FMCSA’s Timeline for
ELD Implementation
• Phase 1: Awareness and Transition Phase: The two-year period following publication of the ELD rule February 16, 2016 to December 18, 2017.
During this time, drivers may use any of the following:
Paper Logs
Logging Software
AOBRD’s (Automatic On-board Recorders)
ELD’s – Registered and Listed w/FMCSA
Phase II• Phase 2: Phased-In Compliance Phase: The
two-year period from the Compliance Date to
the Full Compliance Phase (four years
following ELD rule publication) December
18, 2017 to December 16, 2019.
• Carriers and drivers subject to the rule can
use:
AOBRDS that were installed prior to
December 18, 2017.
Certified, registered ELDs following rule
publication December 16, 2015.
Phase III
Phase 3:
Full Compliance Phase: After December 16, 2019 all drivers and carriers subject to the rule must use certified, registered ELDs that comply with requirements of the ELD regulations.

Of Course….. Drivers who keep RODS no more than
8 days during any 30-day period.
Driveaway-towaway drivers
(transporting an empty vehicle for sale,
lease, or repair), provided that the
vehicle driven is part of the shipment.

violations as they relate to distracted
driving:
Texting : 77
Cell Phone: 3,099
Reckless: 83
Following/Close: 355
Lane Restriction: 1143

The Investigation
• While gathering evidence at the scene, the CMV
drivers log book was found along with multiple other
previous log book entries around the crash scene.
• Due to the fatality involved, cell phone’s are gathered
as well for the investigation. The cmv driver,
Christopher Thornhill, consented to a search of his cell
phone.
• CMV driver was also interviewed a few days later in
Darke County, OH about the collision.
Investigation Continued
• BCSO Electronic Crimes Unit confirmed the
driver was texting prior to the collision.
• Time distance formula’s were completed that
confirmed the driver was texting for 42 miles
up I-71 prior to the collision location. The last
message he “read” was less than one minute
from the first 911 call.
• His log book had multiple entries for the same
days, including working on days that he also
had log book entries for his days off.
Outcome
February 2016, the driver of the CMV
was convicted of manslaughter and
sentence to 8 years in prison.

UK Transportation Center did a
study regarding CMV parking in
October 2015 as it relates to locations
and spaces available.
Here is what they found!
CMV Parking
Daytime use of parking was 45% (2,143
of 4,715 spaces used)
Nighttime use of parking was 87% (6,803
of 7,844 spaces used).
Lowest % was 32% on I-24
Highest% was 93% on I-71
