IntroductionGuide

The state of California grants unemployment insurance to residents who have become temporarily unemployed. These insurance benefits are meant to assist job seekers financially while they are searching for a new job However, not all unemployed Californians are eligible to receive unemployment insurance benefits. To meet the eligibility criteria needed to receive weekly unemployment

benefits, applicants must:

California job seekers may file an unemployment insurance claim by fax, by phone, or online. The online unemployment application is recommended because it is accessible 24/7. The EDD unemployment application line (1-866-333-4606)is available Monday through Friday, from 8:00 a.m. until 12:00 p.m. If the unemployment insurance claimant is eligible for benefit payment, the claimant will be contacted by the California Employment Development Department (EDD) to schedule a telephone interview. The telephone interview is meant to verify that all of the information given by the claimant and their former employer matches. For this reason, applicants are encouraged to gather all documentation necessary to give the interviewer detailed and accurate answers.

If the unemployment claim is accepted, the claimant must certify for payments every week. During the certification process, the claimant will need to meet continued eligibility requirements. Each week when certifying for benefits, the claimant must answer a questionnaire pertaining to their job search.

If the unemployment claim was denied, the petitioner will receive a letter in the mail outlining why unemployment benefits were denied. If the petitioner feels that they were wrongfully denied, they may file an unemployment insurance claim appeal with EDD. During the appeal, it is in the petitioner’s interest to gather all documentation that may help prove that they were wrongfully denied.Unemployment benefits may be extended for an additional several weeks during times of high unemployment. There are currently no unemployment extension benefits available in California since August 2012.

The “base period” is an employment cycle consisting of 3-4 months. The California Employment Development Department will predetermine the base period according to the date the unemployment claim was filed. Applicants who have not worked enough hours or received enough wages during their chosen base period may not be eligible for unemployment insurance in California. California jobseekers who have been fired from their previous job may schedule a phone interview with EDD to investigate and resolve the reason for job separation. Both the petitioner and the former employer will have an opportunity to discuss the situation with the interviewer. A letter will be sent to both the petitioner and the former employer after the interview. The letter will explain to both parties EDD’s decision on whether the claimant is eligible for California unemployment benefits. The employer and the petitioner are both given the right to file an appeal to EDD’s decision. It is the petitioner’s responsibility to maintain eligibility once an unemployment claim has been processed and accepted. The petitioner is required to certify the claim every other week in order to receive unemployment benefit payments. It is during the biweekly certification process that the status of the claimant’s

eligibility will be reevaluated. The biweekly certification can be completed online, by phone, or by mail. To remain eligible for unemployment insurance after a claim has been accepted, the claimant must:

But be sure to verify unemployment eligibility before filing a claim. The California unemployment insurance application may be accessed online, by phone, or by fax. All applications will be processed by EDD within a few weeks. Once EDD has come to a decision, a letter will be sent to the petitioner notifying them of acceptance or denial of benefits. Applying for unemployment benefits online may be the most convenient method, as the application may be accessed at any time. The unemployment insurance application may also be completed by phone with the assistance of a customer service representative. This line is open Monday through Friday, between 8:00 a.m. and 12:00 p.m. This service is available in several languages. The customer service number for the California unemployment application is 1-800-300-5616. Petitioners also have the option of faxing an unemployment application. The form may be printed from the EDD website. The petitioner may fax the completed form to the EDD office at 1-800-547-9565. The petitioner may also use the EDD office locator to find the closest office to turn in an application in person.

Temporarily unemployed California residents may file a claim to receive unemployment benefits until they become reemployed.

Petitioners who have served at least 18 months with the United States military or federal government may fill out a special unemployment insurance application by phone. Alternatively, special applications may be printed and faxed to the EDD office. Before the application process begins, the applicant must have the following information ready:

If an unemployment claim has been accepted by EDD, the claimant will be required to update their application every two weeks in order to receive payment. The unemployment claim may be accessed by phone or online. Online claims may be accessed most quickly and at any time. Unemployment claims accessed by phone may only be available during the line’s weekday open times. Failure to access and update an unemployment claim every 2 weeks may result in a decreased, delay, or denial of benefits.

Appeal if DisqualifiedHow to Request an

Not every unemployed California resident is eligible for state unemployment benefits. In fact, applicants who have met all eligibility requirements are not necessarily guaranteed unemployment benefits. If EDD determines that an applicant is ineligible to receive unemployment benefits, he or she will receive a letter outlining the reasoning for the decision. The applicant reserves the right to file an appeal for the claim if he or she feels that they have been wrongly denied benefits. To begin the appeal process, the petitioner must mail a letter to EDD. This letter must include:

A statement of the intent to repeal the unemployment benefit decision

A copy of the letter stating the predetermination of benefits

The name and address of all legal representatives

The reason why the appeal was created

Mailing address

The Employment Development Department Appeal Form may be sent along with the request for appeal. The unemployment claim appeal form is included in every predetermination of benefits letter. Once the EDD office receives the letter, the claim will be reviewed to verify that benefits have not been wrongfully denied. If EDD officials determine that the original decision was legitimate, an appeal claim will officially open. Former employers also reserve the right to appeal an unemployment decision. In this case, the employer must mail the EDD office a letter stating their intentions of appealing the decision, as well

as their business contact information and the petitioner’s employee information. The closest EDD office may be found with the office locator.

Once an unemployment appeal claim has been opened, the Office of Appeals will continue to review the case. The Office of Appeals will schedule hearings to help come to a decision. During appeal hearings, the petitioner will have the opportunity to gather any evidence that will help prove the case that they are indeed eligible for unemployment benefits. In cases when the petitioner has been accused of misconduct, the petitioner’s former employer may be invited to participate in the hearings. Petitioners who have filed an appeal for California unemployment benefits but live in another state are not required to physically attend the hearings. Alternatively, a hearing may be completed over the phone for former residents. After the final hearing is over, a judge specializing in Administrative Law will come to the final decision.

The appeal decision will be mailed to the petitioner’s house. If the petitioner still believes that benefits were wrongfully denied, they may file a second level appeal with the EDD office within 30 days.

To be prepared for the interview, the petitioner will need all relevant documentation pertaining to recent employers and the reason for separation with the last employer. If a job offer was given and rejected since the claimant was last employed, be ready to provide relevant documents and the reason why the job offer was not accepted.

Benefits Extensions in CaliforniaUnemployment Insurance

However, during periods of high state or federal unemployment, the United States government grants an unemployment benefits extension to claimants who are still unable to become reemployed. Currently, neither the federal government nor the state of California meet the unemployment rate requirements needed to grant recipients an unemployment benefit extension.

In California, when the unemployment rate reaches high levels, the Emergency Unemployment Compensation extended benefits (EUC) are given to eligible claimants. Once EUC benefits have been exhausted, some claimants may be eligible for Extended B¬¬enefits (EB) if the employment is still unusually high. Both ED and EUC benefits are paid for by the federal government, not by state employers. More information, see the full unemployment extension details.

Once state unemployment benefits have been exhausted by a claimant, benefits extensions are received in the following order:

In every state, unemployment insurance benefits are granted for a finite amount of time. After several weeks, the claimant must wait until they are unemployed after becoming reemployed before they are eligible to open another unemployment claim.

If unemployment remains high for a long enough period of time, unemployment claimants may be eligible to receive unemployment benefits for an additional 83 weeks in California. When receiving extended unemployment benefits, continued eligibility requirements may become stricter for claimants, especially in regards to reemployment and searching for a job.

However, there are no unemployment extended benefits available at this time for California residents. As of August 2012, the state of California is no longer eligible for unemployment benefits extensions. After the original claim has been exhausted, California residents must become reemployed before being eligible to receive unemployment benefits.

Become Employed AgainWhat To Do When You

Once a claimant accepts a job offer it is his or her responsibility to notify the California Employment Development Department by ceasing to certify for unemployment benefits every 2 weeks. Failure to report employment to EDD may result in permanent disqualification from unemployment benefits in the state of California.

To stop receiving unemployment benefits in California, the claimant must simply stop certifying for benefits. Once a claimant stops certifying an unemployment claim every 2 weeks, the claim will become inactive. The claim may still be accessed through UI online when it is inactive. The claim can be reopened if the petitioner becomes unemployed again within 52 weeks. When a claim is reopened, the claimant may continue to receive unemployment benefits on the same claim. Alternatively, the claimants that certify benefits by mail may opt to notify the EDD office of employment by ceasing to mail a Continued Claim form each week. With both methods, it is not necessary to notify the EDD office specifically.

If a claimant continues to certify for unemployment insurance benefits after becoming employed full-time, he or she is committing insurance fraud. Insurance fraud is defined as giving false or incomplete information to force eligibility for benefits. If a petitioner is caught committing unemployment insurance fraud, he or she may become ineligible to ever apply for California unemployment insurance benefits again.

If unemployment benefits are received after the petitioner has received a job, the petitioner may mail the payment back to the EDD office to avoid a fraud investigation. To send back a residual payment, the claimant must mail to EDD:

If an employed claimant fails to give back an unemployment payment and fraud has not been indicated, the overpayment will be deducted out of the claimant’s next tax refund check.

The California Employment Development Department (EDD) offers a range of services for recipients of unemployment insurance. The two main programs that facilitate these services are the America’s Job Center of California (AJCC) and the CalJOBS program. Between these two robust programs, you will find everything you need to get your career back on track.

Career with the CaliforniaUnemployment Office

America’s Job Center of California (AJCC) is the main program for advancing employment and career goals for residents. This program is administered by the California Employment Development Department (EDD) which has prioritized the use of online employment systems. However, in-person workshops and consultations are also included. The program’ provides access to an extensive network of employers and has been successful in placing many job seekers in positions that match their skills. The AJCC is active in supporting communities and preventing disadvantaged youth from a life of poverty, and is responsive to local communities and organizations. For example, one initiative that was started in Sacramento provides at-risk young adults the opportunity to start apprenticeships. If you are on unemployment, you can also access other training services such as vocational programs that provide critical skills needed in today’s market, like how to use word processing and database applications.

If participants only are looking for help to enroll for certain classes, such as math or reading to obtain further education or a GED, this program gives them information and helps them make informed decisions. For other services and training opportunities, or information on taking another test preparation course, applicants can check out the Workforce Innovation and Opportunity Act program, which provides access to training for a variety of job roles. For those already receiving unemployment benefits, the California Training Benefits program provides separate training customized for each individual. The unemployment office can also assist with resume-building, cover letter writing, skills assessment and interview preparation.

The California EDD also runs an online career advancement system called the CalJOBS program, which provides services like resume-building, work references, and access to training programs. Applicants will have to have a Social Security number and register with the CalJOBS website to complete an application. Once registered, you will have access to an application that creates resumes. If you already have a resume, just upload it to the system and it will be available for browsing by prospective employers. With access to the employer database, you can opt to have instant notification through text message or email of new job openings and offers. Job training opportunities are diverse and encompass a range of skills. Participants may attend workshops helping them gain knowledge and planning for building their previous career or a new one. For example, the topic might be about labor market statistics on types of work, or a current trend in training for a certain profession. Requirements for using the CalJOBS career system are a stable internet connection, as well as a web browser that is up-to-date and has a bandwidth of at least 33.6 kb/s. The program was started in response to severe strain on the economy due to the 2008-2009 recession and has been instrumental in preventing those who are chronically unemployed from losing their benefits.

In most cases, unemployment extensions are unavailable nationwide unless the federal government initiates them. The reason is that extended benefits become available only when the state unemployment rate becomes too high. The program was started by the federal government, which currently approves up to 36 weeks of unemployment benefits for recipients. However, these extra weeks are only initiated at the federal and state level, and apply to all individuals at the same time. All unemployment recipients should receive a notice in the mail regarding activation of an extension. One exception is jobs training programs, which can be extended even if there is no federal extension and your claim is about to run out. Any apprentice, or vocational training program that is started before the claimant stops receiving benefits, can be continued until the program ends. Recipients will just have to submit a request through the unemployment application online or report the training to the EDD. The process for calculating weekly unemployment benefits begins with determining your base period wages.

The base period will be a year’s worth of earnings depending on when you filed your claim and the highest quarter earnings. See the next sections to apply your wages according to these criteria and figure out an estimate for your weekly benefit amount.

California unemployment benefits are generally calculated based on your income during the first four of the previous five calendar quarters. For example, if filing in February, the base period would begin on October of the 2nd previous year and end on September of the previous year. If you do not meet the income requirement under this base period, there is an alternate base period which consists of the last four completed calendar quarters. So, if starting the application in Jan-Mar, the base period would be the entire previous year, excluding January and February of the present year. According to the California EDD, once the base period has been established, the income requirement is to have earned at least $1,300 in one quarter of the base period. If this amount is not earned in any quarter, then you would have had to earn $900 in one quarter and at least 1.25 times that amount in all three other quarters combined, which would be $1125. The quarter with the highest earnings is used to determine the weekly benefit amount. For example, if you earned $5,000 in your highest quarter, but no more than $1000 in the other quarters, then your weekly benefit would still be calculated based on the highest quarter ($5,000) amount.
