Clarirication on the method of fixation of pay on promotion/financial upgradation under MACP between 01.05.2017 and 30.11.2017

under Nagaland Services (Revision of Pay) Rules, 20u.

1. Rule 6 {b) of the Nagaland Services (RoP) Rules, 2017 provides

that Government servants may continue to draw pay in the existing pay band

and grade pay at their option urltil they vacate their post or ceases to drawpay in that scale. Form of option has been annexed to the Nagaland Services

(ROP) Rules, 2017 to enable Government servants to exercise the option

Representations have been received seeking clarification on theservants having gotmethod of fixation of pay in respect of Government

promotion between 01.06.2017 and 30.11.2017.

3. The matter has been examined. An illustration of pay fixationmethod in respect of Government servants having got promotion/financial

upgradation under MACP between 01.06.2017 and 30.11.2017 is enclosed forguidance of all concerned:

4. For fixation of pay as given in the illustration, Government

servants having exercised the option as stated ai para 1 above within

stipulated time should also furnish an option as provided under FR 22 (1) (a)

(1). The option for fixation of pay under FR 22 (1) (a) (1) should be exercised

within thirty days from the date of issue of this OM.

(l) These rules may be called the Nagalaod Goods and Services Tax (EighteenthAmendment)Rules,20l8.

2. In the Nagalaud coods and Servic.s'l'ax Rulcs, 2017, -

(i)in rule 89, for sub,rule (5), rhe followingJhall be subsrirured, namely:-

'97. Consumcr Wclfare Fund.-(l)All amounrs of slate tar and incore fiominvestment along with olher monies specified in section 57 of lhe Nagaland Coodsand Services Tax Acl 2017 (4 of2017) shall be cred;ted to the Fund:

Provided tha! an amount equivaleni to fifty per cent.of the am,rt:rrl oiintcgrated tax determined under sub,section (5) of section 54 of the Central Goodsand Se.vices Tax Act, 2017, read lyith section 20 of the lnresrared Good\ and5ervices Ta)\ Aci.20r?. qha bedepo\ired in rhe Fund.

i2) Where any amount, having been credited to ihe Fund, is ordered or direcled to be

paid to any claimant by thc proper oflici:r, appellate authority or coun. the same shallbr prid from the Fund.

(3) Accounrs of rhe Fufld mainrained by ihe Cenrral Covemmenr shall be subjecl loaudit by rhe Comptroller and AudirorGeneml of India.,(4) The Gover renl shall, by an order, constitute a Standing Committee (hereinafle.referred to as tho'Committee') with a Chairman, a Vice,Chairman, a Membc.Secretary and such olher members as it may deem fit and the Committee shall makerecommendations fo. proper utilisarion ofthe oncy credited to fie Fund for welfareofthe consumers.

(5) (a) The Commifiee shall meet as and when nccessary, generally four times in 6year;

(b) thc Conmittee shall meet st such time and ptace as lhe Chairlnan. or in hisabsence, the Vice-Chairman ofthe Committee may deem firi

(c) lhc meeting oflhe Commitlee shall be presided over b) rhe Chairman, or ;n hjsabsence, by the Vice-Chairman;

(d) themeeting of the Commirtee shatl be called, afte, giving al least ren days,nolicein rvriting to every member;

(6) Tfic Committee shallhave powers -

(a) to require any applicant to ger regislered wilh any aulhoriry as the StareCovemment may speciE,;

(b) to require any applicant to produce before ir, or before a drly authorizedofficer of the State Covemment, as the cas€ may be, such books, accounls,documcnts, instruments, or commodities in custody and contsol of theapplicant, as may be necessary for proper evaluarion of the application;

(c) to requirc any applicant to alloiy entry and inspection ofany piemises, fromwhich activities claimed io be for the welfare of consum€rs arc srared to becarried on, to a duly authorised otlcer of th€ State Governmcnt, as the casemay be;

(d) to get thc accounts ofthe applicants audited, for ensu.ing proper utilisation ofthe Brant;

(e) to require any applicant, in case of any defaul, or suppression of materialinformation on his part, to refund in lump-sum along with accrued inlerest. thesanctioned grant to the Commifiee. and to be subject to prosecution under lhe

(i) to recover any sum duc llom anv rDplicant in accordance wilh the prcvisionsofthe Act:

(g) to require any applicant, or class of aPPlicants to submit a periodical reporl'

indicating proper utilisalion of the grant;

(h) to rejecl an application placed befor€ it on accounl offactual inconsistcncy, or

inaccurac) in malerial parliculars:

(i) to recommend minimum financial assistance, by way ofgrana to an applicant,

having regard to his finaflcial status, and importance and utility ofihe nalure

of activity under pursuit, aiier ensuring thal lhe financial assistance provided

shall not be misutilised:

(j) to identify beneflc;al and safe scctors, where investments out ofFund may be

made, and make recommendalions, accordingly;

(k) to relax the conditions required for lhe period of engagement in consumer

welfdrs activilies of an applicant;

(l) to make guidelines for the managemenq and administration ofthe lund.

(7) The Committee shall not consider an application, unless it has been inquired

into, in material details and recommended for consideration accordingly, by the

Member Secretary.

(8) The Committce shall make recommendalions:-

(a) for making availablc grants !o any applicant;

(b) for investmeniofdrc money avoilable in the Fundl

(c) For making available grants (on selective basis) for reimbursing legal expenses

incurred by a complainant, o. class of complainants in a consumer dispute,afier its final adjudicalion.

(d) formaking availabl€ gmnts for any other purpose recommendcd by lhe CenlralConsumer Proiection Council (as may be considered appropriate by the

Commitlee):

(e) for naking ayailable up !o 50% of the tunds credited to thc Fund each year,for publiciry/ consumer awarcness on GST, p.ovided the availabiliry" of tundsfor consumer welfare activities ofthe Departrnent ofConsumer Affairs is notl€ss than twenty five crorerupees perannum.

Erplahation.- For the purposes oflhis rule,

(a) 'applicant'means,

(i) the Central Govemment or State Govemment;

(ii) regulatory authoriries or autonomous bodies constituted under an Act ofParliamentorlhe Lcgislature ofa State or Union Territory;

(iii) any agency or organization engaged in consumer welfare activilias for a minimumperiod of three years, registered under th€ Companies Act, 20ll (18 o00l3) or underany other law for the time being in forc€;

(iv) village or mandal or samiti or s3xiti level co-operatives of consumers especiallyWomen, Scheduled Caslos and Scheduled Tr;bes;

(!) an educalional or research institution incorporated by an Aci of Parliameni or theLegislatureof a Slale or Union Tenitory in India or other educarional institutions

(b) 'application' means an application in tle form as specified by rhe Slanding Commjtteefrom lime totime;
