Included herein is the Scope of Work and specifications for this project. Electronic copies of this document and the project drawings are available upon e-mail request at [email protected] or may be downloaded from the board’s website: www.troutmanabc.com.

Proposals can be mailed to the Troutman ABC Store General Manager, ABC Store, 511 N. Main Street, Troutman, NC 28166, to be received no later than 3:00 PM on Tuesday, March 31, 2020. Proposals may be hand delivered to the Troutman ABC store located at 511 N. Main Street, Troutman, NC 28166. However, it is important to note that this is not a mailing address (proposals may only be mailed to the P. O. Box 194 address).

Instructions to Bidders

1. It is intended that the successful bidder shall furnish all tools, equipment, machinery, apparatus, labor and materials necessary to complete all work required under the terms of such contract(s) as may be entered into.

2. Sealed proposals shall be mailed to the General Manager, Troutman ABC Board, P. O. Box 194, Barium Springs, NC 28010. Bids are due by 3:00 PM on Tuesday, March 31, 2020 for the furnishing of labor, materials, equipment, and services for construction of the Project. Proposals may be hand delivered to the Troutman ABC Store at 511 N. Main Street, Troutman, NC 28166. However, it is important to note that this is not a mailing address (proposal may only be mailed to the P. O. Box 194 address) and clearly marked “Bid Proposal –Warehouse Extension Project.” The bidders state contractor’s license number shall be printed in the lower left-hand corner of the envelope containing the bid.

3. Bid, Performance and Payment Bonds are not required for this project.

4. The successful bidder shall procure and maintain during the life of the contract the Insurance Provisions as outlined in the Contract.

5. The successful bidder will be required to commence work within 3 weeks of receipt of “Notice to Proceed” being issued by the ABC Board.

6. Bidder’s attention is called to the contract time limit of 19 weeks allowed to complete the work specified after the date of the Notice to Proceed has been issued. Preference will be considered for the

8. Bidders are hereby notified that they must have proper license(s) under General Statues of N. C. governing their respective trade(s).

9. Bidders are hereby notified that Chapter 87, General Statutes of North Carolina, will be observed in receiving and awarding the Contract(s).

10. Bids shall be submitted on the Bid Proposal Form furnished with the specifications and must be completed in ink or typewritten without erasure, interlineations or changes. All prices shall be stated in numerals. In case of conflict, unit prices will take precedence over unit price extensions.

11. Bids by corporations shall be executed in the corporate name by the President or Vice-President (or other duly authorized corporate officer accompanied by evidence of authority to sign), and the

12. Bids by partnerships must be executed in the partnership name and signed by a partner. The partner’s title must appear under the partner’s notarized signature. The official address of the partnership and the names of all partners must be typed or printed below the signature.

13. Bids other than by corporations or partnerships shall be executed by the owner of the firm submitting a bid, in the presence of a notary public whose signature and seal attest said signature.

14. All bid prices shall include sales taxes.

15. This project uses no Federal or State funding.

Troutman ABC Board Warehouse Extension Project (The Project)

OverviewThe Troutman ABC Board (The Board) is seeking to extend its current warehouse space by ~ 1,760 Square Feet. The extension will be an addition to the current ABC store which totals 4,000 SF. When the original building was constructed in 2016 it was believed it would handle the stores projected growth for the first 5+ years of operations. The store has experienced stronger than expected sales with continued growth to this day. The ABC Board uses a forklift to offload the alcohol shipments from a bi-weekly delivery truck. The warehouse is used to store all alcohol inventory, forklift and all other tools, IT/Data equipment and items needed to operate the store as well as the business office and restroom. After each delivery it has become increasingly difficult to get everything, including the forklift, into the existing space. This has the potential to become a safety issue in the foreseeable future; especially for the first 4 to 5 days after a delivery. The extension of the warehouse was planned for in the original construction documents of the building. The Troutman ABC board has had follow on construction documents created for this project as well of procurement of the building permit. It is believed that the additional square footage will alleviate the current space shortage while also allowing for this additional space to serve as the central warehouse for a second store when it is deemed to be needed.

The addition/extension of the warehouse will be on the west side of the current Troutman ABC Store building located at 511 N. Main Street, Troutman, NC 28166 (on the corner of Main Street and Goodman Road). II. Scope of Work The winning contractor shall complete work in strict compliance with state, county and town laws and standards.

A. General Provisions 1. General: It is understood and agreed that by submitting a bid that the Contractor has

examined these contract documents, drawings and specifications and has visited the site of the work and has satisfied himself or herself relative to the work to be performed.

2. Specifications: The Board seeks a turnkey project of a completed ~1,760 square feet warehouse extension that is identical in all aspects to the current interior and exterior of the existing building. Existing building has exterior brick veneer and wood siding. Rear portion of building will be extended to approximately 44” with 40” width footprint to match the existing width. Site development will include building location, parking, curb cuts, landscaping, and other services. Detailed familiarization with the design drawings included as a part of this informal RFP is required. The drawings will also serve as the construction drawings for this project.

3. Award of Contract: To the extent permitted by law, the board reserves the right to reject any and all bids, waive any informality or technicality and be the sole judge of suitability of the services offered. The award shall, if made, be to the lowest responsible bidder meeting bid specifications, taking into consideration offeror’s history of quality performance, timely delivery of end product and ability to remain within budget.

4. Quality of Work : All materials furnished, and work performed shall be strictly of the best quality of their respective kinds and suitable for the use intended, subject to approval by the board. Unless otherwise specified, all materials shall be new, unused, and of recent manufacture. All equipment and tools shall be clean and in good working order. All workers shall be qualified in the work assigned and to operate equipment or machinery as directed

5. As-Built Marked Up Construction Documents: Contractor shall provide one complete set of legible “as-built” marked-up construction drawings and specifications recording any and all changes made to the original design during the course of construction. In the event no changes occurred, submit construction drawings and specifications set

with notation “No Changes.” The Designer/Owner must receive “As-built” marked-up construction drawings and specifications before the final pay request can be processed.

6. Payment : Payment will be made on thirty percent (30%), sixty percent and ninety percent 90% of estimated work done less payments previously made. The Troutman ABC Board shall retain the remaining ten percent (10%) until acceptance of all work contracted is fully completed and the certificate of occupancy is issued.

7. Price : Price quoted shall be net and shall include delivery of services, equipment, all transportation and delivery charges prepaid to the point of delivery indicated in the proposal, fully equipped as indicated herein and in the proposal.

8. Exclusion of Taxes : All federal excise and transportation tax shall be excluded from the bid; North Carolina sales tax shall be shown as a separate item on the Bid Proposal Form.

9. Contract Requirements : The board requires a written contract that obligates contractors to standard insurance requirements and other responsibilities. A sample contract for your review is included in this document.

10. Owner’s Right to Do Work : If, during the progress of the work or during the period of guarantee, the contractor fails to prosecute the work properly or to perform any provision of the contract, the owner, after seven (7) days' written notice sent by certified mail, return receipt requested, to the contractor from the designer, may perform or have performed that portion of the work. The cost of the work may be deducted from any amounts due or to become due to the contractor, such action and cost of same having been first approved by the designer. Should the cost of such action of the owner exceed the amount due or to become due the contractor, then the contractor or his surety, or both, shall be liable for and shall pay to the owner the amount of said excess.

11. Equal Opportunity Clause: The non-discrimination clause contained in Section 202 (Federal) Executive Order 11246, as amended by Executive Order 11375, relative to equal employment opportunity for all persons without regard to race, color, religion, sex or national origin, and the implementing rules and regulations prescribed by the secretary of Labor, are incorporated herein.

The contractor(s) agree not to discriminate against any employee or applicant for employment because of physical or mental disabilities in regard to any position for which the employee or applicant is qualified. The contractor agrees to take affirmative

12. Minority Business Participation : GS 143-128.2 establishes a ten percent (10%) goal for participation by minority business in total value of work for State affiliated building projects.

The contractor shall include with his/her bid a completed Identification of HUB Certified/Minority Business Participation form. Contractor shall submit completed Appendix E MBE Documentation for Contract Payments form with final payment request.

14. Security Plan : The successful proposal will include a comprehensive security plan for protecting the contents of the warehouse and retail sales area which contain a dynamic inventory, a safe, cash registers, office files, sensitive computer and document storage, et al. The ABC Board requires that current warehouse access be limited to contractor’s project manager/superintendent except as approved by the ABC Board representative for the purpose of installing equipment or making connection to the breaker box. The retail sales area is off limits to all contractor and subcontractor employees except as customers at the end of the contractors’ workday. External sanitary facilities are required for all contractor employees.

15. Design Drawings : The design drawings can be accessed on our website at www.troutmanabc.com or by contacting the General Manager at [email protected] for an electronic version or coming to the board’s office at 511 N. Main Street, Troutman, NC to review the hard copy version.

16. Building Permit : All documentation has been provided, reviewed and approved by the Iredell County Building Inspections. The successful contractor will obtain the permit upon execution of a signed contract with the Troutman ABC Board.

B. TECHNICAL PROVISIONS :

1. Demolition: Any required demolition shall be marked and reviewed with the ABC Board representative prior to any demolition activity.

2. Coordination : The contractor shall coordinate the activity of each subcontractor to maximize productivity while minimizing disruption and inconvenience. Scheduling of subcontractors in advance to have no disruption or gap in activity will be required to meet the deadline of August 15, 2020 for owner occupancy.

3. Restoration : All private and public property disturbed in the process of project construction shall be restored to the condition existing prior to construction or as otherwise specified on the plans.

4. Erosion and Sediment Control Measures : Erosion and sedimentation control devices shall be installed as needed and maintained according to the standards of the Town of Troutman and Iredell County. The Contractor shall immediately correct any deficiencies in erosion and sedimentation measures identified by the town, county or state agency. The Contractor shall indemnify and hold harmless the board for any penalties imposed against the board by any local or state agency for the Contractor’s failure to install and properly maintain erosion and sedimentation control devices.

5. Pavement Removal : The Contractor shall be advised that when a portion of any area of asphalt, concrete sidewalk, or curb and gutter must be removed, all areas to be removed shall be defined by a machine sawed joint prior to removal, with particular attention to clean cuts in front of doorways. The Contractor shall exercise caution when removing the curb, such that the edge of the pavement will be smooth. The existing asphalt shall be saw-cut to obtain a straight edge.

6. Demolition and Construction Debris : Disposal of all waste material from construction sites shall be made in strict accordance with all local ordinances pertaining to disposal of

construction waste. It shall be the responsibility of the Contractor to secure the necessary permits and provide all information required to secure said permits. The Contractor shall designate the disposal site prior to beginning any needed demolition.

7. Roof, Gutters and Drains : Install Firestone .060 TPO roof membrane over Firestone R8.5 insulation with 24 gauge metal eve and gutters to match existing, provide 20 year firestone labor and material manufacturer warranty. Existing and new roof drains shall remain or be tied into subsurface storm drainage structures. Otherwise, whenever possible multiple drains shall be piped together below grade and routed into an existing single cast iron outlet. This is not included on the design drawings. It will be discussed and agreed upon between owner and contractor prior to commencement of work.

8. Electrical Requirements : Arrangements must be made and coordinated in advance of work commencement to ensure sufficient AC power supply is available to support the project without disturbing or interrupting the ABC store’s operations. Close attention to detail is required to existing conduit and wiring so as to match as close as possible existing conduit and wiring and to emulate its placement above the ceiling.

9. Sanitation Station : Coordination is required between the Board Representative and the project manager for the placement of a portable toilet at least a week before the commencement of work.

10. Daily Site Cleanup: The ABC Store will remain in operation during this project. As such

the contractor shall perform a complete external site cleanup at the end of each day. All debris will be placed in the back of a dump truck, preferably. The truck will be emptied at the end of each work week or as needed, if sooner; weather permitting.

11. Security Cameras : Removal of the existing security cameras from the side and rear of the building shall be coordinated with Alarm South. Re-installation of existing cameras and addition of any new cameras will also be coordinated with Alarm South.

C. CONSTRUCTION MANAGEMENT AND TRAFFIC CONTROL

1. Contractor Responsibility : At least one week prior to the start of work, the Contractor shall provide a Construction Management Plan for review indicating phases and sequencing of work to complete the project including the approximate schedule of dates for each proposed phase and location of construction staging.

2. Parking and Traffic: At least 48 hours prior the commencement of work, the contractor shall submit a parking plan that will minimize or eliminate disruption of

the ABC Store’s customer parking, Walgreen’s parking and traffic flow between the 2 businesses during business hours with a recommended plan for enforcement.

3. Customer and Employee Access and Safety: Access to the ABC Store’s and Walgreens’ parking lots shall be maintained with pedestrian safety measures provided by the Contractor. When concrete sidewalk is poured and finished, temporary boardwalks or bridges/ramps shall be provided. Installation of driveway aprons and sidewalk crossings shall be coordinated with ABC Store General Manager to minimize disruption to ingress and egress, with consideration for solid waste collection services that may occur outside regular business hours.

4. Traffic Control Signs : The Contractor shall furnish, erect, operate, relocate, maintain and remove all temporary traffic control devices necessary for notifying and controlling both pedestrian and vehicular traffic.

5. Maintenance of Traffic : The Contractor shall coordinate with the Board Representative and Walgreens Manager prior to removing and restoring any driveway access. Access to parking lots must be maintained during regular business hours. The Contractor shall provide adequate drainage under driveways and within the project area for the duration of the project.

6. Contract Documents: The successful offeror selected by the board pursuant to the

RFP will be required to enter into a written guaranteed maximum price contract consistent with the acceptable services, terms and conditions outlined in the successful proposal and the requirements set forth in this RFP. This RFP is considered a part of the contract.

7. Reduction in Scope: The board reserves the right to reduce the scope of this project (for example, reduce the total square footage of the proposed building) if the winning offeror’s price proposal exceeds the funding available to the board for this project.

D. Supplemental General Conditions Vaulted ceiling in sales area–to be priced as alternate bid; all work to be done after closing

hours. All sidewalks connecting to the new addition to be replaced to match remaining sidewalk. Disregard note on A1.01 “Remove and relocate existing double door.” Instead add new exterior

opening to be double 3’ x 8’ doors with 4 ball bearing hinges each and hardware to match existing; remove existing doors and blank off hinge pockets.

Forklift access to the existing rear door must be available during the length of the project with a hard surface runway from back drive to the current warehouse door.

Densifying floor and joints with polyurea to match current floor 1” x 8” pre-finished pine wood base boards Require the use of Statesville Brick to provide Smooth Face brick with red mortar to match

existing brick and mortar. Restripe parking lot at completion of construction Repair and/or replacement of any and all damage done to parking lot, adjacent property and

landscaping during construction. Seed back all disturbed grass

CAUTION:Hyper sensitivity must be paid to existing infrastructure to include, current electrical, internet, telephone, DATA/wifi, and computer wiring. A breech of any of the above that interrupts/disrupts business will result in a fine of an average day’s sales for each day that the store is without full systems capability. Current average daily sales are $5,691. A detailed review of original construction documents as well as a site visit is encouraged to prevent a disruption.

This agreement is made and entered into by and between the Troutman ABC Board, herein “Board”, and ______________________________________, herein “Contractor” for services hereinafter described for the Troutman ABC Board. This contract is for a 1,760 square foot warehouse extension, herein “Project.”

WITNESSETH

That for and in consideration of the mutual promises and conditions set forth below, the board and contractor agree:

1. Duties of the Contractor: The Contractor agrees to perform those duties described in the Request for Proposals, herein “RFP,” attached hereto and incorporated herein by reference.

2. Duties of the Board: The Board shall pay for the Contractor’s services as set forth in the RFP.

3. Fee Schedule and Maximum Sum: Contract amount not to exceed ___________________________. Payment shall be made as outlined in the RFP.

4. Billing and Payment: The Contractor shall submit an invoice to the Board for work performed under the terms of the RFP. The Contractor shall bill, and the Board shall pay the rates set forth Therein. Payment will be made by the Board within thirty (30) days of receipt of an accurate invoice, approved by the board chairman.

5. Business License: The Contractor shall have a valid contractor’s license with the state of North Carolina and a business license with Iredell County before beginning work.

6. Indemnification and Hold Harmless: The Contractor agrees to indemnify and hold harmless the Troutman ABC Board and its officers, agents and employees from all loss, liability, claims or expense (including reasonable attorneys’ fees) arising from bodily injury, including death or property damage to any person or persons caused in whole or in part by the negligence or misconduct of the Board.

7. Insurance Provisions: The Board requires evidence of Contractor current valid insurance during the duration of the Project and further requires that the Board be named as an additional insured. The required coverage limits are $1,000,000 per occurrence for Comprehensive General Liability and Business Automobile. Workers’ Compensation coverage requirements are $100,000 for both employer’s liability and bodily injury by disease for each employee and $500,000 for the disease policy limit.

8. Non-Discrimination: The Contractor shall administer all functions without discrimination because of race, creed, sex, national origin, age, economic status, sexual orientation, gender identity or gender expression.

9. Federal and State Legal Compliance: The Contractor must be in full compliance with all federal and state laws, including those on immigration.

10. Amendment: This Agreement may be amended in writing by mutual agreement of the Board and the Contractor.

11. Interpretation: This Agreement shall be construed and enforced under the laws of North Carolina. In the event of any dispute between the parties, venue is properly laid in Iredell County, North Carolina for any state court action and in the Western District of North Carolina for any federal court action.

12. Preference: In the event that the terms of the RFP are not consistent with terms of this Contract, this Contract shall have preference; provided that where either the RFP or the Contract establish higher standards for performance by either parties, the higher standard, wherever located, shall apply.

13. Severability: The parties intend and agree that if any provision of this contract or any portion thereof shall be held to be void or otherwise unenforceable, all other portions of this Contract shall remain in full force and effect.

14. Assignment: This Agreement shall not be assigned without the prior written consent of the parties.

15. Entire Agreement: This Agreement shall constitute the entire agreement of the parties and no other warranties, inducements, considerations, promises, or interpretations shall be implied or impressed upon this Agreement that are not expressly addressed herein. All prior agreements, understandings and discussions are hereby superseded by this Agreement.

16. Term: This Agreement, unless amended as provided herein, shall be in effect until _______________.

This Contract is between the Troutman ABC Board and _______________________for the Troutman ABC Store warehouse extension of ~1,760 Square Feet.
