PUBLIC HEARING DETAILS

1. INTRODUCTION

Assam State Pollution Control Board organized the 'Environmental Public Hearing' on 10th

January 2017 at 11:30 am, for the proposed 120 MW Lower Kopili Hydro-electric Project at

Longku, near project site, district Dima-Hasao, Assam. The Assam Power generation

Corporation Limited is the project proponent. The advertisement for Public Hearing was issued

in the local daily “The Assam Tribune’ on 06.12.2016

Assam State Pollution Control Board on 10th January, 2017 at 11:30AM organized the

'Environmental Public Hearing' as per Govt, of India Notification No. - SO 1533 dated

14.09.2006 at Longku, APGCL Project Site, District-Dima-Hasao, Assam. for the proposed

Lower Kopili Hydro-electric Project (120 MW) of Assam Power generation Corporation Limited.

The Public Hearing was conducted under the Chairmanship of Sri Dipak Jidung, ACS, Addl.

Distt. Magistrate, Dima Hasao. The copy of advertisements is enclosed as Appendix-I.

At the onset of public hearing, the representative of Assam State Pollution Control Board, Mr.

B.K.Baruah addressed the meeting and explained the purpose and motive of public hearing.

Thereafter, the project proponents and their Consultants described the proposals of them, the

proposed Lower Kopili Hydro-electric Project (120 MW). Mr. P.D. Karkhanis (CE),

representative of WAPCOS Limited, presented the findings of EIA and EMP Report prepared for

the proposed Lower Kopili Hydroelectric project.

The representative of the project proponent requested for co-operation of the public for

implementation of the proposed Project and expressed the company's commitment towards the

development of the area and thanked the public for their large presence in the public hearing.

The minutes of meeting are enclosed as Appendix-II.

2. ISSUES RAISED DURING PUBLIC HEARING

The public hearing commenced with the permission of the Chair. The issues raised by the public

and their replies by the government officers, project proponent and their consultants are given in

Table-1.

Joint assessment comprising representatives of respected District Councils, APGCL were carried out in 2012. APGCL has accordingly submitted the assessment proposal to Govt. of Assam, and based on the same, Govt. has allotted the necessary funds to APGCL. Thus, reassessment at this stage will be difficult. Both the councils were agreed to the fact 2012 be the cut off year.

He suggested to fix a date for fulfillment the demand of local people by APGCL

Date may be fixed up by the Rural Development Society. APGCL, authorized representatives of District councils and administrations. APGCL is free to discuss any constructive issues at any time.

6 Mr. Martin Tarang, Local people

He asked that whether the picnic spot in the downstream of Kopili river will be safe from the project. He also suggested to plant with local fruit species.

Efforts will be made to protect the picnic spot during construction as well as during operation of the project. There is a provision for plantation as well as Green Belt Development Plan in the project area. About 1600 trees/ha including fruit bearing trees will be planted.

During the time of public hearing 3 nos. of Memorandum from local people were received. The

Memorandum received from Lower Kopili Hydroelectric Project Affected People Association

(LKHEPAPA) is enclosed as Appendix-III.

Demand of Villages Response

1. Legitimate Compensation: The payment of entire legitimate compensation against Land & Properties of the indigenous and the genuine affected families of Longku area as well as district of Dima Hasao its going to be abolished & departed forever by the implementation of 120 MW Lowe r Kopili H.E Project which has bequeaths of our ancestry of 11 centuries, therefore the compensation must be paid at a glance before commencement of the project at latest revised rate as executive Committee Meeting of N.C. Hills Autonomous Council on 25th October’ 2016 to the directly or in directly affected.

Compensation will be paid as per provision of the “Right to Fair Compensation and Transparency in land Acquisition Rehabilitation and Resettlement Act, 2013”.

2. Mode of Payment in traceable:

Bank account shall be opened

Disbursement.

Bank account shall be opened by each PAF prior to disbursement of compensation.

Disbursement of compensation and premium proposed to be made as per the decision arrived at the meeting with Govt, DHAC, KAAC and APGCL held on 22.11.2016 wherein it was decided that :-

Compensation and premium should be made to the respective council in single installment. Disbursement shall be made subject to:

1. Final handing over the land with the required land documents to APGCL which will be full and final and no claims would be entertained thereafter.

2. Both the Councils will identify the Project Affected Families (PAF) along-with quantum of land to be acquired from them, amount of compensation to be paid, name of the head of family/owner.

3. On this basis, APGCL will issue Account Payee Cheques in favour of PAFs which will be handed over to Councils for disbursement to PAFs.

3. SCHEME UNDER CSR-CD Subject to applicability of CSR, APGCL will undertake CSR activities in the project. However, about 0.5% of the project cost (0.5% of Rs 1115.91 Cr= Rs 5.58 Cr) is proposed to be earmarked for Local Area development, which will be spent mainly as Educational facilities, Healthcare facilities, improvement of infrastructure & living standard, development of training & educational facilities etc.

4. A) Construction and maintenance of approach roads (Black toping/ Concreting along with drainages & Culverts as required to the affected villages and up to 10th Km radius distance around the project area.

Will be done as per provisions of approved DPR. Possibilities will be explored to construct roads other than proposed in DPR.

4. B) Construction and maintenance of water supply facilities at the entire affected villages Longku area (which will be free iron & arsenic)

Will be done as per provision of approved DPR and Rehabilitation and Resettlement Plan. Possibilities will be explored to incorporate in the CSR.

4. C) Free Electricity and electrification at affected villages and construction & maintenance of street light along the approach road up to 10th Km radius distance around the project area along with installation OF 11KV Transformer for affected families/ villages each.

The matter relating to free electricity is being taken up with the state Govt of Assam. It is proposed to be taken up as per prevailing policies of Govt. Electrification will be done after commissioning of the project. Possibilities will also be explored for incorporation in the CSR programme.

4. D) Construction and maintenance of school building along with Hostels for Girls and Boys for affected families & villagers around the project area at suitable place.

This will be taken up as per the provisions of approved Rehabilitation and Resettlement act and Local Area Development.

4. E) Free education facilities along with providing of books must be made up to 12 (twelve) standard to the affected families.

Project proponent will take up the matter with the appropriate Authority at the state government land. Possibilities will also be explored for incorporation of free education facilities in the CSR programme.

4. F) Scholarship must be provided to the 50% marks secure/ obtainers to the affected families.

Project proponents will take up the matter with the appropriate Authority of the state Government. Possibility will be explored whether this can be implemented as a part of CSR.

4. G) Construction of at least 20 Bedded Rural Hospital with full bedded and other accessories along with electrification & 24X7 water supply facility & Maintenance of Hospitals along with free medicines & treatment to the affected families. And necessary employees of this Hospital must be trained under Company’s expenses apart from Doctors must be engaged from the affected families.

APGCL proposes Public Health Delivery System as a part of Environment Management Plan, wherein there is provision for Construction of Dispensary, engagement of Doctors, Nurses Para medical Team, Ambulances etc. Doctors from Dispensary shall make regular visits to the nearby villages and organize health promotional activities with active participation of Local Village Panchayats, NGOs and available local health functionaries. Upgradation of Health care facilities will also be

taken up as per provisions of Local Area Development plan. APGCL will take up the matter with the state Govt of Assam for construction of 30 bed hospital in the project area.

4. H) Free medical camp time to time must be held up to 10th Km radius distance around the project area.

Project proponent shall take up the matter with the appropriate Authority of the state Government.

4. I) Construction of hygienic toilets and sanitary system at the directly / indirectly affected families/ villages of the project.

Construction of hygienic toilets and sanitary system are proposed as a part of Local Area Development Plan.

4. J) Construction and maintenance of community Hall cum auditorium hall along with electrification, water Supply facility and Toilets.

Will be done as per provisions of approved Rehabilitation and Resettlement act, 2013. Possibilities will be explored to undertake the work under CSR programme.

4. K) Construction and maintenance of Mini stadium with play ground for different games & sports at suitable place for affected families of Longku area.

May be done as per provisions of approved Rehabilitation and Resettlement act, 2013

4. L) Construction & Maintenance for Vocational Training Centre at suitable place for genuine local tribal affected families/ people of Longku area and must be trained to the affected families youths under company’s expenses like; Welder, Electrician, Fitter, Riggers, Instrumentation etc. requires for the project and after completion of trained they must be appointed with full pledged.

Matter will be taken up with the appropriate authority of state Govt of Assam.

4. M) If engaged through out sources employment (Contractual Basis): Entire “man power” suppliers must be from the affected families ( who having an affected certificate and other mandatory documents imposed by the Association).

Preference of any supply work (not highly technical ) will be given to PAFs.

4. N) Construction and maintenance and also development of Market along with Postal and Bank & ATM counter facilities must be established for accessible the affected families at Suitable place.

May be incorporated in Local Area development Plan and also in CSR activities.

4. O) Arrangements of Socio cultural activities and sustainable Environmental safeguards, providing of weaving centre and must be facilitated to the women’s upliftment.

May be implemented as per provisions of approved Rehabilitation and Resettlement Act, 2013. Special measures are proposed to be adopted for protection of cultural identity of locals. For sustainable Environmental safeguards, APGCL proposes to appoint experts who will work in consultation with administration, PAFs and local committees.

5. Employment Facility Grade -III & IV For employment, job reservation generally be as per State Govt. policy subject to availability of qualified manpower and is to be limited to direct recruitment personnel, However preference will be given to Project Affected Families.

6. Creation of employment facilities With the commencement of project activities many employment avenues will automatically open up for locals.

7. Constant services for affected families: Also would like to assert that if the incumbent employees absconded during their services period under any circumstances their family must be replaced without any interview and delay.

Will be done as per provision of “Right to Fair Compensation and Transparency in land Acquisition Rehabilitation and Resettlement Act, 2013”.

8. Agreement sign in between APGCL & DHAC: An association (LKHEPAPA) of affected families of the project must be included while an agreement sign between Dima Hasao Autonomous Council ( DHAC) and APGCL authority for implementation of 120 MW Lower Kopili H.E Project, on any time/ day at any place which to be constructed at Longku, Dima Hasao.

MoA has been drafted in due consideration to the terms and conditions set earlier by Dima Hasao Council and as per the norms laid down by the state Govt. of Assam.

9. Contracts & Supply works: Any contract & supply works opportunities must be given as a top most priority to the genuine local tribal affected families/ peoples of the project area, Umrongso area as well as the dist. other than the technical nature of works, which shall be constructed for “120 MW Lower Koplili H.E Project” by APGCL at Longku Dima Hasao.

Agreed for contract and supply work. For contract of highly technical nature suitability and experience will be taken into account.

10. E tendering: Execution of “E-Tendering”.

Matter will be dealt as per the existing norms. However possibilities will be explored whether relaxation could be given to PAFs.

11. Registration for contracts and supply Matter will be dealt as per the existing norms and practices.

12. Mandatory documents to all contractors and suppliers

Matter will be dealt as per the existing norms and practices.

13. Documents must be produced for suppliers

As per codal practice.

14. Mode of payment against works/supplies bill by APGCL

As per codal practice

15. Disagree directly awarding work order Contract work will be awarded by inviting bids through wide publicity.

16. Circulation of NIT NIT will be published in local newspapers also will be posted in project offices and other area around project site.

17. Tender process Matter could be decided in due course of time.

18. Works and supply bill Bills will be released for payment only on satisfactory execution, submission of relevant documents and availability of fund.

19. Shifting of APGCL office at project site Immediately after acquisition of land, project office building will be shifted to project site, Longku.

20. Additional planning for Irrigation: APGCL shall have to be extended the tail race discharge water from the power house of the project to a certain point in order to facilitate irrigation facilities in Diyungbra area under Diyungbra block for greater benefit of the district.

APGCL would limit its investment to the power project, decision regarding conversion to multi-purpose project (with irrigation facility) to be taken with appropriate authority of the state Govt.

21. Land Extension: If submergence area (catchment) of APGCL shall have to be extend the acquisition of land in near future for extension & up-gradation of Power - House for generation of power, the payment of compensation shall have to be made with proper joint spot verification assessment and the billing of the land owners apart from 1386.12 (Hectors) including KRF & Council Reserve forest must be paid to the affected families.

There will be no extension of area of submergence than what is given in the DPR.

22. Permission for entrance in to the APGCL complex Longku: The APGCL authorities shall have to allow a person who having an original Photo- identity cad of the Affected people’s Association which card will be sealed with sign of the G.S & the President of LKHEPAPA to enter in to the APGCL complex during construction and even after commissions the project, but the company’s custodian have right to ask the purpose to a person for safety measures. An affected person shall be provided a “PHOTO- IDENTITY CARD” for proof of the affected person.

To be discussed with PAF representatives. For protection of cultural identity of locals appropriate measures have been proposed in the EIA report.

23. Honorarium Payment: Monthly honorarium payment must be given to the entire respective G.B of affected villages from the Assam Power Generation Corporation Ltd. (APGCL).

Matter is to be taken up with the state Govt of Assam.

24. Including Project: The construction company should be converted in to a Multipurpose project and it should be included Fishery, Irrigation and

Project has been accorded Techno Economic approval by competent authority of Govt of India as Power project. APGCL would limit its investment to the power project, decision

Tourism. regarding conversion to multipurpose project (with irrigation facility) to be taken by the state government of Assam.

25. Controlled of Pollution/ Environment: A detailed Environmental Management Plan outlining measures for control of Air, Water, soil and Noise Pollution has been formulated for implementation during project construction and operation phases.

26. Providing of office building: The APGCL management should be constructed one Office- Building for LKHEPAPA at suitable place Longku area.

Proposed to be constructed in due course of time.

27. Power sharing: Also we demand 5% sharing of free power in between APGCL & DHAC.

Decision in this regard to be taken by the State Government of Assam

28. Financial Assistance: Cultural for financial assistance amounting to Rs. 50,000.00 to 1,50,000.00 should be earmark annually and must be provided to Karbi Dimasa community of affected villages for cultural & customary practices/ activities/ festival/ Annually Puja. The appropriate committee shall apply if and when necessary is arises and the matter should be response to consider by the management in time.

To be finalized with appropriate authority. Possibilities will also be explored for incorporation in the CSR.

29. Te main Affected Villages namely: a) Boro-Longku which comprises 46 Houses b) Tortelangso party affected as Dyke Construction area 4 Houses c) Longku- II 5 Houses These must be included in the homestead list of assessment.

Villages fully and partially affected were indentified during Joint Survey comprising Revenue officials of District Councils & APGCL.

Association on behalf of the affected people is looking forward the immediate implementation of “120 MW Lower Kopili H.E Project” by APGCL or any flagship company at Longku Dima Hasao and desire to keep long term relationship with implementation company

APGCL welcomes this cordial gesture from the Lower Kopili Hydroelectric Project Affected People Association (LKHEPAPA).

31. LKHEPAPA extend my heartfelt and sincere co- operation to your honor and pray to God so that almighty may grant a long happy and prosperous and hope prolific result will be received by us after this day.

All environmental norms must be strictly followed, Green Belt Development must be done due to deforestation of Forest area.

APGCL is committed to follow all the environmental norms as set up be MoEF and ADB.

Adequate Compensation be provided to direct and indirect affected families, Relief & Rehabilitation scheme must be implemented for the overall development of PAP, CSR activities must be implemented on need basis of the Project affected and local people.

Compensation will be paid as per provision of the right to Fair Compensation and Transparency in land Acquisition Rehabilitation and Resettlement Act, 2013.

Project Affected/Local people must be given preference in job, Employment, Supply, Contract Works as per their capacity.

For employment, job reservation to be done as per State Govt. policy subject to availability of qualified manpower and is to be limited to direct recruitment personnel. However, Project Affected Families (PAFs) will be given preference.

Medical Centre be established at Longku with adequate Doctors, Paramedical staffs etc along with sufficient medical facilities.

Establishment/Construction of Skill Training Centre at Longku.

Will be explored for incorporation in CSR.

Project Office should be established at Longku or in Umrangso.

Immediately after acquisition of land, project office building will be shifted to project site, Longku.

All Affected Village road must be constructed. Will be explored for implementation as a part of CSR and Local Area development

TRIPARTITE TALK: A tripartite talk between APGCL, NCHAC authorities and KSA a local organization is a must, subsequently a formal agreement should be signed after talked on the agreed points which is for future security of the affected local people

The proposed land and properties of the affected people which is assessed by NCHAC authority for payment of compensation must be as per the guidelines given in the Right to Fair Compensation and Transparency in the land acquisition and Resettlement Act, 2013. Compensate amount should be paid before the commencement of the project activities directly to their respective Bank A/Cs of the affected people.

Disbursement of compensation and premium proposed to be made as per the decision arrived at the meeting with Govt, DHAC, KAAC and APGCL held on 22.11.2016 wherein it was decided that :- Compensation and premium should be made to the respective council in single installment. Disbursement shall be made subject to: Final handing over the land with the required land documents to APGCL which will be full and final and no claims would be entertained thereafter. Both the councils will identify the Project Affected Families(PAF) alongwith area of land acquired from them, amount of compensation, name of the head of family/owner. On this basis, APGCL will issue Account Payee Cheques in favour of PAFs which will be handed over to Councils for disbursement to PAFs.

APGCL proposes Public Health Delivery system in the Environment Management Plan, wherein there is provision for Construction of Dispensary, engagement of Doctors, Nurses Para medical Team, Ambulances etc. Doctors from Dispensary shall make regular visits to the nearby villages and organize health promotional activities with active participation of Local Village Panchayats, NGOs and available local health functionaries. Health care facilities will be taken up as per provisions of Local Area Development plan. APGCL will take up the matter with Govt of Assam for construction of 30 bed hospital in the project area

FREE EDUCATION AND SCHOLARSHIP must be provided to all affected children in all categories i.e. (Science, Technical, Arts, Medical and General Education) right from the primary level to University. Initiative should also be made by the management authority for establishment of CBSE affiliated school from primary to Higher Secondary level like KV or Nobodaya etc to be brought in at Longku for free education to all affected children.

Project proponent will take up the matter with the appropriate Authority of state Government Possibility will be explored whether this can be done as a part of CSR..

HONORARIUM PAYMENT: Payment of honorarium must be made on a monthly basis to all Gaonbura (GBs) of the affected villages effecting from the month of the project commenced of construction work.

Free 5 points current/electrification must be provided for all affected villages in every household. And free supply of water for safe drinking water.

The matter relating to free electricity is being taken up with the state Govt of Assam. It is proposed to be taken up as per prevailing policies of the state Govt. Electrification will be taken up after commissioning of the project. Possibilities will be explored for incorporation in the CSR programme.

90% of job under 3rd and 4th grade level and 100 % under unskilled categories should be reserved and provided to all unemployed youth of the affected villages and genuine inhabitant of NC Hills and Karbi Anglong District

For employment, job reservation may be as per the State Govt. policy subject to availability of qualified manpower and is to be limited to direct recruitment personnel. However, Project Affected Families (PAFs) will be given preference.

LIAISON OFFICER in the graduate level should be appointed/ recruited from local affected candidate, who have passed BA/Graduate. Also executive officer and project executive under the CSR department of the project should be reserved for the unemployed youth of the genuine project affected villages.

Will be decided in due course of time.

COORDINATION COMMITTEE (CC): Local affected association and management coordination committee must be constituted for proper implementation of local affected grievances immediately.

For effective implementation of Resettlement and Rehabilitation (R&R) Plan and monitoring there will be representation from of women, various castes and tribes, voluntary organizations operation and in the area

One Weaving Training Centre at Longku should be constructed along with necessary tools, Instructor’s remuneration. Keeping in mind that the tribal are interested for traditional method and this should be upgraded in used of the modern technology to preserve their customs and traditions

FINANCIAL ASSISTANCE: Cultural fund for financial help amounting to Rs. 1,00,000.00 to Rs. 2,00,000.00 should be earmark annually and must be provided to Karbi Community and Dimasa Community for cultural and customary practices/activities/Festivals/Puja annually. The genuine/appropriate committee shall apply if and when necessary is arises, the matter should be response to consider by the management in time.

KHEP Umrongso that the kin of employee belonging to project affected villages who have exhausted/retired from his/her service length in any categories are not taken back or reappointed to fill the vacant post. Therefore we demand the APGCL management authority that such deprivation should not be done to the local affected people. If not the kin of the employee the meritorious local affected candidate should be recruited in the vacant post. So, we would like from management authority a assurance for adopting a compensatory ground appointment policy to the employee next kin i.e. may be wife. husband, son, daughter or his brother in case of affected employed in this project. The policy is applicable only for local affected person after exhausted/retired of service should be adopted. So that the retired person family can survives happily without any problem.

Schemes/Welfare works and scheme: the APGCL management must used 5-10% of the total cost of project or benefit/income/annual turned over by this project for welfare works i.e. providing safe drinking water, footpath, approached road. School, games and sports material, field and CSR activities as per need basis.

Will be addressed in Local Area Development programme.

Control of Pollution/Environment: Though it is not like cement factory but deforestation is very high and the balance of the environment is affected due to Hydro Project. So, we demanded that the plantation should be made along the project catchment area by the APGCL management, so that the balance of environment is keep. All types of pollutions including , sound, air, water and other shall be well controlled by the APGCL as per ESR.

Proposal already been given in Environmental Management Plan.

The APGCL management should constructed one building including toilet room facilities for the uses of LKHEPAPA Office at Longku.

Will be explored for implementation as a part of CSR and Local Area Development Plan.

CONTRACT AND SUPPLY WORKS costing upto Rs. 20,00,000.00 and medium technical works should be offered directly to the local affected contractors.

Issuance of AK Patta The matter of issuance of immediate AK patta to all affected people against their resettlement plot of the new site should be initiated by APGCL to the NC Hills Autonomous Council.

Cultivation The NCHAC authority has to allow the affected family to cultivate wet paddy field where it is feasible or whether it is in reserved forest/unclass or grass land.

Sacred community The sacred community alteration place called LONGRI RONGKER) performed since 1825 AD measuring 4 bighas and VOTHUNG RONGKER 1(one) bigha all these places will be totally affected and remain under water. In this regards we have already given memorandum/claimed petition to the concerned authority. But it seems unattended. So, it has not seen in your project report. So, again we the project affected people once again claimed in this regard in today’s public hearing for redressal of the grievance for giving compensation of the above mentioned area including rehabilitation and shifting cost to be borne by APGCL.

Matter will be taken up in due course of time with the sacred community.

Main affected Villages The main affected villages namely a)BORO LONGKU which comprises 46 Houses b) Tortelangso partly affected as Dyke Construction area (4 Houses) c) Longku-II (5 Houses) must be included in the Homestead affected list of assessments.

Financial assistance FINANCIAL ASSISTANCES to SHGs, NGOs of the affected villages for community upliftment activities must be provided.
