B:BranchandConstituencyAssociationRules

StatusandAuthority B.1.1ThebasicunitsofthePartyaretheConstituencyAssociationsandBranches,establishedunderArticle3.6oftheConstitutionoftheUKIndependenceParty.TheyshallupholdtheprinciplesoftheConstitutionandareresponsibletotheNationalExecutiveCommitteeviathePartyChairmanorhisdelegatewhowillnormallybetheRegionalOrganiser.B.1.2AConstituencyOrganisationorBranchmayexistonlyifauthorisedbytheNationalExecutiveCommittee.NoConstituencyAssociationorBranchmaybeestablishedwithoutthewrittenconsentofthePartyChairman,onbehalfoftheNEC.B.1.3AConstituencyAssociationconsistsofoneentireparliamentaryconstituencyanditshallbearthatname.B.1.4ABranchconsistsofmorethanoneparliamentaryconstituencyandshallincludetheparliamentaryconstituenciesconcernedintheirentirety.Itshallhaveanappropriategeographicalname.TheNECmayatitsdiscretionpermittheformationofbranchesfromgeographicalareasotherthanParliamentaryconstituencies.B.1.5TheprimaryfunctionsofConstituencyAssociationsandBranchesaretoselectandsupportcandidatesforlocal,ParliamentaryandotherkindsofelectionsinaccordancewiththeseRulesofProcedure,recruitnewmembers,raisefundsandgenerallytopromotethePartyanditspolicies.B.1.6.1Inaccordancewiththeparty’saimtohaveConstituencyAssociationsinallparliamentaryconstituencies,branchescoveringmorethanoneconstituencyareencouragedtosplitwhenbranchmembershipbecomessufficientlylarge.B.1.6.2AbranchwishingtosplitmusthavetheapprovaloftheBranchCommitteeandtheRegionalOrganiser,andmustalsohavethewrittenconsentofthePartyChairman,onbehalfoftheNEC.WhereaCountyCommitteeexists,itmustbekeptinformedofthechange.B.1.7Branchesshallco-operatewithanyRegionalCommitteeandCountyCommitteecoveringtheirarea.B.1.8ConstituencyAssociationsandBranchesshallbothbemanagedundertheserulesandbotharehereinafterreferredtoasBranches.B.1.9BranchMeetingsshallbeheldinaccordancewiththe‘StandingOrdersfortheconductofInternalPartyMeetings’.

B.1.10OfficersofallbranchesandconstituencyassociationsshallcompletetheParty’s

DataProtectionformsandotherdocumentationasrequiredbyHeadOfficetoensuresmoothfunctioningoftheParty’sinternalprocedures.

Membership B.2.1AllPartymembersaremembersofthebranchinwhichtheyliveandshallbeentitledtoparticipateinitsactivities.WhereamemberislivingintheUKandregisteredtovoteinonelocation,forthepurposesofthisRuletheirresidenceshallbetakenastheaddressatwhichtheyareontheelectoralregister.B.2.2TheaffairsofmemberswholiveinaparliamentaryconstituencywithnoestablishedbranchshallbeadministeredbythePartyChairmanorhisdelegate.B.2.3.1Partymembersmay,onrequest,becomeamemberofanotherbranch,subjecttotheagreementofthereceivingbranchcommittee.Onmovingbranches,themembershallhavefullvotingrightsinthenewbranchandceasetobeamemberoftheirpreviousbranch.B.2.3.2Shouldthereceivingbranchcommitteewithdrawtheirconsent,themembershallbeentitledtoreverttomembershipoftheirbranchofresidency.B.2.4APartymembermayserveononlyonebranchcommitteeatatime.

B.2.5WhereaBranchcollectsamembershipfeefromanewmember,itshallbeentitledtoretainthefirstyear’ssubscriptionsonlyfromthoseresidingwithinthegeographicalareacoveredbythebranch.Wherethemoneyiscollectednationally,andwheremembershipisrenewed,themoneyshallbekeptbythenationalParty.

BranchCommittees

B.3.1Branchesareresponsiblefortheirownactionsandfinancialaffairs.

B.3.2.1TheChairman,SecretaryandTreasurershallbemembersofthebranchcommittee.ThenumberofCommitteememberstobeelectedshallbedeterminedbytheAGM,subjecttoamaximumofeightmembersintotal.

B.3.2.2NoformermemberofaPartyororganisationontheproscribedlistshallbepermittedtoholdofficeonabranchcommittee,ortoholdanyotherformalofficewithintheParty.

B.3.2.3NocurrentmemberofanyotherPartyshallbepermittedtoholdofficeonabranchcommittee,ortoholdanyotherformalofficewithintheParty.ThePartyChairmanmaypermitanexceptiontoB.3.2.3wherehebelievesittobeintheParty’sstrategicintereststodoso.

B.3.3Thethreeprincipalbranchofficers,Chairman,TreasurerandSecretaryshallallbecommitteemembers.Furtherofficersmaybeelectedtofulfilotherposts.Ifonlytwomembersareelectedtothecommittee,theyshallbeChairmanandTreasurerandoneoftheseshallalsobenamedasSecretary.

B.3.4Thebranchofficersandothercommitteemembersshallbeelectedatthebranch’sAnnualGeneralMeeting(AGM)byballotofmembersattending.TheirtermofofficeshallrunfromtheAGMwhenelecteduntilthenextAGM.TheprincipalofficersshallberequiredtocompleteandreturnaPartyOfficer’sDeclarationform.SectionQoftheseRulesofProcedureshallnotapplytotheelectionofofficers.B.3.5AllmembersingoodstandingareeligibletostandforelectiontothebranchCommitteeoftheirbranch.'Ingoodstanding'isdefinedunderI.8below.ForthesepurposesmembersarebranchmemberseitherthroughB.2.1orB.2.3above.B.3.5.2.AbranchcommitteemayacceptnominationsfrommembersofotherbranchestostandforelectiontothebranchCommitteeoftheirbranchiftheyagreetothosenominationsbyamajority.B.3.6Membersoflessthantwelvemonths’standingmustbeproposedandsecondedbythosewhohavebeenPartymembersformorethantwelvemonths.ThePartyChairmanshallhavethepowertovetotheelectionofanymemberoflessthantwelvemonths’standing,within21calendardaysoftheAGM.

B.3.7Theelectedcommitteeshallhavethepowertoco-optotherbranchmembersforspecificpurposeswhosetermshallendatthenextAGMandwhosevotingrightsshallbedeterminedbytheelectedcommittee.

DutiesofBranchOfficers B.3.8.1TheChairmanhasprincipalresponsibilityforthedirectionofthebranchandshallnormallychairallmeetingsincludingtheAGMandshallenjoyfullvotingrights.TheChairmanshallnormallycallmeetingsofthecommittee(andmeetingsofthewholebranchasdefinedinB.4.4)butasimplemajorityofcommitteemembersmaycallacommitteemeetingintheeventthattheChairmanisunableorunwillingtodoso.B.3.8.2Aduly-constitutedbranchmayholdabankaccount.TheTreasurershallberesponsibleformanagingthebranchfinancesandbankaccount.AllbranchesareAccountingUnitsforthepurposesofthePoliticalPartiesElectionsandReferendumsAct2000(PPERA2000)andtheTreasurerisresponsibleforcompliance,inparticularthereportingofdonationstoHeadOfficeandthepreparationandsubmissionofBranchAccounts,accordingtoguidancefromthePartyTreasurer.B.3.8.3Bankaccountsshouldhaveatleastthreesignatories,withanytwosignatoriesbeingrequiredtodrawuponbranchfunds.SignatoriestothebankaccountshouldnormallybeCommitteemembers.Accountswithjusttwosignatoriesshallbepermittedonlyinextremis,orwhentherearejusttwomembersonaCommittee.Branchesmaypermitelectronicbankingtobeundertakenbyasolenamedindividualbutshallensurethatappropriatefinancialreportsarereceivedateachmeeting.

B.3.8.4TheSecretaryshallnormallyberesponsibleforthegeneraladministrationoftheCommittee,includingtakingminutesofmeetings,maintainingarecordofthebranch’spartymembersandadvisingHeadOfficeofchanges.ThesecretaryshallalsoadviseHeadOfficeofanychangestotheofficersandthebranchregistrationdetailsandisresponsibleforcompliancewithE.14oftheseRulesofProcedure.B.3.9Onlymemberswhoarebranchofficers,orwhohavetheexpresspermissionoftheCommittee,shallbeauthorisedtorepresentthelocalpartyormakeuseofpartylogos.Unauthoriseduseofthepartynameorlogomaybeconsideredtobebringingthepartyintopublicdisreputeandthereforegroundsfordisciplinaryaction.B.3.10Intheeventthatabranchofficerresignsorisotherwiseunabletocontinueintherole,apermanentreplacementmayonlybeselectedbyageneralmeetingofthebranchwith21days’notice.AnactingreplacementmaybechosenbythebranchcommitteetocontinuewiththeroleuntilthefollowingAGM.B.3.11UpondisbandmentofanyBranch,thefinancialreservesandotherassetsshallbetransferredtothenationalpartyviathenationalPartyTreasurer.B.3.12WhereabranchofficialisseriouslyfailingintheirdutiesunderB.1.5andB.3.8.1toB.3.8.3,andeffortstodealwiththesituationhavenotresultedinimprovedperformance,theNationalExecutiveCommitteemayasalastresortremovefromofficeabranchcommitteemember.B.3.13BranchesmustcontacttheirRegionalOrganiseriftheywishtoselectasabranchcommitteememberanyonewithseriouscriminalconvictions(tobedefinedashavingbeenconvictedofanoffenceforwhichthemaximumsentenceisaprisonsentenceof12monthsorgreaterorforwhichanycustodialsentencewasimposed).TheRegionalOrganisermayaccepttheappointment,rejecttheappointmentorreferthemattertotheNEC.IftheRegionalOrganiserrejectstheappointmentthereshallbearightofappealtotheNEC.B.3.14Whereabranchcommitteememberisconvictedofacriminaloffencewhilstaservingofficial,themembermustnotifythePartySecretaryandtheGeneralSecretary.WheretheParty’sreputationcouldbeaffected,themattershallbereferredtothePartyChairmanwhomaysuspendthecommitteememberfromofficependinganNECdecisionconcerningremovalfromoffice.B.3.15FailuretodiscloseinformationunderB.3.13orB.3.14maybegroundsfordisciplinaryaction.B.3.16WhereavoteatageneralBranchmeetingoronaBranchCommitteeistied,thefollowingprinciplesshallbeusedtoresolvethetie:a)Thebranchcommitteeshouldcontinuetodiscussthematter,seekaconsensusorcompromisewherepossible,andthenre-vote.b)Ifsuchacompromisecannotbereached,whereverpossible,theBranchChairmanmustusetheirsecondorcastingvotetomaintainthestatusquo.

c)Ifthemattertobevotedondoesnotpermitthestatusquotocontinueandisachoicebetweenthreeormoreoptions,orbetweenthreeormorecandidatesforaposition,thenthevoteshallberepeatedwithonlythetoptwochoicesavailable.d)Ifthevoteremainstied,andanyco-optedmembershavevotingrightsontheBranchCommittee,thenthevoteshallberepeatedwithonlythosememberselectedbyaGeneralMeetingofthebranchentitledtovote.e)Ifthetiestillcannotbebroken,themattershouldifpossiblebedeferredtothenextmeeting.f)Ifthemattercannotbesodeferred,orifthedeadlockpersistsintoasecondmeeting,thenacointossorotherrandommethodmaybeusedtodeterminehowtheChairman’ssecondorcastingvoteshouldbeused.

BranchandCommitteeMeetings B.4.1.1Branchcommitteesshallnormallymeetatleastsixtimesperannumwithsufficientflexibilitytocopewithemergenciessuchasthesuddencallingofanelection.B.4.1.2Halfofthecommitteemembers,includingtwooftheChairman,SecretaryandTreasurer,shallconstituteaquorum.Thenormalnoticeperiodis7days.

B.4.1.3TheRegionalOrganiserandRegionalChairmancoveringthebranch,andanyofficerlistedunderC.3.9below,shallhavetherighttoattendanyBranchorCommitteemeeting.

AnnualGeneralMeeting B.4.2.1BranchAGMsshallbeheldannuallybetweenOctober1standDecember31st.Ageneralmeetingofthebranchmustbeheldduringthefollowingquartertoapprovetheannualaccounts.ThisRuleshallcomeintoforceonSeptember2017.B.4.2.221days’noticeoftheAGMshallbegivenandthenoticeshallinvitenominationsfortheelectionofcommitteeofficersandmotionsforthemeeting.Nominationsshallrequireaproposerandseconder,andcandidatesmaybenominatedeitherinwritinginadvanceofthemeeting,orinpersonatthemeeting.B.4.2.3AnymotionsfortheAGMmustbesubmittedinadvanceandmustbeconsistentwiththeprinciplesandConstitutionoftheParty.B.4.2.4ThebusinessoftheAGMshallinclude:(i)ApprovaloftheminutesofthepreviousAGM;(ii)Receivingreportsfromthechairmanandsecretary;(iii)ReceivingtheTreasurer’sStatementofAccountsforthepreviousyear;(iv)Electionofthebranchcommitteemembersandofficersforthefollowingyear;

(v)Transactingsuchotherbusinessasmaybebroughtbeforeit.B.4.3Anextraordinarygeneralmeeting(EGM)ofthebranchshallbeheldwhencalledforaspecificpurposebythebranchcommittee,bythePartyChairmanorbythewrittenrequesttothebranchchairmanorsecretaryof25%ofbranchmembersingoodstanding.AnEGMmustbeheldwithin6weeksofbeingvalidlycalledand21days’noticetoallbranchmembersmustbegiven.B.4.4Ordinarymeetingsofthewholebranchmaybeconvenedasthoughtfitbythecommitteeandmaytypicallybecombinedwithcampaigningorotheractivities.B.4.5TheAnnualGeneralMeetingshouldbeheldatanappropriatevenuewithinthegeographicalareacoveredbythebranch.Thisshouldnotbeamember’sprivateresidence,butratheravenueinwhichapublicmeetingcouldreasonablybeheld.B.4.6TheAGMshallbeopenonlytopaid-upmembersoftheParty.B.4.7TheagendaforanExtraordinaryGeneralMeetingshallberestrictedtothebusinessforwhichitwascalledandmattersarisingbutvotescanonlybetakenonmatterontheagenda.Attendeesshallberestrictedtopaid-upmembersfromthebranchforwhichtheExtraordinaryGeneralMeetinghasbeencalledunlesstheyaretheindependentandimpartialpersoncitedinB.4.9oraPartyofficialmentionedinB.4.1.3.B.4.8AnExtraordinaryGeneralMeetingshouldbeheldatanappropriatevenuewithinthegeographicalareacoveredbythebranch.Thisshouldnotbeamember’sprivateresidence,butratheravenueinwhichapublicmeetingcouldreasonablybeheld.B.4.9AnExtraordinaryGeneralMeetingshouldbechairedbyanindependentandimpartialchairman.ThiswillnormallybeeithertheRegionalChairmanortheRegionalOrganiserintheregionconcerned,butinexceptionalcircumstancesanExtraordinaryGeneralMeetingmaybechairedbyanNECmemberornationalPartyofficial.

B.4.10WhereanExtraordinaryGeneralMeetingresolvestoremovebranchofficer(s)fromtheirpositions,itshallproceedtofillthevacancywithanimmediateelectioninaccordancewiththeRulesofProcedure,inparticularobservingtherequirementsofB.3.5,B.3.6andB.3.7.

(d)InsuchotheractivitiesasmayfromtimetotimebeidentifiedbytheNECordesignatedsub-committeeoftheNEC.C.2.2EachRegionalCommitteeshallregularlyinformandotherwiseupdatetheconstituencyassociationsorbrancheswithinitsregionofitsactivitiesandundertakings.

C.2.3EachRegionalCommitteemaydelegatetasksinC.2.1andC.2.2abovetotheCountyCommitteescontainedwithinit.

Membership C.3.1ARegionalCommitteeshallnormallybecomprisedofonerepresentativeandonealternatefromeachcountywithintheregion.ForthepurposesoftheseRules,eachofthelargesttencitiesintheUKbypopulation(exceptingLondon,whichisconsideredbelow)shallbeconsideredtohavethesamestatusasacounty.ThesearecurrentlyBirmingham,(Greater)Manchester,Leeds,Glasgow,Sheffield,Bradford,Edinburgh,LiverpoolandBristol.C.3.2WheretheregionalgeographyorthedistributionofmemberswithincountieswouldrendercompositionaccordingtoC.3.1unsuitable,theNECmaypermittheappointmentofrepresentativesandalternatesfromregionalsubdivisionsotherthancountiesoritmaypermitmorethanonerepresentativeandalternatepercounty.TheNECmay,atitsdiscretionandatanytime,revokeitspermissionforanysucharrangement.C.3.3Therepresentativeandalternateforeachcountyorotherregionalsubdivisionarebothmembersoftheregionalcommittee.However,iftherepresentativeispresentatameeting,thealternatewouldnotgenerallybeexpectedtoattend.Thealternatemayonlyvoteintheabsenceoftherepresentative.C.3.4OnlyPartymembersingoodstandingintheregioninquestionareentitledtobemembersofaRegionalCommittee.‘Ingoodstanding’isdefinedunderI.8below.RuleB.3.6shallapply,mutatismutandis,toRegionalCommittees.C.3.5PartymemberswillnormallybeeligibletoserveasmembersofaRegionalCommitteeintheregioninwhichtheynormallyreside,andinwhichtheirpartymembershipisregistered.PartymemberswhohaveresidentialorbusinessaddressesinmorethanoneregionmaybeamemberoftheRegionalCommitteeinanyoftheregionsinwhichtheyhavearesidentialorbusinessaddress,buttheymaynotserveonmorethanoneRegionalCommittee.C.3.6Anypersonwhoisprovidingservicesonaremuneratedbasis(whetheremployed,self-employedorotherwise)tothePartyoranyofitselectedrepresentatives,shallnotbeeligibletobeavotingmemberofaCountyorRegionalCommittee.C.3.7Thefollowingpeopleshallbenon-votingmembersoftheRegionalCommittee:(a)AnyelectedUKIPmemberofParliament(MP),AssemblyMember,MSPormemberoftheEuropeanParliament(MEP)withintheregion;

(b)AnyUKIPPoliceCommissionerormemberoftheScottishParliament,WelshAssembly,NorthernIrelandAssemblyorGreaterLondonAuthority,and(c)TheRegionalOrganiserappointedbythePartyChairmanC.3.8WhenregionallistsofcandidateshavebeenselectedaheadofaEuropeanelection,allmembersoftheregionallistshallbecomenon-votingmembersofthecommittee.IftheyarealreadyelectedmembersofthecommitteeaccordingtoparagraphC.3.1orC.3.2,theirvotesshallpasstotheiralternates.C.3.9ThePartyLeader,PartyChairman,PartyTreasurer,PartySecretary,GeneralSecretaryandmembersoftheNECshallbeentitledtoattendanyRegionalCommitteeorCountyCommitteemeetingbutmaynotvoteunlesstheyarealreadyelectedtothecommitteeandarenotprohibitedunderC.3.6above.C3.10NoformermemberofapartyororganisationontheproscribedlistshallbepermittedtobeelectedtoortoholdofficeonaCountyorRegionalCommittee,ortoattendaCountyorRegionalCommitteemeetinginanycapacity.C.3.11NocurrentmemberofanotherPartyshallbepermittedtobeelectedtoorholdofficeonaCountyorRegionalCommittee,ortoattendaCountyorRegionalCommitteemeetinginanycapacity.ThePartyChairmanmaypermitanexceptiontoC.3.11wherehebelievesittobeintheParty’sstrategicintereststodoso.C.3.12RegionalandCountyCommitteesmustcontacttheirRegionalOrganiseriftheywishtoselectasacommitteememberanyonewithseriouscriminalconvictions(tobedefinedashavingbeenconvictedofanoffenceforwhichthemaximumsentenceisaprisonsentenceof12monthsorgreaterorforwhichanycustodialsentencewasimposed).TheRegionalOrganisermayaccepttheappointment,rejecttheappointmentorreferthemattertotheNEC. If the Regional Organiser rejects the appointment there shall be a right of appeal to the NEC. C.3.13WhereaRegionalorCountycommitteememberisconvictedofacriminaloffencewhilstaservingofficial,themembermustnotifythePartySecretaryandtheGeneralSecretary.WheretheParty’sreputationcouldbeaffected,themattershallbereferredtothePartyChairmanwhomaysuspendthecommitteememberfromofficependinganNECdecisionconcerningremovalfromoffice.

C.3.14FailuretodiscloseinformationunderC.3.12orC.3.13maybegroundsfordisciplinaryaction.

TermofOffice C.4.1TheRegionalCommitteeshallbeastandingcommitteecomprisedofrepresentativeselectedaccordingtotheproceduressetoutinparagraphsC.3.1andC.3.2.ThoserepresentativesshallbeelectedannuallyinadvanceoftheAGMandshallnormallyserveatermofofficenotexceeding15monthsbeforere-electionataproperlyconstitutedCountyMeeting.C.4.2ItsChairmanandotherofficersshallbeelectedbyasimplemajorityatits

OperationofRegionalCommittees C.5.1TheelectionorappointmentofallofficersofaRegionalCommitteeshalltakeplaceasascheduleditemontheRegionalCommitteemeetingagendawhichmustbepublishedbeforehand.C.5.2EachRegionalCommitteeshallselectaChairman,SecretaryandTreasurerfromamongstthevotingmembersofthecommitteeasperC.4.2above.C.5.3ByvariationofparagraphC.5.2,theSecretaryandTreasurermaybeco-optedfromoutsidetheelectedcommitteebutsuchappointmentsdonotcarryvotingrights.C.5.4Allofficesshallbeheldsingly.C.5.5 Each Regional Committee may co-opt additional non-voting members to fulfill specific functions. agenda.TheSecretaryshallberesponsibleforcompliancewithE.14oftheseRulesofProcedure.C.5.11RegionalCommitteemembersshallsubmititemsforinclusionontheagendatotheSecretaryatleasttendaysbeforethenextscheduledmeeting.TheseitemsshallbeincludedsubjecttotheapprovaloftheRegionalCommitteeChairman.C.5.12Theagendashallbeapprovedandemergencyitemsadmittedbymajorityvoteatthestartofeachscheduledmeeting.C.5.13ARegionalCommitteeChairmanmay,withamajorityvoteofmemberspresent,requestthatanymemberactinginadisruptivemannerleaveameeting.ThemattershallthenbereferredtothenextmeetingoftheRegionalCommitteewhowilldecidewhetherthememberconcernedshouldbesuspendedfromPartyactivities.C.5.14TherewillbearightofappealtotheNECagainstanysuspensionfromPartyactivitiesunderC.5.13.AnysuchappealshouldbemadeinwritingtotheGeneralSecretary.Theappellantwillbegiventheopportunitytopresenthis/hercasetotheNEC,asshalltheRegionalCommitteeChairman.C.5.15TheStandingOrdersfortheconductofinternalPartymeetingsshallapplytoRegionalCommitteemeetings.C.5.16 In the event of substantial breach of these rules, the National Executive Committee may suspend or disband any Regional Committee, and require the committee to be selected again. C.5.17Regionalbankaccountsshouldhaveatleastthreesignatories,withanytwosignatoriesbeingrequiredtodrawuponbranchfunds.SignatoriestothebankaccountshouldnormallybeCommitteemembers.Accountswithjusttwosignatoriesshallbepermittedonlyinextremis.RegionalCommitteesmaypermitelectronicbankingtobeundertakenbyasolenamedindividualbutshallensurethatappropriatefinancialreportsarereceivedateachmeeting.C.5.18InstancesmayarisewhendifferenceswithinaRegionalCommitteethreatenitsproperfunctioning.Everyeffortshallbemadetoresolvetheseatregionallevel,firstlyinformallybytheRegionalOrganiser,andifthisdoesnotsucceed,ataRegionalCommitteemeeting.C.5.19Ifthedisputeremainsirreconcilable,thePartyChairmanshallappointaRegionalOrganiserfromadifferentregiontoinvestigatethesituation,andseektonegotiatearesolution.Ifthisstilldoesnotsucceed,andifthePartyChairmandeemsthatthebehaviourofthecommitteeoritsofficersisinconsistentwiththeParty’sConstitutionorprinciples,theRegionalOrganiserappointedtoinvestigate(afterconsultingwith,andwiththewrittenpermissionof,thePartyChairman)maysuspendordissolvetheRegionalCommittee,suspendorremoveaRegionalCommitteemember,orsuspendamemberfromPartyactivities.

CountyMeetings C.6.1EachCounty,orotherapprovedsub-divisionasdefinedunderC.3.1andC.3.2,willelecttheirrepresentativestotheRegionalCommitteeatanannualmeetingheldin

advanceoftheAnnualGeneralMeeting.C.6.2ThedelegatesataCountyMeetingshallbetheChairmenoftheproperlyconstitutedBranchesandConstituencyAssociationswithintheCounty(orapprovedsub-division).ABranchorConstituencyAssociationChairmanmaysendanalternate,withtheapprovaloftheBranchorConstituencyAssociationCommittee.C.6.3NoformermemberofapartyororganisationontheproscribedlistshallbepermittedtoattendaCountymeetinginanycapacity.C.6.4ThedelegatesataCountymeetingasdefinedunderC.6.2maymeetmoreoftenthanannuallyasaCountyCommitteeinordertodiscussissuesofmutualinterest,sharebestpractice,co-operateonoperationalandcampaigningmattersandprovidesupporttoeachother.C.6.5ThequorumforaCountymeetingasdefinedunderC.6.2shallbetwo-thirdsofthedelegates.C.6.6TheresponsibilitiesofaCountyCommitteeshallbe:(a)ToelectdelegatestotheRegionalCommittee;(b)ToenhancecommunicationbetweenthebranchesandtheRegionalParty; (c) To assist the Regional Committee with local planning including by providing up-to-date lists of selected candidates for local government elections and by-elections, and (d) To undertake such tasks as may be delegated to the County Committee by the relevant Regional Committee. C.6.7 County Committees, where formed, may be accounting units and shall not hold funds. The Secretary of a County Committee shall be responsible for compliance with E.14 of these Rules of Procedure. C.6.8 Rules B.7.1 through B.7.5 shall apply, mutatismutandis,toCountyCommittees.

C.6.9 Only members in good standing may serve on a County Committee. Rule B.3.6 shall apply, mutatis mutandis, to County Committees.

I:Termsandconditionsofmembership I.1Membershipshallstartfromthedateofreceiptoftheinitialmembershipsubscriptionandcontinueforthenumberofyearsforwhichthesubscriptionhasbeenpaid.I.2Membershipsubscriptionsarenotnormallyrefundable.I.3Membersshallbeconsideredtobefullypaid-upuntiltheendofthemonthofexpiry.I.4ThePartymayrefuseorrescindanapplicationformembershipiftheNationalExecutiveCommitteeconsidersthattheapplicationdoesnotfulfilthecriteriaformembershipassetoutinthePartyConstitution.I.5ThePartySecretaryhastherighttosuspendorexpelmemberswhoclearlybringthePartyintodisreputebyassociationwithormembershipofanorganisation,membershipofwhichtheNEChasdeclaredtobeincompatiblewithmembershipofthePartyorestablishagroupinoppositiontoanofficialUKIPgroup.I.6MembershipisnotavailabletoanyonewhoisorhaspreviouslybeenamemberoftheBritishNationalParty,theNationalFront,theUKFirstparty,theEnglishDefenceLeague,theBritishFreedomParty,BritishPeople’sPartyandtheBritainFirstParty(oranyotherpartiesororganisationslateraddedtotheproscribedlist).Anyapplicationsmadefrompeoplewhoareorhavebeenmembersoftheseorganisationswillberefused,andanysubscriptionscollectedwillberefunded.Bymakinganapplicationformembership,theapplicantcertifiesthatheisnotandhasneverbeenamemberofeitheroftheseparties.I.7AnyactionunderparagraphI.5shallbeconfirmedbytheNECattheearliestopportunity.I.8Amembershallbeclassedas‘ingoodstanding’ifatanygivenmomenttheirsubscriptionsareuptodate,theyarenotsubjecttoanysuspensionorexclusioneitherfromelectedofficeorfromstandingasacandidateofanysortinanyelection,andtheyarenotsubjecttoanyformofsuspensionorrestrictionastotheirmembershipoftheParty.

I.9Anymemberwhofailstomaintaintheirsubscriptionsmayhavetheirmembershiprevokedimmediately,althoughathreemonthsgraceperiodmayalsobeofferedbythePartyonadiscretionarybasis.Followingtheexpirationofamembership,anex-member’spaymentofamembershipsubscriptionshallbeconsideredtobeafreshapplicationformembership.

S.22NoCompensationforanyloss,whetheritrepresentsmoniesalreadyexpendedoranyfuturelosswhatsoevershallbepayabletoanypersonintheeventofanydecisiontowithdrawapprovalofacandidateoraninstructionnottostandacandidateandbyapplyingtobeacandidatetheapplicantshallbedeemedspecificallytohavereadandagreedtothisRule.

Parliamentaryby-elections S.23Wherepractical,candidatesselectedforParliamentaryby-electionsshouldbeonthenationalApprovedListofcandidates.S.24Selectionofcandidatesisthejointresponsibilityofthebranch/constituencyAssociationandtheNationalExecutiveCommittee;however,thefinaldecisionmustberatifiedbytheNationalExecutiveCommittee.

Targetseats S.33TheNationalExecutiveCommitteewilldrawupalistofNationalTargetSeatsforaGeneralElection,comprisingnotmorethan50seatsnationwide.IntheseNationalTargetSeats,thecandidateshallbeselectedaccordingtothesamerulesasforaParliamentaryby-election.TheNECmaychoosetoappointanagentandspecifythecampaigningprocessandresources,throughdelegatedauthority.

Eligibility

V.7.1Membersshallbeeligibletovoteintheelectiononlyif:(a)TheyareacurrentmemberofUKIPatthetimethatballotpapersareproduced,(b)TheywereamemberofUKIP28dayspriortocloseofnominations,and (c)TheiraddressonthePartydatabaseiswithinthegeographicalareacoveredbytherelevantAssembly.

V.8.5Shouldanycandidatesleavethelistwithin14daysofthecloseofnominationsfortheAssemblyElectionsthePartyChairmanshallhavetheauthoritytoauthorise,inextremis,theimmediateadoptionofacandidateforthevacancy.

ValidityofrulesV.9.1Allcandidatesshallbesentacopyoftheserules.V.9.2AnymembershallbesentacopyoftheserulesuponwrittenrequesttotheGeneralSecretary.

V.9.3AnyvariationoftheserulesshallbeagreedbytheNECandtheReturningOfficerandnotifiedimmediatelytoallcandidates.

W.2.6AllcandidatesforpublicelectedofficemustalsocomplywiththerulesgoverningPartyofficials.

Rulesgoverningtheconductofelectedmembers W.3AllelectedmembersareexpectedtoactatalltimesinamannerwhichreflectspositivelyupontheParty,bothintheirpersonalandprofessionallife.Electedmembersareexpectedtobeawarethatbyvirtueoftheirelectedposition,their

actionsaresubjecttogreaterpublicscrutinyandthatthereforepoorbehaviourcandamagethePartyorbringitintodisrepute.W.4Electedmembersholdingapaidpositionshallbeentitledtositasex-officionon-votingmembersoftheirRegionalCommittee.W.5ElectedmembersshouldnotmakepublicstatementswhichcontradictPartypolicyexceptinaccordancewithL.12above.W.6ElectedmembersshouldrefrainfrompubliccriticismofotherPartymembers.W.7IntheeventofaseriousbreachofW.5orW.6above,disciplinaryactionmaybetakenagainstthememberconcerned.W.8Electedmembersareexpectedtomakethemselvesavailableformediainterviews,includingatshortnoticeandunsociablehours.W.9Electedmembersareexpectedtoremainaspaid-upmembersofUKIPfortheremainderoftheirtermofoffice.InadditionelectedmembersshallremainontheUnitedKingdomelectoralregister.Afailuresotoremainmaybetakenintoaccountwhenreselectionisbeingconsideredandmayamounttoadisciplinarymatter.W.10Electedmemberswhoreceiveofficeallowancesareexpectedtositetheirofficeinapubliclocationinamajorpopulationcentre.W.11Electedmembersholdingpaidpositionsareexpectedtocontributesubstantiallytothecentralpartyfromincome.W.12UKIPelectedrepresentativesshallacceptcollectivedecisionsconcerningmembershipofaGroup.Notwithstandinganyruleconcerningtheindependentmandateofanelectedrepresentative,thePartymaytakeanydisciplinarymeasure,includingexpulsionfromtheParty,againstanyUKIPelectedrepresentativewhofailstoacceptsuchcollectivedecisions.ByapplyingforreselectiontobeacandidatetheapplicantshallbedeemedspecificallytohavereadandagreedtothisRule.W.13TheextenttowhichW.3andW.5toW.12abovehavebeencompliedwithbyelectedmemberswithpaidpositionsshallbenotedandconsideredbyaninterviewpanelbeforeanelectedmemberisreselectedasacandidateandshall,ifdeemedappropriate,beproperandvalidreasonsfortheelectedmemberbeingdeselected.ByapplyingforreselectiontobeacandidateofanykindtheapplicantshallbedeemedspecificallytohavereadandagreedtothisRule.W.14ElectedmemberswithpaidpositionsshallbeentitledtosubmitawrittenstatementtoaninterviewpaneltoexplaintheircompliancewithW.3andW.5toW.12above.W.15UKIPcouncillorsshouldnotbesubjecttoaformal‘whipping’system,butmayformaUKIPGroup.W.16UKIPcouncillorsmayjoinwithindependentcouncillorsorresidents’associationsifthispermitssufficientrepresentationtoformaGrouporgainrepresentationunderthecabinetsystem.TheNationalExecutiveCommitteemay

X.4.1TheExecutiveCouncilshallbechosenfromamongstmembersofthePartyingoodstandingandberesponsibleforcarryingouttheaimsandobjectivesofYoungIndependence.

X.5.1AnationalYoungIndependenceco-ordinatormaybeappointedbythePartyafterconsultationwiththeYoungIndependenceExecutiveCouncil,toworkwithandassisttheCouncilwithitsundertakingsandcommunicatedirectlytotheleadership.

X.6.1TheExecutiveCouncilshallseektoestablishanetworkoflocalrepresentatives,initiallyatregionallevelandsubsequentlyineachParliamentaryConstituency.TheCouncilmayappointregionalofficerstoleadYIactivityinaregion.

X.6.1.1RegionalChairmenandotherOfficersmayinitiallybeappointedbytheExecutiveCouncilbyamajorityvoteandequallyremovedbythecouncilbyamajorityvote.

X.6.1.2WhereRegionalChairmenareappointedbythecouncilthecouncilwillre-assesstheirroleonayearlybasistodecidewhethertheyshouldcontinueintheirposts.

X.6.1.3RegionalChairmenmayapplytotheExecutiveCounciltochangetheirrolefromappointedbytheCounciltoelectedbytheregion.IftheExecutiveCouncilapprovesthischange,amemberoftheCouncilwilloverseetheelectionprocess.SuchelectionswilltakeplaceonceayearinlinewithelectionstotheExecutiveCouncil.

X.6.2YoungIndependenceshallseektobuildrelationshipswiththeParty’sconstituencyassociations,regionalandnationalcommittees,andsecureYIrepresentationatalllevels.

X.6.3TheExecutiveCouncilmayapprovetheestablishmentofsub-nationalbranchesifitissatisfiedwiththeproposals.

X.6.4Advocatesshallsubmitaproposaldemonstratingtheneedforabranch,howitwillfurthertheaimsofYoungIndependence,andanoutlinestrategicplan.

X.6.5YoungIndependencewillmovetoestablishandsupportstudentbranchesatinstitutionsofhigherandfurthereducation.

X.6.6Studentbranchesshallbeknownas“*NameofInstitution+UKIP”or“*NameofInstitution+YoungIndependence”.

X.6.7TheExecutiveCouncil,actingbyasimplemajorityvote,mayreferdisciplinarymattersrelatingtoYoungIndependencetotheParty’sdisciplinarycommitteewhere:

X.6.7.1TheCouncilfeelsamemberhasbroughtYoungIndependenceintodisrepute;

X.6.7.2AmemberiswilfullyactingagainsttheinterestsofYoungIndependence,or

Elections X.7.1 Balloting and counting for any YI Council election shall be as documented in chapters BB and CC.

X.7.2.2TheReturningOfficershallpublishontheYIwebsiteandtheYImailinglistatleastaweekinadvanceofcloseofnominations;thedateoftheelection,thetimetablefortheelection,thenumberofpoststobefilledandinstructionsforcandidatesseekingnomination.

X.7.3.1Avalidnominationshallconsistofacandidate'sconsenttonominationandthesignaturesofaProposer,aSeconderandeightAssentors.Allmustbefullypaid-uppartymembersingoodstandingontheclosingdatefornominations.TheProposer,SeconderandfiveoftheeightAssentorsmustbeYImembers.

Y:SpecialInterestGroups Y.1SpecialInterestGroups(hereinafterreferredtoas‘groups’)withinthePartymaybesetupsubjecttorecognitionbytheNationalExecutiveCommitteeandshalltakethenameform“xxxxxxxinUKIP”.Y.2.1AnymembersformingaGroupwithoutapprovalfromtheNationalExecutiveCommittee,ormaintainingaGroupwhenpermissionhasbeenrevokedbytheNationalExecutiveCommittee,maybesubjecttodisciplinaryaction.Y.2.2GroupsshallinformtheNationalExecutiveCommitteeoftheidentityoftheirofficerswhenseekingapproval.AnestablishedgroupshallrequireratificationbytheNationalExecutiveCommittee(orthePartyChairmanbydelegatedauthority)whenachangeinofficersismade.Y.2.3AnyofficerofaGroupmayberemovedbytheNECfollowingthesameprocedureasforremovalofanofficerofthePartyinE.17oftheseRulesofProcedure.Y.3GroupsareformalorinformalassociationsofPartymembers;theirviewsandbeliefsshallnotbeheldtobetheviewsoftheParty.Y.4NoGroupshallfalselyrepresenttheirviewsandbeliefsasbeingthoseoftheParty,ormakestatementswhichcouldprovetobeanembarrassmenttotheParty;sanctionsmayincludehavingtheirauthorisationrescindedandthoseresponsiblemaybesubjecttodisciplinaryaction.Y.5SuchGroupsmusthaveaConstitutionand‘AimsandObjectives’whichincludesupportofUKIP,andshallnotdirectlycontradictPartypolicy.AllsuchgroupsmustacceptasaminimumtheaimsandobjectivesofthepartyassetoutinitsConstitution.Y.6TheNationalExecutiveCommitteeshallhaveregardtoequalitylegislationwhenapprovingGroups.Y.7.1WhereaGroupmakesadonationtotheParty,itshalleitherregisterwiththeElectoralCommissionasaregisteredthirdpartyorprovideawrittenguaranteecomplyingwiththeprovisionsofthePoliticalParties,ElectionsandReferendumsAct2000.Y.7.2AnyGroupwhichholdsabankaccountshallnotbeanAccountingUnitoftheParty.Y.7.3AnyGroupshallexerciseduediligenceinallitsfinancialdealingsandstewardshipofmembers’funds.

Y.8TheNECmayrevokerecognitionofaSpecialInterestGroupatitssolediscretion.Insuchacase,theSpecialInterestGroupshallberequiredtodisband.Y.9AllGroupsshalloperateinafair,transparentanddemocraticmanner.TheyshalldonothingtounderminetheParty’sinterests,althoughtheymaycampaigntochangePartypolicybylobbyingtheHeadofpolicyortherelevantPolicygroup.Y.10.1EitherthePartyChairmanortheNECmayrequirethewithdrawalofanyliterature,bothprintedandelectronic,producedbyaSpecialInterestGroupwhichtheybelieveattheirsolediscretionmaybeharmfultothewiderinterestsoftheParty.Y.10.2EitherthePartyChairmanortheNECmayrequireaSpecialInterestGrouptosubmitallliterature,whetherphysicalorelectronic,toanamedPartyofficerforvettingbeforepublication.EitherthePartyChairmanortheNECmay,attheirdiscretion,withdrawpermissionforaSpecialInterestGrouptousesocialmediaortousetheParty'slogo(oranyvariantthereof).Y.11SpecialInterestGroupsarerequiredtocomplywiththeParty'sSocialMediaGuidelines(Appendix4totheseRulesofProcedure).Y.12FailuretocomplywiththeprovisionsofsectionYoftheseRulesofProcedureshallbeconsideredtobegroundsfordisciplinaryaction.

ComplaintsProcedure AA.3.1Thecomplaintsprocedureshouldbeinvokedonlywhenallotherreasonablestepshavebeentakentoresolveanissueordispute,orwhereanactionissoseriousthatonlydisciplinaryactionisappropriate.AA.3.2AcomplaintmustbemadeinwritingtotheGeneralSecretary.Thecomplainantmuststatethegroundsforthecomplaint,quotingspecificbreachesofthePartyConstitutionorRulesofProcedureandincludinganysupportingfactualevidence.AA.3.3TheGeneralSecretarymay,athisdiscretion,consultwiththecomplainantand/ortherespondenttoascertainadditionalinformationand/orevidencebeforereferringthemattertothePartySecretary.AA.3.4IfthePartySecretaryconsidersthatthecomplaintisnotsubstantive(i.e.thatitdoesnotrelatetoaspecificbreachofthePartyConstitutionorRulesofProcedure),heshalldismissthecomplaint.AA.3.5Arespondentwhopromptlyacknowledgesfaultmay,atthediscretionofthePartySecretary,beissuedwithadviceastofutureconductorawrittencautionastofuturebehaviour.Insuchcircumstances,nofurtherdisciplinaryactionshallberequired.

AA.3.6Oncethedocumentspecifyingthenatureandparticularsofthecomplainttobeheard,itshallbesenttothecomplainant,totherespondentandtothenominatedvotingmembersoftheNECwhowillhearthecomplainttogetherwithcopiesofwitnessstatements,documentsandothermaterialformingthecomplaintproducedunderProcedureforhearings,below.

Hearings AA.4.1IfthecomplaintisnotupheldattheHearing,thecomplaintshallbedismissed.Ifthecomplaintisupheld,theDisciplinaryPanelshalldecidewhatactionistobetakenandmayimposeapenaltyasdescribedinArticle11.5ofthePartyConstitution.Iftied,thePanelChairmanshallhaveacastingvote.TheDisciplineCommitteeshallatalltimesexerciseitspowerswithproperregardfortheprincipleofproportionality.AA.4.2ExpulsionfromthePartyalsoentailsexpulsionfromallPartyofficesheld.AA.4.3ArulingbytheHearingPanelshalltakeimmediateeffectunlessthePanelexpresslystatesotherwise.

AA.4.4AverbalrulinggivenbytheHearingPanelshallbeconfirmedinwritingtothecomplainantandrespondentassoonaspracticable.

Appeals AA.5.1UnderArticle11.7oftheConstitution,theNECshallcauseanappealhearingtobechairedbyanIndependentChairmanandmayappointsuchaChairmanwhoneednotbeamemberoftheParty.NopersonwhosatonaDisciplinaryPanelatfirstinstancemaybeamemberoftheappealpanelforthematterathand.AA.5.2AnappealagainstthefindingsofaDisciplinaryPanelmustbelodgedinwritingwiththeGeneralSecretarywithinfourteendaysofreceiptofthewrittenfindings.Anappealmayonlybelodgedbyarespondentwhereacomplainthasbeenupheld.Theappealmuststatethegroundsfortheappeal,whichmaybeagainstthefindingsorthepenaltyimposedorboth.Theappellantshallsendafeeof£500towardsthecostsofholdinganappealhearing. AA.5.3 The Appeals Chairman shall appoint two voting members of the NEC (who may not be members of the original Disciplinary Panel) as an Appeals Panel (hereinafter referred to as “the Appeal Panel”). If eligible members of the NEC are unavailable, the AppealsChairmanshall,withtheadviceandassistanceoftheGeneralSecretary,appointotherPartymembersontotheAppealPanelasnecessary.AA.5.3.1Ifanappellantwishestowithdrawtheirappeal,theymaydosobywritingtotheGeneralSecretary.Insuchcircumstances,thefeeshallonlybereturnedifthePartyhasnotyetincurredanycostsrelatingtotheappeal.AA.5.4TheAppealPanelshallexaminetheevidencesubmittedtotheDisciplinaryPanel,itsfindingsandthenoticeofappealandanyrepresentationsmadetoitbyeitherthecomplainantortheAppellantandthereaftermay:a)Dismisstheappeal;b)Allowtheappealinwholeorinpart;AA.5.5UpondismissingtheappealtheAppealPanelmay:a)Increasethepenaltyimposed;orb)Substituteanotherpenaltyforthatoriginallyimposed;orc)Confirmthepenaltyimposed;andd)MakeanorderthatthememberforfeithisfeebywayofcostsAA.5.6UponallowingtheappealinparttheAppealPanelmay:a)Notwithstandingtheappealbeingallowed,confirmthepenaltyasappropriateandproportional;orb)Reducethepenaltyimposed;andc)MakeanorderthattheAppellantforfeitsuchamountofhisfeeasisdeemedappropriateinallthecircumstances

Other AA.6.1IfaPartyOfficeholderoraholderofpublicelectedofficebecomessubjecttolegalproceedingsheshallnotifythePartySecretaryimmediately.ThePartySecretarymayreferthemattertotheDisciplinaryPanelathisdiscretion.AA.6.2TheDisciplinaryPanelmayinvokedisciplinaryproceedingsagainstanymemberitconsiderstohavemadeafrivolousormaliciouscomplaint.AA.6.3PartymembersshallrefrainfromcommentingoncasesinPartymeetingsorinpublicwhiledisciplinaryproceedingsarepending.TheDisciplinaryPanelmayinvokedisciplinaryproceedingsagainstanymemberitconsiderstohavebreachedthisrequirement.AA.6.4Allcomplaints,HearingandAppealproceedingsshallbetreatedasconfidential,exceptthatthePanelChairmanmaypubliciseasuspensionpendingahearingandtheNECmay,atitsdiscretion,issueastatementsummarisingthefindingsoncompletionofHearingandAppealPanelproceedings.AA.6.5PartymembersshallnotunderanycircumstancesattempttocontactDisciplinaryPanelmembersaboutpendingcases.AnysuchbreachbyacomplainantorrespondentshallresultinimmediatesuspensionfrommembershipandreferraltotheDisciplinaryPanel.AnysuchbreachbyanyothermembermayresultinimmediatesuspensionfrommembershipandreferraltotheDisciplinaryPanel.AllcorrespondenceaboutpendingcasesshallbeconductedthroughthePanelChairmanorapersondulyauthorisedbyhim.AA.6.6ThePartySecretaryshallsummarisetheprogressofpendingcomplaintsanddisciplinaryhearingsateachNECmeeting.

AA.6.7TheburdenofproofrequiredforacomplainttobeupheldagainstanyRespondentatadisciplinaryhearingshallbethebalanceofprobabilities.

ProcedurefordisciplinaryhearingsAA.7.1ThePanelChairmanshallcompileabundleofdocumentswhichshallconsistof:(a)Thecomplaintandsupportingwrittenevidence;(b)Anywrittenresponseandsupportingwrittenevidencefromtherespondent,and

CC.1Thischaptertakeseffectinagivenelection,oncetheReturningOfficer(RO)hasmadearulingtothatpurposeunderBB.5,afterconsultingtheTreasurer.

CC.2TheROshallestablishalocation/teamforthecount,andinvitethecandidates,and/ortheiragentstoattend.Hemayrestrictattendancenumbers,ifnecessary,shouldthevenuesizerequireit.

CC.3PrintedBallotPapers.General:

• Eachvotingpapershallbeseriallynumbered,andshallcarrysuchsecurityfeaturesasnecessarytosatisfytheReturningOfficeroftheintegrityoftheprocess.

• Thecandidatesshallbelistedinalphabeticalorder,exceptforMEPrankingelections,wheretheorderingshallbeasdeterminedinT.5.7.

• Onevotingpapershallbeissuedtoeachfullmembereligibletovote.• AcopyofthemailinglistshallberetainedbytheReturningOfficer,anda

recordofthenumberofvotingpapersissuedshallbemade.• Onlytheoriginalvotingpapershallbeacceptedasavalidvote;faxed,

emailedorphotocopiedvotingpaperswillberejected.• Completedvotingpapersmustbereturnedbytheclosingdateforreceiptof

ballotpapersinordertobecounted.• Thenumberofenvelopescontainingcompletedvotingpapersshallbe

counteddailyastheyarereceivedandthenstoredsecurelybytheReturningOfficerorhisnominee.

CC.7Replacementvotingpapers:Ifamemberaccidentallyspoilsaprintedvotingpaper,itmustbereturnedintheofficialreturnenvelopenotlaterthanfiveworkingdaysbeforetheclosingdateforthereturnofvotingpapers,withthewords‘SPOILTBALLOT’writtenonthefrontandannotatedwiththemember’snameandaddress.Areplacementwillbeissuedbyfirstclasspost.TheReturningOfficercannotguaranteethatsuchreplacementswillreachthememberintimeforavotetobecastbeforetheclosingdate.

CC.8Thecount.

CC.8.1ThecountshallbeconductedatalocationtobeannouncedtoallthecandidatesbytheReturningOfficer.TheReturningOfficershallappointthetellerstoassistinthecount.Candidatesandtheirrepresentatives,toamaximumnumberpercandidateasdeterminedbytheReturningOfficer,mayattendthecount.Candidates,theirrepresentatives,proposerandassertorswillnotbepermittedtoassistinthecount.TheReturningOfficershallarrangetocountthenumberofvotingpapersreturned,identifyandcountinvalidvotingpapers,calculatetheturnout(thepercentageofvalidvotingpapersreturnedagainstthenumberofvotingpapersissued)andcalculatethenumberofvotescastforeachcandidate.Candidatesmaybepenalisedwherenecessary,e.g.underV.5.3.TheReturningOfficer’sdecisioninallmattersconcerningthecountshallbefinal.

CC.8.2Doubtfulvotingintentions:

CC.8.2.1Wherethereisdoubtaboutvotingintentions,theReturningOfficermayaskcandidatestoagreehowtocountthevote,buttheReturningOfficer’sdecisionshallbefinal.

CC.8.2.2Inarankedelection,whereavoterclearlyindicatestheirvotesbymeansofcrossesorotherwisemakestheirintentionsclearastowhichcandidatestheyintendtovoteforwithoutrankingthem,eachvotecastshallbeconsideredtohavethevalueof1vote.

CC.8.3Invalidvotingpapers:

Avotingpapershallbedeclaredinvalidif:

• Thevotercastmorethanthepermittednumberofvotes.• Thevotingpaperdoesnotbearavalidserialnumber.• Thevotingpaperisacopyofanoriginalvotingpaper.• Theintentionsofthevotercannotbedeciphered.• Thevotingpaperhasnotbeenreceivedbytheclosingdateforthe

receiptofvotingpapers.

CC.8.4Storage:

Allvotingpapers,calculationsheets,andacopyofthesigneddeclarationshallbestoredinsealedpackages,countersignedbyanindependentwitness,tobestoredatthediscretionoftheReturningOfficerfornotlessthan12monthsfromthedateofthecount.
