Our feature for this month’s United Contractor’s magazine is UCON’s Member Projects and People. As you look at these projects and the people, think of the effort and commitment that went into making their project and thus their people successful. The other day I heard an interesting phrase referring to a daunting task as “Eating an Elephant.” It struck me as funny, but also very poignant. When I was young and feeling overwhelmed with school, or sports, or just being a teenager, my parents would always tell me to take one step at a time and work your way through. Each one of these projects represents just that, step by step, or bite by bite, the elephant gets eaten.

As an industry, or an industry organization such as United Contractors, the eating of the elephant can’t be done by one person, and it certainly can’t be eaten at one time. The issues that UCON

tackles each year— whether it’s working out an equitable union agreement, or fighting red tape—is like eating an elephant. As an industry, it takes a knife and a fork from everyone to get the job done.

I saw my role as your United Contractors President as one of inspiration and promotion of our industry which I wrote in my “Getting to Know Your President” article. To inspire members to get involved was my point, and not as one of my good friends said, “I’m going to cut your article out and tape it to my wall in the bathroom and each morning I’ll look at it and be inspired.” Not quite what I was referring to.

This past year has been extremely enjoyable for me. What I find most fulfilling is to say that I did my part and I will continue to do my part, and that I gave of my time and I will continue to give my time, so that I can be an active part of a very successful organization that

For generations before us, simply having a job was something to be thankful for. It didn’t matter if you liked your job. Didn’t matter if it came with work/life balance. Didn’t matter if it met your creative and personal needs for growth. But that was then and this is now. Work needs to matter. Today, it cannot be just about getting a paycheck. Finding meaning and importance in what we do is a huge part of being happy and fulfilled. For me, being thankful for life at UCON is no different. Our organization touches hundreds of companies and thousands of people – but to be worth anything we have to have a really good reason “why”. And it is these I am most thankful for. So in the footsteps of David Letterman, I submit my 2015 Top Ten list of the things I am thankful for at UCON:

For the rare opportunity to lead a cutting edge, hard driving, top business organization that does not have profit as its main motivation.

To be part of an organization that cares and attracts hundreds of volunteers annually. An organization that put together our UCON Veterans Initiative which has employed every soldier or sailor referred to us in 3 days or less.

Thankful as a State of Mind: The Top Ten At UCONFor some people their big annual holiday is Christmas, or maybe their birthday. For me it has always been Thanksgiving. Not just the bonding of family and the overeating. No, each year, as Thanksgiving rolls around, I try to take stock of life from a perspective of the glass half full. I take a minute to try to appreciate how great life actually is. No matter what troubles or setbacks or disappointments have occurred, there is

Your HR Cheat SheetNew Laws to Watch Out for in 2016

The following are some new employment-related laws that impact California construction employers, based on available updates at the time this magazine went to print. These laws will be effective January 1, 2016, unless stated otherwise. A more detailed Legal Bulletin is being sent out to our contractor members.

Corrections to Technical Pay Stub Violations (AB 1506):Many employers, including some UCON members, have been found to be in violation of Labor Code Section 226, which specifies what information must be included on paycheck stubs or some other form of itemized wage statement with each paycheck. Even when these were clerical errors that did not harm the employee (such as an abbreviation of the employer’s name), employers have been subject to needless litigation and penalties through PAGA (Private Attorneys General Act) lawsuits. While AB 1506 does not fix all the abuses of PAGA, it at least gives employers 33 days to correct two types of technical violations involving failure to provide employees with itemized wage statements:1. Inclusive dates of pay periods2. Name and address of legal entity (the employer)

Gender Wage Equality (Fair Pay Act, SB 358):Existing laws at the state and federal level currently prohibit employers from paying men and women differently for performing equal work at the same establishment. This law expands the requirement for equal pay to “substantially similar work” and to the entire business enterprise (not just a single location), and prohibits retaliation against employees who invoke the law, plus protects employees who discuss wages (which was already in place through existing laws). Employers will need to carefully analyze job positions and the employees filling them to determine which jobs are “comparable” to each other and to make sure that any pay differences for these comparable jobs are due to clear reasons having nothing to do with gender that the employer can produce as proof if a lawsuit is filed.

Expansion of Labor Commissioner Enforcement:• SB 588 expands what the Labor Commissioner can do to enforce

the law, including issuing levies, liens and stop orders to enforce judgments against employers of nonpayment of wages.

• AB 970 expands the Labor Commissioner’s enforcement authority to local overtime and minimum wage laws, as well as to the payment of employer-required expense reimbursements.

2016 Employer Poster Updates:

• California Paid Sick Leave Notice – This notice was included in all 2016 postings

• Workers’ Compensation – Revisions have been made to the Notice to Employees

• Whistleblowers – Revisions are being made to this notice to reflect changes in the law made by AB 1509

• There are also pending changes to the Pregnancy Disability Leave notice (Notice A), as well as to the DFEH Discrimination and Harassment notice (California Law Prohibits Workplace Discrimination and Harassment).

LABOR

Prevailing Wage Expansion:• AB 219 extends prevailing wages to hauling and

delivery of ready-mixed concrete. This UCON-opposed bill is expected to add further layers of complication and confusion to the already-difficult area of on/off-haul trucking labor compliance. It does not go into effect until July 1, 2016 (for projects awarded on or after that date). UCON will be working on providing guidance and clarification for our members in early 2016.

• AB 852 expands the definition of “public works” for prevailing wage purposes to certain private hospital projects funded with conduit revenue bonds issued on or after January 1, 2016.

Workers’ Compensation:Several bills were passed that impact workers’ compensation, including revisions to the DWC-1 Form (Claim Form and Notice of Potential Eligibility), requirements for forms and notices to be made available in more languages by 2018, and providing investigation and enforcement authority to the California State License Board to secure the payment of valid and current workers’ compensation insurance.

Leave Laws:Two new laws make revisions to School Activities Leave (SB 579) and National Guard Leave and Protections (AB 583). Additionally, SB 579 amends California’s “kin care” law to be in conformance with California Paid Sick Leave.

Increase to Minimum Wage:In accordance with previously enacted law, California’s minimum wage increases to $10.00 per hour. While union wages are typically well above the minimum, California employers also need to pay attention to the minimum wage for non-union employees, including exempt employees as the rise in minimum wage impacts those minimum wage thresholds. California employers also need to pay attention to any increases in localities that have their own minimum wage (i.e., San Francisco, San Jose, Oakland).

Electronic Certified Payroll Reporting:UCON has heard from 30+ contractors regarding their concerns, confusion and frustration with the new Department of Industrial Relations (DIR) electronic certified payroll reporting (eCPR) system, which was implemented last year despite strong concerns and opposition from industry. UCON has written to the Division of Labor Standards Enforcement (DLSE) to request clarification regarding the core problems we’ve been informed about from contractor staff who are using the new system. Additionally, UCON has requested that the scheduled date of January 1, 2016 for CPRs on all projects to be required electronically be delayed until all of these issues have been resolved. We are in touch with DIR and will notify members of any changes, meetings or request for input. The list of contractor concerns that we have relayed to DIR was sent out to members in recent bulletins. A lot more than autumn leaves were rustling in the Nation’s Capital in late October. The House Transportation & Infrastructure (T&I) Committee released a six-year highway and transit bill—the Surface Transportation Reauthorization and Reform Act (STRRA)—even as the chamber grappled with the leadership battle that began in September with the resignation of Speaker John Boehner (R-Ohio).

The T&I Committee marked up and approved the bill on Oct. 22; a move that brings reauthorization one step closer to completion by the end of 2015.

Another short-term highway and transit funding authorization extension is likely to allow for additional time for the full House to take action on the bill. And the creation of a conference committee to resolve the differences between STRRA and the Senate-passed DRIVE Act will also offer another

Governor to Address UCON Legislative PriorityWe Continue to Push for Prompt-Payment On Change-Order Work

Despite virtually no “no” votes in the Senate or Assembly and the removal of the vast majority of state and local Agency opposition, Governor Brown vetoed AB 1347, a UCON-sponsored bill aimed at getting contractors paid fairly, and on-time, for extra work performed. Although the bill targeted all local agencies, the UC/CSU system and Caltrans, the single biggest opponent of the bill was Caltrans. Nonetheless, in his veto letter, Governor Brown said that he recognizes the seriousness of this issue and directed Caltrans,

specifically, to fix this issue internally. Governor Brown’s veto message read, in part:

“I am committed…to ensuring timely payment for work ordered by public agencies. In the interest of furthering that goal I am directing my departments to immediately work with industry partners and the proponents of this bill on ways of improving our prompt payment policies.”

As such, Caltrans and UCON, along with our industry partners, have begun discussions to determine how Caltrans can internally resolve the matter of extreme delays on payment for change ordered work. UCON has reached out to all contractors who sit on the Caltrans Construction Partnering Steering Committee to participate in the meeting(s) with Caltrans leaders to improve the current system. In addition, UCON is working with the Author, Assemblyman David Chiu and the Governor’s administration to introduce legislation in early 2016 aimed specifically at local counties and agencies. While we are disappointed AB 1347 was vetoed, our association carried the banner on this issue to the highest levels and made legislators on both sides of the aisle, local county and city officials, and Governor Brown’s administration aware of this glaring problem. We brought together stakeholders from all sides. We engaged our industry and made an important mark in Sacramento. Providing a global fix to the loop hole in prompt pay that exists regarding change orders is a big lift, but we are confident we will get this done.

Graniterock(Left and below) Graniterock’s Runway Safety Area project at Monterey Regional Airport is part of a mandate by the Federal Aviation Administration to meet new runway safety standards.

Graniterock construction crews worked for several months to build a series of retaining walls in preparation of installing blocks made of a special concrete designed to arrest or slow an airplane unable to stop with normal braking.

Nearly 4,000 EMAS blocks (Engineered Materials Arrestor System), have been installed on each end of the Monterey runways.The project involves a 100-foot-tall terraced retaining wall with pavers and six terraced soil nail retaining walls—100 feet tall and 1,000 feet long—sculpted with shotcrete and stained to look like sand bluffs and blend in with the natural environment (graniterock.com)

FMG A Graniterock Division(Left) Graniterock’s cold-in-place recycling team is out to prove the alternative paving method deserves a place on big, heavily-traveled roads with the Construction Division’s $3.7 million Lawrence Expressway rehabilitation project (Santa Clara County’s Roads and Airports Department). The CIR segment involves four traffic lanes in each direction, three intersections and a 2-inch overlay. High traffic volume (nearly 100,000 cars travel Lawrence Expressway each day) makes the project more challenging than others. In addition to CIR, the Lawrence Expressway project includes 4.5 miles of micro surfacing, 6 miles of crack filler, 71 concrete locations for curb and gutter improvements and miscellaneous electrical work. Graniterock will provide nearly 10,000 tons of asphalt from the Redwood City plant (graniterock.com).

RGW Construction, Inc.(Photos above) Highway 80 “Lift” project. This project on Highway 80 outside of Loomis required the raising of six highway bridges to meet the new Federal bridge clearance standard of 16’-6”. RGW designed and installed the temporary support and jacking systems that enabled the “lifting” of each concrete bridge (weighing between 2 million and 5 million lbs.), raising it between 18” and 21”. After installing the support structure the bridge was closed to traffic, sections of the abutments and columns were removed, then each bridge was raised in a one or two night operation. Then the abutments and columns were replaced, new approaches were installed and traffic was opened over the bridges. Start to finish: Caltrans allowed just 17 to 20 days to complete each bridge. RGW was able to beat that schedule by a minimum of 5 days on every bridge. RGW’s project team was Jake Lewon, PM, Bill Shurbert, Structure Superintendent, Nate Inman, Roadway Superintendent. Project Foremen are David George, Bob Bailey, Robert Burns, Mike Buttacavoli and Richard Kent (rgwconstruction.com).

OSHA’s Preliminary 2015 List of Top 10 Safety ViolationsFall Protection tops list—again!

OSHA’s preliminary list of the top 10 most frequently cited workplace safety violations for fiscal year 2015 was announced in September at the National Safety Council Congress & Expo in Atlanta. The list, shown at left, cites the OSHA standard and number of violations. The final 2015 top 10 citations report is expected to be released by OSHA in December, 2015.

While the ranking of categories has shown minor variations from year to year, the recurrence of top 10 categories has remained almost constant for at least the last six years. Fall protection remains the most frequently cited safety category, with the number of violations already exceeding 2014 data by over 9%. Scaffolding ranks third with almost 4300 citations (up 6%), and Ladders ranks seventh at close to 2500 citations (2% over 2014).

The high incidence and persistent recurrence of top 10 construction violations can serve as a clear road map of where to focus attention to raise hazard awareness. It is more important than ever for employers, contractors and workers to increase safety awareness through planning, providing the right equipment and training to help eliminate construction hazards, with particular emphasis on OSHA’s top 10 categories that are applicable to their worksites.

SAFETYsafely. Planning includes deciding how the job will be done, what tasks will be involved and what safety equipment may be needed to complete each task. All necessary equipment and tools should be available at the construction site.

PROVIDE: To protect workers who are six feet or more above lower levels, employers should provide fall protection and appropriate equipment for the job, including the right kinds of ladders, scaffolds and safety gear. If workers use personal fall arrest systems (PFAS), they should be provided harnesses to tie off to an anchor, and all fall protection equipment should be regularly inspected.

TRAIN: When workers understand proper set-up and safe use of equipment, falls can be prevented. Employers should train workers in hazard recognition and in the care and safe use of ladders, scaffolds, fall protection systems and other equipment they’ll be using on the job.

OSHA has been conducting a nationwide outreach campaign for several years to raise awareness among workers and employers about the hazards of falls from ladders, scaffolds and roofs. OSHA has partnered with the National Institute for Occupational Safety and Health (NIOSH) and National Occupational Research Agenda (NORA) - Construction Sector on this nationwide outreach campaign to raise awareness about common fall hazards in construction, and how falls can be prevented and lives saved. As part of its outreach effort OSHA

has provided a wide selection of materials and training resources on its website that employers can use during toolbox talks and other training programs to train workers on safe practices to avoid falls in construction.

Fall from roofs, scaffolds and ladders are preventable with the appropriate training, equipment and oversight. Among the steps that workers on roofs should take are:• Wear a harness, make sure the harness fits and

always stays connected• Use guardrails or lifelines• Inspect all fall protection equipment before use• Guard or cover all holes, openings, and skylights

When ladders are used, workers should:• Choose the right ladder for the job • Maintain three points of contact • Secure the ladder • Always face the ladder

Projects that use scaffolding require extra care and diligence in order to ensure fall protection, including:• Use fully planked scaffolds • Ensure proper access to scaffold • Plumb and level • Complete ALL guardrails • Ensure stable footing• Inspect before use (by competent person)

Construction workers engage in many activities that can expose them to serious hazards, and construction worksites are among the most potentially hazardous. The high incidence and persistent recurrence of OSHA standards violations underscores the need for employers in the construction industry to renew their commitment to eliminate or significantly reduce the risk of accidents, injuries and fatalities. Planning, providing appropriate safety equipment and raising hazard awareness through safety training have been shown to be effective strategies for preventing or significantly reducing worksite accidents. u

As 2015 winds to a close, developments have occurred in Off-Road, On-Road, and Portable Equipment Regulations, which will affect most of our contractors’ fleets. Schedule your fleet reviews, analysis and budgeting with a view toward CARB requirements for 2016 and beyond, and note the upcoming cut-off dates by which you must act in order to take advantage of the revisions. To assist in that regard, we are providing some summary review checklists for Off-Road, On-Road, and Portable Power.

What You Need to Know Now:

OFF ROAD4 Tier 0. No fleet may add a vehicle with a Tier 0 engine to its fleet.4 Tier 1 for Large and Medium Fleets (over 2500 HP). A large or medium fleet

may not add a vehicle with a Tier 1 engine to its fleet. The engine Tier must be Tier 2 or higher.

4 Tier 1 for Small Fleets (up to 2500 HP). Commencing January 1, 2016, a Small Fleet may not add any vehicle with a Tier 1 engine to its fleet. The engine Tier must be Tier 2 or higher.

4 Tier 2. Beginning January 1, 2018, for large and medium fleets, and January 1, 2023, for small fleets, no fleet may add a vehicle with a Tier 2 engine to its fleet. The engine Tier must be Tier 3 or higher.

Fleets are allowed to continue operating lower tiered vehicles that they already own, but must comply with the adding vehicle requirements when considering purchases of new or used vehicles.

Emissions Performance Requirements:4 Large Fleets had until July 1, 2014 to meet the performance

requirements originally scheduled for January 1, 2014. Annually hereafter, Performance and Compliance dates will revert to January 1.

4 Medium Fleets compliance date is January 1, 2017. 4 Small Fleets compliance date is January 1, 2019. 4 Fleet owners should check their Compliance Snapshot on

the CARB DOORS web site to determine whether the fleet meets CARB target emissions for the given year.

To meet annual emissions performance requirements, fleets must either (1) meet the fleet-average emissions targets, or (2) meet the

Best Available Control Technology (BACT) requirements. In general, if a fleet does not meet the fleet-average emissions targets, then it must apply BACT each year on a certain portion of its fleet until it does meet those targets. In order to meet BACT requirements, fleets can either: (1) turn over to newer, cleaner engines or vehicles, or (2) install ARB-verified exhaust retrofits.

In addition, review the following checklists for your fleets for 2016, and be prepared to take action as necessary. Large Fleets (5000+HP)4 Annual Report (ROAR) due March 1, 2016. Include

any changes since your last reporting date and submit a compliance statement signed by responsible official. Submit engine hour meter readings for vehicles claimed as low-use.

4 Low-Use Hours increased to 200. Report Hours for Annual Low-Use Equipment selected. Tier 0 and Tier 1 engines declared Permanent Low-Use cannot be restored to the fleet, as that would be adding a Tier 0 or Tier 1 under the regulation. Be careful!

4 Two EIN labels are required, beginning 2013. Order extras now and affix to the equipment.

4 Compliance Planning Fleet Calculator now available for All Fleets. Use to Plan to meet the Fleet Average Targets, or repower, upgrade, or retire older, Tier 0 and Tier 1 equipment.

4 Review your accumulated emissions credits.

Medium (2500+HP) and Small Fleets (under 2500 HP)4 Register your fleets and affix EIN Labels (2 each).4 Report Equipment Sales and Acquisitions within 30

days.4 Except for Annual Low-Use, No other reporting

required. Medium Fleets must begin to meet emissions requirements on January 1, 2017; and Small Fleets by January 1, 2019. When adding vehicles and equipment, check total fleet horsepower with your additions to determine whether or not fleet size status has changed; i.e., a small fleet becomes medium as soon as 2500 HP is exceeded.

The regulation exempts trucks less than 14,000 lb. GVWR. Light Duty Trucks are classified as those between 14,001 and 26,000 lb. GVWR, and Heavier trucks are classified as those over 26,001 lb. GVWR.

Light Duty Trucks:4 No reporting required, but starting January 1, 2015

and each year thereafter, smaller trucks with engines 20 years or older must be retired, or replaced with newer trucks.

4 Note that by 2020, all non-filtered Light Duty Trucks must have 2010 engines or better. This is true regardless of the age of the engine. For example, a 2004 Light Duty Truck must have 2010 technology by 2020 even though it will not reach age 20 by then.

4 If using the Phase-In option (below), New Light Duty trucks with OEM filters may now count toward your fleet filtering requirements, but must be added to your fleet for reporting purposes.

Heavier Trucks:If using the Engine Model Year Schedule, plan on replacing your 1994-1995’s in 2016, and filtering or upgrading 1996-2006 models if you have not done so since 2014.

Additional Time for Small Fleets (1-3 Trucks). The Board approved amendments for small fleet owners that complied with the small fleet option for heavy trucks and had at least one PM filter by January 1, 2014. These fleet owners now have until January 1, 2017 to filter a second

truck, and until January 1, 2018 to filter a third. These filtered trucks will now be compliant until 2023. The Small Fleet Option is now closed.

If the Phase-in Option for heavier trucks was selected, the requirements have been softened. This option now requires PM filtering of 33% of the fleet by January 2014, 40% by January 2015, 60% by January 2016, 80% by January 2017, and 100% by January 2018. All trucks must then meet the engine model year schedule by January 2020. The Phase-In Option is now closed. Selecting this phase-in option enabled fleets to use low-mileage exemptions, specialty construction exemptions, and other available credits to extend the compliance life of the fleet. But, as stated above, selecting this option commits the fleet to the fleet percentage filtering schedule, and is now closed.

Under the revisions, the Construction Truck extension is now a Work Truck extension and allows up to 20,000 annual miles. Phase-In Fleet owners may designate which trucks will be low mileage work trucks for the coming year annually in January of each year. Report mileage from the previous year each January in your TRUCRS account

on the CARB web site, and designate low mileage work trucks for the coming year.

Low Use Revised:The annual low use exemption has been increased from 1000 to 5000 annual miles (Think water trucks, small dumps, and any other trucks used primarily on site at your projects, as well as normal trucking operations). No filtering of any of these vehicles is required, but mileage reporting IS required annually, by January 31.

Reminder: “Low-Mileage Construction (now Work Truck) Extension” and the “Under 5000 Annual Miles Exemption” are two different things.

4 If you claimed the Low-Mileage Construction Truck (now Work Truck) Extension, you are phasing your filtering of the fleet between now and 2018.

4 If you claim a 5000 mile Low-Use Exemption (such as for a water truck), that vehicle does not count as part of your fleet for emissions purposes, and no compliance actions are necessary, other than reporting mileage in January of each year. So long as the vehicle

remains within the mileage levels required, you may keep and operate that vehicle as-is until Jan. 2020, at which time the exemption expires.

Updated Truck Fleet Calculator Available. The compliance planning calculator for Truck Fleets has been updated to reflect the revised regulations. The tool is available for downloading from the CARB TRUCRS website: http://www.arb.ca.gov/msprog/onrdiesel/compliancetool.htm

Smoke Testing. Lest we forget, annual smoke testing violations remain the most enforced (and penalized) portions of the Truck & Bus regulation. Therefore, do not neglect your annual smoke testing and recordkeeping requirements. A list of vendors can be found on the TRUCRS web site. A recordkeeping spreadsheet is also available online.

PORTABLE POWER

CARB is re-opening the ATCM and PERP regulations for revisions and adjustments, due primarily to UCON/CIAQC member concerns involving availability and cost of equipment meeting the stringent emissions targets currently required in the regulation. UCON is working with top-level CARB staff members in an effort to revise the regulation prior to the 2017 reporting date. Meanwhile, other than some enforcement softening relative to the above, the current regulations remain in effect.

PERP critical registration requirements. Portable equipment 50 HP and greater may be registered with PERP, the Statewide Portable Equipment Registration Program, provided the engine is Interim Tier 4 or better in the 75-174 HP and 750 HP and above ranges. Engines

in the 50-74 and 175-749 HP ranges must be Tier 4 Final. In most cases, this is also true of equipment to be registered initially in Local Air Districts. The PERP exception is that FLEXED engines, regardless of model year or Certified Tier level, can always be registered.

ATCM Requirements for Portable Fleets: Effective January 1, 2013, portable diesel engines registered in PERP or operating under local air district permits must meet the additional emissions fleet averages established by the California Airborne Toxic Control Measure (ATCM). The next compliance date is 2017, and the final date is 2020. Fleet Average Emissions Targets grow smaller at each successive compliance date (see above note on potential revisions pending).

If your permitted portable fleet exceeds ATCM standards, you must replace, repower with non-diesel, or filter (not recommended). CARB has provided a calculator to determine compliance, and has outlined reporting and remedial requirements, including record-keeping. Review your portable fleet and consider turning over your old equipment, or converting to alternate fuels,

such as gas or propane. New compressors are rated at 49.5 HP, for example, and are therefore exempt from regulation. Rentals are always a good option, provided the Rental Co. can provide the proper compliance documentation.

A Note of Caution on Permit Renewals. If the equipment being renewed in PERP does not cause the fleet to fall out of compliance with the ATCM fleet emissions requirements, the permit will be renewed. Older permitted equipment may not meet the current requirements at time of renewal. These renewal applications will be rejected. CARB will ask for an updated ATCM fleet compliance report with the renewal application if one has not previously been submitted.
