Providing Leadership in the Construction Industry Since 1952 AB 219 Prevailing Wages for ReadyMix Drivers Ruled Unconstitutional: Associated General Contractors (AGC) tweeted the following last week: “The judge presiding over Allied Concrete, et al. versus Brown, et al. ruled Labor Code section 1720.9 unconstitutional Monday and granted a motion for summary judgment. AB 219 passed in 2015, expanding coverage of California's Prevailing Wage Law to include hauling and delivery of ready‐mix concrete to public works projects. The companies initially ϐiled suit to prevent enforcement of the labor code, citing the law's inclusion of only those drivers and not all materials drivers unfairly subjects companies to AB 219's requirements. It is recommended that contractors continue to comply with the enacted requirements of AB 219 until otherwise advised. …” Federal “Blacklisting” Rule to be blocked by Congress and President Trump. Associated Builders and Contractors (ABC) is tweeting that President Obama’s Executive Order, “Fair Pay and Workplaces” will be permanently stopped from taking effect. Commonly referred to as the Blacklisting rule, it allowed Federal agencies to use subjective criteria to blacklist a contractor from being awarded a job. In October, implementation was temporarily blocked by a US District Court for a number of reasons, including that the regulations… “…appear to conϐlict directly with every one of the labor laws they purport to invoke by permitting disqualiϐication based solely upon ‘administrative merits determinations’ that are nothing more than allegations of fault asserted by agency employees and do not constitute ϐinal agency ϐindings of any violation at all.” Among the thousands of bills authorizing new legislation are a few good ones. AB 996 Contractors Licensing Board Web site: search function for workers compensation claims. This bill is sponsored by the Sacramento Regional Builders Exchange and CalBX. It was initiated by a VCE member’s frustrating experience of having their license automatically suspended for lack of workers comp renewal, even though the notice of renewal was received by CSLB 30 days early. Temporary Traffic Control and Flagging CSO 1598: Where a hazard exists to employees because of traffic or haulage conditions at work sites that encroach upon public streets or highways, a system of traffic controls are required so as to abate the hazard. 

CSO 1599: A flagger or flaggers shall be utilized at locations on a construction site where barricades and warning signs cannot control the moving traffic. Flaggers shall be trained in the proper fundamentals of flagging moving traffic before being assigned as flaggers. 

The Traffic Control & Flagging program incorporates the California Manual on Uniform Traffic Control Devices 2012 and covers: 

Warning sign placement,  

Proper fundamentals of flagging moving traffic, and  

Signaling directions used by flaggers.  

Upon completion of this course, trainees will receive a card stating that they have satisfactorily completed training on the CA MUTCD and meet the requirements of CSO 1599. 

Who should attend:  All employees who are responsible for flagging & temporary traffic control as an aspect of their job function, per Cal OSHA’s Title 8 Construction Safety Orders Section 1598 and 1599(f).

CPR & FIRST AID CERTIFICATION  

Cal/OSHA requires that all employers have trained persons to render First Aid and CPR on every job site. 

 

Title 8, Ch4, Subch4 (CSO), Section1512(b)‐ Emergency Medical Services Appropriately Trained Person: Each employer shall ensure the availability of a suitable number of appropriately trained persons to render first aid. Where more than one employer is involved in a single construction project on a given construction site, the employers may form a pool of appropriately trained persons. However, such pool shall be large enough to service the combined work forces of such employers.  

CPR/First Aid Certificates must be renewed every 2 years per American Red Cross regulations.

CSLB has updated its license applications. Effective May 1, 2017, CSLB will only accept versions of the applications listed below with a revision date of October 2016 (“rev. 10/16” in bottom left corner) or later.

Older versions of the applications listed below submitted to CSLB after May 1, 2017, will be returned to the applicant, along with any fees included. The applicant will need to complete and resubmit a new application and all applicable fees.

Copies of these new applications, which are electronically fillable, are available on the CSLB website (www.cslb.ca.gov). Paper copies are available at CSLB Headquarters in Sacramento and at all field offices throughout the state.

Disposable Respirators   Filtering facepiece respirators are disposable and come in various styles and designs to protect you from non‐hazardous contaminants in the workplace. The filtering material in the disposable respirator can be made of cloth or paper that cleans the air as you breathe it to prevent you from inhaling irrita ng substances. Some filtering facepiece respirators (dust masks) are used to control nuisance contaminants such as dust, non hazardous fibers, animal dander, and pollen. Other filtering facepiece respirators can have added features for use with infec ous diseases, organic vapors, chemical fumes, and nuisance odors.   While disposable respirators are convenient, you should be aware of their use guidelines and limita ons in order to wear them safely. Your disposable respirator should be cer fied by the Na onal Ins tute for Occupa onal Safety and Health (NIOSH). Follow all of the manufacturer's instruc ons for respirator use and make sure you are medically fit to wear a disposable respirator before you use it.   Your disposable respirator should be designed for the work you will be doing and the materials you use. Choose the correct respirator by consul ng the NIOSH cer fica on on the package, or talking with your supervisor. Because disposable respirators are not  ght‐fi ng, they should not be worn in hazardous atmospheres. If you will be using your disposable respirator in a hazardous environment to protect against infec ous diseases or other chemical exposure, contact your supervisor or safety personnel to determine the addi onal procedures required for this use.   To wear a disposable respirator, hold it in your hands with the nosepiece up and place it over your nose and mouth. Pull the top strap over your head and posi on it above your ears. Pull the bo om strap over your head and posi on it at the back of your neck. If the respirator has a nose clamp, use both hands to pinch it evenly over your nose. Adjust the straps so that they fit comfortably and hold the respirator securely to your face.   It is important to check that your disposable respirator fits properly each  me you wear it. To fit test a disposable respirator, cup both of your hands over the mask and inhale. The mask should pull in toward your face. If the mask does not pull in, or if you feel air leaks around the edges of the mask, readjust the nose piece and straps and try again un l you get a good fit.   Keep track of your disposable respirator and do not share it with other workers. Inspect it before and a er each use. Replace the respirator if it develops holes, the straps break or loosen, or it becomes dirty and overly contaminated. Be sure to store your respirator in an area that is free of dirt and contaminants. If the disposable respirator gets splashed with chemicals or other liquid materials while you are working, exit the work area and remove it immediately. If it becomes difficult to breathe through the disposable respirator, exit the work area, throw it away, and replace it with a new respirator. Properly adjust and fit test the new disposable respirator before you re‐enter the work zone.

By Kenneth S. Grossbart, Abdulaziz, Grossbart & Rudman  Let us start off with once again reminding everyone how important a wri en construc on contract is, regardless of the amount of the contract, or who the contract is with. The wri en contract is the best tool in order to prove what was agreed upon, especially if a dispute does arise.   On construc on projects, whether they are public or private works, the owner (or public en ty) contracts with a contractor. This direct contractor may then contract with other contractors (known as subcontractors) to do por ons of the work on the project.   The direct contractor can enter into a Subcontract Agreement with the subcontractor for the project. In some instances the direct contractor will contract with the same subcontractor on many jobs. In this case a Master Subcontract may be used as an agreement between the direct contractor and subcontract in order to avoid renego a ng all of the terms and condi ons. A Master Subcontract does not have specifics about each individual job but the specifics for each job are then agreed upon in a Work Authoriza on.   The Subcontract Agreement or Work Authoriza on will cover all of the per nent informa on for said project to include, but not limited to: 

The par es to the contract and their addresses;  The owner or public en ty;  The jobsite address and descrip on;  The contract price;  The scope of work to be performed;  The  me and scheduling of work; and  The  me for payment.

GENERAL STATEMENT OF DUTIES: Under the general supervision of the Department Director, plans, organizes, manages, and coordinates the Building Division activities, which includes building permit processing, plan checking, building permit plan review, building inspection, and building code compliance; recommends and implements City policy concerning building safety matters; provides highly responsible and technical assistance in areas of assignment; and performs other related duties as assigned.

CLASS CHARACTERISTICS: This classification is distinguished by its responsibilities for the day-to-day operations of the Building Division. Additionally, this classification functions as the Building Official for the City, performing highly technical and professional assistance in Building matters related to the protection of the health and safety of citizens by ensuring building, construction and remodeling activities meet appropriate codes, standards and City ordinances. The incumbent is expected to have a high degree of technical expertise in areas of responsibility and to exercise considerable independence, judgment and discretion in the application and enforcement of building codes and ordinances within the City; and is expected to exercise initiative in ensuring building codes used by the City meet current legal and professional guidelines. Direct supervision is exercised over assigned staff.

EXAMPLES OF ESSENTIAL DUTIES:

• Plans, organizes, manages, and coordinates the daily operations of the Building Division, including issuance of building permits, plan checking, scheduling and overseeing inspections, and assessing and resolving complex permit, code and procedural questions and problems.

• Functions as the Building Official for the City, reviewing and enforcing laws, ordinances and codes; monitors and implements changes in the California Administrative Code requirements and construction techniques.

• Establishes standards by which plans are reviewed, in accordance with applicable building codes; recommends and implements programs, procedures, and practices for providing effective and efficient plan examination and building inspection services; reviews plans submitted for building permits; determines when plans are to be sent out to be reviewed by the City’s contract plans examiner(s); determines and calculates permit values and costs; issues and processes building permits.

• Develops, coordinates, and participates in the preparation and maintenance of building records, including digitizing building permit records, maintaining database inventories, ensuring the quality control of the building permit filing system, and purging files and building permits in accordance with established policy.

• Inspects construction in various stages of completion to insure compliance with plans and codes; researches suitable alternate methods, designs, and materials, which meet the requirements of the Building Code, as necessary; prepares letters informing owners of code violations.

• Coordinates Land Use and Building enforcement activities, including inspection of substandard housing and commercial building complaints; enforces all appropriate building and safety codes and ordinances, including issuing “Stop Work Orders”, “Notice of Nuisance”, and “Unsafe to Occupy” notices; prepares warning letters to negligent owners or contractors, and carries negligent cases through prosecution channels in situations of non-compliance; testifies in court as required.

• Confers with legal, police, fire and other necessary authorities regarding building, fire, life safety and other code interpretations and applications, including performing inspections of substandard buildings, gaining right-of-entry into unsafe, dangerous or hazardous structures for the purpose of inspection and enforcement, and obtaining inspection warrants if right-of entry is refused.

• Assigns, directs, and reviews the work of assigned personnel, including providing training, feedback, and direction, motivating employees, and conducting performance evaluations and disciplinary actions.

• Assists with the preparation of and manages the division budget. • Acts as Staff to assigned Committees and Commissions; serves as liaison between assigned Committees/Commissions and

City, including attending meetings, and preparing and presenting reports and recommendations.

• Provides technical and specialized support to various City departments regarding building related issues, including City building projects, permitting assistance, code interpretation, and review of business license applications for code compliance; monitors changes in regulations within assigned activities, and identifies and recommends necessary City ordinance / policy revisions to ensure ongoing compliance.

• Confers with and represents the City in meetings with architects, engineers, contractors, property owners and various groups and associations regarding difficult design and construction issues; resolves complex problems within the the required codes, regulations and standards; responds to and resolves difficult and sensitive citizen inquiries and complaints.

• Gathers, interprets and prepares data for studies, reports, and recommendations; issues various reports to County Assessor, State of California and other agencies as required.

• Performs other related duties as assigned.

REQUIREMENTS: Knowledge of: Federal, state and local codes, regulations, ordinances, policies and procedures related to plan review, building permitting, inspection and enforcement functions, including the California Building, Plumbing, Mechanical, Electrical, Residential, Green Building Standards, Energy and Historical Building Codes; Federal and State Health and Safety Codes; principles, practices and materials related to building construction, electrical, plumbing, and solar, heating and ventilation installations; the principles and practices of budget development and administration; the principles and practices of employee supervision, including training, evaluating, and discipline; modern office methods, practices, procedures, and equipment including computer hardware and software necessary for work functions, such as word processing, spreadsheet, and database applications; techniques for dealing effectively with those contacted in the course of work, both in person and on the telephone. Ability to: Plan, organize, manage and coordinate the activities of the Building Division; provide expert professional and technical assistance in all Building matters related to the protection of the health and safety of citizens; interpret, apply, and explain federal, state and local codes, regulations, ordinances, policies and procedures in areas of assignment; understand and interpret plans and specifications; develop, coordinate and participate in preparation and maintenance of building records; participate in the administration and direction of a comprehensive building inspection program, including enforcement activities; assist in

preparation and administration of assigned budget; provide direct supervision to assigned staff; operate computer systems and applications in relation to work functions; communicate clearly and concisely, both orally and in writing; establish and maintain cooperative working relationships with those contacted in the course of work.

OTHER REQUIREMENTS: • Possess a valid California Driver's License.

• Possess, or obtain within twelve (12) months of date of hire, a Building Official certification issued by CABO (Council of American Building Officials) or ICC (International Code Council).

• Possess ICC Building Inspector certification and ICC Electrical Inspector certification.

• Possess ICC or IAPMO (International Association of Plumbing and Mechanical Officials) Plumbing Inspector certification and ICC or IAPMO Mechanical Inspector certification.

• Must be able to be called out at any time of day or night to determine safety of structures following emergency and natural disasters.

• Must be willing to attend meetings after normal work hours as necessary.

• Must be willing to work extended hours as necessary to complete assigned projects.

• Must be willing to travel for trainings and/or meetings.

PHYSICAL REQUIREMENTS: Work is generally performed in both a general office and field environment. Must be able to perform the physical aspects of the job, including sitting for periods of time, operating standard office equipment, including a computer; inspecting building and occupancy sites, including traversing rough/uneven terrain; operating a motor vehicle; hearing and speech to communicate in person and over the telephone; lift, push, pull, and carry up to 25 lbs; climb into crawl spaces; balance on high and narrow places, climb ladders and scaffolding up to 40 feet in height; working outside in varying weather conditions, with exposure to dust and pollen.

EXPERIENCE AND TRAINING: Any combination of training and experience that would provide the required knowledge, skills, and abilities is qualifying. A typical way to obtain the required qualifications would be: College coursework in structural, mechanical, civil engineering, architecture, or related field; and at least four (4) years progressively responsible experience as a Plans Examiner or Building Inspector working under the direction of a Building Official, or related experience, and some supervisory experience. BENEFITS:

Retirement NEW PERS MEMBERS or PREVIOUS PERS MEMBERS WITH A BREAK IN SERVICE OF 6 CALENDAR MONTHS OR GREATER (2% @ 62) – The current 7.75% employee contribution is paid by the employee. For the 2% @ 62 formula the employee contribution may change each fiscal year to be at least 50% of the normal cost rate as determined by PERS. PERS CLASSIC MEMBERS (2% at 55) - The current 8.5% employee contribution is paid by the employee. FOR VACANCIES FILLED BY A CURRENT CITY OF ARCATA EMPLOYEE WHO IS ALREADY A PERS MEMBER, THE EMPLOYEE WILL REMAIN AT THEIR CURRENT PERS FORMULA.

Medical The City currently pays the majority of the premium for employee and family for medical, dental, and vision. The current monthly employee contribution for employee + 2 or more is $295.82 for medical (Anthem Blue Cross); The employee contribution is fully paid by the City for dental (Delta); and vision (VSP) coverage. Contributions are lower for employee only and employee +1. City offers $300/mo. health insurance opt out option. Note: There are specific requirements for continuing these medical coverages as a retiree. The City's workers’ compensation coverage is self-funded.

Vacation Accrues at 8 hours per month upon employment and increases with time in service. Sick Leave Accrues at 8 hours per month with no limit. Family Illness / Bereavement Leave

An employee may be granted up to 6 days per year Family Illness leave with pay and up to 5 days per year Bereavement Leave with pay. This is not accruable.

Holidays The City pays for 11 fixed holidays per year, in addition to 32 hours floating holidays. Life Insurance The City pays the premium on a $50,000 term life insurance policy for eligible employees. Management Leave All mid-management employees are entitled to 10 days management leave per fiscal year in lieu of overtime pay or compensating

time-off. Longevity Pay Employee receives an additional 2.5% of base pay after 10 years; 5% after 15 years; and $50/mo. after 20 years. Deferred Compensation Two 457 Deferred Compensation plans available, with City contribution upon employment and increases with time in service. A ‘caveat emptor’ warning for contractors and consumers! However, we begin with ‘dis nc on’ in our first answer, and give another contractor some extra ‘ me’… Q:  I have a “C‐9” (Drywall) license and I’m selling my business (Corpora on) to a person who doesn’t have a Contractor’s License and cannot document the four years of experience to Qualify.  Can he just con nue opera ng with my license number if he’s the owner? A:  Is it an asset sale or a stock sale?  There is a dis nct difference. If you are doing a stock sale, the Corpora on can use the same license number.  If it will be an asset sale, the company would need to apply for a new license number.  Keep in mind that either way, the license needs to have a Qualifying Individual who is either qualified for the “C‐9” classifica on based on prior licensure or by documen ng the required experience and passing the exam.  Q:  Our President disassociated from our license in November of last year and we have yet to replace him.  Is there a certain  me frame to elect a President and no fy the CSLB?  I know when a Qualifier disassociates we are given 90 days to replace him/her on the license. A:  No, there is no specific  me frame the CSLB has for replacing an Officer on a Contractor’s License.   CSLB Issues Statewide Consumer Alert:  This Winter’s heavy rains and storms have le  many asphalt roads and driveways throughout the State crumbling.  The CSLB urges consumers to beware of long‐standing construc on scam, in which unlicensed paving and seal coa ng contractors from out of state come in and take advantage of unsuspec ng homeowners.   “With heavy rain around the state this winter, it’s especially likely other groups of transient criminals are out there,” said CSLB Registrar Cindi Christenson. “Always be wary when someone shows up uninvited at 

your front door and says they’ve got a ‘great deal’ with le over materials.”  The CSLB urges consumers and licensed contractors to watch for these red flags: 1.  No CSLB issued Contractor’s License 2.  Unsolicited offers to do seal coa ng, paving, 

roofing, or pain ng 3.  Claims of le over materials 4.  High pressure sales or scare tac cs; 5.  Reluctance to sign and wri en contract; 6.  Demand for payment in cash or checks wri en to 

individuals or their spouses, rather than to the business; 

7.  Brand new vehicles, large pickup trucks with a large tank on the bed or pulling a trailer, dump trucks, or other heavy road construc on equipment with out‐of‐State license plates, no plates at all, or obscured license plates 

8.  Toll‐free or out‐of‐State telephone number, instead of a local contact number
