I.INTRODUCTIONTheWalkingHorseOwners'Association(WHOA)wasorganizedin1975.TheWHOABoardofDirectorsiscomposedoftwenty-sixmembers.Aspartofitsduties,theWHOABoardestablishesandformulatestheissuingofaWHOARulebook,thelicensingofWHOAjudges,andtheaffiliation/sponsorshipofWHOAhorseevents.Inordertoeffectivelycarryoutitsduties,WHOAhaspreparedandpublishedthisRulebook.Itisvirtuallyimpossibletocoveralleventualitiesintheformationofrulesandregulationstogovernanyworkingorganization,therefore,WHOAhastheultimateresponsibilityofinterpretingthemeaningandintentoftheseRulesanditsdecisiononanymattershallbefinal.TheseRulesmaybechangedandamendedfromtimetotimebytheWHOABoardofDirectors.AnysuchchangesshallbepublishedontheWHOAwebsiteandbreedpublications.Itistheresponsibilityofeachowner,trainer,breeder,andexhibitortoknowtheRulesofWHOA.Therefore,eachshouldcheckwiththeWHOAwebsiteorcontacttheofficeonaperiodicbasistoascertainwhetherornottherehavebeenanyRulechangeswhichmayaffectthem.TheWHOAofficewillbehappytoassistyouatanytime.Wealsowelcomeyourcommentsandsuggestions.Pleasereadallcross-referencescarefully.WalkingHorseOwners’AssociationP.O.Box4007Murfreesboro,Tennessee37129Phone:(615)494-8822Fax:(615)494-8825walkinghorseowners.com

II.WHOARULEBOOKPOLICYSTATEMENTWHOAactivelyprotectsandpromotesthewelfareoftheTennesseeWalkingHorse(TWH).Tothisend,WHOAiscommittedtothefollowing:
BeginningJanuary1,2015allTWHsexhibitedatWHOAhorseeventsmustberegisteredTWHswithTWHBEA/CANADARegistriesoranyotherregistryapprovedbyWHOA.(Exception:AllDayPleasureentriesandClassicAllDayPleasureentries.)HoofBandsinallclassesareprohibitedandarenotallowedontheshowgroundsatanyWHOAhorseevent.Onlycleargroomingproductsareallowedforuseashoofpolish.BlackoropaquehoofpolishisprohibitedatanyWHOAevent.Themaximumhooftoelengthwillbe5inches,exclusiveoftheshoe,measuredfromthecoronetband,atthecenterofthehoofalongthefrontofthehoofwalltothebottomofthehoof,atanyWHOAevent.Tungstenmetal(inwholeorpart)isprohibitedandnotallowedontheshowgroundsatanyWHOAevent.Horses5andunderareconsideredjuniorhorses.
III.WHOAPOLICYSTATEMENT
Ensuringthattheoverallandon-goingwelfareoftheTWHistheprimaryconcernofallowners,trainers,breeders,andexhibitors.Ensuringthatallowners,trainers,breedersandexhibitorstreattheirhorseshumanelyandwithdignityandrespect,andusepropercareintraining,handlingandshowingoftheTWH.Inhumanetreatmentofanyhorseoranyotheranimalonshowgroundsisstrictlyprohibited.Continuingtoworkwithgovernmentandindustryofficialstoensurethatthehigheststandardsofwelfare,safety,andhealtharemaintainedatalWHOAevents.
Developingandenforcingstringentrulesthatgoverntheexhibiting,judging,showing,andsellingoftheTWH,inorderthatthenaturalabilitiesoftheanimalsarebestreflected.Increasingawarenessoftherulesamongallowners,trainers,breeders,andexhibitorsemphasizingtheirresponsibilityforthewelfareandhumanetreatmentoftheTWHentrustedtotheircare.

IV.DEFINITIONS
A. AgeofHorse.Forhorseshowpurposes,ahorseshallbeconsideredtobeoneyearofageonthefirstdayofJanuaryfollowingthedateoffoaling.**ExceptionfoalsborninOctober,NovemberandDecemberareeligibleforclassesalongwithfoalsbornthefollowingcalendaryear.Amaturehorseisonethatissixyearsofageorover.
B. AffiliatedSales.AllsaleswhichhavebeenacceptedforthisprivilegebytheWHOAHIOoranyotheroftherecognizedHIOthatlicenseDQP’s.
C. AffiliatedShows.AllshowswhichhavebeenacceptedforthisprivilegebytheWHOAHIOoranyotheroftherecognizedHIO'sthatlicenseDQP's.
D. Affiliation.OrganizationswhoseshowsoreventsarenotsponsoredbyWHOAbutchoosetoaffiliatetheirshowsoreventswithWHOA.TheseshowsagreetoabidebytheWHOARulebook.Also,see“Sponsored”.
E. Classic(asrelatestoDivisions).Thehorsemustbesafe,pleasant,andmildmanneredshowingcompletecooperationwiththeexhibitor,appearingrelaxed,fluid,andsteady.
F. DesignatedQualifiedPerson(DQP).ApersonlicensedbytheWHOAHIOtodetect
horseswhichareinviolationandtootherwiseinspecthorsesforthepurposesofenforcingtheHorseProtectionActandWHOARules.
G. Event.WHOAHorseEventencompassesallshows,salesorexhibitionsaffiliatedorsponsoredwiththeWalkingHorseOwners’Association(WHOA).
H. Exhibitor.Anyrider,driver,handler,orcontestantwhoshowsorexhibitsanyhorseinahorseshow,horseexhibition,hosesale,orhorseauction.
I. Exhibiting.Forhorseshowpurposes,exhibitingmeansshowingincompletionatahorseshow,exhibitingahorseatasale,presentingtheNationalColorsatahorsehoworotherevent,oranyotherpublicexhibitionofahorse.
J. HearingCommittee.TheHearingCommitteeisestablishedtohearallegedviolations,imposepenalties,andanyothermattersthatWHOAmaydirect.
K. HeightofHorse.Theheightofallanimalsshallbestatedinhandsinsteadofinches.Ahandisfourinches.Maximumheightshallbereckonedassomanyhands"andunder"whileminimumheightsshallbereckonedas"over"agivennumberofhands.Measurementshallincludeahorse’sshoes.

L. HorseorPony.Theterm“horse”asusedintheserulesdenoteseitherahorseorapony.Whentheterm“horse”or“pony”isusedinprizelistsandcataloguesofshowsorsaleswhereheightisoneofthequalificationsoftheclass,theword“horse”shalldesignateanimalsover14.2handsandtheword“pony”shalldesignateanimals14.2handsandunder.Aponythatis14.2handsorundermaycompeteinclassesthatspecify14.2andunderaswellasclasseswithoutheightspecifications.
M. HorseProtectionAct(HPA).ThefederalHorseProtectionActof1970,asamendedbytheHorseProtectionActAmendmentsof1976,15U.S.C.§§1821etseq.
N. ImmediateFamily.Forhorseshowpurposes,theterm“immediatefamily”shallincludethefollowing:husband,wife,parent,stepparent,child,stepchild,brother,sister,halfbrotherandhalfsister,stepbrotherandstepsister,in-lawsofthesamerelationsstatedherein,grandparents,grandchildren,andanyadultwhosharesthesameresidencewithaprofessional.
O. KegShoe.Factorystamped(pouredorcast)hotorcoldrolledsteeloraluminumlighthorsebreed(nondraftbreed),nontoe-weightedkegshoe.Pouredorcastclipsifpouredintheoriginalcast(maynotbeweldedon).Pouredorcastheels,(caulks)ifpouredintheoriginalcast(maynotbeweldedon).Boriumisallowedonthetoe(11/2”wideatthetoeandspotsontheheelsnomorethan1/8”thick).
P. MeasurementofHeightEntries.Theexhibitorshallstandtheanimalonasmooth,levelsurface,insuchapositionthatthefrontlegsareverticalandthebacksofthehocksareinaverticallinewiththepointsofthehorse'squarters.Theheadshouldbeheldlowenoughtorevealthehighestpointofthewithersfromtheground.ThearmoftheMeasuringStandardshallbeplacedoverthehighestpointofthewithersandnomeasurementtakenatanyotherpartofthehorse'sbodyshallcount.TheStandardmustbeastraight,stiff,unbendablestickandshouldbeprovidedwithaplumbboborspiritleveltomakesurethestandardisperpendicularfromthewitherstothegroundandthatthecrosspieceisparallelwiththegroundsurface.
Q. Non-AffiliatedShow.AshowthatisnotaffiliatedwithanorganizationthatlicensesDQP'sandjudges,andpublishesacurrentrulebook.
R. Owner.Forhorseshowpurposes,theterm“owner”meansthepersonshownastheownerbytherecordsoftheregistryorapersonwhohasabonafideleaseonsaidhorse(whereleasesareallowed).
S. Pleasure(asrelatestoDivisions).Mustdisplayanelegantandcooperativewayofgoing,withsmoothperformanceandbrilliantaction.

T. ServiceableSoundnessforHorseShowPurposes.AllhorsesenteredataWHOAeventmustbeserviceablysound.Anyhorsethatappearstobeunhealthy,dehydrated,exhausted,painful,exhibitsalowbodyconditionscore,etc.,maybeclassifiedasunfittoshow.IftheserviceablesoundnessofanentryiscalledintoquestionbytheDQPorjudgetheyshallnotifytheofficialveterinarianandhisdecisionshallbefinal.Iftheofficialveterinarianisnotavailableorcalledon,thenthejudge’sdecisionastotheserviceablesoundnessofahorseshallbefinal.
U. ShowEmployees.Forhorseshow,saleorexhibitionpurposes,theterm“showemployees”shallincludeandrefertothefollowing:Managers,Announcers,Ringmasters,RingClerks,Farriers(Optional),andotherpersonsengageddirectlybytheshow.
V. Show/Sale/ExhibitionManagement.Forhorseshow,saleorexhibitionpurposes,theterm"showmanagement"shallrefertothepersonnelrepresentingthesponsoringorganization.
W. ShowOfficials.Forhorseshow,saleorexhibitionshowpurposes,theterm"show
officials"shallincludeandrefertothefollowing:ManageroftheShow,Judges,DQPs,Veterinarians,andTimekeepers.
X. SpecialtyClasses.Nocanterrequired.Alsocalled2-gait/nocanter.
Y. Sponsored.Whenitstates"Sponsored",intheRulebookitmeansthattheWHOAistheSponsorofthehorseevent.
Z. Suspensions.AllWHOApenalties,includingfinesandsuspension,willapplytoanyeventregardlessofhorseeventaffiliation.
AA. Unacceptable.AnyFlatShodhorseisconsideredtohaveanunacceptableimageifitexhibitsstifffrontlegs,crampyrearlegmotion,laboring,stumbling,unevennessinitswayofgoing,quickflippingofitsfrontfeet,orlandingonitsheels,or,repeatedlyrocksbackinthelineup.
V.AFFILIATIONRULESA. PROCEDURESFORAFFILIATINGAHORSEEVENT

1. Anyshowdesiringtoaffiliatemayapply,uponitsagreeingtouseonlyWHOAlicensedjudgesandapprovedHIOqualifiedDQPsinallsaddle,breeding,model,halterandequitationclassesandtoabidebyalltheRules,regulationsandproceduresofWHOARulebook.Whentherequestforaffiliationisreceived,anapplicationformandallnecessaryinformationwillbepromptlyforwardedtoShowManagement.Theappropriatefeemustbeincludedwithanyapplicationsubmitted.
2. Anysaledesiringtoaffiliatemayapply,uponagreeingtouseonlyqualifiedHIODQP'sandtoabidebyalltheRules,regulationsandproceduresofWHOARulebook.Whentherequestforaffiliationisreceived,anapplicationformandallnecessaryinformationwillbepromptlyforwardedtoSaleManagement.Theappropriatefeemustbeincludedwithanyapplicationsubmitted.
3. ToallowAffiliationapproval,applicationshouldbemadenotlessthan30dayspriortotheshowdate.
4. ShowManagementmustensurethatallparticipantsagreetobesubjecttotheWHOARuleBook.
5. ShoworSaleManagementshallfurnishWHOA/WHOAHIOwithin15daysaftertheshowthefollowing:
Paymentofinspectionfees.Copyofaproperlyexecutedclasssheet,showingallentriesandclasswinners,includingcompletenamesandaddressesofbothownersandtrainersonallhorsesinspected.Classsheetmustalsoincludetheregisterednameandnumberofthehorse,thetrainer’slicensenumber,andtheamateuroryouthcardnumber.(NotrequiredofSaleManagement)ShoworSaleManager'sReportontheformfurnishedbyWHOA/WHOAHIO.CopyofPremiumListand/orProgramorSaleCatalogue.Judges’Cardsiftheshowutilizedmorethanonejudge.
B. INSPECTIONFEES
AnyshoworsaleagreeingtoaffiliateherebyagreestocollectforWHOAHIOallappropriateinspectionfees.AscheduleofWHOAHIOinspectionfeeswillbeprovidedintheShowManager’sinformationalmaterialssentbyWHOA.C.PRIVILEGESOFANAFFILIATEDEVENT ListinginWHOA'sadvertisedscheduleofshowandsaledates.

CooperationofWHOAstaff,includingassistanceinobtainingtheservicesofjudges,judgeslist,andrulebookServicesofWHOABoardandHearingCommittee.ProtectionofShowManagementand/orSaleManagementthroughtheuseoflicensedWHOAHIODQP's,assetforthintheHorseProtectionAct(HPA)andtheRegulationsoftheUnitedStatesDepartmentofAgriculture(USDA).
VI.WHOARULESANDREGULATIONS
A. GENERALRULES
1. TheRulesoftheWHOARulebookshalltakeprecedenceovertherulesofanyothercommittee.Alldivisions,sectionsandclassesforwhichrulesareprovidedhereinmustbeconductedaccordinglyandshallnotbeheldunderanyrulesthatarenotinagreement.
2. Everyhorseeventandeverypersonparticipatingthereinincludingexhibitor,owner,lessee,manager,agent,rider,driver,handler,contestant,judge,DQP,showofficial,oremployeeissubjecttotheWHOABylawsandRulesofWHOARulebookandtothelocalrulesoftheshow.EverypersonparticipatinginanyshowrecognizedbyWHOAissubjecttotheprovisionsofWHOAwhetherornottheparticularclassinwhichheorsheparticipatesisoperatedunderWHOARules.
3. AllhorseeventswillbegovernedentirelybyWHOARuleBookineffectatthetime.ItisShowManagement’sresponsibilitytoknowandadheretothecurrentWHOARuleBook.
4. ClassInterruptions.Intheeventthataclass,inwhichhorsesorexhibitorscompete,whethertogetherorindividually,isstoppedwhileinprogressduetostorm,accidentorotheremergency,thefollowingprocedureshallgovern:
a. Iftheclassiscontinuedatasucceedingsessionoftheshow,itshallbeheldoverinitsentirety.
b. Ifclassesarepostponedtoadaynotincludedintheoriginalshowdates,exhibitorsareentitledtoarefundofentryfeesandarerelievedofanyobligationtoshowbackinpostponedclasses.

5. Sweepstakes.WhenaSweepstakesClassisoffered,providingforadivisionofentryfees,eitherwithorwithoutmoniesaddedbytheshowcommittee,thetotaltobedistributedshallincludetheentryfeesofallentrieslistedinthecatalogueorontheclasssheet,whetherornotthehorsesareshown,unlessashowstipulatesinitsprizelistthatportionoftheentryfeeswhichwillbewithheld.
6. ServiceableSoundnessforHorseShowPurposes.Allhorsesshownatashowmustbeserviceablysound.Anyhorsethatappearstobeunhealthy,dehydrated,exhausted,painful,exhibitsalowbodyconditionscore,etc.,maybeclassifiedasunfittoshow.IftheserviceablesoundnessofanentryiscalledintoquestionbytheDQPorjudgetheyshallnotifytheofficialveterinarianandhisdecisionshallbefinal.Iftheofficialveterinarianisnotimmediatelyavailableorcalledon,theJudge'sdecisionastoserviceablesoundnessofahorseshallbefinal.
7. ChallengeTrophies.
a. Achallengetrophyisatrophydonatedtoorofferedbyashow,whichmustbewonaspecifiednumberoftimesunderspecifiedconditionsinordertobepermanentlyretired.WhenoriginallyplacedincompetitionitbecomesthepropertyoftheShowManagement,andcannotbewithdrawnbythedonor.
b. Perpetualtrophiesarenevertoberetired.
c. Theconditionsunderwhichachallengetrophymayberetiredshallnotbechangedwithouttheconsentofthetrophydonororhisorherlegalrepresentativeandofallpreviouswinnerswhohavequalifiedaspotentialwinnersofsuchtrophy,exceptintheeventthattheconditionsstipulatedareinconflictwiththecurrentRulesofWHOA.Insuchanevent,theShowCommitteeshallconferwithWHOARulebookastoprocedure.
8. PrizeLists.
a. Iferrorsarediscoveredpriortothedateoftheshow,exhibitorsshouldbenotifieduponreceiptofentries,orinwritingwhentheyarriveattheshow.
b. Ifclassesareaddedorpremiumsincreased,exhibitorsshouldbenotifiedinwritingatleastfivedayspriortotheshow.Postentriesmustbeacceptedinsuchclasses.
9. Stallions.Stallionsmaybeshownbyanadultinanyclassinanydivision.Youthexhibitorsmaynotshowstallionsinanyclassexceptweanlinghalterclasses.
10. RetirementCeremonies.Intheeventthataretirementceremonyshallbeallowedattherequestoftheownerofahorse,saidhorseshallnotbepermittedtocompeteatthatshow.Anyhorsethusofficiallyretiredshallbebarredforlifefromfurthercompetition,exceptbyspecialpermissionofWHOA.

11. TimeSchedules.
a. Theannouncedorderortimeforclassesshallnotbechangedunlessnoticeisgiventoexhibitors,Judge(s)andDQP(s)affected.
b. Providedtheorderofeventsisnotchanged,ShowManagementshallhavetheprivilegeofcallinganyclassupto30minutesaheadofitsscheduledtime.Exhibitorsshouldbereadyforclassesinreasonabletimeandmaynotprotestsuchadvanceofschedule.
c. Whenitisfoundthataclassisbeingdelayedbyhorsesnotbeingreadytoperform,theentrancegatemaybeclosedattheorderoftheJudge(s)orShowManagement,providedwarningisissuedandexhibitorsaregiventhreeminutesinwhichtoappearattheentrancegatereadytoparticipate.Judgingshallnotcommenceuntilthegateisclosed.Anofficialtimermustbeappointedtoenforcethisrule.
12. ClassesforHorseandExhibitor.Inaclasswheretheperformancesofbothhorseandexhibitorareconsidered,thehorseandexhibitortogethershallconstituteanentry.
B. ENTRIES
1. InorderfortheDQPtoinspecthorses,allclassentrysheetsmustcontainthefollowinginformation:
a. TennesseeWalkingHorseClasses:

6. CancellationorWithdrawalofEntries.Ashowmayadoptitsownpolicycoveringtherefundingoffeestoanexhibitorwhocancelshisorherentriespriortotheshow'sbeginning.
7. FeesandFines.AllfeesandfinesshallbepaidinU.S.currencyanddrawnfromaU.S.bank.Anyreturnedchecksshallresultinanadditionalchargeorfee,asdeterminedbyWHOAanddisclosedinthescheduleoffeesprovidedintheShowManagersinformationmaterials.
8. UnpaidAccounts.Anyexhibitor,ownerortrainerwhofailstopayanyaccount(s),finesorservicechargeduetoShowManagement,HorseSalesManagementorWHOAshallbesubjecttosuspensionbyWHOA.Uponreceiptofnoticethatatrainer,exhibitororownerhasnotpaidallaccountsorchargesowedasaresultofparticipationinsaidshoworsale,WHOAshallnotifysaidperson,firmorcorporationthatsettlementmustbemadewithinfifteen(15)daysorhe,sheoritshallbesuspendeduntilsaidaccountsorchargesarepaidinfull.Ifapersonotherthananowner,exhibitorortrainerwasresponsibleformakingsaidchargesatanyshoworsale,thentheowner,trainerorexhibitoronwhosebehalfsaidchargesweremadeshallbesubjecttosuspensionuntilsaidaccountispaidinfull.
9. RefusalofEntries.
a. InadditiontoentriesofpersonssuspendedorexpelledbyWHOA,ShowManagementmayreservetherighttorefusetheentryofanexhibitorwhohasdemonstratedunsportsmanlikebehavioratashoworhasconductedhimselforherselfinamannerwhichbringsdiscredittotheshow,itsmanagement,officials,oremployees,providedthattheexhibitorsoexcludedshallhavetherighttobeheardontheissuebyShowManagementbeforetherefusalofentryismade.TheexcludedexhibitorshallhavetherighttoappealthedecisionofShowManagementtoWHOABoardofDirectors,whichmayoverrulethedecisionofshowmanagementbytheofficialvoteof75%oftheboardinattendance.
b. Showmanagementmayrequireahorsetoqualifyforentryintheshowormaysetalimitastothenumberofentriesthatwillbeacceptedinanyclassordivision,providedthemethodtobeusedissostatedintheprizelist.
10. Leases.AnofficialwrittenandnotarizedleaseofaregisteredTWHhorseshallbeconstruedasbonafideownershipandmustbeonfilewiththeWHOAentryoffice.
11. Pleasure/Classic.WhenclassesintheTrail,Country,andAllDayDivisionsaredividedintoPleasureandClassicPleasure,itissuggestedbyWHOAmanagementthatthePleasuredescriptionbeusedandstatedintheshowprogram.IntheLiteShodDivision,whichisdividedintoLiteShodandClassicLiteShod,thesameprocedureissuggested.

InkeepingwithtraditionandthepolicyofWHOA,allriders,driversandhandlersmustbecorrectlyattiredfortheclassesinwhichtheycompete.Allattendantsmustbeneatlydressedandallgroomsbeproperlyattiredwhenenteringtheshowring.Anyattireadvertisingahorseisprohibitedintheshowring.Showmanagementmay,atitsdiscretion,baranyentryorpersonfromenteringtheringifnotsuitablypresentedtoappearbeforeanaudience.Theexhibitor’shairmustbeneatandwell-groomed,longhairshouldbestyledsothatthebacknumbercanbeeasilyseen.Safetyhelmetsareallowedinallclassesonanyexhibitor.
Anyexhibitornotmeetingattirerequirementsmustbepenalizedinfinaljudging.

7. ArtificialMarkingsandAppliances.Anychangeincolorofmarkingsotherthanmaneortailisprohibited.Onlycleargroomingmaterialsareallowedonthehide,hairandhooves.Blackoropaquehoofpolishisprohibited.Allartificialappliancesotherthanthosesetforthinthissectionareprohibited.Refertopenaltysection.
8. Whips.WhipsoffourfeetorlessincludingthesnapperareallowedinanyclasswhereEnglishattireandequipmentareused.Whipsuptosixfeetinlengtharepermittedinanyclassinwhichthehorseisdriven,nolashesorappendagesoranyotherappliancesofanykindarepermittedtobeattachedtothewhip.Awhipofthiskindisnotpermittedinawarmupringorshowring.Nowhiporanyotheritemmaybehandedacrosstherailtoanexhibitor.
9. Ifthebacknumberoftheexhibitorismissingwhenenteringtheringitmustbehandedtotheringmastertobegiventotheexhibitor.Noitemmaybeused,insideorfromoutsidethering,whileshowingahorse,exceptonewhipperhandler,nolongerthanfourfeet,includingthesnapper.Refertopenaltysection.
10. HoofBands.Metalhoofbands,suchasusedtoanchororstrengthenpadsandshoesarenotpermitted.Hoofbandsareprohibitedandarenotallowedonshowgrounds.
11. ToeMeasurement.Toelengthmustexceedtheheightoftheheelbyoneinchormore.Thelengthofthetoeshallbemeasuredfromthecoronetband(wherehardandsoftmaterialmeet),atthecenterofthefrontpasternalongthefrontofthehoofwalltotheendofthetoe.

Acrylicmaybeusedtorepaironehoofonlytomendahoofwheretheshoehasbeenthrownandthehoofhasbeendamaged.Acrylicmaybeusedtofillinaroundthenailholesorcracksonthesideofthehooves.Acrylicoranyothermaterialmaynotbeusedforthepurposeofextendingthelengthofthenaturalhoofinanymanneronbothfeet,whichincludesthetoesorheels.

Itismandatorythatthejudgepostanypattern(s)tobeworkedatleastonehourpriortothecommencementoftheclass.Pattern(s)shouldbedesignedtotesttheexhibitor'sabilitytoeffectivelypresentahorsetothejudge.Alltieswillbebrokenatthejudges’discretion.
b. Theexhibitormustleadonthehorse’sleftsideholdingtheleadshankintherighthandnearthehalterwiththebightoftheleadneatlycoiledinthelefthand.Itispreferablethattheexhibitor’shandnotbeonthesnaporchainportionofthelead,andtodososhouldbepenalized.Whenleading,theexhibitorshouldbepositionedbetweentheeyeandthemid-pointofthehorse’sneck,referredtoastheleadingposition.

Botharmsshouldbebentattheelbowwiththeelbowsheldclosetotheexhibitors'sideandtheforearmsheldinanaturalposition.Heightofthearmsmayvarydependingonthesizeofthehorseandexhibitor,butthearmsshouldneverbeheldstraightoutwiththeelbowslocked.Thepositionoftheexhibitorwhenexecutingaturntotherightisthesameastheleadingpositionexceptthattheexhibitorshouldturnandfacetowardthehorse’sheadandhavethehorsemoveawayfromthemtotheright.Whenexecutingaback,theexhibitorshouldturnfromtheleadingpositiontofacetowardtherearofthehorsewiththerighthandextendedinfrontoftheexhibitor’scheststillmaintainingslightbendintheelbowandwalkforward.Ideally,theexhibitors'leftshouldertobeinalignmentwiththehorses'leftfrontleg.Whensettingthehorseupforinspection,theexhibitorshouldstandangledtowardthehorseinapositionbetweenthehorses’eyeandmuzzle,andshouldneverleavetheheadofthehorse.TheexhibitormustusetheQuarterMethod(seediagram)whenpresentingthehorse.Theexhibitorshouldmaintainapositionthatissafeforthemselvesandthejudge.Thepositionoftheexhibitorshouldnotobstructthejudge’sviewofthehorseandshouldallowtheexhibitortomaintainawarenessofthejudge’spositionatalltimes.Theexhibitorshouldnotcrowdotherexhibitorswhensettingupside-by-sideorhead-to-tail.Whenmovingaroundthehorse,theexhibitorshouldchangesidesinfrontofthehorsewithminimalstepsandshouldassumethesamepositionontherightsideofthehorsethattheyhadontheleftside.Leading,backing,turningandinitiatingtheset-upshouldbeperformedfromtheleftsideofthehorse.Atnotimeshouldtheexhibitoreverstanddirectlyinfrontofthehorse.Theexhibitorshouldnottouchthehorsewiththeirhandsorfeet,orvisiblycuethehorse.Whipsareprohibited.

PRESENTATIONOFTHEHORSE:Thehorses’bodyconditionandoverallfitnessshouldbeassessed.HorsesmaybepresentedineitherEnglishorWesterntack,dependingontheattireoftheexhibitor,butneveracombinationofboth.Awell-fittedhalterwillbeused.Whenexhibitinginahalter,achainshankmaybeusedinahumanemanner,butneverthroughthemouth.Thehaircoatshouldbeclean,well-brushedandingoodcondition.Themane,tail,forelockandwithertuftmustbewellconditionedandgroomed.Thelengthofmaneandtailmayvary,aslongastheyareneat,cleanandfreeoftangles.Thebridlepath,eyebrows,andlonghairontheheadandlegsmaybeclipped,exceptwheregovernmentregulationsprohibit.Thehoovesshouldbeproperlytrimmedandifshod,theshoesshouldfitcorrectlyandclinchesshouldbeneat.Hoovesmustbecleanandmaybewithhoofdressings,orshownnaturally.Alltackshouldfitproperlyandbeneat,cleanandingoodrepair.HorsesshownunderEnglishtackshouldbebraidedwithribbonsasiscustomaryforthatdiscipline,whilehorsesshownunderWesterntackshouldshowastraditionallows.
e. PERFORMANCE:Theexhibitorshouldperformtheworkaccurately,precisely,smoothly,andwithareasonableamountofspeed.Increasingspeedoftheworkincreasesthedegreeofdifficulty,however,accuracyandprecisionshouldnotbesacrificedforspeed.Thehorseshouldlead,stop,back,turnandsetupwillingly,brisklyandreadilywithminimalvisibleoraudiblecueing.Aseveredisobediencewillnotresultinadisqualificationbutshouldbepenalizedappropriately,andtheexhibitorshouldnotplaceaboveanexhibitorthatcompletesthepatterncorrectly.Excessiveschoolingortraining,willfulabuse,lossofcontrolofthehorsebytheexhibitor,failuretofollowprescribedpattern,knockingoverorworkingonthewrongsideoftheconesshallbecausefordisqualification.
Thehorseshouldbeleddirectlytoandawayfromthejudgeinastraightorcurvedlineandtrackbrisklyandfreelyattheprescribedgaitasdictatedbythepattern.Thehorse’sheadandneckshouldbestraightandinlinewiththebody.Allhaltsshouldbestraight,prompt,smoothandresponsivewiththehorse’sbodyremainingstraight.Thehorseshouldbackreadilywiththehead,neckandbodyalignedinastraightorcurved

ii Toobtainthisposition,theridershouldsitcomfortablyinthemiddleofthesaddleandfindhis/hercenterofgravitybysittingwithaslightbendattheknees,withouttheuseofthestirrups.Atthisposition,thestirrupsshouldfallatorslightlybelowtherider'sankle.Whiledoingthis,havestirrupleathersadjustedtofitsothatironswillbeunderballoffootwithevenpressureonentirewidthofsoleandcenterofiron.
iii Thefootpositionwillbenaturalandcomfortableifthekneeandthigharerolledinwardandtheheelislowerthanthetoes,withtoespointingstraightahead.Fromthefrontorrearview,thelowerlegwillbeheldnaturallyawayfromthehorse,dependingontheanatomyoftheriderandthesizeofthehorse.Atnotimeshouldthereeverbeanyspaceordaylightbetweentherider'skneeandthesaddle.

2. GUESTJUDGES.AGuestJudgeisanindividual21yearsofageorover,notenrolledasaJudgewithWHOAtowhomWHOAmaygrantpermissiontoofficiateupontherequestofaparticularshowforVersatilityDivisionandEquitationandShowmanshipDivisionsandforthatshowonly.ThefeeforaGuestJudgeshallbedeterminedbyWHOAandisnotrefundable.Theapplicationmustbemadeontheofficialformprovidedforthatpurposeandmustbeaccompaniedbytherequiredfee.ThestatementontheformthattheshowholdsitselfresponsiblethattheindividualappliedforisfamiliarwithWHOARulesandiscapabletoadjudicateasrequested,mustbesignedbyShowManagement.WHOAExecutiveDirectorandJudgesCommitteewillhavetheauthoritytograntguestjudgepermit.RestrictionsofaGuestJudge:

B. LICENSINGPROCESS
Allpersons21yearsofageorolderdesiringtobelicensedbyWHOAasaJudgeofFlatShodhorses,versatility,halterorequitationclassesshallsecureandcompleteanapplicationfurnishedbyWHOA.ApplicationmustbemadeonanofficialWHOAformandaccompaniedbytherequiredfee,whichisnotrefundable.Noapplicationshallbeconsideredifincompleteand/orfailstomeetthedeadline.AlljudgesmustbemembersingoodstandingoftheWHOA.

IndeterminingthequalificationsofanapplicantforaJudge'slicense,theevidencetobeconsideredbytheWHOAExecutiveDirectorandtheJudgesCommittee,shallbealloftheevidencepresentedtoWHOAbytheapplicant,suchevidenceasWHOAmayotherwiseobtainandanyotherfactswhichmaybeintheapplicant'sfile.ExceptasotherwisehereinandafterprovidedintheseRules,nopersonshalljudgeataWHOAshowunlessheorsheholdsavalidlicense.AWHOAjudge,priortobeinggrantedalicenseorrenewedlicense,shallberequiredtosignanoathofofficeandstandardsofconduct.
C. RULESANDRESPONSIBILITIESOFAJUDGEAJudgeisobligatedtoadjudicateeachclassinconformitywiththeRulesandspecificationsofthatclassastheyappearintheWHOARuleBook.HeorsheisexpectedtobeproficientandtopossessathoroughknowledgeoftheRulesofWHOA.
Onceaclasshasbeenjudged,itshallnotbere-judged,andoncetheJudgehasmarkedhisorherrecordsandplacesforawardsmade,thereshallbenochangingoftheJudge’srecord.FailureofaJudgetoattendashowtowhichheorsheiscommitted,toperformhisorherduties,andtoofficiateintheclassestowhichheorsheisassignedshallconstitutecausefordisciplinaryaction,exceptincasesofextremeemergency.AJudge,byacceptinganinvitationtoofficiateashow,assumesaresponsibilitytoprotectShowManagementbyexcusingfromtheringallhorsessuspectedofbeinginviolationoftheHPAandWHOARules.AsstatedintheWHOARuleBook.WhenaJudgeisofficiatingatashow,heorsheisnottoarriveonshowgroundsuntilthirty(30)minutespriortoshowtime.Anynecessarycommunicationbetweenajudgeandanexhibitorduringaclassmusttakeplaceinthepresenceofaringmasterorshowmanagement.AnyJudgeselectedtoofficiateatashowshallnotbecontactedrelativetothisshowbyanypersonhavinganinterestinanyhorseexpectedtobeshownatsuchshow.AllcontactsmadeinviolationhereofshallbereportedimmediatelytoWHOAExecutiveDirectorbysaidJudge.ItistheresponsibilityofaJudgetoreportanyviolationtoWHOAExecutiveDirector.Telephonecallsfromtrainers,exhibitors,etc.aretobereportedtotheWHOAExecutiveDirectorandJudgesCommitteewhomayfileacomplaintagainsttheallegedviolator.TalkingtoorcriticizingaJudge(s)ataWHOAaffiliatedorsponsoredeventisaviolationandJudge(s)oranyothershowofficialthatarewitnesstosuchanincidentmustreporttheviolationtotheWHOAExecutiveDirectorortheJudgesCommittee.TheJudgeorothershowofficialhasnochoiceexcepttoreporttheviolation.

AllJudgeslicensedbyWHOAmustconductthemselvesinamannerthatreflectscredituponWHOA,thehorseshow,andtheTWH.Inallclassesinwhichahorseisshownundersaddle,thehorsemustperformallgaitsinordertobejudgedinoverallperformance,presentationandconformation.Anentrymay,atthediscretionoftheJudge,beexcusedfromtheringforanyinfractionornon-complianceofWHOARulesorfordeviatingfromthedescribedgaitsoftheWalkingHorse.Theentryshallbeeligibletoshowinasucceedingqualifyingclassiftheproblemcanbecorrected.
D. REGULATIONSGOVERNINGJUDGES
AJudgeshallnotbeanexhibitorormanageratanyshowatwhichheorsheisofficiating.AJudgeshallnotadjudicateinanyshowinwhichamemberofhisorherfamily,immediatefamily,oranyco-owner,oranyhorsestheyownortrainarecompeting.
AJudgeshallnot,duringtheperiodofashowatwhichheorsheisjudging,bethehouseguestofapersonwhoisexhibitingintheshow,orwhosefamilyisexhibitingatsuchshow.NohorsemaybeshownbeforeaJudgethathasbeensoldbysaidJudgeorbyhisorheremployerwithinaperiodofthirty(30)dayspriortotheshow.NohorsemaybeshownbeforeaJudgethathasbeenboarded,owned,trainedorshownbysaidJudgewithinaperiodofthirty(30)dayspriortotheshow.NohorseforwhichaJudgehasactedinthecapacityofagent,and/orhascollectedacommissionastheresultofasale,maybeshownbeforethatJudgewithinthirty(30)days(excludinghorsesboughtthroughapublicauctionwherethatJudgewassalemanagerorownerofthatpublicauction,andthisistheonlyconflictaccordingtotherules.)NooneortheirimmediatefamilymayshowbeforeaJudgewhereeithertheJudgeorexhibitorhasremuneratedtheotherpersonfortheleasing,boarding,riding,training,consulting,schooling,assistingortutoringofanyhorsewithinaperiodofthirty(30)dayspriortotheshow,studfeesexcluded.
NoexhibitormaycompeteinanEquitationClassbeforeaJudgewithwhomhisorherparent,guardianorinstructorhashadanyfinancialtransactioninconnectionwiththesale,lease,boardingortrainingofahorsewithinthirty(30)dayspriortotheshow,unlessthesaleorpurchasewasmadeatpublicauction.NoexhibitormaycompeteinanEquitationClassbeforeaJudgebywhomheorshehasbeeninstructed,coachedortutored,withorwithoutpay,withinthirty(30)dayspriortotheshow.Theconductingofclinicsorassistanceingroupactivities,unlessindividualinstructionisgiven,isnotconsideredtobeinstructing,coaching,ortutoring.RemunerationandexpensespaidtoaJudgeshallnotaffecttheamateurstatusoftherecipientasanownerorexhibitor.

AnexhibitormaymakearequestthroughShowManagementfortheJudge’sopinionconcerningthatexhibitor’shorse.Therequestmustbemadeattheconclusionoftheshow.ItisurgedthattheJudgewillgivehisorheropinioncourteouslyandsincerelyinthepresenceofShowManagementandinaprivatesetting.
AWHOA-approvedJudgeshallbetreatedwithcourtesy,cooperationandrespect.Noperson,exhibitor,ownerorotherwise,shalldirectabuseorthreateningconducttowardthem,eitherinthefurtheranceoftheirjudgingduties,orasaresultthereof,whetherornottheconductoccursduringanapprovedeventorshow,oronshowgrounds.TheJudgehasnochoiceexcepttoreporttheviolationtoWHOA.AWHOAlicensedjudgeisnotallowedtojudgeanon-affiliatedTWHhorseshow.(SeeIV.Definitions,Q.)
E. DISCIPLINARYACTIONSAfteraJudge’slicensehasbeenissuedtoanyperson,andsuchJudgeshalldemonstratelackofcompetence,skill,integrity,cooperation,orthedesiretodeporthimselfinamannerastobeworthyofaJudge,thelicenseofsuchJudgemaybesuspendedorrevokedbyWHOAExecutiveDirectorandtheJudgesCommittee,inthemanneranduponsuchnoticeasishereinprovided.
ForfeitofLicense:JudgesholdingalicensewithWHOAwhohaveanindebtednesstoahorseshoworsaleofrequiredfeeswhichare30dayspastduewillresultinthelossoflicenseforoneyearandtheindebtednessrecordwillbefiledinJudge’sfile.Heorshemayre-applyforlicensethefollowingyearafterindebtednessispaidinfull.
F. GENERALJUDGINGPROCEDUREAllhorsesshallentertheringattheflatwalk,shallgototherightandmaythengoateaseuntiltheclassiscalled.ThegatewillbeclosedwhentheJudgecallsforthefirstgait,andnoentryshallbeadmittedintotheringafterthegateisclosed.TheJudgethenshallcallforTWHgaitsinthefollowingorder:flatwalk,runningwalk,flatwalkandorcanter.Whenhorsesarereversed,theordershallbe:flatwalk,runningwalk,flatwalkand/orcanter.ThesecondrunningwalkmaybecalledforthelastwayoftheringasthelastgaitattheJudge'sdiscretion.Asthehorsesentertheringandatanytimeduringtheclass,theJudgemustobservetheirwayofgoing,andifhefindsthatanentryisinnon-complianceassetforthintheHPAandRulesasstatedintheWHOARuleBook,hemustexcusetheentryimmediately.HorsesshallbeworkedbothwaysoftheringatallrequiredgaitssufficientlyforallhorsestohaveperformedbeforeeachofficiatingJudge.Horsesmustperformallrequiredgaitsbothwaysofthering.Ahorsethathasnotperformedallrequiredgaitsshallnotbeplacedoverahorsethathasperformedallgaits.

Horseshoworhorseexhibitionworkoutsorperformancesof2-yearoldTennesseeWalkingandRackingHorsesandworkingexhibitionsof2-yearoldTennesseeWalkingandRackingHorses(horseseligibletobeshownorexhibitedin2-yearoldclasses)athorsesalesorhorseauctionsthatexceedatotaloften(10)minutescontinuousworkoutorperformancewithoutaminimumfive(5)minuterestperiodbetweenthefirstsuch10(ten)minuteperiodandthesecondsuchten(10)minuteperiodand,morethantwosuchten(10)minuteperiodsperperformance,class,orworkoutsareprohibited.Afterthepreliminaryworkoutofaclass,allhorsesshallbelinedupandinspectedbytheJudge,unlessaqualifiedRingmasteroraqualifiedOfficialoftheShowispresent.Inthejudgingofaclass,aJudgemakesthefinaldecision(onpossibleRuleviolations)aswhethertoexcuseahorseorpermitittoremainintheclass.IftheJudgefindsthatanentrydoesnotconformtotheHPA,theWHOAunacceptablerule,orRulesasstatedintheWHOARuleBook,hemustexcusetheentryimmediatelyandtheentrymustreporttotheDQPimmediately.AtthediscretionoftheJudge,onegroommaybeallowedintheringduringthelineupinDrivingandYouthExhibitorClassesonly,forthepurposeofaiding,assistingandencouragingtheexhibitor.Thegroommaynottouchthehorsebelowtheknees,unlessdirectedtodosobytheJudge.InChampionshipClasseshorsesmaybestrippedforconformationatthediscretionofJudgeorShowManagement.GroomswillnottouchthehorseortackbelowthekneesunlessdirectedtodosobytheJudge.InChampionshipClasses,twogroomswillbeallowed.Noequipmentshallbehandedtoanexhibitoracrosstherailonceheorsheenterstheshowring.Violationofthisruleresultsinimmediatedisqualificationfromtheclass.Time-outsinterruptashow;thereforeunauthorizedtime-outswillnotbepermitted.Duringtheclass,ifaquestionarises,communicationmustbemadethroughtheringmastertothejudge.Anexhibitordesiringatime-outwillridetothecenterofthering,remainmountedandrequestitoftheJudge.TheJudgewillascertainthereasonforthetime-outandeithergrantordenytherequest.Afteranexhibitorpullsinonthegrass,heorshemustobtainatime-outbeforedismounting.FailuretodososhallrequiretheJudgetoexcusetheentry;theJudgehasnodiscretioninthisregard.Further,theentranceofatraineroranassistantintotheshowringbeforeatime-outisgrantedshallrequiretheJudgetoexcusetheentry.ThesoleexceptiontothisRuleshallbeahorseand/orexhibitorinimmediatedangerofinjuryintheopinionoftheJudge.
IftheJudgegrantsatime-out,horsesontherailwillgoatease,andagroomorfarrierwillbeorderedinasrequired.Theexhibitormaythendismount.Exhibitorsgrantedatime-outmaynotmakeadjustmentstoanyequipmentotherthanthatforwhichthetime-outwasauthorizedexceptforsuchadjustmentsastheycouldmakewhilemounted.Curbchainsmaynotbeadjustedatanytime.

Exhibitorsateaseontherailduringtime-outsmaymakesuchadjustmentsastheycanmakewhilemounted,butassistanceovertherailisnotpermitted;physicalassistance(touchingthehorse)isnotpermittedandwillresultinthehorsebeingexcused.Curbchainsmaynotbeadjustedatanytime.
IftheJudgefindsthereasonforatime-outnotvalid,heorshemustordertheentrybacktotherailimmediately.
Time-outsmaybegrantedbytheJudgeforreplacementofshoes,replacementofbrokenequipment(e.g.,partiallythrownshoe),orinotherinstanceswheretheJudgefindsreasons.Inanydivision,ashoethrownintheringmustbepresentedimmediatelytotheJudge&DQPforhisinspection.Ifaviolationisfound,thehorseisdisqualifiedandaticketiswrittenbytheJudge,whoshouldretaintheshoeandturnitovertotheDQP.Time-outsforadjustmentsofequipment,suchascurbchainsorbridlesarenotallowed.
Atotaloftenminutesinaggregateshallbeallowedforeachentryforauthorizedtime-outs,butnomorethantwotime-outsperclassperhorse.Alltime-outswillbeginwhenjustifiablereasonsareacknowledged,exceptforthereplacementofshoes,inwhicheventthetime-outshallbeginthemomentthefarrierliftsupthehorse'sfoot.Timewillbeallowedpriortothebeginningoftime-outforlocatingthrownshoe.
Intheeventahorsethrowsashoeinthewarm-upareaafterbeinginspectedbytheDQP,heorshemaychoosetohavetheshoereplacedbytheshowfarrierafterheorsheenterstheringtoshow.Heorshemustbechargedwithatime-out,withnormaltime-outrulesprevailing.
Workouts.AllhorseschosenforaworkoutmustbeworkedbothwaysoftheringateachgaitaskedforbytheJudge.AJudgeshallnotplaceanyentryinaworkoutunlesstheentryhasperformedallrequiredgaitsbothwaysoftheringintheinitialperformance.Horsesnotmakingthegoodworkoutinitiallydonothavetobeworkedbothwaysofthering.AnyJudgeignoringthisruleshallhavesubjectedhimself/herselftodisciplinaryactionbyWHOAExecutiveDirectorandJudgesCommittee.Workoutsshallbejudgedasaseparateclass.Exception:EquitationClassesFalls.Anexhibitorisconsideredtohavefallenwhenheorsheisseparatedfromahorsethathasnotfalleninsuchawayastonecessitateremountingorvaultingintothesaddle.Ahorseisconsideredtohavefallenwhentheshoulderandhaunchonthesamesidehavetouchedtheground.Thefallofahorseand/orexhibitorshallnotdisqualifytheentry,unlessduetobadmannersofthehorseorunlessthesafetyoftheexhibitoristhreatened.Exception:InEquitationClasses,thefalloftheexhibitordisqualifiestheentry.UnrulyHorse.Horsesbeingunruly,rearingup,balking,runningoff,orleavingtheringmustbeexcused.

1. MajorityOpinionThree-JudgeSystem.UndertheMajorityOpinionSystem(M-O-S),allthreeJudgescarryequalweightinthefinalclassdecision,andwinnersareplacedbythebesttwooutofthreevotes.Eachhorseisjudgedasifitwereworkingindividuallyandthencomparedwiththeperformanceofallotherhorsesintheclasswhoarejudgedonthesamebasis.AllJudgesplacethesamenumberofentriesineachclass,dependingonclasssize.TiesareresolvedbyaveragingtheopinionsofthethreeJudges.
a. Judging.Judgesmustworkindependently,withnodiscussionofanykinduntilthewinnersareannounced.Theyshouldvarytheirjudgingpositionsandrotatearoundthering.Theyshoulddiscussandplanhowtocovertheringandworkclassesbeforetheshowtoavoid"cluster"judging.Asuggestionwouldbetosectiontheringintothreeareas,whichwillgiveeachJudgeaseparatebutequalviewoftherailwithrotationofpositionsforeachclass.
b. Rotation.MarktheJudges'cardsaheadoftimewiththerotationandindicatewhowillbeCallJudgeforeachclass.Norefereeisrequiredsincealltiesarebrokenbyatwo-thirdsmajorityvote.
c. Placings.MarktheJudges'cardsaheadoftimeindicatinghowmanyentriesshouldbeplaced.Threeadditionaltiesarerecommendedforeachclass.(Tie11horsesinaclassinwhich8horsesreceiveawards.TheRingmastershouldreturnanincompletelytiedcardtotheJudgeforcorrectionbeforegivingittotheScorer(s).
d. Workouts.AnyJudgemayrequestaworkoutinanyclassbycommunicatingthroughtheRingmaster.TheJudgemakingtherequestmuststatethenumbersofthosehorseshewantscalledtotheworkoutandforhowmanyplacestheyaretobeworked.TheRingmasterrelatesthistotheotherJudgesoneatatime.Aworkoutrequiresagreementbytwoofthethree,orthepositionsmustbefilledwithoutaworkout.Ifaworkoutisagreedupon,theRingmastermustasktheotherJudgesiftheywishtoaddotherhorsestothosebeingsenttotherail.TheRingmastermustbesurethatallJudgesknowwhathorsesareworkingtofilltheplaces.Tobeincludedinapreliminaryclassworkout,anentrymustappearontwojudges'cards.Anentrythatdoesnotreceivetwovotesreturnstotherailandmaythenbeparkedinbyonejudge.Inachampionshipclass,ahorsethatappearsononlyonejudge'scardmustbeincludedintheworkout.TheRingmastermustinformtheAnnounceroftheworkoutrequest.Wheneverhorsesarebeingcalledforaworkout,theAnnouncermustcallfortheminnumericalorder.

c. TheRefereeshalltieallhorsesunderconsiderationforfinaljudgmentbutdoesnothavetowalkthelineup.
d. Inallworkouts,twoormoreofthethreejudgingofficialsmayagreetolimitthenumberofhorses;eachsuchofficialmayselectfortheworkoutandnoofficialmayselectmorethanthenumberagreedupon.
e. Inallworkoutsinwhichthemaximumnumberofhorsesallowedtobeselectedbyanyoneofficialislessthanthenumberofplacestobetied,theonlyhorseseligibleforsuchworkoutarethoseselectedbytwoormoreofsaidofficials.

f. Allhorsesinaworkoutshallbeplacedconsecutivelyinsofarasthenumberofplaceswillallow.
g. Whenpullinghorsesinfromtherailforadditionalworkouts,theCallJudge,theSecondJudgeandtheRefereeshallhaveequalauthority.
3. High-LowOlympicJudgingSystem.Fivejudgesworkingindependentlyofeachotherwillplaceeachclass.JudgenumberonewillbetheCallJudge.Pointswillbeassignedtotheplacingsonaonetotenbasiswithfirstplacereceivingtenpoints,secondplacereceivingninepoints,thirdplacingreceivingeightpoints,andsoforthondowntoonepointfortenthplace.Thehighestplacingandthelowestplacingareeliminatedforeachentry.Theremainingthreeplacingsaretotaledandtheentryreceivingthemostpointswinstheclass.Incaseofatie,thenallfiveplacingsareadded.Ifstilltied,thenthefirstorCallJudge'scardwillbreakthetie.Ifahorsereceivesfourorlessplacings,thetopscoreiseliminated.
4. Five-JudgeSystem.Fivejudgesworkingindependentlyofeachotherrankthehorsesonaonethroughtenbasis,assumingtenplacesareawarded.Thescoresofallfivejudgesareused.JudgesareassignedrankasCallJudge,SecondJudge,ThirdJudge,FourthJudge,andFifthJudge.Eachentrythatreceivesavotefromthejudgesisawardedapointassignmentonthebasisoftenpointsforfirstplace,ninepointsforsecondplace,eightpointsforthirdplace,etc.Theresultsofallfivejudgesaretotaledandtheentryreceivingthehighestscorewinstheclass.ProceduresforBreakingaTie:
a. Involvingfirstplace:Intheeventofatieforfirstplace,thereisanautomaticworkoutunlessaworkouthasalreadybeenheld.Ifthereisstillatieaftertheworkout,thenthenumberplacedhighestonanyofthejudges'cardsisthewinner.
b. Involvingsecondthroughtenthplaces,eitherofthefollowingproceduresmaybeusedtodetermineplacement:
Thejudge’scardsareplacedinorderofCallJudge,SecondJudge,ThirdJudge,FourthJudge,andFifthJudge.Thecardsarereadfromlefttoright,toptobottom.Theentrynumberinvolvedinthetiethatisplacedhighestonanyofthejudges'cardsisthewinner.Thismethodisusedregardlessofthenumberofentriesinvolvedinthetie.Intheeventofatwo-waytie,thehorsethatisplacedhighestonthemajorityofthefivejudges'cardsisthewinningentry.Ifthereisatwo-waytieandneithernumberisonthemajorityofthejudges'cards,thehorsethatisplacedthehighestonanyofthejudges'cardsisthewinner.Todeterminethis,thecardsareplacedinorderofCallJudge,SecondJudge,ThirdJudge,FourthJudgeandFifthJudge.StartingwiththeCallJudge'scard,theyarereadlefttoright,toptobottom.Theentrynumberinvolvedinthetiethatisplacedhighestonanyofthejudges'cardsisthewinner.

XI.VIOLATIONSANDPENALTIES
A. AFFECTEDINDIVIDUALS,FIRMS,CORPORATIONSORPARTNERSHIPSTheprovisionsoftheWHOARuleBookshallapplytoallowners,exhibitors,agents,trainers,managers,showorsaleofficials,showorsaleemployees,membersofthefamiliesoremployeesoftheabove,participatingeitherindividually,orasamemberofanentity,oranypersonwhoactsinamannerinviolationoftheRulesofWHOARuleBook,orisdeemedprejudicialtoitsbestinterest,andthereforesubjecttopenalty.
1. AnyactataWHOAaffiliated/sponsoredevent,saleorexhibitioninviolationoftheRulesbyamemberofthefamilyoremployeeofapersonparticipatingintheshow,saleorexhibitionwhoisdescribedintheprevioussentence,maybedeemedtohavebeencommittedbysuchpersonandsubjecthimtopenalty.
2. Anyperson,firm,corporationorpartnershiporanyotherentitygrantedanyright,privilege,authorization,orlicense,oracceptinganybenefitfromWHOAshallbedeemedtohavecontractuallyagreedtofullycooperatewithalldulyappointedcommittees,agentsandemployeesinenforcementofallRules,regulations,andordersofWHOA.
3. Anyperson,firm,corporation,partnership,orotherentitygrantedanyright,privilege,authorization,orlicense,oraccepting,receiving,orexercisingthesame,mayberequiredtogiveevidenceortestimonyinanyinvestigation,hearing,trial,orotherproceedingheldbydulyappointedrepresentativesofWHOAinconnectionwithinvestigationofpossibleviolationandenforcementoftheseRules.
4. AnyviolationsandpenaltiesshallapplyequallytoallWHOAaffiliated/sponsoredevents.
5. AnyviolationofWHOARulesthatdoesnotresultinacomplaintbeingfiledwithin12monthsofthedateofthecommissionoftheviolationshallforeverbebarredfromproceedingsbyWHOA.
B. VIOLATIONS
Aviolationisanyactcommittedatanaffiliated/sponsoredevent,prejudicialtothebestinterestofWHOA,includingbutnotlimitedto:• ViolationoftheRulesofWHOARuleBook• Disqualificationbyashow• Thefollowingspecificacts:
a. Providingfalseinformationofanynatureorkindtoanyshoworsaleofficial.
b. ActingorincitingorpermittinganyothertoactinamannercontrarytotheRulesofWHOA,orinamannerdeemedimproper,unethical,dishonest,unsportsmanlikeorintemperate,orprejudicialtothebestinterestofWHOA.

c. Committinganyactormakinganyremarkconsideredoffensiveand/orhavingbeenmadewithintenttoinfluenceorcastaspersionsonthejudging.
d. Failing,asaJudge,toperformdutiesatashowinaccordancewiththeRules.
e. Failing,asanexhibitororhisrepresentative,tosigntheentryblankofashowinwhichhecompetes.
f. Physicallyassaultinganyshow,saleorWHOAofficial.
g. InhumaneTreatment.Treatinganyhorseinaninhumanemanner.ThisprohibitionagainstinhumanetreatmentappliestoWHOAmembersandnonmembers.InhumanetreatmenttohorsesotherthanTennesseeWalkingHorsesandotheranimalsusedincompetitionisincludedinthisprohibitionasitindicatesageneralcourseofdealingwithhorsesthatisunacceptabletoWHOA.Forpurposesofthisrule,apersonresponsibleforthecareofahorseisalsoresponsibleforandmaybedisciplinedfortheinhumaneconductoftheirtrainers,agents,representativesandemployees.Forviolationofthisrule,anindividualmaybedisciplined,suspended,fined,deniedWHOAprivileges,disqualified,expelledfromshowgroundsand/orexpelledfromWHOA.Inhumanetreatmentofanyhorseoranyotheranimalonshowgroundsisstrictlyprohibited.Treatmentofanyhorsewillbeconsideredinhumaneifaperson,educatedorexperiencedinacceptedequinetrainingtechniques,wouldperceivetheconductofanindividualtobeinhumane.
h. FailingtoobeyanypenaltyimposedbyWHOA.
i. InfluencingorattemptingtoinfluencebyanymeansormanneranyJudgeindeterminingwhichhorseshallwininanyclassatanyaffiliated/sponsoredevent.
j. PressureShoeing.Shoeingahorse,ortrimmingahorse’shoofinamannerthatwillcausesuchhorsetosuffer,orcanreasonablybeexpectedtocausesuchhorsetosufferpainordistress,inflammation,orlamenesswhenwalking,trottingorotherwisemoving.
k. VerbalorphysicalabusedirectedtoanyonerepresentingWHOA,ShoworSaleManagement,Judges,DQP,DirectorofAnimalWelfare/DQPServiceCoordinators,USDA,EmployeesorDirectors,whilefunctioninginanyofficialcapacityat,orpertainingto,anyhorseshow,sale,orexhibition
l. Showingorattemptingtoexhibitahorsethatisonsuspension.Classwillbere-tied.
m. Misrepresentationofahorse’sidentity,name,height,age,eligibilityfortheclass,registeredorrecordedname,registrationnumber,ownerofrecord,orotherinformationonanyentryblank,orsubstitutionintheshowringofanyentryotherthantheonenamedfortheclassinquestion.Thisshallresultintheexhibitor’sforfeitureofanyribbon,trophy,cashprizeandotherawardwonbysuchmisrepresentedorsubstitutedanimal,andshallrendertheexhibitorliableforfurtherpenalty.Theclasswillbere-tied.

n. Voluntarilyremovingahorsefromtheringwithoutthepermissionofajudge,forwhichtheexhibitorandallanimalsunderhiscareandtrainingmaybedisqualifiedfromallfutureclassesatthatshowbyShowManagementandcausedtoforfeitallprizesandentryfeesfortheentireshow.
IMPORTANT:WHOAmayhonorallsuspensionswithallUSDAcertifiedHIO's.
C. PENALTIESAnypersonfoundguiltyofaviolationoftheWHOARulesmaybesubjecttothefollowing:
1. Expulsion:ExpulsionfromallWHOAAffiliated/SponsoredEventsand/orWHOAmembership.
2. Forfeiture:Forfeitureofawards,trophies,ribbonsandprizemoneywoninconnectionwiththeoffensecommitted.
3. Revocation:RevocationofaJudge’slicenseorTrainer’sprofessionalcard.
4. Fine:Fineofnotlessthan$25normorethan$5,000.
5. Probation:Probationforanyperiodoftimeuptoone(1)yearfromthedateofdecisionor,ifSuspensionislevied,fromthedatetheSuspensionisterminated.ProbationshallbeatimeduringwhichtheconductofthepersonisscrutinizedcarefullybyWHOAandshouldviolationbefiledagainstsaidpersonhe/sheisautomaticallysuspendedfromallrightsandprivilegesuntiltheHearing,withoutactionoftheHearingCommittee.
XII.PROTESTS,COMPLAINTS,VIOLATIONSANDHEARINGSWheneveranyperson,firmorcorporation,hereinaftercalledandreferredtoasthecomplainant,believesthathis,heroritsrightshavebeeninfringedupon,orthatanotherperson,firmorcorporation,hereinafterreferredtoastheaccused,hasviolatedtherulesandregulationsofWHOA,thefollowingproceduresshallbefollowed:
A. DEFINITIONSTermsshallhave,indescendingrankofpreference,suchmeaningasdefinedherein,suchmeaningasdefinedelsewhereinWHOARuleBook,asamendedfromtimetotime,suchmeaningasthecontextorusualandcustomaryusagewoulddictate,orsuchmeaningasestablishedbythemostrecenteditionofWebster’sDictionary.Exceptasmaybeclearlyindicatedtothecontrary,thefollowingtermsshallbedefinedasfollows:
1. “Complainant”shallmeantheindividualorentitythatinitiatesorcausestobeinitiatedaproceeding.
2. “Complaint”shallmeanthedocument,ticket,orwritingthefilingofwhichresultsintheinitiationofaproceeding.

3. “Ex-Parte”shallmeananythingwritten,saidordonebyorforonesideorpartyintheabsenceoftheothersideorparty.
4. “FileorFiling”,unlessthecontextclearlyindicatestothecontrary,shallmeanthedepositingofanydocument,writing,ticket,paper,letterorrequest,requiredorauthorizedbytheserulesofproceeding,inthemainofficeofWHOAasthesamemaybeestablishedfromtimetotime.
5. “Hearing”shallmeanthatportionoftheproceedingwhereinevidenceistakenbeforetheHearingCommittee.
6. “HearingCommittee”shallmeanthoseindividualsqualifiedandselectedtodecidetheissuesinahearing.
7. “HearingOfficer”shallmeananindividual,qualifiedtopracticelawinthejurisdictioninwhichthehearingistotakeplace,asittingJudgeorJusticeofanyCourtinthatjurisdiction,oraretiredJudgeorJusticepreviouslysittinginthatjurisdiction,employedbyWHOAsolelytopresideoverahearingbeforetheHearingCommitteeandtoruleonevidentiaryandproceduralquestions.
8. “WHOARuleBook”shallmeanthisRuleBook,asadoptedbyWHOAandasamendedfromtimetotime.
9. “ProbableCause”shallmeanacommonsensedeterminationofonlyafairprobabilityofanoccurrenceandisamuchlesserstandardthanthatnecessarytofindthataComplaintisfounded.
10. “Respondent”shallmeantheindividualagainstwhomaproceedingisinitiated.
11. “Rules”shallmeantheseRulesofSelection,Procedure,andEvidence.
12. “Staff”shallmeananyemployeeof,agentof,orcounselforWHOA,andanylawenforcementofficerorindividualconsultedbyWHOAortheHearingCommittee.
13. “Ticket”shallmeanthatdocumentdelineatingaviolationasdeterminedbyaDQP(DesignatedQualifiedPerson).
B. SHOWMANAGEMENTJURISDICTIONANDPROCEEDINGS
1. General.
ViolationsofrulespertainingtothefollowingmattersshallbesubjecttothejurisdictionofShowManagementashereinafterprovided.
Theexhibitingofanyhorseinaclasswhichsaidhorseorexhibitorisineligibletoparticipateorcompetein.Theexhibitingofanyhorsewhichisshodinamannerfoundtobeinviolationoftheserules.

ItismandatorythatanycomplaintorprotestregardingthemeasurementofahorsebeheardbytheWHOAExecutiveDirectororShowManagementatanaffiliatedorsponsoredevent.
2. ShowManagementComplaintProcedures.
a. Ifacomplainanthasreasontobelievethatanaccusedhasviolatedanyoftheforegoingrulesandwishesthatmatterinvestigated,heorshemustfileawrittenstatementwithShowManagementstatingthefollowing:
Thenameandnumberoftheexhibitorandhorse.Theclassinwhichthehorsewasexhibited.Therulethatthecomplainantbelieveswasviolated.Themannerinwhichtherulewasviolated.Thenameandaddressofthecomplainant.
b. ThecomplainantshallsubmithisorherwrittenstatementtoShowManagement,alongwiththeappropriatefeebeforethecompletionofthefinalclassoftheshow.Ifthecomplaintconcernsaninfractioninthelastclass,thecomplainantshallimmediatelynotifyShowManagementthatheorsheintendstofileacomplaintandheorsheshallhavethirty(30)minutesthereaftertosubmitsaidwrittenstatementthedayoftheshow.
c. ShowManagementshallthentakesuchstepsasitdeemsnecessarytomakeadeterminationofthematterandshallrenderadecisionasquicklyaspossible.
d. IfthedecisionofShowManagementisinthefavorofthecomplainant,thefeepaidshallbereturnedtothecomplainant.ShowManagementshallalsoordertheaccuseddisqualifiedandtoforfeitanyprizesormoneywhichtheaccusedmayhavereceived.Theclasswillberetied.Ifonlyonejudgewasusedintheclass,thenheorsheshallimmediatelytieonemoreexhibitorforlastplace.Ifmorethanonejudgewasusedintheclass,allscoresorselectionsbythejudgesfortheoffendinghorsearetakenoutandthejudges’cardsarerecalculatedtore-tietheclass.
e. IfeitherthecomplainantortheaccusedobjectstothedecisionofShowManagement,anappealmaybetakentothefullWHOA.
f. Aftermakingitsdecision,ShowManagementshallcauseawrittenreporttobefiledwithWHOA.ThereportshallcontainashortstatementoftheprocedurefollowedbyShowManagementinthehandlingofthematterandafindingoffacts,andthedecisionarrivedat.Saidreportshallbefiledwhetherornotanappealistaken.

g. IfthedecisionofShowManagementisappealed,WHOAshallhearthematteratitsnextregularlyscheduledmeeting,oratsomelatermeetingifitdeterminesthatmoretimeisneeded.WHOAshallhearthematteronthewrittenstatementandfindingsoffactsfiledbyShowManagementanddetermineifthedecisionarrivedatwasproper,basedonthefactsfoundbyShowManagement.IfthewrittenfindingsoffactssubmittedbyShowManagementareincompleteorunclear,WHOAmaycontinuethematterandaskShowManagementtosubmitadditionalfindingsoffacts.
h. AnyexhibitorwhofailstoreturnanyprizeormoneyorderedforfeitedbyShowManagementshallbedisqualifiedfromshowinguntilsaidorderisobeyed,unlessanappealistakentoWHOA.
3. DecisionsNotSubjecttoProtest.
a. Thesoundnessofahorseortoelength,whendeterminedbyanofficialveterinarianorDQPoftheshoworbyaJudge,isnotsubjecttoProtestduringthepresentshoworevent.
b. AJudge'sdecision,representinghisorherindividualpreference,isnotsubjecttoProtestunlessitisallegedtobeinviolationoftheRules.
c. AProtestwithrespecttotheheightofahorsemaybemadeonlytotheShowCommittee.Re-measurementshalltakeplaceimmediately,totheendthatthereshallbenochangeinheightbyre-shoeing.ThedecisionofShowOfficialsshallnotbereviewablebyWHOA.
C. WHOAHEARINGCOMMITTEEANDPROCEEDINGS
TheHearingCommitteeshallberesponsibleforconductinghearingsthatmaycomebeforeitinconnectionwithviolationsoftherulesandregulationsofWHOA.TheHearingCommitteeshallhavesuchotherdutiesandresponsibilitiesasmaybesetforthintheserules,andasprescribedbyWHOA.ViolationsofrulesorregulationsofWHOAnotexpresslydelegatedtoShowManagementshallbesubjecttothejurisdictionoftheHearingCommitteeashereinafterprovided.
1. InitiationofDisciplinaryProceedings.
a. Wheneveranyinterestedindividual,orentity,(the“Complainant”)shallbelievethataruleand/orregulationcontainedinWHOARuleBookhasbeenviolatedanddesirestoinitiateadisciplinaryproceeding,suchindividual,orentity,shallfileintheofficeofWHOAawrittenstatement(the“Complaint”)specificallysettingforththeallegation(s)ofviolation(s),andforeachallegedviolation,theRuleorportionthereofallegedtohavebeenviolatedandthemannerinwhichitwasviolated,including,ifavailable,dates,times,andplaces.

b. TheComplaintshallsetforththenameoftheallegedviolator(the“Respondent”)andtheaddress,ifknown,andthenameandaddressoftheComplainant.ItshallbesworntoandexecutedbeforeanindividualauthorizedintheComplainant’sjurisdictiontoadministeroaths.TheComplaintshallbeaccompaniedbyanon-refundableadministrativefeeestablishedbyWHOA.
c. TheExecutiveDirectorofWHOAandtheJudgesCommitteeshallinvestigatecomplaintsand/orviolationsrelatingtojudges,including,butnotlimitedto,theirconflicts,conduct,methods,ability,and/orintegrity.
Ifafterconcludingtheinvestigation,theDirectorfindsinsufficientevidencetosupportthecomplaintorviolation,theDirectorshallissueawrittenfindingandsonotifythecomplainingindividualorentity. Ifafterconcludingtheinvestigation,theDirectorfindssufficientevidencetobelievethecomplaintorviolationtobesubstantiated,theDirectorshallissueawrittenfindingandpenalty,ifany,inaccordancewithWHOARuleBook. Thewrittenfindingand/orpenaltyoftheDirectorshallbecomefinalunlesstheindividualorentityaggrievedbythedecisionappealstotheHearingCommittee.Inordertoperfectanappeal,theindividualorentitymustfilewiththeSecretary-Treasurerawrittenrequestforanappealhearingandposttheappropriatenon-refundableadministrativefee,withintwenty(20)daysofthewrittendecisionoftheDirector.IftheaggrievedpartyisWHOAoranagentthereof,thefeeshallbewaived.Uponcompliancewiththeforegoing,theDirector’sdecisionshallbestayeduntiltheHearingCommitteerulesonthematter.ComplaintsorviolationswithoutspecifiedpenaltiesinWHOARuleBookshallbesubjecttodeterminationbytheHearingCommitteewithoutanyadministrativefee.
d. WHOAExecutiveDirectorandtheHearingCommitteeshallreviewallcomplaintsand/orviolationsbroughttoorbyWHOAnotencompassedbythosetobeinvestigatedbytheDirectorofAnimalWelfare/DQPServicesorJudgesCommitteeandHorseShows.Ifafterconcludingtheinvestigation,WHOAExecutiveDirectorfindsinsufficientevidencetosupportthecomplaintorviolation,theDirectorshallissueawrittenfindingandsonotifythecomplainingindividualorentity.Ifafterconcludingtheinvestigation,WHOAExecutiveDirectorfindssufficientevidencetobelievethecomplaintorviolationtobesubstantiated,theDirectorshallissueawrittenfindingandpenalty,ifany,inaccordancewithWHOARuleBook.

UponreceiptofaComplaintmeetingtherequirementssetforthin(a)and(b)acomplaintoraviolationassetforthin(c),(d),theWHOAExecutiveDirectorshallschedulethetime,date,andplaceforahearing.Thedateshallnotbelessthanthirty(30)days,normorethansixty(60)daysfromthereceiptoftheComplaintorappeal.However,notwithstandingtheforegoing,ifWHOAExecutiveDirectordeterminestheComplaintorappealtobeofsuchseverityand/orsignificancetoWHOAorthehorseindustrythatitshouldbeheardexpeditiously,asoonerdatemaybeset,whichdateshallnotbelessthanfifteen(15)daysthereafterwithouttheconsentoftheComplainantandRespondent.

2. HearingCommitteeSelection.
WHOAshallestablishaHearingCommittee.TheHearingCommitteeshallbecomprisedofthree(3)individuals.ThisCommitteeshallbeselectedbyWHOAExecutiveDirectoronarandombasisfromamasterlistofindividualsqualifiedandexpressingawillingnesstoserveinresponsetoanopeninvitation,inaccordancewithadoptedrulesandprocedures,andmaychangefromonehearingtoanotheratthediscretionofWHOAExecutiveDirector.

TheHearingCommitteeshallmeetforthepurposeofhearingprotests,complaintsand/orviolationsbroughttoorbyWHOAinaccordancewithitswrittenpoliciesandprocedures.Thethree(3)membersoftheHearingCommitteeshallfunctioninaccordancewithawrittenpolicythatoutlinesitsdutiesandresponsibilities.
3. HearingProcedures.
a. Atalltimesofthehearing,theComplainantandtheRespondentshallhavetherighttorepresentthemselvesorberepresentedbycounseloftheirownchoosing.Bothshallhavetherighttobepresentduringthehearing,therighttoconfrontthosewitnessesagainstthosewhoarepresent,therighttocross-examinewitnessesagainstthosewhoarepresent,therighttopresentwitnesses,therighttopresentrelevantevidence,andtherighttotestifyintheirownbehalf.

4. Evidence.
a. Experttestimonymaybeadmittedandinconsideringtheweighttobegiventothetestimonyofanexpertwitness,theHearingCommitteeshallconsiderthebasisforhisopinionandthemannerbywhichheorshearrivedatitandtheunderlyingfactsanddatauponwhichheorsherelied.TheCommitteeshallnotconsidertheexperttestimonyasconclusive,butshallconsideritaspartoftheevidenceandgiveitsuchweightastheydeemappropriate.
m. IftheHearingCommitteebelievesthataparty,withoutexplanation,failedtocallanavailablewitnesswhohasknowledgeofnecessaryandmaterialfacts,theHearingCommitteemaypresumethatwitness’stestimonywouldhavebeenunfavorabletothepartywhofailedtocallthewitness.

TheHearingCommitteeshallbethejudgesoftheRules,thefacts,thecredibilityofthewitnesses,andtheweightoftheevidence.TheHearingCommitteemayconsidertheappearanceandmannerofthewitnesseswhiletestifying,theirintelligence,theiropportunityforknowingthetruthandforhavingobservedthemattersaboutwhichtheytestified,theirinterestintheoutcomeofthecase,theirbias,and,ifanyhavebeenshown,theirpriorinconsistentstatements,orwhethertheyhaveknowinglytestifieduntruthfullyastoanymaterialfactinthehearing.TheHearingCommitteeshallnotarbitrarilydisregardbelievabletestimonyofawitness.However,afterhavingconsideredalltheevidenceinthehearing,thentheCommitteemayacceptordiscardallorpartofthetestimonyofawitnessasitdeemsproper.
o. TheHearingCommitteeshallusetheircommonsenseinjudginganytestimony.Fromthesethingsandalltheothercircumstancesofthehearing,theHearingCommitteemaydeterminewhichwitnessesaremorebelievableandweightheirtestimonyaccordingly.
p. ItisnotnecessarythateachelementoftheComplaint,ticketorviolationbeprovedbydirectevidence,foranelementmayalsobeprovedbycircumstantialevidence.TheHearingCommitteemayfindaComplaint,ticketorviolationfoundedoncircumstantialevidencealone,oroncircumstantialevidencecombinedwithotherevidence,iftheHearingCommitteebelievesfromalltheevidencethattheComplaint,ticketorviolationisfounded.
q. TheburdenshallbeupontheComplainanttoprovetheComplaint,ticketorviolationbyapreponderanceofevidence,otherwiseknownasthegreaterweightofalltheevidence.ItisthatevidencewhichtheHearingCommitteefindsmorepersuasive.ThetestimonyofonewitnesswhomtheHearingCommitteebelievescanbethegreaterweightofevidence.
r. MembersoftheHearingCommitteeshallnotconsidertheopeningandclosingstatementsofcounselasevidence.Openingandclosingstatementsofcounselaremerelycounsel’sviewoftheevidenceandargumentastohowtheywanttheHearingCommitteetoviewandruleontheevidence.TheHearingCommitteeshouldonlyconsiderasevidencethesworntestimonyofwitnessesandanydocumentary,visual,orauditoryevidenceadmittedbytheHearingOfficer.
5. Penalties.UponfindingthataComplaint,ticketorviolationisfounded,theHearingCommitteeshalldeterminetheappropriatepenalty.TherangeofpenaltyshallbeassetforthinWHOARuleBook.Indeterminingtheappropriatepenalty,theHearingCommitteeshallconsiderthefollowing:
a. ThedegreeoftheRespondent’sculpability;
b. Thenumber,manner,andseverityoftheviolation(s);
c. TheRespondent’spriorrecordofviolations,ifany,incomparisontotheRespondent’stenure;and

d. Anymitigatingcircumstancesthatmaybepresentedatthehearing.
6. DefaultJudgments.Iftherespondentfailstoappearatahearingthatheorshehasrequested,theCommitteeshallenteradefaultjudgmentandassessappropriatepenaltiesforboththeunderlyingviolationandthecosttoWHOAoftherespondent’sunexcusedabsence.
7. Re-HearingsandAppeals.
a. Withinten(10)daysoftheHearingCommittee’sannouncementofitsfindingsinregardtoaComplaintorviolationtheComplainantortheRespondentmayfileawrittenrequestforare-hearingbasedonnewlydiscoveredevidencethatwasnotreasonablediscoverablepriortheretoandwhich,iffoundtobecrediblebytheHearingCommittee,wouldmateriallyaffecttheoutcomeofthehearing.
b. TheHearingOfficershallreviewtherequestwithinfive(5)daysofitsfilingandshalldeterminewhetherornottograntare-hearing.IftheHearingOfficergrantsare-hearing,theproceedingwillcommenceanewasiftheoriginalComplaint,ticketorviolationweresubmittedonthedateofthegrantofthere-hearing.IftheHearingOfficerdeniesthere-hearing,suchdenialshallbefinalandthependingoftherequestforare-hearingshallnottolltherunningofthetimeinwhichtoperfectanappeal.
c. AnypartyaggrievedbyadecisionoftheHearingCommitteemayappealtoWHOABoardofDirectorsbyfilingwiththeSecretary-Treasurerawrittenrequestforanappeal,postingtheappropriatenon-refundableadministrativefee,andfilingtwelve(12)copiesofthetranscriptfromthehearing,allwithintwenty(20)daysofthedecisionTheaggrievedpartywillberesponsibleforthecostofthetranscript.IftheaggrievedpartyisWHOAoragentthereof,orhorseshowmanagement,thenthefeeshallbewaivedandWHOAshallpaythecostsofthetranscript.Uponcomplyingwiththeforegoing,theHearingCommitteedecisionshallbestayeduntilWHOABoardofDirectorsreviewsthetranscript.TheBoardshallreviewthetranscriptwithinsixty(60)daysoftheproperfilingoftheappeal.WHOABoardofDirectorsmayreversetheHearingCommitteeuponthefindingbymorethaneighty-fivepercent(85%)oftheentireBoardthatthetranscriptlackssubstantialevidencetosupportthefindingoftheHearingCommittee.
d. WHOABoardwillnothearinterlocutoryappeals.
8. Confidentiality.

a. FromthemomentaComplaintisfiledinWHOAoffice,orinformationinregardtoapotentialRuleviolationisprovidedtostaff,allinformationinregardtotheComplaintorinformation,including,butnotlimitedto,thenamesoftheComplainantandtheRespondent,thenatureoftheallegedviolation,andtheevidenceandinformationdevelopedinrelationthereto,shallbeheldinstrictconfidencebystaff,exceptwhenpresentingevidenceatthehearing,ifany.
b. If,uponpresentationofaComplaint,orviolationandevidenceatahearing,theHearingCommitteeshallfindtheComplaint,orviolationtobeunfounded,theconfidentialityshallbeheldinviolate,exceptforthewrittennoticeofthatfindingasrequiredtobedirectedtotheComplainantandRespondent.If,uponpresentationofaComplaint,orviolationandevidenceatahearing,theHearingCommitteeshallfindtheComplaint,ticketorviolationtobefounded,theHearingCommitteeshallholdallinformationinregardtotheComplaint,orviolationinstrictconfidenceexceptthatthefindingandpunishment,ifany,shallbereleased.
c. NothingcontainedhereinshallprecludethestafffromdisseminatinganddiscussingtheComplaint,orviolationwithanylawenforcementofficer,attorneyconsultedbystafforanyindividualengagedoremployedbyanyoftheforegoing.However,suchinformationasdiscussedanddisseminatedshallbeheldinconfidencebythereceivingindividualincompliancewiththeseRules.
d. Thehearingshallbeopentothepublic,includingtheannouncementofthefindingandpenaltyasthecasemaybe.ThedeliberationsoftheHearingCommitteeshallbeinprivateandinconfidence,andsuchconfidentialityshallbeheldinviolate.
e. AnystaffmemberfoundbytheHearingCommitteetobeknowinglyandwillinglyinviolationoftheforegoing,uponthefilingofaComplaintandbytheprocedureassetforthintheseRulesshallbedismissed.AmemberoftheHearingCommitteefoundtobeknowinglyandwillinglyinviolationoftheforegoing,uponthefilingofaComplaintandbytheprocedureassetforthintheseRules,shallbeexcludedfromparticipatingontheHearingCommitteeatanytimeinthefuture.
9. Ex-ParteCommunication.
a. Noindividualshallhaveanyex-partecommunicationwithanymemberoftheHearingCommitteeinregardtoapendingComplaint,orviolationexceptasmaybenecessarybystaffinordertocomplywiththeseRules.
b. Astaffmemberfoundtobeknowinglyandwillinglyinviolationoftheforegoingrule,uponthefilingofaComplaintandbytheprocedureassetforthintheseRules,shallbeterminated.

c. Anynon-staffornon-memberindividualfoundtobeknowinglyandwillinglyinviolationoftheforegoing,uponthefilingofaComplaintandbytheprocedureassetforthintheseRules,shallbesuspendedfromparticipatinginanyWHOAaffiliatedhorseshow,exhibition,orsaleforaperiodofnotlessthantwo(2)yearsandnotmorethanten(10)years.
d. AnyindividualmemberoftheHearingCommitteefoundtohaveknowinglyandwillinglyparticipatedinanyex-partecommunication,uponthefilingofaComplaintandbyprocedureassetforthintheseRules,shallbeprecludedfromparticipatingontheHearingCommitteeatanytimeinthefuture.
Unlessthecontextclearlyindicatestothecontrary,theuseofonegendershallincludeallgendersandtheuseofthesingularshallincludetheplural(andviceversa).
XIII.SHOWMANAGEMENT,OFFICIALSANDEMPLOYEES
Thesponsoringorganizationofashow,saleorexhibitionorthegoverningbodyincharge,shallberesponsiblefortheoperationoftheshow,saleorexhibition.Thesponsoringorganization/governingbodywillberesponsiblefortheappointmentofashowmanagerwhowillberesponsiblefortherunningoftheshow,saleorexhibitionwhomustalsobeavailableatalltimesduringtheshow,saleorexhibitiontoactinexecutivecapacity.
A. DUTIESOFSHOW,SALEOREXHIBITIONMANAGEMENT
Itshallbethedutyoftheshow,saleorexhibitionmanagementtoenforcealltheRulesofWHOAfromthetimeentriesareadmittedtotheshowgroundsuntiltheirdeparture.Inparticular,itshallbetheirduty:
1. TouseaDQPassignedbyWHOAHIOoranyotherUSDAcertifiedHIO.
2. ToseethathorsesrequiredtobemeasuredshallbecorrectlymeasuredaccordingtotheRules.
3. Toorderthemeasurementofanyhorsewhoseheightisprotestedbyanexhibitor.Suchmeasurementshalltakeplaceimmediately,totheendthattherebenochangebyre-shoeing.ThedecisionofShowManagementmaybereviewablebyWHOA.IftheDQPfeelsthataninjusticeisdoneatashow,heorsheshallreportthesametoWHOA.
4. Toeliminate,withoutwaitingforaprotesttobemade,anyentrythatisknowntobeineligible.

5. ToreceiveandactuponProtestsinaccordancewiththeRules,andtoreportwhateveractionistakentoWHOA.IntheeventthatapersonparticipatingatashowshallcommitanoffenseorviolationdescribedintheRules,ShowManagementmay,athisorherdiscretion,disqualifythatpersonfromfurtherparticipationintheirshowonly.AnysuchoffenseshallbereportedtoWHOAforwhateverfurtheractionisdeemednecessary.
6. Topaypremiumsandotherindebtednessoftheshow.
7. Toobtain,ifnecessary,theGuestcardsforJudges.
8. Toprovideatelephoneatshowswherehorsesarestabledovernight.
9. ToemployaJudgecurrentlylicensedbyWHOAandsendnotificationofthistoWHOA.ItisrecommendedthatthecontractsuppliedbyWHOAisusedandacopybesenttoWHOAuponitsexecution.
10. Toprovideallnecessaryphysicalfacilitiestoaccommodatetheshow,saleorexhibitionincludinganareasetasidefortheinspectionofhorsesbyDQP'sandapreshowwarmuparea.Also,managementmustprovidethenecessarypersonnelfortheDQPtocarryouthisorherduties.
11. ToacceptresponsibilitytoinsurethatallRules,regulationsandproceduresstatedinthisRuleBookarefollowed.
12. ToabidebyalldecisionsmadebyaJudgeorDQP,andinnowayattempttoinfluenceaJudge’s,orDQP’s,decisionorhisorherprocedure.
13. AllsubstancesareprohibitedonthepasternareaofanyFlatShodhorsebeingshownorexhibitedatanyWHOAevent.
14. TocooperateinwhateverwayrequestedwithWHOAorUSDA.
15. TofulfilltheobligationsofanyWHOAeventassetforthinthisRuleBook.
16. Totakereasonablestepstoinsurethatallentriesinclasseswheremeasurementsarerequiredareincompliancewiththerules.Itismandatorythatshowofficialsresolveanyprotestregardingmeasurements.
17. TotakestepstoinsurethepersonalsafetyofallofficialsrepresentingWHOA.
18. Tokeepexhibitorsandtrainersinformedofallchangesintheprintedprogram.
19. ToinsurethatnomanagerorDQPservesasaJudgeorDQPathisorherownshow.
20. ToinsurethatnoShowManager,DQP,Judge,Announcerorcompetesinashowatwhichtheyareparticipatinginanofficialcapacity,norshallanyhorseownedbyanyoftheabovebeshownatsuchshow.Exception:AnAnnouncerorRingmastermayshowpriortoworkinginanofficialcapacityasAnnouncerorRingmaster.
21. Todisqualifyanyexhibitorandhisorherentriesifthereisjustcauseandtorulethatheorsheforfeitwinningsandribbonsatthatshow,and,ifnecessary,tohavethehorsesofsuchexhibitorremovedfromthegroundswithoutbeingheldliablefordamage.AllsuchactionsmustbereportedtoWHOA.

22. Torecommendthatjudgescards,orcopiesthereof,bepostedinaconspicuousplaceduringtheshow,atmulti-dayshow.
B. DUTIESOFSHOWSECRETARY
1. TheSecretaryshallapplyannuallytoWHOAforaffiliation.WHOAmaywithholdaffiliationofashowifsaidshowhasindebtednesstoWHOA.
2. TheSecretarymustfurnishacopyoftheprizelisttoWHOAimmediatelyuponpublication.(ItissuggestedthatextracopiesbeforwardedtoWHOAduetothemanyinquiriesreceivedforcopiesofprizelists.)
3. TheSecretaryshouldfurnishtheDQPwiththefollowing:
a. Classsheetsoneachclassthatistobeinspected.
b. Copyofprizelistand/orProgram.
4. TheSecretaryofeachaffiliatedshowshallhaveacopyofthecurrentWHOARuleBookavailableforreferenceatalltimesduringtheshow.
5. TheSecretaryshallreportinwritingtoWHOAanyactonthepartofanypersondeemedprejudicialtothebestinterestsofWHOA.Matterstobesoreportedincluderemovalbyanexhibitorofhishorsesfromtheshowgrounds,orwithdrawalfromtheshowafterithascommenced,withoutpermission.
6. TheSecretaryshallfurnishtheJudgeineachclassacardcorrespondingexactlywiththespecificationsasshowninthePrizeList,oramendedifinconflictwiththeRuleBook.
7. TheSecretaryshallprovideanumbercardforeachentry,whichshallbewornontheexhibitor’sback;clearlyvisibletothejudgeatalltimeswhenincompetition.
8. TheSecretaryshallberesponsibleforallmattersinconnectionwithentries.

10. TheSecretarymustforwardtoWHOAclassentrysheetsandanyotherrequiredformspostmarkedwithinfifteen(15)daysaftertheshow,indicatingthewinners,postorotheraddedentries,scratchesandcorrectionsinallclasses.Classentrysheetsmustbesignedbyexhibitor,traineroragentandmustincludecompletenamesandaddressesofowners,trainers,andexhibitorsonallentries.WHOAmembership,Amateur/YouthCardandorTrainer’sLicensenumbermustbeincludedontheentryform.Horseregistrationnumbermustbeincludedontheentryformunlessthehorseisacountrypleasureentry.TheSecretarymustsendinalistofJudges,DQP'sandShowOfficialsofficiatingattheshow.
