. That's an awful lot of postmor-tem examinations. And I told them, "Fellas. I'm not holding you to 51 percent: not even I percent: not even 1/100th of I percent. Just bring in one bullet—one bullet that has done what CE 399 is alleged to have done and which emerged in the intact condition of this wondrous missile. You've got all the time in the world. Bring in one documented bullet like the JFK stretcher bullet." Well, as you know, no such bul-let has ever been produced. And I think that this. perhaps. is the bottom line. There is no such bullet. There never was and never can be. There will never be experiments repeated under government auspices of the kind that were performed in 1964, because they've al-ready got enough difficulty liv-ing with those results. There's no way in the world that they want to account for similar re-sults under an even more con-trolled background today.

he Assassinations 1:111 Comthittee had more than autopsy evidence to over-

come. A mass of physical evi-dence exists in the Kennedy case that is subject to scientific testing and analysis.

During its public hearings.-the Committee presented a great deal of expert testimony that appeared to bolster the Warren Report. However. the testimony was not as valid as it appeared to be:

Neutron Activation Analysis One of the most sophisticated methods by which the single-bullet and lone-assassin theo-ries can be tested involves neutron-activation analysis (NAA) by which analyses of trace elements present in the metals are compared.

The FBI submitted Kennedy ballistics evidence to the Atomic Energy Commission for the purpose of conducting NAA in 1964. however the re-sults of those tests were never made available to the Warren Commission. The Assassina-tions Committee commissioned Dr. Vincent P. Guinn. an expert in the field of NAA, to conduct tests on the various bullets and fragments in evidence. Guinn compared bullet fragments al-legedly taken from President Kennedy's brain with frag-ments allegedly found in the Presidential limousine. He also compared fragments allegedly from Governor Connally's wrist with CE 399. the alleged single bullet.

Guinn found that it was "highly probable" that the fragments found in the car and brain matched and that the bul-

let fragments taken from Con-nally's wrist came from CE 399—persuasive evidence in support of the single-bullet theory. Guinn concluded that "there is no evidence for three bullets, four bullets, or any-thing more than two."

This testimony was the most dramatic evidence yet pre-sented in support of the Warren Commission's lone-assassin findings. Once again, however. the Committee failed to ask the right questions. Fortunately. George Lardner of the Wash-ington Post did not. Questlbned by Lardner after the Committee

• session. Guinn conceded that key fragments were missing. and. more important. that the fragments he tested were not the same ones tested by the FBI in. 1964. Elatorating. he said that he was given only two fragments from Kennedy's brain, neither of which weighed the same as any of the four brain fragments tested by the FBI. Similarly, neither of the two "Connally wrist frag-ments" weighed the same as any of the three tested by the FBI.

Where did these fragments come from? Testimony elicited from FBI firearms expert Robert A. Frazier at the Clay Shaw conspiracy trial suggests a sinister possibility. According to the Warren Report. the FBI had removed only a small piece of CE 399's outside jacket for NAA testing. Frazier con-ceded, however, that a sample was also removed from the bul-let's base.

That a piece of CE 399's lead base was removed and is unac-counted for raises grave ques-tions about the origin of frag-ments tested by Guinn. Why are Guinn's fragments differ-ent from those that were tested in 1964? That is a question the Assassinations Committee failed to ask.

Congressman Chris Dodd. the only member of the Assas-sinations Committee who dis-sents from the conclusion that the shot from the grassy knoll missed, raised new doubts about the NAA tests. At the closing moments of the Com-mittee's public hearings. Dodd asked Chief Counsel Blakey if. in view of the acoustic evi-dence. he might be willing to comment upon "a bullet frag-ment found in the limousine that for some time has not been easily identifiable as a result of neutron activation tests." Blakey. pleading memory lapse. promised Dodd a private briefing later. No clarification about this never-before-men-tioned fragment has been forthcoming at this writing.

Ballistics, Trajectory The Committee produced many "expert" witnesses who demon-strated a predisposition to the of-ficial lone-assassin findings.

Ballistics expert Larry Stur-divan (who had also done work for the Warren Commission) testified that the bullet that hit Governor Connally had proba-bly first passed through Presi-dent Kennedy. He based this conclusion on the alleged de-scription by Dr. Robert Shaw. Connally's attending physician. of a long, elliptical back wound. Sturdivan said that this could only have been caused by a bul-let that had first struck some-thing else and had begun to tumble. In fact. Dr. Shaw has always unequivocally rejected the single-bullet "theury and maintains that "the wound of entrance was consistent with a bullet that had not struck any-thing else" before it struck Governor Connally. Shaw was

cet# SYNOPSIS: Former Laboratory SA advised that radioactive metal samples were disposed of at Oak Ridge National Laboratory (ORNL),. A review of Bureau file indicates that certain "fatal ballistic' evidence," namely specimens Ql through' 05, Q9, Q14 and 015 were,P6/ examined by neutron activation analysis (NAA) and/or emission \/-__ spectroscopy. Portions (exact weight not determined) of these specimens were consumed by emission spectroscopy. Weighed replicate samples of specimens 01, 02, 04, 05, Q9 and Q14 were analyzed by NAA. All of these samples were disposed of at ORNL. What remained of specimens 01 through Q5, Q9, Q14 and 015 after cleaning and analysis was transferred to National Archives and Records Service (NARS) in 1966.

RECOMMENDATION:

That the attached LHM with cover letter be approved for transmission to Deputy Assistant Attorney General Robert L. Keuch.

that it was his recollection that the lead fragments which were

made radioactive were disposed of as "radioactive trash" at the

ORNL. This, according to Gallagher, was the appropriate

method of dealing with these radioactive samples at the time.

The HSCA's consultant in NAA, Dr. Vincent P. Guinn, Professor

of Chemistry, University of California, Irvine, made an informal

inquiry about these specimens to SA John Kilty in May 1978.

Kilty stated that if the fragments were not maintained by NAPS

they were most likely disposed of at ORNL.

A review of pertinent documents in the file reveals the

following concerning the description and weight of the "fatal

ballistic evidence" when it was received in the FBI Laboratory:

The milligram weight was determined by multiplying the grain weight by 64.8. The documents do not show metric weights when the specimens were first received.

Other documents in the file show that all the above-listed specimens were examined by emission spectroscopy. This method of analysis consumes, by burning, the metal analyzed. The documents do not indicate the weight of material analyzed; however, it was likely less than 10 milligrams per specimen.

The documents pertaining to the NAA of the specimens show that metal samples weighing the following were subjected to this type of analysis:

It is pointed out that the documents indicate that replicate samples were analyzed. For example, five replicates of Ql were analyzed which have a total weight of 17.73 milligrams. These are the samples which were disposed of at ORNL and to which Professor Guinn refers.

It is also pointed out that some mass of material may have been "lost" because of the necessity for cleaning the specimens prior to emission spectroscopy and NAA.

Information concerning the weights of the specimens when they were turned over to NAPS is not retrievable from Bureau files. However, Bureau records disclose that the "fatal ballistic evidence" listed above minus the portion removed for analysis and/or cleaning was transferred to NABS in 1966.

This is to advise that the FBI has completed its review of the HSCA's Final Report and eight Staff Reports in accordance with Section VII

of the October 5, 1977, Memorandum of Understanding between the:Department

of Justice and the HSU.

The FBI has no permissible objection to make, at this time, under Section VII of the Memorandum of Understanding since all auch objections were presented to HSCA former Chief Counsel C. Robert Blakey on June 15, 1979. At that time, be accepted certain objections and be did cause certain changes to be made which mow obviate the necessity of presenting formal objections.

Robert Blakey at Cornell Law , - School, Ithaca, New York; and Blakey's editorial staff, House Annex II; Washington, D.C. During the Call substantive objections under the Memorandum of Understanding were presented, as well as detected errors in fact. Blakey contemporaneously instructed his editorial staff to make certain changes which eliminated the substantive objections and corrected the factual errors. Police Department officers conducted the original investi-

gation of the shooting at General Walker's residence on

April 10, 1963. At that time, reportedly, a Dallas police

officer, Billy Gene Norvell, located a bullet among debris

at Walker's residence. On June 3, 1964, Norvell advised

an FBI Agent that °. he then picked up the bullet and

scratched his initials '14.N.° or his initial 'N' on the

On May 28, 1964, B. G. Brown, a Dallas police -1

officer assigned to the Crime Scene Search Section (CSSS),

Special Agent Odum forwarded the Walker bullet to the FBI Laboratory where it arrived for examination on December 4, 1963. The FBI Laboratory compared the Walker bullet to test --. bullets fired from the Oswald rifle, 01766, however, no positive identification could be made. The FBI record of this examination shows no indication that the FBI significantly altered the Walker bullet in any respect during the examination. The FBI designated the Walker bullet as Specimen Q188 and Item Number C-148. Item C-148 was delivered to the Warren Commission on March 21, 1964. It was subsequently designated Warren Commission Exhibit- 573 (CZ 573). A 1963 photograph of the Walker bullet in FBI records appears identical to CZ 573. FBI records indicate that Item C-148 was turned over to the custody of the National Archives and . Records Service (MARS) in 1966.

On June 29, 1979, a representative of MARS accompanied CZ 573 to FBI Headquarters where the bullet was microscopically examined in the FBI Laboratory, while remaining within the observa-tion, oontrol and custody of the MARS representative. The follow-ing were noted: CZ 573 appears to be contained in an original Dallas Police evidence box. The cover (top) of the box bears '4-10-63 4011 Turtle. CZ Burg by F. A. DGB RF JR Q188." The inside bottom of the box bears "Day 7640" and the outside bottom bears "7640 Day' as well as "Q188" and 'Rm.' .

Identifiable marks were found inscribed on varying por-tions of the bullet itself. It must be understood that certain markings are clearly discernible, others admit of more than one interpretation, while others may be obscured by oxidation or other-wise. Among the discernible markings are °Q188" and letters which appear to be as follows. 'N,' "B," °D," '0' or 'D,' 'Jr (with "R" joined to 'J'), 'IF' (with 'X' joined to 'Re).

- The 'B,' "J." and "D' may refer to Dallas police officera Norvell, Brown and Lieutenant J. C. Day. The "A' may refer to Mr. Alexander or Mr. Anderson, CCCIL. The significance of "0" or "D" is not certain at this time. The "JR" and "RF" refer to FBI Laboratory examiners in 1963.

In conclusion, the Walker bullet, CE 573, as it exists in NABS at this writing, appears identical to Q188 as it was examined in the FBI Laboratory in 1963. If, in fact, the HSCA

September,-1978, hearings, then the *SCA is correct according to FBI records, and General Walker is mistaken in his recollection.

At present, only the published record of BSCA hearings can speak to what the BSC& say have displayed or referred to with regard to

. the Walker bullet. General Walker is free to obtain the published

'MCA hearings from the Government Printing Office, Worth Capitol

and I Streets, Washington, D. C. 20401.

NOTE: This matter has been coordinated with Messrs. Marion Johnson and Mike Leahy, NABS, and Special Agent McNair

Perry, Firearms-Tool Marks Unit, Laboratory Division. Involved

in the 6/29/79 Laboratory examination were Laboratory Technicians

Joseph Twardowski and Robert Murphy. Twenty-four photographs of
