INTRODUCTION
ABOUT THIS PUBLICATION
The Department of the Legislative Council has compiled these statistics on the operation of the Legislative Council for the information of Members and the public. This publication is for the calendar year 2017. The sitting period during 2017 was from 11 May to 7 December.
This report augments the statistics provided in the Annual Report of the Department of the Legislative Council.1 The statistical information in this report is based on the calendar year rather than the financial year information contained in the annual report.
FOCUS ON RESULTS
The Department’s mission is to pursue excellence in supporting the Legislative Council. The Department achieves this by providing professional, advisory and administrative support to the Members and officers of the Council. The Department’s purpose in gathering and publishing statistics is to assist it to provide better and more relevant services to Members and the public.

WORK OF THE LEGISLATIVE COUNCIL CHAMBER
This chapter provides data and analysis on the work of the Legislative Council Chamber during 2017, as well as year to year (historical) comparisons. The effect of the different procedural regimes on the work of the House is considered, focussing on the impact on Government business.
More detailed information and data on these matters and other functions of the House is provided in Appendix 1 (Chamber Publications), Appendix 2 (Procedures in the House) and Appendix 3 (Bills and Amendments).
Table 1 provides summary information on the procedural regimes applying since 2013 and the outcomes in terms of sitting times and time devoted to Government business.

BILLS CONSIDERED AND PASSED BY THE COUNCIL
In 2017 the Council passed 22 bills. Of these, the Council amended 4. Figures 5 and 6 (previous page) do not take into account the different total sitting hours from year to year.
Bills Proceeding to Third Reading by leave
An indicator of the complexity and contentiousness of bills is the number that avoid scrutiny in detail of the committee stage of consideration. In 2017, leave was granted on 9 occasions to dispense with the Committee of the Whole House stage and to proceed to the Third Reading of a bill. The bills were the:

WORK OF THE LEGISLATIVE COUNCIL COMMITTEES
The Legislative Council Committee Office
The Legislative Council Committee Office (Committee Office) provides advice and support to Legislative Council committees in order to enable them to produce high quality and informative reports that are presented to the Parliament. This is achieved by a team of professional staff who provide research, administration and executive services to committees. The statistical overview provides some insight into the range and nature of the work of this office.
Committee operations
In 2017, the Committee Office supported and administered five standing committees, two joint standing committees and one select committee. The Select Committee into Elder Abuse was established by the Legislative Council on 13 September 2017. The Procedure and Privileges Committee is a standing committee not administered by the Committee Office.
Each committee has different roles and functions. The Legislation Committee and the Uniform and Statues Review Committee routinely scrutinise bills referred to them by the Legislative Council. The Delegated Legislation Committee considers disallowable subsidiary legislation including regulations, local laws, by-laws and some orders. The Delegated Legislation Committee has the power to recommend that the Legislative Council disallow any piece of subsidiary legislation that is before it.
The remaining standing committees deal with issues relating to the administration of the State and matters of public interest. The Environment and Public Affairs Committee considers all petitions presented to the Legislative Council and has powers to initiate inquiries related to broader environmental issues. The Public Administration Committee has powers to examine most aspects of public administration, including to consult regularly with statutory office holders. The Estimates and Financial Operations Committee focuses on how public money is allocated and used. Over time this function has extended to include not only scrutiny of the Annual State Budget but also scrutiny of agencies annual reports.
The Select Committee into Elder Abuse commenced its inquiries into the causes and risk factors behind elder abuse and the way that community and government agencies can best address the damaging effects of elder abuse on older people in Western Australia.

Reports This year was the first year of the 40th Parliament. Despite being early in the Parliamentary cycle committees of the Legislative Council tabled 20 reports in 2017.
The Legislation Committee tabled one report that analysed the Sentence Administration Amendment Bill 2017. The Uniform and Statutes Review Committee tabled seven reports, five of which reported on uniform legislation. The other two reports announced terms of reference for inquiries into the form and content of the Statute Book and the Committee’s treaty function. The Delegated Legislation Committee tabled six reports in total. Four of their reports successfully recommended five pieces of subsidiary legislation be disallowed by the Legislative Council. The remaining two reports provided information to the Parliament on:
the procedures for dealing with consequential amendments to delegated legislation following enactment of primary legislation
the Committee’s observations arising from their review of the City of Joondalup Local Government and Public Property Amendment Local Law 2015.
The Environment and Public Affairs Committee tabled one report to announce the terms of reference for their inquiry into mechanisms for compensation for economic loss to farmers in Western Australia caused by contamination by genetically modified material. The Public Administration Committee tabled one report to announce the terms of reference for their inquiry into the functions of WorkSafe WA in relation to the Occupational Health and Safety Act 1984 and other associated matters. The Estimates and Financial Operations Committee tabled two reports announcing their Annual Budget Estimates hearings and Annual Report hearings.
The Procedure and Privileges Committee tabled two reports, one successfully recommended that an Acknowledgement of Country be adopted by the Legislative Council.
Travel/Training On occasions Committees undertake investigative travel to collect evidence during an inquiry. This may include hosting hearings in regional Western Australia, inspecting locations and sites, or where particular expertise or experience exists in other locations. Committees may also travel for the purposes of attending conference and forums to inform themselves.
The Elder Abuse Committee attended an Elder Law Forum run by the Law Society of Western Australia, aimed at addressing elder abuse in the community.
The Estimates and Financial Operations Committee engaged the Institute of Public Administration Australia to provide them with training on finance, budgeting and analysis of financial statements in the Public Sector.
The Chair and Deputy Chair of the Environment and Public Affairs Committee accepted an invitation to attend a Commonwealth Parliamentary Association Hot Topic Seminar on the role of Parliaments and Parliamentarians in deliberating climate change.
