DETAILED DESCRIPTION OF COMPLAINT Failure to control sediment discharged in rainfall runoff from construction site.

INVESTIGATION & ACTION TAKEN A NPDES inspection of the site was performed on 9/6/2013. No one was onsite. This inspection revealed the following violations of the permittee’ s NPDES Permit ARR153671: (1) Effective perimeter sediment controls were not in place at the site's main storm water outfall in violation of Part 1.B.12.A(5) of the referenced permit. A large sedimentation pond called for at this location by the SWPPP submitted by the permittee and on file at ADEQ had not been constructed. Installed silt fencing at this perimeter had not been adequately maintained. Culverts installed though a rock check dam had their inlets located at sediment level rendering the rock check dam ineffective as a sediment control. See attached Photos #2 through #8 for evidence of this violation. (2) Site soils had not been stabilized as required by Part 1.B.12.B of the permit. Almost none of the site soils had been stabilized. Significant erosion gullies were observed on some of the slopes. See attached Photos #2, #7,#8 #9 and #10 for evidence of this violation.
