    The Board of Directors has arranged for the City ofTallahassee to do a special pickup on Monday,February 4, 2008. Items ordinarily banned fromdisposal at the dumpster area may be taken down forpickup: furniture, lamps, TVs, carpets, bikes, scraponstruction materials, bedding, and other discarded

    materials. Hazardous waste items such as computers,

    monitors, batteries, paint and chemicals must not bencluded. Call the Leon County Solid Waste Division

    o get information on disposal of hazardous items.

    Leave items between the fenced storage area and thelubhouse on the white lined parking spaces south ofhe Association clubhouse. NOTE: Items should be

    placed in the parking spaces only, NOT NEXT TOTHE DUMPSTERS, and only on Friday-Sunday,February 1-3, 2008.

    At the Westwood Clubhouse

    Meeting called to order at 7:07

    In attendance:David Stevenson (DS), President

    Officers report:

    DS is unable to get all of the bonafides from Jacky Dancy.- missing, wrong, or out dated information- Molly Maids will be coming out to clean prior to the annual meeting, for $120.00

    - the three year tree is coming up- Armstrong has presented an estimate- BG moves to accept it, LR seconds, AIF- Mulch rings are needed around our 2 new Oak trees, Gloria will ask AA if they

    - Gloria also noted garbage thrown off of the back porches of some of the unitsalong Tharpe

    Lighting committee

    - we received 2 bills from RC Electric-

    - $117.91 for repair of floodlights on clubhouse- - $350.00 for repair of pole lights in front of units: 101, 102, 511, 210, and by thepool

    - LR spoke to Anthony Williams from the City concerning the garbage area lightpole installation (694-8191). Mr. Williams said we are on the list to have one putin. Were number 40.

    Sidewalk maintenance

    - Curtis White gave an estimate for side walk replacement of $8.16 per square foot,1475 sq ft, and $12000.

    - Details include putting the concrete 8 deep where tree roots may crack it (4where theyre not an issue), using hand equipment instead of backhoes to removedebris, and repairing the crushed curb in front of clubhouse.

    - BG moves to go ahead with Mr. Whites estimate, JC seconds, AIFHandbook committee requests a deferment of one month due to too much on the plategetting ready for annual meeting.

    Old Business

    A. Report on implementation of Dr. Leo Rotans Management by .Committee proposal

    Leo Rotans management proposal is deferred to next meeting.

    B. Consideration of electricians assessment of safety of temporary fix ofCommon electrical element near Unit 312 and need for additional .

    Maintenance for which the Association is responsible.

    Gloria Rotan met with electricians who looked at 312s repair and said it looked okay.

    Fancy spoke with an electrician doing work on 111 a couple of weeks ago, doesntremember their name. Says Steve Vancorte might know. This bears following up becausethe Tamper evident lock was never put back on by the city

    C. Consideration of effort to secure an engineers recommendation forconstruction of a French drain between the 400 and 500 block buildings

    This is still under evaluation

    D. Consideration of contracting with Jackie Dancy to clean clubhouse

    on a regular basis. Beginning with comprehensive cleaning prior to annual. Membership meeting.

    This was addressed earlier.

    E. Consider removal or replacement of storage yard fence.

    BG moves to reposition the fence so that it covers the chain link area of the storage yard,remove unusable sections of wooden fence, and use existing landscaping. The purpose ofthis is to eliminate a potential crime area and get rid of a catch all that accumulatesjunk. LR seconds, DS opposes, 3 in favor.

    New business

    A. Consideration of contracting with Lowes for storage room doorreplacement throughout the Association where needed.

    Per Phylliss research:- Lowes will install 8 doors for $4700.- Jett Builders will install a better quality door (6 sides being metal rather than only

    2 sides), for significantly less money. He has given an estimate to that effect- BG moves to contract with Jett to replace doors (8), paint the doors, and replace

    the locksets as necessary, as phase 1 of door replacement. JC seconds, AIF

    B. Consideration of other preparations for annual membership meeting.

    - BG moves to hire Molly Maids to clean clubhouse for $120, plus additionalcharge to buff the floor. LR seconds,AIF

    - BG moves to buy 4 umbrellas and one table at sale price for the pool area. LRseconds, AIF

    - 3:00 Saturday is scheduled for clubhouse set up timeC. Board after-the-fact approval of emergency approval of locating and.repairing of underground pipe water leak adjacent to Unit 101.

    - BG moves to reimburse DS $1600 he paid to Bennett, as well as $95 when hefinds the receipt. Also moves to pay American Leak Detection the $1600 owedthem. LR seconds,AIF.

    D. Board response to Steven Vancores recent maintenance request- We need a copy of his WDO report from when he originally obtained his unit if it

    exists- BG moves to ask for a 30 day extension in order to better respond to his request.

    Consider engagement of a CPA for review of financial statements

    - BG moves to have CPA firm do the review for $4500.JC seconds,AIFG. Consider termination of 407 deck contracts and consideration of new

    contractor.

    - Because the original contractor has returned the up front money already, thecontract is terminated. For the record, the contractor shouldnt be held totally toblame as a previous business arrangement went sour. He was up front with uswhen he found out something was wrong and returned the deposit when it was

    apparent he couldnt do the work,- Jett offered an estimate for $11860 plus $400 for a city engineering plan.- BG moves to hire Jett at the proposed price and our specifications. LR seconds,

    Exact Wording of Proposed Amendments to Governing Documents

    AMENDMENTS TO DECLARATION OF CONDOMINIUM

    Proposed Language:20. Rate of Assessments. All annual assessments shall be divided equally among all houses exceptassessments for "B" units as depicted upon Exhibit "C" hereof shall be eighty percent (80%) ninety percent

    (90%) of assessments on all other houses. All special assessments shall be divided equally among allhouses. Assessments may shall be collected on a monthly basis.

    Proposed Language:21. Collection of Assessments. Assessments are due on the first day of each month. Assessments andinstallments thereon paid on or before ten (10) days after due date the last day of that month shall bear nointerest. All such sums not paid within said period of time shall bear interest at the maximum rate permittedby law. Such interest shall run from ten (10) days the first day of the subsequent month after said sum orsums are due until the date of payment. Any partial payments shall be credited first to interest and then tothe assessment. ..The Association shall be entitled to collect from the homeowner all legal costs includinga reasonable attorney's fee incurred by the Association in connection with or incident to the collection ofsuch assessment and interest or in connection with the enforcement of the lien resulting therefrom. Inconnection with any foreclosure of such lien or assessments and interest, the Association shall be entitled tothe appointment of a receiver during said foreclosure proceedings and during any foreclosure of a lien orassessments and interest, the homeowner shall be required to pay a reasonable rental for the use of the

    house during the period that he occupies the same.

    22. Penalty Charge on Delinquent Assessments. All assessments not paid within thirty (30) fifteen (15) daysafter the due date shall bear a service charge of $15.00 per month from the due date thereof. (previouslyamended 1988, Official Records 1314/0598)

    Proposed Language (To bring the Association into compliance with Florida Statutes 718.112(2)(d)3 )3.(b) Election of Directors shall be conducted at the annual meeting of members. A nominating committeeof five members shall be appointed by the Board of Directors not less than thirty (30) sixty (60) days prior tothe annual meeting. The committee shall nominate at least one (1) person for each term which will expireand shall submit said nominations to the Board not less than 40 days before a scheduled election. Anyeligible person desiring to be a candidate for the board must give written notice to the Association not lessthan 40 days before a scheduled election. Additional nominations for Directorships and Directors may bemade from the floor.     5.(c) Rules and Fines. The Board shall develop rules to govern residents activities at Westwood. Rulesshall be published and available to owners and tenants. The Association may levy reasonable fines againsta unit for the failure of the owner of the unit, or its occupant, licensee, or invitee, to comply with any provisionof the declaration, the Association bylaws, or reasonable rules of the Association. No fine will become a lienagainst a unit. No fine may exceed $100 per violation. However, a fine may be levied on the basis of eachday of a continuing violation, with a single notice and opportunity for hearing, provided that no such fine shallin the aggregate exceed $1,000. Fine may be levied after giving reasonable notice and opportunity for ahearing to the unit owner and, if applicable, its licensee or invitee. The hearing will be held before acommittee of other unit owners. If the committee does not agree with the fine, the fine may not be levied.This section does not apply to unoccupied units.

    2. Proposed Language:8. Budget. The Board of Directors shall adopt a budget for each fiscal year, commencing on July 1, andterminating June 30 of each year, calendar year which shall include the estimated funds required to defraycommon expenses and to provide funds for the accounts listed in Section 1 of these By-Laws.

    9.(a) Assessments against the homeowners for their share of the items of the budget shall be made on orbefore December June 1 of the fiscal year preceding the fiscal year for which the assessments are made... Such assessments shall be due in monthly payments on the first day of each month for which theassessments are made. If an assessment is not made as required, an assessment shall be presumed tohave been made in the amount of the last prior assessment. In the event the assessment proves to beinsufficient, the budget and assessments therefore may be amended at any time by the Board of Directors ifthe items of the amended budget do not exceed the limitations thereon for that year. Any item which doesexceed the limitation shall be subject to the approval of the membership of the Association as provided inthe Declaration. The unpaid assessment for the remaining portion of the calendar month for which theamended assessment is made shall be due upon the date of the assessment.
