Managing Intellec- tual Property. Clients seeking expert
intellectual property rep- resentation require two key components
from their outside counsel: an in-depth, studied under- standing of
an industry and its products and the substantive legal experience
to back it. IP Stars takes aim at both with discriminating
precision, highlighting in all 50 states and DC only those who can
meet these expectations. In addition to neatly organizing the firms
and individual star at- torneys in each jurisdiction, our
state-by-state breakdown frees us to examine the sometimes
overlooked non-coastal practitioners whose ex- pertise often belies
their non-coastal locale. The IP Stars research was based on
hundreds of interviews with partners, interviews with clients, and
thousands of surveys completed by law firm partners and in-house
counsel active throughout the United States. The purpose of the
surveys was to collect attorneys specific practice details, the
relevant portions of which we have printed in the Attorney Listings
pages at the end of each chapter. We also asked participants to
nominate peers for inclusion in our individual stars rankings,
which assisted in the vetting of new stars for 2015. New to this
years publication is the Corporate IP Stars section, a list of the
countrys most es- teemed and accomplished corporate in-house
counsel. All information is believed to be correct at the time of
press. Jakob Schnaidt, Editor METHODOLOGY

NOTABLE FIRMS Adduci Mastriani & Schaumberg UPDATE Adduci
Mastriani & Schaumberg is a single-office firm with two dozen
profes- sionals based in Washington, DC. The firm is best known for
its practice before the International Trade Commission. Its
attorneys handle ITC proceedings as lead counsel for complainants
and re- spondents alike as well as serving as local counsel and ITC
specialists on be- half of patent litigators looking to supple-
ment their ITC expertise. Roughly 25% of the ITC cases the firm
takes on are in partnerships with other firms, of which Adduci
takes little or no credit for the outcomes. Recently-finalized
matters include patents on semiconductors, lighting dim- mer
switches, RFIDs, and other high- tech electronic components, but
other representative matters include ceramics, plastics, and
mechanical components, too. Adduci is representing Converse in
their ITC petition asserting that 31 retail- ers, including
Wal-Mart and H&M, have been infringing on their trademark
rights by selling footwear imitative of the Converse brand. So far,
defendant H&M has settled out of the case, paying Con- verse a
monetary sum and recalling the accused products from its inventory
to recycle or destroy. Name partners Jim Adduci II, Lou Mastriani,
and Tom Schaumberg are specialists in proceedings before the ITC.
The trio are considered without peer in their knowledge of the ITCs
proce- dural requirements and expedited schedule. Deanna Tanner
Okun served for 12 years as an ITC commissioner, in- cluding two
nonconsecutive terms as commissioner and two terms as vice
commissioner. Akin Gump Strauss Hauer & Feld Akin Gump Strauss
Hauer & Feld is a full-service international law firm with 67
IP lawyers located across 13 domestic offices. The Texas,
Philadelphia and Washington, DC offices serve as the main nerve
centers for the IP group with a recent expansion to Irvine boosting
the firms IP footprint in California. It is par- ticularly well
regarded for its patent liti- gation expertise at the ITC, but it
also maintains a strong reputation across trademark and copyright
law. Trial work is the firms standout strength.

Karol Kepchar and ITC specialist Cono Carrano, both based in the
Wash- ington, DC office, are among the attor- neys praised by
peers. Steven Zager, in addition to obtaining a patent infringe-
ment trial win on behalf of Zynga late in 2013, led the medical
device manufac- turer Globus Medical to victory in a trade secret
case in which the jury awarded his client $4 million in past
damages. Alston & Bird UPDATE Alston & Bird is a
full-service law firm with nine US offices and more than 170 IP
attorneys, including more than 100 legal professionals with a USPTO
regis- tration. This one-stop IP practice covers a range of
litigation, prosecution, and transactional services but is
particularly well known for successfully represent- ing clients in
contentious patent matters. One peer says, Alston & Bird is
focused in Atlanta, but theyre a growing force. They seem to have
made a lot of acquisi- tions, and I see them more and more. Another
praises Alston & Bird for strate- gic case management,
purporting that the firm typically will avoid piling un- necessary
staff onto a case. Atlanta-based partner Frank Smith is
consistently mentioned by peers and clients alike as one of the
most-well-re- spected patent litigators in Georgia. In July 2014,
Smith and his team obtained a permanent injunction for client Mylan
against GlaxoSmithKline after winning a $106 million jury verdict
in July. At stake was the production and sale of a generic
formulation of a paroxetine hy- drochloride, a popular
antidepressant that Mylan now has the exclusive right to sell under
the name Paxil CR. John Haynes, winner of Managing IPs Georgia IP
Litigator of the Year award in 2015, achieved an important victory
in the ITC on behalf of firm client Nokia in patent infringement
litigation against InterDigital relating to wireless protocols. In
August 2014, the ITC af- firmed the ALJs determination made two
months previously that Nokia had not infringed upon any of the
seven patents under review. In 2015, Alston & Bird won the Man-
aging IP national award as ITC Firm of the Year. Arent Fox Arent
Fox is a general practice firm headquartered in Washington, DC,
where 30 partners of the firms 100 IP at- torneys more than a
quarter of the firms total capacity are based. The firm also has an
IP capacity in its New York, San Francisco, and Los Angeles of-
fices. The firm maintains a stellar repu- tation among intellectual
property circles for its top-tier trademark work, especially in
matters of media and enter- tainment. A prominent trademark client
singled out Arent Fox for its wonderful technical expertise in
trademarks and understanding of our company and its history. In
2014, the firm has honed its inter- national presence, committing
its top tal- ents to perform trademark work in Latin America as
well as cross-border trade- mark and IP advice for European com-
panies doing business in the US and vice versa. Mars, Discovery,
Burger King, Qualcomm, and Diane von Furstenberg are some of the
blue chips populating Arent Foxs list of clients needing trade-
mark advice while expanding overseas. Anthony Lupo heads the
fashion, luxury goods, and retail practice. He is representing a
host of fashion clients in IP matters, including Hugo Boss, Diesel,
Lacoste, and Diane von Furstenberg. Other stars singled out in the
firms Washington, DC office include: Cristina Carvalho, who
represents Mars, Petro- bras, and several major Brazilian com-
panies; and Arthur Beeman, who recently represented The Saul Zaentz
Company regarding the trademark rights it holds in JRR Tolkiens The
Hob- bit and The Lord of the Rings. The firm manages The Saul
Zaentz Companys thousands of trademarks. Qualcomm, which files more
than a thousand patent applications a year, re- tains Arent Fox as
one of its primary US patent prosecution counsel. Among the 9,000
Qualcomm-related cases that Arent Fox is handling, the firm has re-
cently aided its largest client with the release of new wireless
broadband, next-gen LTE, UWB, and other stan- dard-essential
patents. Other firm clients on the patent side include the hard
disc manufacturer Western Digi- tal, Fujitsu, and generics maker
Par Pharmaceutical. Arnold & Porter UPDATE Arnold & Porter
is a full-service firm with seven offices in the US and other lo-
cations in Brussels and London. The practice includes more than 100
lawyers firm-wide with expertise in patents, copyright, trademarks,
licensing, trans- actions, and trade secrets. The outfit has a
unique internet and new-media prac- tice with precedent-setting
court cases for the sports and entertainment indus- tries. The firm
represented Boston Scien- tific in four separate cases, dubbed the
stent wars, in which Johnson & John- son alleged infringement
on features of a stent. Arnold & Porter was successful in
moving for summary judgment and affirming on appeal. Matt Wolf and
David Marsh were the key partners on several features of the
related trials. Wolf, Marsh, and newly-minted IP star Jennifer
Sklenar obtained post-is- suance rejection of claims in two patents
owned by Smith & Nephew on behalf of client Hologic. The team
used a multi- front strategy in its defense, filing peti- tions for
IPRs to cancel the asserted claims in view of prior art. By the end
of August 2014, all claims against Hologic in the district court
were rejected by the USPTO. Other patent litigation clients in-
clude Google, Hewlett-Packard, and GE/SightSound Technologies. In
the fields of copyright and trade- mark, Arnold & Porter has a
legacy posi- tion advocating before copyright royalty boards, and
the practice now includes brand protection and enforcement for
prominent luxury goods clients. Gucci, Swarovski, Pernod Ricard,
and Altria are examples. In February 2014, Arnold & Porter ob-
tained an injunction in a copyright in- fringement matter in which
its client, Nexstar Broadcasting, sought relief from Aereos
television programming retrans- mission practices. The decision
marked the first time that plaintiffs in the sur- rounding Aereo
litigation were able to obtain an injunction. Star attorney Robert
Garrett led the team in this case and has also represented several
large networks in related copyright litigation against FilmOnX, a
web service stream- ing television broadcast stations over the
internet. Arnold & Porter was awarded Manag- ing IPs Copyright
Firm of the Year South in 2015. Banner & Witcoff UPDATE Based
in Chicago, Banner & Witcoff also has a strong presence in
Portland, Oregon; Washington, DC; and Boston, Massachusetts. More
than 90 attorneys
9. 8 IPSTARS UNITEDSTATES 2015 UNITED STATES NATIONAL ANALYSIS
represent a diverse mix of clients that range in size, location,
and industry. Over the years, the firm has built its rep- utation
upon a client-focused approach and flexibility regarding billing
and tai- loring techniques to fit each clients needs. Almost 50
Chicago-based attorneys take on a range of client issues. Many
focus on patent prosecution and litiga- tion, but they can further
boast their trademark experience. Clients speak highly of Banner
& Witcoff. In the words of one: The firm is very effective at
han- dling litigation on our behalf; they achieve the results we
seek at a reason- able cost, and they are always aware of and
aligned with our business strate- gies. Furthermore, clients and
peers alike extol several others at the firm chief among them, the
names Darrell Mottley, Helen Hill Minsker and Christopher Renk are
frequently men- tioned. Mottleys knowledge of electrical and
mechanical processes, internet tech- nology, and computer-gaming
make for a sophisticated patent prosecution prac- tice. Minskers
practice primarily con- cerns trademark and copyright law. She has
served on the board of directors for both INTA and AIPLA. Renks
clients have included household names such as Nike, which in 2013
he represented in a trademark victory in protracted litiga- tion
with Yums dating back to 2009 that also involved the design of
Nikes Air Force 1. Out of the Washington, DC office, Robert Katzs
handling of utility patents and industrial designs, among others,
is broadly applauded. A competitor asserts, He is very creative and
working on the cutting edge. Birch Stewart Kolasch & Birch
UPDATE Since its founding nearly 40 years ago, Birch Stewart
Kolasch & Birch has evolved into a full-service IP firm whose
expertise with patent prosecution and post-grant patent review,
including reex- aminations and reissues, has become a well-known
force nationally. This recog- nition puts the firm among the top
tier. Located in Falls Church, Virginia, the firm is powered by the
strengths of more than 50 dedicated professionals, nearly half of
whom are partners. BSKBs deep bench contains the likes of MaryAnne
Armstrong, whose practice is aug- mented by biochemistry and
immunol- ogy degrees at the post-collegiate level. Robert Kenney
bears considerable experience with the pharmaceutical and
biotechnology, mobile telecommunica- tions, electronic and
electrical equip- ment, chemicals, and automobile and parts
industries. Another attorney, Leonard Svensson was recently in-
volved in a case for Leo Pharmaceutical Products before the Federal
Circuit. The result was the reversal of a USPTO deci- sion of
obviousness on a psoriasis drug patent. Brinks Gilson & Lione
UPDATE With approximately 135 attorneys, Brinks Gilson & Lione
is among the largest of its kind as a full-service IP firm with
offices in Detroit and Ann Arbor, Michigan; Indianapolis, Indiana;
Washington, DC; Durham, North Car- olina; Salt Lake City, Utah; and
Chicago, Illinois, the last of which also serves as its
headquarters. Since 1917, its attor- neys have provided premier
legal serv- ices to name-brand clients including Honda, RJ Reynolds
Tobacco, and Maersk Drilling. Their expertise with litigation ex-
tends to both trademark and patent pros- ecution and licensing.
Theyve been doing well especially considering the consolidation in
the industry, a com- petitor attests. A client elaborates, Im very
happy. Brinks Gilson & Lione has a tough, analytical approach
to litigation that is fact-based but does not overlook the behavior
and perception issues that are naturally part of jury trial work in
the US. The firm is a longtime standout here, another claims, with
a great group of people [who are] very talented. It is further
described as one of the stal- wart firms in the country with a lot
of good IP attorneys. Peers praise William Frankel, who is called a
great commu- nicator and student of the law as well as a strong
litigator patient and thoughtful. He is chair of the firms
copyright group, and his practice further encapsulates the full
spectrum of IP-re- lated activities. Peers consider his col- league
also in the Chicago office James Sobieraj as an excellent patent
litiga- tor. As president, he contributes more than 30 years of
experience with the en- forcement, licensing, and procurement of
intellectual property rights. Brooks Kushman UPDATE The
Michigan-based IP outfit Brooks Kushman was founded in 1983 and has
grown significantly from its five first founding partners. From
such humble beginnings, the firm now has more than 90 dedicated
professionals. They are ca- pable of handling a full range of
intellec- tual property matters, both nationally and around the
world. Today, they work out of Southfield, Michigan, with a sec-
ond location in Los Angeles. The firms specialties encompass
counseling on IP, technology, and commercial issues, and it is no
stranger to litigating in state and federal courts. That is a firm
with a good national reputation, a peer insists. Several others in
Michigan marvel at how quickly Brooks Kushman became a powerhouse
in the IP arena. Firm president Mark Cantor can take much credit
for expand- ing its national and international pres- ence. Also
serving as co-chair of its litigation practice, he is astute when
it comes to complex litigation regarding all aspects of technology,
and he has tried patent, trademark, trade secrets, and copyright
cases throughout the country as well as in international fo- rums.
In recent years, he represented Joymax Trading, a handbags and
fash- ion accessories distributor, in a case over claims of
trademark, trade dress, and copyright infringement. He was able to
reach a settlement after his client received favorable rulings on
key pre- trial motions. Litigator Frank Angileri, who won this
years Michigan Litigator of the Year award in Managing IPs North
America Awards, recently scored a victory for client Dominos pizza
by attaining a hard-won summary judgment against Im very happy.
Brinks Gilson & Lione has a tough, analytical approach to
litigation that is fact- based but does not overlook the behavior
and perception issues that are naturally part of jury trial work in
the US.

claimant GeoTag, a non-practicing en- tity based in Texas. The
representation is particularly exceptional due to Angi- leris
persistence on behalf of Dominos, who ended up being the lone
defendant out of 500 to stave off settlement for a chance at trial.
Robert Tuttle regularly receives the accolades of peers throughout
the state. One describes him as an aggressive, top-notch litigator.
Indeed, these recom- mendations are largely confirmed, as he has
received several awards over the years, including being previously
named Managing IPs Michigan Litiga- tor of the Year. The partner
has been rep- resenting Double L, owner of restaurants throughout
the state, in on- going trademark litigation relating to the Luckys
and Luckys Steakhouse design trademarks. Cooley UPDATE Cooley is a
national general practice firm with 850 lawyers around the world,
approximately 140 of whom specialize in IP law. Based in Palo Alto,
the firm has a deep West Coast footprint in addi- tion to
maintaining a strong presence in the countrys interior and in the
east. Cooley handles IP litigation, prosecu- tion, licensing, and
counseling for patent, trademark, and copyright clients.
Bet-the-company patent litigation is a big focus for the IP group,
as is handling counseling, copyright litigation, and both
contentious and non-contentious trademark matters. Since 2008,
Cooley lawyers have served as lead counsel in more than 35
trademark infringement suits. The firms IP practice features more
than 50 partners nationwide and is led by Jim Brogan in Colorado in
close con- cert with litigation and prosecution prac- tice group
leaders in Palo Alto and San Francisco. Brogan is Managing IPs 2015
Colorado IP Litigator of the Year. In the past few years, Cooley
has seen the growth of its ITC practice, a large in- crease in the
volume of patent litigation, a substantial number of successful
patent applications, and a sizeable trade- mark practice in
litigation, applications, and cancellations. Cooleys team in-
cludes California-based attorneys John Crittenden, Michael Rhodes,
Heidi Keefe, and Thomas Friel; New Yorks Janet Cullum; and
Washington, DCs Peter Willsey. These individuals come highly
recommended by clients and peers alike. One describes Crittenden as
a talented and knowledgeable trade- mark litigator. Another asserts
of Keefe, Heidi is a tireless and effective court- room advocate
for her clients. These sources further praise the firm as a whole.
One declares, Ive been ex- tremely happy with the quality of the
work they have provided. They bring a very strategic approach and a
personal passion for their work. A client corrob- orates this:
Cooley has a strong expert- ise in the law and in the procedural
rules specific to the forums in which patent litigations tend to be
filed. They also have depth of litigation and techni- cal support
talent. A third adds: Theyre such a strong force in the high- tech
space. [They] see a lot of corporate deals [and] still see a lot of
really prom- ising start-ups in the Bay Area. Because of that, they
continue to be in the front pack as far as representing interesting
clients in the IP space. In 2015, Cooley won the Managing IP award
for Trademark Prosecution Firm of the Year West. Covington &
Burling UPDATE As Covington & Burling approaches its
centennial, the international law firm can reflect upon its long
tradition of ex- cellence and success since first opening its doors
in Washington, DC. Still main- taining its headquarters in the
capital, the firm has also expanded its domestic presence with an
office in New York in three in California. More than 175 IP
attorneys give life to these locations nationwide. The firm is
renowned for its governmental and reg- ulatory affairs practices,
and its ITC practice is considered elite. The firm re- cently
represented a Johnson & Johnson subsidiary, Janssen
Pharmaceuticals, in Hatch-Waxman litigation; Samsung in both
federal court and ITC patent litiga- tion; and Microsoft on matters
regarding software patents. Other clients repre- sented in District
Court or the ITC in- clude Hewlett-Packard, Merck, and Knowles
Electronics. Covington & Burling is regularly cited among the
top firms practicing be- fore the International Trade Commis- sion.
It is adept at integrating its litigation team practicing in
domestic and foreign trial courts and tackling the expedited
schedule and procedural haz- ards the ITC presents. The firm has
rep- resented Samsung Electronics, Huawei, Knowles, Energizer,
Scientific Atlanta, and other major electronic or consumer goods
manufacturers on matters related to LED technology, silicon
microphones, and wireless technology. Hoffman- LaRoche is also
listed among its well- known clients. The firms ITC specialists
include Sturgis Sobin, Maureen Browne, and Alexander Chinoy in
Washington, DC and Robert Haslam in Silicon Valley. A client
praises Haslam: He has an unbe- lievable ability to take complex
technical issues and explain them in a fresh way a jury will
understand. Another attests, He should be in the top tier, adding,
I see him a lot in the market. I see him a lot while pitching
cases. As one source concludes, They are a well-oiled machine. They
focus on what the technical issues are. He further re- marks,
People get caught up in the pro- cedure, but, at the end of the
day, they wont win the case. I was impressed by Covingtons ability
to cut away the noise. Cowan Liebowitz & Latman UPDATE Cowan
Liebowitz & Latman is a single- office law firm based in New
York City. The firm, which was founded in 1957, re- mains lean at
50 attorneys. However, it is a strong outfit, as most of these are
partners highly equipped to handle a slew of IP-related affairs.
They are great in copyright and do a lot of trade- mark work, a
source notes. This sentiment, in fact, is widely echoed: Several
well-known clients turn and return to the firm for the consistent
merit of their work. Cowan Liebowitz & Latman recently obtained
an order on behalf of Ferrari, enforcing a prior settle- ment
agreement in a trademark dispute with a manufacturer of high-end
replica model cars. Also of note is Major League Baseball
Properties, which the firm rep- resented in trademark oppositions
and cancellation proceedings, and its inten- sive work within the
music industry. Re- garding the latter, the firm represents
plaintiffs and defendants alike in high- profile copyright
infringement litigation. Richard Mandel, William Borchard, Richard
Dannay, and Mary Kevlin are all active members of the firm,
well-re- spected for their capabilities in the IP arena. They
receive the accolades of peers and clients alike, who note their
responsiveness and intimate familiar- ity with clients particular

standout for this firm are the results they deliver, their
expertise as trademark practitioners and litigators, and their
communication and client re- lationships. Davis Wright Tremaine
Davis Wright Tremaine employs more than 75 intellectual property
attorneys out of eight offices spread across the United States, the
majority of which are on the West Coast. The full-service firms IP
practice is renowned for provid- ing copyright litigation and
counseling services for clients in entertainment, communications,
media, and related technologies. In recent years, its attor- neys
had been at the forefront of litiga- tion involving file-sharing
services, digital publications, and the intersection of First
Amendment and copyright law. The IP practice is chaired out of New
York by Alexandra Nicholson, who pro- vides trademark portfolio
management to Sesame Workshop, Martha Stewart Living Omnimedia,
Home Box Office, and Wenner Media, which publishes Rolling Stone,
Mens Journal, and US Weekly. Debevoise & Plimpton UPDATE
Offering a wide range of business and transactional services,
Debevoise & Plimpton maintains two offices domes- tically, in
New York and Washington, DC, as well as six more across Europe and
Asia. Debevoise is considered a first- rate law firm for trademark
and copy- right litigation in parallel with its work in
advertising, media, and entertain- ment. Although the 18 attorneys
in the media and communications, technology, and intellectual
property practice group make up a relatively small percentage of
the 650 lawyers at the firm, Debevoise is one of the most highly
reputed of firms in trademark and copyright litigation. Debevoises
IP litigation group is based in New York and led by Bruce Keller,
who was referred to as an ex- cellent lawyer first rate in every
re- spect. He is distinguished for his career in copyright,
trademark, enter- tainment, advertising, and related mat- ters.
Former clients include: Sony Pictures; NBC, CBS, and ABC; Amazon;
the National Football League; the New York Times; the Washington
Post; and many other media companies. A peer calls him a brilliant
lawyer, further remarking on his service as general counsel of
INTA. Another finds Keller to be outstanding practical and as- tute
all at once. The New York office also features David Bernstein, who
is revered as a top trademark lawyer by peers. [He] is as good as
anyone in trademarks, one attests. He represented Yves St Laurent
in a trademark infringement suit with Christian Louboutin over
Louboutins trademark on footwear with lacquered red soles. The suit
was resolved in 2012 after litigation in both the District Court
and the Second Circuit. In 2013, Bern- stein lead a trial team
defending the Kate Spade Saturday clothing brand in a se- ries of
expedited hearings and a bench trial. The plaintiff in the case,
Saturdays Surf NYC, sought to prevent the launch of the Kate Spade
Saturday brand. Desmarais UPDATE Desmarais may be a single-office,
New York-based patent litigation firm, but its reach is broad, and
nearly 35 attorneys can cover a lot of ground quickly. Be- tween
them, its patent litigators have decades of experience practicing
in the federal courts. Clients spare no praise for their abilities,
as they are said to offer a superior level of litigation strategy,
courtroom skills, and client counseling. Five years ago, John
Desmarais and a core group of attorneys, including Paul Bondor, Jon
Hohenthaner, Alan Kellman, and Michael Stadnick, left a large
patent litigation practice to strike out on their own. Much of the
firms ear- liest work concerned a patent portfolio owned by Round
Rock Research, which was acquired in part from Micron Tech-
nologies. From these beginnings, the firm has steadily attracted
major clients that represent a range of industries, in- cluding
Cisco Systems, IBM, MetroPCS, Boston Scientific, and
GlaxoSmithKline. Today, this group is nationally known as some of
the most prominent litigators both for their skillsets and their
secure position at the forefront of the industry. As an attorney,
Desmarais himself is lauded by clients and peers alike. One calls
him a unique lawyer and great when personally engaged. Competitors
across the board acknowledge the part- ner as a top IP trial lawyer
with a lot of trial experience. As one simply puts it: Hes a good
guy. The firm won Managing IPs 2015 award for National Plaintiff IP
Firm of the Year. Dickstein Shapiro UPDATE Dickstein Shapiro has 47
full-time, IP- dedicated lawyers and six offices in the US.
Although the firm is predominately recognized for patent
litigation, attor- neys in the IP group also handle con- tentious
trademark and copyright matters as well as a substantial amount of
transactional, licensing and counsel- ing work. The emphasis placed
on plain- tiff representation is one aspect that distinguishes the
firm from its peers, as is the firms focus on maintaining close,
professional relationships with their clients. Partner and deputy
practice leader of the firms IP Practice Steven Weisburd has
focused his practice representing clients in litigation, licensing,
and strat- egy development. Deborah Fishman and Weisburd are
defending Olympus and its various entities in patent in- fringement
claims brought by Perfect Surgical Techniques. The firm also filed
two petitions for inter partes review chal- lenging the validity of
two of the patents- in-suit, both of which have been instituted.
Star Jon Grossman focuses most of his practice on patent prosecu-
tion, but he also advises clients in copy- right, and general IP
counseling matters. DLA Piper With 77 offices across the globe and
more than 4,000 attorneys, DLA Piper is one of the largest
international law firms in the world. In the United States, the
firm employs upwards of 150 IP lawyers across more than 20 offices.
Locations in New York, California and Washington, DC are
particularly important centers of intellectual property expertise.
Peers say the strength of DLA Piper stems from its broad-based
capabilities across a full range of legal practices. The firms
reputation for handling patent litigation, trademark prosecution,
and copyright matters is especially strong. The firm successfully
defended subsidiaries of St Jude Medical in a patent infringement
case regarding wires that measure pressure in blood vessels. It was
ruled that St Jude did not infringe two patents of medical
device

Feldman are praised as a great go-to resource who make themselves
available, both as lawyers and as businesspeople. Drinker Biddle

practice firm with 11 offices and 65 IP lawyers across the United
States. Drinker Biddles attorneys han- dle a substantial amount of
patent liga- tion and prosecution but are also widely known for
expertise across trademark and copyright law. The firm represents
B/E Aerospace, one of the worlds largest manufacturers of com-
ponents for jet airplanes, in connection with the companys
trademark and patent portfolios in addition to provid- ing
counseling, litigation and licensing services. The portfolios for
B/E Aero- space reportedly comprise more than 280 pending and
issued patents and 175 pending applications and registered
trademarks. In one litigation matter, at- torneys represented
defense clients Samsung Techwin and Samsung Opto- Electronics in a
suit brought by another company alleging that Samsung digital
cameras infringed two patents involv- ing USB technology. Duane
Morris UPDATE Headquartered in Philadelphia, Duane Morris is a
full-service international law firm upholding a strong presence in
27 cities, where more than 700 attorneys are responsible for some
of the worlds largest companies. Of these, approxi- mately 90 in
the United States concen- trate on IP affairs. The team has grown
and expanded its practice areas over the years, and today has
established a favor- able reputation within the legal commu- nity.
A peer explains, They have a good practice focused on patent and
technol- ogy litigation. He continues, They are largely litigators
and trial lawyers, and they have a good client base. One source
says, Duane Morris has superior practitioners. Competitors
compliment their work on the con- tentious and non-contentious
trademark side as well as for patent litigation, coun- seling, and
prosecution. Patent litiga- tion is their bread and butter, a
source reports. Woody Jamesons superior level of expertise in this
goes virtually uncontested. The Atlanta-based partner chairs the IP
practice group. He is held in high regard among his peers. Jame-
son is a great trial lawyer with a national reputation, says one.
Another celebrated attorney, Matthew Gaudets practice primarily
concerns patent litigation as well as re- lated complex commercial
and technol- ogy litigation. Between him and Jameson, they manage a
client roster that includes T-Mobile, Netapp, Cisco, and Aeroflex
in electrical, computing, and telecommunications patent dis- putes.
Its record of success on large, complex cases cause clients to
return to the firm. Durie Tangri UPDATE Durie Tangri is a widely
celebrated liti- gation boutique that grew from six attor- neys
five years ago to more than 20 attorneys who consistently
demonstrate passion for the practice and their craft. This has not
gone unnoticed by the legal community. Its a very good firm, says
one peer. Their reputation is one that has climbed through the last
couple of years. They seem like theyve definitely made great
strides. The firms portfolio of clients consists of large household
names like Google, Genentech, LinkedIn, and Twitter as well as
smaller but still notable companies such as Fitbit, Snapchat, and
Eventbrite. Other clients include Quantum, Dish Network, Yelp,
Netflix, Shutterfly, Guidewire Soft- ware, and RingCentral. They
have a re- ally interesting client base, a peer confirms. If I had
a tech company [or] a small company [that] needed ninjas in- stead
of an army, thats whom Id hire. The firm is frequently enlisted by
such companies when hundreds of millions of dollars are on the
line. The firm operates out of its San Fran- cisco office. Pound
for pound, its the best patent shop in the country, attests a
competitor. Says a former co-counsel, Durie Tangri is very a
skilled, highly competent, and efficient firm of true pro-
fessionals. Its attorneys are individually recognized by peers
nationwide for their innovative yet no-nonsense approach to
litigation. Its boutique status is consid- ered an asset rather
than a shortcoming. As a competitor reports, They are not big
enough to be wasteful or frivolous with legal arguments. Daralyn
Durie and Ragesh Tangri come highly recommended across the board.
Durie is called an excellent prac- titioner with a significant
patent litiga- tion practice and a Northern California leader. She
led a team that won summary judgment that Googles book digitizing
project is a fair use. This ended eight years of litigation and is
still considered among the most significant copyright rulings in
recent years. On the patent side, theyve done a bunch of patent
work killing on Section 101 grounds. Theyre really pushing the edge
of the envelope. In 2008, the two name partners along with Clem
Roberts and Stanford Univer- sity professor Mark Lemley made the
decision to leave Keker & Van Nest to forge their own way and
open Durie Tangri. Roberts is called a brilliant lawyer absolutely
brilliant. He will be a leader of the bar, attests a peer. He is a
rising star in a small firm full of stars, another agrees. He is
tactical, efficient, and gracious, enthuses a competitor. Hes
really fast on his feet and an ele- gant writer. Lemley, a source
contends, is an excellent professor, litigator, and counselor as
well as a widely recog- nized IP author. In 2015, Durie Tangri won
Managing IPs Specialty IP Firm of the Year award. Faegre Baker

Trevor Carter is recommended for his capabilities with patent
litigation, as is Ken Liebman, who is further noted for his
practice in due diligence when companies, investors, and
institutions in the fields of medical technology and in- formation
technology are concerned. Hes good, attests a peer. Overall, an-
other reports, the team is doing great work. Fenwick & West
UPDATE For more than 40 years, Fenwick & West has been at the
forefront of the in- dustry and today represents some of the
leading high-technology and life sci- ences clients with their IP
requirements. Chief among these are such household brand names as
Facebook, Twitter, and Amazon, which the full-service firm rep-
resents in a range of litigation, prosecu- tion, and transactional
matters. Founded in the heart of Silicon Valley, Fenwick & West
operates out of three West Coast of- fices with an additional
outpost in Shanghai. The firms strong presence in California and
Seattle makes it a very popular as a firm representing Silicon
Valley companies, a competitor notices. They get a lot of business
from them, and their clients are quite pleased with the work they
do for them. The firms impressive client list also includes
companies like Cisco, NVIDIA, and Symantec, which they regularly
as- sist with complex patent litigation, patent prosecution, and
before the ITC. Its attorneys further represent several start-up
clients that are later involved in multimillion-dollar acquisitions
by jug- gernauts such as Google, Oracle, and AOL. The firm can
boast one of the largest patent prosecution practices, with 36
attorneys and 20 agents. John McNelis is a noted specialist in this
area. His skillset also encompasses IP dili- gence and audits,
patent counseling, and patent reexaminations for computer soft-
ware and hardware technologies. Robert Hulse has had success as a
patent prosecutor in electronics, com- puter software,
telecommunications, and related technologies. Hulse provides
counseling and portfolio management, including consulting on
standard essen- tial patents like MPEG, 802.11, and WiMAX. The firm
has more than 40 IP part- ners on the West Coast, the majority of
whom operates from its office in down- town Mountain View. Located
San Fran- cisco, Laurence Pulgram leads commercial litigation for
the firm and serves as co-chair of copyright litigation. His robust
practice is bolstered by 30 years of trial and appellate
experience, and he is particularly attuned to emer- gent web and
internet technologies cloud computing, for example. Michael Shuster
is Fenwicks life sci- ences co-chair. Shuster is based in San
Francisco, where he focuses his practice on biotechnology and
chemical and pharmaceutical companies. The second co-chair of life
sciences is Stephen Gra- ham. Also serving as managing partner of
the Seattle office, his practice fre- quently concerns corporate
and transac- tional work as well as mergers and acquisitions as
needed by high-tech clients and pharmaceutical companies, among
others. This involves both emer- gent technologies and more
established high-growth companies. Many of Fenwicks alumni have a
sig- nificant influence on policy making in the White House, before
Congress, and in the USPTO. Former Fenwick attor- neys include the
head of the USPTO, Michelle Lee as well as Colleen Chien, a former
academic, who is now the a sen- ior technology advisor to the White
House and coined the term patent-as- sertion entities. Chien is
considered one of the worlds top thought leaders for in- tellectual
property. Finnegan Henderson Farabow Garrett & Dunner UPDATE
The name Finnegan Henderson Farabow Garrett & Dunner bears the
weight a 50-year-plus presence in the market. With nearly 400
lawyers spread throughout nine offices in the United States,
Europe, and Asia, the firm is one of the best-known IP outfits in
the na- tionand certainly among the largest. Theyve got a really
strong bench of peo- ple that do good work, a peer says. Clients
corroborate this sentiment. In the words of one, The service from
this firm is always timely, useful, clear, and outstandingnot only
from their part- ners, but their bench of associates all op- erate
to an extremely high standard. Finnegan attorneys cover all aspects
of patent, trademark, copyright, and trade secrets law. This

have specialists in every domain in IP. A client adds, Finnegan is
uniquely qualified in all matters related to IP; in particular, we
have been impressed with their expertise in ITC investigations and

counsel who has a strength in his practice before the International
Trade Commission. The source adds, Bob is a great collab- orator
with our firm and with co-coun- sel working in the district court.
His robust practice encompasses portfolio management, licensing,
trade secret pro- tection, and copyright protection of soft- ware.
Several attorneys are noted stars for the individual and combined
efforts on behalf of their clients. Donald Dunner, also of the
firms Washington, DC, office, is noted by peers as the best CAFC
liti- gator in the USA, an excellent appel- late advocate, and a
top appellate IP lawyer. Another goes even further: He is the

coun- seling. Last year, they filed nearly 5,000 patent
applications in the US and more than 3,500 abroad. For US and
foreign trademarks, the firm filed nearly 1,300 in 2014 as well.
Fish is a one-stop shop, a peer as- serts. It has significant
litigation groups and significant prosecution groups. An- other
explains, Its a true patent litiga- tion group and worth the money,
because thats what they do. Yet a third warns, Its always a force
to be reck- oned with. Clients agree. Says one, Fish &
Richardson is absolutely one of the best. They are unparalleled in
the combination of client responsiveness, service, and the quality
of work product. They are truly best in class in my opin- ion.
Another surmises, Despite their size, Fish & Richardson has an
ability to produce both great and uniform legal counsel. Their high
standards transcend their many practice groups and offices. Patent
ligation remains a central pil- lar of the firms success. Over the
years, its attorneys have won cases worth bil- lions in
controversy. These decisions have had a great impact on the law,
often making for new ones to emerge. Its clients include some of
the most innova- tive and influential industry leaders coming from
a diverse spectrum of sec- tors. In recent history, the firm
secured significant jury verdicts for Allergan in patent
infringement suits against the generic pharmaceutical manufacturers
Sandoz, Lupin, High-Tech, and Watson. These decisions were upheld
in the Fed- eral Circuit in 2013, and the following year, the firm
successfully represented this client again in the Eastern District
of Texas concerning a similar formula- tion of the drug. Juanita
Brooks led the charge in both matters. Brooks won Managing IPs
California IP Litigator of the Year award in 2015, in part due to
her expert representation of Fresenius in a 10-year- long patent
litigation suit that finally ended in 2014. She is a great trial
lawyer, a peer remarks. Talented litiga- tor Jonathan Singer, who
is active in both the Minneapolis and San Diego of- fices, leads
the firms life sciences litiga- tion practice. Several competitors
offer praise for Washington, DC-based Ruffin Cordell, who is fluent
in all varieties of IP. He is an effective advocate, one attests.
Oth- ers describe him as a terrific guy and a fine trial lawyer. A
peer concurs, Ruffin is an outstanding trial lawyer, who is very
easy to work with. Fish & Richardson is Managing IPs Patent
Contentious Firm of the Year in 2015. Fitzpatrick Cella Harper

Harper & Scinto has developed into a full-service IP firm with
more than 150 attorneys, including upwards of 50 partners, focused

made a name for itself in patent prosecution and litiga- tion
regarding the pharmaceutical, life sciences, and biotechnology
sectors. The firm is a leading US institution, escorting clients
from Fortune 500 com- panies to internet start-ups through all
phases related to patents, trademarks, copyrights, unfair
competition, and trade secrets. One satisfied client en- thuses,
The quality of the work is excel- lent. They have a knack for
finding the right nuance or exploitation of a second- ary detail
that will overcome the exam- iners objections and get the patents
granted. In the words of another, They are the most
client-accommodating peo- ple Ive ever encountered. They just make
themselves available whenever you need them, and they provide
practi- cal advice and have a real, thorough knowledge of all the
relevant subject matters. A peer adds that the firm em- ploys
consistently excellent litigators and prosecutors. The firm
currently handles more than 100 patent litigation cases on a
national level involving biotechnology, electronics, trade secrets,
copyrights, and trademarks. Still, Fitzpatrick maybe best known for
its high-stakes pharmaceutical patent litiga- tion practice. After
a seven-day trial that closed in October 2013, New York-based
partner Dominick Conde secured a win for Merck, when a judge ruled
that San- dozs proposed genetic products infringed every asserted
claim of four patents cov- ering AzaSite azithromycin eye drops to
treat eye infections. Pfizer and InSite own the patents, although
Merck markets them. The former managing partner is frequently
enlisted by several big-name clients, including Bristol-Myers
Squibb, Eli Lilly and Company, Entegris, Ikaria, LEO Pharma, Mars,
Sanofi-Aventis, and Warner Chilcott. Several partners are singled
out for their superior knowledge of IP matters. A client remains
impressed by John Murnanes excellent insight and the ability to get
to the core of issues quickly. As for Michael Sandonato, a client
immediately replies A++. The source adds, In my 15 years of working
with Mike, I and our executive team have been impressed by the
profession- alism, legal acumen, attitude, and client- focused
approach to his work. This Despite their size, Fish &
Richardson has an ability to produce both great and uniform legal
counsel. Their high standards transcend their many practice groups
and offices.

Chicago, Boston, Washington, DC and California offices are also

electronics sectors. Other practice areas the firm is en- gaged in
include general IP counseling, patent litigation, and Section 337
