B:BranchandConstituencyAssociationRules

StatusandAuthority B.1.1ThebasicunitsofthePartyaretheConstituencyAssociationsandBranches,establishedunderArticle3.6oftheConstitutionoftheUKIndependenceParty.TheyshallupholdtheprinciplesoftheConstitutionandareresponsibletotheNationalExecutiveCommitteeviathePartyChairmanorhisdelegatewhowillnormallybetheRegionalOrganiser.B.1.2AConstituencyOrganisationorBranchmayexistonlyifauthorisedbytheNationalExecutiveCommittee.NoConstituencyAssociationorBranchmaybeestablishedwithoutthewrittenconsentofthePartyChairman,onbehalfoftheNEC.B.1.3AConstituencyAssociationconsistsofoneentireparliamentaryconstituencyanditshallbearthatname.B.1.4ABranchconsistsofmorethanoneparliamentaryconstituencyandshallincludetheparliamentaryconstituenciesconcernedintheirentirety.Itshallhaveanappropriategeographicalname.TheNECmayatitsdiscretionpermittheformationofbranchesfromgeographicalareasotherthanParliamentaryconstituencies.B.1.5TheprimaryfunctionsofConstituencyAssociationsandBranchesaretoselectandsupportcandidatesforlocal,ParliamentaryandotherkindsofelectionsinaccordancewiththeseRulesofProcedure,recruitnewmembers,raisefundsandgenerallytopromotethePartyanditspolicies.B.1.6.1Inaccordancewiththeparty’saimtohaveConstituencyAssociationsinallparliamentaryconstituencies,branchescoveringmorethanoneconstituencyareencouragedtosplitwhenbranchmembershipbecomessufficientlylarge.B.1.6.2AbranchwishingtosplitmusthavetheapprovaloftheBranchCommitteeandtheRegionalOrganiser,andmustalsohavethewrittenconsentofthePartyChairman,onbehalfoftheNEC.WhereaCountyCommitteeexists,itmustbekeptinformedofthechange.B.1.7Branchesshallco-operatewithanyRegionalCommitteeandCountyCommitteecoveringtheirarea.B.1.8ConstituencyAssociationsandBranchesshallbothbemanagedundertheserulesandbotharehereinafterreferredtoasBranches.B.1.9BranchMeetingsshallbeheldinaccordancewiththe‘StandingOrdersfortheconductofInternalPartyMeetings’.

B.1.10OfficersofallbranchesandconstituencyassociationsshallcompletetheParty’s

DataProtectionformsandotherdocumentationasrequiredbyHeadOfficetoensuresmoothfunctioningoftheParty’sinternalprocedures.

Membership B.2.1AllPartymembersaremembersofthebranchinwhichtheyliveandshallbeentitledtoparticipateinitsactivities.WhereamemberislivingintheUKandregisteredtovoteinonelocation,forthepurposesofthisRuletheirresidenceshallbetakenastheaddressatwhichtheyareontheelectoralregister.B.2.2TheaffairsofmemberswholiveinaparliamentaryconstituencywithnoestablishedbranchshallbeadministeredbythePartyChairmanorhisdelegate.B.2.3.1Partymembersmay,onrequest,becomeamemberofanotherbranch,subjecttotheagreementofthereceivingbranchcommittee.Onmovingbranches,themembershallhavefullvotingrightsinthenewbranchandceasetobeamemberoftheirpreviousbranch.B.2.3.2Shouldthereceivingbranchcommitteewithdrawtheirconsent,themembershallbeentitledtoreverttomembershipoftheirbranchofresidency.B.2.4APartymembermayserveononlyonebranchcommitteeatatime.

B.2.5WhereaBranchcollectsamembershipfeefromanewmember,itshallbeentitledtoretainthefirstyear’ssubscriptionsonlyfromthoseresidingwithinthegeographicalareacoveredbythebranch.Wherethemoneyiscollectednationally,andwheremembershipisrenewed,themoneyshallbekeptbythenationalParty.

BranchCommittees

B.3.1Branchesareresponsiblefortheirownactionsandfinancialaffairs.

B.3.2.1TheChairman,SecretaryandTreasurershallbemembersofthebranchcommittee.ThenumberofCommitteememberstobeelectedshallbedeterminedbytheAGM,subjecttoamaximumofeightmembersintotal.

B.3.2.2NoformermemberofaPartyororganisationontheproscribedlistshallbepermittedtoholdofficeonabranchcommittee,ortoholdanyotherformalofficewithintheParty.

B.3.2.3NocurrentmemberofanyotherPartyshallbepermittedtoholdofficeonabranchcommittee,ortoholdanyotherformalofficewithintheParty.ThePartyChairmanmaypermitanexceptiontoB.3.2.3wherehebelievesittobeintheParty’sstrategicintereststodoso.

B.3.3Thethreeprincipalbranchofficers,Chairman,TreasurerandSecretaryshallallbecommitteemembers.Furtherofficersmaybeelectedtofulfilotherposts.Ifonlytwomembersareelectedtothecommittee,theyshallbeChairmanandTreasurerandoneoftheseshallalsobenamedasSecretary.

B.3.4Thebranchofficersandothercommitteemembersshallbeelectedatthebranch’sAnnualGeneralMeeting(AGM)byballotofmembersattending.TheirtermofofficeshallrunfromtheAGMwhenelecteduntilthenextAGM.TheprincipalofficersshallberequiredtocompleteandreturnaPartyOfficer’sDeclarationform.SectionQoftheseRulesofProcedureshallnotapplytotheelectionofofficers.B.3.5AllmembersingoodstandingareeligibletostandforelectiontothebranchCommitteeoftheirbranch.'Ingoodstanding'isdefinedunderI.8below.ForthesepurposesmembersarebranchmemberseitherthroughB.2.1orB.2.3above.B.3.5.2.AbranchcommitteemayacceptnominationsfrommembersofotherbranchestostandforelectiontothebranchCommitteeoftheirbranchiftheyagreetothosenominationsbyamajority.B.3.6Membersoflessthantwelvemonths’standingmustbeproposedandsecondedbythosewhohavebeenPartymembersformorethantwelvemonths.ThePartyChairmanshallhavethepowertovetotheelectionofanymemberoflessthantwelvemonths’standing,within21calendardaysoftheAGM.

B.3.7Theelectedcommitteeshallhavethepowertoco-optotherbranchmembersforspecificpurposeswhosetermshallendatthenextAGMandwhosevotingrightsshallbedeterminedbytheelectedcommittee.

DutiesofBranchOfficers B.3.8.1TheChairmanhasprincipalresponsibilityforthedirectionofthebranchandshallnormallychairallmeetingsincludingtheAGMandshallenjoyfullvotingrights.TheChairmanshallnormallycallmeetingsofthecommittee(andmeetingsofthewholebranchasdefinedinB.4.4)butasimplemajorityofcommitteemembersmaycallacommitteemeetingintheeventthattheChairmanisunableorunwillingtodoso.B.3.8.2Aduly-constitutedbranchmayholdabankaccount.TheTreasurershallberesponsibleformanagingthebranchfinancesandbankaccount.AllbranchesareAccountingUnitsforthepurposesofthePoliticalPartiesElectionsandReferendumsAct2000(PPERA2000)andtheTreasurerisresponsibleforcompliance,inparticularthereportingofdonationstoHeadOfficeandthepreparationandsubmissionofBranchAccounts,accordingtoguidancefromthePartyTreasurer.B.3.8.3Bankaccountsshouldhaveatleastthreesignatories,withanytwosignatoriesbeingrequiredtodrawuponbranchfunds.SignatoriestothebankaccountshouldnormallybeCommitteemembers.Accountswithjusttwosignatoriesshallbepermittedonlyinextremis,orwhentherearejusttwomembersonaCommittee.Branchesmaypermitelectronicbankingtobeundertakenbyasolenamedindividualbutshallensurethatappropriatefinancialreportsarereceivedateachmeeting.

B.3.8.4TheSecretaryshallnormallyberesponsibleforthegeneraladministrationoftheCommittee,includingtakingminutesofmeetings,maintainingarecordofthebranch’spartymembersandadvisingHeadOfficeofchanges.ThesecretaryshallalsoadviseHeadOfficeofanychangestotheofficersandthebranchregistrationdetailsandisresponsibleforcompliancewithE.14oftheseRulesofProcedure.B.3.9Onlymemberswhoarebranchofficers,orwhohavetheexpresspermissionoftheCommittee,shallbeauthorisedtorepresentthelocalpartyormakeuseofpartylogos.Unauthoriseduseofthepartynameorlogomaybeconsideredtobebringingthepartyintopublicdisreputeandthereforegroundsfordisciplinaryaction.B.3.10Intheeventthatabranchofficerresignsorisotherwiseunabletocontinueintherole,apermanentreplacementmayonlybeselectedbyageneralmeetingofthebranchwith21days’notice.AnactingreplacementmaybechosenbythebranchcommitteetocontinuewiththeroleuntilthefollowingAGM.B.3.11UpondisbandmentofanyBranch,thefinancialreservesandotherassetsshallbetransferredtothenationalpartyviathenationalPartyTreasurer.B.3.12WhereabranchofficialisseriouslyfailingintheirdutiesunderB.1.5andB.3.8.1toB.3.8.3,andeffortstodealwiththesituationhavenotresultedinimprovedperformance,theNationalExecutiveCommitteemayasalastresortremovefromofficeabranchcommitteemember.B.3.13BranchesmustcontacttheirRegionalOrganiseriftheywishtoselectasabranchcommitteememberanyonewithseriouscriminalconvictions(tobedefinedashavingbeenconvictedofanoffenceforwhichthemaximumsentenceisaprisonsentenceof12monthsorgreaterorforwhichanycustodialsentencewasimposed).TheRegionalOrganisermayaccepttheappointment,rejecttheappointmentorreferthemattertotheNEC.IftheRegionalOrganiserrejectstheappointmentthereshallbearightofappealtotheNEC.B.3.14Whereabranchcommitteememberisconvictedofacriminaloffencewhilstaservingofficial,themembermustnotifythePartySecretaryandtheGeneralSecretary.WheretheParty’sreputationcouldbeaffected,themattershallbereferredtothePartyChairmanwhomaysuspendthecommitteememberfromofficependinganNECdecisionconcerningremovalfromoffice.B.3.15FailuretodiscloseinformationunderB.3.13orB.3.14maybegroundsfordisciplinaryaction.B.3.16WhereavoteatageneralBranchmeetingoronaBranchCommitteeistied,thefollowingprinciplesshallbeusedtoresolvethetie:a)Thebranchcommitteeshouldcontinuetodiscussthematter,seekaconsensusorcompromisewherepossible,andthenre-vote.b)Ifsuchacompromisecannotbereached,whereverpossible,theBranchChairmanmustusetheirsecondorcastingvotetomaintainthestatusquo.

c)Ifthemattertobevotedondoesnotpermitthestatusquotocontinueandisachoicebetweenthreeormoreoptions,orbetweenthreeormorecandidatesforaposition,thenthevoteshallberepeatedwithonlythetoptwochoicesavailable.d)Ifthevoteremainstied,andanyco-optedmembershavevotingrightsontheBranchCommittee,thenthevoteshallberepeatedwithonlythosememberselectedbyaGeneralMeetingofthebranchentitledtovote.e)Ifthetiestillcannotbebroken,themattershouldifpossiblebedeferredtothenextmeeting.f)Ifthemattercannotbesodeferred,orifthedeadlockpersistsintoasecondmeeting,thenacointossorotherrandommethodmaybeusedtodeterminehowtheChairman’ssecondorcastingvoteshouldbeused.

BranchandCommitteeMeetings B.4.1.1Branchcommitteesshallnormallymeetatleastsixtimesperannumwithsufficientflexibilitytocopewithemergenciessuchasthesuddencallingofanelection.B.4.1.2Halfofthecommitteemembers,includingtwooftheChairman,SecretaryandTreasurer,shallconstituteaquorum.Thenormalnoticeperiodis7days.

B.4.1.3TheRegionalOrganiserandRegionalChairmancoveringthebranch,andanyofficerlistedunderC.3.9below,shallhavetherighttoattendanyBranchorCommitteemeeting.

C.5.17Regionalbankaccountsshouldhaveatleastthreesignatories,withanytwosignatoriesbeingrequiredtodrawuponbranchfunds.SignatoriestothebankaccountshouldnormallybeCommitteemembers.Accountswithjusttwosignatoriesshallbepermittedonlyinextremis.RegionalCommitteesmaypermitelectronicbankingtobeundertakenbyasolenamedindividualbutshallensurethatappropriatefinancialreportsarereceivedateachmeeting.C.5.18InstancesmayarisewhendifferenceswithinaRegionalCommitteethreatenitsproperfunctioning.Everyeffortshallbemadetoresolvetheseatregionallevel,firstlyinformallybytheRegionalOrganiser,andifthisdoesnotsucceed,ataRegionalCommitteemeeting.C.5.19Ifthedisputeremainsirreconcilable,thePartyChairmanshallappointaRegionalOrganiserfromadifferentregiontoinvestigatethesituation,andseektonegotiatearesolution.Ifthisstilldoesnotsucceed,andifthePartyChairmandeemsthatthebehaviourofthecommitteeoritsofficersisinconsistentwiththeParty’sConstitutionorprinciples,theRegionalOrganiserappointedtoinvestigate(afterconsultingwith,andwiththewrittenpermissionof,thePartyChairman)maysuspendordissolvetheRegionalCommittee,suspendorremoveaRegionalCommitteemember,orsuspendamemberfromPartyactivities.

CountyMeetings C.6.1EachCounty,orotherapprovedsub-divisionasdefinedunderC.3.1andC.3.2,willelecttheirrepresentativestotheRegionalCommitteeatanannualmeetingheldin

Administrativerules

I:Termsandconditionsofmembership I.1Membershipshallstartfromthedateofreceiptoftheinitialmembershipsubscriptionandcontinueforthenumberofyearsforwhichthesubscriptionhasbeenpaid.I.2Membershipsubscriptionsarenotnormallyrefundable.I.3Membersshallbeconsideredtobefullypaid-upuntiltheendofthemonthofexpiry.I.4ThePartymayrefuseorrescindanapplicationformembershipiftheNationalExecutiveCommitteeconsidersthattheapplicationdoesnotfulfilthecriteriaformembershipassetoutinthePartyConstitution.I.5ThePartySecretaryhastherighttosuspendorexpelmemberswhoclearlybringthePartyintodisreputebyassociationwithormembershipofanorganisation,membershipofwhichtheNEChasdeclaredtobeincompatiblewithmembershipofthePartyorestablishagroupinoppositiontoanofficialUKIPgroup.I.6MembershipisnotavailabletoanyonewhoisorhaspreviouslybeenamemberoftheBritishNationalParty,theNationalFront,theUKFirstparty,theEnglishDefenceLeague,theBritishFreedomParty,BritishPeople’sPartyandtheBritainFirstParty(oranyotherpartiesororganisationslateraddedtotheproscribedlist).Anyapplicationsmadefrompeoplewhoareorhavebeenmembersoftheseorganisationswillberefused,andanysubscriptionscollectedwillberefunded.Bymakinganapplicationformembership,theapplicantcertifiesthatheisnotandhasneverbeenamemberofeitheroftheseparties.I.7AnyactionunderparagraphI.5shallbeconfirmedbytheNECattheearliestopportunity.I.8Amembershallbeclassedas‘ingoodstanding’ifatanygivenmomenttheirsubscriptionsareuptodate,theyarenotsubjecttoanysuspensionorexclusioneitherfromelectedofficeorfromstandingasacandidateofanysortinanyelection,andtheyarenotsubjecttoanyformofsuspensionorrestrictionastotheirmembershipoftheParty.

I.9Anymemberwhofailstomaintaintheirsubscriptionsmayhavetheirmembershiprevokedimmediately,althoughathreemonthsgraceperiodmayalsobeofferedbythePartyonadiscretionarybasis.Followingtheexpirationofamembership,anex-member’spaymentofamembershipsubscriptionshallbeconsideredtobeafreshapplicationformembership.

S.22NoCompensationforanyloss,whetheritrepresentsmoniesalreadyexpendedoranyfuturelosswhatsoevershallbepayabletoanypersonintheeventofanydecisiontowithdrawapprovalofacandidateoraninstructionnottostandacandidateandbyapplyingtobeacandidatetheapplicantshallbedeemedspecificallytohavereadandagreedtothisRule.

Targetseats S.33TheNationalExecutiveCommitteewilldrawupalistofNationalTargetSeatsforaGeneralElection,comprisingnotmorethan50seatsnationwide.IntheseNationalTargetSeats,thecandidateshallbeselectedaccordingtothesamerulesasforaParliamentaryby-election.TheNECmaychoosetoappointanagentandspecifythecampaigningprocessandresources,throughdelegatedauthority.

SelectionofRegionalListcandidates V.4.1TheRegionalLeaderwillconveneaninterviewpaneltoconsidereachpotentialcandidate,andassesstheirsuitabilityforcandidacy.V.4.2CriteriawhichshouldbeconsideredbytheRegionalLeaderwhenassessingsuitabilityforlistpositionsshallincludetrackrecordofservicetotheParty,mediaability,previouselectoralperformancefortheParty,skillswhichtheywouldbringtotheAssembly,andtheabilitytoavoidnegativeordamagingmediastories.V.4.3TheinformationgainedfromthisprocessshallinformtheRegionalLeader'sdecisiontosubmitalistofcandidatestotheNationalExecutiveCommitteeforratification.V.4.4TheRegionalLeadershallrankthislist,andsubmitthatdecisionalsototheNationalExecutiveCommitteeforratification.Iftherankingofthelisttakesplaceafterthelistisannounced,performanceasacandidatewillbeoneofthecriteriausedtoinformtheRegionalLeader'srecommendation.V.4.5OnlytheNationalExecutiveCommitteemayremoveacandidatefromthelist,orre-orderthelist,oncetherelevantannouncementshavebeenmade.V.4.6ThePartyshallmaintainalistof'reserves'ineachregion,fromwhom(attheNEC'sdiscretion)replacementcandidatesshallbechosenintheeventthatacandidateisremovedfrom,orresignsfrom,thelist.V.4.7Allproposers,secondersandassentorsmustbefullypaid-upmembersofthe

Campaigning V.6.1AllcampaigningshouldbeconductedinagoodspiritwithoutattacksonopponentsorotherPartymembers.V.6.2EvenwhereacandidatehaslegitimateaccesstoaPartyDatabase,theyarespecificallynotauthorisedtousethatDatabaseforanycampaigningwhatsoeverinrelationtothisselectionprocedure.UnauthoriseduseofthePartyDatabaseshallprovidegroundsforexpulsionfromtheselectionprocessand/orDisciplinaryactiontobetakenagainstacandidateorsupporter.V.6.3Whereacandidateisfoundtohavebeenunfairlyadvantagedbyathird-partycampaignpromotingtheircandidature,thentheReturningOfficermaypenalisethecandidatetotheextentthat,inhisorheropinion,thecandidatebenefitedfromthesaidcampaign.V.6.4Nocandidateorsupportershallmakeunsolicitedcontactwithmembersbyanymeanswhatsoever.Thisshallinclude,butnotbelimitedto,contactbytelephone,post,email,SMSandonlinemessaging.V.6.5Candidatesmayproduceapersonalcampaignwebsite.V.6.6CandidatesmaycreateaFacebookGrouporothersocialmediaGroupadvocatingtheircandidacybutmaynotaddotherstothatGroupwithouttheirexpressconsent.FacebookstatusesandTwitterupdatesrelatingtotheselectionprocessarealsoacceptable.V.6.7Candidatesmayproducecampaignliteraturewhichcanbegivenouttomembersuponrequest.Suchcampaignliteratureshallnotexceed4sidesofA4.V.6.8EachCandidateshallbeentitledtohavetheirdetailspublishedinamedium

Eligibility

V.7.1Membersshallbeeligibletovoteintheelectiononlyif:(a)TheyareacurrentmemberofUKIPatthetimethatballotpapersareproduced,(b)TheywereamemberofUKIP28dayspriortocloseofnominations,and (c)TheiraddressonthePartydatabaseiswithinthegeographicalareacoveredbytherelevantAssembly.

TheCount V.8.1TheNECthroughitsappointedsubcommitteeshalldeterminethefinalcompositionofthelist,takingintoaccountthecandidateassessmentreports,thevotesofthePartymembershipandanyotherfactorswhichmateriallyaffectthesuitabilityofthecandidateandtheoptimalconductoftheelection,totheParty’sadvantage.V.8.2Whereavacancyiscreatedbythewithdrawalofacandidate,othercandidatesfromthelistshalleachmoveupbyoneplaceonthelist.V.8.3ExceptbyresolutionoftheNationalExecutiveCommittee,therankingofthe

Objects

X.2.1TheobjectsofYoungIndependenceshallbe:

a)Toadvancetheprinciples,aimsandpoliciesofthePartytopeopleundertheageof30;

b)Toadvocateitsownstatementofaims,wherethesecomplementandextendtheprinciplesofthePartyanddonotconflict;

c)Torecruitnewmembers;

d)Tosupportthedevelopmentofitsmembershiptowards,andsupportitsmembersin,contestingelections;

e)ToengagewiththeleadershipofthePartytorepresenttheviewsofitsmembership,and

f)ToprovidecounseltothePartyleadershiponissuesrelatingtoyoungpeople.

Membership

X.3.1AnymemberofthePartywhoisunder30yearsofageshallautomaticallybecomeamemberofYoungIndependence.

X.3.2MembershiprecordsofthePartyshallconstitutethefinalauthorityonvalidityofmembershipofYoungIndependence.

X.3.3MembershipofYoungIndependenceiscontingentonmembershipoftheParty.

X.3.4MembershipofYoungIndependenceconfersvotingrightsforelectionstotheYoungIndependenceExecutiveCouncil.

TheExecutiveCouncil

X.4.1TheExecutiveCouncilshallbechosenfromamongstmembersofthePartyingoodstandingandberesponsibleforcarryingouttheaimsandobjectivesofYoungIndependence.

X.4.2TheExecutiveCouncilshallcomprise:

X.4.2.1AChairman,Secretary,Treasurer,UniversitiesOfficer,CommunicationsOfficer,ElectionsOfficer,EventsOfficerandGrassrootsOfficerwhoshallbeelectedannuallyinaccordancewiththeYIVotingRulesinsectionX.7.

X.4.2.2TherolesofChairman,SecretaryandTreasurerarenecessaryrolesandcannotbechanged;allotherrolesmayberemovedorchangedbyamajorityvoteiftheybecomeunoccupiedorimmediatelybeforeanelectionperiod.

X.4.2.3TheroleofViceChairmanwillbeanappointedroleconferreduponanymemberoftheExecutiveCouncilastheChairmanseesfit,subjecttoX.4.7below.

X.4.2.4TheExecutiveCouncilshallco-optsuchadditionalofficersasnecessary,eitherfornewpositionsortofillvacancies,subjecttoX.4.7below.Co-optedofficersshallholdequalvotingrightstoelectedCouncilmembersandshallbeconsideredinallwaysequaltotheirelectedcounterparts.

X.4.3TheExecutiveCouncilshallactbyasimplemajoritypositivelyassentingtoamotion.

X.4.4TheChairmanshallchairmeetingsoftheExecutiveCouncil,orintheabsenceoftheChairmantheViceChairmanshallchair.

X.4.5TheExecutiveCouncilmeetmonthly,inpersonorvirtually,andwheninpersonshallalternatelocationsequitablyfortheconvenienceofitsmembers.

X.4.5.1ExecutiveCouncilmeetingdatescanbechangedinadvanceofaweekbyamajorityvote

X.4.6IfamemberoftheExecutiveCouncilatanypointstandsdownfromorisremovedfromtheExecutiveCounciltheCouncilwillbymajorityvotedecidewhethertoholdaby-electionorwhethertoappointanewmember.Aby-electionwillfollowthesamerulesfornormalExecutiveCouncilelections.

X.4.7Theappointmentand/orelectionofallofficersorregionalofficersofYoungIndependenceshallbesubjecttoratificationbytheNationalExecutiveCommittee.ThisauthoritymaybedelegatedtothePartyChairman.

TheNationalCo-ordinator

X.5.1AnationalYoungIndependenceco-ordinatormaybeappointedbythePartyafterconsultationwiththeYoungIndependenceExecutiveCouncil,toworkwithandassisttheCouncilwithitsundertakingsandcommunicatedirectlytotheleadership.

OrganisationalStructure

X.6.1TheExecutiveCouncilshallseektoestablishanetworkoflocalrepresentatives,initiallyatregionallevelandsubsequentlyineachParliamentaryConstituency.TheCouncilmayappointregionalofficerstoleadYIactivityinaregion.

X.6.1.1RegionalChairmenandotherOfficersmayinitiallybeappointedbytheExecutiveCouncilbyamajorityvoteandequallyremovedbythecouncilbyamajorityvote.

X.6.1.2WhereRegionalChairmenareappointedbythecouncilthecouncilwillre-assesstheirroleonayearlybasistodecidewhethertheyshouldcontinueintheirposts.

X.6.1.3RegionalChairmenmayapplytotheExecutiveCounciltochangetheirrolefromappointedbytheCounciltoelectedbytheregion.IftheExecutiveCouncilapprovesthischange,amemberoftheCouncilwilloverseetheelectionprocess.SuchelectionswilltakeplaceonceayearinlinewithelectionstotheExecutiveCouncil.

X.6.2YoungIndependenceshallseektobuildrelationshipswiththeParty’sconstituencyassociations,regionalandnationalcommittees,andsecureYIrepresentationatalllevels.

X.6.3TheExecutiveCouncilmayapprovetheestablishmentofsub-nationalbranchesifitissatisfiedwiththeproposals.

X.6.4Advocatesshallsubmitaproposaldemonstratingtheneedforabranch,howitwillfurthertheaimsofYoungIndependence,andanoutlinestrategicplan.

X.6.5YoungIndependencewillmovetoestablishandsupportstudentbranchesatinstitutionsofhigherandfurthereducation.

X.6.6Studentbranchesshallbeknownas“*NameofInstitution+UKIP”or“*NameofInstitution+YoungIndependence”.

X.6.7TheExecutiveCouncil,actingbyasimplemajorityvote,mayreferdisciplinarymattersrelatingtoYoungIndependencetotheParty’sdisciplinarycommitteewhere:

X.6.7.1TheCouncilfeelsamemberhasbroughtYoungIndependenceintodisrepute;

X.6.7.2AmemberiswilfullyactingagainsttheinterestsofYoungIndependence,or

X.6.7.3RepresentationsaremadetotheCouncilconcerningindividuals.

(c)Theapproximatedatefordistributionofvotingpapers/Candidates'details;(d)Thedatefromwhichcampaigningisallowedtobegin;

(d)Theclosingdateforreturnofvotes,and(e)TheexpecteddateofCountandDeclarationofresult.

X.7.2.2TheReturningOfficershallpublishontheYIwebsiteandtheYImailinglistatleastaweekinadvanceofcloseofnominations;thedateoftheelection,thetimetablefortheelection,thenumberofpoststobefilledandinstructionsforcandidatesseekingnomination.

X.7.3.1Avalidnominationshallconsistofacandidate'sconsenttonominationandthesignaturesofaProposer,aSeconderandeightAssentors.Allmustbefullypaid-uppartymembersingoodstandingontheclosingdatefornominations.TheProposer,SeconderandfiveoftheeightAssentorsmustbeYImembers.

X.7.3.2Proposersandsecondersmayproposeorsecondonlyonecandidate'snominationforms.

ComplaintsProcedure AA.3.1Thecomplaintsprocedureshouldbeinvokedonlywhenallotherreasonablestepshavebeentakentoresolveanissueordispute,orwhereanactionissoseriousthatonlydisciplinaryactionisappropriate.AA.3.2AcomplaintmustbemadeinwritingtotheGeneralSecretary.Thecomplainantmuststatethegroundsforthecomplaint,quotingspecificbreachesofthePartyConstitutionorRulesofProcedureandincludinganysupportingfactualevidence.AA.3.3TheGeneralSecretarymay,athisdiscretion,consultwiththecomplainantand/ortherespondenttoascertainadditionalinformationand/orevidencebeforereferringthemattertothePartySecretary.AA.3.4IfthePartySecretaryconsidersthatthecomplaintisnotsubstantive(i.e.thatitdoesnotrelatetoaspecificbreachofthePartyConstitutionorRulesofProcedure),heshalldismissthecomplaint.AA.3.5Arespondentwhopromptlyacknowledgesfaultmay,atthediscretionofthePartySecretary,beissuedwithadviceastofutureconductorawrittencautionastofuturebehaviour.Insuchcircumstances,nofurtherdisciplinaryactionshallberequired.

AA.3.6Oncethedocumentspecifyingthenatureandparticularsofthecomplainttobeheard,itshallbesenttothecomplainant,totherespondentandtothenominatedvotingmembersoftheNECwhowillhearthecomplainttogetherwithcopiesofwitnessstatements,documentsandothermaterialformingthecomplaintproducedunderProcedureforhearings,below.

Hearings AA.4.1IfthecomplaintisnotupheldattheHearing,thecomplaintshallbedismissed.Ifthecomplaintisupheld,theDisciplinaryPanelshalldecidewhatactionistobetakenandmayimposeapenaltyasdescribedinArticle11.5ofthePartyConstitution.Iftied,thePanelChairmanshallhaveacastingvote.TheDisciplineCommitteeshallatalltimesexerciseitspowerswithproperregardfortheprincipleofproportionality.AA.4.2ExpulsionfromthePartyalsoentailsexpulsionfromallPartyofficesheld.AA.4.3ArulingbytheHearingPanelshalltakeimmediateeffectunlessthePanelexpresslystatesotherwise.

AA.4.4AverbalrulinggivenbytheHearingPanelshallbeconfirmedinwritingtothecomplainantandrespondentassoonaspracticable.

Appeals AA.5.1UnderArticle11.7oftheConstitution,theNECshallcauseanappealhearingtobechairedbyanIndependentChairmanandmayappointsuchaChairmanwhoneednotbeamemberoftheParty.NopersonwhosatonaDisciplinaryPanelatfirstinstancemaybeamemberoftheappealpanelforthematterathand.AA.5.2AnappealagainstthefindingsofaDisciplinaryPanelmustbelodgedinwritingwiththeGeneralSecretarywithinfourteendaysofreceiptofthewrittenfindings.Anappealmayonlybelodgedbyarespondentwhereacomplainthasbeenupheld.Theappealmuststatethegroundsfortheappeal,whichmaybeagainstthefindingsorthepenaltyimposedorboth.Theappellantshallsendafeeof£500towardsthecostsofholdinganappealhearing. AA.5.3 The Appeals Chairman shall appoint two voting members of the NEC (who may not be members of the original Disciplinary Panel) as an Appeals Panel (hereinafter referred to as “the Appeal Panel”). AA.6.7TheburdenofproofrequiredforacomplainttobeupheldagainstanyRespondentatadisciplinaryhearingshallbethebalanceofprobabilities.

CC.8.1ThecountshallbeconductedatalocationtobeannouncedtoallthecandidatesbytheReturningOfficer.TheReturningOfficershallappointthetellerstoassistinthecount.Candidatesandtheirrepresentatives,toamaximumnumberpercandidateasdeterminedbytheReturningOfficer,mayattendthecount.Candidates,theirrepresentatives,proposerandassertorswillnotbepermittedtoassistinthecount.TheReturningOfficershallarrangetocountthenumberofvotingpapersreturned,identifyandcountinvalidvotingpapers,calculatetheturnout(thepercentageofvalidvotingpapersreturnedagainstthenumberofvotingpapersissued)andcalculatethenumberofvotescastforeachcandidate.Candidatesmaybepenalisedwherenecessary,e.g.underV.5.3.TheReturningOfficer’sdecisioninallmattersconcerningthecountshallbefinal.

CC.8.2Doubtfulvotingintentions:

CC.8.2.1Wherethereisdoubtaboutvotingintentions,theReturningOfficermayaskcandidatestoagreehowtocountthevote,buttheReturningOfficer’sdecisionshallbefinal.

CC.8.2.2Inarankedelection,whereavoterclearlyindicatestheirvotesbymeansofcrossesorotherwisemakestheirintentionsclearastowhichcandidatestheyintendtovoteforwithoutrankingthem,eachvotecastshallbeconsideredtohavethevalueof1vote.

CC.8.3Invalidvotingpapers:

Avotingpapershallbedeclaredinvalidif:

• Thevotercastmorethanthepermittednumberofvotes.• Thevotingpaperdoesnotbearavalidserialnumber.• Thevotingpaperisacopyofanoriginalvotingpaper.• Theintentionsofthevotercannotbedeciphered.• Thevotingpaperhasnotbeenreceivedbytheclosingdateforthe

receiptofvotingpapers.

CC.8.4Storage:

Allvotingpapers,calculationsheets,andacopyofthesigneddeclarationshallbestoredinsealedpackages,countersignedbyanindependentwitness,tobestoredatthediscretionoftheReturningOfficerfornotlessthan12monthsfromthedateofthecount.
