Rep. Gomez said that, “I thought long and hard about it. Voting yes gave me the most peace. I like knowing that there is capital punishment for the evil ones.”

The congresswoman, who is known to be prayerful, admits that a recent brush with these “evil ones” helped her make up her mind. “Admittedly, minus the Espinido episode, maybe I can be swayed to vote otherwise, but given that it happened, I like knowing there is capital punish-ment for the evil ones.”

Rep. Gomez is referring to the controversial cop, Ch. Insp. Juvie R. Espinido, who handled the Es-pinosa drug syndicate in Albuera. Espinido manipulated the slain Albuera Mayor Rolando Espinosa to implicate her husband, Ormoc Mayor Richard Gomez, in the drug trade here. With the strong support of the city’s local government unit, the event converged hundreds of women at the Superdome, com-ing from both private and public sector and from various women’s

organizations to celebrate their rights and empowerment.

One of the highlights of the congress was the ceremonial sign-ing of the revised Gender and De-velopment (GAD) Code of the city by Mayor Richard Gomez, which was passed and approved by the 14th Sangguniang Panlungsod in January. Originally authored by SP member Leah Doris Villar in 2013, the city council revisited the ordinance and added more provisions to further strengthen women empowerment in the city, just in time for the national

women’s month. The revised GAD code was

authored by SP member No-lito Quilang, co-sponsored by SP member Vincent Rama, chair-man of the Committee on Social Welfare.

DAR Secretary bats for 2-year suspension of land conversion

Coke asks for TRO vs. regulation of HFCSORMOC CITY – The lo-cal sugar industry and soft drink giant Coca-Cola Bottling Philippines, Inc. – FEMSA, are at odds again over High Fructose Corn Syrup (HFCS), after Coke sued for a Temporary Re-straining Order (TRO) against the implementa-tion of Sugar Order No. 3 regulating the importation of the sweetener.

However, the Court, which heard the petition and SRA’s answer to it, has not issued a TRO to date. Sugar Order No. 3 took effect on Friday, March 10.

Hermenegildo R. Se-rafica, board director rep-resenting sugar planters of the Sugar Regulatory Administration (SRA), said that Coke filed for a TRO with prayer for the issuance of a permanent injunction on March 3, 2017, the very same day SRA received a letter from them asking for a reconsideration of the sugar order.

Respondents to the pe-tition are the SRA, includ-ing chairman Atty. Anna Rosario V. Paner and Atty. Roland B. Beltran, sugar millers’ representative; Ag-riculture Secretary Manny Piñol and Bureau of Cus-toms commissioner Nica-nor Faeldon.

Serafica slammed Coke for the underhand tactic, writing SRA to reconsider their order, yet on the same day files a court action. The SRA board had calendared Coke’s asking for reconsid-eration on March 9.

Serafica added he also has reliable sources saying that on the day Sugar Order 3 was passed, the beverage companies ordered huge volumes of HFCS. “As we speak, large tankers loaded with HFCS from China are on their way to the coun-try,” Serafica said.

It was learned that Coke filed the case at the

Bulwagan ng Katarungan in Quezon City, and had been raffled to the Court of Judge Marilou Runes-Tamang. A preliminary hearing was immediately done on Tues-day, March 9, and the judge gave the SRA two days to file their written opposition to the petition for TRO.

In their undated letter to the SRA asking for recon-sideration, Coke-FEMSA claims that Sugar Order 3 is anti-business.

The soft drink com-pany argued that Philippine sugar prices are 30 percent higher than world market pricing, “impacting not only our industry but Fili-pino consumers as well.”

Coke also said that Fili-pino consumers pay P 60.00 per kilo for sugar, which is only around 33-37 pesos in India and Thailand. The domestic supply of sugar cannot also fully supply the actual sugar demand of the country, because of the decline in production.

They also played the economic card, saying that “the beverage industry di-rectly employs over 70,000 associates and partners with over 1 million sari-

sari store owners”, and that they are only getting a 2-5% profit margin from their op-erations because they are “a high volume but low mar-gin business because 80% of consumers come from the C, D and E economic segment.”

For his part, Serafica said Sugar Order 3 does not ban the entry of HFCS to the country. “It only regulates the volume of importa-tion,” he said, because they would also want companies like Coke to patronize local sugar.

Sugar planters blame the unregulated entry of HFCS into the country for the decrease of farm gate price of sugar, and Sugar Order No. 3 was hailed as a milestone for the sugar industry when it was ap-proved on February 17, 2017, in an SRA board meet-ing held here.

Records obtained from the BOC show that for the year 2015, Coke import-ed 169,521.38 metric tons (MT) of HFCS, equivalent to 3,390,427.65 sacks of raw sugar. In 2016, Coke imported 254,863 MT of HFCS, or the equivalent of

5,097,260.00 sacks of raw sugar. The difference alone, which is 1,706,832.40 bags of raw sugar, could have helped the sugar industry had it been bought locally, said Serafica.

He also debunked the claim that Philippine sugar prices are higher than world market prices. Serafica said that currently, raw sugar is selling at P 28.79 per kilo at the mill level, and P 34.00 wholesale. Refined sugar, on the other hand, sells at P 44.00 wholesale and P 56.00 retail.

Serafica also said that it is also alarming that HFCS is considered an unhealthy alternative to sugarcane sugar. Made through a chemical process from squeezed corn stalks, Se-rafica said, “we don’t even know what chemicals they put in to produce HFCS.”

HFCS use has also been directly linked to rising obesity and diabetes rates by some medical studies, he pointed out, quoting the ar-ticle “5 Reasons High Fruc-tose Corn Sugar Will Kill You” written by Dr. Mark Wyman, medical director at the Cleveland Clinic’s Cen-ter for Functional Medicine.

Meanwhile, sugar-pro-ducing parts of the country are gearing up for another fight with beverage com-panies. Here in Ormoc, the city council on Tuesday, March 7, passed a resolu-tion “manifesting strong support” for Sugar Order 3 and “urging concerned bodies for the strict and immediate implementation thereof.”

Similar resolutions are expected to pass over the week from other areas like Western Visayas and Tarlac Province.

This is not the first time that the local sugar industry and Coke has had a dispute over HFCS importation. In 2011, the Bacolod-based Sugar Watch group initi-ated a call to boycott Coke products for importing pre-mix sugar and HFCS. By Lalaine M. Jimenea

The mayor even wanted to give the team a pair of shoes each, like he did to EVRAA athletes, but unfortunately his office was informed late about the games and the required procurement and supply procedure could not be processed on time.

T A G B I L A R A N C I T Y (PNA) – For food security and farmers protection, Agrarian Reform Secre-tary Rafael “Ka Paeng” Mariano reinforced the stand of his department for a two-year freeze of land conversion in the country.

He said he hoped Presi-dent Rodrigo Roa Duterte (PRRD) signs the proposed Executive Order declaring moratorium of land conver-sion in the country despite some opposition mostly from land developers.

This concern is one of the highlights of the Agrar-ian Reform Beneficiaries Summit 2017 held here where Mariano was the guest speaker along with PARPO II Grace Fua, DAR regional director Alejandro Otacan and agrarian reform communities in the prov-ince attending.

Mariano said once the EO is signed, a task force would be formed to the status of the land-use conversion in the country and the DAR would call upon the support of other Comprehensive Agrarian Reform Program (Carp)-implementing agencies.

DAR says, “The rel-evant provisions in the Phil-ippine Constitution give a foundation which specifi-cally addresses the issue of industrialization based on sound agricultural develop-ment and agrarian reform while ensuring the optimal use of the nation’s limited land resources (Article XII, Sec. II, The 1987 Constitu-tion of the Philippines)”

The provision is quali-fied by the declaration that the use of property bears a social function, implying maximum productivity for all lands (Article III, Sec-tions I, I5 and I6, The 1987 Cosntitution.

“Land use conversion is allowed because of the following realities: (1) Re-quirements of people for housing to respond the growing housing needs of the people; (2) Industrial-ization. Some agricultural lands need to be developed for non-agricultural pur-poses as not to hinder in-dustrialization in urban and rural areas; (3) Agricultural lands already devoted to non-agricultural uses prior to affectivity of CARL but are classified as agricultural lands; (4) Land Resources maximization. Rabies Awareness Month

March is Rabies Awareness Month. Ra-bies is a disease with almost 0% survival rate. Usually, when symptoms appear, the rabies virus has reached the brain and death is imminent. All patients diagnosed with rabies will eventually die.

In 2015, the Department of Health not-ed that there were 432,458 animal bite cases and there were 226 reported deaths due to rabies. It is lower compared to 257 deaths reported in 2010. Rabies is considered to be a neglected disease. It is 100% fatal yet it is 100% preventable. It is not among the most common causes of death but it is a significant health concern. This is because it is one of the most sudden and devastating diseases which is responsible for about 200 to 300 deaths in the Philippines annually.

The DOH plans to eliminate rabies by 2020. Their strategy includes pre and post exposure vaccination to certain groups at risk, health education and advocacy, train-ing and capability building for health work-ers and the establishment of more animal bite centers nationwide.

Rabies is a zoonotic disease. It means it is being transmitted from animals to man. The virus is usually transmitted through animal bites – by rabies-infected dogs, cats, rats and bats. Usually, rabid dogs die first before the bitten person dies. A rabid dog usually exhibits hyper-salivation, hyper-activity and irritability; we call it “iro na buang”. These animals have the tendency to bite anyone or any animal along their path.

In the Philippines, no one has survived of rabies infection. In human infection, from the day of the animal bite, it takes 20-90 days (incubation period) before symptoms become prominent. Initial symptoms include fever, weakness, loss of appetite, dizziness, vomiting, pain and/or itchiness at the site of the bite. After a few days, symptoms indicating brain involvement are manifested by hyperac-tivity, bizarre behavior and presence of hallucinations. It will then be followed by frequent salivation, hydrophobia or fear of water (refuses to take a bath, even drink-ing water), aerophobia or anxiety or fear of moving air (fanning or air from electric fan) and seizures. If these symptoms are manifested, death is imminent. Doctors can only give supportive care to patients which includes giving of IV fluids, administering of anti-seizure medications, confining the patient in a dim room, with no moving air

and no noise. Persons who are bitten by pets must

thoroughly wash the site of the bite with soap and water for 5-10 minutes. Avoid putting vinegar, nor sucking the wound. One must see a doctor so that appropri-ate anti-rabies vaccines can be given (at the recommended interval and number of doses, if indicated). If the bite is inflicted by a vaccinated and domesticated dog, the dog must be observed for 10 days, noting that the first symptoms of rabies in humans appear in more than 2 weeks after the bite. If the dog survives after 10 days of obser-vation, the animal bite is most likely “non-rabid”. However, if the dog dies before 10 days, the victim must be vaccinated with rabies vaccines. This is why the dog must not be killed, but instead be confined for observation. But, if the victim can afford rabies vaccination which can be expensive, up to 20,000 pesos depending on the dose (the dose is dependent of the weight; so the heavier the victim, the more vaccines he/she needs). It is very important to report the animal bite incidents to the local ani-mal bite centers which tally the cases, and provide rabies vaccine to victims if stocks are available. There are about 480 animal bite centers nationwide.

Eighty percent (80%) of dog bites occur in the home. The only way rabies can be prevented is through the routine vaccina-tion of pets, and it is always wise to consult our friendly veterinarians; coupled with ‘responsible pet ownership.’ Immunizing our pets will not only protect our neigh-bors, both ourselves and the members of our family from rabies. Several cities and towns have passed ordinances allowing the impounding of stray dogs and strictly penalizing dog owners who fail to keep their dogs within their homes. Those dogs roaming around the neighborhood are likely to be bitten by rabid dogs, thus, can also transmit the rabies virus. In this light, rabies prevention starts with responsible pet ownership. And if one is bitten by either a pet or stray animal, it should not be ignored. One should immediately seek consultation in the nearest animal bite cen-ter for proper management and treatment.

IT CERTAINLY would seem so, if we have to consider the tone of the exchanges of ideas, opinions and views in the media today—especially the American media. It’s amazing that people who flaunt their being tolerant, broad-minded, politically correct, etc. to the public, are throwing verbal barbs and inflammatory words to those who may have different or conflict-ing views.

There’s a lot of toxic air around nowa-days, and this should be a great challenge for us. We can always disagree with the oth-ers in many issues, but these disagreements are no excuse for us to indulge in seething and prolonged anger, if not bursting hatred.

Yes, we are free to express our views, but let’s not curtail or undermine the same freedom that others also have to express their views either, no matter how lowly we consider their views to be.

We should expect a great variety of opinions and positions, especially today when the world is growing in sophistica-tion. But this variety that can include not only different but also conflicting views should occasion in us an enrichment of our knowledge of things.

It should not occasion animosity, discord and division. We have to be wary when our reactions to the views of others start to hover around impatience, irritation, irony, sarcasm and the like.

We have to practice a lot of patience and understanding, trying to see where the others are coming from. Patience is our capacity to suffer or to bear, and in this life, we cannot help but suffer and bear the burden of the others.

We have to learn how to discipline our emotions and polish our temper. We should refrain from immediately answering back when we feel provoked.

We have to see to it that our heart is full of goodness and compassion, because, as the gospel has told us, “out of the abun-dance of the heart the mouth speaks.” (Lk 6, 45) What we have in our heart should only be goodness that is stronger than evil.

Of course, the current problem we have in this field is a call for us to return to God. Without him, we would be at the mercy of our emotions, passions and intellectual powers. We should immediately realize that this situation is dangerous to us.

We all know that if these are not an-chored on God, there is no other way but for them to go wild. What was meant by God to be good for us can turn to be a great evil if used simply by our own designs. This is a basic truth in human and Christian morality.

It does not mean that we would be im-poverishing our public exchanges of views and opinions if we discipline and restrain our emotions, passions and intellectual powers. The contrary is true. When we dis-cipline them, our public discourse would become more purified of unnecessary and confusing elements. It would become more focused on the essentials.

I KNOW that the raging debate of this week would be the death penalty. Here in our parts, there would be buzz about why congress people so-and-so voted for yes, and why some congress-people were absent, why there was only one “no”.

There will also be those indignant and righteous who will invoke the Church in their arguments. Thanks to the internet, the days of ignorance is gone (if you read the net) and not gullible enough to believe fake news hook, line and sinker.

It is interesting to note that as late as 1969, even Vatican City, the seat of Catholicism, had a death penalty. It was only abolished as an ad-vocacy of Pope Paul VI. To quote: “Pope Paul VI removed the capital punishment statute from the “fundamental law” of Vatican City in 1969, along with other adaptations, four years after closing the Second Vatican Council, announc-ing the change only in the August 1969 issue of the Gazette, which is published in Latin. The change came to public attention only in January 1971 after reporters accused Paul VI of hypoc-risy for his criticisms of planned executions in Spain and the Soviet Union.”

Before that, Pope Innocent III viewed capital punishment as a function of the secular govern-ment. The Church also authorized executions of non-believers. To quote: “Pope Innocent III required Peter Waldo and the Waldensians to accept that “secular power can, without mortal sin, exercise judgment of blood, provided that it punishes with justice, not out of hatred, with prudence, not precipitation” as a prerequisite for reconciliation with the church. During the Middle Ages and into the modern period, the Inquisition was authorized by the Holy See to turn over heretics to secular authority for execu-tion, and the Papal States carried out executions for a variety of offences.”

The manner of execution then were burn-ing at the stake, hanging and beheading. In the Philippine version, what is recommended is hanging, electrocution or lethal injection.

There is also this misplaced notion that there is no death penalty anymore in the United States of America. This is not true. 31 states in the US still has the death penalty, only 19 doesn’t. In some states, the death row convicts can choose the manner of their death aside from lethal injection. It can be electrocution in Alabama, Arkansas, Florida, Kentucky, South Carolina, Tennessee and Virginia; gas inhalation in Ari-zona and California; hanging in Washington and even firing squad in Utah.

Belarus in Europe is the last holdout in the cold continent, however, there are also demands for its return especially in countries bugged by terrorists. The demand, however, is limited to citizens corroborating with terrorists and not the radicals. The biggest punishment they can give to the radicals and the radicalized is to prevent them from dying, and thus preventing their ‘martyrdom.’

The seriousness of the drug menace, ex-posed by the Duterte administration (who I think was also taken aback by the number of surrenderers), has made so many people angry.

Early on Duterte’s term, I remember an acquaintance turning up at our door crying. I asked what she was crying about, and she said her son had just admitted to being a meth or shabu addict to her. He wanted help because he was afraid of the Duterte administration. I hope she has found a solution to her problem and that her son has turned a new leaf. I don’t think she is forgiving of the people who had victimized her son.

EVERY NEW YEAR, millions of people make a resolution to exercise. In January, they buy gym memberships, new running shoes and bicycles. By February, those resolutions are often distant memories. As a person who would really rather read than exercise, I can totally relate. But research shows the tremendous amount of benefit that exercise can have.

Regular exercise can lower blood pres-sure, cholesterol, blood sugars and weight. In addition, it lowers your risk of coronary artery disease, heart attacks, strokes and dying. It’s really discouraging that most Americans do not get regular exercise. Also, many who are exercising are not doing it ef-fectively to lower their cardiovascular risk.

What most people want to know is how much and how intensely they should exercise to gain maximum benefit. Here is what we know so far: You should get about 2.5 hours of moderate exercise per week. Moderate exercise means that your breathing quickens, but you aren’t panting for breath. Also, you’re sweating.

Another way to assess this is by mea-suring your heart rate. You can buy heart rate monitors these days for a relatively cheap price. You want to aim for about 50 to 70 percent of maximal predicted heart rate, or MPHR. Your maximal predicted heart rate is determined by your age. The formula is 220 minus your age. So if you are 50 years old, then your MPHR is 170. To determine 50 to 70 percent of MPHR, you have to multiply by 0.5 (50 percent of heart rate) to 0.7 (70 percent of heart rate). Your heart rate should be between 85 and 119 beats per minute for moderate activity.

Some people will find this too easy. If you do, for more vigorous exercise, you can raise your heart rate range between 70 and 85 percent of MPHR. For our 50-year-old

patient, that would be around 119 to 144 beats per minute. If you’re doing vigorous exercise, you need to exercise 75 minutes a week. For patients who haven’t been ex-ercising at all, it’s important to start slow. Often patients push themselves, they get injured and then they quit exercising all together.

Also, it’s really important to find exercises you like to do. If you hate the treadmill, then pick something else. The best exercise is the one you will continue to do without quitting.

Some people want to walk, others prefer to swim. It does not matter as long as you do it and do it continuously at a moderate or vigorous pace. Change up your exercise routine, too, so that you don’t get bored. In addition to aerobic exercise, as we get older it’s important to improve our strength and balance. Light weight training, yoga, tai chi and Pilates are great ways to achieve these goals.

It’s important that we make exercise routine in our life. If it’s not routine, it will eventually fall away from your schedule, and exercise will be something you think about but don’t do. Try to make exercise as easy and convenient as possible. You don’t have to go to a gym or spend a lot of money to exercise. Also, try to exercise in spurts. If you can’t exercise 20 minutes at a time, try to exercise 10 minutes in the morning and 10 minutes at night. Try to exercise during lunch.

It is important to know that it’s never too late to start exercising. If you have never exercised, talk to your doctor before you embark on an exercise program. Just remember: It’s never too late to start gain-ing the benefits of regular exercise.

NOW THAT we are into the middle part of the season of Lent, it makes us retro-spect and wonder what is in store for us by setting aside the daily grind of life. It has reached so far that we forget the quality of life due largely to our incessant search for the better life. We forget that life is more than just the daily search of what lies ahead in our day to day grind. Let us ease off from the serious part of life in order to give substance to the quality of life. It is not just the daily search for the peso to pay for our daily needs. It was said that “more things are wrought by prayer than this world dreams of.” Therefore, let us consider our options of life.

Actually we are just travellers in this big wide world. None of us are permanent. Even the greatest Saints pass away (the eth-ical way of saying that we die). It is only in dying that we are born to eternal life. Even Jesus Christ died (to redeem us). It is in the Bible that only two men were spared from dying: Enoch who disappeared into thin air, and Elijah who was taken up to Heaven in a fiery chariot. Death is not entirely the end of Man’s existence. It is how we will be in the afterlife: Heaven or Hades. Those who follow religiously the Ten Commandments are sure to inherit Heaven. Let this corner review the Ten Commandments for those who forgot it:

03) Remember that thou keep holy the Sabbath Day;

There was a Japanese who was said to reach 121 years old. Some of us may have reached a hundred years but certainly not 500 or even 200. And if we are to attain old age, this corner will find it odd to reach old age because we become loners. All of our

THE COMMISSION on Appointments (CA) of Congress has rejected the con-firmation of Foreign Affairs Secretary Perfecto Yasay for telling the Commission members a lie that he did not acquire US citizenship. The CA cannot do anything but to deny confirmation of Yasay’s ap-pointment since what kind of a high gov-ernment official is he for declaring an un-truthful statement that he did not acquire a foreign citizenship when he just filed a renunciation of his US citizenship at the US Embassy in Manila on June 28, 2016, just two days before he was appointed by President Duterte. And aside from telling a lie on the grant of US citizenship to him, imagine if his appointment was confirmed by the CA, if he was not found out to have taken an oath of allegiance as a US citizen? Then we would have a foreign affairs secretary and cabinet member who is not a full pledged Filipino citizen.

Now, will the Commission on Ap-pointments make a strike two and also deny confirmation of Environment and Natural Resources Secretary Gina Lopez on different issues such as her closure of 23 operating mines, and the suspension of five more mines after being found out to have violations of mining laws and for damaging watershed areas.

Due to her official actions of closing operating mines and the cancellation of 75 mining contracts still due for development and operation in the future, several mining groups led by the Chamber of Mines of the Philippines filed letters of opposition to Secretary Lopez’s confirmation before the CA. The mining groups claim that the

mining audits done by Sec. Lopez on the closed mines were not done well and in accordance with law. They also accused Lo-pez of being influenced by her “prejudices”, and for being mainly an environmentalist in orientation and not being knowledge-able or technically well-versed in mining operations.

Sec. Lopez countered during the CA hearings that she is assisted in her job in the department by technical experts she has appointed to help her in the DENR. She has submitted programs to be implemented by DENR such as development of a “green economy” and ecotourism projects as alter-native economic plans to fill in lost income from the closed mines, including plans to help displaced miners who lost their jobs.

The Commission members now are facing a dilemma which side they will hear favorably and support. Will it be Sec. Lopez and her environment protection advocacy? Or, the side of the big mining groups and their plea for help for the lost income in their mining operations and the displaced mine workers and their families? Is there no way for a middle ground to be reached on this problem of the mining industry and the DENR officials? A middle ground or a consensus among the environment of-ficials and mining companies officers to be reached and agreed upon like support for the environment officials led by Sec. Lopez in the protection of the Philippine environ-ment, and the mining officers guaranteeing to implement safe mining operations and for the protection of the environment in their mining areas and not only aim for the big money their companies will earn.

Cambatutay Bay in Samar now red tide freeTACLOBAN CITY (PIA) - Cambatutay bay in Samar is now negative for paralytic shellfish poison otherwise known as red tide toxin.

Shellfish advisory no. 08 series of 2017 dated March 6, 2017 released by the Bureau of Fisher-ies and Aquatic Resources (BFAR) disclosed that shellfish samples collected from said coastal waters yielded negative results for red tide per laboratory results that were obtained from three (3) consecutive weeks of sampling in the area.

Thus, shellfish samples harvested from Cam-batutay bay in Samar are now safe for human

consumption or can be gathered and eaten now by the public. However, the coastal waters in Eastern Visayas of Daram Island and Irong-irong bay in Samar; Matarinao bay in Eastern Samar; Leyte in Leyte and the coastal waters of Biliran are still positive for red tide toxin.

BFAR Undersecretary for Fisheries Director Eduardo B. Gongona assured that BFAR and the local government units concerned are continu-ously monitoring the status of the coastal waters in Eastern Visayas to safeguard the health of the public and to protect shellfish industry.

Registrar of Mahaplag, Leyte is hereto attached as Annex “B”, that late last year, she started to process her requirement for the Professional Reg-ulations Commission (PRC) Board Examina-tion in Civil Engineering and when she obtained her Certificate of Live Birth from the Philippine Statistics Office (PSA), she found the error in the entry of her middle name initial which is “L”. This error in her middle name initial is also reflected in her Certificate of Live Birth issued by the Local Civil Registrar of Mahap-lag, Leyte; that the cor-rect middle name of her mother is “Rusora” and not “Lusora”. This fact is supported by the entry of family name of her moth-er in her (petitioner) birth certificate issued by the Philippine Statistics Of-fice (PSA) which shows that her mother ’s last last name is “Rusora”. In addition, on page two (2) of the said documents, the affidavit of delayed registration of birh also shows that the affiant’s name reflected is “Mar-ilou R. Cano”, that with the above predicament, her application for PRC Board Examination was denied to her prejudice. She sincerely desires to take the examination this 2016; that she has no hand in the erroneous en-try on her middle name initial in her Certificate of Live Birth; that because of this predicament, she begs that the entry on her birth certificate as regards the initial of her middle name be changed from “L” to “R”. Peti-tioner most respectfully prays of this Honorable Court that, after due notice, publication and hearing, an order be is-sued directing the Civil Registrar of Mahaplag, Leyte to correct the entry in the Records of Birth of Vilma Rose L. Cano, particularly in the initial of her middle name to be changed from “L” to “R”. Petitioner likewise prays for other reliefs just and equitable under the circumstances.

The petition being sufficient in form and substance, notice is here-by given that this petition is set for initial hearing on March 29, 2017 at 8:30 o’clock in the morning at the session hall of this Court. Begin-ning at a point marked “1” on plan, being S. 6 deg. 21’E., 804.80 m. from B.L.L.M. P h o t o c o p i e s o f Transfer Certificate of Ti-tle No. 32196 and Trans-fer Certificate of Title No. 24293 are hereto attached as Annexes “A” and B, respectively, while a copy of the Death Certificate of Diosdado Bautista is hereby attached as An-nex “C”.

4. Petitioner and MARILU ROMERO, are presently the rightful owners of the above-described parcels of land, having bought the same at public auctions held on November 23, 2011 and February 6, 2013 for the partial satisfaction of the judgment in Civil Case NO. 4213-0;

5. Petitioner and MARILU ROMERO were later issued with Sheriff’s Certificates of Final Sale for failure of respondents to redeem the property within one year from registration of the sales; Photocopies of the Sher-iff’s Certificates of Final Sale dated August 15, 2013 and May 30, 2014 are hereto attached as Annexes “D” and “E”, respectively;

6. D e s p i t e a l -ready being the new owners of the property, the registration of the property cannot be trans-ferred to the name of petitioner and Marilu Romero without the owner’s copies of Trans-fer Certificate of Title No. 32196 and Transfer Certificate of Title No. 24293. Petitioner and Marilu Romero thus filed a Motion to Compel De-fendants to Surrender the Owner’s Copies of Cer-tificates of Titles before the Regional Trial Court, Branch 12, Ormoc City in Civil Case No. 4213-0;

7. The Motion to Compel Defendants to Surrender the Owner’s Copies of Certificates of Titles was granted, but the writ for the execution of the Order granting the motion was returned unserved because defen-dants could not be lo-cated in their last known address; Copies of the Writ of Execution dated February 20, 2015 and the Return of the Writ of Execution dated June 15, 2015 are hereto attached as Annexes “F” and “G”, respectively;

8. Petitioner and Marilu Romero then filed a Motion with the same Court praying that an Order issue declaring the owner’s copies of Trans-fer Certificates of Title Nos. 32196 and 24293 as null and void and direct-ing the Registry of Deeds of Ormoc City to issue new owner’s copies of the certificates of title, but the same was denied for lack of merit in its Order dated October 16, 2015, the relevant portion of which reads;

“This court is mind-ful of the fact that issu-ance of second owner’s copy of Certificate of Title of a parcel of land can only be had pursuant to Sec. 107 of PD 1527. It provides that a petition must first be filed before the proper court and only after hearing should the remedies enumerated therein be granted. In

other words, it cannot be availed of by just filing a mere motion.”

A copy of the Order dated September 16, 2015 is hereto attached as An-nex “H”;

9. Petitioner and Marilu Romeo have ex-erted all efforts to re-trieve the owner’s copies of Transfer Certificates of Title Nos. 32196 and 24293 from the respon-dents but the same proved futile as their present whereabouts is unknown and the own-er ’s copies of Transfer Certificates of Title Nos. 32196 and 24293 could no longer be found;

10. Petitioner is thus constrained to file the instant petition, in accordance with Sec-tion 107 of P.D. No. 1529 otherwise known as the Property Registration Decree which provides:

“Section 107. Sur-render of withhold dupli-cate certificates. Where it is necessary to issue a new certificate of title pursuant to any invol-untary instrument which divests the title of the registered owner against his consent or where a voluntary instrument cannot be registered by reason of the refusal or failure of the holder to surrender the owner’s duplicate certificate of title, the party in inter-est may file a petition in court to compel sur-render of the same to the Register of Deeds. The court, after hearing, may order the registered own-er or any person with-holding the duplicate certificate to surrender the same, and direct the entry of a new certificate or memorandum upon such surrender. If the person withholding the duplicate certificate is not amenable to the process of the court, or if not any reason the outstanding owner’s duplicate certifi-cate cannot be delivered, the court may order the annulment of the same as well as the issuance of a new certificate of title in lieu thereof. Such new certificate and all duplicates thereof shall contain a memorandum of the annulment of the outstanding duplicate.”

PRAYER W H E R E F O R E ,

premises considered, it is most respectfully prayed of this Honorable Court that, after due notice and hearing.

(a) An order issue directing respondents to surrender the owner’s copies of Transfer Certifi-cates of Title Nos. 32196 and 24293;

And in the alterna-tive, should said regis-tered owners unjustly fail or refuse to comply with the said order,

(b) To declare the owner’s copy of Transfer Certificates of Title Nos. 32196 and 24293 in the possession of the regis-tered owners as null and void and to direct the Registry of Deeds for Ormoc City to issue new owner’s copies of Trans-fer Certificates of Title Nos. 32196 and 24293 in lieu of the owner’s copies of the certificates of title requested to be declared null and void.

The entry sought to be corrected pertains to his first name whereby BENJAMIN was errone-ously spelled as BENJA-MEN, as well as to his year of birth, from March 31, 1972 as indicated in the Register of Births instead of March 31, 1982

A perusal of the petition shows that the same appears to be suf-ficient in form and sub-stance. Set therefore the initial hearing on May 12, 2017 at 8:30 in the morning.

The petitioner is DI-RECTED to cause at his expense, the publication of this Order once a week for three (3) consecutive weeks in an accredited newspaper of general circulation in the Prov-ince of Leyte. Under Section 65 of RA 6657, Department of Agrar-ian Reform (DAR) is “au-thorized under certain con-ditions, the reclassification or conversion and the dis-position of lands awarded to the Agrarian Reform Ben-eficiaries (ARBs). Section 4 of the Executive Order No . 129-A mandates DAR to approve or disapprove the conversion, restructuring or readjustment of agricultural lands into non-agricultural uses. Section 5 of the same EO authorizes DAR to have exclusive authority to ap-prove or disapprove con-version of agricultural land to residential, commercial, industrial, and other uses as

may be provided for by law. Section 4 of Malacañang Memorandum Circular No. 54, s. 1993 provides that action on application for land use conversion on in-dividual landholdings shall remain as the responsibility of the DAR.”

Mariano lamented that since the approval of the Constitution in 1987, no single government agency has monitored land conver-sion in the country.

THE HOUSE of Represen-tatives, voting 217-54 with one abstention, passed Tuesday night House Bill 4727 or the proposed “Death Penalty Law,” which seeks to reinstate the punishment of death for drug-related heinous crimes.

The re-imposition of the death penalty will require the repeal of Republic Act No. 9346 entitled “An Act Prohibiting the Imposi-tion Of Death Penalty in the Philippines”, and fur-ther amendment of Act No. 3815, as amended, or “The Revised Penal Code,” and Republic Act No. 9165, otherwise known as the “Comprehensive Danger-ous Drugs Act Of 2002.”

The bill defines heinous crimes as “grievous, odious and hateful offenses, which by reason of their inherent or manifest wickedness, viciousness, atrocity and perversity are repugnant and outrageous to the com-mon standards and norms of decency and morality in a just, civilized and orderly society.”

Under the bill, the death penalty shall be imposed on the following offenses: (1) importation of dangerous drugs; (2) sale, trading, ad-ministration, dispensation, delivery, distribution, and transportation of dangerous drugs; (3) maintenance of a den, dive, or resort where any dangerous drug is used or sold; (4) manufacture of dangerous drugs; and (5) possession of 10 grams or more of dangerous drugs.

The death penalty shall also be enforced when the crime is committed under the influence of dangerous drugs, provided that the of-fense committed is punish-able by reclusion temporal or 12 years and one day up to 20 years.

However, the imposi-tion of capital punishment is not automatic, as the proposed law provides for an automatic review by the Court of Appeals or by the Supreme Court, and a ma-jority vote is required for it to be imposed.

Moreover, death pen-alty shall not be imposed when the offender is below 18 years old or more than 70 years old when the crime was committed.

Among those who vot-ed in favor of the bill was Rep. Emi Calixto-Rubiano (Lone District, Pasay City) who said her affirmative de-cision was based on consul-tations and meetings with her constituents, which reflected overwhelming support for the death pen-alty reimposition.

“After a series of con-sultations and meetings with the different sectors in our city, which started as early as November 2016,

and after the survey I com-missioned just last month to get the sentiments of my constituents, majority, if not all, favored the reimposi-tion of the death penalty. Being their lone represen-tative and voice here in Congress, I bring with me today the decision of my people. Therefore I vote Yes in favor of House Bill 4727,” said Calixto-Rubiano.

Rep. Aniceto “John” Bertiz III (Party-list, ACTS OFW), in explaining his affirmative vote, said hei-nous crimes in the country continue unabated mostly due to uncontrolled drug trafficking.

“We cannot afford to see more lives wasted, more futures destroyed by big-time drug syndicates op-erating in our country. Our OFWs who are working so hard for their families deserve to know that their own government will be just as tough on drug traf-fickers as most other coun-tries are,” said Bertiz.

Bertiz added “Pinagta-tawanan at pinapalusutan lang po tayo ng mga West African drug syndicates na ginagawang transship-ment ang Pilipinas at gi-nagamit ang ating mga kababayan bilang drug couriers abroad. Tulad po sa kaso ni Mary Jane Veloso, yung sangkot na African nationals, hindi man lang natin naipakulong at napa-rusahan. Kung may death penalty, sila na mismo ang iiwas sa Pilipinas. At ang mahalaga, ‘yung mga kawani ng pamahalaan na nasa bulsa ng drug lords ay maari na ring maparusahan ng kamatayan.”

Rep. Ruwel Peter Gon-zaga (2nd District, Compos-tela Valley) likewise voted in favor of the bill, saying the enactment into law of HB 4727 will not violate the International Conven-tion on Civil and Political Rights (ICCPR). He said the late President Corazon Aquino ratified the ICCPR on October 23, 1986. The Batasan Pambansa did not concur with the ratification made by the President of the ICCPR simply because the Batasan Pambansa was abolished by virtue of Proc-lamation No. 3 signed by Mrs. Aquino establishing a Revolutionary Govern-ment.

Gonzaga also said that Fr. Joaquin Bernas, in his book, Philippine Constitu-tion: Comprehensive Re-viewer, states, ‘’Article 6 Paragraph 2 of the covenant explicitly recognizes that capital punishment is an allowable limitation on the life to right, subject to the limitation that it may be imposed for the most seri-ous crimes.’’

The second issue clari-fied by Gonzaga is that the

death penalty, if enacted into law, will not violate the Second Optional Protocol to the ICCPR. “The Second Optional Protocol to the ICCPR is not a treaty nor an international agreement because the ratification of the President did not have the concurrence of at least two-thirds of all members of the Senate as required under Section 21 Article 7 of the Constitution,” said Gonzaga.

Rep. Rozzano Rufino B. Biazon (Lone District, Muntinlupa City) also vot-ed for the bill, saying his return to the House in the 17th Congress has given him another opportunity by his constituents to repre-sent them. He said his view about illegal drugs remains the same that “it is a menace to society, it brings about moral decay, it fuels crime and brings misery in the life of anyone and everyone who gets entangled in its web.’’

Biazon said the Consti-tution allows capital pun-ishment for compelling reasons involving heinous crimes. “The continued proliferation of the illegal drug trade with its devas-tating effects is a compelling reason. And the resulting crimes are heinous. Under the authority of the People of Muntinlupa City for me to be in this Chamber, I vote yes,” said Biazon.

Deputy Speaker and Camarines Sur First District Rep. Rolando Andaya, Jr. said the real crime deterrent is the certainty of apprehen-sion, the certainty of pros-ecution, and the certainty of conviction.

“Ano ang punto ko, hindi lang parusa kundi

ang buong sistema ang i-reporma. Sang-ayon ako sa hindi mandatory ang death penalty, sang-ayon ako sa automatic review, sang-ayon ako na iisa lang ang sakop ng batas na ito. I vote in the affirmative,” said Andaya.

Meanwhile, leading those who voted against the bill was Rep. Edcel Lagman (1st District, Albay). He cit-ed two overriding reasons for his vote: one, the imposi-tion of death penalty would openly defy the country’s irrevocable commitment not to re-impose the death penalty as a State party to the Second Optional Pro-tocol to the International Convention on Civil and Political Rights; and two, the 1987 Constitution abol-ished death penalty. How-ever, it allowed Congress to re-impose it for compelling reasons on heinous crimes.

These two stringent conditions are separate but concurring. Lagman said the proponents have failed to comply with the Consti-tutional prerequisites.

Rep. Kaka Bag-ao (Lone District, Dinagat Islands) said her “No” vote to the bill was based on funda-mental values anchored on social justice and human rights, and dignity.

SAAD vows more projects for SamarTACLOBAN CITY – The Department of Agriculture (DA) through its Special Area for Agricultural Devel-opment (SAAD) continues to implement development projects in the three prov-inces of Samar, which are among the twenty poorest provinces in the country.

DA Asst. Reg’l Director for Research and Regulation Elvira Torres told EV Mail that after its launching last De-cember 19, wherein they have distributed P25 million for each province, they continue

to identify suitable projects for the area, aside from increasing their rice and corn production, livestock and high value crop production.

“Our focus for SAAD is enhancing production and live-lihood interventions, while the infrastructures such as farm-to-market roads will be under our regular programs like the Philippine Rural Development Program (PRDP),” she shared.
