Submission for Plan Change

March 2015

This submission is being made on behalf of Gavin Terry, in regards to Plan Change 15A-H to the

Palmerston North City District Plan.

Plan Change 15A-H is part of the Sectional District Plan Review in which the Palmerton North City

Council is currently undertaking. This submission is only concerned with Section A- Rural Zone and

Rural Subdivision of Plan Change is.

The specific provisions of Plan Change lSA in which this submission specifically relates, is a site

located along Flygers Line. This site is legally known as Lot 1 DP 32009 BLK VI Kairanga SD. This site

can be located on Planning Map 12 of Plan Change 15, and has a total area of 6.4724 hectares.

Under Plan Change lSA this area of land will remain as rural zoned land, with the north-eastern

corner of the site being subject to air noise contours. The land on the opposite side of Flygers Line

and to the west of the site is also zoned rural land. The land which lies at the rear of the site behind

the stream, and to the east of the site is zoned residential.

Our submission is to have the land described above rezoned from Rural to Residential under

Palmerston North City District Plan- Plan Change lSA. If this is not possible due to it being outside

the scope of the plan change, we wish to have this land re-classed as part of the Rural-Residential

overlay under Plan Change 15A.

If Council is still of the opinion that the above is not considered appropriate, then we ask Council to

keep the subject land zoned as Rural, but ask that rural blocks less than 20 hectares, as at the date

that Pian Change is is made operative, are able to be further subdivided as a Discretionary Activity

provided that they are abie to meet the following provisions:

• All access standards

• Air noise contours

• Fiooding mitigation

• Cannot be Class 1 soils

• Are able to comply with the One Plan

• SOOOm' of 11 degree land

• Must be close to (within 3km) of residentially zoned land

• Is not subject to any future urban growth strategies

We believe that the rezoning of this site from Rural to Residential or similar, would allow for the site

to continue to fit with the surrounding environment as there is already a mix of rural and residential

properties.

We believe the soils present on the subject site are classed as 2-3 soils. These are not optimal soils

for rural activity to take place on and therefore could be used to serve more residential purpose,

Council may wish to consider the surrounding land between the subject site and Rangitikei Line,

when also considering our submission. Our client is however not making any submission with

respect to the adjacent land.

I submit the following,

That the uniqueness of the Shannon & Co property adjacent to the Manawatu Gorge andRiver and its place within Te Apiti, 'the park', warrants special consideration, a zone of itsown, at least part of an overlay that recognises the aspirations and work to date achieved bythe stakeholders and communities.

That PNCC planners engage directly with Shannon and Co and with other key stakeholders (Horizons, DoC, NZTA, Rangitane, Kiwi rail and T.D.C ) to incorporate the vision of Te Apitiand the development potentials it holds, into PNCC planning rules and regs and beyond.

The Shannon & Co property is about 100 Ha, divided in three by SHW 3 and 57, and 2km+ boundaries with Doc and Horizons.Approximately 20ha is protected regenerating native, 20 ha in woodlots and shelter planting.the remaining open space is in permanent pasture, being farmed ecologically.It is not a viable economic enterprise pastorally, too small, too divided.

I have believed its value lay long term in its recreational and amenity values. Its connectionwith Te Apiti, Ashhurst and beyond.

That included in time, a park 'HQ', { a regional hub, showcasing the natural heritage-­conservation and sustainable land management, good ecological design,along with the cultural heritage,--the stories and the art.. j

Tourism development and safe 'people' management in a high use area, requires goodunderstandings and agreements with all effected parties. Good working relationships anchorthe process and take much time and successes to become effective.

These are at the core of the Vision,

Linking the town with the country, to Ashhurst and into Te Apitiremembering - 'we are the river, and the river is us',

'the Park'.

Creating significant economic opportunities for the district and region ( a high point to visitand enjoy. A destination, a facility, a place of incredible learning, something to be proudof..

To date fellow stakeholders have invested heavily in the area, supporting the vision andrespecting the values and have achieved considerable results, too many to mention for themoment!

The collaborative approach, demanded by the project, ( See, Vision, Mission and ValuesStatement), now requires, I believe, 'a cuppa , round the table' tocapture the gains and the opportunities ahead.

'Co creating' a special place ttlat can accommodate the diverse stakeholder interests.and reporting directly with and to Council(s).

'Te Apiti' is 'place making' in action !!

There has been dialogue with city planners and policy analysts over a long period regardinguse and development of the Filzherbert EasU Ashhurst node, within the cily. They are familiarwilh the Biodiversity Project, and have provisioned for engagement in the Biodiversity andRecreation Strategy documents.

Developments with NZTA around the Manawatu river Bridge at Ashhurst have progressedstrongly and now require more detailed discussions and planning. Some special 'zone' wouldgo a long way to facilitating good safe bureaucratic outcomes.

1. While there are many good features in the proposed amendments to the present District Plan, there iscertainly some opportunity to improve the outcomes by a few small alterations. This is an opportunitythat should not be missed - these changes would have been very useful if they had been in place atleast ten years ago (before the Mighty River and perhaps the Motorimu aaplications). The wind farmseparation distance (R 7.16.1.2(g)), (page 155), proposed at 1.5km will probably meet most people'sneeds, but I am mindful that for some Ashhurst residents in the 2007-2010 period the Te Apiti turbinescaused difficulties over a greater distance.

2. I do expect that there will be conflict between the Rural Zone Objective 7 and Objectives 8 and 9when commercial interests are at stake (pages 191·193)

3. I see two aspects of R9.8.6 (page 222) needing attention. Both are at the end of performanceStandard (Ii) which states "., ..consent form signed by the owner of occupier." The typo should now beclear. But I believe that an occupier must have some real involvement in the property to be entitled tosign a consent agreement instead of the owner. Perhaps the consent agreement should be requiredfrom the owner, and from an occupier where that person has a contractual right of Lise for at least(say) 24 months from the date of the application for consent,

The area which gives me most difficulty is in respect to R9.9.3 (page 227) unless an addition is madeto create a Rule R9.1 0.3 (Which would be placed on page 228), The conflict can arise becausesomeone will overlook Performance Standard (i) which states "The Wind Farm site must not be insidethe Tararua Ranges Landscape Protection Area (Map 9.1)" in order to treat an application as a Non­Complying activity. Rule R9, 10.3 would simply re-state the performance standard as a prohibitedactivity.

5. Map 9.1 (page 230) has a yellow line to show the Tararua Ranges Landscape Protection Area. Theline is very thin and will not protect anything. More probably the Protection Area is implied to bebetween the yellow line and the City boundary to the east of the yellow line. But nothing I have seenon page 230 or any other page in the 534 pages of Proposed Plan Change 15 A-H Appendix 1actually defines this.

In general, the proposals for change in Section 7 are to be commended. It has long been a goal (that I sharewith many other people) to protect the productive capacity of the City's versatile soils. I am pleased to find inSections 7.2, and 7.3 issues recognised, and Objectives and Policies which show considerableunderstanding of the matters related thereto.There is one matter where I think a replacement wording would eliminate any opportunity formisunderstanding by any party in future.

I seek two decisions from the Council in respect to PPC 15A. These are that (a) the issues, Objectives and Policies for

the Rural Zone and Rural Subdivision are not pared back from the proposed position, and (b) the wording of Policy

2.8.5 be changed to that suggested below. The proposed wording is "In rural areas, propelties will !Je supplied wi/h

water and fire safety requirements met from rainwater tanks, !Jores, wells or specially constructed storage tanks". I

see a significant risk of some people grasping 'propelties will !Je supplied with water' and not understanding what

the entire policy sentence is stating.

A better wording would be in the nature of "In rural areas, property owners andlor occupiers must make their own

provision for water collection and storage for household, horticultural, stock and fire safety requirements by the use

of rainwater tanks, bores, wells or specially constructed storage tanks".

15A In principle I agree with the "The minimum lot area for rural subdivision is increased from 4 ha to 20 ha"

However this should be amended so that properties of <20 ha that already have more than one dwelling

should remain under the existing 1ha ruling.

I understand that the change is being suggested to

- Maintain the rural environment

- Reduce any further traffic and other pressures on the existing infrastructure which has recently

become over-loaded

- Reduce conflict between farming and residential landowners.

If an existing property of <20 hectares has more than one dwelling in place this is already part of the existing

environment, already has its impact on the infrastructure and neighbor relations.

People, such as myself, who purchased such properties may need/want to subdivide and sell the second

property and will be unfairly disadvantaged by the new rule.

I understand that a subdivision could still be granted but this is by no means guaranteed, will take

significantly longer and cost significantly more to obtain because it will be outside compliance.

15B I am opposed to permitted activity standards for dwellings in relation to a separation distance (1.5km)

from a wind turbine as no commercial wind turbine should be closer than 3km to a dwelling.

There are enough places for wind turbines to be situated without being that close to properties.

Cost alone cannot be used to justify putting the rural environment and potentially peoples' health at risk.

There is insufficient long term data on windfarms and their health effects to situate them so close to housing.

A recent systemic review (Schmidt, 2014) concluded

"Exposure to wind turbines does seem to increase the risk of annoyance and seif-reported sleep disturbance In a dose-response

relationship. There appears, though, to be a tolerable level of around L-Aeq of 35 dB." And "Wind turbines emit noise, including

low-frequency noise, which decreases incrementally with Increases in distance from the wind turbines"

We oppose the inclusion of the runway end protection area over our site at 142 Midhurst Street.

If council was to place the restriction on the use of our land this would seriously devalue our land and also hinder any

future sale.

Our land is already subdivided in two titles and this gives us the option of building a lifestyle home in the back corner

(previously discussed with your planning department) in the future. We wish to have this fact confirmed please.

However, the new restrictions read that in the event of fire or earthquake, losing the existing house, cattery and

kennels buildings on the smaller tit ie, we would not be able to re·build. If this plan change was to happen the land

becomes valueless. This plan change is taking away our rights as rate payers and property owners to use our land,

which also impedes on us financially.. ..4. I seek the following decision from the Palmerston North City Council:

3.1 Role of the Transport Agency

3.3.1 The Transport Agency's objective, functions, powers and

responsibilities are derived from the Land Transport Management

Act 2003 ("LTMA"), and the Government Roading Powers Act 1989

("GRPA"). The Transport Agency's functions include "to contribute

to an effective, efficient, and safe land transport system in the

pubiic interest'" and the "management of the state highway

system, including planning, funding, design, supervision,

construction, and maintenance and operations, in accordance with

this Act and the Government Roading Powers Act 1989",.

3.3.2 The Transport Agency is a Crown entitYl, with the sale powers of

control and management for all purposes of all state highways,.

The Transport Agency is also an investor In Palmerston North City's

transport network, investing in roading maintenance and

operations, and renewals, improvements, walking and cycling and

public transport services. As an investor, we therefore have a

significant interest in seeing that land use planning for the City is

integrated with the transport system. We also have an interest in

present and future land use decision--making to ensure that the

public receive value for money transport outcomes horn our

investment.

3.3.3 The Transport Agency is a requiring authority and a network utility

operator in terms of the Resource Management Act 1991 s. The

network we operate within Palrnerston North City includes the

following transport corridors, classified under the One Network

Road Classification as: National: State Highway 57, Regional: State

Hiqhway 3 & State Hiqhway 56: and Arterial: State HIqhway 54. In

managing these networks the Transport Agency must promote the

safe, efficient and effective functioning of the land transport

system and ensure the system is not adversely affected in a

significant manner.

3.3.4 The Government Policy Statement (GP5) on Land Transport Funding

issued by the Minister of Transport sets out the Government's

objectives and funding priorities for the land transport sector for a

six-year period, with further indicative information for the

following four years. The Transport Agency must qlve effect to

the GPS when performinq its functions in respect of land transport

plannlnq and funding,.. The GP5 confirms that economic growth

and productivity remain the primary objective for land transport

expenditure, and extends this to include value for money and road

safety as additional priorities. In addition to investing in the State

hiqhway network, the GPS identifies that quality investment in

public transport and Improving the local road network both have

roles to play. All of these areas of focus are directly relevant to

Palmerston North's transport network and the relationship between

land use planning, network management, and transport

investment. The CPS also sets strong expectations regarding the

role of integrated planninq in transport investment.

coordination of statutory resource management and transport

the Resource Management Act (1gg1), Local Government Act

that a policy framework aligns land use and transport planning

within Palmerston North City.

We operate a plant nursery at 126 Turitea Rd. The property was purchased and re-developedfrom an existing nursery in May 2000. The original owner had subdivided a 4 ha. Ruralproperly in July 1998 into 7 separate allotments. We purchased Lot 3 DP 86488 with theintention of establishing a plant nursery mostly using open ground production practices.We do not currently live on site as there is a consent prohibiting a residential dwelling on thisproperty. (Sec Attachments I & 2)

By 2004 the nursery was well established with new production enterprises. At this time itwas determined that we could run a successful nursery employing up to 4 part-time staff andfunding the salary of myself as a working manager/owner. This is achieved by utilizing justover I ha of the land from the 2.35 ha. of the total land area. In view of the circumstances ofbeing able to create a viable business with approximately $200,000 turnover from I ha. ofland we approached the Council with a proposal to build on the un-used land. This wasdeclined by lettcr datcd 5 Jul. 2004 from the PNCC Principle Plan ncr stating that a consentnotice RM 1343 prohibits building of a residential dwelling on this Lot.

We still have the desire to build a residence on this land and feel our best hope is a change inthe District Plan to allow such activity by including our property in the Rural ResidentialOverlay. We agree that the Rural Residcntial Overlay needs to be made more compact butfeel it include the properties on the Westside of Turitea Rd from the Old West Rd.intersection to the Harts' Rd. Intersection. Currently these properties are considered to beRural and outside the Rural Residential Overlay. To my knowledge we are the only propertyin this area mentioned that is making a commercial 'Living" from agricultural pursuits andwe arc doing that using 50% of the land area. While other neighbors have a range of stock ontheir properties they could only be considered as "hobby" fanners where they have 4 ha. ofland.

It is our long term goal to divide our property into two I ha.+ properties and to build aresidence for ourselves so we can live on site and create another residence for a nurscrymanager.

In a broader view we support the entire Rural corridor up to Greens Rd. converting to RuralResidential as we arc close to the City, Summerhill Shopping Centre services, bus routesfrom Summerhill Dr. and there has already been considerable Rural Residential developmentalong both sides of Turitea Rd. and in the Ngahcre Park developments.

We believe that with the exception of intensive horticulture that the minimum size forconsideration as a "Rural Producer" should be increased paI1ieularly concerning pastoralproducers. However we cannot support or oppose the Development principles of the RuralProducer without further clarification.

Attachment 2: Background Information and Explanation

NZDF wishes to make sure that the noise standards included in District Plans areup-to-date, appropriate for the type of noise generated and relatively simple tounderstand and assess compliance with. To this end, NZDF has commissionedprofessional acoustic advice on appropriate standards to control noise effects fromTemporary Military Training Activities. This report can be provided on request.Based on this advice, NZDF has developed revised noise control standards that itwill seek to have included In proposed district plans nation-wide.

The replacement noise standards proposed by NZDF focus on compliance atdwellings, residentially zoned sites, and buildings used for residential, educational orhealthcare purposes.

In summalY, the NZDF's proposed standards divide noise sources from TemporaryMilitary Training Activities into four categories: weapons firing and explosions; othermobile sources such as vehicles and earthmoving equipment; fixed noise sourcessuch as power generators and water pumping, and helicopter landing areas. Eachof these noise sources has different noise characteristics, and therefore a differentset of standards for controlling noise. NZDF considers that this division allows amore comprehensive and appropriate method for controlling noise from TemporaryMilitary Training Activities.

For weapons firing and explosives, the noise control standard used is separationdistances between the activity and any sensitive receiver (dwelling, residentiallyzoned site, or building used for residential, educational or healthcare purposes).Four separation distances are specified - a nighttime and daytime distance for firingof live ammunition and explosives, and a nighttime and daytime distance for firing ofblank ammunition, which is less noisy than live firing. The distances have beenarrived at after review and analysis of data measured from real military activities, toensure that the sound levels received at the specified distances will be reasonable(generally less than 55 dBA for daytime and less than 45 dBA for nighttime). Usingseparation distance as a standard has the advantage of being an easy to complywith and easy to monitor standard.

For mobile noise sources (other than weapons firing and explosives), compliancewith the construction noise standards is recommended, as this standard mostappropriately addresses this type of noise.

For fixed noise sources, which can be located to ensure compliance with standards,dB LAeq levels are specified, in line with NZS6802:2008 Acoustics - EnvironmentalNoise. This is considered the most appropriate way to control noise levels fromthese sources.

NZDF has also considered noise from helicopters associated with temporary militarytraining activities. NZDF proposes the use of NZS6807: 1994 Noise Management andLand Use Planning for Helicopter Landing Areas to control this type of noise.

I oppose the proposal to apply the increase in rural subdivision from 4ha to 20ha to the Boundary change Area from North Street Ashhurst to

Davis Road (formerly within the Manawatu District) and propose that this small area be allocated Rural Residential status.

This section of properties is a small rural residential neighborhood of lifestyle blocks. It is in effect already physically a Rural Residential area,

Further subdivision of e)(isting lifestyle blocks to smaller rural properties would not reduce any rural economic viability as these are already hobby

properties. The two largest properties in thIs enclave are in fact in Ashhurst on North Street. I believe this neighborhood is perfectly suited to the

type of rural residential living currently e)(perienced in the Aokautere / Polson Hill / Moonshine Valley Road area.

I also believe that a category of rural residential for this spot would enhance the e)(it from Ashhurst at North Street. It is a pretty group of

properties and would make a lovely segue to the countryside beyond. I think it would soften the e)(it from Ashhurst, from North street to Davis

Road. At the moment the e)(it from Ashhurst starting at North St starts abruptly with vehicles rocket boosting to dangerous speeds through this

populous lifestyle area as if it was compulsory to reach 150K by the first gate. The small stretch from North to Davis seems to be an unofficial

drag strip which is most unfortunate given the nature of the properties in this patch.

North St to Davis Road could be a very special area of small lifestyle properties creating a sought after area to live and a tranquil pretty buffer

between town and country. It is the very beginning of Pohangina Road, which leads ultimately to the Pohangina Valley.

It would be a shame to brutalise this area into squares of suburban sprawl (as per a residential expansion of the town) as it would most certainly

destroy the 'Constable like' sweetness of this spot - But it would equally be an uncomfortable fit to place a productive agricultural zoning to this

locality which is already far from it.

I do believe that Ashhurst is a special little place In a spectacular location and there is an opportunity to create something truly special around it's

'edges' not just the relentless encroachment of suburbia or an unofficial boomfa line for personal speed trials, but instead a tasteful and sensitive

integration of town and country.
