WOMENS COURT OF PUBLIC OPINON FOR THE STATE OF NEW MEXICO

    Nos. 99-1

    NEW MEXICO WOMEN, PETITIONER

    V.

    MATT CHANDLER ET AL.

    ON WRITS OF CERTIORARI

    [November 7, 2011]

CHIEF JUSTICE MARY A FEMALE NEW MEXICAN delivered the opinion of the court.

In the matter of, 9th Judicial District Attorney Matt Chandler eavesdropping on a private

telephone conversation of New Mexico Supreme Court Chief Justice Charles Daniels. The

question being did District Attorney Matt Chandler purposefully eavesdrop on the Chief Justice

of the New Mexico Supreme in order to advance his own personal desire of judge shopping in

direct violation of state legal ethics? The remedy for politically motivated behavior of this nature

is public condemnation from the woman of the State of New Mexico, and future political

contributions of considerable amounts to any opposing district attorney candidates during the

next regular election for the position held by Mr. Chandler.

    I

It has come to our attention through comprehensive local media coverage, that Ninth Judicial

District Attorney Matt Chandler did knowingly eavesdrop on the chief justice of the state

Supreme Court in what should be a direct violation of legal ethics in this state. We find this

behavior highly inappropriate and disrespectful of Mr. Chandler. Members of the legal

profession and officers of the court should at all time express the highest respect toward justices

and judges in a public setting. If by accident Mr. Chandler happened to overhear what a justice

was saying during a telephone conversation in a public sitting, he should have immediately

stopped the justice from any further speech and informed him that others could overhear the

    conversation.

    II

Should Mr. Chandler have the right to use information overhead in a court case? It is clear if he

took the time to read the ethics rules of the state bar association that any inadvertent information

acquired by an attorney is not to be used in a pending court case. The fact the Mr. Chandler has

attempted to use information in court paper where correct or incorrect is only too clear an ethics

violation. It is further proof that Mr. Chandler did act in an unprofessional manner, which

reflexes poorly on the states district attorneys and the states legal system as a whole.

    III

The state has productswritten documentationthat Mr. Chandler intent with this behavior was

directly linked to political motivations. The women of New Mexico have a direct concern when

it appears that Mr. Chandlers behavior was directly motivated by political desires. Since the

governor, appointed Mr. Chandler this behavior clearly reflexes badly on her office as well.

    IV

It is therefore the ruling of this court that the Ninth Judicial District Attorney Matt Chandler did

knowingly violate ethical standards for an officer of the court. It is of the upmost important to all

women in New Mexico that all officers of the court appear unbiased and show professional

respect for our states judicial employees no matter what the level. The court therefore condemns

Mr. Chandlers behavior and strongly suggests that the Women of New Mexico open their

purses. The Women of New Mexico should strongly support all candidates who wish to

challenge Mr. Chandler for his position in future elections. The Women of New Mexico should

also strongly consider contacting the governors office in order of personally expressing

    displeases with Mr. Chandlers behavior.

Let it be known that the Women Court of Public Opinion for the State of New Mexico welcomes

any and all either concurring or dissenting opinions on this very serious issue of professional

ethics of our officers of the court from the Women of New Mexico.
