Press Conference 2013• Autopsy: Catawba plant worker

died of hydrogen sulfide intoxication;

• Samir Storey, 39 and others were cleaning a 10-by-40-foot tank;

• “clear, cloudy smoke” entered the tank, triggering emergency alarms, which trapped Samir in the tank;

• Hydrogen sulfide affects the body in two ways, she said. It blocks oxygen from binding with blood cells, and it interrupts the central nervous system, which, in turn, affects the respiratory system.

• 1910.146(k)(2)(iv);

• Ensure that affected employees practice making permit space rescues at least once every 12 months, by means of simulated rescue operations in which they remove dummies, manikins, or actual persons from the actual permit spaces or from

representative permit spaces. Representative permit spaces shall, with respect to opening size, configuration, and accessibility, simulate the types of permit spaces from which rescue is to be performed.

• Employer indifference to the working conditions of many contingent workers is simply unacceptable.

• While some employers may believe they are not responsible for temporary workers, OSHA requires that employers ensure the health and safety of all workers under their supervision and control.

• We need to make it clear to supervisors, staffing and temp agencies, and other employers that even if workers are temporary, they are entitled to the same safety and health rights and should be treated no differently from other workers.

The March Toward Criminal 1983

• Film Recovery – 1983;

• Stefan Golab, a Polish Immigrant died February 10, 1983 while cleaning out tank containing sodium cyanide;

• Three managers prosecuted by Cook County States Attorney;

• Two received 18 month sentences of manslaughter.

Imperial Foods 1991

• September 3, 1991;

• 25 workers died in food processing plant;

• Owner locked rear doors to prevent workers taking breaks, stealing chicken and to keep out insects;

• Company cited for flies in 6/90 by USDA;

• Emmet Roe – 25 counts of involuntary manslaughter – Served 4 ½ years in jail

Not one inspection in 11 years despite multiple fires.

Grain Fire 1996

• January 13, 1996;

• Seward, IL.

• The Stickle employee collapsed and died due to carbon monoxide inhalation;

• After entering the bin, Pecatonica Fire Department Chief Dale Zimmerman became lethargic and was physically unable to climb the ladder to exit the bin;

• William J. Kirchner, 54, of Leaf River, IL, manager of Fasco's Seward elevator, pleaded guilty to a misdemeanor charge of making false statements on a document;

Victor A. Randolph, 42, of Cedar Rapids, a vice president of Stickle, indicted for obstructing an OSHA investigation and making a false document concerning workplace safety violations. Three years probation. $10,000 fine.

Dumping Toxic Waste 2000

• Allan Elias, 61, was ordered to serve 17 years in Jail;

• $6.3M in restitution;

• Told workers to clean cyanide tank without respirators;

• Employee suffered permanent brain damage;

Great White Fire 2003• February 20, 2003;

• 4 Station employees, one band member and 95 others died;

• 180 injured;

• Club had $1 million in liability policy limits, the foam insulation company had $5 million, the property owners had none, the city had $4 million, and the state has a cap of $100,000 per plaintiff;

• December 2003, a grand jury indicted the club's owners, brothers Jeffrey and Michael Derderian, and Great White's former tour manager, Dan Biechele, on 100 felony counts of involuntary manslaughter;Jeffrey received a suspended sentence; Michael was

sentenced to serve four years in prison because he bought the foam. Michael served less than three years and was released in 2008;

In May 2006, Biechele pled guilty to 100 counts of involuntary manslaughter and was served under two years in a minimum security prison

Entrapment 2010

• Haasbach, LLC. sent Will Piper 16, Alex Pacas 19, and Wyatt Whitebread 14, into the grain

bin.

• 179 grain entrapment deaths since 1984

• Michaels also says OSHA has urged both state and federal prosecutors to file criminal charges. "We don't have criminal prosecution powers," he says.

• Water Cardin, former safety manger to 78 months in prison for deliberately falsifying records of workplace injuries

• Franklin “Al” Bieri, age 54, five months for asbestos violations

• John Prisque, 63 sentence 70 months for OSHA crimes.

• Erasmo Ponce was sentenced to 90 days and $450,000 restitution.

• Matthew Lawrence Bowman, 41, of Houston, pleaded guilty to willfully violating the Occupational Safety and Health Act (OSH Act) and making a false statements. Awaiting sentence.

• Connie Knight, 47, sentenced 57 months for impersonating OSHA.

• A Philadelphia judge refused to allow Sean Benschop, 42, to leave jail.

• Tree-service owner charged with manslaughter of a child after 14-year-old fell 50 feet to his death while using a chainsaw in a tree.

• Jonathan Harves Wilkes, 37, of Palatka, FL turned himself in at the Sheriff’s Office and faces a maximum of 30 years in prison.

Criminal 2013

• David Hughart, sentenced on conspiracy charges. Judge Irene Berger gave Hughart 3½ years in jail and 3 years supervised release for his part in alerting miners to surprise MSHA inspections.

• Craig Sanborn owned the Black Mag plant in Colebrook, where the 2010 explosion killed 56-year-old Donald Kendall, of Colebrook, and 49-year-old Jesse Kennett, of nearby Stratford.

• Sanborn, 64, faces up to 30 years in prison on each of two counts of manslaughter and up to seven years on each count of negligent homicide.

• Eric Jensen, 37, and Ryan Jensen, 33, were arrested in the listeria outbreak investigation that killed 33 people.

• The F.D.A. said Jensen Farms bought the used processing equipment just before the outbreak, and it was corroded and dirty.

• Also, the packing facility floors were difficult to clean, so pools of water potentially harboring the bacteria formed close to the packing equipment, the agency said.

• Another possible source of contamination was a truck that frequently hauled cantaloupe to a cattle operation and was parked near the packing house.
