Ten Facts about Mortgage Debt ForgivenessBelow is an article from IRS.gov with information about the Mortgage Forgiveness Debt Relief Act of 2007. Here is the link to the IRS.gov newsletter http://www.irs.gov/newsroom/article/0,,id=205004,00.html to help you share this important information with your clients. IRS Tax Tip 2010-44If your mortgage debt is partly or entirely forgiven during tax years 2007 through 2012, you may be able to claim special tax relief and exclude the debt forgiven from your income. Here are 10 facts the IRS wants you to know about Mortgage Debt Forgiveness.

1. Normally, debt forgiveness results in taxable income. However, under the Mortgage Forgiveness Debt Relief Act of 2007, you may be able to exclude up to $2 million of debt forgiven on your principal residence.

2. The limit is $1 million for a married person filing a separate return.

3. You may exclude debt reduced through mortgage restructuring, as well as mortgage debt forgiven in a foreclosure.

4. To qualify, the debt must have been used to buy, build or substantially improve your principal residence and be secured by that residence.

5. Refinanced debt proceeds used for the purpose of substantially improving your principal residence also qualify for the exclusion.

6. Proceeds of refinanced debt used for other purposes – for example, to pay off credit card debt – do not qualify for the exclusion.

7. If you qualify, claim the special exclusion by filling out Form 982, Reduction of Tax Attributes Due to Discharge of Indebtedness, and attach it to your federal income tax return for the tax year in which the qualified debt was forgiven.

8. Debt forgiven on second homes, rental property, business property, credit cards or car loans does not qualify for the tax relief provision. In some cases, however, other tax relief provisions – such as insolvency – may be applicable. IRS Form 982 provides more details about these provisions.

9. If your debt is reduced or eliminated you normally will receive a year-end statement, Form 1099-C, Cancellation of Debt, from your lender. By law, this form must show the amount of debt forgiven and the fair market value of any property foreclosed.

10. Examine the Form 1099-C carefully. Notify the lender immediately if any of the information shown is incorrect. You should pay particular attention to the amount of debt forgiven in Box 2 as well as the value listed for your home in Box 7.

Paragon 5 is closer than ever to becoming a reality. A few months ago, Paragon 5 entered the Beta stage. The Beta stage signaled to us that we could open access to a few members who wouldn’t mind testing and finding some of the bugs that may have come from the development cycle. As the Beta cycle has progressed, we have been able to provide input back to the developers on how to make some of the new features even better. Our testers have done an amazing job with feedback and finding bugs.

Common Paragon 5 QuestionsQ: When is Paragon 5 coming?A: We do not have a definitive date set for the new software. NNRMLS is waiting until it is a stable and complete product before we release it to our entire membership. With only a few bugs remaining, we are almost ready.

Q: How much different will the new Paragon be from our existing software? A: “If you know how to do it in Paragon 4, you will know how to do it in Paragon 5”. The number one idea behind the design of Paragon 5 was to make the transition as easy as possible. Many enhancements have been implemented into Paragon 5, but the basic idea is the same.

Q: Is this the Paragon that will work on a Mac?A: Yes. Paragon 5 will work on the five most common browsers. Internet Explorer, Firefox, Chrome, Opera, and Safari (for Windows and Mac).

Q: Will this work on my iPhone, iPad, or tablet?A: Tablet devices will not be fully compatible initially. Many new smartphones are adverted as having “full web browsers”. This is not quite the case. While these new devices are able to show full size web pages and can run many websites with no problems, the web browsers are still scaled down versions from what is available on your desktop or laptop computer. Changes will be made to accommodate the new tablet devices shortly after full development is done.

Q. Will you offer training classes?A: Absolutely. NNRMLS will offer a wide variety of training classes for Paragon 5. We want everyone to know about everything that is available in the new system. We will hold many hands-on training courses in our lab at the office, but we will also take the training on the road. We have 10 computers ready to travel for hands on training through our region.

Q: Can I become a Beta Tester?A: Sure. NNRMLS will be glad to add you to the list of Beta Testers. We do require that testers attend a training class to see what is new and the potential bugs that may still exist. When our last bugs are fixed, we will open it up for everyone to preview. That’s why it is so important that you keep your e-mail address current with your Association, and also NNRMLS.

Please watch your e-mail for your monthly invoice and newsletter. If you make a change to your email, address, or phone number, notify your local Association immediately. They will notify us of the changes.

The top three notices that are sent on a daily basis are:

1. Incorrect Area 2. Remark Violations 3. No photo or sketch

Listings with an incorrect area means the listing cannot be easily shown and creates incorrect stats. We have Google area maps with NNRMLS area boundary overlays available on our member website at members.nnrmls.com under resources. They are very precise and can help you determine exactly what area your listing falls in. If you have any questions, you can always contact us at NNRMLS.

Remarks Violations usually include contact information or possible fair housing violations. The MLS Remarks and Extended Remarks are to be used for the description of the property. Please do not describe the potential purchaser. Private remarks are for agent-to-agent communication, such as information regarding the special conditions of sale or financing programs. Please do not enter the name of a company/bank or a representative. If you have special showing instructions you can place this information in Private Remarks only.

Listings with no pictures means your seller’s property will most likely be overlooked by potential buyers. Basic listing information including photos are sent to consumers in many ways, such as email notification, websites, etc. Research shows that consumers skim over a listing that does not display

photos, even if it is the best property on the market. They want to see pictures and not just one. We allow 5 days to upload your photos before being in violation, however we encourage you to upload the photo at the point you save the listing to maximize the exposure of your sellers property.

Correction Notice SpecificsCorrection notices are sent on a daily basis via email. Both the listing agent (and if applicable, the

second listing agent) and the designated broker receive the email. Members usually have 48 hours to correct the listing to avoid a citation/fine being assessed. If the listing is not corrected within 48 hours a fine will be assessed.

The correction notice will always state the Violation Level and the potential fine amount if not corrected by the due date. Only Level 4 violations carry fines that are automatically assessed without the 48 hour grace period. Level 4 fine amounts vary depending on the infraction.

A Level 1 citation starts at $100 and doubles every 7 days for 28 days. If the listing is not corrected by the 28th day the member is suspended and a fine of $800 is assessed. To have your MLS services reactivated the fine must be paid and the listing must be corrected.

A Level 2 citation starts at $250 and doubles every 7 days for 28 days. If the listing is not corrected by the 28th day the member is suspended and a fine of $1,000 is assessed. To have your MLS services reactivated the fine must be paid and the listing must be corrected.

A Level 3 citation starts at $500 and doubles every 7 days for 28 days. If the listing is not corrected by the 28th day the member is suspended and a fine of $4000 is assessed. To have your MLS services reactivated the fine must be paid and the listing must be corrected.

If you are assessed a fine, you have the right to appeal. You must correct the listing and then request a waiver of the fine in writing. You have thirty (30) days from the date you were assessed the fine to ask for the waiver. The request can be emailed, faxed, hand delivered or mailed.

Many of our Members are unaware of the numerous ways Paragon can be customized to make your time in Paragon more productive and efficient.

One of the more important places to begin customization is “User Preferences”. This section helps you personalize Paragon to the settings you choose. To get started, click on the “Preferences” button and then click on “User.”

Application section - This is the section where you can modify your Logo & Agent images by uploading an office logo as well as a picture of yourself. Simply click on either link to browse, find the pictures stored on your computer, then upload them. These images are vital because they add a personal touch to reports that your clients will receive.

Home section - You can customize the Market Monitor to show the most recent information on the specific areas or property classes of interest to you.

Search section - This section has two parts: The first is “Search Options” where you can customize mapping aspects. For example, you can choose map display or a custom starting address. The second part called “Search Result Options” is where you customize information displayed on reports.

These are just some of the many customization options available to you in the “User Preferences” section of Paragon. As always, we want to make sure you have all the training necessary to feel comfortable with the Paragon system. Basic skills needed for everyday work in the MLS System. Learn how to search by building and customizing the search parameters specifi c to your clients needs. Prerequisite for the other Paragon classes

Learn to use the most popular functions of the system; add prospects and send automatic emails based on individual search requirements. Let Paragon do the work for you! Prerequisite MLS201 or 3 months use

Learn all aspects of entering a listing into the Paragon system. Increase your awareness of the requirements to avoid citations. Learn how to add photos and how to maintain a listing once it’s entered. Prerequisite: None

Build a CMA package through Paragon that includes cover letters, resumes, multiple formats for comparables, the ability to add a subject property and more. Prerequisite: MLS 201 or 3 months use

Learn how to maximize and use all of the mapping features of Paragon, including map searching, Geojet, Re-geocoding and more.

Study Hall classes are 1-hour sessions where you control the content of what is taught. Stop by to get help with a quick question or stay for the whole hour - the choice is yours!

Our MLS classes are taught in the state-of-the-art computer training lab at the Northern Nevada Regional MLS offi ces at 5650 Riggins Court, Reno. A $25 “No-Show” fee will be billed to your account if a cancellation is not received 24 hours in advance.
