In this document CBP issoliciting comments concerning the following information collection:

Title: Customs Modernization Act Recordkeeping Requirements.OMB Number: 1651–0076.Form Number: None.Abstract: The North American Free Trade AgreementImplementation Act, Title VI, known as the CustomsModernization Act (Mod Act) amended title 19 U.S.C. 1508, 1509and 1510 by revising Customs and Border Protection (CBP) lawsrelated to recordkeeping, examination of books and witnesses,regulatory audit procedures and judicial enforcement.Specifically, the Mod Act expanded the list of parties subject toCBP recordkeeping requirements, distinguished between recordswhich pertain to the entry of merchandise and financial recordsneeded to substantiate the correctness of information containedin entry documentation, and identified a list of records whichmust be maintained and produced upon request by CBP. Theinformation and records are used by CBP to verify the accuracyof the claims made on the entry documents regarding the tariffstatus of imported merchandise, admissibility,classification/nomenclature, value and rate of duty applicable tothe entered goods. The Mod Act record keeping requirements areprovided for by 19 CFR part 163.

ACTION: CBP proposes to extend the expiration date of thisinformation collection with a change to the burden hours as aresult of a revised estimate of the number of respondentscurrently complying with these recordkeeping provisions.Type of Review: Extension (with change).Affected Public: Businesses.Estimated Number of Respondents: 5,459.Estimated Number of Total Annual Responses: 5,459.Estimated Time per Response: 1,040 hours.Estimated Annual Burden Hours: 5,677,360.

SUMMARY: U.S. Customs and Border Protection (CBP) of the De-partment of Homeland Security will be submitting the followinginformation collection request to the Office of Management and Bud-get (OMB) for review and approval in accordance with the PaperworkReduction Act: Dominican Republic-Central America-United StatesFree Trade Agreement (CAFTA–DR). This is a proposed extension ofan information collection that was previously approved. CBP is pro-posing that this information collection be extended with a change tothe burden hours. This document is published to obtain commentsfrom the public and affected agencies. This proposed informationcollection was previously published in the Federal Register (76 FR75893) on December 5, 2011, allowing for a 60-day comment period.One comment was received. This notice allows for an additional 30days for public comments. This process is conducted in accordancewith 5 CFR 1320.10.

Title: Dominican Republic-Central America-United States FreeTrade Agreement (CAFTA–DR).OMB Number: 1651–0125.Form Number: None.Abstract: On August 5, 2004, the United States entered into theDominican Republic-Central America-United States Free TradeAgreement with Costa Rica, the Dominican Republic, ElSalvador, Guatemala, Honduras, and Nicaragua, (also known asCAFTA–DR.) The Agreement was approved by Congress insection 101(a) of the Dominican Republic-Central America-UnitedStates Free Trade Agreement Implementation Act, Public Law109–53, 119 Stat. 462 (19 U.S.C. 4001 et seq.), as amended bySec. 1634(d) of the Pension Protection Act of 2006 (Pub. L.109–280), and provides for preferential tariff treatment of certaingoods originating in one or more of the CAFTA–DR countries. Itwas signed into law on August 2, 2005, and the presidentproclaimed the implementation dates as follows: El Salvador(3/1/06), Honduras (4/1/06), Nicaragua (4/1/04), Guatemala(7/1/06), Dominican Republic (3/1/07) and Costa Rica (1/1/09).In order to ascertain if CAFTA–DR imported goods are eligible for

preferential tariff treatment, a certification and supporting docu-

Current Actions: CBP proposes to extend the expiration date ofthis information collection with a change to the burden hours.Specifically, estimated number of responses was lowered from10,000 to 3,000 based on revised estimates by CBP. The time perresponse was increased from 24 minutes to 2 hours based on publiccomments that CBP received. This form is used to documentclearance by the arriving aircraft at the required inspectionalfacilities and inspections by appropriate regulatory agency staffs.CBP Form 7507 collects information about the flight routing, thenumbers of passengers embarking and disembarking, adeclaration of health for the persons on board, details aboutdisinfecting and sanitizing treatments during the flight, and adeclaration attesting to the accuracy and completeness andtruthfulness of all other documents that make up the manifest.

ACTION: Notice of proposed modification of a ruling letter and pro-posed modification of treatment relating to the admissibility jewelryset with tumbled diamonds from the Republic of Zambia.

SUMMARY: Pursuant to section 625(c), Tariff Act of 1930 (19 U.S.C.§1625(c)), as amended by section 623 of title VI (Customs Modern-ization) of the North American Free Trade Agreement Implementa-tion Act (Pub. L. 103–182, 107 Stat. 2057), this notice advises inter-ested parties that U.S. Customs and Border Protection (CBP) intendsto modify a ruling concerning the admissibility of jewelry set withtumbled diamonds from the Republic of Zambia (Zambia). BACKGROUND

On December 8, 1993, Title VI, (Customs Modernization), of theNorth American Free Trade Agreement Implementation Act (Pub. L.103–182, 107 Stat. 2057) (“Title VI”), became effective. Title VIamended many sections of the Tariff Act of 1930, as amended, andrelated laws. Two new concepts which emerge from the law are

“informed compliance” and “shared responsibility.” These con-cepts are premised on the idea that in order to maximize voluntarycompliance with customs laws and regulations, the trade communityneeds to be clearly and completely informed of its legal obligations.

Accordingly, the law imposes a greater obligation on U.S. Customsand Border Protection (CBP) to provide the public with improvedinformation concerning the trade community’s responsibilities andrights under the customs and related laws. In addition, both thepublic and CBP share responsibility in carrying out import require-ments. For example, under section 484 of the Tariff Act of 1930, asamended (19 U.S.C. §1484), the importer of record is responsible forusing reasonable care to enter, classify and value imported merchan-dise, and to provide any other information necessary to enable CBP toproperly assess duties, collect accurate statistics, and determinewhether any other applicable legal requirement is met.

Pursuant to section 625(c)(1), Tariff Act of 1930 (19 U.S.C.§1625(c)(1)), as amended by section 623 of Title VI, this notice advisesinterested parties that CBP is proposing to modify a ruling letterpertaining to the admissibility of jewelry set with tumbled diamondsfrom Zambia. Although in this notice, CBP is specifically referring toNew York Ruling Letter (NY) N018792, dated November 8, 2007(Attachment A), this notice covers any ruling on this merchandisewhich may exist, but have not been specifically identified. CBP hasundertaken reasonable efforts to search existing databases for rul-ings in addition to the one identified. No further rulings have beenfound. Any party who has received an interpretive ruling or decision(i.e., a ruling letter, internal advice memorandum or decision, orprotest review decision) on the merchandise subject to this noticeshould advise CBP during the notice period.

Similarly, pursuant to section 625(c)(2), Tariff Act of 1930 (19U.S.C. §1625(c)(2)), as amended by section 623 of Title VI, CBP isproposing to modify any treatment previously accorded by CBP tosubstantially identical transactions. Any person involved in substan-tially identical transactions should advise CBP during this noticeperiod. An importer’s failure to advise CBP of substantially identicaltransactions or of a specific ruling not identified in this notice mayraise issues of reasonable care on the part of the importer or itsagents for importations of merchandise subsequent to the effectivedate of the final decision on this notice.

In NY N018792, set forth as Attachment A to this document, CBPstated that jewelry set with tumbled diamonds imported from Zambiais not admissible into the United States. CBP now clarifies thatjewelry set with tumbled diamonds from Zambia is not subject to the

Pursuant to 19 U.S.C. §1625(c)(1), CBP proposes to modify NYN018792 and to revoke or modify any other ruling not specificallyidentified, in order to reflect the proper admissibility of the subjectmerchandise according to the analysis contained in the proposedHeadquarters Ruling Letter (HQ) H173035, set forth as AttachmentB to this notice. Additionally, pursuant to 19 U.S.C. §1625(c)(2), CBPis proposing to modify any treatment previously accorded by CBP tosubstantially identical transactions.

DEAR MR. HORTON:In your letter dated October 20, 2007, you requested a tariff classification

ruling.You intend to import tumbled diamonds loose as well as set into jewelry.

Tumbled diamonds are not considered “worked” but still in their rough state.A diamond that has been tumbled is where the surface has been renderedglossy and shiny by chemical treatment, also known as chemical polishing.Chemical polishing is different from traditional abrasive polishing in that thediamonds are not mounted individually and polished on a polishing wheel butare loaded, in bulk, into a chemical reactor.

Since the tumbled diamonds are considered rough and Zambia is not amember of the Kimberley Process Certification Scheme, these diamonds arenot admissible into the United States, nor will the jewelry set with thetumbled diamonds be allowed into the United States. If the tumbled dia-monds are cut and polished, both the diamonds and jewelry will be allowedinto the country.

The applicable subheading for cut and polished diamonds will be7102.39.0010, Harmonized Tariff Schedule of the United States (HTSUS),which provides for “Nonindustrial diamonds, Other, Weighing not over 0.5carats each”. The duty rate will be free. The applicable subheading for cutand polished diamonds will be 7102.39.0050, HTSUS, which provides for“Nonindustrial diamonds, Other, Weighing over 0.5 carats each”. The dutyrate will be free.

The applicable heading for cut and polished diamonds set in silver will be7113.11.5000, HTSUS, which provides for “Silver Jewelry, Other”. The rate ofduty will be 5% ad valorem. The applicable heading for cut and polisheddiamonds set in gold will be 7113.19.5000, HTSUS, which provides for “Pre-cious metal jewelry, Other”. The rate of duty will be 5.5% ad valorem. Theapplicable heading for cut and polished diamonds set in copper will be7116.20.1500, HTSUS, which provides for “Articles of precious stones, Jew-elry, Valued over $40 per piece”. The rate of duty will be 6.5% ad valorem.

DEAR MR. HORTON:This modification is in reference to New York Ruling Letter (“NY”)

N018792, dated November 8, 2007, issued to you concerning the tariff clas-sification of loose tumbled diamonds, jewelry set with tumbled diamonds,loose cut and polished diamonds, and jewelry set with cut and polisheddiamonds. All articles were from the Republic of Zambia (Zambia). In NYN018792, U.S. Customs and Border Protection (CBP) stated that jewelry setwith tumbled diamonds from Zambia will not be allowed into the UnitedStates because tumbled diamonds are considered rough and Zambia is not amember of the Kimberley Process Certification Scheme (“KPCS”). We havereviewed NY N018792 and find the ruling letter to be partially in error. Forthe reasons set forth below, we hereby modify NY N018792.

This modification applies only to the admissibility of the jewelry set withtumbled diamonds from Zambia. The classifications contained in NYN018792 of cut and polished loose diamonds under heading 7102, Harmo-nized Tariff Schedule of the United States (HTSUS), and the classifications ofjewelry set with cut and polished diamonds under headings 7113 and 7116,HTSUS, remain unmodified. We also emphasize that, as stated in NYN018792, because tumbled diamonds are considered rough and Zambia is nota member of the KPCS, loose tumbled diamonds from Zambia are not admis-sible into the United States. Our analysis follows.

FACTS:

In your letter, dated October 20, 2007, you stated that you intended toimport certain articles, including loose tumbled diamonds from Zambia, aswell as jewelry set with tumbled diamonds from Zambia. You indicated thatthe jewelry would consist of silver, gold, or copper and that it would be setwith tumbled diamonds. While you stated that each piece of jewelry would bevalued at over $40, you did not provide a carat weight of the tumbleddiamonds which would be set in the jewelry.

NY N018792 states as follows:Tumbled diamonds are not considered “worked,” but still in their “rough”state. A diamond that has been tumbled is where the surface has beenrendered glossy and shiny by chemical treatment, also known as chemicalpolishing. ISSUE:

Is silver, gold, or copper jewelry set with tumbled diamonds from Zambiaadmissible into the United States?

LAW AND ANALYSIS:

The U.S. Clean Diamond Trade Act of 2003 (“CDTA”), (Pub. L. 108–19, 117Stat. 631), concerns efforts by the United States to curb the use of fundsderived from the sale of rough diamonds by state actors and rebels to financemilitary activities and subvert international efforts to promote peace andstability. Section 4 of the CDTA (19 U.S.C. § 3903(a)) prohibits the importa-tion into, or exportation from, the United States of any rough diamond, fromwhatever source, that has not been controlled through the Kimberley ProcessCertification Scheme. See Treasury Regulations section 592 (31 C.F.R § 592).“Rough diamond” is defined in 19 U.S.C. § 3902(9) and 31 C.F.R. § 592.310 asmeaning “any diamond that is unworked or simply sawn, cleaved, or brutedand classifiable under subheading 7102.10, 7102.21, or 7102.31 of the Har-monized Tariff Schedule of the United States.”

The HTSUS provisions referenced in 19 U.S.C. § 3902 are the following:

7102: Diamonds, whether or not worked, but not mounted or set:

7102.10: Unsorted…

7102.21: Industrial:

Unworked or simply sawn, cleaved or bruted:

7102.31: Nonindustrial:

Based on the CDTA definition of “rough diamond,” we find that the jewelryat issue is admissible into the United States and is not subject to KimberleyProcess Certification Scheme requirements. The CDTA restricts the import ofrough diamonds into the United States. The term “rough diamond” is definedin section 19 U.S.C. § 3902(9) as meaning any diamond that is unworked orsimply sawn, cleaved, or bruted and classifiable under subheading 7102.10,7102.21, or 7102.31, HTSUS. 31 C.F.R. § 592.310. Heading 7102, HTSUS,provides for “diamonds, whether or not worked, but not mounted or set”(emphasis added). By contrast, the instant merchandise consists of gold,silver, or copper jewelry set with tumbled diamonds from Zambia. Therefore,it is not classified in heading 7102, HTSUS. Because the merchandise is notclassified in heading 7102, HTSUS, it is not considered a “rough diamond”under the CDTA. Consequently, the jewelry set with tumbled diamonds fromZambia is not subject to Kimberley Process Certification Scheme require-ments and is not prohibited from import under the U.S. Clean DiamondTrade Act.

This modification applies only to the admissibility of jewelry set withtumbled diamonds from Zambia.

HOLDING:

As gold, silver, or copper jewelry set with tumbled diamonds is not classi-fied in heading 7102, HTSUS, the tumbled diamonds do not fall within the

Note, however, that rough diamonds from Zambia classified in subheadings7102.10, 7102.21, or 7102.31, HTSUS, would not be admissible to the UnitedStates.

Pursuant to section 625(c)(1), Tariff Act of 1930 (19 U.S.C.1625(c)(1)), as amended by section 623 of Title VI, CBP published anotice in the June 26, 2009, Customs Bulletin, Volume 43, Number26, proposing to revoke New York Ruling Letters (NY) I87325 andK86469, dated October 25, 2002, and June 21, 2004, respectively,pertaining to the tariff classification of Sunx Fiber Sensors and pho-toelectric sensors, and to revoke any treatment accorded to substan-tially identical merchandise. Two comments were received in re-sponse to this notice.

In NY I87325 and NY K86469, CBP classified the subject SunxFiber Sensors and photoelectric sensors in subheading 8541.40.80,HTSUS, which provides for “Diodes, transistors and similar semicon-ductor devices: photosensitive semiconductor devices… light-emittingdiodes; mounted piezoelectric crystals…Other: Optical coupled isola-tors.” After reviewing the comments in opposition to the proposedrevocation, we now believe that NY I87325 and NY K86469 shouldstand.

As a result, CBP is hereby withdrawing its intent to revoke NYI87325 and NY K86469 and any other ruling not specifically identi-fied. Additionally, CBP is withdrawing its intent to revoke any treat-ment previously accorded by CBP to substantially identical transac-tions.
