Executive Director for the Berks County Bar Association and Law Foundation of Berks County

The Berks County Bar Association (BCBA) and the Law Foundation of Berks County in Reading, PA, are accepting applications for the position of Executive Director.

As the Executive Director for both entities, the person acts as the Chief Operating Officer of the BCBA, an organization of approximately 650 attorneys with a board of directors, as well as for the Law Foundation of Berks County, a non-profit orga nization governed by a separate board of trustees.

The Executive Director is a full-time, FLSA-exempt em-ployee. He or she oversees the financial and operational ac-tivities of the BCBA and Law Foundation, including manage-ment of the headquarters building and administration of education, commu nity outreach, fundraising efforts, grant-making, as well as social and professional activities.

The position requires excellent communication skills, fi-nancial management exper tise, advanced technological skills, and the ability to work effectively with people to represent the BCBA and Law Foundation. The position regularly re-quires work in excess of 40 hours per week, and travel.

Candidate must have at least 10 years’ professional experi-ence, preferably in the non-profit or legal sector, with strong organizational skills, fundraising experience, familiarity with the legal profession and ability to effectively manage staff. Lead ership skills and the ability to build and maintain rela-tionships within a diverse community are essential. A 4-year college degree is required, with a graduate level degree, es-pecially a Juris Doctor, strongly preferred. Suppression—Miranda Warnings— Custodial Interrogation—Probable Cause.

The Court found that the defendant was not subjected to a custodial interrogation when providing certain statements to her arresting police officer, and therefore, Miranda warnings were not required. As a result, the Court denied the defendant’s Motion to Sup-press. The Court also found that the defendant’s arresting officer had the requisite prob-able cause to arrest her for DUI.

anthony, J., June 17, 2016. The defendant is charged with two counts of driving under the influence (DUI) and related of-fenses, stemming from a single vehicle accident that occurred on December 25, 2014. The defendant filed a motion for writ of ha-beas corpus and a motion to suppress. A hearing was held on February 9, 2016, following which I found the Commonwealth presented a prima facie case. I took the motion to suppress under advisement, and the parties submitted briefs. This opinion follows.

FINDINGS OF FACT

On December 25, 2014, at approximately 10:00 A.M., Trooper Curt Schillinger of the Pennsylvania State Police received a call of a single vehicle “hit and run” accident in the area of Golden Key Road and Lyon Valley Road, Lehigh County, Penn-sylvania. Schillinger was advised the vehicle hit a utility pole and drove off. A witness provided this information, as well as a descrip-tion of the vehicle.1 Schillinger arrived at the location of the util-ity pole and observed damage to the pole. Approximately one-half

mile from the pole, Schillinger found a disabled vehicle on the side of the road. The vehicle matched the description given by the wit-ness. When Schillinger pulled up, a female, later identified as the defendant, Carissa Kleinsmith, was standing outside the vehicle. The defendant approached Schillinger and told him her father was on the way. Schillinger approached the defendant’s vehicle and observed damage to the driver’s side fender and flat tire. Schillinger asked the defendant what happened with the pole, and the defen-dant stated she spilled her coffee, causing her to go off the road.

Trooper Schillinger asked the defendant for her license, registration, and insurance, which the defendant provided. With-in the first few minutes of speaking with the defendant, Schillinger smelled an odor of alcohol. Schillinger also observed that the de-fendant had glassy, bloodshot eyes. Schillinger asked the defendant if she had been drinking, and the defendant said she had several glasses of wine the night before, but stopped drinking around 2:00 A.M. Schillinger had the defendant perform field sobriety tests and the defendant exhibited indicators of intoxication on each test. Thereafter, the defendant was arrested for suspected DUI. The defendant subsequently refused to consent to a blood test.

DISCUSSION

The defendant alleges that all evidence should be suppressed because she was interrogated while in custody without having re-ceived her Miranda warnings. I find this allegation without merit.

The Pennsylvania Supreme Court recognizes three categories of police-citizen interactions: a mere encounter, an investigative detention, and a custodial detention. Commonwealth v. Boswell, 554 Pa. 275, 721 A.2d 336 (1998) (citing Terry v. Ohio, 392 U.S. 1, 88 S. Ct. 1868, 20 L. Ed. 2d 889 (1968)).

The first of these is a ‘mere encounter’ (or request for information) which need not be supported by any level of suspicion, but carries no official compulsion to stop or to respond. ... The second, an ‘investigative detention’ must be supported by a reasonable suspicion; it subjects a suspect to a stop and a period of detention, but does not involve such

coercive conditions as to constitute the functional equivalent of an arrest. ... Finally, an arrest or ‘custodial detention’ must be supported by probable cause.

Commonwealth v. Ellis, 541 Pa. 285, 293-94, 662 A.2d 1043, 1047 (1995).

It is well settled that Miranda warnings are required where an individual is subjected to custodial interrogation. Common-wealth v. Williams, 941 A.2d 14 (Pa. Super. 2008). “[T]he test for custodial interrogation does not depend upon the subjective intent of the law enforcement officer interrogator.” Commonwealth v. Gibson, 553 Pa. 648, 662, 720 A.2d 473, 480 (1998). Instead, the inquiry is “whether the suspect is physically deprived of his freedom in any significant way or is placed in a situation in which he reason-ably believes that his freedom of action or movement is restricted by such interrogation ... . ” Commonwealth v. Brown, 473 Pa. 562, 570, 375 A.2d 1260, 1264 (1977) (quoting Commonwealth v. O’Shea, 456 Pa. 288, 292, 318 A.2d 713, 715 (1974)). Custodial interrogation includes any words or actions on the part of the police, other than those normally attendant to arrest and custody, that are reasonably likely to elicit an incriminating response from the indi-vidual being questioned. Commonwealth v. Gaul, 590 Pa. 175, 912 A.2d 252 (2006).

It is important to note, however, that while a ‘seizure’ of a suspect by police triggers Fourth Amendment protec-tions, it does not trigger Miranda rights under the Fifth Amendment. ‘Seizures’ and ‘custody’ are analytically distinct concepts in the modern criminal constitutional law lexicon. The mere fact that an individual is subjected to a stop and a period of detention during which the individual is subject to the control of the police and not free to leave (a seizure) does not render such detention ‘custodial’ so as to require Mi-randa warnings. ‘While a suspect may certainly walk away from a mere encounter with a police officer, every traffic stop and every Terry stop involves a stop and period of time dur-ing which the suspect is not free to go but is subject to the control of the police officer detaining him.’

Commonwealth v. Haupt, 389 Pa. Superior Ct. 614, 625, 567 A.2d 1074, 1080 (1989) (quoting Commonwealth v. Ellis, 379 Pa. Su-perior Ct. 337, 354, 549 A.2d 1323, 1331 (1988) (emphasis added)).

Moreover, “motorists have certain statutory obligations to provide officers with information at an accident scene” and, there-fore are not in custody for Miranda purposes during the time their freedom is restricted because they are obligated to remain and provide the required information about an accident. Common-wealth v. Williams, 941 A.2d 14, 31 (Pa. Super. 2008) (citing 75 Pa. C.S.A. §§3743 and 3744).

Here, when Trooper Schillinger approached the defendant to investigate an accident, the defendant was not in custody, nor could she have any reasonable belief she was in custody. She was not transported; no restraints were used; and Schillinger made no show, threat, or use of force. See id. (listing factors to consider in determining whether a detention is custodial or investigative). She was asked a minimal number of questions at the scene of an ac-cident on a public street. Those questions cannot be characterized as “custodial interrogation.” Commonwealth v. Gonzalez, 519 Pa. 116, 546 A.2d 26 (1988). Under the totality of the circumstances, the defendant was not “in custody” for purposes of Miranda, and thus warnings were not required.

Additionally, I find Trooper Schillinger had the requisite probable cause to arrest the defendant for DUI. “Probable cause exists where the facts and circumstances within the officers’ knowl-edge are sufficient to warrant a person of reasonable caution in the belief that an offense has been or is being committed.” Common-wealth v. Luv, 557 Pa. 570, 575, 735 A.2d 87, 90 (1999) (quoting Commonwealth v. Gibson, 536 Pa. 123, 638 A.2d 203, 206 (1994)). Probable cause determinations are based on the totality of the circumstances. Id.

Under the totality of the circumstances, Trooper Schillinger possessed the requisite probable cause to arrest the defendant for DUI as he had knowledge of sufficient facts to warrant a belief that the defendant had been driving under the influence of alcohol or a controlled substance. Circumstantial evidence—the information received from the witness, as well as Schillinger’s observations of the pole and the defendant’s vehicle—established the defendant was driving.2 Additionally, when Schillinger spoke to defendant, he detected classic signs of intoxication, including the odor of al-cohol as well as glassy, bloodshot eyes, and then, when asked to

perform field sobriety tests, the defendant exhibited signs of im-pairment.

Based on all of the above, the defendant’s allegations are without merit and her motion to suppress must be denied.

AND NOW, this 17th day of June 2016, upon consideration of the defendant’s Motion to Suppress Evidence, filed May 19, 2016, IT IS HEREBY ORDERED that said motion is DENIED.

The Lawyer Referral office receives phone calls from clients requesting services from attorneys. At this time, the office will obtain all needed information from the client and contact the attorney to schedule. They are entitled to a half-hour consultation with the attorney for a $25 fee. An information sheet will be faxed to each attorney, which needs to be completed at the end of each consultation.

The referral form must be faxed back to the LRS office upon completion of the consultation. Client fees are pre-paid to the LRS office. Fees are determined by the attorney for any services requested after the consultation.

Please notify the LRS office if you are unavailable to accept referrals due to vacations, etc. This will ensure no clients are referred to your office while you are away. Please note that screening of clients is not permitted – no telephone consultations prior to the client coming in unless specified on the referral form. All attorneys must contact the client within 3-5 business days upon receipt of referral.

I further agree that I will not charge nor solicit any fees other than the $25.00 referral fee for the first conference, of one-half hour in duration, with the referral client. This presentation focuses on the buying and selling of municipal real estate from the perspectives of both private and municipal purchasers and municipal sellers. Municipal officials, real estate professionals and attorneys should benefit from this presentation.

Although the focus of the presentation will be on the obligations of municipalities under the First and Second Class Township Codes and the Borough Code, other more generally applicable statutes to be addressed will include the “No Bid” Law, the Eminent Domain Code and the Donated and Dedicated Property Act, as well as relevant case law.

Attorney Dinkelacker’s practice is concentrated in the areas of land use, real estate, environmental, insurance and personal injury/disability law. Notable cases over his career include representation of the Hotel Bethlehem in complex litigation following a devastating fire in the late 1980’s, representation of Smith Barney in one of the first death cases alleged to have been caused by distracted driving due to cell phone use and complex litigation against Monsanto Corporation relating to executive compensation packages. More recent matters involve the representation of individuals, citizen groups and municipalities in land use, zoning and environmental matters. Tom also represents municipal governing bodies, boards, commissions and authorities in the day-to-day handling of municipal matters.

Tom has drafted or participated in drafting numerous municipal ordinances and regulations relating to zoning, land development, historic districts, apartment licensing, storm water, sewer and water matters. He regularly represents municipal and private clients before zoning hearing boards, code appeal boards, governing bodies and various courts of the Commonwealth. In addition, he has served as a special solicitor to various municipal entities throughout the Lehigh Valley.
