07/06/1995 89 ORDER by Judge Stephen V. Wilson that the Crt GR plfs' motion to hold dfts in contempt [76-1]. Crt preliminarily concludes that it cannot impose a monetary sanction on the INS because of sovereign immunity. At the hrg, the Crt ORD the parties to brief this issue in greater depth, however, & the Crt may reconsider its position. Crt GR dfts' motion to modify injunction and make injunction permanent [84-1]. Crt will not adopt dfts' proposed inj, however, Crt has independently analyzed the record of the case, & finds that the inj can be modified. [See document for court's modified injunction]. Crt finds that the INS is in civil contempt of the Crt's 1/31/95 ord. In ord to purge themselves of this finding of civil contempt, dfts shall adhere to the schedule expressed [in this document]. The INS shall submit a written stat rpt to the Crt every month on or bef the 5th day of the month, beginning in August 1995. Crt VACATES the schedule fld 1/31/95 w/ regard to applicants that are not affiliated w/ cnsl for plfs [70-1]. Crt shall issue a fur inj w/ regard to these applicants at or after the hrg scheduled for 1:30 8/14/95.
