ORDER

Sub : Calculation of the requirement of additional security on

the basis of average consumption of electricity for the

preceding twelve months.

In accordance with the Clause-16(d) “Annual Review of

Security Amount” of TCS-04, the Nigam reviews at the beginning of each

financial year, the requirement of security amount from the consumer to

cover the average consumption of electricity for the preceding twelve

months. As per practice in vogue, the average consumption is taken for the

preceding period of billing months of April to March (i.e. consumption

months of March to April ) of every year.

Some of the consumers have represented against above

methodology. They have protested that the period of calculating the

average consumption of preceding 12 months should be considered as

consumption months of April to March of every year i.e. billing months of

May to April.

The matter was put up in 97th meeting of the Coordination

Committee held on 28-09-06. The Coordination Committee decided that

position be clarified for the information of field officers. Accordingly,

following procedure be adopted for calculating the additional amount of

security deposit :

The period for arriving at the amount of additional security

deposit be taken as consumption months of April to March i.e.

billing months of May to April of preceding twelve months, instead

of present practice of considering consumption months of March to

February i.e. billing months of April to March.

ORDER

Sub : Limitation prescribed by Law in raising Debits as a

consequence to meter found defective on testing-Debiting

the assessment within 2 years.

With regard to limitation of law applicable in the matter of

amount due from any consumer relating to Electricity Charges etc. Section

56(2) of the Electricity Act-03 is applicable. The same is reproduced

hereunder :-

Sec.56(2):

“Notwithstanding anything contained in any other law for the

time being in force, no sum, due from any consumer under this section,

shall be recoverable after a period of two years from the date when such

sum became first due unless such sum has been shown continuously as

recoverable, as arrear of charges for electricity supplied and the licensee

shall not cut off the supply of the electricity”.

On the basis of the provisions of the Electricity Act, similar

provision exists in the Electricity Supply Code notified by the R.E.R.C.

and also in the “Terms and Conditions for Supply of Electricity-04”. The

clause 39 of the Electricity Supply Code and the clause-49 of the TCS-04

is relevant on the subject matter. Clause 49 of TCS-04 is also reproduced

hereunder :-

Clause-49 of TCS-04 :

“No sum due from any consumers on account of charges for

electricity or any sum other than a charge for electricity shall be

recoverable after a period of two years from the date when such sum

became first due unless such sum has been shown continuously as arrears

and the Nigam shall not cut off supply of electricity ”.

On perusal of the aforesaid provisions, it is clear that no sum

due from any consumer is recoverable after a period of two years from the

date when such sum become first due unless such sum has been shown

continuously as arrear of charges for Electricity Supply and the licensee

shall not cur off the supply of the electricity. It is, therefore, necessary to

know that if a period of two years has passed from the date any amount of

electricity charges becomes first due from any consumer and in case the

demand has not been raised within the prescribed two years period, the

same cannot be recovered.

If this provision is applied in cases where the metering

equipment of the consumer is checked by the meter wing officers and in

case the meter is found to be stopped or meter is declared as defective on

the basis of test report, in such cases, the assessment under clause-27 of the

TCS-04 or under clause 28 of the TCS-04 is required to be made. If the

assessing officer fails to assess the amount and debit the same in the bill of

the consumer and if a period of two years has passed from the date of

checking then the amount cannot be recovered in terms of Section-56(2) of

the Electricity Act-2003 as the same becomes time barred and there is no

provision in the Act for condoning the delay occurred in raising the

demand.

The State Regulatory Commission had also decided cases

involving delay in debiting assessment amount to Ajmer Discom in the

petition No.RERC/90/06 and 91/06 in the matter of M/S Sisodia Marble

and Granites Pvt. Ltd. & M/S Sem Polymer Pvt. Ltd., Udaipur. Based on

the directions/orders of RERC as laid down while deciding aforesaid

petitions the sum becomes due from the date when the meter is found

defective or metering errors are detected as per test report whichever is

later, and the same is required to be debited within limitation period of two

years failing which the assessment would become time barred in terms of

Sec.56(2) of Electricity Act and hence not recoverable from consumer.

This matter was submitted for consideration of the

Coordination Committee in its 97th meeting held on 28

th Sept., 06. The

Coordination Committee noted the position brought out in the agenda note

and also noted that circular be issued by Discoms to sensitise the field

officers to take care of limitation bar in raising debits of assessment.

From the position submitted above, it is clear that if the

demand for electricity charges is raised after expiry of two years from the

date of testing, the same is not recoverable because of limitation prescribed

under the Electricity Act-2003 and therefore utmost care is necessarily

required in keeping watch over such demands to avoid these becoming

barred by limitation of law as prescribed by Electricity Act, and causing

further implications.

It is, therefore, enjoined upon all field officers to strictly

follow the instruction enumerated herein above.

ORDER

Sub : Replacement of burnt/damaged Push Fit Energy

Meters.

Jodhpur Discom is installing Push Fit Static Energy Meters

through armoured cable/service lines to prevent unauthorized extraction of

energy by the miscreant consumers under Feeder Renovation Programme.

It has been reported that some of the consumers are approaching for

replacement of burnt/damaged push fit static meters at the cost of Nigam

being under guarantee period.

The matter was discussed in 97th Coordination Committee

Meeting held on dtd.28-09-2006 and it was decided that the burnt/damaged

Push Fit Static Meters of the consumers may be replaced at the cost of

Discom provided that these meters are covered under Guarantee Period

and no complaint/report regarding tempering or any vigilance report has

been lodged/pending against the consumer.

It is enjoined upon all the concerned to follow above direction

strictly.

ORDER

Sub : Replacement of burnt/damaged Service Lines.

At present the Jodhpur Discom is replacing the old

damaged/defective service lines of consumers through armoured cable to

prevent unauthorized extraction of energy as part of Feeder Renovation

Programme. It has been reported that some of the consumers are

approaching replacement of burnt/damaged service lines at the cost of

Nigam as these overhead service lines are to be maintained by Nigam.

The matter was discussed in 97th Coordination Committee

Meeting held on dated 28-09-2006 and it was decided that burnt /damaged

service lines of the consumer may be replaced at the cost of Discom

provided that recommendation of field officer is obtained in this regard and

such replacement is a part of F.R.P.

It is enjoined upon all the concerned to follow above direction

strictly.

ORDER

Sub :Laying of separate feeder for industrial and non-

domestic connections situated in rural areas for

connecting them from continuous supply feeders.

Any Industrial or Non-domestic consumers situated in the

rural areas, if wants to have direct feeder from Urban area supply for

continuous supply, the same can be allowed if the consumer deposits full

cost of the estimate of the 11 KV Line to be drawn in this regard. This

facility is prescribed for HT Supply consumers situated in the rural areas.

In such cases, the transformer is either provided by the consumer or the

same is installed by the Nigam and the rent of transformer is recovered as

per provisions of TCS-2004.

Presently, the Nigam is receiving distribution transformers

(upto 100 KVA) with welded meter boxes on the transformers for fixing

the meters. On consumer’s request these metered transformer can be

installed by the Nigam for releasing pending connections of consumers

requiring Urban supply by recovering transformer rent. As these meter

boxes are installed on the LT Side, the metering of such consumers can be

done on LT Side and 3% transformation losses shall be added for the

purposes of billing.

The above instructions shall come in force with immediate

effect.

This bears the approval of Hon’ble CMD, Jodhpur Discom.

Consumers disconnected up to or before 31-03-06 and running consumers, it has been

decided to allow following concessional package to Agriculture Consumers of Bikaner

amount as on 31-03-2006 shall be waived off.

The principal amount of outstanding dues as on

31-03-2006 shall be recovered alongwith

interest @ 6% per annum interest from 01-04-

2006 to date of payment.

For running connections

Component of DPS to the extent of 75% in the

outstanding amount as on 31-03-2006 shall be

waived off. The payment of principal dues as

on 31-03-2006 plus balance 25% DPS plus

principal amount of outstanding dues

accumulated alongwith DPS on full principal

amount for the period 01-04-2006 to date of

payment could be made in installments as

under :

(a) First installment would be 50% of the

amount calculated as above and is payable upto

20th

Dec., 2006.

(b) Balance amount is payable in Billing

Months of Jan., 2007 and Feb., 2007. This

balance amount shall attract interest @ 10% per

annum w.e.f. 01-04-2006.

For disconnected connections:

Component of DPS to the extent of 75%

/interest on outstanding dues on 31-03-2006 be

waived off. The payment could be made as

under :

a) First installment payable before 20th

Dec.,

2006 shall be 50% of dues as on 31-03-2006

plus interest @ 6% per annum on such dues

from 01-04-06 to date of payment.

b) Balance dues along with interest @ 10%

w.e.f. 01-04-2006 till date of payment in two

equal monthly installments payable in billing

months of Jan., 2007 and Feb., 2007.

Terms & Conditions :

(i) The scheme shall be made available for a period from 05th

Dec., 2006 to 20th

Dec., 2006.

(ii) Concerned Assistant Engineer is empowered for allowing rebate in

DPS/interest for Agriculture category of consumers

(iii) The scheme shall be applicable irrespective of whether the disconnected

consumer wants reconnection or not in light of Agriculture Policy.

(iv) To avail these concessions, the consumer shall voluntarily undertake to

withdraw all the Court Cases, if any, pending in any Court of Law/Consumer

Forum any other competent agency etc. related to the outstanding dues.

(v) If the consumer fails to deposit the amount as per agreed time schedule under

this concession package, this facility shall be withdrawn.

(vi) This concession package will not be applicable for the amount of assessment

made against theft of electricity &/or malpractice.

(vii) This scheme shall not be applicable for consumers who have availed benefits

under the earlier Amnesty Schemes announced during the years 2004-05 or

2005-06.

(viii) For availing the concession package, the consumer shall be required to apply

to the concerned Assistant Engineer in the format enclosed at Annexure-“A”.

(ix) The outstanding dues should be worked out without taking into consideration

the adjustment of existing security deposit. However, adjustment of security

deposit may be made for disconnected consumers in the dues so worked out

as on date of disconnection and from such consumers revised security deposit

shall be obtained as per rules before reconnection, if any, in light of

Agriculture Policy.

Sub : Unguarded electric lines passing over educational

institutions.

Some of the electric lines passing over schools are without

guarding due to which accidents can be occurred. In this context, it is

advised that after identification of such unguarded locations it must be

ensured that no electric line passing over the educational institution(s)

building remains unguarded. After completion of the job, the concerned

sub-divisional officers shall furnish a certificate that there is not a single

case where the overhead line is passing over educational institution and is

still unguarded. Such reports shall be compiled at circle level and circle

Superintending Engineer is expected to apprise the position to the Hon’ble
