EIGHTH AMENDED SPECIAL ORDER NO. 60
I. CHARGING AND RELEASING MISDEMEANOR DEFENDANTS GENERALLY
Authorized law enforcement personnel from the above-captioned agencies may
issue citations or violation notices to any person whom they have probable cause to
believe is guilty of a criminal misdemeanor offense consistent with Federal Rule of

Criminal Procedure 58(b)(1), applicable law, and within the limits prescribed for their
agencies. As discussed in this Special Order, below, a person charged on citation or
violation notice may be released on a personal recognizance bond and either: (1) required
to pay a fixed sum to the Central Violations Bureau (“CVB”) in lieu of appearing in court;
or (2) required to appear in court on a fixed date and time (“mandatory appearance”).
Alternatively, within the sound judgment and discretion of the law enforcement officer, a
person charged within the jurisdictions of the above-captioned agencies with
misdemeanor offenses may be arrested and either: (1) brought without unnecessary
delay before a magistrate judge within the District of Nevada pursuant to Federal Rule of
Criminal Procedure 5(a) for his/her initial appearance; or (2) allowed to post bail securing
his/her release and given a mandatory appearance citation/violation notice requiring
him/her to appear in court at a future fixed date and time.
II. FORFEITURE OF COLLATERAL IN LIEU OF APPEARANCE
(A) Forfeiture of Collateral - Generally
Pursuant to Federal Rule of Criminal Procedure 58(d)(1), a person charged with
certain misdemeanors may, in lieu of appearance in court, post collateral in the amount
indicated on the charging document for the offense, waive appearance before a
magistrate judge, and consent to forfeiture of collateral, unless the charging document
makes the person’s appearance in court mandatory.
Collateral shall be posted by making payment to the CVB either by mail or online.
The CVB’s payment mailing address is P.O. Box 780549, San Antonio, TX 78278-0549.
The CVB’s online payment address is www.cvb.uscourts.gov.
Forfeiture of collateral constitutes a waiver of the right to contest the violation
notice, of the right to trial, and shall not be deemed the equivalent of a conviction. Where
the offense charged qualifies as a Class A misdemeanor, forfeiture of collateral further
constitutes waiver of the right to be charged by Information and consent to be charged by
citation or violation notice.

(B) Forfeiture of Collateral Schedule
The offenses for which collateral may be posted and forfeited in lieu of appearance
by the person charged, together with the amount of collateral to be posted, are provided
for in Exhibit A attached hereto. The collateral amount will also be indicated on the
charging document in addition to any processing fee that may be assessed by CVB.
(C) Maximum Penalties in Lieu of Forfeiture of Collateral
If a person charged with an offense under subsection (A), above, fails to post and
forfeit collateral in the amount indicated on the charging document, then a Notice to
Appear shall be sent to the person advising of the location, date, and time of the court
hearing regarding the matter. Upon conviction by plea or after trial, a sentence including
a fine, CVB processing fee, special assessment pursuant to 18 U.S.C. § 3013, restitution
pursuant to 18 U.S.C. § 3556, imprisonment, and/or probation, may be imposed within
the limits established by law.
(D) Failure to Forfeit Collateral and Failure to Appear (“FTA”) Thereafter
If a person charged with an offense under subsection (A), above, fails to post and
forfeit collateral, and then fails to appear for a duly scheduled hearing on the offense
charged, and a showing is made consistent with the provisions of Federal Rule of Criminal
Procedure 58(d)(3), then the magistrate judge may issue a warrant of arrest for that
person.
Upon receipt of the warrant, the United States Marshals Service for this District
may, in lieu of execution thereof, give written notice before arrest to the person with a
copy sent to the citing agency that a warrant has issued for his or her arrest providing
options to avoid arrest. If the person fails to respond per the notice before arrest, the
United States Marshals Service, or other authorized officer, may execute the warrant of
arrest consistent with applicable law.

III. MANDATORY APPEARANCE IN COURT
(A) Mandatory Appearance - Generally
Within the sound judgment and at the discretion of the citing officer, a person
charged with an offense may be issued a mandatory appearance citation or violation
notice requiring the person to appear in court to address the violation. The location, date,
and time of the hearing will subsequently be provided to the person charged via a Notice
to Appear or a Summons. When issued a mandatory appearance citation or violation
notice, the charged person may not post and forfeit collateral in lieu of personally
appearing in court at the specified date and time.
(B) Offenses For Which Mandatory Appearance May Be Required
Those offenses for which mandatory appearance in court are required are stated
as such in Exhibit A, attached hereto. Additionally, with just cause under the
circumstances, the citing officer may determine that the violation requires mandatory
appearance and reflect such requirement on the charging document. In addition to the
offenses noted in Exhibit A requiring mandatory appearance, circumstances that may
warrant mandatory appearance in other instances include, but are not limited to, the
following: (1) offenses involving loss or damage to the property of the United States or
others; (2) offenses involving a threat to the safety and/or welfare of any person; and (3)
offenses that the person charged has a prior history of committing.
(C) Failure to Appear in Court for Mandatory Appearance
If the person charged fails to appear after a Notice to Appear or Summons has
issued advising the person of the location, date, and time of the hearing, the magistrate
judge may: (1) issue a summons and provide a subsequent time and date for the hearing;
(2) issue a bench warrant authorizing arrest; or (3) take other action as appropriate.
Upon receipt of the warrant, the United States Marshals Service for this District
may, in lieu of execution thereof, give written notice to the person that a warrant has
issued for his/her arrest, and also that the warrant of arrest will not be executed if, within
ten days of the notice the person voluntarily presents himself or herself before the

magistrate judge during usual business hours for the purpose of appearing at a hearing
on the charged offense. If the person fails to contact the United States Marshals Service
and fails to appear within the specified time period, the United States Marshals Service,
or other authorized officer, may execute the warrant of arrest consistent with applicable
law.
IV. APPEARANCE UPON ARREST
(A) Appearance After Arrest - Generally
Nothing contained in this Special Order prohibits authorized law enforcement
officers of the above-captioned agencies from arresting a person for the commission of
any offense, including those for which collateral may be posted and forfeited. Such
arrested person must be taken without unnecessary delay before a magistrate judge in
accordance with Federal Rule of Criminal Procedure 5(a) or required to make a
mandatory appearance in court at a future date upon posting a custody release bond in
a fixed amount.
(B) Amount of Bond to be Posted to Secure Release After Arrest
Persons deemed to have violated the law and taken into custody may be released
upon payment of a cash bond pursuant to procedures stated herein. The amount of bond
to be posted is set forth in Exhibit A, attached hereto, unless otherwise stated. Within the
discretion of the citing officer, based upon justifiable circumstances, cash bond may be
set up to the amount of ONE THOUSAND DOLLARS ($1000.00) for any of the offenses
listed in Exhibit A or for any other misdemeanor offense charged.
(C) Procedure for Collecting Bond and Documenting Release Conditions
(1) Appearance forms. Posting of bail to secure release shall be
evidenced by execution of the approved form of ORDER FOR APPEARANCE and
APPEARANCE BOND, with attachment thereto of the written condition that the person
cited and released is required to appear before a magistrate judge at a fixed date and
time. Such Order for Appearance and Appearance Bond, along with the attachment
requiring the person’s appearance in court should be substantially similar to the

documents included in Exhibit B, attached hereto.
(2) Official receipt. The above-captioned agencies may only accept
cash bail in the authorized and prescribed amounts against official receipt, noting the
case incident number on the receipt, the Order for Appearance, and Appearance Bond
documents.
(3) Deposit of bail funds with the Court. Personnel of the above-
captioned agencies in receipt of cash bail funds will promptly and fully deposit and make
accounting for all posted and received bail monies accepted by them as provided above,
together with related citations or violation notices and appearance bond paperwork, to the
Clerk of Court for this District, on the next succeeding workday after such cash bail is
received.
V. CHARGES ON COMPLAINT
Nothing in this Special Order prohibits authorized personnel of the above-
captioned agencies from filing a complaint before a magistrate judge for any offense,
including those for which collateral may be posted and forfeited, in lieu of or superseding
a violation notice or citation.
VI. SUPERSEDING ORDER
This Special Order supersedes Amended Special Order No. 60, filed September
29, 2014.
