DeemedConveyancewithoutOC:MAJORBOONFORSOCIETIES

Recently,thegovernmentissuedanoti�icationstatingthattoobtaindeemed conveyance OccupationCert i � icate is not required.Ramesh S. Prabhu explains whatthismeansforhousingsocieties

Though the deemed conveyance was initiallystartedin2010,inthelastsevenyearsabout2500deemedconveyanceordershavebeenpasseddueto the stringent norms for submission of thedocuments. One of the documents is Occupationcerti�icateorBuildingCompletioncerti�icate.Thedevelopers for one or the other reasons do notobtaintheOCandgivethepossessionofthe�lats.Thesedocumentsaretobegivenbythedevelopertothehousingsocietyandthereaftertheygranttheconveyanceoflandandbuildingtotheregisteredco-operative housing society. There are nearly20,000co-operativehousingsocieties inMumbaiwhoarenotabletogettheconveyanceduetolackof OC or building completion certi�icate or noncooperationfromthebuilderandthelandowner.Itisalwaysbene�icialforthebuildernottogivetheconveyancetotakeupredevelopmentorretaintheadditional Floor space index, Transfer ofDevelopment Rights e tc . On get t ing theconveyance, the society becomes the exclusiveownerofthelandandthenallfutureFSIandTDRwill be with the society and also go for theredevelopment.

RoleofRERA

Therewasagreathopetothe�latpurchasersthattheimplementationofRealEstate(Regulationanddevelopment ) Act, 2016 shall compel thedeveloperstoprovidetheOCandconveyance.Aspertheroughestimatetherearenearly3,00,000buildings in Maharashtra without OC and inMumbai city, the same is more than 15,000buildings. Considering such a huge problemGautam Chatterjee, chairman, MahaRERA hadrecommendedtothegovernmentofMaharashtra,to relax the requirement of OC to grant the

deemed conveyance. He also has recommendedthatoncetheconveyanceisobtainedwithoutOC,thesocietieswillbeabletogettheOCbyful�illingtheleastrequirements.Thusallthependingissuescanberesolved.

The recent judgment ofMaharashtra Real EstateRegulatory Authority (MahaRERA), stating thatbuildings which occupied without Occupationcerti�icate(OC)arenotcoveredunderRERAandarenotrequiredtoberegisteredhassurprisedeveryoneandall.

Therefore, on 18th September 2017, thegovernmenthasissuedanoti�icationstatingthattoobtain the deemed conveyance Occupationcerti�icateorbuildingcompletioncerti�icateisnotrequired. The societies need to give the proof ofhaving taken the possession of the �lats such asMunicipalcorporationorgrampanchayatpropertaxbillsorwaterbillsandanundertaking to theauthority that all the liabilities related to thebuildingregulationshallbeattheresponsibilityofthe society. This is going to ease the process ofdeemed conveyance. The societies should at theearliest obtain the conveyance of their land andbuilding.

required to execute an agreement as per the

services offered as prescribed by the council of

architecture.Thearchitectisrequiredtoobtainthe

regular approval required and the promoter is

requiredtouploadthesameonthewebsite.The

Acthasprovided that70%of the fundsreceived

from the customer should be deposited in a

designated account in a scheduled bank and

utilisedtowardsthecostoflandandconstruction

oftheproject.Thisensuresthatthefundsarenot

divertedandusedforthepurposeforwhichithas

been collected. This will be ensured by three

professionalscollectively(Architect,Engineerand

CharteredAccountant).

Architecthastoprovidethecerti�icateasandwhen

requiredbythepromoteraboutthepercentageof

workcompletedbyvisitingthesite.Thiscerti�icate

has to be obtained by the promoter before the

amountiswithdrawnfromthedesignatedaccount

inwhich70%ofthecollectionfromthecustomeris

directlydepositedandisusedforthepurposeof

thelandcostandtheconstructioncost.Oncethe

building is complete is all respect, a completion

certi�icatehastobeobtainedfromthecompetent

authority and submitted to the promoter for

withdrawalofthebalancelyinginthedesignated

account.

PROJECTENGINEER

A civil engineer needs to be appointed by the

promoterforthesupervisionandmonitoringofthe

real estate project. An agreement for various

servicestobeofferedneedtobeexecutedwiththe

engineer and the promoter should accept the

supervision by such engineer. The engineer is

required to submit the certi�icate regarding the

estimated cost of the project of construction.

During the construction period, he needs to

supervise thework andwhenever the promoter

requires,heneeds to submit a certi�icate for the

estimatedcostoftheconstructionincurredonthe

project. Such certi�icate needs to be obtained

before the amount is withdrawn from the

designatedaccountinwhich70%ofthecustomers

amountisdepositedtobeusedforlandcostandthe

constructioncost.

C H A R T E R E D A C C O U N T A N T F O R

CERTIFICATION

The promoter needs to engage the services of

charteredaccountantinpracticewhowouldverify

the certi�icate issued by the Architect and the

engineer with the books of accounts, bank

statement, etc and conclude the amount of land

cost and the construction cost incurred on the

project. He shall issue a certi�icate which will

entitlethepromotertowithdrawtheamountfrom

the70%designatedaccount.

CHARTEREDACCOUNTANTFORYEARLYAUDIT

The promoter is required to appoint a separate

practicingcharteredaccountanttoverifythebooks

of account, bank statements at the end of the

�inancial year andobtain a yearly audited report

stating that the amount collected from the

customerisutilisedfortherespectiveprojectand

70%designatedaccountwithdrawalhasbeendone

inthemannerprescribed. Theauditorisrequired

to verify the certi�icate issued by the architect,

engineerandthecharteredaccountforthepurpose

o f w i t h d r a w a l f r o m t h e a c c o u n t .

REPRESENTATIONBEFORETHEAUTHORITIES

As per section 56 of the Act, the promoter may

engagetheservicesofCharteredAccountant,Cost

Accountant, Company Secretary or the legal

practitioner to represent them before the real

estateregulatoryauthorityorrealestateappellate

Tribunaloradjudicationof�icertodefendtheside

ofthepromoteragainstanynotices,grievances.

OTHERSERVICEPROVIDERS

Thepromoternormallyappointscontractor,estate

agents and other professionals like project

management consultants, etc to complete the

projects.Allthesenamesalsoneedtobedisplayed

onthewebsiteoftheauthorityonregistrationof

therealestateproject.

Society.Despitethisprovision,largenumberofCo-

operativeHousingSocietiesarebeingdeprivedof

getting conveyance. while seeing the evading

tendency of the developer regarding giving

conveyanceofownershiprightsandinterestinthe

name of society, the Government has decided to

implementtheconceptoftheDeemedConveyance

in view of to give impetus to the Deemed

Conveyance,theactsuggestingtheamendmentto

theMaharashtraOwnershipofFlatsAct,1963was

publishedintheGazettedt.25/02/2008.

In view of effective implementation of the

amendments made in the act , co l lateral

amendments were made in the Maharashtra

OwnershipofFlatsRules,1964. Incidental to the

amendments made in the said act, the Govt.

Resolution was issued on dt. 25/02/2011.

However the Deemed Conveyance did not get

impetusasacceptedbytheGovernmentbecauseof

lack of ful�illment in the documents. To remove

these dif�iculties came across in Deemed

Conveyance, again a committee under the

ChairmanshipofPrincipleSecretary(Housing)and

Comprising Secretaries of Urban Development,

Revenue, Assistance and Rehabilitation and

Cooperation Department was formed under the

Government Resolution dt. 29/03/2016 the said

committee has scrutinized the reportwith some

amendments submitted by the Committee

operativeSocietiesandacceptedthesame.

Incidental to the recommendations suggested bythesaidcommittee,therevisedorderwasissuedondt.14/06/2016.Accordinglyfollowingdocumentswere made necessary wi th the DeemedConveyanceapplication.

Ans:IfOCisreceivedpriorto1stMay2017thenyourproject/phasewudbeexemptedfromRERAAct . Section 3 of RERA, provides, for theregistrationofallprojects beforeofferingforsalefromthecommencementoftheAct(whichisfrom1stMay2017)

When a prospective law is enacted for anyregulation, the provision is done for transitoryperiod. Infact,from1stMay2016itwasknownthatsection3willbeeffectivefrom1stMay2017.InSpiteofsuchaprovision,therewillbecertainprojectsnothavingCompletioncerti�icateasonthecommencement of theAct and the section3 hasmadeitclearthatsuchongoingprojectsneedtobecompleted.

As farasMaharera Rulesareconcerned,OC isconsidered as completion certi�icate for thepurposeofsection3.Thus,ifOCisobtainedinurproject/phaseonorafter1stMay2017thenyourproject/phase needs to be registeredwith RERAauthorities.
