In your last letter you remark “we are unable to issue you a travel document with the name of
Desire Billie Dubonet. We need to see U.S. court documents proving the name change.” My
last name is spelled Dubounet by the way.
Please send me a copy of the law that says you need US court documents. But wait! In fact no
such law exists. It is very unprofessional and improper to make up laws that do not exist. The
State Department form for name change clearly states that if you do not have a court order
then send 3 public records. I have sent you more than 3 and can send more if you wish.
In the USA individual State laws regulate name changes in the United States. Several specific federal court rulings have set precedents regarding both court decreed name changes and common law name changes (changing the name at will). It does not take a court decision.
A person may be employed, do business, enter into contracts, sue and be sued under any name they choose at will. Such a change carries exactly the same legal weight as a court-decreed name change. Usually a person can adopt any name desired for any reason. As of 2009, 46 states allow a person legally to change names by usage alone, with no paperwork. The state I was born in Ohio and my last residence and voting place Colorado are two of these 46 states.
As to what is the law regarding passports here is a copy of the page from the official web site of the Bureau of Consular Affairs, US state Department that describes the Name change procedure. Please notice that the words US court documents do appear but if you have an assumed name what to provide. The State Department requires 3 public records. The legal definition of public records is as follows.
Definition of public record: A "government record" or "record" means any record in any form or
medium, that has been made, maintained or kept on file in the course of his/hers or its official
business by any government, local or regionally funded agency, including school boards.
Every document, paper, record, map, photograph, etc., as defined by law, that is made or received by a
government entity or employee is presumed to be a public record N.J.S.A. 47:1A-1.1.
The definition of public record is not limited to the USA only. I recorded my name change
official in England and it was recorded in Hungary in 2002. The International Medical University
school board recorded the name change over five years ago. I sold a car in America under the
name Desire’ Dubounet. I sold a condominium under the name Desire’ Dubounet in America
and I can give the bill of sale for each if you wish. I sent in a name change to the State of Ohio
for my license to diagnose and treat patients as a LPCC. I have sent and am sending again my
work contracts with name change and other public records. You might decide to thumb your
nose at Hungarian and England documents as not being public record even though America has
a treaty to not do so, but it seems that if someone is going to make up laws they might just
make up jurisdiction lines as well. I live here as Desire’ Dubounet for over ten years and my
official American identity of my voters registration confirms this.
The following is a copy of the State Department requirements of name change. It does not say
court documents it says public records. It does not say US public records it says public record. I
have sent you copies of many public records with my name change.
As or your request for the attending physician of my gender change the attending physician is a
Hungarian doctor and the American doctor is a medical witness to the result. Here is a copy of the
attending physician letter regarding my gender.
So now as per American law I have presented to you evidence of public record of my name change and
attending physician of my gender change. I hope you will not make up any more laws that don’t exist.
The bogus case against me was dropped in 1996 by judge Matsch and it seems that America has become
a place where laws do not seem to apply.
After judge Matsch dismissed the case saying there was no seal, how does another indictment get
issued for the same crime I faced charges for and was dismissed get issued. A federal judge said it was
not the seal and another judge issues another warrant. It seems that power, influence and money
transcend law. It also seems that certain small minded bureaucrats can make up laws and make up
interpretations of law. People of the world now wonder about the American decisions. Homophobia,
petty minds and power seem to cloud judgment of the law. This is why I have not returned. I wonder if
law exists anymore in America.
My mother is very sick and dying I would like to return to see her before she dies. I am happy to face
these bogus charges in a land where law is honored and respected. But if America is a place where law is
not honored then I will not want to return. The law of name and gender change has been satisfied. I
have fulfilled the requirements of the law. I do not understand the difficulty in respecting the law and I
do not see what harm it would be to let me change my name and gender status under State Department
Law. Is my wearing a dress a threat to the state? Is my right to choose gone because of some
bureaucrats fear, petty mind or homophobia? America is based on a concept of personal freedom and
some small minded bureaucrats like to take freedom away. One of those freedoms is to change your
name without having to ask a court as guaranteed in the 14th amendment. Posting this to the public
record is a State Department requirement for the name change of a passport. I have made several public
records and now my sole identity for the last 10 years is a Desire’ Dubounet sex female, all of my
identity documents, rental contracts, banking, phone contracts are in the name Desire’ Dubounet.
The first time I called to handle this issue I was treated very rudely by the American embassy staff. He
threatened to hang up on me if I did not agree with him. His manner was impolite, discourteous and
very haughty. I would like to see my mother and having fulfilled the law requirements of name and
gender change I would like to have my temporary passport issued as the law requires. The embassy
agent was crass and arrogantly laughed at me. The next letter makes up laws that do not exist. I do not
know if all agents of the embassy are so crass, but it seems improper to make up laws and treat people
rudely. These factors make it necessary for me to ask for another agent with less homophobia to deal
with my temporary passport issue.
I hope we can resolve this simple issue and allow me to see my mother. Please respond with a possible
time to go over the details and for me to bring in a photo and the funds if any for my temporary
passport.
