General Provisions

I. INTRODUCTIONPolicy: In carrying out its teaching, research, and public service activities, the University has an obligation to maintain conditions under which the work of its members--the faculty, students and staff--can go forward freely, in accordance with the highest standards of excellence, institutional integrity, and freedom of expression, and with full recognition by all concerned of the rights, privileges, and responsibilities of those who comprise the University community. UCSD Campus regulations and procedures shall be designed to protect and promote the rights of members of the UCSD community, prevent interference with University or UCSD functions or activities, and comply with all pertinent laws and University policies. In order to carry on its work of teaching, research, and public service, UC San Diego has an obligation to maintain conditions under which its work can go forward freely, in accordance with the highest standards of quality, institutional integrity, and freedom of expression, with full recognition by all concerned of the rights and privileges, as well as responsibilities, of those who comprise the UCSD community. Each member of the University community shares the responsibility of maintaining conditions conducive to the achievement of UCSD's purposes. The UC San Diego Student Conduct Standards are designedaddress the rights and responsibilities of members of the University community as well as others while on University grounds and facilities. These standards are designed to protect and promote the rights of members of the UC San Diego community, prevent interference with University-supported activities or UCSD functions or activities, and comply with pertinent laws and University policies. . These policies do not apply to employee organizations representing University employees in their employment relations with the University. Those employee organizations are subject to policies applicable to such organizations as set forth in the "University Policy on Relations with Employee Organizations" and other UC San Diego Policies. II. AUTHORITY The Regents of the University of California and the University of California Office of the President (UCOP) delegate the authority to implement and administer the system-wide Policies Applying to Campus Activities, Organizations and Students policies to the Chancellor of each campus. At UC San Diego, the Chancellor entrusts the Vice Chancellor – Student Affairs or her/his designee with the implementation of these policies. The Vice Chancellor – Student Affairs administers and oversees these policies, except those which are specifically delegated to other Vice Chancellors. APPLICABILITY OF UNIVERSITY OF CALIFORNIA SYSTEM-WIDE POLICIES By adapting or inserting the actual language of the University of California Policies Applying to Campus Activities, Organizations and Students, these Standards remain consistent with system wide Policies. The complete set of policies can be found on the website of the UCOP website. The current version of these Standards supersedes all previous versions. III. INTERPRETATION AND APPLICABILITY These Standards supersede any and all previous versions of these Standards and serves as the official reference for student conduct related matters at UC San Diego. Questions concerning the administration, application, and/or interpretation of these Standards should be directed to the Director of Student Conduct. Other resources for these questions include the A.S. Office of Student Advocacy, Student Legal Services, and the Office of the Ombuds. These standards are subject to the definitions and provisions of University of California system-wide policies. Our student conduct standards provide authorization for the use of the University properties, establish specific procedures for the use of these properties, enumerate regulations that apply to the registration of student, faculty, and staff organizations, specify acceptable standards of conduct, and outline the disciplinary procedures that apply to alleged infractions of those standards.

10.11. Jurisdiction: These policies apply to all UCSD organizations and all persons on UCSD properties or elsewhere when specified. All students, registered student organizations, and college organizations are governed by this document. Pursuant to the procedures described in Section 17.00, the standards of conduct set forth in these regulations at Section 17.11.12., may be applied to conduct of UCSD registered student organizations whether on or off campus. Staff and others may also be subject to these and other regulations found in PPM 510.1, USE OF UNIVERSITY PROPERTIES. These policies and procedures implement the University-wide policies published in Policies Applying to Campus Activities, Organizations and Students, University of California, and the UCSD Academic Senate Policy on Integrity of Scholarship. 10.12. III. OVERSIGHT: The Vice Chancellor for Student Affairs ("VCSA"), shall administers and have oversight oversees the responsibility for policies and regulationsthe standards contained in this document, except those which are specifically delegated to other Vice Chancellors. IV. CAMPUS NOTIFICATION Prior to the start each academic year, the Office of Student Conduct will facilitate campus-wide notification to students, staff, and faculty about the most current version of these Standards. Current and past versions of these Standards are available on the Office of Student Conduct website (studentconduct.ucsd.edu). V. CAMPUS CONSULTATION Students, including student governments, faculty, and staff will be consulted about the development and revision of these Standards, except when revisions are specifically mandated by the University of California Office of the President, and/or applicable laws and policy. The specific procedures by which these Standards may be considered and modified are:

A. Revisions to these Standards will be submitted for approval to the Vice Chancellor - Student Affairs and the Chancellor by the Director of Student Conduct or his/her designee. Prior to submitting revisions for approval, the Director of Student Conduct or his/her designee will consult with the Student Conduct Standards Group. The members of the Student Conduct Standards Group include:

1. CHAIR

STAFF • Campus Counsel or his/her designee • Chair, Council of Deans of Student Affairs or his/her designee • Chair, Council of Resident Deans or his/her designee • Dean, University Extension or his/her designee • Dean, Office of Graduate Studies or his/her designee • Dean, Student Affairs, School of Medicine or his/her designee • Dean, Student Affairs, Skaggs School of Pharmacy or his/her designee • Director, Center for Student Involvement or his/her designee • Director, Student Legal Services or his/her designee

3. STUDENTS

• One representative of the Associated Students Council, appointed and approved by the Associated Students Council

• Associate Vice President for Student Advocacy or his/her designee, appointed and approved by the Associated Students Council

• One representative from each of the undergraduate colleges, appointed and approved by the respective College Council, in consultation with the respective Dean of Student Affairs or his/her designee

• Two (2) representatives from the Graduate Student Association, appointed and approved by the Graduate Student Association

B. Typically, Student Conduct Standards Group appointments will be submitted by the respective constituencies to the Director of Student Conduct or his/her designee prior to each academic year or as soon as practicable during the beginning of the Fall Quarter (e.g. Graduate Student Association, College Councils).

VI. REVIEW BY OFFICE OF THE PRESIDENT Prior to their adoption, all proposed changes to these Standards will be submitted by the Director of Student Conduct or his/her designee to the University of California Office of the President for review, in consultation with the Office of the General Counsel to review for consistency with the general University system-wide policies and applicable legal standards. 10.13. Responsibility for UCSD Conditions: In order to carry on its work of teaching, research, and public service, UCSD has an obligation to maintain conditions under which its work can go forward freely, in accordance with the highest standards of quality, institutional integrity, and freedom of expression, with full recognition by all concerned of the rights and privileges, as well as responsibilities, of those who comprise the UCSD community. Each member of the University shares the responsibility of maintaining conditions conducive to the achievement of UCSD's purposes. 10.14. Applicability of U.C. Policies: The UCSD policies and regulations are subject to the definitions and provisions of University-wide policies. The UCSD regulations provide authorization for the use of the University properties, establish specific procedures for the use of these properties, enumerate regulations that apply to the registration of student, faculty, and staff organizations, specify acceptable standards of conduct, and outline the disciplinary procedures that apply to alleged infractions of those standards. 10.15. Purposes of these Regulations: The primary purposes of these regulations are to promote the effective use of UCSD properties, and to encourage opportunities for association among students, faculty, and staff within the intellectual environment of the University and UCSD.

19.00 Basic Student Rights

19.10. Student Opinion and ViewpointsI. INTRODUCTION : Student opinion and viewpoints should be sought on matters affecting both the academic and non-academic experiences of students and especially those decisions which directly affect their welfare, through drawing upon official student representation, as well as additional means for seeking student input as appropriate. 19.11II. STUDENT RIGHTS : As members of the University and UCSD community, students shall have the right to: ;

19.11.12A. Participate in the governance of UCSD according to guidelines set forth in the UCSD regulations; Participate in the governance of the University, consistent with the University's stated goal of enhancing student participation in the governance process by seeking student opinions and viewpoints on matters affecting both their academic and non-academic experiences. This includes decisions that directly affect student welfare, through drawing upon official student representation, as well as additional means for seeking student input as appropriate; 19.11.19B. Have published annually by UCSD those schedules of fees and charges which must be paid by all students as a condition of attendance; such schedules shall not be subject to change during the year, except on recommendation by the UC President and by action of The Regents; Have published annually by the University those schedules of both system-wide and campus-based fees and charges that must be paid by all students to whom the fees and charges apply as a condition of attendance. Such schedules will not be subject to change during the year, except upon recommendation of the Chancellor or the President (as appropriate) or as required by action of The Regents. 19.11.20C. Have published annually refund schedules for new and continuing students; 19.11.21D. Have published annually information about graduation rates of enrolled students and student athletes and as well as information in compliance with all other notification requirements to students that may be satisfied by publication, as specified by applicable law information on UCSD crime statistics, as specified by applicable law;

E. Receive annually from UCSD written information on campus crime statistics, as well as information in compliance with all other notification requirements to students that rise above simple publication to require individual distribution of the information to students, as specified by applicable law. 19.11.22F. Receive annually written information on the UCSD'sapplicable standards of conduct regarding the use of drugs, alcohol, and other illegal substances, a statement affirming that disciplinarystudent conduct sanctions will be imposedassigned for violations of the standards of conduct, a description of the potential sanctions, and other information specified by applicable law; 19.11.10G. Be pProtectedion against the improper collection of information about student's political and social views, beliefs, and associations; 19.11.11H. Be pProtectedion against the improper disclosure or withholding of information from student records is largely governed byin accord with applicable sState and fFederal law, and University policys. It is the purpose of the University of California Policies applying to the Disclosure of Information from Student Records, and implementing UCSD regulations, to provide reasonable interpretations of these laws and to protect the student's right of privacy. Policies and Procedures Manual Section 160-2, (PPM-160-2), is the implementing regulation applicable to student right to privacy. All matters relating to disclosure or maintenance of information on students at UCSD shall be processed in accordance with UCSD PPM 160-2; 19.11.12. Participate in the governance of UCSD according to guidelines set forth in the UCSD regulations; 19.11.13I. Have all academic decisions affecting their academic standing, including the assignment of grades, based upon academic considerations only, administered fairly and equitably under policies established by the Academic Senate. In professional curricula, such decisions may include consideration of performance according to accepted professional standards; 19.11.14J. Petition the Academic Senate on matters within the jurisdiction of the Senate; 19.11.15K. Be free from UCSD disciplinestudent conduct action for actions committed involuntarily or under duress. Violations Alleged violations committed while under the influence of alcohol or drugs, or other illegal substance will be subject to disciplinestudent conduct action; 19.11.16L. Have access to eEquitable grievance procedures established pursuant to Section 111.00 through 114112.00 of the University-wide policiesUniversity of California Policies Applying to Campus Activities, Organizations, and Students; and Section 23.00 of these regulations; 19.11.17M. Petition for any change in the University-wide policies, or in the UCSD UC San Diego regulations policies issued thereunder, through the appropriate UCSD or University-wide or campus office; and 19.11.18N. Petition to appear before the Board of Regents, under procedures set forth in the Bylaws and Standing Orders of The Regents. Individual students are entitled to seek an appearance before the Board to speak in open committee or Board session on matters on The Regents' agenda. Students must follow administrative procedures established by UCSD UC San Diego to appeal individual academic or administrative decisions relating to the above;

O. To If registered for a current term on any University of California campus, have access to basic outpatient health care services of any other University campus, if registered for a current term on any University campus under conditions that apply to students registered on that campus. 19.11.19. Have published annually by UCSD those schedules of fees and charges which must be paid by all students as a condition of attendance; such schedules shall not be subject to change during the year, except on recommendation by the UC President and by action of The Regents; 19.11.20. Have published annually refund schedules for new and continuing students; 19.11.21. Non-Discrimination Policy

The University of California, San Diego, in accordance with applicable federal and state laws and university policies, does not discriminate on the basis of race, color, national origin, religion, sex, gender identity, pregnancy (including pregnancy, childbirth, and medical conditions related to pregnancy or childbirth), physical or mental disability, medical condition (cancer related or genetic characteristics), ancestry, marital status, age, sexual orientation, citizenship, or service in the uniformed services (including membership, application for membership, performance of service, application for service, or obligation for service in the uniformed services). The University also prohibits sexual harassment. This nondiscrimination policy covers admission, access, and treatment in university programs and activities. (See Appendix D, Non-Discrimination Statement)

23.00 Student Grievance Procedures

To Bottom 23.10.I. BACKGROUNDINTRODUCTION: These Student Grievance Procedures ("Procedures") are adopted in response to the University requirement for Chancellors to develop procedures to resolve grievances by students claiming to have been the subject of specified University action, and to submit them for approval to the Student Academic Services in the Office of the President, in consultation with the Office of the General Counsel.

A. 23.10.10. Except as provided in Sections 23.10.10.14. through 23.10.10.17below., these Procedures are intended to resolve grievances from students claiming to have been the subject of any of the following types of non-academic action by the University/UCSD.

1. 23.10.10.10. : Discrimination based upon sex, under Title IX of the Education Amendments of 1972 or applicable federal or state laws, or under the UCSD Policy Applying to Nondiscrimination on the Basis of Sex and UC sexual harassment policies and procedures, provided that, investigations into alleged violations of the UCSD sexual harassment policy shall be subject to the UCSD Student Conduct Code and UCSD PPM 200-10. 2. 23.10.10.11.: Discrimination based upon disability under Ssection 504 of the Rehabilitation Act of 1973 or the Americans with Disabilities Act of 1990 or the University of California Guidelines Applying to Nondiscrimination on the Basis of Disability except that disputes relating to accommodations requested for the completion of academic requirements of any course or academic program shall be processed in accordance with the San Diego Division of The Academic Senate Policy on Appeals for Accommodation of Students with Disabilities or similar policies in the UCSD School of Medicine and the Skaggs School of Pharmacy and Pharmaceutical Sciences. 3.23.10.10.12. Discrimination based upon race, color or national origin, under Title VI of the Civil Rights Act of 1964. 423.10.10.13. : Except as excluded by these Procedures or other policies, other actions alleged to violate UCSD or University policies, including but not limited to policies against discrimination on the basis of sexual orientation, age, or marital status. 5. 23.10.10.14. Violation of the privacy rights accorded to students by the Federal Family Educational Rights and Privacy Act of 1974, portions of the State of California Education Code, and the University of California Policies Applying to the Disclosure of Information from Student Records shall be processed only in accordance with UCSD policy on the administration of student records, UCSD PPM 160-2. 6. 23.10.10.15. : Assignment of grades to students enrolled in UCSD courses is the exclusive prerogative of the UCSD faculty. Grade-related and other academic grievances are covered under separate policies established by the San Diego Division of The Academic Senate in consultation with representatives from the UCSD student governments. Academic related student grievances shall be referred to the Academic Senate for processing in accordance with the applicable Academic Senate policies. 7.23.10.10.16. : Disputes involving students enrolled at the School of Medicine (SOM) shall be reported to the SOM Associate Dean for Admissions and Student Affairs in accordance with the student grievance procedures set forth in the SOM Advisor and Student Handbook, available in the SOM Student Affairs Office.

23.10.10.17.8. : Disputes involving students enrolled at the Skaggs School of Pharmacy and Pharmaceutical Sciences (SSPPS) shall be reported to the SSPPS Associate Dean for Student Affairs in accordance with the student grievance procedures set forth in the SSPPS Student Handbook, available in the SSPPS Student Affairs Office.

B.23.10.11. These Procedures are internal to UCSD and are not intended to replace other complaint procedures such as those available with the U.S. Department of Education, Office of Civil Rights. Participation in this internal process does not extend external filing deadlines. The grievant has the responsibility of complying with all non-University/UCSD judicial and administrative filing deadlines.

C. 23.10.12.: Civil or criminal law remedies, including injunctions, restraining or other court orders, and monetary damages, also may be available to complainants.

23.11II.. STUDENT CONSULTATION n: These Procedures were developed with student consultation as described in the Revision to the Student Conduct Standards section of the UC San Diego Student Conduct Standards. III.23.12. INFORMAL RESOLUTION PROCESS The grievant should first attempt to resolve the grievance or complaint informally with the UCSD employee involved in the dispute and/or the employee's supervisor or, if the grievance involves the action of a student governmental body, with the advisor for the student governmental body. If such informal discussions are unsuccessful, the grievant is encouraged to consult, as appropriate, with the head of the administrative or academic department or organized research unit involved in the grievance or, in the case of a student governmental body, the Assistant Vice Chancellor for Student Life at UCSD (each referred to as the "Administrative Representative" for purposes of these Procedures) to request informal mediation as an alternative form of dispute resolution before submitting a request for the Formal Resolution Process. In cases where the Administrative Representative is the party against whom the grievance is lodged, the Administrative Representative shall be the Dean, Vice Chancellor or other official of UCSD with oversight over the department or program involved in the dispute.

A.23.12.10. Assessment/Investigation of the Dispute : The Administrative Representative should assess the dispute to determine the appropriate course of action. The assessment may include, in the sole judgment of the Administrative Representative, the appointment of an investigator to assist in the assessment process.

23.13IV. FORMAL RESOLUTION PROCESS: A23.13.10. Level I: Administrative Review

1. 23.13.10.10. When either the grievant or the other party involved in the dispute provides written notice to the other that he/she no longer wishes to participate in the Informal Resolution Process, the grievant must deliver to the Administrative Representative within 120 business days from the date the incident was discovered or reasonably should have been discovered, by the grievant, a written grievance for review and disposition in accordance with the following sections of these Procedures. 2. 23.13.10.11.: Within 15 business days from the date of receipt of the grievance, the Administrative Representative shall review the grievance and respond to the grievant in writing, listing the issues raised by the grievance and indicating a recommended course of action to be taken to resolve/dispose of the grievance. In this response, the grievant shall also be informed about the option of Level II Resolution as described in Section 23.13.11Section IV, Letter B below.

B. 3.13.11. Level II: Formal Resolution Process 1. 23.13.11.10.: In the event that the grievant disagrees with Level I action by the Administrative Representative, she/he may submit a written request for a formal resolution in the form of a hearing, mediation or fact-finding as described in Section

23.13.11.12 below, to the Administrative Representative within thirty (30) business days from the date of the written response referred to in Section 23.13.10.11 Section IV, Letter A(2) above. The request for Level II Resolution shall include a copy of the grievance and the requested remedy. 23.13.11.112. Within fifteen (15) business days after receipt of the request for formal resolution, the Administrative Representative shall determine whether the complaint should be referred to formal hearing, mediation, or fact-finding. The Administrative Representative shall make this determination in his or her sole discretion, based on the nature of the grievance and of any potential remedy. The determination of the Administrative Representative as to whether a grievant shall be afforded a formal hearing is final and binding. 23.13.11.12. 3. : Fact-finding shall, at a minimum, include a review of the investigator's report if an investigator was appointed and all other documentation relating to the dispute that is in the possession of the Administrative Representative. At the sole discretion of the designated finder of fact, hereinafter referred to as "the Fact Finder," the fact-finding may include informal interviews with the parties or other individuals who have direct and personal knowledge that is relevant and important to the dispute at issue. The Fact Finder's report must be completed and submitted to the Administrative Representative within 20 business days from the date of the notice to the grievant that the matter will be referred to fact-finding. Upon receipt of the Fact Finder's report, the Administrative Representative shall notify the grievant of disposition of the matter via written notice sent to the grievant by US mail at the address of record for the grievant at the UCSD Registrar's Office. The Administrative Representative shall also notify the grievant of his/her appeal rights via this notice. 23.13.11.13. 4. If the matter is referred to formal hearing or mediation, such hearing or mediation shall begin within thirty (30) business days from the date of the Administrative Representative's determination to refer the matter to a formal hearing or mediation. The grievant and the respondent administrative unit involved in the hearing or mediation shall be provided with notice of the time, date and location of the hearing or mediation at least ten (10) business days prior to the date of the hearing or mediation. 23.13.11.14. 5. : The hearing or mediation shall be conducted either by an impartial hearing officer or mediator, who may be a UCSD official and who shall be appointed by the Director of the Office of Student Conduct. The hearing officer or mediator shall review the evidence and submit the findings along with any recommendations for the resolution of the grievance to the Administrative Representative. 6. 23.13.11.15.: If the matter goes to a formal hearing, the grievant and the UCSD representative shall have the right to present evidence and witnesses. The hearing officer shall determine the admissibility of evidence and consider other rulings such as, but not limited to:

aA. Admissible evidence shall be of the sort upon which reasonable persons are accustomed to rely in the conduct of serious affairs. bb. At the request of either party, witnesses may be excluded by the hearing officer, except during their testimony. cc. The hearing shall be closed unless all parties and all student participants to the grievance consent, in advance, to an open (public) hearing. dd. The finding shall be based on preponderance of evidence, as defined in UCSD Student Policies and Procedures Applying to Student Activities, effective January 1, 2004Section II, Letter M of the UC San Diego Student Conduct Code., Section 22.19.16.16.m. relating to formal hearing procedures of a complaint of student misconduct.

ee. Deliberations of the hearing shall always be confidential and conducted in private and out of the presence of the public, grievant and UCSD official(s) presenting the case. ff. The participation of advocates, representatives and attorneys is provided in Section 23.13.11.20IV, Letter B(11) below.

7. 23.13.11.16.: Any formal hearing shall be recorded and, at the option of the grievant or UCSD, a stenographer may be provided at the expense of the party initiating the request. The grievant shall have access to a copy of the recording and may have a copy of the recording for the cost of reproduction. However, all records pertaining to the hearing, including but not limited to the transcript, shall be considered to be UCSD records and they shall be retained and administered by the Administrative Representative in accordance with the applicable UCSD records policy, such as but not limited to, PPM 160-2 and PPM 480. 8. 23.13.11.17.: The hearing officer or the mediator shall submit a report to the Administrative Representative fifteen (15) business days from the close of the hearing. The report shall contain a summary of the evidence, findings of fact, other proceedings and, when requested by the Administrative Representative, recommendations for a remedy. 9. 23.13.11.18. The parties to the hearing shall be notified in writing of the final disposition of the grievance by the administrative representative within ten (10) business days from the date of the receipt of the hearing officer's report. The grievant shall also be advised of his/her appeal rights. 10. 23.13.11.19. The report of the outcome of the hearing submitted by the hearing officer is final, except for review on appeal per Section 23.14Section V below. In the interest of finality of the findings of the grievance at issue, the facts, findings or issues addressed in the report of the hearing outcome may not be presented as the sole consideration for a subsequent grievance. 11.23.13.11.20. Role of Representatives in Proceedings:

a. The grievant may be represented at the formal hearing, mediation, or fact-finding only by a student advocate appointed by the AS Advocate from a pool of student advocates trained jointly by the UCSD Student Legal Services Director and the Director of Student Conduct. The grievant may be assisted by anyone, including a student advocate, but only the student advocate may speak on behalf of the grievant. If the grievant is assisted by an attorney or anyone other than a student advocate, the administrative unit may be assisted by Campus Counsel or other representative it selects provided no attorney or non-student advocate shall participate directly in the proceedings. b. The grievant shall inform the Administrative Representative, at least five (5) business days prior to the date of the hearing, of his/her intent to have an attorney or anyone other than the designated student advocate be present at the hearing, mediation, or fact-finding. c. Grievants assisted by a student advocate, or anyone else, must provide a signed release authorizing those third parties to receive relevant information from the grievant student's records as required by UCSD PPM 160-2.

V23.14. APPEAL A. 23.14.10. : The grievant(s) may file a written appeal of a hearing, unsuccessful mediation, or fact-finding with the Vice Chancellor-Student Affairs (VCSA), if the grievant is an undergraduate student, or with the Dean of Graduate Studies (DGS), the appeal shall be made to the Dean of

the student's professional school. The appeal must be submitted within twenty (20) business days from the date of the notice of final disposition of the Administrative Representative's decision, and shall be based only on the following criteria:

1. That the outcome is not supported by the findings; 2. There is incongruity between a proposed sanction and the findings; 3. There was unfairness in the proceedings which prejudiced the result; or, 4. There is newly discovered important evidence not known by the grievant at the time of the hearing, mediation or fact-finding.

B. 23.14.11. : The VCSA, if the grievant is an undergraduate student, or the DGS, if the grievant is a student in a graduate or professional program or professional school, shall render a final decision on the appeal within twenty (20) business days from date of receipt of said appeal.

C. 23.14.12. A decision by the VCSA or DGS shall be final and constitutes the exhaustion of all UCSD administrative remedies relating to the grievance at issue.

VI. 23.14.13. EXTENSION OF TIMELINES The Director of the Office of Student Conduct may extend any timelines in these grievance procedures when practical exigencies so dictate. If an extension is granted, the affected individuals will be notified.

14.00 Policy on Use of University Properties

14.10 I. GENERAL PROVISIONS 14.10.11. . This policy provides procedures and criteria for the use of University properties by UCSD students, student governments and registered student organizations. This policy may also provide procedures and criteria, based upon benefit to the University, permitting the use of University and UCSD properties by other persons or organizations. Non-University persons or organizations shall be eligible to use such properties only in compliance with this policy and upon invitation of student governments, other UCSD administrative units and designated officials, or registered student organizations.

14.10.12. University or UCSD Support, Sponsorship, or EndorsementA. All individuals or organizations using University properties and services must avoid any unauthorized implication that they are sponsored, endorsed, or favored by the University or UCSD. B. 14.10.13. All activity in grounds generally open to the public must be conducted in such a way that traffic is not impeded and the normal activity in classrooms and offices is not disrupted. Tables or moveable stands may not be placed in areas where passages to any entrances or walkways are blocked. Individuals and organizations other than registered student organizations and official units of the University may not set up tables or moveable stands without permission from the UCSD Official responsible for the area.

14.11. II. RESERVATIONS AND AVAILABILITY OF SPACEE 14.11.10. . All use of UCSD properties must be in accordance with applicable Federal, State and local laws, University policies and regulations, and with UCSD procedures which implement this policy per UCSD PPM 510.1.

14.11.11. A. All persons on University property are required to abide by University policies and UCSD regulations and shall identify themselves upon request to University officials acting in the performance of their duties. 14.11.12. B. Violation of University policies or UCSD regulations may subject a person to possible legal penalties; if the person is a student, faculty member, or staff member of the University or UCSD, that person may also be subject to discipline pursuant to applicable University or UCSD policies.

14.12.III. LAWFUL USE OF UNIVERSITY PROPERTY UCSD properties shall be used only in accordance with applicable Federal, State and local laws and shall not be used for the purpose of organizing or carrying out any unlawful activity. 14.13. IV. USE OF UNIVERSITY PROPERTY IN EXERCISE OF RIGHT OF EXPRESSION On University and UCSD grounds and facilities generally open to the public generally, as defined in Section 11.12.17. and Section 11.12.19. of these UCSD regulationsthe Student Conduct Standards, all persons may exercise the constitutionally protected rights of expression, speech, assembly, worship, and distribution and sale of non-commercial literature incidental to the exercise of these freedoms; such activities shall not interfere with the orderly operation of UCSD and must be conducted in accordance with UCSD time, place and manner regulations. 14.14. V. USE OF PROPERTIES BY REGISTERED STUDENT ORGANIZATIONS 14.14.10. Registered student organizations may use the UCSD facilities made available by UCSD for organization related programs.

A. Subject to the availability of space, no charge shall be assessed, except in the following circumstances:

14.14.10.10. 1. Bond finance space is free only to the constituency assessed fees to pay the bond, (e.g., registered student organizations in Registration Fee financed space). Non-residential student organizations in Housing and Food Services bonded space may be charged a fee to cover the expense of the debt service; 14.14.10.11. 2. Space maintained and supported from outside sources, (e.g., the International Center), may assess a space usage fee to organizations outside of their constituency; 14.14.10.12. 3. A fee may be charged for use of those facilities which incur unusual expenses to operate, e.g., Price Center facilities and the Mandeville Auditorium; 14.14.10.13. 4. Religious and student political student organizations may use University properties in accordance with the Time, Place, and Manner Regulations for use of UC San Diego Resources of these regulations; 14.14.10.14. 5. During the period prior to action on application for renewal of registration, student organizations may use UCSD facilities for membership meetings, but not for fund raising purposes unless written permission is obtained from the Assistant Vice Chancellor, Student Life or designee.

14.14.11.B. Upon becoming recognized as a registered student organization for at least one year, registered student organizations are eligible to apply for permanent space within the University Center facilities. 14.14.12. C. Registered student organizations are eligible to request all UCSD services at normal UCSD rates. Note exceptions under the Time, Place, and Manner Regulations for Use of UC San Diego Resources applying to student religious organizations and student political organizations.

14.15. VI. DENIAL OF REQUEST AND APPEAL OF DENIALS 14.15.1 0. Denial of Requests for Use: A request for use of UCSD or University properties may be denied if the request is not in accordance with applicable UCSD Policies and regulations, and shall be denied if circumstances are such that the event will present a clear and present danger to the orderly operation of the UCSD. The applicant shall be accorded a review of any denial of a request for use of UCSD or University properties or facilities. If a request is denied on the basis of a clear and present danger to the orderly operation of UCSD, the applicant shall be accorded a prompt appeal to the Chancellor or designee, who shall recognize the University's heavy burden in justifying such a denial.

14.15.11. A. Denials of requests from students and student organizations for use of UCSD or University facilities shall be appealed by the requester in accordance with the Student Grievance Procedures set forth in Section 23.00. below. Denial of requests may be appealed by the applicant as noted below to the following UCSD officials:

14.15.11.10. 1. Vice Chancellor for Student Affairs for students, registered student organizations, Student Affairs Administrative Units, and college organizations; 14.15.11.11. 2. Vice Chancellor for Business Affairs for all registered campus organizations, except as noted above above in Section 14.15.11.10., and all requests from official units of UCSD not within Student Affairs;

14.15.11.12. 3. External groups may appeal to the Committee on Use of University Properties.

14.15.12. B. The Vice Chancellor for Student Affairs and Vice Chancellor for Business Affairs, respectively may refer appeals to the Committee on Use of University Properties for review and study. Recommendations are then made to the appropriate Vice Chancellor whose decision shall be final unless the Chancellor, at his or her discretion, shall choose to review a request.

14.16. UCSD Alcohol Policy 14.16.10. Introduction 14.16.10.10. The University provides a broad learning experience for encouraging the personal and intellectual growth of students, faculty and staff. It is in keeping with the role of the University and an aspect of its educational mission to promote responsible behavior that recognizes the rights of both individuals and the community. Thus, the University has an obligation to assist the entire UCSD community to become better informed about alcohol use and its abuse. 14.16.10.11. Alcohol consumption, and the adverse consequences thereof, represent one of the most serious problems on University campuses. Alcohol problems have effects throughout the spectrum of academic and personal campus life. Those who consume or serve alcoholic beverages at functions should be provided with an adequate understanding of the substance and the issues that surround its use. This policy places its primary emphasis on behavior, recognizing the rights and responsibilities of individuals to make their own informed decisions regarding consumption. 14.16.11. Scope 14.16.11.10. This policy covers the rules and regulations governing the consumption of alcoholic beverages on University premises under the administration of UCSD. In all instances where consumption is permitted, the sponsoring non-University persons or organizations, student governments, other official UCSD units, registered student and college organizations, and non-UCSD persons or organizations involved are responsible for compliance with applicable local, state, and federal law and applicable University and UCSD policies and regulations. Individuals or groups violating such laws, policies, or regulations may be subject to sanctions by UCSD, University, local, state, or federal authorities. 14.16.11.11. This policy does not cover rules and regulations governing Scripps Institution of Oceanography vessels, for which policies and procedures on the sale, service, consumption, or possession of alcoholic beverages are issued by the Director, Scripps Institution of Oceanography or his/her designee. 14.16.12. 14.16.13. Policy 14.16.13.10. California State Law California law regarding use of alcoholic beverages is highlighted here. The laws are abbreviated for general use and may not cover all situations. It is the responsibility of the server and consumer of alcoholic beverages to be aware of, and abide by, all applicable state laws. It is against the law: a. to sell, furnish, give or cause to be sold, furnished, or given away any alcoholic beverage to a person under the age of 21, and no person under the age of 21 may purchase alcoholic beverages; b. for a person under the age of 21 to possess alcoholic beverages on any street or highway or in any public place or any place open to the public; c. to sell, furnish, or give away alcoholic beverages to an obviously intoxicated person d. to sell alcoholic beverages any place in the state without proper license from the Department of Alcoholic Beverage Control. 14.16.13.11. Alcohol on UCSD or University Property The following provisions cover the purchase, sale, service, and consumption of alcoholic beverages on UCSD or University property or facilities. a. Residential Facilities All residential facilities on UCSD property shall fall under the jurisdiction of this policy. 1. Consumption of alcohol is prohibited in all public areas of the on-campus housing facilities. All areas other than private rooms and apartments are considered public areas. 2. Containers of alcoholic beverages in excess of 1 gallon in size (e.g., kegs, pony kegs, party balls, etc.) are prohibited in all areas of the University residential facilities. 3. It is a violation of University policy for students under the age of 21 to consume or possess alcohol in any University housing area. 4. If students 21 years and older possess and consume alcoholic beverages, such activity must occur in the private bedrooms of UCSD residential facilities and in the interior areas, (e.g., excluding patios and balconies), of UCSD residential apartments. 5. Residents who provide alcohol to guests may be held accountable by UCSD for the behavior of their guests. b. Other UCSD Properties The sale, service, consumption, or possession of alcoholic beverages on UCSD property or facilities shall be in accordance with legal requirements and is prohibited except in the following: 1. areas specifically designated by the Chancellor or other appropriate UCSD officials, e.g., facility managers for a particular function not open only to the UCSD community, i.e., students, faculty, staff, and University affiliates 2. private offices/space where a social function or small meeting is being held with the approval of an appropriate UCSD official or faculty member (e.g., supervisors and management personnel) 3. UCSD Medical Center according to their policies and procedures on the sale, service, consumption, or possession of alcoholic beverages issued by the Director, UCSD Medical Center or his/her designee; 4. licensed areas, properties, or establishments; 5. off-campus locations by UCSD organizations or units sponsoring activities subject to regulations of the properties (areas) being used. Liability insurance coverage may be required, subject to review by the Business Office, if the event is open to the general public. See also Section 14.16.14.11., Liability; c. UCSD Events Held in Public Space 1. UCSD events are defined as events approved by the appropriate UCSD officials which are held in public space on UCSD property or facilities. 2. "Public space", shall be defined as all areas which are accessible to the general public. This does not include personal living space or those residential areas that have access limited to only those in authorized possession of keys.

3. Planners of UCSD events in public spaces at which alcohol can legally be served must receive approval from the appropriate UCSD official(s), at least 2 weeks before the event. This approval must be in writing. The planner(s) must complete the "Use of Alcoholic and/or Malt Beverages" form and must follow State law, University policy and UCSD regulations in the planning and managing of the event. To receive these approvals, the planners must complete the approval form issued by one of the following agencies offices: i. Registered Student Organization - Student Activities and Governments ii. Medical Students - Office of Student Affairs, School of Medicine iii. Graduate Students - Office of Graduate Studies and Research iv. College organizations - Appropriate College Dean's Office 4. The consumption of alcohol must not be the major focus of the event. 5. Security at all events must be approved by the Director of Student Activities and Governments. 6. In order to identify persons who are not of age to drink, a secure system shall be used at student events where alcohol is served. 7. Persons who, in the judgment of the server and/or sponsor, are intoxicated shall not be served. 8. Alcoholic beverages must be served directly by official event personnel who are at least 21 years of age. 9. Identification must be checked by official events personnel who are at least 21 years of age. d. If the organizers plan to sell the alcoholic beverages for money or exchange of the alcoholic beverages for anything else of value, (such as tickets or chits), then the organizers must obtain an appropriate license from the State of California. No "cover charge" or "donation" may be collected at the door of a UCSD or University event when such charge is used for the purchase of alcohol. Organizers must also abide by the requirements set forth in the Use of Alcohol and Malt Beverage form. e. Whenever alcoholic beverages are served, non-alcoholic beverages must be made available at the site of the function. f. Attendance at functions on UCSD at which alcoholic beverages are served is limited to members of the sponsoring organization or administrative unit and their guests. g. Individuals are prohibited from bringing their own alcoholic beverages for consumption at a UCSD event. h. State funds or restricted funds may not be used for the purchase of alcoholic beverages for consumption. It is the responsibility of the UCSD official approving the purchase to be aware of which funds may be properly used. See UCSD PPM 350-30, University Sponsored Entertainment. i. To promote the safety of the participants, sponsors must terminate the serving of alcoholic beverages prior to the end of an event, e. g., at least one (1) hour before the end of an event if the event is scheduled to run for more than three (3) hours. j. Each UCSD function at which alcoholic beverages are served must have official approval prior to the function. k. Purchase of alcoholic and/or malt beverages for UCSD sponsored functions must conform to all established, approved procedures as identified in Section 14.16.14., below. 14.16.13.12. Sponsorship of UCSD Events a. Official Sponsors

Functions, where alcoholic beverages are being served, must be sponsored by an official UCSD administrative unit, registered student organization(s),campus organization(s), or college organization(s) recognized by the appropriate UCSD official. b. Manufacturers and/or Distributors of Alcoholic Beverages 1. All sponsors, must conform to and comply with UCSD policies and procedures, and State law concerning all aspects of the event. The donation of alcoholic beverages by manufacturers and/or distributors is prohibited. 2. The sponsoring UCSD department, office or organization must be clearly identified as the primary sponsor of the event. Any recognition of the manufacturer and/or distributor shall be secondary to the UCSD sponsor and secondary to the name of the event. The primary sponsor's name shall be at least twice the size of the alcohol related sponsor's name or logo. The UCSD logo or University's seal or name shall not be used on any material containing reference to an alcohol manufacturer/ distributor, except as a designation of location for the event. 3. Manufacturers and/or distributors of alcoholic beverages may not be the secondary sponsors for any event at which alcoholic beverages are served. 4. Sponsorship and advertising by manufacturers and/or distributors of alcoholic beverages in the form of money, goods or services must be approved by the designated UCSD official for each event. 5. UCSD administrative units, registered student or UCSD organizations, or college organizations sponsoring events which are co-sponsored by manufacturers and/or distributors of alcoholic beverages must make a demonstrable attempt to secure non-alcohol related sponsorships. 6. All advertising in connection with events co-sponsored by a manufacturer and/or distributor of alcoholic beverages must be approved by the designated UCSD official. 14.16.13.13. Control of Function The sponsoring organization is responsible for: a. Establishing adequate control to ensure that all persons being served alcoholic beverages are at least 21 years of age; b. Requiring that in order for alcohol to be served to an individual, a valid driver's license, passport or State photo ID. must be presented to the appropriate person; c. Providing only single servings of alcohol at a time; d. Denying service to individuals who appear to be intoxicated or who appear to be turning over alcoholic beverages to persons under 21 years of age; 14.16.13.14. Advertising a. No advertising/invitations may be released until final approval has been obtained for the function from the designated UCSD official. b. The restrictions listed below must be followed when developing advertising for a function: 1. Functions at which alcohol will be served may not be advertised off campus or in any way suggest that alcohol will be served at the function or that the function is open to the public. 2. Violations of State or Federal law or University policies or UCSD regulations are not to be implied. Advertising shall not contain statements such as: "All you can drink," "Everyone may drink," or "Open to the public". 3. The name of the sponsoring organization is to be included on all advertising. 14.16.13.15. Enforcement Violations of this policy shall be referred to the appropriate legal authority as required by UCSD regulations and may be grounds for the cancellation of the event, as well as grounds for disciplinary or corrective action.

14.16.13.16. Sanctions Upon a finding of guilty by the appropriate authority or judicial body and in accordance with regulations cited in the UCSD Student Conduct Code, the following sanctions may be applied to students, registered student organization(s) and college organization(s): a. prohibition to sell, serve, consume, or possess alcohol for a stated length of time; b. denial of access to the property, area, establishment, etc. for a stated length of time; c. denial of program/event/function approval for a stated length of time; d. organization(s)/individual(s) probation for a stated length of time; e. loss of organizational status for a stated length of time; f. other disciplinary sanctions per the UCSD Student Conduct Code. (See Section 22.18. below) 14.16.14. Procedures When alcoholic beverages are being served at functions, the sponsoring official UCSD unit, registered student organization(s), or college organization(s) recognized by the appropriate Provost/Dean's Office, must fill out a Use of Alcoholic and/or Malt Beverages form, and obtain all specified approvals. 14.16.14.10. Use of Alcoholic and/or Malt Beverages Form. a. Three members of the student unit/organization(s) must complete and sign the Use of Alcoholic and/or Malt Beverages form, thus accepting personal responsibility for the function individually and on behalf of the organization, e.g., accepting personal liability for damage to property or injury to persons. These three individuals must be at least 21 years of age. b. The requester must submit, AT LEAST TWO WEEKS PRIOR TO THE FUNCTION, a completed copy of this form to the specified UCSD official, along with the completed Use of Facilities and Sponsorship form (see PPM 510-1, Section IV, Authorized Users). c. The designated UCSD officials authorized to approve the Use of Alcoholic and/or Malt Beverages Form for Undergraduate and Graduate Student Organization(s) and Groups are as follows: 1. For Registered Student Activities Organizations - Director, Student Activities and Governments or designee. 2. For Medical Students - Dean of Student Affairs, School of Medicine or designee. 3. For Graduate Students - Dean of Graduate Studies and Research or designee, and Chair, Graduate Student Department. 4. For College Organizations - appropriate College Dean or designee. d. The original, completed, and approved Use of Alcoholic Beverages form shall be filed in the office of the approving UCSD official with copies sent to the UCSD Police Department and to a signing sponsor of the function. 14.16.14.11. Liability a. Individuals representing organizations/units/groups should make themselves aware of their potential legal liability and other consequences to the organization or themselves should a suit be filed against the organization/individual, especially when a person attending a function and consuming alcoholic beverages is involved in an accident resulting in personal injury or death. It is suggested that liability insurance be procured. b. The sponsor(s) of the event are encouraged to obtain information about the need for liability insurance coverage to be obtained by the sponsor of the function. To obtain such information, contact the UCSD Campus Insurance Coordinator at least ten (10) academic days prior to the date of the function.

14.17. Smoke Free Policy 14.17.10. Background As a matter of policy, UCSD endeavors to maintain a safe and healthful environment. The Surgeon General of the United States has determined that cigarette smoking is the leading preventable cause of illness and premature death in the nation. Moreover, research indicates that non-smokers who are

regularly exposed to passive (second-hand) tobacco smoke are also at increased risk of illness. Passive smoke appears to be especially deleterious to the health of certain populations, including the elderly, children, and individuals with allergies, asthma, respiratory disease, or cardiovascular disease. For these reasons, the Surgeon General has urged employers to implement broadly-based health promotion programs with special emphasis on smoking cessation. The response to the Surgeon General's advice and the medical evidence has been an overwhelming trend toward protection of the health and safety of non-smokers. 14.17.11. Reference 14.17.11.10. The California Indoor Clean Air Act of 1976 specifies that tobacco smoke is a hazard to the health of the general public. It is the Chancellor's intent that the UCSD community act with cooperation and courtesy toward all when dealing with smoking/no-smoking situations in all indoor and outdoor properties at UCSD. 14.17.12.11. As an institution committed to providing a safe and healthful environment, the University of California, San Diego hereby adopts a Smoke Free Policy, effective January 1, 1994. 14.17.12.12. This Smoke Free Policy applies to all UCSD facilities, owned or leased, regardless of location. No smoking is permitted in any indoor area, or within five feet of main entrance or exit to any facility, including but not limited to:

administrative offices theaters waiting rooms

private offices lobbies reception areas

laboratories hallways university vehicles

classrooms stairwells machine shops

conference rooms restrooms elevators

auditoriums libraries food service areas

lounges clinics

14.17.12.13. The regulations pertaining to smoking aboard ships operated by the Scripps Institution of Oceanography will continue to be established on each cruise in consultation with the chief scientist. 14.17.12.14. The only exceptions to this policy are for covered parking lots, private residential space and, at the UCSD Medical Center, for those few patients who are both in private rooms and have specific written orders from the attending physician permitting them to smoke. 14.17.12.15. Additionally, where outdoor seating is provided adjacent to indoor food service facilities, non-smoking sections must be designated and posted. 14.17.12.16. PPM 270-7 Advertising of tobacco products is prohibited in University of California owned and occupied buildings except for advertising in newspapers, magazines or other written materials sold, bought or distributed within the building.

14.17.13. Enforcement 14.17.13.10. The success of this policy depends upon the thoughtfulness, consideration, and cooperation of everyone. All share in the responsibility for adhering to and enforcing this policy. Any problems should be brought to the attention of the appropriate Dean of Students, staff, supervisor and/or department head. If a problem cannot be resolved in this manner, recourse may be had by contacting the appropriate Dean, Director, or Personnel Representative. There shall be no reprisal against anyone seeking assistance in enforcing this policy.

15.00. Time, Place, and Manner Regulations for Use of UCSD Resources

15.10. I. USE OF UCSD OR UNIVERSITY PROPERTY AND SERVICES All use of UCSD or University properties, resources and services by individuals or UCSD organizations must conform to applicable time, place, and manner regulations. The use of UCSD or University properties or resources not authorized by these regulations is prohibited. Those using UCSD or University properties, resources and services must avoid any unauthorized implication that they are sponsored, endorsed, or favored by the University. 15.10.10. The University may enter into agreements with external entities to perform specified commercial activities either on campus or using campus property, facilities and/or equipment. Except as allowed under such agreement or as specifically permitted by this or other UCSD policy, commercial activity on the UCSD campus or using UCSD property, facilities and/or equipment is strictly prohibited. See UC San Diego Student Conduct Code, Section VII, Letter U regarding course notes.

15.11. II. RELIGIOUS/POLITICAL NEUTRALITY AND USE OF UCSD OR UNIVERSITY RESOURCES 15.11.10. As a State instrumentality, UCSD and the University must remain neutral on religious and political matters. UCSD cannot sponsor or fund political or religious activities, except when authorized for University purposes by the University of California Regents or the President or their designees. A religiously or politically oriented registered student organization may have access to University facilities and resources subject to any limitations found in these regulations

. 15.11.11BA. In correspondence, statements, or other material relating to religious or political activities or issues, the UCSD or University title of a faculty or staff member or the title of a student government official shall be used only for identification; if such identification might reasonably be construed as implying the support, endorsement, or opposition of UCSD or the University with regard to any religious or political activity or issue, the identification shall be accompanied by an explicit statement that the individual is speaking for himself or herself and not as a representative of UCSD or University or any of its offices or units. 15.11.12CB. The following definitions and regulations apply specifically to political and religious activities of registered student organizations.

1. 15.11.12.10. Political Activities For the purpose of these regulations, a sStudent political activity is defined as means sponsorship of one or more of the following activities:

:a. SsSupporting or opposing a candidate or group of candidates formally running (e.g. in a primary or general election) for city, county, state, local, or national office); b. sSupporting or opposing a ballot measure or a drive to put an issue on the ballot; or c. Rraising funds or sponsoring programs to provide on-going support for any political party, candidate or ballot proposition.

2. 15.11.12.11. Religious Activities A student organization's activity will be defined as "religious" if:

a. The purpose of the activity is worship, devotion, prayer, or study of religious literature (e.g., Bible/Koran); or, if b. mMembership in or affiliation with a group generally recognized as a religious sect is a criterion for participation; or,

c. if tThe purpose of the activity is to bring together persons professing a belief in God or other belief encompassing theories of human origin or place in the universe and occupying a place in members' lives comparable to recognized religion; or, d. if tThe activity is viewed by the organization as "religious."

15.11.13. Neutrality of UCSD or the UniversityC. The specific provisions intended to guarantee the neutrality of UCSD and the University with regard to student political and student religious activities are listed below:

15.11.13.10. 1. Permanently assigned space for conducting any political or religious activity is charged at established rates which recover building depreciation/debt service, custodial services, and utilities. 15.11.13.11. 2. There is no charge for incidental use of equipment, e.g., typewriters, which are generally available for other activities. 15.11.13.12. 3. University services and supplies are available at established recharge rates plus any administrative overhead costs. 15.11.13.13. 4. Outgoing U.S. mail cannot be charged to the University's nonprofit postal permit for bulk mailing in accordance with U.S. Postal Regulations. 15.11.13.14. 5. No UCSD or University controlled funds may be allocated or donated to support these activities, except as authorized in Section 18.00.the Voluntary Student Contributions and Compulsory Student Fees section of the UC San Diego Student Conduct Standardsof these regulations. This includes Associated Students and other mandatory fee monies, unrestricted gifts, and donations given to the University and funds for non-political and non-religious activities. 15.11.13.15. 6. Persons who are not UCSD students, faculty, and staff shall not be permitted to engage in religious or political activities on University grounds, buildings, or other properties, except under the following circumstances:

a. wWhen exercising their rights of free speech, assembly, and worship in free speech areas; and, b. aAs invited, sponsored speakers to address meetings on campus.

7. Except as stipulated above,, (15.11.13. through 15.11.13.15.a., inclusive) political and religious student groups will be treated in the same manner as all other registered student organizations.

15.12. III. USE OF UNIVERSITY NAME, INSIGNIA, SEAL OR ADDRESS : 15.12.10. The name, insignia, seal, or address of UCSD or the University or any of its offices or units shall not be used for or in connection with religious or political purposes or activities except as consistent with University policies and UCSD regulations (See Appendix B) 15.12.11. Individual students and/or a registered student organization shall not use the name of the University of California or abbreviations thereof as a part of its own name except in accordance with University Policies and UCSD regulations. 15.12.11.10. The Associated Students the Graduate Student Association, and registered student organizations may use the address of their University office in connection with official correspondence. There are no other exceptions to this policy.

15.13. IV. NEUTRALITY OF UCSD/UNIVERSITY FACULTY/STAFF TITLES:

V. NON-COMMERCIAL FUND RAISING BY UCSD ORGANIZATIONS: 15.14.10. Non-commercial fund raising by student governments and by registered UCSD student organizations shall be permitted pursuant to University policies and UCSD regulations; non-commercial fund raising by individuals or by other UCSD groups also may be permitted under regulations developed by UCSD consistent with University policy. Appropriate provisions may be made governing the collection of donations, sale of materials, admission charges, and financial accountability.

15.14.11A. Official UCSD administrative units, officially recognized student government(s), registered student organizations, recognized college organizations, and with the prior approval of the Chancellor, charitable organizations may raise funds at UCSD consistent with these regulations. Fund raising by all others is prohibited as a matter of UCSD policy, provided, however, that fund raising other than for commercial purposes or personal financial gain may take place in outdoor areas of UCSD generally open to the public. All fund raising activities are subject to the UCSD time, place, and manner regulations, contained in Section 16.00the Expression and Advocacy section of the UC San Diego Student Conduct Standards. et seq. in these policies.

15.14.11.101. Fund raising activities are defined to include the collection of donations, the sale of materials, and the imposition of admission charges. 15.14.11.112. Admission charges may be required for events on UCSD properties or facilities only if such events are sponsored by official UCSD administrative units, officially recognized student governments, registered student organizations, recognized college organizations, or, with the Chancellor's approval, by charitable organizations. 15.14.11.123. Registered student organizations may sponsor fund raising activities to support their activities subject to the following provisions:

a. The funds are directed through normal UCSD accounting procedures.

b. The funds raised on UCSD may not be used for any illegal purposes; further, the use of the funds being raised must be defined and be consistent with the stated purposes of the fund raising activity.

c. Registered student organizations raising funds through paid admission must use sequentially numbered tickets at events under their sponsorship. All ticket sales must be conducted through the Box Office located in the Price Center. d. If a charge is required for admission to an event, it may not be called or publicized as a "donation". Any implication that a donation is a requirement for admission to an event is prohibited.

e. Registered student organizations may raise funds through their membership through collection of dues and/or initiation fees; they may solicit voluntary donations from others at their own programs or meetings.

f. Registered student organizations may not raise funds for the personal benefit or gain of individual members.

g. Registered student organizations may sponsor commercial enterprises desiring to sell their products on UCSD. The financial terms must be agreed to by

both parties. This contractual agreement must be reviewed and approved by the designated advisor., see Section 15.16. et seq., Seller's Permit.

h. Registered student organizations may sponsor performances and/or events by on-campus or off-campus individuals or groups. The financial terms agreed to by both parties must be set forth in a contract. When University or UCSD funds are used, the contract must be approved and signed by the designated UCSD official.

15.14.11.13B. The University and UCSD reserves the right to audit or investigate the financial records of registered student organizations using University properties to raise funds when a complaint of financial irregularity is made or when there are grounds to believe that funds raised on UCSD have not been used for the purpose of the organization or for the specific purpose for which the funds were raised. Except in emergency situations, proper notice shall be given

. 15.15VI. The DISTRIBUTION, POSTING, AND EXHIBITING OF NON-COMMERCIAL LITERATURE ON UNIVERSITY PROPERTY 15.15.10.This policy applies to all distribution, posting, and exhibiting of non-commercial literature on campus property. For the purpose of this Section, "non-commercial literature" is defined as any printed material published for reasons other than for sale and/or distribution primarily to generate personal, private, or corporate profit/gain which is not tax exempt under federal or California tax law.

A. Except as described in Section 15.15.11.10 below, the University will not restrict distribution, posting, or exhibiting of non-commercial literature based on its content unless its distribution violates state or federal law or constitutes a violation of University policy. Even when not prohibited by this policy, UCSD does not endorse the distribution, posting, and exhibiting of literature that advocates illegal acts or activities, or literature that is offensive to individuals or groups within the campus community. B. Students who engage in violations of this section may be disciplined in accordance with the UCSD Student Conduct Code. as set forth in the UCSD Policies and Procedures Applying to Student Activities, Section 22.00 et seq. Violations of this posting policy may be reported to the Dean of the college and residence facility or to the manager of the building in question.

C. Section X of the Policy and Procedure Manual contains the policy relating to Use of University Properties for Commercial Purposes that governs distribution of commercial literature. Also, see PPM 200-12 for policies and procedures relating to Employee Organizations as defined under HERRA.

15.15.10.101. Commercial Literature Defined: For the purpose of this section these regulations, commercial literature is defined as means any printed material published primarily to generate personal, private, or corporate profit/gain which is not tax exempt under federal or California tax law.

15.15.11D.. Non-commercial literature may be distributed on University grounds open to the public generally, as long as such activities do not materially and substantially disrupt the orderly operation of the campus.

15.15.11.10. Posting: 1. Posting of non-commercial literature on University property is prohibited unless in compliance with the provisions of this policy. In addition, where approval is required such approval must be obtained prior to posting the material. 2. Certain areas are reserved for posting of flyers, posters, and/or banners announcing campus events (events which have been approved by the designated UCSD official responsible for the area in question). Use of these areas for posting of event

anouncementsannouncements requires compliance with procedures set forth in Section 15.15.11.11 below. These are to be identified in Appendix E of this policy. 3. Certain areas may be reserved for posting of certain special purpose notices (such as ride boards or housing information). Use of these areas is generally subject to regulations and procedures described at the location. 4. Certain areas are open for the posting of general non-commercial literature and are for use by registered campus organizations, students, faculty, or staff. Since space is limited, each individual or group is limited to one posting per location and posting over announcements that are still current is prohibited. Postings in general information areas must comply with the procedures set forth in Section 15.15.11.11 below. (See Appendix E for the area listings). 5. Posting on exterior balconies or railings of apartment rooms or dormitory suites is prohibited. However, this policy does not restrict posting of material inside student dormitory bed rooms or on the inside of exterior-facing dormitory room windows, except that postings inside dormitory bed rooms or on the inside of exterior-facing dormitory bed room windows or doors may not interfere with the operation of doors or windows or otherwise endanger health or safety. This policy also does not restrict posting of material in common living areas not open to the general public of apartments or dormitory suites, provided that none of the residents of adjoining rooms with access to the common area object. Any material posted in the common area of apartments or dormitory suites must be removed in the event that any resident of an adjoining room with access to the common area objects to the posting of such material. 6. Postings on kiosks and bulletin boards maintained by the duly established campus student governments such as the GSA, ASUCSD, and college councils, must be approved and posted by the designated representative of the respective student government. 7. Posting on the ground, trees, doors, light poles, walls, fences, walkways, exterior of any building, and other areas not specifically approved for posting by the manager of the area and/or facility is prohibited.

E. 15.15.11.11. Posting Procedures: Except as noted in Section 15.15.11.10 of this policy, all postings of non-commercial literature must be submitted to, and approved (as to form and not content) by the designated UCSD official responsible for the area in question. (See Appendix E for the area listings). Any objections to the removal of posted material must be submitted to the designated UCSD official responsible for the area in question. The material must also comply with the following requirements:

1. Flyers shall not exceed 11" X 17" in size and shall be limited to one of each kind per posting location. Posters shall not exceed 3'X 5' in size. Permission to post posters exceeding 3' X 5' in size may be granted by the designated UCSD official responsible for the area in question, (See Appendix E for the area listings). 2. Banners shall not exceed 10' wide X 3' high except for commercially produced banners representing UCSD campus departments. Permission to post banners exceeding 10' X 3' may be granted by the designated UCSD official responsible for the area in question, (See Appendix E for the area listings). Posting of banners shall be limited to one per posting location. A facility approval stamp from the designated UCSD official responsible for the area in question, (See Appendix E for the area listings), is required before banners may be posted.

3. Banners, posters, and flyers announcing campus events should indicate the name of the sponsoring organization or group, the nature of the event, the date and time, the location, cost (if any), and a contact number for more information. No chalking is permitted on walkways, walls, or anywhere on UCSD property or facilities. 4. Only blue painters' tape or other non-destructive and removable hanging material may be used to post flyers on approved posting areas. Paste, glue, nails, or duct tape are not permitted. Staples and tacks may be used on bulletin boards. 5. All event banners, posters, and flyers announcing campus events must be removed within 48 hours after the event. Approved posting locations for non-event postings may impose reasonable time limits on postings and may require postings to clearly identify their expiration date. Time limits must be uniform to all postings in the particular posting area. 6. No flyers, announcements, or literature of any kind may be placed on automobiles (e.g. under windshield wipers) in campus parking lots. 7. Any item which is posted without the appropriate approvals may be removed without prior notice.

15.16VII. PROCEDURE FOR COMMERCIAL ACTIVITIES 15.16.10. University Properties may be used for commercial purposes or personal financial gain only as permitted in UCSD regulations.

15.16.11. A. Commercial/vendor activities through Student Organizations & Leadership Opportunities the Center for Student Involvement are limited strictly to the quarterly Vendor Fairs. Individual colleges have the authority to permit vending at their respective college as they deem appropriate. 15.16.12. B. Vendor Fairs are sponsored by the Center for Student Involvement Office of Student Organizations and Leadership Opportunities and may not exceed five selling days per fair. 15.16.13. C. Applications for each Vendor Fair are available in the Center for Student Involvement Office of Student Organizations and Leadership Opportunities and must be submitted by the deadline date indicated on the application. Selection of Vendors is at the discretion of the sponsor. 15.16.14. D. In Consideration of being permitted to enter, visit and use space to vend merchandise at UCSD vendors agree to the following:

15.16.14.10. 1. Vendor must fill out and sign a UCSD Vendor Agreement, a UCSD Temporary Vendor Application/Permit, and submit required fees by the deadline indicated on the application. 15.16.14.11. 2. Conditioned upon final sponsoring department approval, UCSD grants vendor permission to sell merchandise with the following requirements: Vendor must read, acknowledge that vendor understands, and that vendors will comply with the UCSD Vendor Sales Policy. 3. Vendor must guarantee that merchandise meets the requirements of the UCSD Vendor Sales Policy and all applicable state and federal requirements.

4. Vendor must verify to the satisfaction of the designated UCSD officials that vendor has the legal right to sell the merchandise and that the merchandise may be legally sold in California. 5. Vendor, in the capacity of a seller, cannot act as an employee or agent of UCSD or the Regents of the University of California, "Regents", and shall make no representations which may indicate an endorsement or guarantee by UCSD or the Regents of the merchandise to be sold. 6. Vendor shall defend, indemnify, and hold harmless UCSD, the Regents, its officers, employees, and agents from and against any and all injury to persons or damage to property arising out of, or in any way connected with, the Vendor's use of this Agreement. 7. Upon departmental approval Vendor shall be issued a Temporary Vendor Permit which specifies date and location for the sale of merchandise, and must be posted at vending location. 8. Vendor must prominently display at all times vendor's policy regarding returns, refunds/and or exchange of merchandise. 9. Vendor must acknowledge by signing the Vendor Agreement that Vendor understands that should Vendor violate the UCSD Vendor Sales Policy, or any law applicable to Vendor's activities at UCSD, the Vendor Agreement shall be terminated forthwith and the UCSD Temporary Vendor Permit shall be im mediately revoked. 10. The Vendor Agreement shall automatically terminate upon expiration of the Temporary Vendor Permit.

15.16.15. Vendor Space Fees E. 15.16.15.10. Vendor space fees are set by the sponsor and may be changed at the discretion of the sponsor. Rates are minimum guarantees or 10% of gross sales, whichever is greater.

F. 15.16.16. Vendor Sales Policy

15.16.16.10. 1. Vending Location

a. Location of vendor sales is to be determined by the Center for Student Involvement.

2. Space Assignments

ba. Space assignments and all other necessary permits and paperwork will be sent to the vendor upon acceptance of vending application. cb. Space assignments are determined by the Center for Student Involvement Office of Student Organizations and Leadership Opportunities. No changes prior to or during the vendor fair will be made in space assignments.

15.16.16.11. Space Assignments 15.16.16.12. 3. Equipment

a. Vendor must provide all their own tables, chairs, tents and any other equipment they require for sales.

b. Vendor has the option to leave their equipment at the vending site overnight, however, the Center for Student Involvement Office, UCSD, nor the Regents will

be responsible for any damage or theft of equipment or merchandise left unattended.

c. Vendor will not be provided any overnight security of vending site.

d. No vehicles are allowed on the Library Walk.

e. Vendor must provide their own hand trucks, dollies or any other equipment needed to transport their merchandise to vending site.

f. One vehicle permit per vendor will be issued. Additional permits must be purchased at any of the UCSD information booths.

g. The Center for Student Involvement, UCSD or The Regents will not be irresponsible for lost parking permits or parking tickets. Parking permits are non refundable.

15.16.16.13. 4. Parking

a. It is the responsibility of vendors to read the instructions on the parking permit and park only in designated spaces.

b. Designated loading zones are strictly for loading and unloading merchandise. Vehicles left unattended in the loading zone will be ticketed. Loading and unloading of merchandise must be completed prior to 10:00 am each day of scheduled vendor fairs.

15.16.16.14. 5. Income Reports

a. Vendors must complete and submit to the Center for Student Involvement a UCSD Vendor Income Report by no later than ten (10) working days after the last day of the vendor fair.

15.16.16.15. 6. Inclement Weather

a. In the event of rain, there will be no refunds. If it rains for (3) or more consecutive days, vendors will have the option of rescheduling their sales the following week if space is available. The location of rescheduled vending days will be determined by the SOLO officeCenter for Student Involvement.

16.00. Expression and Advocacy

16.10I. EXERCISE OF CONSTITUTIONAL RIGHTS : UCSD is committed to ensuring that the exercise of constitutional rights of free and open discussion, expression, and advocacy are not only protected but encouraged as a vital aspect of the spirit of free inquiry appropriate to a university setting. 16.11II. RIGHTS OF DISCUSSION, EXPRESSION, AND ADVOCACY : In the exercise of the rights of discussion, expression, and advocacy on UCSD, all persons are guaranteed the right of freedom from undue surveillance. Specifically, the video-taping of student demonstrations should not occur unless there is probable cause to believe that participants are engaging in illegal activity or activity subject to UCSD disciplinary proceedings. No information shall be gathered for any other purpose and placed or maintained in police or administrative files. 16.12III. TIME, PLACE AND MANNER OF EXERCISE OF EXPRESSION : The time, place and manner of exercising free expression and advocacy at UCSD are subject to UCSD regulations that shall provide for noninterference with University or UCSD functions and reasonable protection to persons against practices which would make them involuntary audiences. 16.13IV. CHANCELLOR'S RESPONSIBILITY : It is the responsibility of the Chancellor to assure an ongoing opportunity for the expression of a variety of viewpoints. 16.14V. POLITICAL AND RELIGIOUS EXPRESSION : These UCSD policies and regulations in no way constitute prohibitions on the right to express political or religious views by an individual in the UCSD and University community. UCSD recognizes, supports, and shall not abridge the constitutional rights of faculty, students, or staff to participate either as individuals or as members of groups in the political process of supporting candidates for public office or any other political or religious activity. 16.15VI. UCSD Policy and Procedure Manual (PPM) Section II, 510-1, Use of University Properties 16.15.11 A. Introduction In order to carry on its work of teaching, research and public services, UCSD has an obligation to maintaiin conditions conducive to the conduct of University business in a free and open manner; and in accordance with the highest standards of quality, institutional integrity, and freedom of expression, with full recognition by all concerned of the rights and privileges, as well as the responsibilities, of those who comprise the UCSD community. Each member of the UCSD community shares in the responsibility of maintaining conditions conducive to achievement of the University's purposes.

16.15.12BA. Definitions

16.15.12.10.1. Expression and Advocacy: On-campus open expression and advocacy is defined asmeans the action by any individual or group who exercises expression and advocacy in an open forum at UCSD. Planned or spontaneous demonstrations or rallies that result from exercising expression and advocacy by any individual or group are included in this definition.

16.15.12.112. Grounds Open to the Public: For the purpose of these regulations, thise term, "Grounds generally open to the public" is defined asmeans the outdoor areas of UCSD, (lawns, patios, plazas) that are at least 25 feet from the entrances/exits of UCSD buildings and parking lots, and that are also a safe distance from the curbings of UCSD

roads. All activity in these areas must be conducted in such a way that traffic is not impeded and the normal activity in classrooms and offices is not disrupted. Tables or moveable stands may not be placed in areas where passages to any entrances or walkways are blocked. Only official UCSD administrative units can set up tables or moveable stands without permission from the UCSD Official responsible for the area.

16.15.13CB. Policy

16.15.13.10. General: The time, place and manner of exercising expression and advocacy is subject to the regulations that provide for noninterference with University or UCSD functions and reasonable protection to persons against practices that would cause bodily harm or injury, or otherwise infringe upon the legal rights of others. UCSD administrative officials are responsible for the effective implementation of this policy.

16.15.13.11. Related Policies The University-wide policies contained in Section 16.15.10., above are considered part of this policy and are also applicable to students.

16.15.13.121. UCSD Policy Any individual or group wishing to exercise rights of expression and/or advocacy may utilize UCSD grounds generally open to the public. These areas include: but are not necessarily limited to:

a. Revelle College Plaza b. Revelle College Grassy Knoll c. Muir College Quad d. Thurgood Marshall College Quad e. Warren College Commons Area f. Gym Steps g. Student Center Area h. Eleanor Roosevelt College Residence Hall Quad i. Pepper Canyon Plaza j. Eleanor Roosevelt College Quad

16.15.13.13. The use of amplification as part of the rights of free expression in student demonstrations and rallies is permitted in the above designated areas as specified in Section 16.16. et seq. below. The use of amplification in times other than indicated shall be subject to approval by the Office of Student Programs, and the appropriate college dean or administrator of the designated areas listed above.

16.15.13.142. The conduct of student demonstrations and rallies in designated UCSD areas as a part of the exercise of expression and/or advocacy shall include the use of demonstration monitors to be designated by the sponsor(s) or organizer(s) of the event.

16.15.13.153. At such time as the Vice Chancellor - Student Affairs becomes aware of a spontaneous demonstration or rally on UCSD for the purpose of exercising expression and/or advocacy, a Student Affairs Coordinator shall be appointed.

16.15.14DC. ProceduresRole of Student Affairs and UCSD Police 16.15.14.101. Role of Demonstration Monitors A minimum of two demonstration monitors will always be designated. For large student demonstrations or rallies, a minimum of one monitor per hundred participants anticipated shall be appointed exclusive of the minimum. All monitors must consent to serve as such and shall wear an identifying mark, badge, or other means of identification that is clearly visible. Demonstration monitors are responsible for maintaining reasonable order during the course of the demonstration and coordinating events with the Student Affairs

Coordinator to insure the health and safety of demonstration participants as well as bystanders. 16.15.14.11. Appointment of Student Affairs Coordinator by the Vice Chancellor Student Affairs.2. At such time that a request is made to an appropriate college dean or administrator for the use of a designated UCSD or college area, or at such times that the VCSA becomes aware of a spontaneous gathering on UCSD for the purpose of exercising speech and/or advocacy, the VCSA shall appoint a Student Affairs Coordinator. The VCSA will maintain a list of individuals within the VCSA Affairs organization who are to be on call to serve as coordinators. 3a. Role of Student Affairs Coordinators Student Affairs Coordinators are responsible as appropriate per event for the following:

a1. Initiate appropriate liaison with the individual or group requesting use of a designated UCSD area. Verify names of all monitors. b2. Contact the UCSD Police and conduct preliminary discussions about the forthcoming event that is planned or anticipated. Obtain the name of the UCSD Police liaison person. c3. Be present at the event, arriving on the scene prior to its scheduled or anticipated starting time or as soon as practical after being informed of the event. d4. Observe events as they occur to ensure that individual rights are not being violated, University/UCSD property is not being damaged or destroyed, and contact the UCSD Police liaison for appropriate action in cases of unlawful activities, including but not limited to obstruction or disruption of teaching, research, administration, disciplinary procedures, or other UCSD related activities. 5e. Make the determination in consultation with demonstration monitors and in accordance with existing University policies and UCSD regulations relating to speech and advocacy that a group of individuals should be dispersed and/or relocated. Dispersal and/or relocation determinations shall be publicly announced and shall include a reasonable warning period. 6f. When violations of law, University policy, or UCSD regulations occur at the event, consult with the UCSD Police liaison and in accordance with existing University policies and UCSD regulations relating to use of University property and speech and advocacy, take action as deemed appropriate and necessary.

4b. Role of UCSD Police

a1. The UCSD Police official(s) at any event described above will be responsible for upholding all Federal and State of California laws and applicable UCSD policies and regulations. UCSD Police would be expected to take immediate action in any case involving the imminent threat to destruction of UCSD or University property or the imminent threat of bodily harm.

2b. When the Student Affairs Coordinator in consultation with student demonstration monitors has made a determination that a group of individuals should be dispersed and/or relocated, the UCSD Police official will be so informed and shall attempt to peacefully implement the decision. If the group does not disperse and/or relocate and, if in the opinion of the UCSD Police official a violation of the Unlawful Assembly statute is occurring, the official shall read the Unlawful Assembly dispersal notice to the assembled group. A second reading shall be given and appropriate action shall be taken by the police official if the group fails to obey the instructions.

16.16.10. Designated Times and Places for Use of Amplified Sound

16.16.10.10. Amplified sound is authorized in the areas listed below on Monday through Friday between 11:30 a.m. – 2 p.m. and on Saturday and Sunday after 4 p.m. and before 10 p.m., unless otherwise approved by the UCSD official designated for the site.

16.16.10.11. No amplified sound is allowed for the Gymnasium Steps except between 4 p.m. and 10 p.m. on Friday, Saturday and Sunday unless otherwise approved by the UCSD designated facility manager.

16.16.10.12. Exceptions to these locations and times must be approved by the designated facility manager, e.g. College Dean, University Center Director or Assistant Vice Chancellor Student Programs and Facilities.

16.16.11. Required Procedures for Use of Amplified Sound

16.16.11.10. The use of amplified sound must be scheduled through the UCSD master calendar website and approved by the designated facility manager.

16.16.11.11. Exceptions to these event scheduling guidelines must be approved by the designated facility manager.

16.16.11.12. Decibel Levels: The maximum permissible decibel level, measured at the sound mix panel, is of 108 dBA peak and a continuous/average decibel level of no more than 98 dBA.

16.16.11.13. Decibel Monitoring: Contracts for outdoor musical events must include language that mandates adherence to the decibel level policy established by UCSD. Events will be monitored by a designated University official with costs recharged to the sponsoring organization. When the decibel level is unacceptable, the program sponsor/advisor or the facility manager will take the necessary corrective action, including but not restricted to, cancellation of the event and non-payment of the performing group since a violation of contractual agreements has occurred.

16.16.11.14. Any scheduled event will have priority over other spontaneous uses of the areas concerned. Sound amplification equipment may not be used at other outdoor locations unless approved in advance by the Assistant Vice Chancellor Student Programs and Facilities.

21.00 Policy on UCSD EmergenciesCampus Emergencies

21.10. State of Emergency: I. INTRODUCTION The Chancellor may, after consultation with the University President, and where possible with student and faculty representatives, declare a state of emergency to exist on the campus when:

21.10.10. A. Extreme conditions exist on or within the vicinity of UCSD, resulting from natural disasters, civil disorders which pose a threat of serious injury to persons or damage to property, or other such seriously disruptive events; and 21.10.11B. Extraordinary measures are required to immediately avert, alleviate, or repair damage to UCSD or University property, or to maintain the orderly operation of the campus.

21.11. II. EMERGENCY REGULATIONS AND PROCEDURES: The Chancellor shall adopt UCSD emergency regulations and procedures, consistent with University-wide policies and these regulations, and upon the declaration of a state of emergency, shall place into effect orders appropriate to the emergency per the following:

21.11.10. A. Emergency Suspension: During a state of emergency, the Chancellor or his/her designated representatives is empowered to impose Emergency Suspension on any student, faculty member or employee where there is reasonable cause to believe:

21.11.10.101. The individual has participated in a disturbance of the peace or unlawful assembly, or has acted in violation of the UCSD emergency orders; or has committed an act of physical violence or has threatened to commit such an act, or has committed a theft or has damaged property; or 21.11.10.112. The individual's presence on campus will lead to violation of UCSD emergency orders, violence, intimidation, damage to property, or other disruptive activity incompatible with the orderly operation of UCSD.

21.11.11B. If Emergency Suspension is imposed by a designated representative of the Chancellor, such representative shall immediately inform the Chancellor and shall submit a written report on the action to the Chancellor as soon as is reasonably possible. The report shall contain a description of the person suspended, including the person's name and, if available, address and phone number, and a statement of the facts giving rise to the suspension. If the Chancellor does not affirm the action of the designated representative within 24 hours after being informed that the suspension has been imposed, the suspension shall be deemed void and a reasonable effort shall be made to inform the person who was suspended that the suspension is void. 21.11.12. C. Any individual placed on Emergency Suspension shall be given written confirmation of the suspension, either by delivering it to the individual personally or by mailing it to the individual's last known address. The confirmation shall inform the individual of the procedures by which the validity of the Emergency Suspension can be appealed, including the opportunity to obtain a special hearing on the Emergency Suspension in accordance with applicable UCSD procedures. If an individual is found to have been unjustifiably placed on Emergency Suspension, UCSD and the University are committed to a policy whereby reasonable efforts are taken to assist an individual who has been disadvantaged in employment or academic status. The outcome of the appeal shall have no bearing on UCSD disciplinary proceedings arising from the conduct which gave rise to the emergency Suspension. 21.11.13. D. Any individual placed under Emergency Suspension shall not, during the period of suspension enter upon specified areas of UCSD or engage in specified activities, as set forth in the written Notice of Emergency Suspension. The exclusion or restriction shall be limited to the minimum extent necessary to protect the health and safety of persons or property, or to maintain the orderly operation of UCSD.

21.11.14. E. The Chancellor may impose Emergency Suspension on a student without declaring a state of emergency as described below.;

21.11.14.101. If Emergency Suspension is imposed by a designated representative of the Chancellor, that representative shall immediately inform the Chancellor and shall submit a written report on the action to the Chancellor as soon as it is reasonably possible. The report shall contain a description of the person suspended, including the person's name and, if available, address and phone number, and a statement of the facts giving rise to the suspension. If the Chancellor does not affirm the action of the designated representative within twenty-four (24) hours after being informed that the suspension has been imposed, the suspension shall be deemed void and a reasonable effort shall be made to inform the person who was suspended that the suspension is void. Should the suspension be voided, that shall have no bearing on UCSD disciplinary proceedings which gave rise to the suspension. Any such disciplinary proceedings shall be conducted after the normal procedures provided in the UCSD Student Conduct Code. 21.11.14.11.2. A student placed on Emergency Suspension, which is affirmed by the Chancellor, shall be given written confirmation of the suspension either by delivering it to the student personally or by mailing it to the student's last known address. The confirmation shall inform the student of the conduct which gave rise to the suspension and of the opportunity to obtain a prompt, special hearing on the suspension. 21.11.14.123. If Emergency Suspension is imposed by the Chancellor or a designated representative of the Chancellor and is not voided pursuant to Section 21.11.11.10. above, the student may choose to have a special hearing by the Dean on the issue of the necessity of the Emergency Suspension. Such a hearing shall have scheduling priority. The student may be assisted at the hearing by a representative. The student may present evidence that the student may have in support of the contention that the suspension is unnecessary. The Dean is authorized to investigate the facts which gave rise to the suspension. Within three (3) calendar days of the conclusion of the hearing, the Dean or other appropriate UCSD official if the suspension was imposed by the Dean, shall determine if the suspension is necessary. If the Dean or other appropriate UCSD official determines that the suspension is unnecessary, the Dean or other appropriate UCSD official is authorized to lift the suspension. Should the suspension be lifted, that shall have no bearing on UCSD disciplinary proceedings arising from the conduct which gave rise to the suspension. Any such disciplinary proceedings shall be conducted under the normal procedures provided in the UCSD Student Conduct Code. 21.11.14.134. If Emergency Suspension is neither voided nor lifted pursuant to Section 21.11.11. or 21.11.12. above, the normal procedures provided in the UCSD Student Conduct Code for student discipline cases shall be followed, except that students under Emergency Suspension shall have a scheduling priority at each step of the proceedings.

21.11.15. F. Violation of any condition set forth in the Notice of Emergency Suspension shall subject the individual to the disciplinary proceedings based upon such violation. 21.11.16. G. A complete statement of the UCSD campus implementation of the System-wide policies pertaining to UCSD Emergencies may be found in the current CAMPUS EMERGENCY OPERATIONS PLAN. Copies of this plan may be seen at the UCSD Police Department, Office of Student Conduct, and the Office of Environment, Health and Safety.

18.00 UCSD-Based Voluntary Student Contributions and Compulsory Student Fees

18.10I. INTRODUCTION Establishment or Increase: Voluntary student contributions and compulsory student fees must be approved by the Chancellor. Compulsory fees must also be approved either by The Regents or by the President.

18.10.10A. Requests for the establishment or increase of a compulsory fee or voluntary student contribution must be submitted for review to the Vice Chancellor-Student Affairs at least five weeks prior to the proposed date of the referendum (described below) for establishing the fee or contribution. In addition, requests for graduate or undergraduate campus-wide compulsory fees or voluntary student contributions must be endorsed by the Assistant Vice-Chancellor Student Life. Requests for college-based compulsory fees or voluntary student contributions must be endorsed by the official student government of the College, the College Dean of Students and College Provost. B. All requests must contain the following information:

1a. Date the proposed referendum was approved by the appropriate student governmental body and terms of passage (for example, approved by 2/3 vote of the College Council). 2b. Proposed referendum date. 3c. Proposed fee level and effective date of the new fee level. 4d. Purpose of the new fee or fee increase and how the fee revenue will be used (i.e., justification). 5e. A statement which shall specify the amount of the "return-to-aid" from the proposed fee for financial aid. 6f. Proposed ballot language. (The ballot language should include a statement that the fee will be charged each academic quarter beginning in [Insert Date]). 7g. Approved criteria (i.e., referendum guidelines) for establishing or increasing a compulsory fee, including voting pool requirements and requirements for at least a majority vote approval (for example, 20% of registered students with passage by a simple majority). 8h. A statement that the proposed voting criteria are in compliance with the applicable student fee policies described in Section 18.00 of the UCSD Policies and Procedures Applying to Student Activitiesthis Policy and, for a college-based request, that it also complies with the college Election/Referendum Guidelines or Constitution and Bylaws. i9. Election Procedures -- How the election will be conducted (e.g., paper ballot, TritonLink). 10j. Campaign Procedures -- How the election, presenting both pro and con positions, will be publicized to the affected student body, and in what form. k11. A copy of the approved applicable student government constitutions, bylaws and/or guidelines.

18.10.11CB. The proposed referendum must be approved by the Vice Chancellor-Student Affairs and the Chancellor prior to the election.

18.11II. VOLUNTARY STUDENT CONTRIBUTIONS : Consistent with the University of California Guidelines for Implementing a Voluntary Student Fee Pledge System, the criteria described in subsections 18.11.10 and 18.11.11 and the and procedures described in subsections 18.11.12 to 18.11.14., inclusivethis section, permit use of the UCSD student registration process or other campus process to collect voluntary contributions from students in support of UCSD student governments and Registered Student Organizations.

18.11.10A. The programs and activities supported by UCSD voluntary student contributions must serve the interests of enrolled UCSD students and the educational purposes of the University. 18.11.11B. The programs and activities supported by UCSD voluntary student contributions must be in compliance with all applicable UCSD policies, UC policies, and the law. 18.11.12C. A voluntary student contribution must receive student approval either through a referendum as detailed in Section 18.11.15 or, subject to the concurrence of the Vice Chancellor-Student Affairs, the voluntary contribution may be approved through a duly adopted resolution by an authorized student government representing the students from whom the contribution is to be collected. 18.11.13D. The wording of the referendum to establish the voluntary student Pledge System shall be prepared in accordance with this Policy and in conformance with ASUCSD and/or GSAUCSD election procedures or other applicable UCSD regulations and procedures. 18.11.14E. The referendum ballot or the resolution must contain a written disclaimer stating that the voluntary contribution does not constitute sponsorship or endorsement by UCSD or the University of the programs or activities supported by the voluntary student contribution. In the case of programs and activities of student governments, the disclaimer must state that a voluntary student contribution does not constitute sponsorship or endorsement by any unit of the University other than the student government. 18.11.15F. Voting Rules for the Referendum

18.11.15.101. In a referendum during a general election, the referendum will pass if (a) the number of students casting ballots equals or exceeds the average number of students who cast ballots in the three previous general elections and (b) the votes in favor exceed the number of votes cast against the specific referendum question and (c) the number of votes in favor exceed the number of abstentions on the specific referendum question. 18.11.15.112. In a referendum during a special election, the referendum will pass if (a) the number of students casting ballots equals or exceeds 20% of the affected students registered at UCSD during the academic quarter in which the special election is held and (b) the number of affirmative votes exceeds half the total votes cast on the specific referendum question and (c) the number of votes in favor exceed the number of abstentions on the specific referendum question.  

18.11.16G. Whether student approval of voluntary student contributions is through referendum or resolution, voluntary student contributions may only be implemented with the approval of the Chancellor, who may take into account other relevant matters. 18.11.17H. Students shall not be assessed a voluntary contribution unless the student elects, by means of a positive check-off, to authorize the assessment of such contribution for the benefit of the student government or Registered Student Organization. 18.11.18I. Voluntary Student Contribution ("Pledge System")

18.11.18.101. The Pledge System is the vehicle by which a student may act affirmatively to contribute to a student government or Registered Student Organization by pledging to pay a voluntary student contribution each academic term for the duration of the student's academic career at UCSD unless reversed by the student in writing or other format as provided by the written agreement for the collection of the voluntary student contribution. 18.11.18.112. A Pledge System may be implemented and maintained only with a valid written agreement which is negotiated between the student government or Registered

Student Organization and Vice Chancellor-Student Affairs in a manner consistent with UC Policy Section 90.00 Policy on the Campus Assessment of Voluntary Student Contributions to Student Governments and Registered Campus Organizations and UCSD Policies and Procedures Applying to Student Activities, Section 18.00this Policy. 18.11.18.123. The written agreement to establish a Pledge System shall, at a minimum, include the following provisions:

a. The text and format of the Pledge System materials. b. A timeline for implementing the Pledge System. c. Procedures to inform students of the Pledge System. d. The procedures for collecting, verifying, and submitting pledges, including the locations for submitting pledges. e. A date shall be set for each academic term by which time all pledges must be submitted in order to be effective for the next term's billing statement. f. The procedures for reversing pledges. g. The procedures for collecting the fee and remitting the amounts collected. h. The procedures for how outstanding accounts receivable will be handled. i. The procedures to reimburse UCSD for costs it incurred in the implementation of the written agreement, including but not limited to the collection and processing of the students' pledge. j. The methods for distributing pledge forms. k. The term, the conditions and procedures for amending, renewing or extending the written agreement. l. The conditions for conducting student referenda related to the voluntary student contribution. m. The procedures for resolving disputes that may arise between the parties in connection with the implementation of the written agreement. n. The procedures for discontinuing collection of the fee or use of the Pledge System. o. Indemnification provisions that UCSD routinely includes in other written agreements, including but not limited to, indemnification provisions in the case of Registered Student Organizations that provide that the Registered Student Organization shall indemnify, defend, and hold harmless the University/ UCSD in any legal action which may arise in connection with the written agreement. In the case of student government, provisions that student government funds will be used to pay for the costs of defense and any judgment in any legal action which may arise in connection with the agreement. p. Provisions that indicate clearly any requirement to show evidence of the Registered Student Organization's ability to pay.

18.11.18.134. The locations where pledges may be submitted should be easily accessible and, in accordance with UCSD regulations, may be along pathways or corridors regularly used by students in the course of registering for or attending classes and/or paying fees. The date by which students must submit pledges should be as late in the academic term as the billing schedule allows. 18.11.18.145. At a minimum, a valid voluntary student contribution pledge shall state clearly the amount of the contribution being pledged each academic term and that such pledge is for the duration of the student's academic career at UCSD, unless revoked in writing or other format as provided by the written agreement. The pledge shall include the student's name, registration identification number, signature and the date of the signature. If alternative formats such as telephone or electronic means for collecting student pledges are used, the written agreement shall include procedures that assure the validity of the student's pledge. 18.11.18.156. Additional information may be included with the pledge, as provided in the written agreement with the student government or Registered Student Organization. 18.11.18.167. The pledge system shall be compatible with UCSD registration and billing systems. Whenever possible, accommodations may be made to collect voluntary student contribution pledges using the UCSD telephone or electronic registration systems. 18.11.18.178. When there is a break in the student's enrollment, assessment of voluntary student contributions shall not be resumed unless a new pledge form is obtained from the returning student. For purposes of this Policy, the term "enrollment" means registration fees are paid in full. 18.11.18.189. A student government or Registered Student Organization may gather pledges in support of a voluntary student contribution in a manner consistent with University/ UCSD policies. Registered Student Organizations must maintain their Registered Student Organization status throughout the implementation of the pledge system, including solicitation of pledges, holding the referendum, and the duration of the contract. 18.11.18.1910. Opportunities to inform students about the student government or Registered Student Organization, the voluntary pledge contribution, and the pledge mechanism may be made available throughout the year. 18.11.18.2011. A student government or Registered Student Organization may be permitted to collect pledges prior to the referendum and before the written agreement is finalized. Pledge forms collected prior to a student referendum shall have no effect if the student referendum is defeated. For fee billing purposes, UCSD shall honor pledges collected during the same academic year in which a student referendum is held to establish a pledge system, provided the students approve the measure. 18.11.18.2112. Once a pledge system is implemented, students may execute and submit pledge forms throughout the year. Opportunities to execute pledges shall be made available, as provided in written agreements and UCSD regulations. 138.11.18.22. A student government or Registered Student Organization may make pledge forms available to students as provided in written agreements or as otherwise provided in UCSD regulations. 148.11.18.243. To ensure that the additional administrative workload is justified, no less than ten percent (10%) of the total affected student population of UCSD must submit a pledge to pay the voluntary student contribution before a pledge mechanism may be

implemented. In determining the minimum number of students who must submit pledges, UCSD may use the student enrollment count, which is used to establish voting pool requirements for student referenda, or other standards established in UCSD regulations. 158.11.18.24. If, by the end of the final billing cycle of the academic year following implementation, and any year thereafter, the percent of students having pledged equals less than the number provided in Section II, Letter I (14)18.11.18.23 above, a referendum regarding the continuation of the voluntary student contribution pledge system shall be placed on the ballot of the next ASUCSD and/or GSAUCSD election held in compliance with the UCSD regulations. For the continuation referendum to pass, the vote requirements are the same as in Section II, Letter F18.11.15. If the continuation referendum is not held or does not achieve passage, the pledge system in question will be terminated. 18.11.18.2516. For each student who has pledged to pay the voluntary student contribution, the contribution shall be itemized on the student fee bill with other fees and included in the total amount due for that billing period. A check-off mechanism to opt-out of the contribution or reverse the pledge shall not be included on the billing statement. However billing statements will direct students to information about non-payment procedures and voluntary contribution revocation procedures. 18.11.18.2617. The voluntary student contribution pledge mechanism should be implemented as soon as possible, as provided in the written agreements, and not later than two academic terms following the student vote in favor. 18.11.18.27. The actual costs of implementing and collecting the voluntary student contribution (as defined in Section 8 of the University of California Guidelines for Implementing a Voluntary Student Fee Pledge System) shall be assessed to the relevant student government or Registered Student Organization, including costs in the first year for designing and implementing the pledge billing system. Such assessed costs cannot exceed the actual costs incurred for billing and collection of the fee, including the pledge mechanism. The pledge system should be cost efficient and compatible with the UCSD registration and billing systems and cost efficiency goals. The student government or Registered Student Organization shall collaborate with the University and with UCSD to identify methods for promoting cost efficiency. 18.11.18.2819. At the discretion of the Vice Chancellor-Student Affairs, all or a part of the actual costs of collection of voluntary contributions to benefit a student government may or may not be required to be borne by the student government. 18.11.18.2920. In the event of a change in billing procedures or any other changes which would affect how the voluntary student contribution is collected, campuses may discuss with the student government or Registered Student Organization how proposed changes in billing procedures may affect the collection of the voluntary student contribution. The student government or Registered Student Organization shall be notified of the need for changes as far in advance as possible to ensure that the student government or Registered Student Organization has adequate time to make any necessary adjustments. 18.11.18.3021. A student who has pledged to pay a voluntary student contribution in support of the student government or Registered Student Organization may revoke the pledge by written request or other format as provided by the written agreement. 18.11.18.3122. A student may revoke a pledge by submitting any of the following which must include the student's name, signature (including electronic signature), date of signature, and registration identification number: (1) a pledge reversal form, (2) a letter to

the Registrar or other appropriate UCSD official, or (3) a handwritten statement on the student's billing statement. 18.11.18.3223. A date shall be set by the parties to the written agreement for each academic term by which time all pledge reversal forms must be submitted to the designated UCSD official in order to be effective for the next term's billing statement. 18.11.18.3324. Once a student has submitted a pledge revocation notice, per Section 18.11.18.31II, Letter I (22) above, that the student no longer wishes to pay the voluntary contribution, UCSD shall no longer bill the student for the fee and the student's billing status should be the same as the billing status of a student who has not pledged to pay the voluntary contribution. 18.11.18.3425. If a student has pledged to pay the voluntary student contribution, but pays less than the total amount of all fees due, it will be presumed conclusively that any shortfall, up to the amount of the pledge, was a failure to pay all or part of the voluntary student contribution. 18.11.18.3526. Once a student has pledged to pay a voluntary student contribution, failure to pay the contribution in any given academic term shall not be interpreted as failure to pay required fees for registration purposes. Therefore, a student's registration shall not be held up, nor shall a student be dropped from classes, because the student did not pay the voluntary student contribution. 18.11.18.36.27. In the absence of an official revocation, failure to pay the voluntary student contribution as pledged in a given academic term shall not be interpreted as an intention to revoke the pledge. 18.11.18.3728. If a student underpays his or her contribution, UCSD, at its option, may include the voluntary student fee on "late bills" sent to the student. However, it shall not be expected that UCSD will send "late bills" if the amount unpaid is equal to or less than the total amount of the voluntary student contribution or if UCSD does not send "late bills" routinely. 18.11.18.38.29. Voluntary student contributions shall not be considered in determining a student's need for financial aid, and payment of the voluntary student contribution shall be made in accordance with Federal, State, University, and UCSD student financial aid policy. 18.11.18.3930. University/UCSD shall not be obligated to undertake responsibilities on behalf of the student government or Registered Student Organization beyond those specified in this Policy. 18.11.18.4031. Disclosure of information regarding students who provide voluntary student contribution pledges must be made in accordance with Federal and State privacy laws and University/UCSD policy.

18.12III. ESTABLISHING, INCREASING , REDUCING, OR ELIMINATING COMPULSORY CAMPUS-BASED STUDENT FEES : Compulsory campus-based fees include fees levied at UCSD that must be paid by all registered students to whom the fee applies to fund (1) student-related services and programs, including, but not limited to, referenda-based student health insurance programs; (2) construction and renovation of student facilities such as student centers and recreation facilities; and (3) student governments, Registered Campus Organizations via a viewpoint-neutral reallocation by a student government, and student government and Registered Campus Organization-related programs and activities. (See section 18.13.10.12)

18.12.10A. This policy does not apply to University-wide fees, to non-referenda-based campus health insurance fees that may be assessed to meet a non-academic condition of enrollment established by either The Regents or the President, to fees related to instruction, or to campus-based miscellaneous fees that require either the Chancellor's or the President's approval. 18.12.11B. Referendum Requirements : Compulsory campus-based student fees may only be established, increased or renewed following a referendum in which students vote in favor of the compulsory fees, except as provided in these Policies.

18.12.11.101. Any compulsory campus-based student fee approved as either a new fee, or as an increase to or renewal of an existing fee, shall provide for fee revenue for local need-based financial aid ("return-to-aid") to be set aside in an amount equal to at least 25% of the total new fee, fee increase, or fee renewal, as appropriate. The return-to-aid generated by undergraduate students shall be reserved for undergraduate financial support and the return-to-aid generated by graduate and professional students shall be reserved for graduate and professional student financial support. Any campus-based fee that is charged to a student as a premium to purchase health insurance for that student shall be exempt from any return-to-aid requirement. This exemption shall not extend to campus-based fees that have been approved by students through the referendum process for the purpose of providing direct support to campus student health services. 18.12.11.112. A proposed new compulsory campus-based fee or proposed increase or proposed renewal to any existing such fee (except as specified in Section III, Letter D 18.12.13 of this Policy) must be voted on by students as a separate ballot measure in a student referendum, except that multiple proposed new such fees or fee increases or renewals may be aggregated into a single ballot measure where the proposed fees or fee increases or renewals strongly and clearly support a common student life, student service, or other programmatically related goal. 18.12.11.123. The actual language of any ballot measure in a student referendum that is intended to fund either construction of a new building or other facility, or major renovation of an existing building or other facility must explicitly state:

(1) a. Whether the fee will be continued following retirement of the original debt on the new construction or major renovation, and b. (2) If the fee is to be continued, the purpose or purposes for which the fee will be used, as well as the mechanism that will be used to determine the level at which the fee will be set, following retirement of the original debt.

18.12.11.134. A payment by students of compulsory campus-based student fees to support student-referendum-funded construction of new buildings or other facilities, or major renovation of existing buildings or other facilities, may be initiated only from the time that students can actually benefit from and use the new or renovated building or other facility, except as specified immediately below. 5. A campus referendum may assess students a pro rata percentage of any such fee in advance of completion of the new or renovated building or other facility for the purpose of supporting the design and planning costs, project mitigations, and financing costs associated with construction or renovation of the building or other facility, provided that both the purpose and level of this assessment are approved by students as part of the ballot measure language in the original referendum. 18.12.11.146. Student Consultation: A request to establish a compulsory fee to be assessed on UCSD students must be endorsed by the student government elected to

represent the students affected by the proposed fee prior to the setting of the date for the referendum as described in subsections 18.12.11.14.10 through 18.12.11.14.13 below.

18.12.11.14.10a. The request for the establishment of campuswide undergraduate student compulsory fees must be approved by the UCSD Associated Students Council. 18.12.11.14.11b. The request for the establishment of campuswide graduate student compulsory fees assessed on graduate students must be approved by the UCSD Graduate Student Association. 18.12.11.14.12c. The request for the establishment of college-based compulsory fees must be approved by the duly appointed college governmental body. (See section 18.14 for the guidelines regarding the student consultation process related to campus‐based fee‐funded facilities.) 

18.12.11.157. Special and General Election Voting Pools and Balloting Requirements: In a referendum during any election, the referendum will pass if (a) the number of students casting ballots equals or exceeds 20% of all students eligible to vote during the academic quarter in which the special or general election is held and (b) the number of affirmative votes exceeds half the total votes cast on the specific referendum question.

18.12.11.168. All referenda results are advisory to the Chancellor and, conditional on the Chancellor's recommendation, are subject to final approval by the President under the President's delegated authority from The Regents.

18.12.12C. Requirements for Reducing or Eliminating a Compulsory Campus-based Student Fee 18.12.12.101. Compulsory campus-based student fees cannot be reduced or eliminated when the campus-based student fee is necessary to meet legal requirements and contractual obligations and other commitments such as income projections, debt service and/or funding covenants of a building or facility that is funded wholly or in part by campus-based student fees. 18.12.12.112. Students may initiate a reduction or elimination of compulsory campus-based student fees, prior to their expiration, by a referendum in which students vote in favor of reducing or eliminating the fee in accordance with the referendum requirements set forth in Sections 18.12.11 through 18.12.11.15III, Letter B.

18.12.13D. Exceptions to the Student Fee Referendum Requirements: An increase in compulsory campus-based student fees may be approved by The Regents subject to the President's and the Chancellor's recommendation, and does not require a student referendum, under any of the following circumstances:

18.12.13.10. When the original referendum language approved by students in a student election specifically allows the Chancellor to increase a compulsory campus-based student fee. 18.12.13.112. When the Chancellor determines that an increase is necessary for the health and safety of students and when the fee is related to maintaining the safety of a building or facility that is funded wholly or in part by compulsory campus-based student fees. Safety issues are those that are potentially dangerous consistent with the standards set forth in the University Policy on Seismic Safety and the University Policy on Management of Health, Safety, and the Environment, as determined by the Chancellor with the concurrence of the Office of the President, such as those that relate to the risk of

fire, the presence of asbestos, or the existence of seismic or other structural deficits. For buildings or facilities with multiple uses, whenever possible, the costs to students for funding safety-related or health-related maintenance should be based on the proportion of current non-academic student use of the facility. Any new fee, or any increase to or renewal of an existing fee, established under the provisions of this Section shall be retired once the fee's stated purpose is fulfilled. Upon the recommendation of the President, the Chancellor may petition The Regents for continuation of any such new fee, fee increase, or fee renewal in advance of its retirement. 18.12.13.123. When the fee increase is necessary to meet legal requirements (such as new code requirements) or contractual obligations (such as income projections) specified in the funding covenants of a building or facility that is funded wholly or in part by campus-based student fees. For buildings or facilities with multiple uses, whenever possible the costs to students for such increases should be based on the proportion of current non-academic student use of the facility. 18.12.13.134. The Regents have authority to impose fees for any University purpose. All campus-based student fees at a campus must be approved by the Chancellor of that campus, except that no compulsory campus-based student fees shall be effective until also approved either by The Regents or by the President under the President's delegated authority, as appropriate.  

18.13IV. SUPPORT FOR REGISTERED STUDENT ORGANIZATIONS AND RELATED PROGRAMS AND ACTIVITIES FROM COMPULSORY CAMPUS-BASED STUDENT FEES

18.13.10A. Conditions for Support 18.13.10.10. UCSD compulsory student fees allocated to student governments may be reallocated to support Registered Student Organizations and Registered Student Organization-related programs and activities consistent with the University's and UCSD's educational purposes in providing such support, as set forth in Section 18.13.11 belowIV, Letter B. The process for making such reallocations must be based solely on viewpoint-neutral criteria, as set forth in Section IV, Letter C18.13.12 below. 18.13.10.112. A Registered Student Organization that is preponderantly or exclusively funded by a student government or other campus entity from compulsory campus-based student fees shall primarily have UCSD students as its members. Programs and activities of a Registered Student Organization funded from compulsory campus-based student fees shall be open to participation by the entire campus community. In addition, all expenditures relating to programs and activities of a Registered Student Organization (whether the program or activity takes place on- or off-campus) that are funded from such fees must be under the direct control of UCSD students. 18.13.10.123. The referendum process set forth in these Policies in Section 18.10, and followingthis Policy, shall not be accessible to a Registered Student Organization or any student group other than a student government for the purpose of establishing a compulsory student fee to support itself or its program's activities. The foregoing is not intended to preclude access to the referendum process by any administrative unit of the University, subject to appropriate student consultation. Support for a Registered Student Organization or any student group other than a student government from compulsory campus-based student fees must be in the form of a reallocation from student government or other appropriate campus entity to the Registered Student Organization or other student group. All such reallocations must be made consistent with the requirements for viewpoint-neutral funding set forth in Section IV, Letter(s) B & C s 18.13.11 and 18.13.12 below. 18.13.10.134. A student government in consultation with the Vice Chancellor-Student Affairs, or the Vice Chancellor-Student Affairs with the concurrence of the student

government, may establish and administer a mechanism providing for a pro rata refund to any student of that portion of his or her student government fees that has been allocated by the student government or other campus entity to support a particular Registered Student Organization or Registered Student Organization-related program or activity.

18.13.10.13.10a. Students who believe that any portion of their compulsory student government fees support political, ideological, or religious organizations or activities may seek a pro rata refund of that portion of their compulsory student fees that were used to support such activity. Requests for refunds of any portion of compulsory student government fees shall be processed in accordance with the procedures set forth in these regulations in Section 23.00 Student Grievance Procedures. The student government body collecting the fee will be responsible for costs of litigation that are incurred as a result of a violation of these regulations. 18.13.10.13.11b. For any student who successfully asserts that a Registered Student Organization, or any activity of any such organization funded by a separate allocation, is predominantly political, religious, or ideological in nature, the student government body collecting the fee will provide for a pro rata refund directly from the organization to the student of that portion of his or her compulsory student fees that has been allocated to support the organization or separately funded activity under challenge.

18.13.11B. The University's Educational Purposes 18.13.11.101. The University's educational purposes are served when reallocations by a student government or other campus entity of compulsory campus-based student fees to support Registered Student Organizations and Registered Student Organization-related programs and activities are made:

(1)a. Tto provide opportunities for the educational benefits and personal and social enrichment that derive from participation in extracurricular programs and activities; and b.(2) Tto stimulate on-campus discussion and debate on a wide range of issues from a variety of viewpoints.

18.13.11.112. Consistent with the purposes set forth in Section IV, Letter B(1)18.13.11.10 above, such reallocations shall only be made to support either the general organizational expenses of Registered Student Organizations and Registered Student Organization-related programs and activities or their associated communicative purposes. 18.13.11.123. In addition, allocation decisions to support Registered Student Organizations and Registered Student Organization-related programs and activities must be made without regard to the viewpoint of a particular Registered Student Organization or Registered Student Organization-related program or activity, and must be balanced in relation to the support provided to other Registered Student Organizations or Registered Student Organization-related programs and activities in similar circumstances.

18.13.12C. UCSD Procedures and Criteria to Assure Viewpoint Neutrality 18.13.12.101. In fulfilling the University's educational purposes, UCSD shall have responsibility for ensuring that student governments and, as applicable, other campus reallocation entities, maintain procedures and criteria for making specific reallocation decisions for the support of Registered Student Organizations and Registered Student Organization-related programs and activities from compulsory campus-based student fees. Such procedures and criteria must be viewpoint-neutral in their nature; that is, they must be based upon considerations which do not include approval or disapproval of the viewpoint of the Registered Student Organization or any of its related programs or activities.

18.13.12.112. Criteria appropriate to be given balanced consideration in the making of viewpoint-neutral reallocation decisions might include, but are not limited to: the objectively documented organizational needs of the Registered Student Organization based on membership size; its office or equipment requirements; the extent of financial support the Registered Student Organization receives from other sources; or the production costs associated with a particular event or series of events the Registered Student Organization typically sponsors. Such sponsored events, supported in whole or in part by compulsory campus-based student fees, need not avoid controversial political, religious, or ideological content, subject to the understanding that under current University policy (see University of California Policies Applying to Campus Activities, Organizations and Students, Section 30.20 of the Policy on Speech and Advocacy) UCSD has a responsibility to assure an ongoing opportunity for the expression of a variety of viewpoints. 318.13.12.12. Student governments or other campus entities responsible for reallocating compulsory campus-based student fees must: (a) publicize widely and regularly to Registered Student Organizations, either through publication in the The UCSD Guardian, by posting to an electronic bulletin board, or by other appropriate means, the availability of such funds to support Registered Student Organizations on a viewpoint-neutral basis, as well as the viewpoint-neutral criteria on the basis of which such funds will be reallocated; (b) assure that communications to Registered Student Organizations on the availability of such funds be made in a timely fashion, and be reiterated periodically during the year as long as such funds remain available, to ensure sufficient time for the preparation of funding proposals in advance of funding decisions; and (c) provide students with a reasonable time to request consideration for a refund. 18.13.12.134. Student governments or other campus entities responsible for reallocating compulsory campus-based student fees must provide for: (a) documentation of all funding processes available to Registered Student Organizations, including notice of the opportunity to apply for funding and the criteria upon which funding requests will be judged, consistent with Section IV. Letter C(2)18.13.12.11 above; (b) documentation of all funding requests by Registered Student Organizations and actions taken by the student government or other campus entities with reference to the published funding criteria in response to such requests; and (c) a formal process that allows Registered Student Organizations or individual students to appeal, in a reasonable and timely manner, funding decisions regarding particular Registered Student Organizations or Registered Student Organization-related programs and activities made by the student government or other campus reallocating entities. 

18.13.12.13.10a. The student government body collecting the fee will use the procedures set forth in the UCSD Policies and Procedures Applying to Student Activities, Section 23.00UC San Diego Student Grievance Procedures, to evaluate challenges by students seeking a pro rata refund of that portion of their compulsory student fees allocated to support a Registered Student Organization or separately funded activity of any such organization asserted to be predominantly political, religious, or ideological in nature. 18.13.12.13.11b. The student government body collecting the fee will provide for a prompt pro rata refund to any student whose challenge is sustained by the review procedure.  

18.13.12.145. Compulsory campus-based student fees may be reallocated to pay for speakers sponsored by Registered Student Organizations. Over time, such events should stimulate on-campus discussion and debate from a wide range of viewpoints on a variety of issues.

18.13.13D. Legal Review of Campus Procedures and Criteria

: Campus procedures and criteria for reallocation of compulsory campus-based student fees to support Registered Student Organizations and Registered Student Organization-related programs and activities on a viewpoint-neutral basis must be reviewed by the Office of the General Counsel to ensure that the procedures and criteria are consistent with the law and these Policies. In addition, campuses are advised to consult with the Office of the General Counsel should a question arise about whether a particular reallocation is viewpoint-neutral in nature and meets the University's educational purposes as specified in Section IV, Letter B 18.13.11 of these this pPolicyies. 18.13.14E. Transfer of Compulsory Campus-based Student Fees to Non-University Entities

18.13.14.101. Compulsory campus-based student fees may be expended by a student government, Registered Student Organization, or other campus entity to cover the expenses of direct participation by UCSD students in a particular non-UCSD-sponsored educational program or activity. Such fees may also be expended in payment of applicable dues necessary to sustain membership by a student government or Registered Campus Organization in national and other regional non-UCSD associations at the basic level established by such associations, so long as the level of any such assessment is in line with what is assessed similar student organizations at other institutions comparable in size and nature to the UCSD as a requirement of basic membership. 18.13.14.112. Except as provided in Section 18.13.14.12, immediately belowthis section, memberships at a preferential level that require the payment of higher periodic dues than what is required to sustain basic membership, or the assessment by such non-UCSD associations of supplemental contributions from their members as an expectation, but not a requirement, of continued membership, may not be supported from compulsory campus-based student fees. 18.13.14.123. Other than for considerations of basic membership as set forth Section 18.13.14.10 abovein this section, additional transfers of funds from compulsory campus-based fees by a student government, Registered Student Organization, or other campus entity to such non-UCSD associations may be made only when they can be justified, in advance of the transfer, to the Vice Chancellor-Student Affairs as providing a direct educational benefit to UCSD students commensurate with the proposed expenditure. 18.13.14.134. Compulsory campus-based student fees may not otherwise be expended by a student government, Registered Student Organization, or other campus entity in support of, or be otherwise transferred to, a non-UCSD organization, program, or activity, except in payment for goods and services directly necessary to the operation of that student government, Registered Student Organization, or other campus entity, its programs or activities. 18.13.14.145. The referendum process set forth in Section I 18.10 of these this Policyies shall not be available either to establish a new compulsory campus-based student fee, or to lock in an increase to an existing such fee, for the purpose of supporting any non-UCSD organization, program, or activity.

18.14V. STUDENT CONSULTATION FOR STUDENT FEE-FUNDED FACILITIES : The procedures described in the following subsections of Section 18.14this section apply to referenda, planning, construction, finance, and other aspects of a facility to be funded by compulsory campus-based student fees ("Facility Fee").

18.14.10A. Referenda to establish a Facility Fee must adhere to mandatory campus-based student fee referendum guidelines described in Section 18.12III of this Policy. No more than one referendum shall be held in a given academic year for a particular proposed facility.

18.14.11B. An assessment of student needs for the proposed facility must be conducted prior to placing a referendum on the ballot. Information for the required assessment may be collected from a survey of students and consultation with student governments, or by other means approved by the Vice Chancellor-Student Affairs. Students must be involved in this needs assessment process. 18.14.12C. If the UCSD administration provides funding and opportunities for dissemination of information about a Facility Fee referendum, it shall provide equal funding and opportunities for a student representative (individual or group) promoting opposing arguments or points of view. 18.14.13D. The following types of facilities shall not be funded by a Facility Fee: (a) facilities primarily used as classrooms, laboratories, or other instructional facilities; (b) facilities providing office space for non-student related use; (c) facilities exclusively for commercial or rental use, such as bookstores and food service facilities. 18.14.14F. Prior to placing a Facility Fee referendum on the ballot, the appropriate student governments and the Vice Chancellor-Student Affairs must approve a Facility Advisory Board ("FAB") charter. The jurisdiction of the FAB shall include, but not necessarily be limited to, space allocation, general use policy, rent assessment, custodial standards, capital improvements, maintenance and renovation, purchase of equipment, and hours of operation. 18.14.16G. More than half the voting members of the FAB must be students appointed by appropriate student governments and other relevant student groups as determined by the Vice Chancellor-Student Affairs. 18.14.17H. Any subcommittee established by the FAB must have at least one student member. Selection of this member shall be subject to majority approval by a majority vote of the FAB. This provision does not exclude subcommittee membership of other students, nor does it require full FAB approval for other students. 18.14.18I. Students must serve on any search committee to select management personnel and must participate in the evaluation process for management level personnel of a facility funded by a Facility Fee. Such student service and participation must be in accordance with applicable UC and UCSD policies and procedures. 18.14.19J. The FAB shall prepare and publish a report ("FAB Report") that contains a complete program statement and describes the space plan for the proposed facility. 18.14.20K. The FAB Report shall also include a cost-effective financial plan for the proposed facility. The financial plan shall, through appropriate combination of funding sources, make Facility Fee assessments as small as reasonably possible. The financial plan shall also explicitly describe any charges for facility users who will not be assessed the Facility Fee for the proposed facility. 18.14.21L. The FAB Report shall include specific guidelines regarding bond repayment and the period over which Facility Fee is to be assessed. 18.14.22M. The FAB Report shall include recommendations to the Vice Chancellor-Student Affairs for a facility site, an architect, and a procedure for naming the facility. 18.14.23N. The FAB Report must be completed and disseminated as a public document during the fall, winter, or spring academic quarters. In particular, the report shall be distributed to the student governments and other campus groups as deemed appropriate by the FAB or the Vice Chancellor-Student Affairs or her/his designee.

17.00 Registered Student Organizations Policy

I. INTRODUCTION Registered student organizations provide students with opportunities for leadership, exploration, and campus engagement. Involvement in student organizations contributes to students' educational experience and enriches the campus community. By adapting or inserting the actual language of the Policy on Registered Campus Organizations (Section 70.00) of the University of California Policies Applying to Campus Activities, Organizations and Students, this Policy remains consistent with the system wide Policy. The complete Policy can be found at the website for the University of California Office of the President’s (UCOP). (http://policy.ucop.edu/doc/2710527/PACAOS-70).  17.10II. REGISTRATION AND MEMBERSHIP Registration Criteria 17.10.10A. Registration Requirements: An organization whose membership is limited to students, faculty, or staff of UCSD may become a registered student organization by complying with the requirements and procedures set forth inA registered student organization is an organization whose membership is predominantly comprised of UC San Diego students, faculty, and staff and attains recognition through the Center for Student Involvement by complying with this policy and related procedures. these regulations, Registered student organizations are considered independent entities and are not official units of UC San Diego. As such, UC San Diego is not responsible for the acts or omissions of registered student organizations and/or any members/persons acting on behalf of those student organizations. which at minimum shall include furnishing a statement of the name of the organization, its purposes, its officers or other authorized representatives, and other pertinent information as specified in these regulations.

17.10.11AB. General Requirements For Registration of a Student Organization: An student organization must register electronically submit thewith following to their assigned student organization advisorthe Center for Student Involvement in order to become a UC San Diego registered UCSD student organization. Prospective and current registered student organizations must complete the registration process and include a copy of its constitution and/or governing documents along with other required documents. The registration process can be found at https://students.ucsd.edu/student-life/involvement/organizations/register/index.html. :

17.10.11.101. A copy of the constitution or an equivalent document which shall at a minimum include; aa. Nname of the organization, (see Section 17.12. below governing the use of the name of the University or abbreviations thereof), b. Sstatement of purpose which must include language confirming that the organization is not for profit, c. Rrequirements for membership, (including fees), d. Qqualifications for holding office and methods of selecting and replacing officers. 17.10.11.112. A Registration form which includes; a. Tthe names and signatures of no less than four (4) officers or members who are currently registered students, their addresses, phone numbers, and ID numbers, b. Aa statement of nondiscrimination, (See Non), c. Aa statement verifying that the group agrees to comply with Federal, State and local laws, University policies, and UCSD regulations, d. Aa statement by the officers verifying that they have read and will comply with California laws applying to anti-hazing prohibitions, e. Aa statement of membership conforming to the following criteria: 1. Only registered UCSD students may hold office in the organization; 2. Only registered UCSD students may vote in elections for the selection of the organization's officers;

3. Only registered principal members are authorized to officially conduct business with the UCSD or University, e.g., calendar events, reserve facilities, access budget numbers or spend student organization funds. 4. The principle members shall provide a written statement stating that they are personally responsible for the organization's debts and all its other financial liabilities. If a principle member chooses not to accept this responsibility she/he must submit a written request to the Center for Student Involvement to be deleted as a principle member. 5. Faculty, staff, and community members may participate in the activities of registered UCSD student organizations. 6. The University or UCSD shall not prevent the organization from retaining or using independent legal counsel or from selecting an independent representative as provided for in any UCSD disciplinary or grievance procedure. 7. The organization shall meet at least once annually. f. A a statement stating that the assets of the student organization shall transfer to another student organization of the choice of the current members or to UCSD if no current members are present. 17.10.11.12C. Any Cchanges in theto the information required by above for registration must , must be reported to the Center for Student Involvement,be updated in the Student Organization Registration System within fifteen (15) academic business days offrom the date that the change occurred. B. Only registered UC San Diego students may hold office in a registered student organization and vote in elections for the selection of the organization's officers. C. Only principal members of registered student organizations that are currently registered and in good standing with the Center for Student Involvement are authorized to officially conduct business with the University (e.g., hosting events, reserving facilities, managing and spending organizational funds). Good standing means that the registered student organization has completed all registration requirements, is not under a current student conduct suspension, and/or has not been deregistered due to previous student conduct matters. D. By signing the Principal Member Agreement, principal members of a registered student organization agree to be personally responsible for the organization's debts and all other financial liabilities. If a principal member chooses not to accept this responsibility, he/she must request to be deleted as a principal member. E. To maintain status as a registered student organization, the organization is required to meet at least once each academic year.

17.10.11.13DF. A registered student organization lending its name, membership, property, or financial support to an activityfunction shall will be held responsible for the conduct of all its members and guests attending that functionactivity. The organization's officers or representatives listed on the event registration form are responsible for the planning and organization of all activitiesfunctions sponsored or co-sponsored by their organization. At least one officer and one other responsiblePrincipal Mmember must be in attendance at all activitiesfunctions sponsored or co-sponsored by their organizations.

III. NON-DISCRIMINATION STATEMENT In accordance with applicable Federal and State law and University policy, the University does not discriminate on the basis of race, color, national origin, religion, sex, gender identity, pregnancy, physical

or mental disability, medical condition (cancer related or genetic characteristics), ancestry, marital status, age, sexual orientation, citizenship, or service in the uniformed services. The University also prohibits sexual harassment. This nondiscrimination policy covers admission, access, and treatment in University programs and activities.

Principal members applying for status as a registered student organization must certify that the organization will not discriminate on the basis of race, color, national origin, religion, sex, gender identity, pregnancy, physical or mental disability, medical condition (cancer related or genetic characteristics), ancestry, marital status, age, sexual orientation, citizenship, or service in the uniformed services. This certification will override any contrary language in the organization's constitution, bylaws, or other documents. 17.10.11.14. Student organizational members who violate any standard of conduct are subject to disciplinary action which may include suspension or dismissal (See Section 22.00.).

17.10.11.15. The name, insignia, seal, or address of the University may not be used in any manner, which implies that the University supports or agrees with any of the activities, positions, purposes, ideals, or goals of any individuals, groups, or organizations acting within these regulations.

17.11IVI. Conduct and DisciplineSTUDENT CONDUCT AND DISCIPLINE: The UC San Diego Student Conduct Code applies to all rRegistered student organizations and other campus organizations. Section XIV of the Code describes the student conduct process for registered student and other campus organizations. Individual registered sStudent organizational members who violateviolating any standard of conduct aremay be subject to disciplinary student conduct action which may include suspension or dismissal. (Seeper the UC San Diego Student Conduct Code). Additionally, UC San Diego registered student organizations and individual student members are subject to state laws and University policies relating to hazing on or off the University’s campus. Section IV, Letter (K) of the UC San Diego Student Conduct Code describes the standard of conduct relating to hazing. may be denied registration or their current registration status may be revoked, or other sanctions may be applied, for misconduct as specified in , below. In such cases notice of the alleged violation and an opportunity for a hearing, at the request of the duly authorized officers of the organization, shall be given pursuant to the procedures contained in et.seq. of these regulations. Registered student organizations may also be denied registration, or their current registration status may be revoked, for failure to comply with administrative requirements not relating to alleged misconduct violations and such denials may be contested only pursuant to the Student Grievance Procedures set forth in these regulations at et.seq. 17.11.10. Jurisdiction: UCSD shall have jurisdiction over conduct of a UCSD registered student organization that occurs on or off UCSD/University property, or in connection with an official UCSD/University event or function whether on or off UCSD. Specifically, a student organization may be disciplined, including the termination of its association with UCSD as a registered student organization, if such conduct is found to have violated any of the standards of conduct referred to in and its sub-parts, below. 17.11.11.In determining whether or not to exercise off-campus jurisdiction, the designated UCSD official will consider the seriousness of the alleged misconduct; whether the alleged victim is a member of the UCSD community; the ability of the UCSD official to gather evidence, including the testimony of witnesses; and whether the off-campus conduct is part of a series of actions that occurred both on and off campus. 17.11.12. Whether on or off campus, all UCSD registered student organizations are required to comply with applicable University policies and UCSD regulations, including the standards of conduct listed below in this section. In some cases, the standards of conduct listed below may be

violated by one or more members of the registered student organization. The registered student organization may be held responsible for conduct engaged in by its members where it appears fair and reasonable to do so in light of the relevant facts. The following criteria should be considered in determining whether to hold the registered student organization responsible for the conduct of one or more of its members: i)how many members engaged in the conduct; ii)whether the conduct occurred at an event planned, implemented, sponsored, or otherwise sanctioned by the registered student organization; iii)what efforts were made by the registered student organization to avoid the occurrence of the conduct in question; iv) what actions were taken by the registered student organization in response to the conduct in question; v) the seriousness of the conduct in question; vi)whether members of the registered student organization have previously engaged in such conduct. The standards of conduct applicable to registered student organizations include:

a. All forms of academic misconduct, including but not limited to, cheating, fabrication, plagiarism, any form of bribery/attempted bribery or facilitating academic dishonesty as may be further specified in the UCSD Academic Senate Policy on Integrity of Scholarship.

b. Theft or other abuse of UCSD/University computing facilities, or computer time, including but not limited to: any violation of the Academic Computing Services (ACS) acceptable use policy; unauthorized entry into data to use, read, or change the contents or any other purpose; unauthorized transfer of data; unauthorized use of another individual's identification or password; use of computing facilities to interfere with the work of another student, faculty member, or UCSD or University Official; use of computing facilities to interfere with a UCSD or University Computing System.

c. Unauthorized entry to, possession of, receipt of, duplication of or use of the UCSD or University's name, insignia, or seal.

d. Unauthorized entry to, possession of, receipt of, or use of any UCSD or University properties, equipment, resources or services.

e. Physical assault or threat of violence or conduct that threatens the health or safety of any person.

f. Battery, defined as any unwanted touching, physical abuse, or fighting including but not limited to conduct that results in the injury of another.

g. Sex offenses committed by force or without consent, including but not limited to rape, sexual assault, or sexual battery.

h. Sex offenses committed without force or by consent, but in violation of law, including but not limited to statutory rape and incest.

i. Unlawful conduct of a sexual nature including but not limited to, indecent exposure, prostitution, voyeurism, or loitering for the purpose of soliciting or engaging in any lewd act.

j. Sexual harassment, as defined in the UCSD Sexual Harassment Policy, Appendix F including but not limited to: unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment when:

1. Submission to such conduct is made either explicitly or implicitly a term or condition of instruction, employment, or participation in a UCSD or University activity; or

2. Submission to or rejection of such conduct by an individual is used as a basis for evaluation in making academic or personal decisions affecting an individual; or

3. Such conduct has the effect of unreasonably interfering with an individual's performance or creating an intimidating, hostile, offensive UCSD or University working or learning environment.

4. Prior to applying the sexual harassment policy to any registered student organization conduct, UCSD officials must consult with the Director of Student Conduct.

k. Hazing or any method of initiation or pre-initiation into a UCSD organization, or any activity engaged in by the organization or members of the organization which causes, or is likely to cause, bodily danger, physical harm, or personal degradation or disgrace resulting in physical or mental harm to any student or any person.

l. Unlawful manufacture, distribution, dispensing, possession, use, or sale of, or the attempted manufacture, distribution, dispensing, possession, use, or sale of controlled substances, identified in federal and state law or regulations.

m. Manufacture, distribution, dispensing, possession, consumption, or sale of, or the attempted manufacture, distribution, dispensing, or sale of alcohol which is unlawful or otherwise prohibited, or not in compliance with, University policy or UCSD regulations.

n. Possession, use, storage, or manufacture, or attempted possession of fireworks.

o. Possession, use, storage, or manufacture, or attempted possession of explosives and/or explosive devices, firearms or other dangerous or destructive devices or deadly weapons.

p. Possession or use of a firearm or other weapon without the prior written approval from the UCSD Chief of Police.

q. Violation of the conditions contained in the terms of a disciplinary action imposed under these UCSD regulations.

r. Violation of the conditions contained in a written notice of emergency suspension issued pursuant to UCSD Policies and Procedures Applying to Student Activities, ; or

s. Violation of orders issued pursuant to UCSD Policies and Procedures Applying to Student Activities, ; during a declared state of emergency.

t. Selling or distributing course notes, (whether taken by students or others), or information provided by an instructor such as, but not limited to handouts and readers, or using such materials for commercial purposes without the explicit permission of the instructor and without compliance with other applicable University regulations and policies.

17.12IVII. USE OF UNIVERSITY NAME, SEAL, AND INSIGNIA, Seal : A registered student organization shall will not use the name of the University of California, University of California, San Diego, or related abbreviations thereof as a part of its own name except in accordance with University policies and UCSD regulations.

17.12.10A. Permission Authorization to use the University’s name, seal or insignia of the University of California, San Diego, or any related abbreviation thereof as part of a registered student organization's name may be granted only by the Chancellor or his/her designee.

B. 17.12.11B. AuthorizationPermission, when granted from the Chancellor or his/her designee , does not expressly or by implication impart (expressly or by implication) any endorsement or sponsorship by the University; in appropriate circumstances, permission may be made conditional upon a requirement of an express statement that UCSD or the University does not endorse or sponsor a particular activity.. Therefore, registered student organizations using University property or services must avoid any unauthorized implication that they are sponsored, endorsed, or favored by the University.

C. The Chancellor or his/her designee may make authorization conditional upon a requirement of an express statement that the University does not endorse or sponsor a particular activity. Authorization may be withdrawn by the Chancellor or his/her designee at any time and will be communicated to the organization in writing. D. The geographical designation "at UCSD" or “at UC San Diego” may be used by any registered student or other campus organization as part of its name without obtaining approval from the Chancellor of his/her designee.(PPM 510-10, Section IV, D3)

17.12.12C. Permission to use the name of the University of California, San Diego, may be withdrawn by the Chancellor, or designee, at any time.

17.12.13DE. Registered student organization use of the University name, seal, and insignia may not be used in any manner implying that the University supports or agrees with any of the activities, positions, purposes, ideals, or goals of any individuals, groups, or organizations acting within University policy. The geographical designation "at UCSD" may be used by any student organization as part of its name without obtaining special approval. E. The name, insignia, seal, or address of the University may not be used in any manner, which implies that the University supports or agrees with any of the activities, positions, purposes, ideals, or goals of any individuals, groups, or organizations acting within these regulations.

F. 17.13IV. Use of University Properties

: All use of University properties and services by registered student organizations must conform tomust follow the Use of University Properties policy of these regulations. G. Receipt of University funding does not expressly or by implication impart any endorsement or sponsorship by the University.

VI17.14. FISCALscal ACCOUNTABILITY : The Chancellor or his/her designee may investigate, , through audits or other means, , and take action to ensure that the fiscal activities of registered student organizations on Campus and their or useing of University properties comply withfollow applicable legal requirements and , University policies, and UCSD regulations and procedures applicable to such practices. 17.15VI. University Sponsorship : As provided in of these Policiesabove, registered student organizations using University property or services must avoid any unauthorized implication that they are sponsored, endorsed, or favored by the University.

20.00 Student Governments  To Bottom 20.10I. AUTHORIZED STUDENT GOVERNMENTS 20.10.10 A. The Chancellor may authorize or discontinue student governments as official units of the University of California, San Diego responsible for representing student constituencies comprising either the student body as a whole or a particular segment of it. The Chancellor may also assign to such student governments specific powers and other responsibilities concerning student affairs.

20.10.11B. Student governments may be supported by either compulsory or voluntary fees. Fees established to support a student government must comply with the requirements set forth in Sections 18.00. et seq., abovethe UC San Diego Voluntary Student Contributions and Compulsory Student Fees Policy , and they must be approved by the chancellor, except that no compulsory fee shall be effective until approved by the Regents. 20.11II. STUDENT GOVERNMENT RIGHT TO ADDRESS PUBLIC ISSUES : Student governments shall have the right to address and take positions on public issues, as consideration of such matters serves the University's and UCSD's educational purposes. Positions on issues taken by student governments shall not be represented as or deemed to be official positions of the University or UCSD. Except for authorized lobbying on student-related issues, no compulsory student government fees shall be expended in support of such positions. This does not affect the right of any student, as an individual, to petition governmental officials or bodies. 20.12III. DELEGATION OF FISCAL AUTHORITY TO ASSOCIATED STUDENTS OF THE UNIVERSITY OF CALIFORNIA, SAN DIEGO, AND GRADUATE STUDENT ASSOCIATION : The Chancellor is responsible for the fiscal soundness of student governments. In the discharge of this responsibility, the Chancellor may make audits of the finances of student governments, exercise control over expenditures of their funds when and to the extent necessary to maintain financial solvency of student governments, and where necessary may take action to ensure that any activity under the control of student governments is operated in accordance with sound business practices consonant with University and UCSD policies and procedures applicable to such practices.

20.12.10A. Compulsory UCSD based fees and other UCSD funds may be expended by ASUCSD and GSAUCSD only for programs and purposes directly related to the University and for the beneficial interests of the UCSD Student Body. 20.12.11B. Expenditures shall not be in violation of the law and shall be consistent with University or UCSD policies and UCSD regulations. 20.12.12C. Funds may not be expended either directly or indirectly for political purposes or for the purpose of encouraging the establishment of religion except as noted in the UC San Diego Voluntary Student Contributions and Compulsory Student Fees Policy. Section 18.13 above.

20.12.13D. In the expenditure of University/UCSD funds, ASUCSD and GSAUCSD will follow accepted business and accounting practices and methods of accountability approved by the Vice Chancellor for Business Affairs. This should include a periodic audit for ASUCSD's and GSAUCSD's financial activities. Also, policies governing employees of ASUCSD or GSAUCSD

should be developed in consultation with the UCSD Personnel Office and should be keeping with the University regulations governing other University employees. 20.12.14E. In following these guidelines, the ASUCSD and GSAUCSD are required to secure the approval of the Vice Chancellor for Student Affairs prior to the expenditure of any funds when there is reasonable doubt as to whether such expenditures conform to the guidelines set forth in Sections 20.12.10 through 13, abovethis section.

20.13IV. Student Reciprocity Privileges : A student registered for a current term on any University campus shall be entitled to basic outpatient health care services on another University campus, under conditions that apply to students registered on that campus.

24.00 Student Participation in UCSD Governance 24.10. Policy: As members of the UCSD San Diego community, students have a substantial interest in the governance of UCSD and the University. Their participation has increased significantly in the last decades, and UCSD and the University community hasve benefited from it. It is the intent of this Policy to reaffirm UCSD's and the University's commitment to the principle of student involvement in governance in both administrative and academic areas and to state the primary purposes and goals of that involvement. This commitment is based on the premise that student participation is vital to a vigorous intellectual exchange and the furtherance of the University’s education and research objectives. The overall goal is of UCSD and the University and appropriate, effective, and productive student involvement, consistent with the development of policies that reflect the total needs of UCSD and the University, is the goal. 24.11. Student Role in UCSD Governance: The governance of UCSD the University involves more than the process of making decisions. The process of governance provides a forum for group interaction, expression of concerns, exploration of feasible solutions, and reconciliation of diverse viewpoints. Within this context, student participation serves several functions. such as; 24.11.10.First, it is important to the sound development of policy. Student views and advice, often from special perspectives, provide for more informed UCSD and University decision making. Participation should be encouraged and strengthened through the involvement of all levels of student representation. 24.11.11.Second, tThere is a recognition that students have a vital interest in decisions directly related to policies and programs affecting their academic and non-academic experience at UCSD and the University. Clear procedures are required to ensure that students are afforded access to needed information, an opportunity to share ideas, and encouragement to express concerns, both formally and informally. 24.11.12. Third, sStudent participation is crucial to ensure that student viewpoints are considered on issues of importance to UCSD and the University community. This communication provides opportunities for testing assumptions, for understanding the attitudes of others, for sharing information, and for developing understanding and mutual trust among constituencies. The special nature of UCSD and the University requires a sense of community. While every decision may not be wholly satisfactory to all parties, the governance process should provide a forum for candid discussion. 24.12. Extent, Quality, and Effectiveness of Student Participation: Efforts should continue to be directed toward improving not only the extent but also the quality and effectiveness of student involvement. To these ends, UCSD and the University must work to achieve several goals. , such as; 24.12.10.First, t The processes central to student involvement, including the selection, training, and continuity of student participants, need to be clearly understood by all members of the UCSD UC San Diego community and periodically reexamined. Care should be taken, in particular, that the process of reaching decisions in UCSD campus governance is openly communicated and well understood. 24.12.11.Second, bBuilding on existing mechanisms, means for student participation in administrative and academic areas should be developed and implemented at UCSDUC San Diego and the University of California Office of the President. I; it is important that a variety of ways be provided to ensure that UCSD and the University gains full benefit from student participation in those areas. 24.12.12.Third, aAreas where students are not now participating need to be examined. In this regard, ways should be sought to enhance student involvement in academic departments, where important decisions that affect students are made. 24.13. Achievement of Goals: In order to achieve these goals, UCSD UC San Diego has developed a plan for student participation. Essential to the success of the plan is a periodic review of the procedures

used by UCSD campus academic and administrative departments, student governments, and other student organizations, and an evaluation of progress toward implementation of the plan. This review process should involve broad consultation with the UCSD campus community, including formal consultation with student governments and the Academic Senate. 24.14. Access to Campus Plan: Campus plans for student participation in institutional governance should be made readily available for review. Matters which have been delegated by The Regents to the Academic Senate are beyond the scope of the UCSD campus plan, but direct discussions between students and the Academic Senate on student participation in the deliberations of the Senate should continue.
