    1.Thedivisionshalldetermineandexecutethebestmethodforprotecting

    privateandpublicpropertyby:

    a.exceptasprovidedbySubsection(1)(e),preventingtheoriginandspread

    ofreonnonfederalforest,range,orwatershedlandinanunincorpo-

    ratedareaofthestate;

    b.protectinganonfederalforestorwatershedareausingconservation

    principles;

    c.encouragingaprivatelandownertopreserve,protect,andmanage

    forestorotherlandthroughoutthestate;

    d. takingactionthedivisionconsidersappropriatetocontrolwildlandre

    andprotectlifeandpropertyonthenonfederalforest,range,or

    watershedlandwithinanunincorporatedareaofthestate;and

    e. implementingalimitedresuppressionstrategy,includingallowinga

    retoburnwithlimitedormodiedsuppression,ifthedivision

    determinesthatthestrategyisappropriateforaspecicareaor

    circumstance.

    2. Thedivisionmay:

    a.enterintoanagreementwithapublicorprivateagencyorindividual:

    (i)forthepurposeofprotecting,managing,orrehabilitatingland

    ownedormanagedbytheagencyorindividual;and

    gravel,sand,soil,vegetation,orimprovementonstatelands;

    b.grazeslivestockonstatelands;

    c.uses,occupies,orconstructsimprovementsorstructuresonstatelands;

    d. usesoroccupiesstatelandsformorethan30daysafterthecancellation

    orexpirationofwrittenauthorization;

    e.knowinglyandwillfullyusesstatelandsforcommercialgain;

    f. appropriates,alters,injures,ordestroysanyhistorical,prehistorical,

    archaeological,orpaleontologicalresourceonstatelands;g.campsonthebedsofnavigablelakesandriversexceptinpostedand

    designatedareas;or

    h.parksoroperatesmotorvehiclesonthebedsofnavigablelakesand

    riversexceptinthoseareassupervisedbytheDivisionofParksand

    Recreationorotherstateorlocalenforcemententityandwhichare

    postedasopentovehicleuse.

    controllingare;

    c.refuses,onproperrequestofthestateforesteroranyofhisdeputies,to

    assistinthecontrollingofare,withoutgoodandsufcientreason;or

    d.resanytracerorincendiaryammunitionanywhereexceptwithinthe

    connesofestablishedmilitaryreservations.

    65a-8-203 CooperaTive ire proTeCTion agreemenTs WiTh CounTies

    1.Thecountylegislativebodyofanycountymayenterintoacooperativeagree-

    mentwiththedivisiontoreceivenancialandsupervisorycooperationand

    assistancefromthedivision.

    2. AcountymaynotreceivecooperationorassistanceunderSubsection(1)until

    acooperativeagreementisexecutedbythecountylegislativebodyandthe

    division.

    3.Inordertobeeligibletoenterintoacooperativeagreementwiththedivision,

    thecountyshall:

    a.adoptawildlandreordinancebaseduponminimumstandardsestab-

    lishedbythedivision; b.requirethatthecountyredepartmentorequivalentprivateprovider

    undercontractwiththecountymeetminimumstandardsforwildlandre

    training,certication,andwildlandresuppressionequipmentbasedupon

    nationallyacceptedstandardsasspeciedbythedivision;and

    c.lewiththedivisionabudgetforresuppressioncosts.

    4.Acountythatchoosesnottoenterintoacooperativeagreementwiththedivi-

    sionmaynotbeeligibletoreceivenancialassistancefromthedivision.

    5. Thestateforestermayexecutetheagreementsandmaydividethestateinto

    reprotectiondistricts.

    6. Thesedistrictsshallprovideefcientandeconomicalreprotectionwithinthe

    areadened.

    7. Thedistrictsmaycompriseoneormorecounties,orportionsofcountiesto

    bespeciedinthecooperativeagreements.

    8.Underthetermsofthecooperativeagreements,thestateforestershallle

    annualbudgetsforoperationofthe

    cooperativedistrictswitheachparticipatingcounty.

    9.Ifthecountyapprovesabudgetmutuallyacceptabletothecountyandthe

    stateforester,andbudgetsanamountforactualresuppressioncostsde-

    terminedtobenormalbythestateforester,theagreementshallcommitthe

    statetopay1/2oftheactualsuppressioncoststhatexceedthestatednormal

    costs.

    65a-8-204 WilDlanD ire suppression unD CreaTeD1.Thereiscreatedaprivate-purposetrustfundknownastheWildlandFire

    SuppressionFund.

    2. Thefundshallbeadministeredbythedivisiontopayresuppressionandpre-

    suppressioncostsoneligiblelandswithinunincorporatedareasofcounties.

    (ii)establishingapredeterminedresuppressionplan,includingalim-

    itedresuppressionstrategy,foraspecicremanagementarea;

    and

    b.enterintoareciprocalagreementwithareprotectionorganization,

    includingafederalagency,toprovidereprotectionforlandandanim-

    provementforwhichtheorganizationnormallyprovidesreprotection.

    b.Theequitypaymentshallrepresentwhatthecountysequityinthefund

    disbursementsfromthefunduntilthecloseoftheprogramyear,atwhich

    malbythestateforesterinaccordancewiththeformulaspeciedby

    rule.

    b.Acountyisnotrequiredtopayforanacreorrealpropertydescribedin

    Subsection(2)(a)(i)iftheacreorrealproperty:

    (i) issubjecttoconcentratedresidential,commercial,or

    industrialdevelopment;

    (ii) wouldnotbeexposedtowildlandre;and

    (iii)wouldnotexposeanywildlandtorespreadingfromit.

    3. a.Anycountythatelectstoinitiateparticipationinthefund,orreestablish

    duetoneglectorincompetence.

    b.Areescapingcontrolofthepermitteethatnecessitatesrecontrolac-

    tionordoesinjurytothepropertyofanotherisprimafacieevidencethat

    therewasnotsafe.

    5.Thestateforester,hisdeputies,andthecountysheriffsmayrefuse,revoke,

    postpone,orcancelpermitswhentheynditnecessaryintheinterestof

    publicsafety.

    6. a.Aburningpermitisnotrequiredfortheburningoffencelinesonculti-

    vatedlands,canals,orirrigationditchesif:

    ()theburningdoesnotposeathreattoforest,range,orwatershed

    lands;

    foresterinwritingthatacountysresuppressionbudgethasbeendepleted.

    2. Agoodfaitheffortmustbemadebythecountiestorecoversuppression

    costsforhumancausedres.Ifthecountyhasevidencethatindicatesa

    responsiblepartyforareandchoosesnottoproceed,suppressioncost

    forthatreisnoteligibleforreimbursementfromtheWildlandFireSup-

    pressionFund.Afterconsultationbetweenthecountyandstate,thestate

    foresterwilldetermineifagoodfaithefforthasbeenmadetorecoversup-

    pressioncost.3. WildlandFiresuppressioncostsrecoveredunderSection65A-3-4willbe

    repaidtotheWildlandFireSuppressionFund.

    4. Pre-suppressionprojectsmaybefundedfromtheWildlandFire

    1. Thefollowingstandardsareapplicabletoequipmentusedbyredepart-

    mentsrepresentingthosecountieswhohavecooperativewildlandrepro-

    mentsandotherredepartmentswhicharecontractedwiththecountiesto

    providereprotectiononprivatewildland.TheUtahDivisionofForestry,Fire

    andStateLandshasdeterminedthatthisstandardbemetbyJune1,2006.

    2.Enginesandwatertendersusedonprivatewildlandreswithinthecountys

    jurisdictionwillmeetthestandardforthetypeofequipmentplusappropri-

    1. Thecostofacountysapprovedpre-suppressionprojectsshallnotexceed

    75%ofthatcountysannualassessmentfeefortheWildlandFire

    SuppressionFund.

    2.Pre-suppressionprojectsmaybecostsharedataratebetween25%and

    75%ofthetotalcostoftheproject.Thecostshareratewillbedeterminedby

    thestateforesterforeachprojectcategoryonanannualbasis.Thesecost

    sharerateswillbecommunicatedtothecountiesbyJanuary30ofeachyear

    3. Pre-suppressionprojectsmaybeproposedformulti-yearfundedprojects.

    Thesemulti-yearfundedprojectsmaynotexceedthreeyears.Annualcostsharepaymentstoacountyforamulti-yearprojectmaynotexceed75%of

    thatcountysannualassessmentfee.Projectproposalswillbedeveloped
