PRE-TRIAL CHAMBER I of the International Criminal Court ("Chamber" and "Court"respectively);

HAVING EXAMINED the "Prosecutor's Application under Article 58" ("the Prosecutor'sApplication"), ^ filed by the Prosecutor on 2 December 2011 in the record of the situation inDarfur, the Sudan ("the Darfur situation") requesting the issuance of a warrant for thearrest of Abdel Raheem Muhammad Hussein ("Mr Hussein") for crimes against humanityand w ar crimes;

HAVING EXAMINED the supporting material submitted by the Prosecutor;^

NOTING the "Decision on the Prosecutor's Application under article 58 relating to AbdelRaheem Muhammad Hussein"^ in which the Chamber held that it was satisfied that thereare reasonable grounds to believe that Mr Hussein is criminally responsible under article25(3)(a) of the Statute as an indirect co-perpetrator for war crimes and crimes againsthum anity and that his arrest app ears to be necessary und er article 58(l)(b) of the Statute;

NOTING articles 7, 8, 13(b), 19(1), 25(3)(a), 27, 58(1) and (2)(d) of the Rome Statute (the"Sthlte");

CONSIDERING that, on the basis of the material provided by the Prosecutor in supportof the Prosecutor's Application and without prejudice to any subsequent determinationthat m ay be m ade un de r article 19 of the Statute, the case against Mr H ussein falls withinthe jurisdiction of the Court;

CO NS IDER ING that, on the basis of the material provided by the Prosecutor in su pportof the Pro sec utor 's Ap plication, there is no ostensible cause or self-evident factor to imp elthe Chamber to exercise its discretion under article 19(1) of the Statute to determine at thisstage the admissibility of the case against Mr Hussein;

CONSIDERING that there are reasonable grounds to believe that from about August 2002and at all times relevant to the Prosecutor's Application, a protracted armed conflictwithin the meaning of article 8(2)(f) of the Statute took place between the Sudanese armedforces along with th e Militia/Janjaweed on the side of the Gov ernm ent of the Republic ofthe Sudan and organised rebel groups, including the Sudanese LiberationMovement/Army (SLM/A) and the Justice and Equality Movement (JEM) in Darfur, theRepublic of the Sudan;

CONSIDERING that there are reasonable grounds to believe that the Sudanese armedforces and the Militia/Janjaweed, acting together as part of the counterinsurgencycampaign, carried out several attacks on the towns of Kodoom, Bindisi, Mukjar, Arawalaand s urro und ing areas over an extensive period of time ru nnin g at least betw een 2003 and2004;

CONSIDERING that there are reasonable grounds to believe that during these attacks,the war crimes of: murder contrary to article 8(2)(c)(i) of the Statute, rape contrary toarticle 8(2)(e)(vi) of th e Statute, o utrag es u po n p erso nal dign ity c ontra ry to article 8(2)(c)(ii)of the Statute, attacks intentionally directed against the civilian population contrary toarticle 8(2)(e)(i) of the Statute, destruction of property contrary to article 8(2)(e)(xii) of theStatute and pillaging contrary to article 8(2)(e)(v) of the Statute were committed against

the primarily Fur populations of the towns of Kodoom, Bindisi, Mukjar, Arawala andsurr oun ding areas by the Sudanese arm ed forces and the Militia/Janjaweed;

CO NSID ERIN G that there are reasonable gro unds to believe that the attacks perpetratedby the Sudan ese arm ed forces and /or the Militia/Janjaweed we re com mitted in the contextof a systematic and widespread attack pursuant to a State or organizational policy toattack the civilian population, belonging largely to the Fur, Masalit and Zaghawa groups,perceived as being associated with the rebels;

CONSIDERING that there are reasonable grounds to believe that, during these attacks,the crimes against humanity of: persecution contrary to article 7(l)(h) of the Statute,murder contrary to article 7(l)(a) of the Statute, forcible transfer contrary to article 7(l)(d)of the Statute, imprisonment or severe deprivation of liberty contrary to article 7(l)(e) ofthe Statu te, tort ure contrary to article 7(l)(f) of the S tatute, rap e co ntrary to article 7(l)(g) ofthe Statute, and other inhumane acts contrary to article 7(l)(k) of the Statute, werecomm itted against the primarily Fu r popu lations of the tow ns of Kodoom , Bindisi, Mukjar,Araw ala and s urro und ing areas by the Sudanese arm ed forces and the Militia/Janjaweed;

CONSIDERING that there are reasonable grounds to believe that a common plan wasformulated at the highest levels of the Government of the Republic of the Sudan to carryout a counter-insurgency campaign against the SLM/A, the JEM and other armed groupsopposing the Government, that a core component of the common plan was an unlawfulattack on that p art of the civilian popu lation perceived by the G ove rnm ent of the Republicof the Sudan as being close to the rebel groups - belonging largely to the Fur, Masalit andZaghawa groups - and that the alleged crimes were committed pursuant to the commonplan;

FOR THESE REASON S,HEREBY ISSUES :A WARRANT OF ARREST for Abdel Raheem Muhammad Hussein, a Sudanese citizenover sixty years old, believed to have been born in or around Dankla in Karma city inNorth Khartoum, who at the time relevant to the alleged crimes, served as Minister of theInterior of the Government of the Republic of the Sudan and the President's SpecialRepresentative in Darfur, and who, was appointed as Minister of National Defence in 2005,a position w hich he continued to hold at the time of the Prosecu tor's Application.
