BACKGROUND • While most of our construction management services are performed in-house, we contract support to fill gaps

• Construction phase support services are needed in highly specialized disciplines or when in-house capability faces time or location limitations

• USACE’s command-wide policy is to procure construction phase support services as Architect–Engineer (A-E) service

• Brooks A-E Act: Public Law 92-582 – we are committed to selection based on highest qualified firms

Construction Management & Surveillance Opportunities

•  Disclaimer: Construction Management (CM) as a service is defined differently by different organizations; this is how the Air Force uses it based on our acquisition vehicles

•  Projects executed as Design-Bid-Build or Design-Build •  CM responsibilities usually performed by the Agent

─  Agent provides construction surveillance ─  GC responsible for Quality Assurance/Control

•  Construction Surveillance/Title II Quality Assurance ─  Provided by in-house personnel, A-Es, CM firms, or other

service providers during construction ─  Observation, inspection, and documentation of

construction progress ─  Provides the government technical interpretation of

proposed changes

Page 19: Welcome to Construction Management Business Opportunities•2,300 civilian and military engineers, scientists, project managers & technical experts • $4 billion civil works and military

Construction Management & Surveillance Opportunities

•  Agents for Air Force projects can be the installation, AFCEC, USACE, NAVFAC, or other entities

•  Air Force may use Title II Quality Assurance when the installation or AFCEC is construction agent ─  May be contracted out due to project location, required

specialized expertise, high level of focus ─  Roles of Title II QA are strictly controlled by contracting - QA/

QC remains responsibility of the GC ─  AF builds cost into programmed project Supervision,

Inspection, and Overhead (SIOH) ─  AF allows single projects to have multiple associated

contracts: Construction, Title II, advisory, etc.

Air Force MILCON Projects

•  Design Agent/Construction Agent – DoD component responsible for: –  performing contracting function –  overseeing technical execution –  Assumes “CM” role

•  Agents for Air Force Projects –  USACE –  NAVFAC –  AFCEC (UK and British Isles)

•  Alternate agent (<5% of portfolio) –  AFCEC –  Installation

Page 23: Welcome to Construction Management Business Opportunities•2,300 civilian and military engineers, scientists, project managers & technical experts • $4 billion civil works and military

FSRM

•  Program centralized at AFCEC •  MAJCOMs prepare and submit Integrated

Priority Lists (IPLs) to AFCEC •  Projects are racked/stacked and released on

an annual Construction Tasking Order (CTO) –  Can be authorized for Design or Construction –  Release on the list provides Authority to Advertise –  Includes cost, timing & “weaponeering” (execution)

•  Projects can be funded in CTO year or year +1 –  Ex: Projects on FY18 CTO can be funded in FY17/18

Page 24: Welcome to Construction Management Business Opportunities•2,300 civilian and military engineers, scientists, project managers & technical experts • $4 billion civil works and military

FSRM Weaponeering

•  Assignment of Execution Agent •  Primarily 3 Options

–  Base Installation executed through local contracting –  USACE districts –  AFCEC (via Enterprise Procurement)

•  CTO Provided to Agents and Posted Online

Construction CTO (plus Environmental and Housing CTOs) available online at: http://www.afcec.af.mil/Home/Business/

Page 25: Welcome to Construction Management Business Opportunities•2,300 civilian and military engineers, scientists, project managers & technical experts • $4 billion civil works and military

FSRM Weaponeering

•  FY18 CTO – 1,205 Projects, $1,910.7M –  Design – 322 Projects, $88.0M –  Construction – 883 Projects, $1,822.7M

AFCEC, $377.3

Installation, $1,272.7

USACE, $144.5

Other, $28.3

FY18 CTO by Execution Agent ($M)

Other Includes: FAA, Troop Training, NAVFAC, DIO (UK), LBB (Germany), etc.

Page 26: Welcome to Construction Management Business Opportunities•2,300 civilian and military engineers, scientists, project managers & technical experts • $4 billion civil works and military

FSRM Weaponeering

•  Divided into funding ranges •  Displays location, project number/title, agent

and status (design or construction) 25

Page 27: Welcome to Construction Management Business Opportunities•2,300 civilian and military engineers, scientists, project managers & technical experts • $4 billion civil works and military

Construction Management & Surveillance Opportunities

•  Current examples of Pacific Title II work: ─  MILCON: Misawa MFH Phase 3 and Weatherization ─  SRM: Relocate Elec Lines Underground, Bellows AFS, Hawaii ─  Housing: Renovate 221 Units, Camp Lester, Okinawa ─  Medical: Repair Hospital Fire Alarms, HVAC, Yokota AB ─  Research: Renovate Building 300, Kihei, Hawaii

•  Potential future opportunities for Title II ─  CTO projects >$2M PA with AFCEC/Installation Agent

─  Eielson F-35 Beddown SRM projects ─  Projects at remote locations (Wake Island, Kaena Point, Capes)

─  Overseas housing projects (Yokota, Misawa, Okinawa) ─  Airfield projects (CONUS primarily)

VA Acquisition Strategy

§  Veterans First Contracting Program - the Program, which gives

preference to SDVOSBs and VOSBs, was created by 38 U.S.C. § 8127 and § 8128 and implemented by VA in 2009.

§  2016 Supreme Court (SCOTUS) Kingdomware Decision

•  Prior to the decision, VA believed and two lower courts agreed, that the Program did not apply when placing orders under FAR subpart 8.4, the Federal Supply Schedule (FSS).

•  The SCOTUS decision overruled the lower courts and decided that the Program does apply to FSS orders and is mandatory not discretionary.

Office of Acquisition, Logistics, and Construction Construction & Facilities Management 59

VA Acquisition Strategy Rule of Two

§ Rule of Two – The process whereby a contracting officer of the VA, “shall award contracts on the basis of competition restricted to small business concerns owned and controlled by veterans if the contracting officer has a reasonable expectation that two or more small business concerns owned and controlled by veterans will submit offers and that the award can be made at a fair and reasonable price that offers best value to the United States.”

§ Market Research – Conducted to support the Government’s acquisition strategy – no change to current policy.

Page 61: Welcome to Construction Management Business Opportunities•2,300 civilian and military engineers, scientists, project managers & technical experts • $4 billion civil works and military

Office of Acquisition, Logistics, and Construction Construction & Facilities Management 60

VA Acquisition Strategy Rule of Two (Continued)

§  Impact: CFM anticipates that the “Rule of Two” decision will not have a significant impact on Construction procurements, but there is the potential for a noticeable increase in awards to SDVOSB/VOSBs for A/E and other services.

§ Certification Requirement: In order to compete for awards under the Veterans First Contracting Program, eligible SDVOSBs/VOSBs must first be verified by the Center for Verification and Evaluation (CVE).

VA Acquisition Strategy Sole Source Authority for SDVOSB/VOSB

§ Authority: Public Law 38 USC § 8127 and VAAR 819.7007(b) and 7008(b) “Sole source authority for SDVOSB and VOSB”, provide the Contracting Officer (CO) authority to make sole source awards up to $5 million based on his/her own discretion, provided the concern can be determined responsible and the award can be made at a fair and reasonable price.

§ Restrictions: A restriction for sole source currently exists within an internal Procurement Policy Memorandum (PPM) that is being modified to align with the authorizations found in 38 USC § 8127 and the VAAR.
