Summary:

On November 11, 2015, the Vietnam Ministry of Agriculture and Rural Development (MARD) issued

Decision 4758/QĐ-BNN-TY to promulgate the List of Harmonized Schedule Codes for the animal and

animal products subject to animal quarantine requirements during customs clearance and importation.

Decision 4758 in Vietnamese is available on the Official Gazette website:

Decision 4758 further specifies the general List of Animal and Animal Products subject to Quarantine

regulated in MARD’s Decision 45/2005/QĐ-BNN dated July 25, 2005 with a specific list of HS Codes

specifying individual products. The List of Animals and Animal Products subject to Quarantine is

specified in detail in Section II of MARD’s Decision 45/2005 and as below:

I. Animals

1. Animals: Cattle, donkeys, horses, mules, goats, sheep, pigs, rabbits, dogs, cats and other domestic

livestock species;

2. Poultry: chickens, ducks, geese, turkeys, ostriches, pigeons, quails, ornamental birds and other birds

3. Animals for experiments: hamster, mice, rabbits and other laboratory animals

4. Wild animals: elephants, tigers, leopards, bears, deer, gibbons, orangutans, monkeys, pangolins,

lorises, squirrels, raccoons, lizards, geckos, pythons, snakes, jungle fowl, pheasants, pheasant, public

and other wild animals;

5. Other animals: bees, silkworms, other insects.

II. Animal products

1. Meat, offal, by-products and products derived from meat, offal, animal byproducts specified in

Section I of this List in the form of fresh, smoked, dried, salted, frozen, canned;

2. Sausage, pate, salami, ham, lard and other pre-processed, or processed animal products;

3. Fresh milk, yogurt, butter, cheese, canned milk, milky cakes and products from milk;

4. Fresh eggs, salted eggs, egg powder and egg products;

5. Breeding poultry eggs, silkworm eggs, animal embryos and semen;

6. Meat meal, bone meal, blood meal, feather meal and other animal products used as raw materials;

animal/poultry/ and aquatic feed products containing ingredients derived from animals;

7. Fish meal, fish oil, fish fat, shrimp powder, oyster powder and other aquatic products used as raw

materials for processing feed for animals and poultry;

8. Medicine derived from animals: snake venom, bee venom, pangolin scales, bile, digestive enzymes

and other kinds of animal original medicines;

9. Animal skin under the form: fresh, dried, salted;

10. Coat, stuffed animals of animals: tigers, leopards, civets, rabbits, otters and other animals.

11. Cilia: hair of horse/cattle tale, pig hair, wool and feathers of other animals;

12. Feathers: chicken feathers, duck/goose feather, peacock feathers and feathers of other birds

13. Teeth, horns and claws, tusks, bones of animals;

14. Canary bird;

15. Honey, royal jelly, beeswax;

16. Worm cocoons, pre-processed silk, silk waste;

17. Pathological materials;

18. Other objects subject to animals/animal products quarantine as required by the importing country or

the provisions of the international treaties that Vietnam has signed or acceded;

Quarantine is exempted for imported tanned skin products under the HS Codes: 4104; 4105; 4106; 4107;

4112.00.00; 4113; and 4115, despite their initial listing in Decision 4758. As a result of a request from

the Vietnam hide and skin industry, on December 3, 2015, the Department of Animal Health (DAH)

issued Official Letter 2403/KD-TY requesting Vietnam Customs to instruct Customs Offices at entry

ports to not ask importers to register for import quarantine for products under the above mentioned HS

codes. As indicated in Letter 2403, DAH requested DAH’s Regional Offices to only conduct quarantine

procedure for exported tanned skin products if there is requirement from importing countries.

Responding to DAH’s Letter 2403, on December 9, 2015, Vietnam Customs sent Letter 1569/GSQL-

GQ1 to instruct provincial and city Customs Offices to not require quarantine procedures to be applied

for imported tanned leather products outlined in DAH’s Letter 2403.

Consolidated Legal Document 12/VBHN-BNNPTNT implementing the Veterinary Ordinance

The quarantine process for terrestrial animals and animal products for export and import to Vietnam is

currently regulated in the Consolidated Legal Document 12/VBHN-BNNPTNT which was developed by

merging different legislative documents regulating the implementation of the Veterinary Ordinance.

Article 30 of the Document 12/VNHN-BNNPTNT regulates the registration for quarantine of terrestrial

animals / animal products. Accordingly, the owners of shipments of terrestrial animals/animals products

on the List of animals/animals products subject to quarantine for export, import, temporary import for

re-export, temporary export for re-import, gate transferring, transited in Vietnamese territory must

submit an application for quarantine to the competent Animal Health Agency. Within five (5) working

days from the date of receiving a valid application, the Competent Animal Health Agency will notify

and provide the owner of animal shipment with guidance on the requirements for animal quarantine and

assign a relevant animal health agency to coordinate the quarantine (note: the notification issued by

Competent Animal Health Agency to the shipment owner is similar to an import permit). After getting

the Notification, the owners of animal shipment has the responsibility to make a declaration to the

Competent Animal Agency before the arrival of the shipment as follows: a) for imported shipment: at

least eight (8) days before the shipment arrival to the entry port and two (2) days before the shipment

arrival by postal mail; b) for a shipment temporarily imported for re-export; temporarily exported for re-

import; or transited in Vietnam territory, the declaration should be made at least four (4) days before the

shipment arrival.

The quarantine inspection of imported terrestrial animals and animal products is regulated in Article 35

of Document 12/VBHN-BNNPTNT. In the case of animals or animal products imported via sea or air,

the quarantine shall be conducted at Float 0 or parking areas of the airport. If the dossier for quarantine

is valid and the animals / animal products do not show signs of carrying disease pathogen, the quarantine

officer shall verify and allow the shipment owner to do customs clearance or transport animals to

quarantine areas. If the quarantine dossier is not valid, the animal health inspection agency shall notify

the competent agency of exporting country for them to inspect, revise, or complete the dossier for

quarantine. In case, the imported animals / animal products are infected with animal diseases they must

be compulsorily slaughtered, destroyed, or re-exported directly to the exporting country. Depending on

the animal species and animal diseases, the quarantine period should not exceed 45 days for live animals

and the time to isolate animal products for quarantine should not be more than 10 days. After the

isolation period for quarantine, imported animals / animal products meeting veterinary hygiene

requirements shall be issued a Certification of Quarantine and can complete customs clearance.

The application for import quarantine is guided in detail by DAH’s Guidance 615/TY-KD dated April

20, 2009. Accordingly, the application dossier for imports of terrestrial animal includes: 1) a

Registration Form as regulated), 2) Business license (or notarized copy), 3) other related documentation

as regulated. The application dossier applying for imports of animal products for human consumption

(such as meat, egg, milk, products derived from meat, eggs and milk includes: 1) a Registration Form as

regulated, 2) Business license (or notarized copy), 3) a HACCP Certificate for food processors with

clear signature of the company’s leader and the signing date (note: for milk products imported from the

United States, DAH accepts the Sanitary Certificate issued by USDA’s Agricultural Marketing Service

(AMS), instead of a HACCP Certificate), and 4) other related documents. The dossier registering the

import of other animal products includes: 1) a Registration Form as regulated, 2) Business license (or

notarized copy), and 3) other related documents. DAH’s Guidance 615/TY-KD in Vietnamese is

The most updated Vietnamese regulation on quarantine of animals and animal products is the Vietnam

Veterinary Law (VM5068) that will enter into force July 1, 2016. The requirements for quarantine of

imported terrestrial animals and animal products are specified in Article 44 of the Law. The application

registering for quarantine of animals/animal products, the quarantine (inspection) procedure, and the

contents of the quarantine of terrestrial animals and animal products are detailed in Article 45, 46, and

47, respectively.

To implement the new Veterinary Law, MARD is drafting a Circular on the quarantine of terrestrial

animals / animal products and inspection of veterinary hygiene that was notified to the WTO SPS

Committee as SPS/VNM/68 on April 24, 2015. The final Circular has not been published.

Pursuant to Veterinary Ordinance No. 18/2004/PL-UBTVQH passed by the Standing Committee of the

National Assembly on April 29, 2004;

Pursuant to Decree No. 199/2013/ND-CP dated November 26, 2013 of the Government stipulating the

functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural

Development;

Pursuant to Decree No. 33/2005/ND-CP dated March 15, 2005 of the Government making detailed

provision for the implementation of some articles of the Veterinary Ordinance; Decree No.

119/2008/ND-CP dated November 28, 2008 of the Government amending and adding to a number of

articles of Decree No. 33/2005/ND-CP;

Pursuant to Decree No. 08/2015/ND-CP dated January 21, 2015 of the Government stipulating detailed

provisions and measures to implement the Customs Law regarding customs procedures, inspection,

supervision and customs control;

Pursuant to Decision No 45/2005/QD-BNN dated July 25, 2005 of the Minister of Agriculture and Rural

Development on promulgating the list of objects of animal quarantine, animal products; The list of

animals and animal products subject to quarantine;

Pursuant to Circular No. 156/2011/TT-BTC of November 14, 2011 by the Minister of Finance on the

promulgation of the List of Vietnamese export and Import goods;

At the request of Director of the Department of Animal Health,

DECIDES

Article 1. To issue together with this Decision the HS code Table of the List of terrestrial animals and

animal products subject to quarantine.

Article 2. This Decision takes effect as from November 18, 2015.

Article 3. The Director of the Office, The Director of Department of Animal Health and the relevant

organizations and individuals shall be responsible for implementing this Decision. /.
