Accessing Student Data

• Access to student information has major benefits for teachers and students.

• However, it also creates a responsibility for teachers to use this information in line with Privacy laws.

• We need to balance the risk of misuse of student information with providing appropriate access for teachers to the information they need to effectively carry out their role.

‘The only purpose for which teachers may use

student data from the Ultranet is when it is

necessary to enable the teacher to fulfil their official teaching or

pastoral care duties to that student’

Safe and Responsible Online Behaviour

The internet and digital technologies are now very much a part of life and learning.

As an increasingly interactive medium, it brings with it exciting educational opportunities, but at the same time it also brings some risks.

Safe and Responsible Use

• Schools have an important role in educating and supporting students to participate safely and responsibly in online environments.

• A teacher’s duty of care extends to any online environment that DEECD has provided including the Ultranet.

Page 11: ULTRANET Release 1 Information for schools: Privacy Safe and Responsible Use Copyright and Intellectual Property

• The Ultranet will open up the classroom to learning opportunities and experiences that utilise the power of social networking in an environment that is safer than many environments that students currently access via the internet.

• However, in enabling social networking, the Ultranet has the potential to present new challenges for student wellbeing at the school level.

• Cyberbullying is probably the greatest risk.

WE SPACE

• A collaborative "We" space were I am able to share my work with a controlled/known group of peers or colleagues

• Ultranet eXpress, Design, Collaborative Learning and Community Spaces

SEE SPACE

• A public space where the whole world can “See” what I publish

• World Wide Web, school websites, online published newsletters

• Global teacher, web conferencing events, published FUSE content, Ning, teacher tube (not the Ultranet)

• No SEE spaces on the Ultranet

ME SPACE

• A private "Me" space were I am free to reflect, record my thoughts, take responsible risks and try new things, only I can see it

• Ultranet Home Page and My Content

ME WE SEE

Cyberbullying

• The Ultranet is not the Internet – it is a WE space. It is safer place than the Internet for students to collaborate and communicate.

• All online spaces have a teacher as a moderator.

• There are filters for bad language.

• Students can easily flag inappropriate content.

• Learning Contacts is a reciprocal relationship.

• No anonymous postings. Students will also be prompted to note that their content is not inappropriate or hurtful when it is uploaded.

• All postings are logged and can be audited.

Safe and Responsible Use

A range of ‘controls’ have been put in place to reduce cyber bullying on the Ultranet:

Page 14: ULTRANET Release 1 Information for schools: Privacy Safe and Responsible Use Copyright and Intellectual Property

Ultranet Terms of Service• All users need to accept the Terms of Service when logging in. • All school staff should read them when they login for the first time.

School Level Acceptable Use Agreements• A new template is available to assist school communities to develop

agreements which articulate appropriate use of digital technologies in their community.

• Current AUA’s should be reviewed prior to Ultranet deployment in line with the new templates.

• What does your AUA say?

Student Engagement Policy• Schools must include a statement about bullying and cyber bullying

behaviours in their Student Engagement Policy .• What does your Student Engagement Policy say?

Cybersafety Programs

• Cybersafety programs are a critical component of providing a safe environment for students. These should not be one-off programs.

• Cybersafety awareness and action needs to permeate all aspects of our online interactions. It is a key responsibility of a teacher in every classroom, every day.

Safe and Responsible Use

• All staff need to understand and model, safe and responsible behaviours when using the Ultranet.

• If inappropriate behaviour does occur it needs to be handled within school policy as you would any other inappropriate behaviour.

Page 16: ULTRANET Release 1 Information for schools: Privacy Safe and Responsible Use Copyright and Intellectual Property

• Teachers have a responsibility to educate and model, but students also have a responsibility to use the Ultranet safely.

• This responsibility is most effectively developed when students are involved in ongoing discussions and decisions regarding cybersafety.

• A new website ‘Leading Online’ will provide schools with a range of resources to support safe and responsible use of the Ultranet.

Safe and Responsible Use of the Ultranet

Safe and Responsible Use

Page 17: ULTRANET Release 1 Information for schools: Privacy Safe and Responsible Use Copyright and Intellectual Property

• In Australia, copyright law is contained in the Commonwealth Copyright Act 1968 (Copyright Act)

• The Ultranet, because of its scope for sharing materials, highlights that we all need to be more vigilant about using material that is not our own work.

Copyright and Intellectual Property

Copyright and Intellectual Properly

• You will be prompted to consider Copyright and Intellectual Property whenever you upload content into the Ultranet.

• A process is available for you to reference the source of any material that is not your own work.

How the Ultranet will support you not to breach copyright:

Page 18: ULTRANET Release 1 Information for schools: Privacy Safe and Responsible Use Copyright and Intellectual Property

Complying with copyright

1. LINK to content, rather than uploading it.

2. Use content from the Ultranet endorsed repository.

3. Use licensed content such as that available from Creative Commons or NEALS.

4. Rely on a Part VB or VA License under the Copyright Act.

If not using your own work:

Copyright and Intellectual Properly

Page 19: ULTRANET Release 1 Information for schools: Privacy Safe and Responsible Use Copyright and Intellectual Property

Teachers can use:

• 10% or less of a third party text

• Images that are surrounded by text

• Movies or programs broadcast on television or radio

• Music in limited circumstances

Part VB or VA License

Copyright and Intellectual Properly

DEECD pays substantial fees to Copyright

Agency Limited (CAL) every year for the

educational copying and communication of works used under Part VB of

VA of the Copyright Act. Any wider use of

copyright materials is against the Law.

Teachers can use copyrighted content for educational purposes under Part VB and VA of the Copyright Act.

Using Endorsed Content from Ultranet Repository

White Content can be copied and modified

Green Content can be copied and modified

Endorsed content from the Ultranet repository while cleared for IP and copyright, still carries usage conditions:

Page 21: ULTRANET Release 1 Information for schools: Privacy Safe and Responsible Use Copyright and Intellectual Property

Other issues

• Teachers cannot rely on Part VB when uploading information that is not for education purposes.

• 10% rule is cumulative across the Ultranet.

• Minimise duration of content being on the Ultranet ie: remove to personal repository when not in use, link and take down multiple versions.

• All third party content must have the source acknowledged.

• If you are aware of infringing material on the Ultranet – you should seek to have it removed as soon as possible.

Copyright and Intellectual Properly

Page 22: ULTRANET Release 1 Information for schools: Privacy Safe and Responsible Use Copyright and Intellectual Property

• LINKING to content

• Using content from the Ultranet ‘endorsed’ repository

• Using licensed content such as that available from Creative Commons or NEALS

• Relying on the Fair Dealing defence, which also applies the 10% rule
