Political Candidates…. receiving Cincinnati Build-PAC financial support in the May 6th Ohio primary election include Christine Matacic, Butler Co. Commissioner; Rick Bryan, 28th Ohio House; Wes Retherford, 51st Ohio House; Margy Conditt, 52nd Ohio House; Shannon Jones, 7th Ohio Senate. Details: Dan Dressman, [email protected].

Property Tax Abatement… for 12 years (increased from 10 years) was approved by the Cincinnati City Council on March 26th for all new and remodeled homes that are certified visitable. To meet this requirement a home must include a minimum of one no-step exterior entrance, main floors with a minimum of 32 inch hallway clearance and a wheelchair-friendly half-bath on first floor. The abatement applies to a maximum of up to $275,000 on the value of a new home or improvements, minus the lot price. Details: Dept. of Community Development, 513-352-6146.

OHBA Supports Residential Contractor Licensure… at the state level with the following conditions: 1) legislation overrides any local licensing; 2) includes a builder-majority board of overseers and 3) includes exemption from the Consumer Sales Practices Act (CSPA).The OHBA board of trustees approved the position at their April meeting. The HBAGC board of directors passed a policy last year opposed to any form of state residential contractor licensure. Details: Vince Squillace, 800-282-3403, [email protected].

Residential Code of Ohio… interpretations were recently issued addressing Chapter 11 and Duct Tightness Testing as well as Low-Frequency Audible Alarm Notification Appliances. Introducing Felicia Frodge… the HBA’s new Administration/Special Projects Coordinator. She will be performing a variety of accounting and membership support functions as well as assisting with many of the networking events. She can be reached at [email protected] or 513-589-3204.

Passing: Neil Murphy, one of the founding members of Murphy Homes and brother of Ray Murphy, 1957 HBA president, died on March 14 at the age of 95. Memorials can be made in his name to the Heartland Hospice Care, 3960 Red Bank Rd., Cincinnati 45224.

Congratulations to… HBA President Dan May, wife Maya and daughter Piper on the birth of Avery Ryone May on April 7th.

Willows Bend… in Clermont Co. (Loveland School District) was approved by the HBA Board of Directors as the 2015 site of HOMEARAMA®. Be Prepared if OSHA Comes CallingThere have been signs that OSHA is increasing its enforcement actions on home building sites throughout the country. The current OSHA administration has been clear for some time now that stepped-up enforcement is a top priority and it appears as if OSHA will remain as aggressive as ever under the new Secretary of Labor, Thomas Perez. Even though Ohio administers its own agency it still must adhere to the OSHA standards.

There are a few simple things that your members should do to be prepared for OSHA inspections:

• Conduct an assessment to identify and correct safety hazards on the jobsite;• Conduct appropriate safety training for employees; • Update records and make sure they are readily available;• Understand the OSHA inspection process (see links below).

Builders and trade contractors should pay particular attention to the following hazards, which are the top 10 most frequently cited OSHA standards in 2013 (with the reference to the specific OSHA standard in parentheses):

1. Fall protection, construction (29 CFR 1926.501) 2. Hazard communication standard, general industry (29 CFR 1910.1200) 3. Scaffolding, general requirements, construction (29 CFR 1926.451) 4. Respiratory protection, general industry (29 CFR 1910.134) 5. Control of hazardous energy (lockout/tagout), general industry (29 CFR 1910.147) 6. Powered industrial trucks, general industry (29 CFR 1910.178) 7. Electrical, wiring methods, components and equipment, general industry (29 CFR 1910.305) 8. Ladders, construction (29 CFR 1926.1053) 9. Machines, general requirements, general industry (29 CFR 1910.212) 10. Electrical systems design, general requirements, general industry (29 CFR 1910.303)

nWhat Home Buyers Really Want: Ethnic Preferences Among other demographic variables, such as age, income, or stage of life, a buyer’s race or ethnicity can play a significant role in how he/she evaluates the characteristics and features of a prospective home. A new study recently released by NAHB, What Home Buyers Really Want: Ethnic Preferences, was designed to compare and contrast how housing preferences are affected– or not –by the racial/ethnic background of the home buyer, after controlling for factors such as age and income. The analysis focused on four racial/ethnic groups of buyers:

• White (Non-Hispanic),• African-American (non-Hispanic),• Hispanic, and• Asian.

Survey results corroborate well-known demographic differences between these groups:

• Minority home buyers are younger than White (non-Hispanic) buyers: the median African-American buyer is 39 years old, the median Hispanic buyer is 37, and the median Asian buyer is 36. The median White buyer is 43 years old.

• Asian home buyers have the highest median household income of all four groups, $72,797, compared with $67,747 for Whites, $50,221 for Hispanics, and $43,774 for African-Americans. Asians also expect to pay the most for their next home: $283,469, compared with $205,775 among Whites, $181,444 among Hispanics, and $176,397 among African-Americans.

So what are some of the differences/similarities among these groups in terms of housing preferences? After controlling for age, income, and household type, survey findings show that Hispanics and African-Americans want more bedrooms. In fact, 51 percent of Hispanics and 49 percent of African-Americans report wanting to have at least 4 bedrooms in their home, compared to 44 percent among Asians and 36 percent among White buyers.

A majority of buyers in all four racial/ethnic groups, however, will be satisfied with up to 2½ baths: 73 percent of Asians, 65 percent of both White and Hispanic buyers, and 61 percent of African-Americans. Similarly, most buyers in all four groups prefer high ceilings (9 feet or more) in the first floor of their home: 75 percent of Asians, 68 percent of African-Americans, 67 percent of Hispanics, and 64 percent of White buyers.

Placing the washer and dryer in the first floor of the home is a good bet, as buyers of all backgrounds strongly prefer this location for the laundry equipment: 76 percent of Whites, 51 percent of African-Americans, 50 percent of Hispanics, and 46 percent of Asians. The basement and garage are the second and third choice for about 20 percent of both Hispanics and Asians, significantly more than the share of White buyers who want to do laundry in either of these locations.

The 2-car garage is the most popular parking facility across all groups, preferred by more than 50 percent of White, African-American, and Asian buyers as well as 47 percent of Hispanic buyers. A garage for 3 cars or more has far fewer fans, especially among minorities.

EPA Plans to Increase Reach of Clean Water ActThe Environmental Protection Agency’s (EPA) proposal to expand the reach of the Clean Water Act will increase the cost of new homes without a corresponding benefit to America’s lakes, rivers and other water bodies.

While NAHB has long asked for the rulemaking, EPA’s proposal goes too far. “EPA was told to make changes to the rule so that everyone understands exactly when a builder needs a federal wetlands permit before turning the first shovel of dirt,” said Kevin Kelly, NAHB president and a home builder and developer from Wilmington, Delaware.

Expanding federal authority under the Clean Water Act would greatly increase the number of construction sites required to obtain appropriate permits, which will also result in the delay or impede construction projects. Moreover, additional permits will burden the current exorbitant backlog of permits ranging between 15,000 to 20,000. Enacted in 1987, the Clean Water Act continues to be a source of confusion for both regulators

and those subject to regulation – and just what land should fall under federal, as opposed to state or local, permitting authority. It was originally designed to provide federal protection to navigable waters and those used for interstate commerce, but

the limits of that protection were never clear.

The new definition doesn’t just affect home builders. Farmers and ranchers could also feel an impact on their business practices. Even home owners could need wetlands permits before doing landscaping projects if regulators determined that their land included a “tributary”

and is thus subject to federal oversight.

“It’s clear to us that this new proposal is not at all what Congress intended when it told EPA to clarify its jurisdictional reach,” Kelly said. “The agency needs to go back to work on this. We need to protect the environment with a carefully crafted rule, not this hurried, catch-all attempt. Adding this layer of regulation makes the land development process more expensive

“Instead, EPA has added just about everything into its jurisdiction by expanding the definition of a ‘tributary’ – even ditches and manmade canals, or any other feature that a regulator determines to have a bed, bank and high-water mark. It’s a waste of taxpayer resources to treat a rainwater ditch with the same scrutiny as we would the Delaware Bay,” Kelly said.

OVDC UpdateLegalThere are currently two bills in the Ohio Legislature that are opposed by the Ohio HBA that OVDC is keeping track of: a bill to eliminate Type 2 Annexations (HB277) and a bill that proposes to regulate condominium associations (HB371). The second bill would require condo associations to register with the state and pay a fee. Board members who violate this statute would be criminally liable. OVDC will continue to communicate with Ohio HBA and track these two bills.

Metropolitan Sewer District (MSD)OVDC and MSD recently came to agreement regarding revisions to inspection fees. The current process of charging an hourly rate for mainline sanitary sewer inspection will replaced by a set fee approach based on lineal foot of pipe and structures. This change makes it possible for developers to calculate these fees much more precisely on the front end of projects to eliminate the uncertainty in their budgets for inspections. Also, OVDC and MSD came to agreement on revisions to the

detention requirements for projects tributary to the combined sewer system. These changes will bring new sites into better compliance with Ohio EPA water quality rules & also enable detention to be waived on smaller, urban redevelopment sites.

Soil & Water ConservationHamilton and Clermont Counties will co-host a field day in October; once information is available it will be sent to HBA members. This is a great opportunity for builders, developers, engineers and contractors to meet the Hamilton and Clermont County staff, see demonstrations of various BMPs, learn about rules new products and meet vendors.

BondingThe new Hamilton County Engineer rules & regulations were updated to remove sidewalk bonding from the developer’s bond. This is a key improvement in the bond process for developers. In Butler County, one bond will be allowed to cover multiple subdivisions.

Public admission: The show will be open to the public daily from Saturday, September 13th through Sunday, September 21st. The show hours are 4:00 – 9:00 PM Monday – Thursday and 12:00 Noon – 9:00 PM on Friday, Saturday and Sunday.

Special Features: Poster Contest – Local artists will compete in a contest to design a CiTiRAMA® poster. The poster will be displayed in College Hill businesses and in the CiTiRAMA® homes. Parking: Parking is free and will be located on site.

Concessions/Restrooms: Concessions and Restrooms will be available on site. Admission: Nine Dollars ($9.00) for adults; children 12 and under will be admitted free of charge if accompanied by an adult. Discount tickets will be available at Kroger for Seven Dollars ($7.00). AAA members can purchase tickets at the gate for Seven Dollars ($7.00) by showing their AAA membership cards.

Cincinnati Named Third Most Affordable Place to LiveCincinnati was ranked as the third most affordable region in the country, according to a study published In the March 11th online issue of Forbes Magazine. A total of 100 of the largest MSAs in the country, with populations of 600,000 or more were considered.

The study factored in housing affordability using the NAHB’s affordability index, Sperling’s Best Places cost of living index and the Dept. of Labor’s Consumer Price Index (CPI).

Overall, Cincinnati’s affordability index of 83.8 percent and cost of living index of 96.5 percent means that both were below the national average of 100 percent. The median new home price was in the $200,000 - $249,000 range over the last year. The national median home price was $205,000 during that same time frame, according to the National Association of Home Builders.

With four cities including Cincinnati-#3, Dayton-#4, Akron-#6, Toledo-#11 and Columbus-#20, Ohio had more cities in the top 20 list than any other state.

Other regions in the top 20 include Buffalo-#1, Memphis-#2, Knoxville-#5, Grand Rapids-#7, Louisville-#8, Oklahoma City-#9, Warren, MI-#10, Detroit-#11 (tied with Toledo), Birmingham-#12,

St. Louis-#13, Virginia Beach-#14, Jacksonville-#15, Pittsburgh-#16, Tulsa-#17, Tampa-#18, Syracuse-#19.
