Conditioners) Regulations 1988 S.R. No. 310/1988

1. Title

These Regulations may be cited as the State Electricity Commission (Energy Efficiency Labelling) (Refrigerative Air Conditioners) Regulations 1988.

2. Commencement

These Regulations come into operation on 30 August 1988.

3. Authorising provisions

These Regulations are made under sections 57 and 111 of the State Electricity Commission Act 1958.

4. Objectives

The objectives of these Regulations are to provide for—

(a) the setting of standards and procedures for the measurement of energy efficiency of refrigerative air conditioners; and

(b) the labelling and testing of refrigerative air conditioners for energy efficiency.

5. Definitions

In these Regulations—

"the Act" means the State Electricity Commission Act 1958;

"applicant" means a person who makes an application under Regulation 6;

"application" means an application described in Regulation 6;

"approved label", in relation to a refrigerative air conditioner, means—

(a) a label approved by the chief electrical inspector in accordance with the Regulations indicating the energy efficiency rating and the energy consumption rate of the refrigerative air conditioner; or

(b) a label approved or registered by a regulatory authority indicating the energy efficiency rating and the energy consumption rate of the refrigerative air conditioner.

"cooling co-efficient of performance", in relation to a refrigerative air conditioner, means the total cooling effect in kilowatts divided by the power input in kilowatts when both are calculated in accordance with the relevant test contained within the specifications;

"display front", in relation to a refrigerative air conditioner, means an assembly supplied by a manufacturer or an importer to wholesale or retail outlets which is intended to represent a model of the front of the refrigerative air conditioner;

"energy efficiency rating", in relation to a refrigerative air conditioner, means the value derived from the cooling or, if applicable, the heating co-efficient of performance calculated in accordance with the formula set out in Schedule 3;

"energy consumption rate", in relation to a refrigerative air conditioner, means the electrical energy consumption rate of the refrigerative air conditioner—

(a) calculated in accordance with the test contained within the specifications; and

(b) expressed as the rate of electricity consumed by the refrigerative air conditioner over a continuous period of 500 hours.

"heating co-efficient of performance", in relation to a refrigerative air conditioner, means the heating effect in kilowatts divided by the power input in kilowatts when both are calculated in accordance with the test contained within the specifications;

"output capacity", in relation to a refrigerative air conditioner, means the total cooling or, if applicable, the heating effect of the refrigerative air conditioner calculated in accordance with the specifications;

"refrigerative air conditioner" means a type, description or class of refrigerative air conditioner declared by the Governor in Council by Order published in the Government Gazette to be a proclaimed electrical appliance;

"regulatory authority" means a regulatory authority in another State or Territory as defined in section 51 of the Act;

"specifications", in relation to a refrigerative air conditioner, means the Air Conditioning Units Method of Assessing and Rating Performance—Refrigerative Air Conditioning published by the Standards Association of Australia as Australian Standard 1861.1–1988 as amended and in force from time to time;

"star rating" means the number of stars to be used to indicate the energy efficiency rating of a refrigerative air conditioner as set out in Schedule 3;

"test report" means a report in the form of Schedule 4, furnished by a testing facility relating to a refrigerative air conditioner which complies with the provisions of the specifications and including the results of at least three test runs carried out to determine each of the cooling, and, if applicable, the heating co-efficient of performance for that refrigerative air conditioner;

"testing facility" means a test laboratory approved by the chief electrical inspector.

5A. Conflict between the specifications and the Regulations

If there is an inconsistency between a provision of these Regulations and a provision of the specifications, the provision of these Regulations prevails.

6. Application for approval of a label

(1) Any person may apply to the chief electrical inspector, in the form in Schedule 1, for an approved label.

(2) The application must specify whether the applicant seeks an approved label for one type of refrigerative air conditioner only or two of more types of refrigerative air conditioners having the same energy efficiency rating and energy consumption rate but which the applicant distinguishes by a different brand or model name or a different model or catalogue number.

(3) The application must be accompanied by—

(a) a sample of the label in the form in Schedule 2 marked with the energy efficiency rating and energy consumption rate claimed by the applicant in respect of the refrigerative air conditioner; and

(b) a test report.

(4) If—

(a) an approved label has been approved in respect of a refrigerative air conditioner; and

(b) there has been a change in the energy efficiency rating or the energy consumption rate or any of the component parts or physical features relating to that refrigerative air conditioner or the brand or model name

or the model or catalogue number of the refrigerative air conditioner—

the approved label is no longer an approved label for the purpose of these Regulations and must not be used in respect of that refrigerative air conditioner.

(5) If an application is necessary by reason of the requirements of sub-regulation (4), the application must be accompanied by—

(a) a copy of the approved label issued in respect of the refrigerative air conditioner before a change referred to in sub-regulation (4) was made; or

(b) a copy of the application made in respect of the refrigerative air conditioner before a change referred to in sub-regulation (4) was made.

(6) The chief electrical inspector may require an applicant to deliver or make available to the chief electrical inspector any sample of the refrigerative air conditioner of the type in respect of which an approved label is sought, and any related data.

(7) The application must be accompanied by a fee of $50.00 for the examination of the labelling of the refrigerative air conditioner.

7. Testing of refrigerative air conditioners

An applicant must—

(a) ensure that refrigerative air conditioner in respect of which an approved label is sought has been tested in accordance with the specifications; and

(b) provide a certified copy of the test report for the refrigerative air conditioner in respect of which an approved label is sought.

8. Calculation of energy efficiency rating for refrigerative air conditioners

The energy efficiency rating indicated on a sample of a proposed label accompanying an application must be calculated in accordance with the formula specified in Schedule 3.

9. Prohibition on approval of a label

The chief electrical inspector must not approve an label in respect of any refrigerative air conditioner unless the refrigerative air conditioner complies with the specifications.

10. Form of label

The chief electrical inspector must not approve a label unless the label is in the form of Schedule 2.

11. Testing by chief electrical inspector

(1) The chief electrical inspector must accept a test report, unless—

(a) he or she reasonably believes that any of the required testing procedures have not been properly carried out; or

(b) he or she considers the test report to be inaccurate; or

(c) he or she considers that the test report does not comply with the specifications.

(2) If the chief electrical inspector does not accept a test report, the chief electrical inspector may carry out or require the applicant to carry out any tests that the chief electrical inspector specifies for the purpose of measuring the energy efficiency rating

and the energy consumption rate of the refrigerative air conditioner in respect of which an approved label is sought.

12. Testing of refrigerative air conditioners after approval granted

(1) After the approval of an approved label, the chief electrical inspector may on his or her own initiative or upon the request of any person at any time test or cause to be tested, in accordance with the specifications, any refrigerative air conditioner for compliance with the energy efficiency rating and energy consumption rate stated on the approved label for that refrigerative air conditioner.

(2) If the chief electrical inspector considers that he or she should test more than one refrigerative air conditioner under sub-regulation (1), he or she may select such refrigerative air conditioners as he or she considers necessary for testing for energy efficiency rating and energy consumption rate.

13. Notification of approval or refusal

(1) If the chief electrical inspector approves a label for a refrigerative air conditioner, he or she must notify the applicant in writing within 21 days after the approval.

(2) If the chief electrical inspector refuses an application for an approved label for a refrigerative air conditioner, he or she must notify the applicant in writing within 21 days after the refusal.

(3) If the chief electrical inspector revokes the approval of an approved label for a refrigerative air conditioner, he or she must notify the applicant in writing within 21 days after the revocation.

14. Refusal of application for approved label

(1) The chief electrical inspector may refuse an application for an approved label if—

(a) when examined, the proposed labelling of the refrigerative air conditioner is inaccurate; or

(b) the chief electrical inspector does not accept the test report for any of the reasons set out in Regulation 11; or

(c) the applicant does not comply with the requirements of these Regulations and the non-compliance is of a substantial or material nature.

(2) The chief electrical inspector may revoke an approved label if—

(a) the approved label of the refrigerative air conditioner is inaccurate; or

(b) the refrigerative air conditioner fails to comply with the specifications; or

(c) the applicant requests the revocation of an approved label; or

(d) the applicant does not comply with the requirements of the Regulations and the non-compliance is of a substantial or material nature.

15. Changes in details contained in application

The applicant for an approved label must, within 21 days of any change in the applicant's name and address (whether before or after the label was

approved), furnish to the chief electrical inspector a statement which contains particulars of that change.

16. Notices

If the applicant is not a company incorporated pursuant to the Companies (Victoria) Code, the chief electrical inspector may serve a notice or other document on the applicant by posting or delivering it to the place last known to the chief electrical inspector as the place of residence or place of business of the applicant.

17. Registered or approved labels of other states, etc.

(1) In this Regulation "corresponding law" means a law of the Commonwealth or of another State or Territory of the Commonwealth that relates to the energy labelling of refrigerative air conditioners.

(2) A label attached to a refrigerative air conditioner and stating the energy efficiency rating and energy consumption rate of the refrigerative air conditioner is to be treated as an approved label under these Regulations if it is approved or registered in respect of that refrigerative air conditioner by a regulatory authority under the provisions of a corresponding law.

18. Placements of label

(1) Subject to sub-regulation (2), the prescribed manner for labelling a refrigerative air conditioner in respect of energy efficiency rating and energy consumption rate is by affixing the approved label approved for that refrigerative air conditioner—

(a) on the front of the refrigerative air conditioner and any display front for the refrigerative air conditioner; or

(b) in a position that is approved in writing by the chief electrical inspector.

(2) A person must not attach or affix an approved label to a refrigerative air conditioner where the approved label is obscured in any way.

19. Offences

(1) A person must not affix, attach, place or reposition an approved label otherwise than in the manner prescribed in Regulation 18.

Penalty: 5 penalty units.

(2) A person must not affix to a refrigerative air conditioner a label stating an energy efficiency rating and energy consumption rate which has not been approved in respect of that refrigerative air conditioner.

Penalty: For the first offence—2·5 penalty units. For any subsequent offence—5 penalty units.

(3) A person must not—

(a) forge or fraudulently alter any application made under these Regulations; or

(b) make a statement which is false or misleading with respect to—

(i) an application for an approved label; or

(ii) a test report from any testing facility; or

(c) remove, forge or fraudulently alter any approved label before final sale or hire to a customer; or

(d) cause an approved label to be obscured from view by an means.

Penalty: 5 penalty units.

(4) A person must not affix or attach any tag or label to a refrigerative air conditioner offered for sale or hire (other than the approved label of that refrigerative air conditioner) if the tag or label contains any statement which misleads or which is likely to mislead, a potential buyer or hirer with respect to the energy consumption rate, the energy efficiency rating or other information contained in the approved label for that refrigerative air conditioner.

Penalty: 2 penalty units.

(5) A person must not display on or near any refrigerative air conditioner exposed for sale or hire on which an approved label has been affixed any sign or notice which—

(a) conflict with any information or statement contained on the approved label; or

(b) is likely to mislead the purchaser or potential purchaser or hirer or potential hirer with respect to the information or statement on the approved label.

Penalty: 2 penalty units.

NOTES

1. General Information The making of the State Electricity Commission (Energy Efficiency Labelling) (Refrigerative Air Conditioners) Regulations 1988, S.R. No. 310/1988 was approved by the Governor in Council on 23 August 1988 and the Regulations were made by the State Electricity Commission of Victoria under sections 57 and 111 of the State Electricity Commission Act 1958, No. 6377/1958 on 23 August 1988. The Regulations came into operation on 30 August 1988: reg. 2.

The State Electricity Commission (Energy Efficiency Labelling) (Refrigerative Air Conditioners) Regulations 1988 will sunset 10 years after the day of making on 23 August 1998 (see section 5 of the Subordinate Legislation Act 1994).
