Schedule an Appointment

The U.S. now offers 5 year, multiple entry visas to Saudi students studying in the U.S. Please apply early to avoid missing the beginning of classes! While obtaining a visa can be a lengthy process, the U.S. Mission in Saudi Arabia currently approves the vast majority of completed student applications submitted by Saudi Arabian nationals, and is working hard to make sure that students can make it on time to their programs.

Application Process: the following information was copied from http://riyadh.usembassy.gov/visas/student-visas-f1-f2.html

1. Get a visa photo

Photos must be a .jpg between 600x600 and 1200x1200 pixels

Photos must be less than 240kb

Photos must not be digitally altered

You must bring a 5x5cm photo to the embassy

2. Complete the online application

DS-160 visa application form found at https://ceac.state.gov/genniv/

3. Schedule an appointment with Visapoint

When you obtain admission to a school in the U.S. you will also get a Certificate of Eligibility for Nonimmigrant Student Status (I-20) form.

The date circled in red is the start date of your program. You must enter the United States within 30 days before this date. You may not enter before the date was passed. We do not print visas for entry earlier than 120 days before this date. If your visa is not ready in time to travel before this date, you will need a new I-20 or an extension letter from your school.

Spouses and children under 21 are eligible to apply for F2 visas. Each individual will need an I-20 with their name on it.

5. Pay application fees

The visa application fee for F1 and F2 visas is SR608. This nonrefundable fee must be paid BEFORE you come to your interview.

You may pay the application fee at any branch of SAMBA bank in Saudi Arabia. If you have a SAMBA account, you can pay online. You must bring the receipt with you to the visa interview.

Students must also pay the $200 SEVIS receipt. This can be paid online at www.fmjfee.com. All visas are returned via FedEx. You must bring cash to pay for a FedEx envelope, regardless of where you live. Address in Riyadh SR65Address outside Riyadh SR125

6. Go for the interview

On the day of the interview, only applicants with valid appointments are allowed to enter. You may enter up to thirty minutes before the time listed on your confirmation sheet. Only a legal guardian may accompany you into the waiting room, other friends and relatives will not be able to enter.

After your interview, you will be told approximately how long it will take to process and print your visa. Please remember that this is only an estimate and wait times vary, with many visas taking up to three months to process.

If you need your passport for travel in the near future, we recommend that you take back your passport at the end of the interview.

After reading the previous information each student needs a laptop, access the internet, complete the DS-160 application, schedule an appointment, and pay the fee.

Sequence of using a taxiHailing a taxi on the street:

1. Stand on the edge of the street (don’t stand too far out into the street).2. Raise your hand as high as you can.3. Gently wave it up and down to indicate you need a ride.4. When a taxi pulls up, get in carefully.5. Get a back sit.6. Tell the driver where you need to go.7. Have the money ready to pay a fee (make sure you have the proper cash on hand, or else the

In some cities in America taxi cabs are yellow, in others they may be white or black. Occupied cabs have their top lights switched off. Taxis that that are not on duty have their “Off-Duty” sign lit. A taxi can carry up to four passengers with a single fare covering everyone on board. To take a taxi on the street stand by the edge of the street. Make sure not to stand too far out in the street or you risk getting hit by oncoming traffic, and don’t be in the way of other pedestrians. Raise your hand as high as you can, gently wave it up and down to indicate you need help. If a taxi pulls up, get in carefully and tell the driver where you need to go. Have an idea of your destination before you enter the cab, and don’t be vague. Make sure your driver understands exactly where you want to go before you start your ride. When the cab driver accepts you as a passenger the meter starts ticking at approximately $2.50. The fare increases 40 cents after each 267 meters (292 yards) or every 120 seconds of waiting time. There is an additional 50-cent charge between 8pm and 6pm, and $1 charge between 4pm and 8pm on weekdays. Make sure you have the proper cash on hand to pay the taxi fare. Public TransportationPublic transportation can be tricky. In bigger cities, most transportation will accept credit cards; however, in smaller cities they might pose a problem. For this reason, it is a good idea to have cash. It is a good idea to have smaller size bills available because larger bills might not be accepted in certain areas if for example the fair is one dollar and you are trying to pay with a twenty, fifty, or a hundred dollar bill. If you will be using public transportation frequently, you can purchase monthly passes that are more economical.

TIP SHEET: STEPS PRIOR TO MOVING OUT

When your lease has expired and you are ready to move out of your apartment or house, there are a few steps you should take to ensure legal problems do not arise when you are gone.

Give and Receive Proper NoticeThe best practice is to give your landlord 30 days’ notice that you plan to terminate the lease (California Civil Code section 1946.1).   Make sure you DATE the notice and make a copy for yourself. Send this notice to the same place as your rent.

Walkthrough and Final Inspection

• Similar to the initial inspection, the final inspection is crucial.• The landlord is supposed to notify you in writing that the tenant has a

right to the walkthrough with landlord, within a reasonable time after either party has provided notice of termination (Civil Code 1950.5). If your landlord doesn’t do this, make sure to request it!

• The walk-through can be scheduled no earlier than 2 weeks before the termination date. Try to do it as early as possible before you move out, to ensure ample time for any repairs or cleaning that you may need to do in order to receive the return of your full deposit.

• Take photographs!Steps to Getting your Security Deposit Back

Step 1: Provide a forwarding address for your landlord to return your security deposit to you.Step 2: Know the legal deductions a landlord can make.

• Proper deductions include unpaid rent, actual cleaning costs (if the dwelling is not in the same state of cleanliness as when the tenant moved in), and repairs beyond normal wear and tear (such as holes in walls).

• Improper deductions include repair of normal wear and tear (like minor nicks or marks on walls) and general cleaning, if the premises are as

clean as at the beginning of the lease.Step 3: When you get your deposit in the mail, make sure you have received an itemized statement of deductions, so you know exactly how much was deducted and for what reasons.  You are entitled to receipts if deposit deductions are more than $125. (Civil Code Section 1950.5)

If your landlord does NOT return your security deposit to you within 21 days, or has made improper deductions, you can sue in Small Claims Court.  Civil Code Section 1950 allows a tenant to make a claim for a penalty equal to twice the amount of the withheld security deposit if the landlord withheld it in bad faith.  Consult Student Legal Services for assistance, and see http://sls.berkeley.edu for a sample security deposit demand letter that you should send before filing a Small Claims action.

For rent-controlled units in Berkeley, the Rent Board offers a petition process for the recovery of a security deposit from the landlord that is simpler and faster than Small Claims Court.  You will need to file a "Tenant Petition for Individual Rent Adjustment."  See the Rent Board Web site (http://www.ci.berkeley.ca.us/ContentDisplay.aspx?id=9192#TENANT) for more details.

Roommates and Security DepositsWhen two or more cotenants share a rental unit, the landlord is not required to return the security deposit until all of the original tenants have left. Roommates should sign an agreement in advance that governs how the security deposit will be handled if one tenant moves out before the other(s).

TIP SHEET: BEFORE MOVING IN

For apartment searching advice, check out the Cal Rentals “House Hunting” Videos: http://www.housing.berkeley.edu/calrentals/househunting.html. Once you find a place to live, you will go through some or all of the steps below before you move in.

Step 1: "Holding" DepositOnce you find a potential apartment, the landlord may request a “holding deposit” to ensure the landlord will not rent the unit to anyone else.  Before paying this fee, find out how and when it will be applied and what will happen if you change your mind. If the landlord rents the apartment to someone else, you are entitled to your holding deposit and any other costs that you have incurred.

Step 2: Credit Check/Application FeeAs of early 2009, a landlord can charge you up to $42.00 to check your references and credit, which is an amount based on the increase in California’s Consumer Price Index since January 1, 1998.  (California Civil Code Section 1950.6 and California Dept. of Industrial Relations CPI data)

Step 3: Security DepositOnce you decide to rent a unit, the landlord will probably require a security deposit. According to Civil Code Section 1950.5, a security deposit cannot be deemed “non-refundable.” Other important information to know about your security deposit:

• Amount. The security deposit cannot be more than two months’ rent for unfurnished premises, or three months’ rent for furnished premises. The landlord may also charge up to an additional ½ of one month’s rent if the tenant has a waterbed.

• How it can be used.  According to Civil Code Section 1950.5, the landlord can only use the security deposit to pay for:

◦ Unpaid rent

of cleanliness as when the tenant moved inReplacement of personal property (if provided in the lease)

Step 4: The Rental Agreement/LeaseThe rental agreement is crucial, as it specifies all the terms of agreement between you and the landlord. Some important things to look for in the rental agreement/lease include, but are not limited to:

• Duration and Term of Lease: how long and whether it is periodic (month-to-month) or fixed (e.g. 12 months). This is extremely important, because the tenant is contractually obligated to pay rent for the entire lease term even when the tenant leaves early (subject to certain limitations — see below).

• Rent: monthly amount, whether any rent has been prepaid, when the rent is due each month, to whom it is to be paid, where it is to be paid, and any late fees.

• Security Deposit: make sure the amount you pay is specified in the lease.

• Number of people allowed to live in the rental unit• Promises by the landlord for repairs or improvements, and when they

will be done.• Whether pets are allowed• Subleasing and assignment rights of the tenant• Who pays the utilities (garbage, water, gas, electricity, cable, etc.)READ your agreement CAREFULLY. If you do not agree with any part of the agreement, make sure to negotiate it with the landlord BEFORE signing the agreement.  If you don’t comply with the terms of the agreement, the landlord may have the right to evict you.

Does it have to be in writing?If your lease term is shorter than one year, it does not legally have to be in writing. An oral rental agreement is still a binding agreement between you and the landlord, but if problems arise, there is no written proof of the terms. That’s why it’s better to have a written agreement.

Step 5: RoommatesWhen signing the rental agreement, it is important to plan ahead for the unexpected, especially when it comes to roommate

Unlawful DiscriminationA landlord cannot refuse to rent to a tenant, or engage in any other type of discrimination, on the basis of group characteristics specified by law, which include: race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income, disability, medical condition, and personal characteristics. If you feel you are a victim of unlawful discrimination, act quickly! There are a number of resources available to you, including:

LIVING IN THE PREMISES

Once you’ve found a rental unit and signed an agreement, here’s what you can do to avoid problems during your tenancy:

Move-In Checklist

• When you move in, print an inventory checklist. You can find a copy of one on the Cal Rentals website (https://calrentals.housing.berkeley.edu/flyers/Inventory_Checklist.pdf)

• Conduct a joint walk-through of the unit with your landlord, using the checklist as a guide.

• It is extremely important to take note of any repairs or issues right away and TAKE PICTURES to avoid problems that may arise when you move out - make sure the "date stamp" function on your camera is turned on.

• If there are any needed repairs, identify them on the checklist, keep a copy of the checklist, and also mail a copy of it to your landlord by certified mail for an additional record of the pre-existing problems at

your unit.RentPaying Rent. The amount, due date of your rent, and name of the party the rent must be made out to should be specified in your rental agreement.  You cannot be required to pay in cash unless you have submitted a “dishonored check.”  If you do pay in cash, get a receipt.

Rent Increases. The landlord may be able to increase your rent, subject to these rules:

• Rent CANNOT be raised during your initial fixed lease term unless the rental agreement specifies the increases.

• If specified in the agreement, or if the initial lease term has ended and is now a month-to-month lease, the landlord must give you at least 30 days’ notice prior to a rent increase if it is 10% or less.

• An increase of more than 10% requires 60 days’ notice in writing.• The landlord can only receive the higher rent for the remainder of the time

you live there (i.e. no retroactive collection of increased rent).Repairs and MaintenanceDuring the lease term, both the landlord and the tenant have maintenance responsibilities.  The landlord is responsible for “habitability”. This means that the landlord is generally responsible for all repairs and maintenance that is required to keep the apartment livable, which include:

• Effective weather protection including broken windows and doors,• Working plumbing, gas and heating facilities• A functioning electrical system• Clean and sanitary premises• Adequate trash receptacles in good repair and floors• Stairways and railings in good repair• Working toilet, wash basin and bathtub/shower• Working smoke detectors

Note: If you have contacted your landlord about certain repairs that fall under the warranty of habitability, and s/he has not made those repairs, specific remedies may be available, such as repairing the problem yourself and deducting the cost from rent, or terminating the lease early without penalty. kitchen)SubleasesWhen subleasing, a tenant brings in a subtenant, but is still obligated under the lease. The original tenant is now in the “middle,” acting as a landlord to the subtenant, but still a tenant under the original lease and responsible for fulfilling all tenant obligations under the original lease.

When subleasing, make sure to:

• Discuss your plans with your landlord in advance, EVEN IF your rental agreement does not directly prohibit subleasing.  Remember, unauthorized subletting CAN lead to eviction.

• Understand that the subtenant has only the same rights and responsibilities as you do (for example, month to month rent or pet policy).

• Communicate with the subtenant and discuss the terms of the agreement, as the subtenant is responsible to YOU, not the landlord.

• Ask landlord to approve the sublease by signing under a line titled “Approved by Landlord” at the end of the document.

• To ensure communication and avoid future disputes, put the terms in a written sublease agreement.  The Student Legal Services Web page has a sample form (http://sls.berkeley.edu).

Renewing a LeaseIf your lease is about to end and you would like to continue living there, tell your landlord BEFORE the end of the term. If you do nothing, the lease automatically becomes a month-to-month periodic tenancy (Civil Code Section 1945), but the landlord can potentially terminate upon 30 days’ notice (although this termination right of the landlord is limited in some cities - see below).  If you have a “Fixed term” lease, it can only be renewed automatically by the landlord for the same duration (e.g. a full additional year) if the automatic renewal provision is included in at least 8-point boldface type immediately above the space where you sign the lease (Civil Code Section 1945.5).

Termination/Eviction by LandlordIf your lease is month-to-month, the Landlord can typically terminate by simply giving you 30 days notice and usually doesn’t have to state any reason. However, ”just cause” for termination is required in some California cities, including Berkeley, Oakland and San Francisco.  Consult with SLS if you have questions about whether a termination has “just cause.”

In special cases, the landlord may seek to evict upon three days’ notice if the tenant:

• Failed to pay rent (the tenant can “cure” by paying rent)• Violated provision of lease (the tenant can “cure” by correcting the

violation)• Materially damaged the rental property• Substantially interfered with other tenants• Used the rental property for an illegal purpose

What to do if you receive notice of eviction or terminationFor a 30-day notice (assuming “just cause” is not required, or has been provided): Either make arrangements to move out or, if you want to continue to occupy the rental unit, ask the landlord what you can do to make that possible. IF the landlord does agree to let you stay, make sure this agreement is in writing! Otherwise, you must move out. Make sure you do this within the time permitted; otherwise, the landlord can file an unlawful detainer lawsuit to evict you. Seek outside help or consult with SLS if this is the case.

For a 3-day notice: If your notice is a demand to pay rent, it should specify the amount of rent you owe. You must either: pay the rent that is due, vacate within THREE days, or dispute the landlord’s unlawful detainer action in court if the amount of rent demanded is incorrect.  If your 3-day notice is for something else, the notice should indicate whether you can correct the problem and remain in the unit.  If this IS the case and you want to remain in the unit, you must correct the problem before the third day.  If you can’t, you must either move out or dispute the landlord’s unlawful detainer action.Note: Even if your notice does not indicate whether you

can correct the problem, you can try to convince your landlord of this solution.

If you feel that your landlord has improperly given you any termination notice, consult with SLS or another lawyer to evaluate your options.

General Advice for Dealing With Your LandlordCommunication. Make sure to try to talk to your landlord often to avoid any problems or to resolve any problems before seeking a legal remedy. Both you and the landlord have the duty to deal with one another “fairly and in good faith.”  If talking with your landlord doesn’t work, there are many services available to help you, such as:

• Local Housing Code Enforcement Agency (In Berkeley: Housing Code Enforcement Program: http://www.cityofberkeley.info/ContentDisplay.aspx?id=4152)

• City or Council Rent Control Board (In Berkeley: Rent Stabilization Board: http://www.ci.berkeley.ca.us/DepartmentHome.aspx?id=9546)

• Student Legal Services (see “Community Legal Resources” tip sheet on particularly the “Landlord-Tenant/Housing Rights” section)

• Some housing agencies also offer mediation services. It is always better to try this method before a lawsuit.

TIP SHEET: TERMINATING A LEASE OR RENTAL AGREEMENT

A lease or rental agreement obligates you to pay rent for the entire period of the agreement, even if you move out early: for example, if you sign a 12-month lease that starts on August 15, but you need to move on June 1 of the following year, you’ll be required to pay rent through mid-August unless you make an alternative arrangement such as one of those described below.

TERMINATING BEFORE THE END OF THE LEASE TERM If you intend to move out early, it is best to contact the landlord as soon as possible to discuss potential alternatives to your continuing to pay rent when you will not be there.  The landlord may have other tenants interested in the premises, and might be happy to replace someone whose lease ends fairly soon with someone who will sign a 12-month lease.

The landlord has a legal obligation under California Civil Code Section 1951.2 to make a reasonable effort to find a replacement tenant.  This requirement is pretty easy to meet: if the landlord puts a “For Rent” sign on the building or posts an ad on craigslist, that’s probably enough.  If you know you will move out early, one way to protect yourself is to seek out potential replacement tenants.  Compile a list of names and include notes that indicate

how they are responsible and able to pay rent.  Provide this list to the landlord and keep a copy for yourself.

If you move out early, the landlord can keep your security deposit and apply it against any lost rent, including the difference between your rent and the new tenant’s rent if the landlord is unable to rent the premises for the same amount.  The landlord can also sue you (most likely in small claims court) for any remaining amount that you may owe under the lease.  In cities like Berkeley, where there is high demand for rentals, the likelihood that you will be liable for such a deficiency is probably low.

TERMINATING AT THE END OF THE LEASE TERMTypically, if you do not provide a notice of termination at the end of a 12-month lease term, your lease will automatically convert to a month-to-month tenancy that you can terminate at any time upon 30 days’ notice.

When you remain in your apartment until the end of the lease term, or if the original lease term has already ended and you are renting month-to-month, it is a good idea to give your landlord 30 days’ written notice of termination. 

*Note: Some leases may state that the lease will renew automatically if the tenant stays past the end of the lease term.  In the case of a one-year lease, staying for an extra day beyond the one-year term would mean the lease had been renewed for an additional 12 months.  To be enforceable, a provision like this must be in at least eight-point bold type, right above the tenant signature line on the lease.  If the renewal provision does not meet these requirements, you may legally disregard it under Civil

Code Section 1945.5.

ASSIGNING YOUR LEASE

If you want to move out before the end of the lease term, one option is to assign your lease to someone else.  This transfers the obligations of the tenant under the lease from you to another person, and requires the approval of the landlord. 

SUBLEASING

Another option is to sublease your apartment during the period you won’t be living there.  Under a sublease, you rent your premises to someone else for some portion of your lease term and become the “landlord” of your subtenant.  As a “sublandlord,” you can enforce your subtenant’s obligation to pay you rent under the sublease, but you also remain responsible for all rent due to the landlord even if the subtenant does not pay.  A sublease usually requires the landlord’s approval, even though it does not release you from your responsibility to pay rent and meet the other obligations under the lease.

IMPLIED WARRANTY OF HABITABILITY

Under certain circumstances, you may be able to move out of your residence before the end of the lease term without any further financial obligation to the landlord.  These tend to be more extreme situations where the premises are so unsafe or damaged that they are legally “uninhabitable.”  A rental may be legally uninhabitable if it does not have:

• Effective weather protection (including unbroken windows and

doors)• Plumbing and heating facilities that are maintained in good

working order• Electrical lighting maintained in good working condition• Hot and cold running water that is connected to an approved

sewage disposal system• Floors, stairways, and railings that are in good repairA rental may also be deemed unfit for occupation if it has conditions such as the following that endanger you or the public:

• Lack of working toilet or bathtub/shower, both in a room that is ventilated and private

• Infestation of insects, vermin, or rodents as determined by a health officer

• Structural hazards such as improper floor, wall, ceiling, or roof supports

• Lack of safe fire or emergency exits that lead to a street or hallway

If you’re living in a residence that is legally uninhabitable, you may have the right to move out and/or seek a reduction in rent (including retroactive reductions) covering the period that the problem was not corrected.  You should document the problem by taking pictures and keeping notes, and notify your landlord of the problem in writing.  If the landlord fails to respond, contact the code enforcement office for the city where you live.  In Berkeley, there is a Rental Housing Safety Program that enables residents to request an inspection (call 510-981-5445). 

WHAT IF ONE ROOMMATE IN A MULTI-TENANT LEASE MOVES OUT?

Sometimes, a roommate situation doesn’t turn out as expected, and one roommate leaves before the lease term has ended (to

plan ahead for resolving disputes that may arise with roommates, please see our Form Roommate Agreement [2]).  Usually, the departing roommate will still have legal obligations under the lease, and remaining roommate(s) may have potential legal claims against the roommate who moves out.

When you sign a lease with more than one roommate, each of you is “jointly and severally” liable under the contract, meaning that the Landlord can seek to enforce the lease against any one of the tenants individually (for example, by demanding full payment of rent from just one tenant).  This doesn’t typically happen when everything is going smoothly, but joint and several liability comes into play when one roommate moves out of the premises on short notice, and fails to find a replacement tenant to fulfill his/her responsibility to pay the rent.

The roommate who moves out without a replacement is still responsible for his or her share of the rent for the remainder of the lease term, but the Landlord doesn’t have to demand it from the now-gone roommate, and will typically expect the remaining tenants to pay the entire rent.  If the remaining roommate(s) don’t pay the full rent due, the Landlord can potentially evict the remaining roommate(s), first by delivering a 3-day notice to pay rent or quit, and then by filing an action for unlawful detainer in Superior Court.

In most cases, the remaining tenants will have the legal right to seek reimbursement from the departing tenant for his/her share of rent, provided that the remaining tenants also try to “mitigate” their losses by looking for a replacement roommate.  However, actually collecting any money from the departing tenant can be very

impractical, especially if the relationship between tenants has become strained. Often, the most viable remedy to recover the money owed is Small Claims Court.

If you have a roommate who has moved out before the end of a lease term and refuses to continue paying rent, consider these strategies:

Find a Replacement Roommate:  Whenever feasible, this is the simplest and most complete way to deal with the problem.  A new tenant who takes the place of the departing tenant can cover the rent obligation, leaving no one with extra out-of-pocket expenses.  Ideally, a departing tenant will find a replacement that is acceptable to the remaining tenant(s) before moving out, and if the landlord consents, the departing tenant can assign his/her interest in the lease to the new tenant.  Usually, the landlord’s consent is required to bring in a new tenant, but shouldn’t be too difficult since the landlord wants to ensure that the full rent is paid. Talk to the Landlord/Property Manager:  If a roommate moves out unexpectedly, explain the situation to the landlord or property manager, and ask whether they can offer a reduction in the rent, even if only temporary, while you find a replacement.  The landlord does not have to agree to this, but may consider it in the interest of keeping good tenants, ensuring payment of rent, and avoiding the hassle of a potential eviction.

Offer a Discount:  If the remaining tenant(s) are having trouble finding a replacement, they might consider offering the additional space at a rent lower than what the departing

tenant was paying.  This is not ideal for the remaining tenants, because they will have to collect the difference from the previous tenant or pay it themselves (unless the landlord agrees to a rent reduction) - but it can reduce the initial out-of-pocket losses of the remaining tenants.  For example, if the previous tenant was paying $700/month, it may be better to collect $500 per month from a new tenant than to spend two months finding a replacement while the spot remains empty.]
